The HCG Story... The Status of Pre-Birth Parentage Orders Very little has changed for assisted reproduction law in Indiana since the opinion In re Paternity and Maternity of Infant R was published by the Indiana Court of Appeals in 2010; however, this decision did significantly help intended parents establish their parentage for their unborn child. Intended parents who are biologically related to their child carried by a surrogate can petition the court for a pre-birth parentage order. Among numerous things, a pre-birth parentage order allows the intended parents to place their names on the birth certificate at the hospital and allows the hospital to discharge the newborn directly to the intended parents. Indiana Code allows for the establishment of a Father’s parentage of a child. But because it is presumed that a woman who gives birth to a child is the child’s biological mother, there are no provisions on the establishment of maternity. There are also no specific provisions on the establishment of parentage rights when a child is born through the use of assisted reproduction. With increasing reproductive technologies, the need for the establishment of legal parentage for both parents exists and because it is well settled law that it is in the best interests of a child to have their biological parentage established the paternity statutes can be used for intended biological mothers attempting to establish their maternity. Intended parents seeking to establish their parentage 12

by pre-birth order can file a petition establishing their paternity and maternity. The carrier can agree to the establishment of the intended parents’ parentage, but she cannot petition the court to disestablish her maternity because Indiana paternity statutes do not provide a procedural template to disestablish paternity. If the carrier is married, it is necessary that her husband be made a party to the proceedings as well because he would be recognized as the child’s legal father until the intended biological father’s paternity is established. Indiana paternity statutes also allow paternity to be established without the need for a hearing if the mother and alleged father stipulate that he is the father or they file a joint petition alleging he is the child’s biological father. It is possible to petition the court for a pre-birth order without the need for a hearing. However, there is no statute on point and that is likely to be determined on a case by case basis. I believe it is important that the intended parents and the carrier be represented by independent legal counsel. The American Bar Association and the American Society for Reproductive Medicine’s guidelines state that the carrier and intended parents should have separate legal representation. You should always consult with your ART team, including your clinic/agency, medical providers and attorneys.

Are You Prepared for your Future? When asked what they want more of, most people say time and money. There is a great song from the show Mama Mia called Money, Money, Money and the lyrics go like this: “I work all night; I work all day, to pay the bills I have to pay. Ain't it sad? And still there never seems to be, a single penny left for me. That's too bad. In my dreams I have a plan; if I got me a wealthy man, I wouldn't have to work at all; I'd fool around and have a ball!” Haha! Well, for most women….that’s not necessarily a great plan or a realistic one. And so many women I meet work very hard, long hours and still don’t have what they need financially. They have been affected by the economy by it downsizing their income, savings or retirement. Many are looking at not being in a position to retire until way past 70 years old! So how do they even think about more income... where do they begin? You know, somewhere along the way the American Dream has shifted from working hard and creating financial security to overspending and creating massive amounts of debt. That’s the number one reason why people claim they need more money…to pay off debt. Dave Ramsey writes in his book, The Total Money Makeover, “there are only two ways to become financially stable: earn more or spend less.” Imagine what can happen when you do both. When asked how their spending compares to their income, 37 percent reported that their spending was equal to their income. However, one-in five respondents report that their spending exceeded their income. And further, nearly a third of respondents went without some medical treatment in the past year because they could not afford it. No that’s really scary! Find Meaning And Purpose In Your Life Are you one of those people that have wondered why bad things seem to happen in your life? Have you experienced a divorce, or had a sick child, and wondered why this has happened to you? It is not unusual to have those kinds of thoughts and want to “lick your wounds.” When obstacles seem great it can be easy to go into a self-pity mode but that takes away your power. As difficult times arise … it is important to feel your pain and then move forward to ask yourself how you can grow from it. All the great philosophers say that true transformation requires suffering. The more you experience suffering the more likely you are to grow. There is a term called post–traumatic growth which means that suffering elicits great growth in your life. This means that you should look for great meaning in your life and to make a difference in the lives of others! Most women would admit that when bad things happen to them they feel fear anxiety, stress, and anger which typically turns into depression. When these feelings become overwhelming, it can lead to posttraumatic stress disorder. The good news about PTG is that it offers an opportunity to think about the world differently and reassess one’s life. It allows one to move beyond the sadness and betrayal and look for opportunities for meaning and purpose. I have worked with clients including a mother who lost her adult son to heroine and as a result she created a foundation to fight chemical addiction. I have a friend who lost her best friend to cancer and has made it her mission to raise money for the Susan G. Komen foundation. I have worked with a woman who was horribly betrayed by her husband’s sexual addiction and after she experienced the pain and betrayal, she decided to create a specialized group
for women who had experienced the same betrayal bond. As you can see these women turned their trauma into something positive and are contributing to the world.

Where do you find your support? Is it from healthy friends, a mental health therapist, a support group or institutions like your church or synagogue. It can often take 2 to 5 years to get through the trauma but that’s when the good stuff happens. Support and quiet time are crucial to taking your life to the next level. Spend time reflecting on why this happened to you and use your quiet time to spiritually to reflect on how you might use this to give your life meaning? Have you had those moments when you had actually thought of ways to make a difference in your own life and in the life of others because of your past pain? It is never too late to spend time reflecting and contemplating how you can make meaning out of the chaos that has occurred in your life. You will need to stop the busyness of your day and find time to listen to your intuition so that you can decide how you can contribute to the world in ways that manifest your greatness.
Homework assignment:
Spend some time thinking about the worst thing that has ever happened in your life. Ask yourself what you might do to transform meaning out of the trauma and then find yourself a support network to make that change happen. You really were born for greatness and you can use post traumatic growth to actualize your potential!

Innovation... by Shelly Aristizabal What does it mean to be innovative? The term innovation, along with its shopworn adjective, innovative, and its breathless verb, innovate has become every product manager’s rallying cry, every design consultant’s pursuit, and every press release writer’s staple. The word’s been wrapped around everything from the latest i-something to even a new scooter. So how can one term be used to describe such vastly different things? In essence, what does innovation really mean? Technically, innovation is defined merely as “introducing something new.” There are no qualifiers of how groundbreaking or world-shattering that something needs to be -- only that it needs to be better than what was there before. Innovation can mean different things to different people. What does innovation mean to you? Every innovative idea begins with a thought, an inspiration. An idea that you can do something that has never been done, improve on something, make a change to something or do it cheaper or better than it has been done before. Creating a paradigm shift that will add value to the lives of others is considered innovative. This is a unique ability to see the unfolding patterns of the future and recognize the emergence of fresh ways to interpret our surroundings. When the paradigm shift occurs, the new system eliminates old ways of doing things and gives rise to innovative opportunities. Most ideas come from a desire to fill a need or a gap or expand upon an existing way of doing things. We all have ideas; even if it is simply that your closet isn’t big enough to adequately manage all of your clothing so you have an idea to design a bigger closet. But when does the innovation actually take place? The innovator takes ACTION on her ideas -- that is what makes the difference. An
innovative visionary mind will look at a situation and see future improvements, while most people look at the same situation and only see the present and complain about it! Successful innovators develop the ability to clearly define and articulate their vision, clearly define their plan for strategic action, and rapidly gain support for their initiatives. They will educate and help others understand their vision and come up with a game plan to make it a reality -- especially to the people who can affect the success of the idea. The innovator’s view is of the unfamiliar -- which represents change. How do you present a view of the future that only you can envision? Your ability to create a clear presentation of your idea is the tool you use to influence others and enlist critical support. You can have a good idea -- there are lots of good ideas -- but equally as important is marketing those good ideas. Do you believe strongly enough in your dream to enthusiastically engage others to support your efforts? Taking a good idea and making it into a reality will require massive action! Peter Drucker said that Innovation is the specific tool of entrepreneurs, the means by which they exploit change as an opportunity for a different business or a different service. Innovation is capable of being presented as a discipline, of being learned and practiced. Entrepreneurs need to search purposefully for their sources of innovation and apply the principles of successful innovation to achieve success. Make 2016 YOUR YEAR!
