Manager Peter Hurd sent an email reporting that the certificate had been received. “We have met all the requirements concerning the construction of this home and received our Certificate of Occupancy from Santa Rosa County. Storm water conveyance systems are constructed and maintained in accordance with the county, state and federal permit issued by Santa Rosa County. This included grading of the roadside swale. The drainage issue is the Right-of-way of the adjoining property and the county is aware of it. It is not a part of our permit and does not require right of way work adjacent to our lot.This work is completed by the road department under the direction of the county engineer. Since the drainage issue is not our responsibility, I request that you issue the final inspection approval on this property,” Hurd said in the email. But HBTS officials said this was

all after-the-fact, and violated HBTS policies and procedures. “The email requesting a Final Inspection was sent after the homeowners moved in to the new construction,” stated Lawrence in a memo dated November 22. Mr. Hurd was invited several times to the Architectural Control Committee that was to discuss their bond and the case, but a HCH representative did not attend. On December 3, the HBTS Architectural Control Committee met, made and passed a motion to retain the $2,000 builder’s bond because of the homeowners moving into the property before a final inspection with a passing grade. HCH was then invited to the board meeting held on December 10. At the board meeting, HCH representative Brian Van Slyke addressed the board and stated Henry Homes continued on page 2

Board member Pat Traynor askedVan Slyke if he had proof that he was being “leveraged,”to whichVan Slyke replied that the failed inspection was not reasonable and emphasized that the pooling of water that caused the fail was on a HBTS board member’s (Beth Walter) property. “We can’t meet a condition that we are not liable for, we would be held accountable. The matter was moved to the January meeting so that the general manager could gather all of the emails and

Holley by the Sea Homeowners Association operates are in need of a revision due to inconsistencies with Florida State Statute 720, outdated language and vague rules and regulations that have been dealt with inconsistently with each new board. An example of an outdated rule is that under current covenants and bylaws, satellite receivers are not allowed.

Covenant re-write still not done The Holley by the Sea Board of Directors approved spending $7,500 from legal funds in March of 2013 to engage the law firm of Becker & Poliakoff to provide a full legal draft of governing documents during a March 19 HBTS board special meeting. The board was in favor of scrapping the rewrite and rewriting two sections of the covenants: 1. Annual Maximum Assessment Increase Percentage — The current covenants, under Article V, Section 3 states that The annual assessment shall be established by the Board of Directors of the Association in accordance with the bylaws. It does not provide a limit on the increase permitted from year to year. The proposed language will recommend a maximum 5to-7 percent annual increase in the assessment set forth by the Board of Directors. 2. Voting Requirements for Amendments — The current covenants state that Under Article IX, Amendments section, a resolution for the adoption of a proposed amendment of these bylaws requires the following for approval: a) Not less than 66.67 percent of the entire membership of the Board of Directors and by not less than 51 percent of the votes of the entire membership of the Association; or b) Not less than 66.67 percent of the entire membership of the Association.

Remembering active members who left us in 2013 Peggy Elwood The year began on a somber note for Keith Elwood of Elwood HBTS, who lost his wife Peggy Elwood. Peggy was an avid volunteer in the community and had the most spectacular Christmas light display in HBTS and perhaps the Panhandle for many years. She lost her battle with cancer during one last trip over the holidays to her home state to visit her son and daughter. Dorothy “Dottie” Elaine Steinert Dorothy Elaine (Angione) Steinert, 76, Steinert of HBTS in Navarre, Florida, and formerly of Norwalk and Trumbull, Conn., died peacefully at her home after a long illness. She was the wife of the late Uri (Lee) Steinert of 30 years. Lee passed away in February of 2012, just a little over a year earlier.

Christmas decorating a family affair for McCloskeys

By Shelby Smithey shelby@navarrepress.com A family tradition has led to James and Cindy McCloskey’s home being named the winner of the Holley by the Sea Christmas lighting contest. The McCloskeys, who live at 2010 Flamingo Lane, have been going all out for the holiday season since they first were married 20 years ago. James and Cindy now have two children, an 11-yearold and 17-year-old, but even though their children are growing up they still plan to keep decorating their home for Christmas for years to come. “It’s our family tradition to start putting the lights up on Thanksgiving morning,”Cindy said.“It takes us about six days and we do it as a family.” Cindy and James said that they have approximately 50,000 lights that they put up, in addition to decorations including a gingerbread house, nativity scene, snowflakes and glaciers. “My husband and I are active duty military and we would always win all the lighting contests on base,”Cindy said.“So when we moved to HBTS 10 years ago, we wanted to continue doing it.” Both Cindy and her husband are originally from the Northeast, and Cindy said that Christmastime is both of their favorite time of the year. “James is from Pittsburgh and I’m from New Hampshire and we both were brought here to Navarre being in the military,” she said. More than a dozen families filled out applications for the HBTS lighting contest. On Dec. 16, the McCloskeys were happy to find out they had won the contest and received a $50 Walmart gift certificate. “I run a home daycare now, so the kids really love seeing the lights,”Cindy said.“Even when my own kids grow up and leave I think we’ll still continue with our tradition. I think our neighbors expect it every Christmas so we can’t stop!”

Just because the holidays come to an end with the new year doesn’t mean the usefulness of your Christmas tree comes to an end. Here are a few tips that will have you enjoying your tree for months after the holiday — and saving landfill space: ■ Pine needles dry quickly and decompose slowly — use them as mulch to cover your crops. ■ Cut off boughs and lay them over your perennial beds to protect them from frost. ■ Cut the trunk into 2-inch discs and place them in the soil to edge flower beds or walkways. ■ Saw the trunk into various lengths and use the pieces as flowerpot risers for a dramatic group display. ■ Cut thin slabs off the trunk, sand them smooth and apply a thin coat of polyurethane to create a natural drink coaster. ■ Strip small branches and use the remaining twigs for support of your indoor potted plants. ■ Gather your neighbors, rent a chipper and feed the tree through it. Next spring, spread the wood chips under shrubs to aid in suppression of weeds and to add nutrients to the soil as they decompose.
