President’s Message Dan Klein, Sr., HBAL President Tribute to Youth and to Each Our Part For those of you who attended the General Membership Meeting on April 16, you probably wish you could hear it again or hear more. What a GREAT evening for outstanding, creative students to hear a message of congratulations and to experience a message from Anders and Jake Lewendal on how we as Americans can each help to make the economic recovery happen here and beyond. Students with an excellence in Interior Design or CAD Design of a home were honored for their very good and creative work. Congratulations again students! We too are all students in our craft whether our specialty is in architecture or banking, cabinetry or demolition, electrical or furnaces, grading or hustling ….. retirement or subbing, trimming or upgrading, visitor or worker, xylotomist or yogi or zincographer. We can all help in this recovery and remaking America great. Anders and Jake reminded us that how we purchase items. From our groceries or hardware, replacing an appliance or a vehicle; buying products which were grown, made or manufactured in the USA will make a major impact not only locally but nationally. All of us doing a little combines into a BIG improvement for us all. Anders and Jake proved you can build an ALL American Home, even though he had to go out of his way to get the bolts needed from Caterpillar Corp to keep it 100% American. You can find their growing list of suppliers at www.theallamericanhome.com along with their challenge to companies and individuals to increase their purchasing by just 5%. I encourage you to post this list in your business and home which will aid us in learning to buy more American products. Did you see the fabulous remodeling in the Tour of Remodeled Homes on April 21-22? Our remodelers and trades people do a fine job here in Lincoln and the surrounding areas. Our community is truly blessed to be able to tap into our industry which has such skill and creativity. Read the label, thank a student and keep learning. Remember to participate in the primary election and vote on May 15. The HBAL golf tournament is June 1 at the Highlands Golf Course. Even if you don’t golf, it’s a great opportunity to volunteer and spend the day with members.

Nebraska Energy Code REScheck/COMcheck Training Workshops The Nebraska Energy Office announces six no-cost training opportunities scheduled for May 1-10, 2012. These workshops will focus on the use of the REScheck and COMcheck evaluation tools to demonstrate compliance with the Nebraska Energy Code which is the 2009 International Energy Conservation Code. This opportunity is being made available as part of the Nebraska Energy Office’s continuing effort to assist local code officials, builders, architects, engineers and others in the implementation of the Code. REScheck Training These sessions will focus on the use of the REScheck software that simplifies energy code compliance by automating the trade-off calculations allowed in the 2009 International Energy Conservation Code. Participants will learn the proper approach to using the REScheck tool for evaluating the cost effectiveness of alternative energy product options and demonstrating home design compliance to local code officials. Member News In Sympathy

Our sympathy to Mike and Vicki Goings (Goings Homes, Inc.) on the death of Mike’s father, Dean Goings. He passed away on March 23. Our sympathy to Sue and Jim Crawford (Precast Products & Landscape Village) and Shelly Simonson (Lincoln Federal Savings Bank) on the death of Sue’s mother and Shelly’s grandmother, Dolores Foreman. She passed away on March 25. Our sympathy to the family of Jerry Johnson. Jerry was President of HBAL in 1986 and passed away on March 27. Jerry thought very highly of HBAL and even at this last fall’s Past President’ Dinner, he was sharing memories from the early years of HBAL, the Home & Garden Show, our current office when it was finished and other events. He will be missed greatly.

Nadine Condello / Lincoln Home Builders Care Foundation Scholarship In the future, the funds donated by the Lincoln Home Builders Care Foundation to the SCC-Milford NAHB Student Chapter designated for student scholarships will be known as the Nadine Condello Scholarships. In the 24 years Nadine served as Executive Officer of HBAL, the SCC Student Chapter has received over $55,200 to award 249 scholarships to our students. These funds are used for tuition reimbursement and attendance at the International Builders Show. In recent years, we have been able to receive National Housing Endowment IBS matching funds because of the donations from HBAL. We feel very privileged to have had a strong relationship with the Home Builders Association of Lincoln over the years and hope to continue with this bond. Critical Water Bill to Prevent EPA Overreach | EPA Can’t Revoke Clean Water Act Permit

Senator Introduces Critical Water Bill to Prevent EPA Overreach With strong NAHB backing, Sen. John Barrasso (R-Wyo.) and 29 Senate cosponsors from across the country this week introduced S. 2245, The Preserve Waters of the United States Act. This muchneeded bill aims to prevent the Environmental Protection Agency and U.S. Army Corps of Engineers from using a draft guidance to dramatically expand the scope of the Clean Water Act (CWA). The guidance in question would significantly broaden the definition of federal waters of the United States under the CWA. It would allow the EPA to go from regulating oceans and rivers to having jurisdiction over even the smallest bodies of water, including mudflats, prairie potholes and roadside ditches, as well as all wet areas that connect in any way to navigable waters. This proposal was first issued in May 2011 and sent in final form to the Office of Management and Budget last month. By issuing a guidance document as opposed to going through the more transparent rule-making process, EPA and the Army Corps are bypassing the necessary public outreach required under the Administrative Procedures Act and failing to fully consider the legal, economic and unforeseen consequences of their actions. This blatant regulatory overreach would lead to many more land development, road construction and residential projects requiring federal permits and would exacerbate permitting delays while increasing construction costs and hurting job creation, housing affordability and economic growth. With this in mind, NAHB strongly commends Sen. Barrasso for introducing this bill, and we are actively helping to build support for the legislation in Congress. NAHB members are urgently encouraged to help with this endeavor by calling your Senators and asking them to please cosponsor and support S. 2245. Court Rules EPA Can’t Revoke Clean Water Act Permit In a case with significant ramifications for NAHB members, a federal court has ruled that the Environmental Protection Agency has no authority under the Clean Water Act to veto a dredge-and-fill permit after the U.S. Army Corps of Engineers has issued it. The case, Mingo Logan Coal Co. v. EPA, was the first instance in which EPA had attempted a retroactive veto of a previously issued Section 404 permit, which is the same type of permit that home builders/developers obtain to fill wetlands. These permits take significant time and resources to obtain, are generally good for five years, and require the permittee to mitigate any environmental damage that is caused. So when the EPA “withdrew” the permit even though the permittee was in full compliance, the economic hit was significant. Another reason for concern was that, if the EPA could revoke this kind of permit for no reason, the lack of certainty about whether a project could be completed would dramatically impact the permittee’s ability to secure financing. EPA claimed that Section 404(c) of the Clean Water Act gave the agency authority to invalidate a Section 404 permit whenever EPA concludes it should do so to protect water quality under the Act. Recognizing the potential for this unprecedented action to dramatically increase permitting costs, project delays and uncertainties, NAHB joined with ten other trade associations to file an amicus brief supporting Mingo Logan. Our brief, which included a technical report detailing the potential economic impacts resulting from EPA’s retroactive revocation of Section 404 permits, was successfully docketed with the Court despite EPA’s attempts to exclude “friends of the court” from participating in the case or providing extra record materials. NAHB’s efforts were rewarded when the U.S. District Court for the District of Columbia issued a summary judgment blocking EPA’s action on March 23. Habitat for Humanity Builds Futures and Birdhouses!

Habitat for Humanity Builds Futures And Birdhouses! The Spring Parade of Homes will provide another opportunity for the public to view Habitat for Humanity’s Creature Comforts project. The project consists of various birdhouses built by Habitat’s construction volunteers. The birdhouses were then decorated and signed by individuals and groups of local volunteers, a handful of local celebrities and several community leaders. Habitat for Humanity felt this would be an easy opportunity for them to unleash their creativity for a great cause. The birdhouses were all made of recycled or leftover wood materials and were ready for paint application and any other embellishments the volunteers wished to add. These decorative, signed birdhouses are now being used throughout the year to bring awareness to the Creature Comforts we all deserve.

They will continue to migrate around the city for a few more months--landing and being displayed in several different venues--then they’ll be sold via silent auction at an event Habitat for Humanity is planning for later in the year.

HBAL Business Update

HBAL Business Update From the Board of Directors The HBAL Board of Directors met April 12, 2012 for their regular monthly meeting. Updates from many of our Councils and Committees were given, but noted here is information shared by Greg Schwinn regarding the NSHBA. The NAHB petition has been sent and acknowledged with a conference call for discussion and better understanding. The HBAL and the MOBA have proposed a revised set of Bylaws to the NSHBA in an attempt to continue to work with all local HBA’s in Nebraska. The primary focus of these Bylaws is to have equal representation of the NSHBA membership and an efficient and streamlined Board of Directors. Senator Mike Johann’s office invited Mike Benker to attend a round table discussion regarding President Obama’s Health Care Program. This meeting was held in Omaha on March 30 with attendees from two other HBAL member companies as well. Senator Johanns expressed concerns and needs for Health Care reform, but felt strongly the current program under review by the U.S. Supreme Court was not the solution. Dan Klein, Sr., Greg Shinaut and Mike Benker met with Mayor Beutler on April 12 prior to the Board of Directors meeting to request clarification of where the information collected by the various “sustainability and green team” task forces and committees was going. Although the importance of growing Lincoln in a sustainable manner is important to all its citizens, the concern may lie in the path or process we take to maintain

Tour of Remodeled Homes What a beautiful weekend for the 23rd Annual Tour of Remodeled Homes sponsored by the Remodelers Council of Lincoln. There were 18 entries open for the public to view Saturday and Sunday, April 21-22. If you haven’t attended this event in the past, it may be something to watch for next year in mid-April. The reports from entrants mentioned high traffic, attendees interested in projects and overall excitement for the event. What better way to show off your craftsmanship than to have hundreds of prospective clients come to visit you during the Tour of Remodeled Homes.

Spring Parade of Homes – May 13-20 With the Spring Parade of Homes right around the corner, it’s a great time to look at not only the design trends taking place in new housing, but demographics as well.

Who Lives in New Housing?

April was New Homes Month, so we thought we would take a look at the demographic data from the most recent edition of the American Housing Survey (AHS) to see who lives in newly constructed homes. The AHS defines new construction as housing units no more than four years of age. Typically, larger households are relatively more likely to live in new homes. This finding complements previous NAHB analysis that examined home size and geography.

The Household Size graph on the opposite page reports the percentages of various types of housing (owner-occupied, renter-occupied and newly constructed, both owner and rental) with respect to the number of people who reside in each. For example, the first black bar shows that about 22% of owneroccupied homes contain one person, while the second black bar notes that 36% of owner-occupied homes contain two people. It is clear that renters are most likely to be one person households. Similarly, two-person households are the most common type for homeowners. The two-person household is also the most common form for new construction, with 33% of newly constructed homes holding two-person households.

On a relative basis, a greater share of new construction houses three persons or more compared to homes of homeowners or renters. This can be seen by noting that the green bars in the Household Size chart are higher than the black and white bars for households with 3 or more people. In fact, 47% of all new construction houses three or more people. Why? The short answer is that new construction is more likely to house children than other types of housing on a unit-by-unit basis. As can be seen on the Number of Children graph, new construction has the largest shares of homes for all counts of children. Specifically, 44% of newly constructed units house children. Only 35% of rental units and 34% of owner-occupied

Senator Johanns on Board with Bill Aimed at Curbing EPA Overreach Previously, we told you about a newly introduced bill in the U.S. Senate that is of crucial significance to NAHB members, and asked for your help in building support for this legislation in Congress. S. 2245, the Preserve Waters of the United States Act, was introduced by Sen. John Barrasso (R-Wyo.) and 29 Senate cosponsors with strong NAHB backing. The legislation aims to prevent the Environmental Protection Agency and U.S. Army Corps of Engineers from using a draft guidance to dramatically expand the scope of the Clean Water Act (CWA) by broadening the definition of federal waters of the United States to include even the smallest bodies of water, including mudflats, prairie potholes and roadside ditches, as well as all wet areas that connect in any way to navigable waters. By issuing a guidance document as opposed to going through the more transparent rule-making process, EPA and the Army Corps are bypassing the necessary public outreach required under the Administrative Procedures Act and failing to fully consider the legal, economic and unforeseen consequences of their actions. This blatant regulatory overreach would lead to many more land development, road construction and residential projects requiring federal permits and would exacerbate permitting delays while increasing construction costs and hurting job creation, housing affordability and economic growth. As a result, NAHB is leading the charge to find additional cosponsors for Sen. Barrasso’s bill and to expand support for that legislation in both the House and Senate.

Overall, 78% of heads of households who live in new construction are aged 54 or younger, compared to 56% for all owner-occupied housing. However, these statistics may change in the coming years as more 50+ new housing construction gains strength. Green Plumbing and Mechanical Codes | Feather Signs

Lincoln, Neb., Adopts IAPMO Green Plumbing and Mechanical Code Supplement Lincoln, Neb. (March 29, 2012) – The city of Lincoln, Neb., has formally adopted the 2010 IAPMO Green Plumbing and Mechanical Code Supplement (GPMCS), enhancing the Nebraska capital’s protection under the Uniform Plumbing Code® (UPC) with additional provisions toward increased water conservation and energy efficiency. The Lincoln City Council voted 7-0 to amend the UPC by adopting the GPMCS as reference material. “The Green Plumbing and Mechanical Supplement is a vital document to provide guidance for sustainability, not only locally and nationally, but worldwide,” said Lincoln Chief Plumbing Inspector Bob Siemsen. The IAPMO GPMCS serves as a complement to any adopted plumbing and mechanical code, smoothly bridging the previously troublesome gap between existing codes and established green building programs. Where code language and green building concepts lack cohesion, the GPMCS creates harmony by addressing such areas as alternate water sources, high‐efficiency plumbing products, conservation of hot water and training/education. The GPMCS was developed as a tool to be used as an overlay to any plumbing code. It provides code officials with comprehensive and progressive enforceable green code provisions that help eliminate base line code barriers and provide the critical information needed to assure that the sustainable construction practices being incentivized by green rating programs such as USGBC’s LEED and Green Building Initiative’s Green Globes are safe and reliable. With the addition of the GPMCS, Lincoln’s plumbing code will

contain energy and water conservation measures, efficient hot water system design criteria and provisions addressing the safe design, installation and maintenance of alternate water source systems, including harvested rainwater, gray water and reclaimed water for commercial and residential buildings. In December 2011, IAPMO’s Green Technical Committee (GTC) completed its work on an updated second edition of the GPMCS that will be released soon. New or revised provisions will include: •

Reduces the maximum flush volume for non‐residential from 1.6 gpf to 1.28 gpf.

Reduces the maximum flow rate for kitchen faucets from 2.2 gpm to 1.8 gpm and for pre‐rinse spray valves from 1.6 gpm to 1.3 gpm

Limits the use of hot water recirculation pumps to a building’s hours of operation to prevent energy waste

Minimum water quality standards added for non-potable and potable rainwater catchment systems

Expands and clarifies provisions allowing gray water, black water, rainwater, storm water, dry weather runoff, swimming pool backwash, condensate, cooling tower blow down, foundation drainage, and commercial kitchen appliance water discharge to be captured, treated and reused for toilet and urinal flushing, irrigation and other approved uses

Does Your Business Use Feather Signs? As you may have noticed, “Feather Signs” are fluttering in Lincoln’s wind in increasing numbers. These signs primarily are used on a temporary basis to draw attention to a business. They often are purchased over the Internet and can be customized for the specific business purpose. As you may not know, these signs are illegal in the City of Lincoln. About a year ago, the City notified licensed local sign companies of this fact; they agreed not to sell this type of sign. Obviously, however, this does not prevent those who wish to display the signs from purchasing them over the Internet. LMC §27.69.030 sets forth a number of requirements for signs generally in the City of Lincoln. Two of the provisions that apply to feather signs are as follows: (a) (4) Every sign shall be permanently attached to the ground, or to a building or structure which is permanently attached to the ground, except for mobile signs and temporary signs as provided in this chapter and in Title 22 of the Lincoln Municipal Code. (a) (10) No sign shall move, rotate, revolve, or simulate animation by means of spinning, fluttering, or reflective devices or lighting, except a sign may rotate or revolve at a rate not to exceed six revolutions per minute. Building and Safety inspectors have started talking with commercial property owners/managers about their feather signs, informing them of the illegal nature of the feather signs, and requesting they remove the signs. It is their intention over the next three to four weeks to visit enough sites where these signs are being displayed to get the word out that these signs are not permitted.
