President’s Message Mike Rezac HBAL President The guys from “MIKE DYNASTY” say duck season is closed and “MEMBERSHIP SEASON” is official open. If you missed the Tribute to Youth general membership meeting, you’ll have to “LIKE” the HBAL Facebook page and checkout the video! The Mike Dynasty guys work hard and play hard. This is going to be a summer of getting the work done and having some fun. Please check out the opportunities on page 11 to rake in the prizes, spike points and even lunch with this year’s membership drive committee. Everyone knows a potential builder, associate or affiliate member who could benefit from being active with the Home Builders Association of Lincoln. It only takes a few minutes to share your story and ask them to be a part of the team! Mark your calendars now for the Hog Roast at the Bridges on Friday, August 23rd! This will be another fun event for all ages. After you’ve shown what you can do on the golf course this summer, you can face the real challenge of “Fish and Chips.” In order to know whether it’s just another fish story or the luck of a lifetime, you’ll have to see it to believe it! Hog Roast at The Bridges Friday, August 23
The Home Builders Association of Lincoln is planning its first Lincoln Home Builders Care Foundation Hog Roast. We are planning a fun evening, along with the hog roast, there is a fishing tournament in the works, a bounce house for the kids, a “Fish and Chips” contest and a live band! The $60 registration fee includes green fees, cart, hot dogs, hamburgers and the fixin’s for lunch, and lots of prizes! Each person will receive drink tickets toward beverages. Additional drinks may be purchased (please assign a designated driver for your team).
Priority Tee-time
By making a donation of $200 to the tournament, you will have the ability to choose your tee-time range on a priority basis. In order to take advantage of a priority tee-time, you must pledge your contribution by March 1 and pay by May 1, 2013. (This contribution is in addition to the entry fee.)

The Lincoln Home Builders Care Foundation’s mission is to support the educational and charitable activities of the Home Builders Association of Lincoln. The Foundation strives to support the community by contributing to community service projects focused on housing, as well as providing scholarships for students pursuing a career related to the building industry, and providing funding for other industry related educational and research programs. Gifts are tax deductible to this 501(c)(3) non-profit organization.

In Sympathy Our sympathy to the friends and family of Gerald Blattert, owner of Earl Carter Lumber Company who passed away as the result of a serious illness on April 16. HBAL Mailbox It is of much gratitude to receive an outstanding scholarship award that will greatly aid me in my path to success as a Construction Technician. There are not enough words to express the appreciation for the scholarship donation. My skills will be enhanced in all aspects of the construction industry, allowing me to become not only a desirable candidate for the trade, but give me the knowledge I desire to become a successful self-employed contractor. I can assure that my tenure at Southeast Community College will be of the utmost efforts and dedication to acquiring every type of information, education and skills. There is no doubt that my level of motivation and assertion will result in quality project completion, and many satisfied customers for years to come. I believe in being as highly educated as possible in any trade or profession; knowledge equals success. With that being said, it is the reason I will plan to continue my education even further, far beyond just one or even two programs. My acquisitions to the Dean’s List at Southeast Community College for both the first and second quarter should also indicate my dedication to quality craftsmanship and superior performance. I also enjoy, and sometimes find it necessary to encourage, and help other students with any questions or assistance that may be required. I possess strong personal traits that are sought by instructors and prospective employers alike. These traits will engage me in large, quality driven construction projects. My leadership, dependability, integrity, honesty, hard work, motivation and punctuality will result in only the best possible execution of the job, and only the best quality construction performance possible. I would like to thank the Home Builders Association of Lincoln Care Foundation for the scholarship opportunities that were provided to the Building Construction Technology program here at Southeast Community College in Milford. I am one of the five recipients of the Nadine Condello Scholarship this quarter and would like to pass on my appreciation. I am grateful for scholarship opportunities such as the ones you provide. I have not been involved in this program very long, but I love it out here. I think the way HBAL and other organizations allow us to interact with them on a personal level is fantastic. I feel that all of the various shows and events HBAL provides us to attend are very beneficial to our schooling. I think it is important for me to get involved as much as I can, and to soak up as much knowledge as I can in my time with this program at Southeast. The Home Builders Association of Lincoln gives me this ability. My employment intentions for the future will most likely involve working in Lancaster County, so I look forward to being a regular participant in various HBAL events in the future. I would like the thank everyone at HBAL for the $100 Scholarship. I am using the scholarship money for the purchase of my books. My future plans are graduating in December from Southeast Community College Milford campus with an Associates of Applied Science in Building Construction. After graduating college I plan to find employment in Lincoln, residential and/or commercial construction, for a couple years to gain experience and knowledge. My goal is to open my own Residential Construction business back in my hometown, Pierce, Nebraska. Again, I thank you for the opportunity to apply and also receive the Nadine Condello/HBAL Care Foundation Scholarship, it is greatly appreciated. Sincerely, Katlin Ruppert I am honored to have been chosen to receive the Nadine Condello Scholarship. I’m sure many people applied and only a privileged few were chosen. I will put this money to great use in furthering my education and knowledge in the construction field. I am a 5th quarter student, will soon be graduating, getting out in the real world and putting my education to use. Once graduated with my diploma in hand I plan on moving back to Omaha and applying to Kiewit with hopes of moving up the ranks in a respected construction company. This money is an energy boost to my financial situation and I could not be more thankful. Furnace Standards Enforcement Policy Statement The 90% furnace requirement beginning May 1st, 2013 has been delayed by the Federal Department of Energy(DOE). The City of Lincoln will not be enforcing the installation of 90% furnaces until the DOE has resolved the pending law suits. Below is the official statement for the U.S. Department of Enerygy’s website. On January 11, 2013, the Department of Justice, on behalf of DOE, and the American Public Gas Association (APGA) filed a joint motion asking the court to enter an agreement to settle APGA’s challenge to DOE’s June 27, 2011 Direct Final Rule. The settlement agreement would, among other things, vacate the energy conservation standards applicable to non-weatherized gas furnaces established in the DFR. In an exercise of its enforcement discretion, DOE will, during the pendency of the litigation, act in a manner consistent with the terms of the settlement agreement with regard to the enforcement of the standards.

Provided by Brian Willet, Waddell & Reed When developing a succession plan for your business, you must make many decisions. Should you sell your business or give it away? Should you structure your plan to go into effect during your lifetime or at your death? Should you transfer your ownership interest to family members, co-owners, employees, or an outside party? The key is to pick the best plan for your circumstances and objectives, and to seek help from financial and legal advisors to carry out this plan.
Selling your business Selling your business outright You can sell your business outright, choosing the right time to sell--now, at your retirement, at your death, or anytime in between. The sale proceeds can be used to maintain your lifestyle, or to pay estate taxes and other final expenses. As long as the price is at least equal to the full fair market value of the business, the sale will not be subject to gift taxes. But, if the sale occurs before your death, it may result in capital gains tax. Transferring your business with a buy-sell agreement A buy-sell is a legally binding contract that establishes when, to whom, and at what price you can sell your interest in a business. A typical buy-sell allows the business itself or any co-owners the opportunity to purchase your interest in the business at a predetermined price. This can help avoid future adverse consequences, such as disruption of operations, entity dissolution, or business liquidation that might result in the event of your sudden incapacity or death. A buy-sell can also minimize the possibility that the business will fall into the hands of outsiders. The ability to fix the purchase price as the taxable value of your business interest makes a buy-sell agreement especially useful in estate planning. Agreeing to a purchase price can minimize the possibility of unfair treatment to your heirs. And, if your death is the triggering event, the IRS’ acceptance of this price as the taxable value can help minimize estate taxes. Additionally, because funding for a buy-sell is typically arranged when the buy-sell is executed, you’re able to ensure that funds will be available when needed, providing your estate with liquidity that may be needed for expenses and taxes.
Private annuity With a private annuity, you transfer your ownership interest in the business to family members or another party (the buyer). The buyer in turn makes a promise to make periodic payments to you for the rest of your life (a single life annuity) or for your life and the life of a second person (a joint and survivor annuity). Again, because a private annuity is a sale and not a gift, it allows you to remove assets from your estate without incurring gift or estate taxes. Until 2006, exchanging property for an unsecured private annuity allowed you to spread out any gain realized, deferring capital gains tax. IRS regulations proposed that year have effectively eliminated this benefit for most exchanges, however. If you’re considering a private annuity, be sure to talk to a tax professional.

This can be especially valuable if business growth is expected. • Gifts of $14,000 per recipient are tax free under the annual gift tax exclusion. • Aggregate gifts up to $5,250,000 (2013 figure) are tax free under your lifetime exemption. • Partial interest gifts, as with GRATs, GRUTs, and FLPs, may be valued at a discount for lack of marketability or restrictions on transferability.
Gifting your business using trusts You can make gifts outright or use a trust. You can even structure a trust so that you keep control of the business for as long as you want. You can establish a revocable trust, which will bypass probate and allow you to change your mind and end the trust, or an irrevocable trust, such as a grantor retained annuity trust (GRAT) or a grantor retained unitrust (GRUT) that can provide you with income for a specified period of time and move your business out of your estate at a discount.
Gifting your business using a family limited partnership You can transfer your business interest using another entity, such as a family limited partnership (FLP). An FLP is a limited partnership formed to manage and control a family business. You (and your spouse) can be the general partners, retaining control of the business itself and receiving income from the business, while your children can be limited partners. By transferring the business to an FLP, you may be able to use valuation discounts and substantially reduce the value of the business for tax purposes by making annual gifts to the limited partners. A self-canceling installment note (SCIN) allows you to transfer your interest in the business to a buyer in exchange for a promissory note. The buyer must make a series of payments to you under that note, and a provision in the note states that at your death, the remaining payments will be canceled. Searching for Jobs, Workers Made Easier with SCC’s New Web Site Launching a Web-based tool designed to assist SCC students and alumni in finding employment, as well as employers seeking job candidates from the College, usage by these groups continues to increase. Shelly Tolle, placement specialist on SCC’s Milford Campus, told a group of SCC administrators that the response to the service was impressive. “We continue to be amazed at the number of people registering to use the site,” Tolle said. “And we’ve received very positive feedback from all types of users. This has been a number of years in the making, and now it’s a reality. We are very proud to be able to offer this service to our students, alumni and prospective employers.” SCC’s Placement Center offices, with locations on the Beatrice, Lincoln and Milford campuses, provide job-seeker services to current SCC students, SCC alumni and employers who register through the site. All memberships are subject to the approval of the Placement Center. The approval process is conducted during normal business hours. Those hours are posted on the CONTACT INFORMATION tab within the site. To access the site, go to https://placement.southeast.edu. Click on “Register Now” under the “Students and Alumni” or “Employers” section. Complete the online registration form and submit. Upon approval, a confirmation email will be sent to the student, alumnus and employer. Students and alumni can then search for jobs (full- and part-time, internships, seasonal/temporary, volunteer). Elliot Eisenberg, Ph.D. • GraphsandLaughs, LLC During the last year and especially the last five or six months, the economic data have been of two minds. On one hand, household net worth is way up, the stock market has been setting new highs and the number of millionaires is at 9 million, just below where it was before the recession. At the same time, we read that the amount spent at restaurants, bars, and department stores recently fell as households compensate for higher gas prices and payroll tax increases by reining in discretionary spending. Which is it? Is the economy getting better or are households hunkering down? Turns out, it’s both. Behind this seeming paradox is the growing gulf between America’s wealthier households and its poorer ones. And the past recession has put this gap into bold relief. While suffering during the Great Recession, wealthier households, because they are more likely to own equities and a home, have enjoyed the recent rise in house prices and the stock market, as well as the special year-end dividends that were timed to avoid tax increases that went into effect the first of this year. In addition, because they can borrow money at today’s historically low rates, they are spending more on vacations, cars and other high-end discretionary purchases as their financial situation improves. Moreover, over the last few years their incomes have been rising, something the majority of the population has not been experiencing. By contrast, households in the bottom half of the income distribution are having a tough time of it. The combination of stagnant wages in the years before the Great Recession, large job losses during the recession, current high levels of unemployment,
the dramatic increase in those unemployed 12 months or more, high gasoline prices and delayed income-tax refunds are forcing these households to forgo many purchases. As such, retailers that cater to lower and middle-income Americans are feeling the pinch. Worse, the payroll tax hike will probably take three or four months before its impact is fully felt. Fortunately, those in the top half of the income distribution are doing well and they pack a lot of retail punch. The top 20% of households account for 38% of all spending while the top 50% of all households account for 70% of all spending. By contrast, the bottom quintile is responsible for a tad less than 9% of all spending. And so far, higher income households have been carrying the load, with spending most recently rising at a month-over-month rate of 0.7%, the best level since a 0.8% gain in September 2012. Despite high-income households facing higher taxes due to the expiration of the Bush tax cuts and everyone facing the vagaries of the sequester, the economy is not on the ropes. A diet of dirt-low interest rates, a booming energy sector, and solid improvement in the all-important cyclicals including autos, big ticket items, business fixed investment, and most importantly homebuilding, should translate into increases in middle- and lower-class employment and (hopefully) wages, and thus more household spending among those doing relatively little of it now. Conserve...Reduce Outdoor Watering
Conserve…..Reduce Outdoor Watering July and August 2012 were the driest on record dating back to 1887. These dry conditions prompted the City of Lincoln to enact outdoor watering restrictions for the first time since 2002. With record low precipitation throughout Nebraska, the Platte River also reached record low levels affecting the amount of water available to Lincoln’s wells. Low river flows combined with the high water use from summer lawn watering made mandatory restrictions necessary in July 2012. Using the lessons learned in 2012, the City has revised its Water Management Plan to simplify watering restrictions. One important change is a new designated day watering schedule for multi-family, commercial, industrial, governmental properties, street medians and single family properties with a common irrigation system such as townhomes. Designated watering days for these properties will be on Sundays, Tuesdays and Fridays regardless of property address as shown below. Property Type

This change is intended to reduce confusion and eliminate the need for property owners to declare a watering schedule for irrigation systems serving multiple addresses. Single family properties and duplexes will remain on the same designated day schedule based on even/odd numbered addresses as in previous years. Currently there are no restrictions; however, customers should consider making appropriate changes to their irrigation system now in preparation for voluntary or mandatory restrictions. Whether or not restrictions are implemented will depend to a large extent on precipitation and temperatures during the next few months. On warm summer days, several million gallons of treated drinking water are used to irrigate lawns in Lincoln. Customers are reminded that the three (3) designated day watering schedule is to provide flexibility how and when lawns are watered. The schedule is not meant to suggest that lawns be watered all three (3) days. Rather, Adam Flanagan property owners should consider using only minimal amounts of Construction and Real Estate Scott Williamson water to maintain landscapes and restrict weekly watering to one (1) Lending Officer Vice-President Mortgage or two (2) days, if possible. This change allows for minimal watering of landscape materials, container plantings and bird baths without risk of ticketing during mandatory restrictions. Some additional tips to reduce outdoor watering include the following: • Leave mulch on the lawn to retain moisture and nutrients; • Raise your mower height to 3.5 inches which increases root depth; • Water very early in the morning and no later than 9:00 am; • Reduce watering times on automatic sprinkler systems; • Inspect and adjust spray nozzles to eliminate wasteful watering; • Turn off your irrigation system when rain is forecasted. Capture rain water in a rain barrel. • Don’t water during windy conditions, pick another designated day; • Plant drought tolerate landscape; • Allow lawn to go dormant and use watering recommendations from Lancaster County Extension. Start Early For a Healthier Lawn Later This Summer! With the recent rains we have received, it is difficult to consider continued drought conditions may very likely carry over from the summer of 2012. The City of Lincoln has recognized this and will be releasing an updated Water Management Plan very soon. The primary focus will be turf irrigation. Most people take pride and care in maintaining their lawns, although weather conditions often hamper even a green thumb’s best efforts. And, it’s not just a matter of beauty — or friendly neighborhood competition. Maintaining your home’s landscape is important for property values. Gene Theer, Lincoln Turf shared, “Many problems from last year’s drought were caused by mismanagement of water. The time to push roots down is in the spring when the turf is not already under the stress of drought conditions. Too many homeowners start watering their turf way too early in the season and by the time the heat of summer arrives the turf can’t handle the stress.” According to the Oregon State University Extension Service (OSUES), many people water their lawn more than necessary. As a result, lawns have developed a reputation for using a lot of water. Instead of following a predetermined watering schedule, check the soil moisture regularly. You can then alter your schedule to better meet your lawn’s needs. To check soil moisture, the OSUES suggests inserting a screwdriver into the soil. If it penetrates the soil easily, it is moist. If not, you know your lawn is getting dry. During dry summers, consider watering half as much as usual. Lawns will stay mainly green, with a few brown spots, if they receive ½ to ¾ inch of water per week. Watering once or twice a week to apply this amount of water should be sufficient. Don Daringer, Nebraska Sod cautions, “The soil 3-5 feet below the
surface is also very dry in most locations. It will take multiple slow rains in order to return the soil to its normal condition. The University of Nebraska Nebguides (available here: www.ianrpubs.unl.edu/ epublic/pages/index.jsp) are an excellent source of information for learning how to manage your watering and caring for your turf and trees, but many of them are created for normal conditions.” Another option, one that home owners may be reluctant to consider, is to forgo watering altogether and allow the turf to go dormant and turn brown during the summer. If having a brown summer lawn is not your idea of compromise, here are some additional lawn care strategies from the Agronomy and Horticulture department at the University of Nebraska, Lincoln: • Minimize fertilization. Over fertilized and over-watered lawns tend to lack the wherewithal to thrive under stress. This spells trouble during a drought because the lawn hasn’t developed a deep root system. Heavily fertilized lawns also require more water, so home owners may want to wait until fall to fertilize. • Mow your lawn properly. A good rule of thumb for each mowing is to not take off more than one-third of the length of the grass. Mowing higher forces grass to develop and use deeper roots. • Try mulching — even if you don’t have a mulching mower. Let clippings remain on the grass. Lawns tend to lose more water and nutrients through evaporation when you remove clippings. • If you didn’t aerate your lawn in the spring, consider doing so this fall. Aeration creates small holes in the ground that allow water to soak deeper into the ground and promotes root growth. • Maintain your lawn care equipment. Sharpen mower blades at least twice this summer. Dull blades tear grass, forcing grass to use 40 percent to 60 percent more water while it struggles to recover from stress. • Finally, water when the sun is not at its peak, either in the early morning or around dusk. Irrigating during the day wastes water, because much of the water evaporates in the heat.

Even if your community has imposed water limits, it doesn’t necessarily sentence your lawn to a long, brown summer. Follow them. Watering on alternate days can save 40 percent to 50 percent of water, and heeding these few guidelines will go a long way to helping you maintain and enjoy your lawn, even though the hot, dry summer. According to Theer “Last year’s drought affected all types of lawns – there is no one grass that works for everyone. Even fescues may be drought tolerant, but they are not necessarily drought resistant. Areas that didn’t survive the heat of last summer are dead and will need to be replanted.” With the use of technology and rain sensors, modern irrigation is more sensitive and efficient. Theer further shared, “There is nothing more depressing than receiving a nice rain from mothernature and seeing people running their sprinklers.” As you seed, sod or repair your lawns, look for quality turf grasses that will be easy to maintain, drought resistant and disease resistant. These features will ease your stress and possibly pocketbook in the years to come! Lancaster County Perspectives
Lancaster County Perspectives Permits are on the upswing in Lancaster and the 8 county area surveyed by MarketGraphics of Nebraska. The good news is that they continue to increase at a steady if not dramatic pace. The top of the first chart shows a steady increase since December of 2010. The chart below it puts it in context of where we are as compared to the highs of 2004. While we should feel good about the progress we are making, we have a lot of room to grow. Our projections are that we won’t reach the highs of 2004 in the “New Normal” but should reach the 1550 per year level by 2018.
This chart shows the history of the 8 county area surveyed by MarketGraphics of Nebraska. The high of almost 8,000 permits in the total area in 2003 should settle in to a “New Normal of 5500 by 2018/2019. We believe there is plenty of upside to permit growth in the future absent any major political or economic trauma.
