EMPLOYEE & MANAGEMENT PARTICIPATION IN START-UPS, MEDIUM-SIZED AND STOCK-LISTED COMPANIES

Germany, the country known for its successful economic businesses, has a surprisingly weak shareholder culture. This is reflected in many areas of economic life, not least in the area of employee participation. Thus, employees miss their chance to generate valuable assets and set up financial security in their pension plan. Companies, on their part, miss out on a highly practicable tool for employee recruitment, -retention, and -motivation.

How can we raise awareness – especially in the minds of decision makers in politics and economics – for the vast benefits that employee participation entails? What are the conditions needed to render corresponding offers as attractive as possible? These questions, among others, will be at the heart of this year’s conference “Ownership Day 2017”, to which you are cordially invited.

This year, following the success of the first “Ownership Day” in November 2015, we will have a look at several differing modes of participation and their respective advantages – not only among listed corporations but also medium-sized companies and start-ups. In talks, discussions and workshops we’ll gain insight into exciting (and in some cases exceptional) practical examples, where we can identify current obstacles and reservations, exchange arguments, and be presented with thought-provoking impulses and practicable solutions in the field of employee participation.

Employee participation is unmistakably one of the best opportunities for companies and employees, as well as society in general, to benefit from the success of the increasing europeanisation of economic activity. Trade Union Demands for Equity Investments by Employees

For DGB (German Trade Union Confederation) and international trade unions, the focus is on legal codetermination.

It is the central instrument for supporting good work and sustainable, long-term management. Properly set up, equity investment on the part of employees can serve as an additional means of coping with crises, overcoming difficult succession scenarios, and contributing to sustaining company policy. However, employees should bear in mind the “double risk” they are taking: in case of the company becoming insolvent, employees run the risk of not only losing their jobs but also their capital investment. It is therefore important that an equity investment be paid only in addition to the standard wage agreement and that it be made accessible for all employees of a company.

Equity compensation and employee participation work! A market overview Equity-based compensation does work. Financially successful companies allow more employees to participate in equity-based LTIs, have a stronger LTI focus in their compensation packages, have higher participation rates in their share purchase plans and even less fluctuation. However, there are interesting regional and cultural differences with regard to plan design, administration etc. to be pointed out.

But whether robotization will be good or bad for society isn’t a foregone conclusion—it will depend crucially on how public policy and private firms respond. The United States is uniquely situated to move its economy toward shared ownership. Many firms have profit-sharing or group-incentive pay structures, where employee earnings depend on the firm’s profitability. These forms of compensation don’t currently give workers an ownership stake sufficient to ensure that the benefits of robotization will flow widely. What policies can get us there?

In May 2017, the company launched its first all employee international share plan to colleagues in 17 countries. Save and Share is a savings related share option plan that gives colleagues the opportunity to not only work for Sage but to own Sage. This case study takes the audience through the challenges of implementing such a programme from understanding data requirements, delivering straightforward communications covering complex subject matter in multiple languages and ensuring successful engagement during a relatively short enrolment period, complying with different regulatory requirements for a number of countries through to the execution of allowing colleagues to enroll into the plan.

Assets thus gained can help raise pension assets in the long term. Employee participation complements and contributes to company pensions and, therefore, should be subject to the same tax regulations. Assets should be transferrable into the company pension tax free.
