What a year ! New Year is on the doorstep. We are going to do everything better in 2012 than before. Disregard the Maya Calendar but beware of mother nature who is over and over again warning us. The BKK flood was not mother´s nature fault however. Certainly she did deliver the water but if it would have been managed properly and wisely, a lot of disaster could have been avoided. Watch your pockets as the Euro and Dollar are not up to their strength. The Baht unusually strong for whatever reason it is held up there making Thai products expensive in export markets. The German Chancellor, Angela Merkel spoke some strong words at the Marseille Summit. Will they be able to pull it through? Certainly. She said that Europe in comparison to 50 years ago has shrunk in comparison to the rest of the industrial world. We had the upcome of China , Japan , India, you name it. The world population, except Europe has doubled.

WELCOME 2012

We bought endless fortunes of cheap labour backed products and pulled China into our backyard. Our own industry which should support our interests manufactured in China, Indonesia and India. No wonder we are going broke. Who feeds the tax income, who feeds social, retirement? Our banks lend the money to other countries, hoping to make a good deal, who than proclaimed their inability to pay back. Now the banks hope the IMF and their own governments can bail them out. Consumers were animated to spend money and take uploans, spending more than they earned. Herr Zwiebelschneider and Mr. Dubois, hope to get a pension whilst African families are migrating to Europe with endless numbers of kids. Honesty, a primary student could add up 1 +1 on this equation. Our own fault, no national pride, no sense. Tony Blair warned us ! Rragan probably started it all. Clinton, did well to recuperate some debt but the Federal Reserve who seems to rule the country, together with

the Bushes drew th US into more deficit. Angela Merkel makes a lot of sense and we all are focused on her whilst oil multies hope she wont make it. She will make it ! Europe has always made more sense than the overseas neighbor. Now is the time. Weddings in Hua Hin at our star Hotels are wonderful and romantic. Hyatt, Anantara, V-Villas, the intercontinental and other resorts are offering beautiful wedding packages. I attended a few and it was like a fairy tale with a Sala on the beach front, huge cake and champagne. Check their websites in case you want to re-marry , marry or marry your kin, or not. Hua Hin is great for many things , even for traffic chaos. However Mai Penrai with patience things move on. On behalf of my entire team , we wish you a great time during the Western Festive days. Yours truly , the Editor

FROM NADA TO DADA By Jack Mairoo – Writer at large

have never been a President, a rock star, a movie celebrity, a politician; in fact I am just an ordinary man living an ordinary life without pretention. It seems that all successful people end-up writing their biography or a book of some sorts, explaining how hard their ascension to success was and the numerous challenges they have faced. Biographies and personal stories are entertaining and may teach you a trick of two but you will never be able to identify your life with the life of its authors and that is a fact! But nobody ever wrote a book teaching fathers “how to be an eight weeks per year dad, for dummies!” novel, right? Maybe it’s time that someone wrote such a book. The first page should start with an ego booster! “You are a great dad and this is not your fault!” I just

love that sentence, makes me feel good about myself. There are millions of guys out there, facing every day the same challenges, amongst them, dad’s fighting hard to move on with their lives and still trying to be part of the life of their kids. Don’t think one second that behind every divorced couple there is a guilty man, ‘he’ is not always the reason of a divorce, ‘she’ can be guilty as well! For whatever reasons and I have heard it several times, it is believed that if a couple fails, both are to be blamed and have equal responsibilities… What if they were simply not compatible any longer? Love seems to become a perishable good with an expiration date, these days. I’ve managed to pull myself out of bed to catch an early flight home to visit my kids, I haven’t

seen them since mid-July or so to speak, I do talk to them 3x per week via Skype, but in this case it is different, I get to physically hug them and drown them in millions of kisses. It has been a while already since my kids and I live apart, and I am continuously facing the same dilemma over and over, every time I am about to visit them, the becoming of a full time D-A-D! It is not easy when they are of young age. Sitting in one of the coffee shops at the airport and looking into my Latte, my mind is gently preparing itself to go from full time businessman to full time single dad in a blink of an eye, not without a hint of apprehension and a few drops of sweat triggered by nervous thoughts. This time of year, the kids are not on holiday and have a busy schedule, a birthday party to attend here, karate lessons there, an

hour ballet on Friday, kindergarten, school, lunchbox, homework, not mentioning every morning I will wake, dress and feed them before bringing them to school, pick them up, homework, bath, pajamas, bedtime story and here we go again…. Mums around the world seem to master these skills with dexterity and precision and they have my utmost admiration. A question remains though… what would actually happen if you would cut into their routines? What would happen if we reversed the roles and they were to become 8x weeks per year mums? Would they still be able to manage the situation with dexterity and precision? Maybe or maybe not? As for me, this asks for a precise and meticulous military planed operation, “plan your work and work your plan, General, Sir!”

Hua Hin Has Great Potential for Development: Mr.Suwat

The former deputy prime minister of Thailand Khun Suwat and owner of the Intercontinental Resort & Spa in Hua Hin is planning to join hands with the local Hua Hin government on improving the transport systems in Hua Hin and making the city better known internationally, especially in terms of World-Class Sport competition and a Cannes-like Movie Festival. Mr. Suwat Liptapanlop, further said that he had already discussed with the cabinet about making a new transport route directly to Hua Hin, such as a motorway and a parallel railway line. Besides enabling people to travel to the city more conveniently and quicker, the new route will serve as a gateway to the south of Thailand. This is a very important issue that will take place in the next couple of years should the cabinet approve the survey plan and the proposed budget. The former deputy prime minister added that, apart from transportation, one of the key roles is promoting activities in Hua Hin together with the city’s Mayor Mr. Jira Pongpaiboon.

Resort’s tennis court. With over 20-million Baht budget to organize this event, it internationalizes Hua Hin and some profit from the event was used to help the current flood victims as well,” said Mr. Suwat. Since Hua Hin is a Holiday Getaway and Top Tourist Destination and Royal Residence of Thailand as famous and big as Cannes in France, Mr. Suwat is thinking of organizing “Hua Hin Film Festival”. An international film festival in which movies from around the world are screened and cinematic awards are given to film directors, actors and producers. Tentatively taking place at the final of January or the beginning of February next year, the Hua Hin Film Festival will certainly make more income as it promotes tourism in the city. At the event, famous actors from Hollywood, Japan, Korea and India will make their appearance on the red carpet. More important, film producers of Asia will be invited to show their work to the audience, too.

Most of the activities concern sport championships that usually takes place in the city center, city roads and on the beaches. All the events make Hua Hin famous among Thais and foreigners as many visitors come to stay here and attend the events, thus making a lot of money to hotels, restaurants and guesthouses “The film festival is a big highlight for Hua Hin and Prachuab Khirikhan accordingly as it’ll here. make the city famous among visitors and help “At the beginning of this year, we organized promote tourism business here. In doing so, a world tennis exhibition match in close local people and business owners will earn more cooperation with the The Boonrawd Brewery all year round,” concluded Mr. Suwat. Co. Ltd. at the Centennial Park Hua Hin

Suan Dusit University

Fringe Festival

2011/12 at Vic Hua Hin Hands Donation to Flood Victims By Chamnan มหาวิทยาลัยราชภัฎสวนดุสติ (ศูนย์หวั หิน) T A

he Suan Dusit Rajabhat University (Hua Hin Campus) handed over the proceeds and goods donated from people in the city to 50 schools and universities in 30 provinces of Northern and Northeastern Thailand before formally closing its donation center for flood victims.

Dr. Suraphol Siriset, the director of the university, said that the 1,111,111 (One million one hundred eleven thousands and one hundred eleven) Baht as well as fresh and processed foods and boats were collected by the students from local people in Hua Hin during 27 September until 20 November – the period when severe flood hit many parts of the country including Bangkok. All the donations will be directly handed over to 50 schools and universities throughout Thailand because the recent flood damaged not only the school buildings but also teaching and learning materials. “We’d like to assure the people who made donation that everything will be directly forwarded to the director or the headmaster of the schools in the affected areas without any charges,” said Dr. Suraphol. “With good intentions to help people, our students who live in the flooded area will be taken care of as well.” Since flood is one of the natural disasters that can happen unexpectedly at anytime in Thailand, the Suan Dusit Rajabhat University encourages its students to take part in a volunteer program under which they called for local people in Hua Hin to cook some food, give some money and supplies for the affected people. Now that things are getting better and the donation was already forwarded, the university finished the program and closed the donation center, added Dr. Suraphol. The Suan Dusit Rajabhat University (Hua Hin Campus) is an academic institute of Thailand which provides courses on hotel and hospitality, aviation and tourism businesses for Thai and international students. Every year, not only students from Hua Hin but also those from other parts of Thailand come to study there. The university is a so-called educational hub for Thai students. So, the teachers and students are willing to help Thai people in trouble. Apart from the social work, the university also promotes participation in cultural activities as its staff and students are encouraged to join in such activities once informed, concluded the university’s director.

The well-known musical and fundraising event for environmental protection is held one month later than last years’ due to the current flooding that impedes transportation to and from Bangkok. However, it takes place during the New Year’s time, thus served as a present for visitors and local people in Hua Hin. This year’s event features mouth-watering food and drink from top-notched hotels in Hua Hin and concerts by local bands in Hua Hin including the Tang Keramble as well as Mai Charoenpura, a popular actress singer of Thailand. Rak Hua Hin - to Serve Hua Hin People and all Thais By Chamnan

T

he “Rak Hua Hin” (Love Hua Hin in Thai) group has been launched formally with activities aiming to help victims of natural disasters . According to the group leader Dr. Thaweesak Dachapanya, the “Rak Hua Hin” is set up by Mr. Thawee Kasem-ngarm, Mr. Sahatchai Anatamek and him. Once it was formed, the group organized the first activity -- a Chinese dinner charity at the Phon Kingphet Memorial Park --to help flood victims in Thailand. Besides helping people affected by natural disasters, the group will engage in local politics of Hua Hin for the next municipal election to solve problems regarding political, social and cultural issues. This is because the ex-members of the group: Khun Prasat Suknikorn and Mr. Thak Dechapanya, were a mayor and a municipal councilor respectively, added Dr. Thaweesak. “Recently, Hua Hin has been growing and expanding by itself. However, the city’s quickdevelopment and ignorance of local administrators will deter desired urban improvement,” said Dr. Thaweesak. “That’s why the “Rak Hua Hin” has to participate in local politics of the city in terms of socio-cultural issues, which are the crucial factors for the city’s development.”

The group leader went on by saying that, if the “Rak Hua Hin” went into the local politics, there were 2 things that need to be done immediately. The first is improvement of the city’s infrastructure, particularly water storage, as Hua Hin can store only 100,000 cubic meters of water while its people use 40,000 to 50,000 cubic meters of water daily. So, water shortage is common here. Moreover, road paving in small lanes around the municipal areas is a must as people are now having problems commuting. The second is services on house plans and house number registration as well as other services that are reportedly not efficient enough. To solve the problems mentioned earlier, Dr. Thaweesak proposed total urban replanning as this method yields more systematic infrastructure management and prevents traffic congestion in the city’s center. Moreover, governmental administrators have to promote public transport to serve increasing need of local people. The group leader concluded that, although the group was already formalized with its leader, the members were seeking other executive board members who would be announced as soon as they were accepted.

he Dane, who has been the women’s No 1 for the last two years, will return to the beach resort 12 months after losing there to Kim Clijsters in an exhibition match. The World Tennis Charity Invitation is due at 5pm on January 1 at the Hua Hin Centennial Park, and will be televised live by ESPN. “I had a fantastic time in Thailand last year and it is a pleasure to be able to come back again,’’ said Wozniacki, the winner of 18 career titles. “I have seen some of the pictures of the terrible floods and I am delighted to be a part of the tournament and raising money for flood relief.” Rumour has it that the world No 1 might be accompanied by her boyfriend and world golf No 2 Rory McIlroy who is due to play the Thailand Golf Championships two weeks before the charity event. The women’s singles showdown will be followed by the return of former world No 9 Paradorn Srichaphan to the tennis court. Having retired in 2010 due to a wrist injury, the former Thai ace will play the 18th ranked Isner who is known for huge serves as well as his height 2.06 metres. “I have practised with him a couple of times. He is a very nice guy. His game is based on serves which is fine with me as I’m not fit enough to stay in long rallies,’’ said the 32-yearold Paradorn. “I still have a month to prepare for the match. You will still see a power game from me. But what’s more important is that we are delighted to be part of this charity effort. Also, this is a good opportunity to show the world that Thailand is now recovering from the flooding crisis,’’ added Paradorn. Suwat Liptapanlop, president of the Lawn Tennis Association of Thailand, said proceeds from the estimated Bt6 million in ticket sales will go to flood relief. Tickets for the 3,000seat Centennial Park will be Bt2,000. Suwat added that all the players would be involved in promotional activities to boost local tourism. “Wozniacki will arrive on December 26, Isner and Azarenka on December 29. They will be doing activities such as cooking Thai food, giving alms to monks or having spa treatments,’’ said Suwat who revealed that Bt20 million will be spent in organising the exhibition match. Azarenka will make her first appearance in the Kingdom. The Belarusian has won eight WTA titles, three this year. “I am really pleased to

come and play for the Thai fans and help raise money to assist the millions of people affected by the devastating floods.” Since September, many provinces in Thailand including some parts of Bangkok have been hit by the worst floods in half a century.

Hua Hin should Promote “Thainess” Pledge by The Prachuab Khirikan Governor – Khun Weera

T

he Prachuab Khirikhan Governor already endorsed a tourism campaign on promotion of unique Thai art and culture in Hua Hin and supported activities by the Hua Hin Cultural Council as a highly successful performance indicator on Thai identity. According to the Governor, presently, tourists from Europe, Scandinavian and even ASEAN countries are visiting Hua Hin and Prachuab Khirikhan more than any other Thai provinces. Most of them come here to admire natural wonders and local culture the places have to offer. As a result, as members of all Thai citizens, the Hua Hin and Prachuab people should express and show visitors unique Thai identity and culture which can not be found elsewhere. The Governor added that cultural performances, such as stage performances, Thai dance and parades need to be promoted in a concrete way by people from every part of the country so that foreigners can enjoy culture which Thai people have inherited from the past to present. In 2011, Hua Hin organized a lot of cultural activities, namely the 100th anniversary of Thai railway in which participants dressed with traditional and contemporary Thai costumes for evening activities. Lately, the Hua Hin Cultural Council has organized an activity to foster Thai

culture and community relation in which local students participated in a colorful revue and distinguished guests dressed in a retro style for a charity fashion show. Both the activities made Hua Hin and Prachuab Khirikhan well-known among tourists because they manifested core tradition and culture of Thai people to the eyes of both Thais and foreigners. This also made Thailand famous among people in other lands beyond for its unique identity. Mr. Weera also stated that the physical growth of Hua Hin in terms of art and culture run by private business owners vis-à-vis urban development can be seen through the popularity of Plern Wan, Hua Hin Floating Market, Sam Pan Nam Floating Market, the Hua Hin Artists Village, Vic Hua Hin and Cicada Market. Since the places successfully employ local Thai identity as a selling point, governmental authorities need to give them long-term support. Apart from the tourist attractions mentioned above, Hua Hin is also a place where the Klai Kangwon Royal Palace is located. The residence where Thai monarchs, including His Majesty, stay, Klai Kangwon Palace is a much favored tourist attraction for both Thais and foreigners. So, Hua Hin and Prachuab people should be proud of their unique identity, concluded the Governor.

Participants and media assembled at Centara Grand at Central Plaza Ladprao Bangkok on Friday 16th December 2011 and left the hotel to embark on a 225-kilometre journey to the splendid colonial-style resort of Centara Grand Beach Resort & Villas Hua Hin. En-route, there were stops at Phetchburi province for sightseeing and lunch. Before arriving at Centara Grand Beach Resort & Villas Hua Hin, the parade visited the Hua Hin Floating Market. Now in its 9th year, the Vintage Car Paradel featured a wonderful welcome dinner at Hua Hin Market Village with a long buffet of 50 exquisite dishes cooked by gifted chefs from the five-star member hotels of the Hua Hin Hotelier’s Club. Live entertainment l complimented the evening’s dining. The dinner was also open to the public at Baht 284 net per person. The Public could enjoy a ride in a rare vintage car for Baht 250 per trip, and the revenue from this activity was donated to Chaipattana Foundation. Then, the Vintage Car Parade toured Hua Hin. All participants dressed up in a period costume. After returning to the hotel, participants joined a cocktail reception in the garden before a gala dinner, with a gourmet buffet, sparkling entertainment, charity auctions, lucky draws with chances to win room packages to stay at various Centara Hotels & Resorts and a period costume competition. Mixed outlook

for office markets in Asia Pacific

P

reliminary data from Jones Lang LaSalle shows that grade A office rents will fall in Hong Kong and Singapore in the fourth quarter (Q4) of 2011 and will grow more slowly elsewhere in Asia Pacific. Jones Lang LaSalle’s market leasing experts predict that Hong Kong and Singapore are entering a rental level correction phase, with anticipated percentage falls in average grade A rents in the final quarter of the year of five to six percent in Hong Kong and around four percent in Singapore (to US$1,643 per sqm and US$786 per sqm per annum respectively). Some office markets are expected to experience continued rental increases in Q4, albeit at a slower rate than previously, including Beijing (circa five per cent to US$814 per sqm per annum) and Sydney (four to five per cent to US$470 per sqm per annum). In the middle ground Jones Lang LaSalle expects to see a number of markets where rents will remain largely static quarter on quarter, including Melbourne, Mumbai, Delhi, Seoul and Tokyo. Jeremy Sheldon, managing director, Markets Asia Pacific at Jones Lang LaSalle said: “Overall rental growth is expected to soften this quarter. The stand out trend across many key markets is a softening of demand from occupiers, as firms are applying caution in light of economic difficulties in the United States and the Euro-zone. We expect corporates in Asia Pacific to remain cautious for the remainder of this year and into next as they wait to see how the region will be impacted by what is happening elsewhere. We do expect to see continuing demand in certain markets where there is a strong domestic focus – China, Japan and India and emerging markets in South East Asia – however the more transparent markets are where occupiers are far more cautious.” Hong Kong There is clear delineation between Central and other sub markets. Leasing activity in the banking and finance sector has slowed considerably and Jones Lang LaSalle expects to see some firms in this sector looking to downsize in 2012, though not to the same degree as in 2008 and 2009. The firm is seeing some very moderate expansion amongst law firms and

some other businesses that are choosing to relocate to lower cost buildings. Rental growth is not expected in Q4 2011 as a result of low vacancy rates and the decentralisation trend. Singapore Jones Lang LaSalle is witnessing a weakening in net new demand, and secondary supply that is being returned to the market is being absorbed quite slowly. Although some surplus space has become available from major financial institutions, there have been no major headcount reductions in any of the key business sectors. China In Shanghai landlords continue to have higher rental expectations in light of the low vacancy rate and limited new supply. Tenants, particularly multi-national corporations, have recently been more cost conscious due to growing concerns about a slowdown in China’s economy. In Beijing rents have continued to rise at a slower pace than their rapid increase over the past 12 plus months. Leasing demand remains strong on the back of expanding space requirements from existing tenants and more new setups, though some landlords are being more flexible with leasing terms in specific cases. Bangkok The recovery process in the Bangkok office market was interrupted by the recent flooding, As companies were focusing primarily on business continuity plans in order to deal with possible impacts of the flooding, the market saw a marked slowdown in leasing activity between October and mid-November. However, as central Bangkok where most of the office buildings are located has been safe from the

disaster, leasing activity has resumed as the flood has receded. Australia In Sydney there is continued rental growth driven by tightening premium supply coupled with activity by larger users upgrading and/or relocating to the CBD. Decision making is becoming more protracted but relocation decisions are still being made by tenants with definitive needs. There is sustained demand in the 4,000 to 10,000 sq. m and sub 500 sq. m range, but we are also seeing a slight increase in sub-lease space. In Melbourne there is cautious demand and tenants are exploring the suitability of using alternative workplace strategies to reduce their occupied footprint. Development activity is continuing, but there is very limited speculative supply. Japan Landlords in central Tokyo have seen good demand for new developments in the aftermath of the earthquake and given low vacancy rates, rents are unlikely to fall further. However, the market is not expected to support any rental increases over the next one to two quarters given the impact on demand of the strong yen, uncertainty in the Euro-zone economies and a possible global economic slowdown. Korea There is healthy demand from domestic firms but multi-national corporations are becoming noticeably more cautious. Many recently completed buildings in Seoul have high vacancy rates, which is putting pressure on rents in the Central Business District. Any economic downturn is likely to exacerbate the current over-supply situation and delay rental recovery (especially in the CBD where most foreign financial institutions are located). India In both Mumbai and Delhi there is sluggish new demand, and rents are not likely to increase over the quarter due to ample supply. In Mumbai some tenants are deferring decisions regarding relocation to the Secondary Business District as a result of perceived uncertain economic conditions.

he 2011 Thanachart Bank Thailand Property Awards were held on December 6th at the Grand Hyatt Erawan Hotel in Bangkok. A highly anticipated event in the country’s business and social calendar, the Gala Dinner and Awards Ceremony was attended by more than 600 CEOs, managing directors, developers and other senior management figures from the national and regional property sector.

With 31 dedicated categories, the awards have become a benchmark for quality in the property industry and the evening’s winners included Thailand’s best condominiums, villas, commercial and housing developments, as well as awards for best architecture and interior design in the Kingdom’s residential, hotel and commercial sectors. “Over 1,300 nominations were received this year, and from those over 250 entries” said Terry Blackburn, CEO of Ensign Media, the organisers of the event. “This is a clear reflection of both the success of the awards and the strength of the Kingdom’s real estate industry. An important new element this year is welcoming Thanachart Bank as title sponsor of the awards. We are confident that working together with one of Thailand’s leading and most dynamic banks now and in the months ahead, will have a very positive effect both on the awards and on the real estate industry as a whole. The Thanachart Bank Thailand Property Awards will become the gold standard of quality for the industry.”

he Bangkok floods have caused developers and property firms to re-evaluate their strategies for next year. The floods affected 300,000 homes in Bangkok and the surrounding areas. Many developers believe the City Planning Department of the Bangkok Metropolitan Administration (BMA) must include proper floodways in residential areas in the new plans. Property firms have learnt from the floods and they are revising their construction processes, designing homes which can withstand floods and spending more on landfill to raise houses above flood level. The increased use of landfill in flood hit areas will raise construction costs by 1.5 per cent for detached houses and 3 per cent for townhouses. Pruksa Real Estate have lowered their projected revenue target for this year from THB30 billion (US$960 million) to between THB22 billion (US$704 million) and THB24 billion (US$768 million) according to The Nation. Business Housing Association president IssaraBoonyoung, who owns Kanda Group, agreed that the BMA had to take flood prevention into account before releasing the new plans.

Partnering with the Thailand Property Awards is part of a strategy that will see Thanachart Bank offer its customers quality banking support in association with the kingdom’s best, upscale developers and real estate companies. Khun NathapolLuepromchai, Senior Vice President, Housing and Secured Personal Loan, Thanachart Bank Plc said: “We’d like to congratulate all of the winners tonight. These awards not only guarantee the quality of projects that bring great pride to the developers, but from the client’s perspective, recognising award-winning projects will help investors and buyers make an easier purchase decision as all the winners have been through a tough selection process by the judges. Moreover, we will follow up on the event by offering special interest rates and conditions to the developments voted the industry’s best.” As a special contribution to the flood recovery effort taking place in and around Bangkok, the Thanachart Bank Thailand Property Awards, in collaboration with Habitat for Humanity, also conducted a fundraiser in order to raise THB400,000 for the construction of two new houses for flood victims in Lopburi. ” We greatly appreciate everyones’ generosity enabling Habitat for Humanity Thailand to assist those affected by flooding,” said ChamnarnWangtal, CEO of Habitat for Humanity Thailand. “There are so many needs to be met and tonight’s fundraising contribution will help families whose lives were washed away to have a decent place to call Best Residential Architectural Design - The Residences at The St. Regis Bangkok Best Condo Development Thailand - Habita Architects for SonevaKiri by Six Senses Resorts and Spas Best Residential Development (Hua Hin) -CB Richard Ellis (Thailand) Co., Ltd. plan is needed. Millions of Thai homes have been affected by the high waters and developers are recording slump sales as buyers adopt a wait-and-see approach. When the floods eventually recede, what will emerge is the need for better city planning regulations – the latest set of regulations expired in May this year and has been extended for an additional year while regulators struggle to develop a replacement – and a re-evaluation of the location, design and management of residential real estate. “The decision as whether to purchase landed property versus a high-rise condominium will likely be in favour of the latter due to the floods,” claims a report on the effects on the real estate market in Bangkok from Colliers International, “ but

“This is not only for property firms to manage their residential projects. This is necessary for home-buyers to know which locations are safe from floods,” he said. According to REIC figures, the Greater Bangkok property market will drop by 10 to 20 per cent this year because of the floods. The number of new condominiums in Greater Bangkok will be 24 to 31 per cent lower this year compared to last year, from 66,000 units in 2010 to 45,000-50,000 units in 2011. The number of new low-rise detached houses, duplexes and townhouse will drop by 7 to 16 per cent from 54,000 units last year to 45,000 to 50,000 this year.

very golfer has heard of The Royal & Ancient (The R&A) as some stage of their golfing careers. These are the guys who administer the game of golf all over the world (with the exception of the US & Mexico). They set the Rules of Golf & are the organizers of The Open Championship each year. Over the past couple of years, The R&A have begun an international educational program for golfers & golf industry professionals in the importance of sustainable management of golf facilities. They are focusing on the major subjects such as Playing Performance, Economic Performance, Environmental Stewardship & Social Responsibility. Many case studies on golf courses with best practices have been conducted & published on The R&A’s website www.randa.org as a benchmark of how best to achieve the goal of

sustainable management for the industry. One such case study fro Banyan Golf Club Hua Hin was published in June 2011 on the turf managements programs conducted there. Michael Coffey, committee member of The R&A recently paid a visit to Banyan Golf Club to see firsthand the playing conditions & to find out more about the design features and maintenance practices used to achieve this. “I am completely impressed with this wonderful golf course. I enjoyed playing the course with the designer & some of the management which gave me a fuller understanding of how it has developed. The layout & set up is first class, and the choice of native grasses for the majority of the course is exactly what we are trying to teach other courses around the world. Water resources are

becoming more difficult to secure. I just love the natural landscaped areas surrounding the course & around the clubhouse.Very clever indeed. Even my caddy spoke to me about recycling my drinks can during the round.”Mr. Coffey was also invited

to explain his role with The R&A to the dinner guests at the monthly Golf & Wine Dinner held at the golf club. “It is always great to get to try to explain to golfers that course do not need to be emerald green in order to be good courses”.Banyan Golf Club’s General Manager, Stacey Walton, commented, “It is always nice to be visited by the industries ruling body. These gentlemen spend a great deal of time at the home of golf, St. Andrews, and to impress him with our course, its design, playing surfaces and facilities is very satisfying. It is even better when they are here to commend you on being one of our industries best practices”Pictures: Michael Coffey seen speaking to dinner guests at the Golf & Wine Dinner at Banyan Golf Club in recent week, and on the 1st tee box with course designer, Pirapon Namatra and Director of Operations Stuart Daly.

Remembering - Seve Ballesteros One of The Best Golfers

eve Ballesteros, a five-time major champion whose passion and gift for imaginative shotmaking invigorated European golf and the Ryder Cup, has died from complications of a cancerous brain tumor. He was 54. A statement on Ballesteros’ website early Saturday said the golf great died peacefully at 2:10 a.m. local time, surrounded by his family at his home in Pedrena, in northern Spain.Seve Ballesteros, a five-time major champion whose passion and gift for imaginative shot-making invigorated European golf and the Ryder Cup, has died from complications of a cancerous brain tumor. He was 54. Ballesteros, a two-time Masters champion and three-time winner of the British Open, was as inspirational in Europe as Arnold Palmer was in America, a handsome figure who feared no shot and often played from where no golfer had ever been. Headlines such as ‘’The Inventor of Spanish golf’’ and ‘’Life of a Legend’’ were splashed across Spanish media websites as fellow golfers, athletes and figures from around the world paid tribute. George O’Grady, the chief executive of the European Tour, said Ballesteros was the inspiration behind the tour. ‘’This is such a very sad day for all who love golf,’’ O’Grady said on the tour website.

Seve, there was no such thing as trouble,’’ Gary Player once said. ‘’He could manufacture shots like a genius.’’ His last challenge came from an unbeatable foe — cancer. Ballesteros fainted in a Madrid airport while waiting to board a flight to Germany on Oct. 6, 2008, and was subsequently diagnosed with the brain tumor. He underwent four separate operations, including a 6 1/2-hour procedure to remove the tumor and reduce swelling around the brain. After leaving the hospital, his treatment continued with chemotherapy. Ballesteros looked thin and pale while making several public appearances in 2009 after being given what he referred to as the ‘’mulligan of my life.’’ He rarely was seen in public since March 2010, when he fell off a golf cart and hit his head on the ground. His few appearances or public statements were usually in connection with his Seve Ballesteros Foundation to fight cancer. He wanted but was unable to take part in a champion’s exhibition at St. Andrews in the British Open. Such was his stature, even out of the public eye, that European players celebrated his most recent birthday — the Saturday of the Masters — as if it were a national holiday. teed it up in America, a one-shot victory at the Greater Greensboro Open. Partly because of his humble roots, partly because of his Spanish blood, Ballesteros always played as though he had something to prove. Even after some called him ‘’Car Park Champion’’ for his shot at Lytham when he won the 1979 British Open, the Spaniard showed that was no fluke when he arrived at Augusta National the next year.

TRAGIC SPORTS DEATHS

Sports has lost many athletes way too soon. We list a few. He obliterated the field in the 1980 Masters, much like Tiger Woods did in 1997. Applying his genius to a course built for imagination, Ballesteros took a seven-shot lead into the final round and led by 10 at one point until he started spraying tee shots and won by four. Even so, at 23 he was the youngest Masters champion until Woods won at age 21. Ballesteros won the Masters again in 1983, and he was equally dominant in golf’s oldest championship. He won the British Open in 1984 at St. Andrews over Tom Watson, then won again at Lytham in 1988 by closing with a 65 — the best score of the tournament — to beat Price and Nick Faldo. His career was marked by nasty disputes with European tour officials and PGA Tour officials. He quit the European tour in 1981 in a disagreement over appearance money, the only year he missed the Ryder Cup. He became angry with PGA Tour commissioner Deane Beman in 1985 for not playing the required 15 events for membership. Despite his five majors and 87 titles around the world, Ballesteros forever will be linked to the Ryder Cup. He developed an ‘’us against them’’ attitude that became infectious with what had been an inferior European team. He made his teammates believe. Ballesteros was headed for defeat in 1983 at PGA National, his ball beneath the lip of a bunker, some 245 yards from the green, when he lashed a 3-wood to the fringe and escaped with a halve against Fuzzy Zoeller. The Americans narrowly won, but the Ryder Cup was never the same after that year — and perhaps after that shot.

ALWAYS A FIGHTER

In golf and in life, Seve Ballesteros never gave up, Robert Lusetich says. ‘’His desire to beat the Americans was paramount, and probably the reason they beat us,’’ Watson said. ‘’The Ryder Cup became the focus of world golf, and Seve was right there as the leader.’’ He teamed with Jose Maria Olazabal to become the most formidable partnership in Ryder Cup history, producing an 11-2-2 record. In his final Ryder Cup, at Oak Hill in 1995, he was playing a singles match against Tom Lehman when Ballesteros drove wildly to the right. A TV commentator said his only two choices were to pitch back to the fairway or play a big hook around a massive tree. Ballesteros studied his options, then hit over the tree to the front of the green. Such was the unpredictable nature of Ballesteros. There have not been many like him, if any at all. ‘’Seve is a genius, one of the few geniuses in the game,’’ Ben Crenshaw once said. ‘’The thing is, Seve is never in trouble. He’s in the trees quite a lot, but that’s not trouble for him. That’s normal.’’ On Friday at the Spanish Open, Jose Maria Olazabal and Miguel Angel Jimenez — good friends of Ballesteros’ — were in tears as they came off the El Prat golf course upon learning of Ballesteros’ deteriorating state. Olazabal and Ballesteros combined to form one of the greatest Ryder Cup pairs in history. ‘’What he did in sport is unbelievable,’’ topranked tennis player Rafael Nadal said on Friday. ‘’These are tough moments.’’ Ballesteros and his wife Carmen divorced in 2004. They had three children together.

Property Disputes

iam Firm Inter Laws was established by Khun Somsak Chopaka an Attorney at Law with 30 years of working experience in domestic and international law, for individuals both foreign and local, domestic entities and in-house legal counsel for numerous established international companies. Khun Somsak will be giving legal advice about the ever changing situation in regards to Thai Law and keeping readers up to date with the constant changing business and social environment here in Thailand.

After a few weeks of writing and presenting articles in this column introducing Siam Firm, starting on from this week we will write about real case stories that our firm has handled and use our experience to help you with the ways to succeed in a law case. Sometimes we have to say that you cannot win a case all the time, but there are ways for you to gain benefits so that we can get more than normal with regards to a case. The most common case that we have in Thailand is with a foreign man and Thai lady or Thai girl; who bought property and put the property under the lady/girl’s name. Normally you will be in agreement to share the property fifty – fifty after a divorce or separation but that is not always the outcome in reality. The first way is to avoid this dispute by buying the property before you register for marriage, this is the best way to protect your investment, as the property will not come to be the asset of the spouse and we can easily ask for the property back. The second way is almost the same but concerns being a defacto common law couple not a married couple. One very important piece of evidence for these two cases is the bank statements regarding to the transfer of funds into the Kingdom that you use to purchase the property. With this evidence you can prove to the court that the all the money is yours and the court will give you a chance to compromise on the case. With our experience this compromise will be in the form of paying the lady/girl a few hundred thousand baht and case will be solved easily. But there are also some difficult girls and you may have to pay more, consider this fee on a case by case basis. The third way is in the case of marriage, whenever you purchase a property and place under a Thai wife’s name you will have to go with her to the land department on the transferring date and sign a consent form. This form puts you in a bad position as on the form you have to say that the money is not yours and all belongs to the girl, which is the first condition of the form. The second condition is that you will not as for the money back at all. Although the form is in English and Thai some words are Romanized Thai for example “sin suan tuay” (private property) and you will not understand the form fully. The way to fight a case like this is to submit for divorce and to share the property or you can say that all of the property was bought with your money only. On the worst case scenario you will have to split fifty – fifty but again during the case you will have the chance to compromise and if you want to keep the property under your name (Company name) you will have to prepare a few hundred thousand baht to pay to your spouse. Our Comment: For a frequent case like this it is common court procedure for a judge to ask the Thai lady/girl’s side to compromise and accept the money, because all the money that was used to purchase the property was paid for by the foreign man and the Thai lady/girl never paid any money for the property at all. If you have your own case or any questions regarding Thai law you can write in to us and we will answer any questions or concerns in this column. Charity Fundraising

by Skal at The Hyatt Regency

A

formidable wine dinner was organized by the Skal group at the Siam Winery Restaurant in Monsoon Valley. A wine probe was held in the midst of the vineyard at the Elephant base where the latest wine products could be tested. Needles to mention that all patrons attemnding were wine specialists but it was good to see Nail Keddy of Mondo Vino handing out his expertise on request. The dinner was a selection of tropical fruit cocktail and a choice of main courses such as pan fried SeaBass, giant pork cutlet and ribeye steak. All well done by junior Chef Ick, a Cordon Blue – Dusit trained Chef. Kuhn Hanna and her team did a splendid job in presenting Siam Winery Restaurant and many of us would wish they were open at least once a week on Saturdays, for example, for a candle light dinner. A presentation by Scott Resch of Mandarin Media on a promotion website for Hua Hin as a top tourist destination which will be generated on Google´s first pages as it grows.

FLOOD CHARITY FUNDRAISING CONCERT BY SKAL CLUB AT HYATT REGENCY HUA HIN

S

KAL Club of Hua Hin and Cha Am, in cooperation with Rotary Club of Royal Hua Hin and The Hyatt Regency Resort & Spa, presented a flood charity fundraising concert “Reach out, Rebuild and Restore” featuring Nan Sathida Prompiriya, a lovely Thai singer, the winner of five “Gold Medals” for Thailand at the World Championships of Performing Arts 2011 in Los Angeles California USA with a beautiful medley of popular songs and Paul Bankes, a Canadian musician, classical guitarist, owner of Suey Vista on Soi 94 where live music is played, performing Spanish and South American classics. Paul also accompanied Khun Nan with“Bridge over troubled water” with Bruce, “The Fiddler on The Roof” on violin. The “Irish” boys with Barry concluded the performances with a beautiful Irish song and a less compromising Irish drinking song. The concert took place on Saturday, December 3, 2011 from 6:30 pm onwards at the Grand Ballroom, Hyatt Regency Hua Hin. The proceeds from this fundraising concert went directly towards the rehabilitation of Wat Kong-Sa Primary School in Ayutthaya which was severely affected by flooding. The Hyatt Regency Team led by Sammy Carolus, the General Manager, Ben Perera and Chef Mitele, The PR. Department , Human Resources and Engineering team set up a fantastic programme including a delicious Cocktail Buffet and an endless flow of wines, juices and beer and a Dessert Buffet at the Intermezzo. Through the programme and auction, the Editor of Hua Hin Today, generally known as “Khun Jerry” professionally guided the guests and performers as Master of Ceremonies. Numerous lucky draw tickets and bids for objects including a Louis Vuitton lady´s bag were auctioned off. A life auction saw Paul Banks and Pirates sold to a party on board of the Sun Cat , a solar powered boat for a coastal trip of 5 hours with 15 guests. Two Golf Pictures with signatures of Golf Greats were donated by the Banyan Golf Club and auctioned off for considerable amounts. All in all, Approx. Baht 400,000 was collected that evening. A cheque for that amount was presented to a delegation of the Wat Kong Sa school consisting of teachers and students. A Sunday morning call to the MC announced an additional Baht 150,000 collected by Lars Castelund of Black Lotus and friends. The incredible amount of Baht 550,000 was now reality.

A delegation of Hua Hin will visit the school as soon as the restoration works are finished. Among the VIP guests were the Hua Hin Major Khun Jirad and VizeMajor Khun Suwit and numerous members of Hua Hin Society. Thank you to Skal for the initiative. This Auction of Charity showed precious fellowship among the donators. We are sure the school is in need of stationery, computers and other accessories. Children´s Day–January 14, 2012 Children in Thailand will celebrate the Thai Children´s เทศบาลเมืองหัวหิน Day on Saturday, 14 January 2012. เตรียมจัดงานวันเด็กแห่งชาติ

T

he Hua Hin Municipality will host the event at the 19-Rai Queen Sirikit’s Memorial Park. According to the city mayor, Thailand officiates the Children Day on the 2nd Saturday of January. Formerly, it was held for the first time on the 1st Monday of October 1955 following the recommendation of Mr. V. M. Kulkarni, the representative of the UN’s International Commission on Child Welfare. In 1965, this event was changed to the 2nd Saturday of January, after cancellation in 1964, and has taken place on the day since then. The main purpose of the Thai Children Day is to raise concern among Thai adults on potentiality of children who will become the future of the country. By taking part in activities held by private and public organizations, children will learn about their role in national development in the future, their rights, responsibilities and disciplines towards society. The Children Day in Hua Hin will feature activities that promote children’s creativity. Apart from prizes and souvenirs children will get, food and drinks will be available for them for free throughout the day. Spa Techniques

35

In Hua Hin , you encounter a broad collection of Spas. Some offer Thai Massage and others Swedish Massage. What are the different Techniques and who benefits from what? Youth Enhancing Facial Massage, Cellulite Reduction Massage & Scar Tissue Therapy, Stone Massage, Abhyanga (Ayurvedic/Indian Massage), Hydro-Thermal Therapy (also see Water Movement Therapy), Scrubs & Wraps, Raindrop Therapy (Aromatherapy/Essential Oils Massage)

Spa Techniques Spa Techniques encompass a variety of body treatments administered in a spa and some can be done in your home. My Youth Enhancing Facial Massage, Cellulite Reduction Massage & Scar Tissue Therapy are always available. Others may need the use of a spa when available to me. Fees for Spa Techniques are individually priced when they are available.

Youth Enhancing Facial Massage

Regular facial massage can lead to firmer, smoother, more radiant skin by minimizing sagging and fine lines, releasing impurities and toxins, normalizing moisture balance, releasing tension and maximizing your skin’s natural radiance. I will also teach you facial exercises to tone facial muscles, creating a more youthful appearance.

W

Cellulite Reduction Massage & Scar Tissue Therapy Using crossfiber friction, transverse friction and myofascial type techniques (and cupping for cellulite), scar tissue and cellulite can be broken up where a new healing process will begin in the area affected. For scar tissue, emotional release often occurs during this therapy because of related cell damage attached to a trauma (it also can be slightly painful to break up this old tissue or cellulite). I provide nurturing support to help you through this process.

Stone Massage Stones of all shapes, and sizes are used to elicit healing, relaxation, and a connection to the earth. Warm stones provide soothing heat for deep-tissue work. Being massaged with warm stones is most enjoyable. Where as cold stones aid inflammation. Stones are placed in varying positions on the body for balancing energy, and/or stones may be used for specific trigger-point work. Instructor Kathy Padecky – Mueller College

Abhyanga - Ayurvedic Massage

Abhyanga is one part of the traditional detoxification and rejuvenation program of India called panchakarma, in which the entire body is vigorously massaged with large amounts of warm oil and herbs to remove toxins from the system. With the client’s permission, oil is also poured

into the ears and nose, between the eyebrows and at specific chakras, or energy points, during techniques known respectively as karna purana, shirodhara, and marma chikitsa. These treatments have been modified to meet the needs of the West and have been powerful in their effects upon the mind and nervous system — calming, balancing, and bringing both a heightened sense of awareness and deep inner peace. The techniques can be done either as standalone treatments or in conjunction with the ayurvedic body massage. The basis for effectively performing all of the various ayurvedic massage techniques is a thorough understanding of the primordial energies of the five elements (ether, air, fire, water, and earth) and of vata, pitta, and kapha — the three basic constitutional types (similar to the ancient Greek method of mind/ body classification). This knowledge allows the therapist to determine not only which ayurvedic massage techniques to use, but also how to customize treatments by selecting the proper oils and herbs and the rate and pressure of massage strokes to maximize the benefits for each client. (Description - from ABMP) Instructor Stephanie Saunders – Meuller College (and the Chopra Center)

Hydro-Thermal Therapy

Although ancient Greece and Rome had both adopted the beliefs that water had healing properties, it was the Romans to first integrate hydrotherapy into their social life, building temples and baths near natural springs. Father Sebastian Kneipp from Worshofen, Bavaria, however, was the true father of modern-day hydrotherapy in Germany. Various hydrotherapy massage techniques exist and are generally utilized by massage/bodywork practitioners, physical therapists, physicians, and spa technicians. (Description - from ABMP) I use water movement therapy and hot packs (when available)

Scrubs & Wraps Enjoy exfoliating scrubs and herbal wraps to sooth muscles, exhilarate the senses, and ease the mind.

Raindrop Therapy

(Aromatherapy/Essential Oils Massage) Bringing the body into structural and electrical alignment, oils (primarily thyme, oregano, birch, cypress, peppermint, and basil) are dispensed like little drops of rain from a height of about six inches above the back and massaged along the vertebrae. The oils used in this treatment continue to work for the next five to seven days.

Health & Wellness - Checking your Colon

e are anxious to diagnose diseases early in their course and make the treatment more successful. A good screening test is one that is reliable, will identify the disease in the early stages and one where successful treatment will add years to the patient’s life. Colonoscopy to detect Colon cancer is one of those tests. Everybody over the age of 50 should consider having this procedure performed. A Colonoscopy is a test to look at the inside of your colon. The colon is the large intestine the last part of your digestive system. Its job is to dry and eliminate the waste left after the small intestine has absorbed the nutrients in food. The colon is about 3-5 feet long. It travels from the lower right corner of your abdomen up to your liver, across your body in the upper left corner and then down to form your rectum and anus. Our doctor will use an instrument called the Colonoscope to perform the test. It is a long, thin flexible tube about 2cm in diameter and has on the end of it fiber-optic camera that allows the doctor to visualize your entire colon. Colonoscopy is best known for its use as a screening tool for the early detection of colorectal cancer. Colorectal cancer is the second leading cause of cancer deaths and. often develops from growths within the wall of the intestine called polyps. These growths often take 5-10 years to develop and may not cause any symptoms at all... Most people who develop polyps do so after age 50, the American, British, European and Thai experts recommend screening examinations every 5 years for early detection and removal of these cancer-causing growths after that age. If you have had a close relative suffer from Colon Cancer you should start even earlier. Colonoscopy can also be used to investigate

other diseases of the colon. If you have any signs of rectal bleeding, it may be used to find the cause and location of the bleeding and to check for areas for irritation or sores in your colon. Colon problems can cause unexplained changes in bowel habits. Abdominal pain, bloody diarrhea, and weight loss can be caused by inflammation of the Colon, which may be the result a condition called ulcerative colitis. These inflammatory digestive diseases tend to occur in young adults and, if undetected, can produce chronic symptoms and increase the risk of colon cancer developing later. If you have a bowel problem other tests may be performed initially. Your doctor may recommend a Colonoscopy if other screening tests suggest that further information is needed to make a diagnosis. These other tests could include the following: • A manual rectal examination, • A hemocult test to find hidden blood in your feces,

• A barium enema, a test in which barium is used to make your colon visible on an x-ray or a CT Scan. The Colonoscopy may be required when symptoms of digestive disease or other warning signs are present, that could include the following:. • Rectal bleeding which may appear as bright red blood, or very dark, or black stools. • Pain in the lower abdomen • Changes in bowel habits • Unexplained non dietary weight loss When people hear about this procedure there is a natural reluctance to having a tube inserted into that part of your body. When the test is performed, you will be given sedating medications into a vein to make the test comfortable. These IV medications are given under medical supervision of our trained Anesthetist and you will be monitored during the procedure to avoid the risk of any medication-related problems. Before you have the test, we have to clean out all the contents of the Colon. This system of cleaning the bowel is often called “Bowel preparation”. These medications produce diarrhea, which can be uncomfortable, but unless the bowel is empty of stool the doctor will not be able to inspect the wall of the Colon. Colonoscopy is well-tolerated and rarely causes much pain. You might feel pressure, bloating or cramping during the procedure. You will lie on your side or back while your doctor slowly advances the colonoscope through your large intestine to examine the lining. Your doctor will examine the lining again as he or she slowly withdraws the colonoscope. The procedure itself usually takes 20 to 40 minutes, although you should plan on two to three hours for waiting, preparation and recovery. If your doctor thinks an area needs further evaluation, he or she might pass an instrument through the colonoscope to obtain a biopsy

(a sample of the colon lining) to be analyzed under the microscope. . If colonoscopy is being performed to identify sites of bleeding, your doctor might control the bleeding through the colonoscope by injecting medications or by coagulation (sealing off bleeding vessels with heat treatment). If your Doctor finds polyps during the colonoscopy, they will most likely be removed during the examination. These procedures do not usually cause any pain. Polyps are abnormal growths in the colon lining that are usually noncancerous. They vary in size from a tiny dot to several inches. Your doctor cannot always tell a benign polyp from a malignant (cancerous) polyp by its outer appearance, so the removed polyps will be sent for analysis. Because cancer begins in polyps, removing them is an important means of preventing colorectal cancer. Bangkok Hospital Hua Hin has a very experienced Doctor to perform the Colonoscopies. Dr Wacharaporg Luangparat is a specialist in Gastro-intestinal medicine and is an expert at performing Colonoscopies. You will feel safe in his hands. After the Colonoscopy, you will be sleeping for 30-60 minutes under observation. If you have any symptoms such as stomach pain, chest pain or bleeding should inform the nurse immediately. You will be given an appointment to visit the doctor for follow up and discuss results You should have someone pick you up when you are ready to go home, as you cannot drive after the procedure. If you have any inquiry on the procedure or would like to schedule appointment, please contact the Hospital. Dr Michael Moreton. Criminal Law in Thailand - Part VIII

Your rights if you are arrested

by James Finch and Nilobon Tangprasit of Chavalit, Finch & Partners, Ltd.

A

s mentioned earlier, many police speak only the Thai language. Once you are under arrest and brought to the inquiry office, the police station, for example, an interpreter competent in your native language must be provided for you. This requirement of a translator is at state expense and applies for all stages of the proceeding, for example, preliminary hearings, trial and sentencing. If you do not get an interpreter or you want to use one you designate and compensate yourself, you have a right to do so. The same rights apply to the case of an arrestee who is hearing or speech impaired. You must be provided with someone who can sign, so that you understand and can express yourself at every stage of the proceeding. The rules about interpreters, incidentally, also apply to witnesses to crimes. So if you are brought to a police station to give a statement about a crime that somebody else has allegedly committed, an interpreter must be appointed for you. There are other items that have to be explained to you by the police if you are arrested:

You must receive an explanation of the reason for the arrest and a copy of the arrest warrant, if there is one. You can make a statement, but that the statement can in the future be used against you in evidence at a trial. You have to right to call and have a lawyer present, meet with the lawyer in private and have the lawyer attend hearings in the proceeding with you. You can call a relative, friend or other party, and the police have a duty to let you use a telephone to do so. You can also request that the police contact these parties on your behalf. You have a right to medical treatment if you need it. But when do you have to have these rights explained to you? The arresting police officer has a fair amount of discretion as to this. For example, let’s say you’re arrested in a nightclub, and it’s crowded and difficult to hear in there. The police in such a case would clearly have the authority to arrest you and take you outside. At the first possible moment, however, you must be told 1) the reason for the arrest and shown a copy of the warrant, if there is one, and 2) that you can make a statement, but if you do, it may be used against you in evidence at trial. If you ask that someone be notified of the arrest, the arresting officer must, under reasonable circumstances, do so. When you arrive at the police station all of the rights in the list above must be explained to you, even though some of them have already been told you by the arresting officer. How much delay by the arresting officer is permissible in telling you your initial rights as discussed above? The delay must be reasonable. Certainly, in our example, if you’re taken outside the nightclub and immediately told these rights, this would be adequate. But what if you’re then left locked in a police car for a few hours? Or taken somewhere, left alone in a

locked room and no one explains anything to you? In these cases, the police would have the obligation to explain the above rights to you, before you were locked somewhere. Let’s say, alternatively, that inside the nightclub, when the police tried to make the arrest, you put up a fight and tried to hit one of the arresting officers with a beer bottle? The police would have the right to take the action they consider necessary to effect the arrest. This might delay their obligation to let you know about your rights. For example, if they felt you would fight with them until they had you in a secure location, say, at the police station, they could wait until then. Bliss Spa at The Banyan Resort

The Bliss Spa at The Banyan Resort and The Lemon Grass Restaurant

A

bit hidden between the Banyan Resort Villas on Petschkasem Road , slightly South of Hua Hin and after Vic Hua Hin, The Bliss Spa is located. Upon arrival at the Banyan Resort Reception , a lovely smile embodied in an even more lovely receptionist greets the guests and upon request leads them to the Bliss Spa where I was greeted with a herbal refreshing tea.

Khun Apple is the Spa manager and one of the Therapists. There are three double treatment rooms with individual bathrooms. The Spa menu is very comprehensive and contains from Thai massage to Swedish (signature Treatment) but you are well off requesting an analysis of your skin and wellbeing. Needless to say , this Gaeh Leo ( old fa…t) needed a dead skin removal which made me fear a bit as there might not be much left over of me. However after consulting

Khun Apple, we agreed on a spice skin scrub consisting of luke warm water , sesame and thyme and other highly secret ingredients. The rubbing in was done gently and I smelled like a Christmas cake. Trying not to fall asleep after long working hours, I was turned over gently and the same procedure continued. It must have taken about 30 minutes after which I had to wash off the drying residues including hundreds of square millimeters of, my now, not so precious anymore , skin. I felt great but the best had still to come; Hot Thai herbal compresses to open the pores and feed them with rejuvenating aromas and precious oils. The thorough Thai Massage , concentrating on my little aches took another hour after which I had to look down to see whether my feet were touching the earth. Great Treatment. The Spa itself is nested within a Villa and is kept simple, contemporary and comfortable. It

was one of the first massage tables on which I did not feel uncomfortable facing down staring into the traditional ever returning Lealawadee Flowers ( Frangipani) or white lotuses. It must be the way they fold the towel you put your face on. After finishing the treatments , Khun Apple served Ginger Tea and I was on my way for a treat of dinner specials by Chef What, the new Executive Chef of The Lemongrass Restaurant. Chef What decided to go a bit Italian Mediterranean and served his signature dishes as they are called these days. As starters , there was a welcome drink which was a basil pineapple mix, a bit foamy , interesting and refreshing. As seconds we had a very interesting cream potage with thinly sliced potatoes. A tuna tartar was next, familiar but always welcome. Crab cakes with special sauces tasted familiar but you could taste the little addition with made it special. No ordinary crab cakes fried in some plant oil! Now serious food was served and we definitely enjoyed the duck slices with and the Cheesy Gnocchi. A bottle of Rufino, Italian Red Wine, crowned the dinner at which I was accompanied by Richard Mehr , GM of Banyan my lovely wife and daughter who enjoyed a Pizza Margarita as most kids do. As we waited for desserts, it was clear that , being a bit out of Hua Hin, you will hardly

walk in to this great place. Instead the word of mouth and of course Hua Hin Today can contribute towards spreading the word. At Lemongrass you can come early for a cocktail and a round of Pool at the Sports bar after which seating at the Lemongrass is either outside or air conditioned inside. In December and January , the fresh breeze outside makes it altogether nice and smokers need not hold back or disappear for an unhealthy tobacco. The Banyan offers, in addition, great Pool Villas and an 18 holes International Golf Course. It is 3 minutes away from the beach and the shuttle service to and fro the Golf Course or Hua Hin City is superb. Call for further information : 032-616200

Mobile & Tablets Revolution

High Tech in 2012

Breaking News : Australian Court denies Apple´s request to ban sales of the Samsung Galaxy Phone and Tab

S

amsung Australia’s mobile chief says that far from killing its Galaxy Tab 10.1, Apple’s court case was almost a blessing in disguise that made the product a “household name”.

The Mobile Phone Competitors:

Samsung’s tablet will arrive in Australia stores this week after a Sydney court on Friday denied Apple’s request to appeal to the High Court an earlier ruling that reversed the ban on sales of the Galaxy Tab. Some carriers such as Vodafone have already been accepting pre-orders. But when asked whether the court action - which Apple launched after claiming Samsung “slavishly copied” its iPad - was the best marketing Samsung could hope for, McGee was under no illusions about the boost Apple’s case, and the subsequent media coverage, provided. “At the end of the day the media awareness certainly made the Galaxy Tab 10.1 a household name compared to probably what it would’ve been based on the Apple: Latest Mobile phone - iPhone4 investment that we would’ve put into it from a marketing perspective,” he said.

US Court Once More postpones Ruling in HTC Lawsuit Against Apple A US court has postponed the final ruling that it was to deliver on lawsuit filed by HTC, the world’s No.4 smartphone maker, against Apple Inc., reports Reuters. According to HTC, the court has postponed the final ruling until December 19. The International Trade Commission (ITC) was to give its ruling on Wednesday. This ruling is very crucial for HTC. The original date of the final ruling was December 6, which was postponed until December 14. The ruling has once again been postponed, and the reason for the Samsung: Galaxy 2S & Galaxy Tab 10.1 delay is not available. ITC is a trade panel in US that investigates different patent infringement matters involving imported goods. HTC for the past some time is struggling with legal battles with Apple and Samsung. It is also getting stiff competition from these companies. An adverse ruling in this case may result in complete ban on import of HTC handsets in the US. Many industry experts consider this lawsuit as a proxy for the larger fight for market share between Google and Apple. HTC is one of the many companies which manufacture Google Inc’s Android cellphones and tablets. Another Android product manufacturing company,Samsung is also fighting a legal battle with HTC: Incredible S Apple at a number of fronts.

Best Mobile Phones & Tabs What is the best Moblie Phone for you?

Best Mobile Phone tips :

We’ve all got at least one mobile phone each, right? The trouble is, how do you decide which is the best one for you? The last update saw the Samsung Galaxy S2 nabbing the top spot - the combo of Android 2.3 and a beautiful screen in a tightly packaged body saw it head straight to the top of the pile. Apple will also soon release the iPhone 5 which promises to be an upgrade of the iPhone 4. This will probably go on forever. As far as Apples and Nokias and Samsungs are concerned we may need/want a new phone every year. HTC is a good phone but so is Nokia which is desperately struggling to keep up with the Androids and Apple. Keep in mind that we are only G3 in Thailand and that an 8MP camera is only as good as it´s lens and screen resolution. And then it is AIS vs. Dtac vs. True etc…. If that still doesn’t help, well, there are always extensive mobile phone reviews pages as well on the internet. If desperation get´s hold of you, there is a Nokia for 800 Baht at Tesco that will solve all technical fantasies as long as you just want to call and be called. Find some smart comparisons for our aficionados in our review. Your Editor

Phetchaburi - Vintage Cars Parade in town

By Sorravit

F

rom 16 to 18 December 2011, people in Phetchaburi welcomed a lot of vintage cars coming from outside the province to attend the 9th Vintage Car Parade. Organized by the Sofitel Centara Grand Resort and Villa in collaboration with the Vintage Car Association of Thailand and the Tourism Authority of Thailand (TAT), the 9th Vintage Car Parade aims to promote tourism in Phetchaburi and conservation of classic and invaluable old cars in Thailand. This annual event is also a good occasion for local people of Phetchaburi because they will have a chance to see beautiful old cars that can not be seen elsewhere in Thailand. The reason why the 9th Vintage Car Parade takes place in the province every year is because the province was once resided by many kings of the current Chakri dynasty, namely King Rama IV who had the Phanakhorn Khiri or Khao Wang built as his own summer palace, King Chulalongkorn who ordered construction of Phraram Rachaniwes or Ban Puen Palace and King Mongkut who had the Maruekathayawan Teak Mansion built here. The Maruekathayawan Mansion, in particular, is the royal residence made only from teak. Located on the beach in the municipal area of Cha-Am, the Maruekathayawan Teak Mansion encourages outside people, especially the elite of Thailand, to build a home for holiday in the city. One of the most famous holiday getaways of Thailand, Cha-Am welcomes over 4 millions of tourists all year round – the highest number compared to other beachfront cities in the upper south of Thailand. Thanks to its convenient location, top-notched accommodations and various tourist attractions, Phetchaburi and Cha-Am offer many recreational activities to visitors. The 9th Vintage Car Parade is also one of those activities highly favored among local people and travelers alike. Not only were the local people impressed with the colorful parade of all classic old cars but the cars’ owners themselves were also happy to pay a visit to Phetchaburi and Cha-Am and take part in activities the event had to offer.

This covers a hilly area with an old palace and historical temples in the vicinity of the town. This summer palace was built by King Rama IV in 1860. It was named “ Phra Nakhon Khiri Palace”, but the folk usually call it Khao Wang. It consists of royal halls, temples and groups of buildings, constructed mostly in harmonious Thai, Western neoclassic and Chinese architectural styles. The Phra Nakhon Khiri Museum on the western hilltop exhibits some royal paraphernalia of King Rama IV and King Rama V, decorative sculptures, and ceramics from China, Japan and Europe. To reach the hilltop, one can either walk or take a cable car. Tham Khao Luang Located 5 kms. north of Khao Wang, this cave houses a Buddha image cast by the royal command of King Rama V as a dedication to King Rama III and King Rama IV. At the foot of the Khao Luang Hill, there is a large monastery called Wat Tham Klaep or Wat Bun-thawi which has a very large hall and a chapel with beautifully carved door panels.

Introduction to the Cha Am

Darts Fun League

C 47

for Baan Bangkate School

D

arts has been played in the bars of ChaAm for a number of years and interest has been steadily increasing, so we decided it was about time we got ourselves organised! We run a league of 8 teams of 3 people from 5 venues around Cha-Am on a Wednesday evening at 8p.m. Team members are a good mix of Thai and Ex-pat, male and female, young(ish) and old(ish). The purpose of the league is to provide a fun night out, and introduce new players to darts. At the moment only 2 players in the league had ever played darts before coming to

Thailand. It’s cheap and easy to learn, and we offer a quick lesson or 2 and a helping hand along the way. Catch us at any of these bars:- Scandic Bar Soi Long Beach, Paradise Corner Bar, Beach Rd, Cha-Am Soi 10N, Pink Flamingo and Blue Lagoon Naratip Rd and Buddy Bar KhlongThian Rd. If you fancy giving it a try or just having look, why not check out one of the very informal fun nights held in Scandic Bar on Sunday evenings and Paradise Corner Bar on Monday evenings.

otel de la Paix Cha Am Beach and Raffles International College has donated money from a charity fashion show held last year to support Baan Bangkate School. The school has used the funds to build an ICT room equipped with computers which will access sites for online education. This will support both teachers and students with their ability to access information technology and we hope to expand this project to the local community in the future.

T

he opening ceremony was held in November last year. Hotel de la Paix invited the deputy governor and the local tourism authority to witness this event together with the entire Bangkate School team.
