The HCG Story... Estate Planning and Assisted Reproduction Technology by Ann Schneider & Jennifer Hostetter Most people do not think these two fields of law relate, but they actually can be interconnected. And if you have ever gone through any type of assisted reproductive technology (ART) procedure or fertility treatment, it is very important to discuss this with your estate planning attorney. If you are in the process of going through a form of assisted reproductive technology, it may be wise to speak to an estate planning attorney now to prepare documents while you or your spouse are going through these procedures. When planning your estate, it is important to plan and discuss what you wish to happen to any stored sperm, eggs or embryos you may have. The laws governing assistive reproductive technology differ greatly from state to state. In addition, many states, including Indiana, have yet to address issues concerning the treatment of stored genetic material upon an individual’s death. Working with an estate planning attorney will allow you to create an estate plan which takes these matters into consideration. Your 4

estate planning documents can then include direction for what should be done with stored genetic materials upon your death. Additionally, if you are going through some type of surrogacy, you have the ability to make plans in the event something were to happen to you, your spouse or the surrogate. Fertility clinics across the nation have varying agreements and contracts that range from very basic to very thorough. The storage or final disposition of your stored genetic material may have been something you have already addressed with the fertility clinic. Your estate planning attorney should review any agreement you have signed with a fertility clinic to ensure that your estate planning documents will be effective at carrying out your wishes. If you are considering, are going through, or have already gone through some type of ART procedure, I encourage you to seek out an estate planning attorney. ART is a vastly growing area of the law and it is important to plan for the future.

PROACTIVE STEPS YOU CAN TAKE TO PROTECT YOUR PERSONAL INJURY CLAIM When someone is injured in an accident, whether it’s an auto, motorcycle, or bicycle accident, a slip and fall, or some other circumstance caused by another’s negligence, that person is in shock. It is difficult to think straight or ask the right questions. Without a doubt, it’s a time of confusion, pain and anger. Many times, a person is too injured to do anything at the time of their injury other than seek medical attention. But often, that is not the case. Knowing what to do beforehand can help you protect your claim. Here are some simple tips on what to do if you are injured: Collisions involving moving vehicles, motorcycles, bicycles, trucks • Photograph the scene where the collision occurred • If possible photograph the scene before vehicles/motorcycles/ trucks or bicycles are moved • Photograph the damage on all vehicles/motorcycles/trucks or bicycles are moved • Provide a statement to the investigating officer explaining what occurred from your point of view • Ask for a copy of the other driver’s insurance card • Obtain a copy of the police report from www.Buycrash.com • Know the coverage limits of your auto insurance policy including your UI/UIM coverage as well as any excess coverage you may have pursuant to an umbrella policy • Notify your auto insurance carrier right away that you have been involved in an accident • Don’t agree to allow your motor vehicle to be salvaged by your insurance carrier until you have had a chance to examine 8

It’s February – how are those New Year’s Goals Coming? Every year I take quiet time during the holidays to reflect over the last year and visualize the coming year. I review what I accomplished and what I didn’t and why not. Sometimes I really have to face the brutal facts when answering the question of why not. Then I decide if I still want to accomplish those goals that I didn’t and determine what I need to do differently. And of course I create new goals for the coming year. The entire month of January, you see goal setting workshops and New Year’s Resolutions everywhere! Especially with the information overload on social media. Probably the only topics trending higher than Jimmy Fallon and the NFL Playoffs are those relating to New Year’s Resolutions. A Google search created over 84 million results! Wow!! Depending on the source for listing the top New Year’s resolutions, the only thing that really changes is the order. So this list of the most popular won’t surprise you: • Lose Weight • Improve Finances/ Spend Less, Save More • Getting Organized • Get a New Job • Healthier Eating • Manage Stress Better • Stop Procrastinating • Enjoy Life to the Fullest • Exercise/Stay Fit and Healthy • Learn Something New • Quit Smoking • Help others in their Dreams • Improve a Relationship/Fall in Love • Spend More Time with Family Unfortunately, it’s also reported that 1 in 3 people ditch their vows by the end of January. The top reasons include being too busy or not being committed to their goals in the first place.

I am sure many of you have gone through a similar process and now, here we are, it’s already February…down one month…1/12 of the year is already behind us. One of the things I have learned over the years, is to not try to change too many things at once. I suggest you look at your list and prioritize your top 3. Then create your step by step game plan to accomplish your goal. Decide you will reach those goals no matter what, which means doing the work. That’s when I find most people stumble. What they need most to achieve their goals are: time, money and a willingness to work. And it’s always more, not less. One of my goals last year was to run the Indy Monumental ½ Marathon. While I set the goal and created the plan, I stumbled… a lot. I didn’t complete the work. I also learned a lot along the way. The "Wave and Smile" Experiment I consider myself a relatively happy person. As a life coach and psychotherapist I have made it my mission to promote happiness as much as possible with my clients. You may have seen some of my previous articles on the happiness factor and the three things that promote happiness which include staying in the moment – gratitude – and reframing. I am always amazed the clients finest so much happiness in following this simple formula. Go to www. indymetrowoman.com and look up the May 2009 issue for more info. Currently I am participating in a happiness course presented by Shawn Achor through Oprah.com. He is a researcher from Harvard who has made it his mission to find the most successful practices that promote happiness. I actually look for opportunities to increase my "happiness quotient" because I know that happiness is a choice and I want reminders to utilize my attitude to think this way. As I was learning more about the research, Shawn had learned about a very interesting experiment called the "wave and smile experiment." He found that cities that had a high rate of violence and crime benefited from policeman who showed up in their neighborhoods and simply smiled and waved at everyone they met. Initially the police said that the community seemed fairly suspicious of their motives but quickly appreciated the smile and wave activity that occurred between them and the police. It was noted that crime and violence went down in any community that practiced this simple interaction. So Shawn invited us in the course to do the same. And even though I normally do as I walk in my neighborhood, I am going to make an effort to do it places like airports, shopping malls, and less familiar areas. I have always known that it is the right thing to do but

now there is research to substantiate that it truly does work. I would challenge you to do the same… As Carol Juergensen Sheets Shawn encouraged us in the course, spend one second twice a day smiling at someone or waving to them. Since habits take about 21 days to reinforce, practice it for 21 days and see if you don't start noticing that people smile when they notice you and that you truly are making a difference in the life of others. Happiness is a choice. No matter what is going on in our lives and no matter what we are dealing with personally, we get to decide to create happiness within ourselves and wherever we go. That is a principle that we can live by each and every day. No matter what you might be struggling with or what you might be dealing with in terms of depression, anxiety, or anger, we know that if you do practice compassion with other people even though you don't feel like you have the energy… It will pay dividends into your emotional well-being and mental health. You really do have the capacity to change up your life, to practice happiness, and to feel better about anything that may be troubling you. Five Ways to Start the New Year Off Right by Shelly Aristizabal It’s a New Year. Today is the perfect time to follow these 5 ways to start the year off right, and take charge of what you are getting out of life. #1 Do a yearly review Take a look at where you’ve been and celebrate the successes in the last year. Ask yourself these types of questions: What went well for me last year? What accomplishments did I have? How did I improve my life? How did I improve my relationships? What did I remove from my life that is now making me happier? What do I wish I had taken more time for? Keep a journal of these questions and your responses that you can refer back to in the future: your answers over the years will be very enlightening. Ask these types of questions about all the important areas of your life, such as family, relationships, financial, career, home, etc. These questions will help you appreciate all you’ve accomplished in the previous year, and you can use this information to start the new year off right. #2 Finish what you started Which projects, errands, and general list of to-do items do you have left over from the previous year that you can complete in 2 hours or less? Keeping projects around doesn’t do us any good—they just weigh on our minds, and people will spend hours thinking about something that will only take 10 minutes to take care of. Cross those things off your list and give yourself a fresh start. #3 Be realistic Dreaming is fabulous, but if you want to make

some improvements in your life, you need to be realistic. As much as you may want something, it’s very likely you don’t really believe you can have it. (If you did you would already have achieved it.) We have to turn a dream into something we can visualize accomplishing before it can become a reality. Take your dream and start breaking it down into goals: if you want to work from home, what are the steps you need to take? Break those steps down further so you can create a game-plan and start working towards accomplishing that dream. #4 Focus on what you really want Speaking of dreaming, ask yourself what your dream looks like. What are you doing in the dream? How are you living? Who is in the dream with you? What does a typical day entail? These questions will help you define what lifestyle you really want, and give you ideas about how you can achieve that lifestyle. For example, if you see yourself relaxing by the fire with a good book and a cup of tea, ask yourself why you aren’t spending more time that way now. What things are in your way and how can you re-arrange your priorities in order to have the lifestyle you really want? #5 Put yourself at the top of the list Using the information you’ve discovered above by determining what you really want, put yourself at the top of the list this year. The old adage is true; we really can’t help others until we help ourselves. Taking care of yourself and striving to reach your own goals will make you a better spouse, friend, coworker, and parent. Be sure to make time for yourself each day to work toward your goals, and pursue the lifestyle you want. Happy New Year!
