A WORD OF CAUTION: Property stokvels are not part of the formal business sector and not regulated in South Africa. Prospective members need to do the necessary due diligence before joining a stokvel. They should formulated their own constitutions that will deal with the rules, regulations, membership information, duties and responsibilities of each member, goals of the property stokvel, and what should happen when a member leaves or is unable to keep up with their financial obligations.

“GOOI gooi”, also known as an informal stokvel, sees women across South Africa banding together to extend and accessorise, and in some cases, buy their homes. Where do you begin a financial plan to gain equity that will see your house turn into a home? Well, in South Africa. For Bongi Makeba*, it began on a minibus taxi ride to work. “I travel with these women almost daily for about two hours a day for years now,” says Makeba from“WeKhayelitsha.speakabout our hardships and how, on our salaries, we will never have a beautiful home. This is how our group of women came together to start a stokvel (pooling of financial resources to aid those in a community, traditionally to buy groceries or pay school fees), to help us stretch our money and also make ends meet.

“We also helped each other a lot during hard lockdown,” she Fromsays. their origins, stokvels – informal savings schemes that started more than 100 years ago in South Africa to help people stretch their money in difficult times – became an important part of black culture and have evolved into a credible means of not only building and extending houses but also buying property. And it is women who are leading the pack here. In fact, of the property stokvels focusing on homeownership and building homes for its members, 89% of members are female. The National Stokvels Association of South Africa says the stokvel economy is estimated at R49 billion in South Africa. “I saw how my neighbours were creating better lives for themselves and I was curious,” says Makeba. “This is how I heard about stokvels extending further than just helping people buy groceries. “I have been divorced for many years and don’t get any money from my ex, which is why I knew I had to find a way to be independent. I earn less than R5 000 a month, so financial independence seemed like a distant dream until our ‘gooi“Wegooi’.call it ‘gooi gooi’, which in English is ‘throw throw’, because every month we throw money into the pot. “There are six of us and we each contribute R1 500 monthly. That way, you know that twice a year if it is a stove or fridge you want, you will get it with the R9 000 you get. Everyone gets a chance to get that money twice a year. We mostly use the money to extend our homes and buy furniture, groceries and stuff. “I have a fridge and a couch from this stokvel, and my next step is to build an extra room. However I know some big groups who actually buy property and sell it to make a profit – these are the big Propertystokvels.”stokvels, in particular, are becoming increasingly popular in South Africa as more people realise the benefits of pooling capital to purchase assets. The Old Mutual Savings and Investment Monitor believes property stokvelling has an “enormous” potential for disruption.Generally,most stokvel members investing in property use the funds to buy, build or extend their own homes but, increasingly, they are using surplus money to buy affordable property to let for rental“Myincome.group and I have been able to beautify our homes through our ‘gooi gooi’. Being unable to access money unless through a loan share, it’s made a big difference to us,” says Makeba.

The LRC agrees that legal systems have “often been biased against women, ensuring that their access to property wasTheimpeded”.LRCreiterates: “Land ownership and property rights are integrally connected to the power of selfdetermination and this is particularly important for a class of persons historically oppressed by society and the law – elderly blackTwowomen.”yearsago, a landmark ruling in the Durban High Court, saw Agnes Sithole, then 72, score a victory providing her with a share of her husband’s estate. It also sought to protect about 400 000 black elderly women in South Africa whose rights were affected by the discriminatory law dating from the apartheid era under which black women married before 1988 were denied ownership of family property, as all matrimonial assets belonged to the Thehusband.LRCrepresented Sithole and the Commission for Gender Equality in the case. Sithole’s case is well known now, and will go down in history books as a pivotal moment in women’s rights to land and propertyFacingownership.impoverishment and possible homelessness when her marriage ended, Sithole challenged the discriminatory law.

Even before Sithole’s case South African women, particularly single women, had started to rival single men in homeownership.Womenarealso emerging as the primary home loan applicant in many instances because they often are the higher earner in the household. Statistics show the number of women purchasing homes in their own right is increasing at a faster rate than that of men, so more single women own properties than singleHowever,men. women still need to be armed with the tools to build wealth and obtain appreciating assets, such as property, says Sithole-Ngobese.
Case #3 Sithole’s case Finally, in the Sithole case, (see main story) Agnes Sithole challenged Section 21(2)(a) of the Matrimonial Property Act, on the basis that it maintained and perpetuated the discrimin ation created by Section 22(6) the Black Administration Act which deemed marriages between black couples to be out of community of property. This was different to the position of other racial groups whose marriages were automatically converted to being in community of property. The judgment unpacks societal dynamics such as patriarchy, gender stereotyping and inflexible application of oppressive cultural practices which perpetuates intersectional discriminatory consequences for black women.
The changes are thanks, in part, to the work done to break down several archaic laws that sought to keep women out of property.
Case #2 Thokozani Maphumulo In 2017, the LRC represented Ms Maphumulo, the intervening applicant in Ramuhovhi versus the President of RSA. Ms Maphumulo was the second wife in a pre-RCMA polygam ous customary marriage and faced eviction from her home upon her husband’s death. The Constitutional Court declared Section 7(1) of the RCMA invalid with the Constitution, insofar as it applied to polygamous customary marriages but gave Parliament an opportunity to correct the defect within 24 months.OnMarch 2, 2021, Parliament passed the RCMA Amendment Bill. The amendment will ensure that the default position for all customary marriages will be in community of property, unless stipulated otherwise in an antenuptial contract. The bill also ensures that spouses in more than one customary marriage have joint and equal ownership rights and rights of management and control over marital property. The provisions would not invalidate the winding up of a deceased estate that was finalised or the transfer of marital property where the person receiving transfer was not aware that the marital property was subject to a legal challenge.

LANDMARK RULINGS AGAINST DISCRIMINATION
For generations, women struggled for the right to own property, but this is changing
T ODAY, women – either alone or in partnership with other men or women – own more than half the residential property stock registered in South Africa, according to recent stats from Lightstone. The changing ownership patterns reflect the growing participation of women in the economy, and Lightstone data suggests that women-only buyers are edging towards buying more expensive properties. By the end of July 2022, women, individually or in partnership, accounted for 57% (3 896 595) of the total volume of properties in the market (6 868 778), while this accounted for 54% (R3.4 billion) of the total value (R6.4bn) of residential properties registered at the DeedsAndOffice.thepercentage of properties purchased by women only is steadily increasing, from 16% in 2018 to 21% in 2021, with the number up another percent for the seven months to end July 2022, according to Lightstone.
Case #1 Elizabeth Gumede In 2008, the LRC represented Ms Gumede in the case Elizabeth Gumede versus the President of RSA. The Gumedes were married in 1968 and, therefore, their marriage was governed by customary law regulated by apartheid-era legis lation, the KwaZulu Act and Natal Code which stipulated that a husband is the owner of all family property. When Mr Gumede brought divorce proceedings against Ms Gumede, the LRC challenged the constitutionality of Section 7 of the RCMA which would have left Ms Gumede vul nerable and homeless in her old age. The Constitutional Court confirmed that Section 7(1) of the RCMA was inconsistent with the Constitution and invalid to the extent that its provi sions related to monogamous customary marriages.

Prior to the Covid-19 pandemic and the subsequent economic downturn, there was an increase in the number of young, black women driving the property market, says Gugu Sithole-Ngobese, the founder of Women in Planning SA. Female property ownership – or lack thereof – has always been an issue, she Insays.the past, a slew of laws and customs hindered women from making strides in the property world and prevented them from owning or inheriting land – laws and customs that sought to give women the status of children.
It’s no secret that access to land and property is essential in securing financial freedom for women, as well as giving them individual agency and autonomy, says the Legal Resources Centre (LRC), which has brought three cases to court to secure the rights of disadvantaged women.
The new ruling stipulates that all customary marriages are to be declared in community of property, a marital property law that treats the property of either spouse as joint property, regardless of who paid for it. Sithole’s case plus others, including that of Elizabeth Gumede and Thokozani Maphumulo, also fought by the LRC, “illustrate the persistence of patriarchy, the vulnerability of women during and upon termination of a customary marriage and the shortcomings of legislation enacted to protect such women”. “The court cases and the Recognition of Customary Marriages Amendment Act 1 of 2021 recently passed by Parliament reverses thisTherediscrimination.”areplansto amend the act further and regulate the proprietary consequences of customary marriages entered into before the act came into“Theeffect.affected women belong to a generation of black women who were born, raised and married under apartheid, during a time when laws actively prevented their access to freedom of movement, education, and the right to hold property.”
