Compliance 101 In the many years I have been involved in the community management industry, one thing I have learned is some residents are not aware of the expectations they signed up for when purchasing a lot in a community to call their home. Mike Arrington, Corte Bella Country Club Association, Inc. General Manager Although rare, I have been told several times by homeowners that they did not know they bought into an HOA and were subject to assessments. That’s not a good place to be, right? I can confidently say that most people don’t read the CC&R’s (Covenants, Conditions and Restrictions) before signing on the dotted line. It’s important to note when you sign the purchase agreement for your lot, you are validating you understand the expectations and agree to adhere to the established requirements set forth in the CC&R’s. This is because, whether you read the governing documents or not or maybe did not even know you signed or received a copy, the documents are a matter of public record so legally, you have received notice and are expected to be aware. Hint; if you received a CD during the closing process, that’s typically where you will find all information related to the HOA. As noted earlier, the CC&R’s are the primary governing document but not the only one. Today, I will only talk about the CC&R’s because that is where the “Use Restrictions” are located. The CC&R’s establish use restrictions which state what is and is not acceptable on your lot. The CC&R’s state the Board can make rules; those rules become a supplement to the CC&R’s and typically state things like how many guests you can bring to the pool or hours of operation, etc. The Corte Bella Board does have the authority to make rules and they do make them. Sometimes the written documents are in legalese that is hard to understand or complex in nature especially when federal, state and local laws are involved. As neighbors do sometimes, they talk and the message can sometimes become confusing. For instance, something I hear fairly often is “That does not apply to me because state law trumps that article in our CC&R’s.” That is simply not true, at least not in all cases. The law may trump the CC&R’s but only because the CC&R’s are not as stringent as the law. To be valid, the CC&R’s have to be at least as stringent as the law and can even be more stringent than the law. Another important consideration is laws change much more often than CC&R’s do because most communities cannot afford to pay to constantly update their CC&R’s. Additionally, it usually requires the vote of the entire community to cause a change in the CC&R’s.

Corte Bella has done a great job of updating CC&R’s but not all statements are accurate because of changes to the law. Therefore, if the law changed since the last time the CC&R’s were updated and the law became more stringent than the CC&R’s, then the law is superior to what is stated in the CC&R’s. Because of this, I attend at least two different legal seminars each year and have for the past 20 years. At these seminars, attorneys review the law changes that took place over the last year and explain how that affects the HOA industry and community management. In other words, I am expected to know when the law trumps a community’s CC&R’s and I do. In cases where there is doubt, I can contact an industry attorney or two for clarification. Knowing and complying with the “Use Restrictions” are important because if you do not, it can cause problems. Since we want compliance and for your life to be happy and uncomplicated, I wanted to remind and advise you of the basics. So, the first thing I recommend is reading the CC&R’s regarding use restrictions. Although there is some legalese, it will tell you about things like how your lot is to be maintained, where you can or cannot park vehicles, when you must paint your house, garage door or mailbox, whether a business can be run out of your residence, what portion of the home can be rented out and for how long your RV can be on the property, etc. If you don’t know the rules, how can you follow them? Secondly, if you don’t understand what it says, please come and speak with me. I’d be happy to provide the layman’s interpretation I have received from attorneys. Lastly, follow the rules as written and avoid any issues. Although you will receive a series of letters if you are in violation of one or more of the use restrictions, you should consider them to be a reminder in case you forgot or were not aware of the restriction to begin with. The real problem begins when those letters are ignored which could lead to sanctions which usually come in the form of a fine. At one point, if all else has failed, the HOA can actually come onto your property, fix the issue and then bill you for the cost. Of course, the law requires formal notification of intent to do so. Let me say we love compliance and really do not want your money (fines) or to enter your lot to perform something that should have been taken care of by you. Unfortunately, at times this is required and has been done. This is done to protect the neighbors’ property values because the Use Restrictions were put in place to do just that. HOA’s and rules are not for everyone and all HOA’s have different levels of enforcement. Corte Bella is the type of community where residents place great importance on their property value and expectations are high regarding appearance and pride of ownership. Please remember we are only trying to provide the environment that is expected and to ensure Corte Bella continues to be known as the “Jewel of the West Valley.”
Board Talk It’s almost that time of the year again to ask ourselves – where did the past nine months go? By the time you see this publication, we’ll have completed our 2018 Budget. It will be formally presented to the community by the Finance Committee (FC) on Tuesday, October 3rd at 6:00 pm. This is one meeting you don’t want to miss. The presentation will address our current and future assessments, projections by department, budget drivers and investment strategies to protect our future. Capital projects and Reserves will also be addressed. We’ll also have an update on the purchase of the APS poles and new LED lights.

The West Valley Wind Ensemble, under the direction of Clark Chaffee, is a 50-member volunteer group of both amateur and professional musicians that all have the desire to perform and share music. The concert planned for our community will feature a military and patriotic theme. Bring a lawn chair or a blanket to enjoy the band, who will set up on the north patio. Don’t forget to bring your donation of canned goods. The Anacapa will provide a cash bar and snacks for purchase during the concert. Free event but a ticket is required. Each Angel hanging on the tree provides a child’s name and age along with a list of their Christmas gift dreams. Bring the unwrapped gifts back to the tree with the original Angel tag attached before December 15 and the Salvation Army will take care of delivery. Patriot Day Walk-Around the Circle Larry Leighton Patriot Day, observed as the National Day of Service and Remembrance, occurs on September 11th of each year in memory of the people killed in the September 11, 2001 attacks. I’m sure most of us can remember where we were on that fateful day when the attacks on the Twin Towers and the Pentagon, and the crash in Stoneycreek Township, PA happened. The attacks killed 2,996 people, injured over 6,000 others, and caused at least $10 billion in infrastructure and property damage. 9/11 was the single deadliest incident for firefighters and law enforcement officers in the history of the United States, with 343 and 72 killed respectively.
This year, residents of Corte Bella, along with members of the Surprise Police Department, the Sun City West Posse, and the North Country Fire and Medical District were invited to join the Corte Bella Vets to remember Patriot Day. Approximately 85 folks met at the Community flag pole and listened to patriotic music until 7:00 a.m. when TAPS was played and the flag lowered to half-staff. After a moment of silence, we started on the walk. Some walked quickly and others slowly but all had a good time. When the walk was finished, we met at the Anacapa to “cool down” and enjoy each other’s company while munching on a light fare of yogurt, breakfast burritos, coffee, juice and water. The Corte Bella Vets will host this walk-around as an annual event on Patriot Day.

Corte Bella Veterans Support Soldier’s Best Friend Gary Lea Soldier’s Best Friend provides United States military veterans living with combat-related Post Traumatic Stress Disorder (PTSD) or traumatic Brain injury (TBI) with service or therapeutic companion dogs, most of which are rescued from local shelters. The veteran and dog train together to build trust that saves two lives at once and inspires countless others. A service or therapeutic companion dog provides constant support that can make it easier for veterans to readjust to civilian life and manage symptoms such as:

Panic Attacks Depression Flashbacks Irritability Anxiety Nightmares Suicidal thoughts
Soldiers Best Friend is an Arizona-based non-profit organization. Currently training is offered in Phoenix, Tucson, Flagstaff, Prescott and Sierra Vista. On average, veterans and their dogs complete training in 6-9 months.
Making a Difference Hilda Furkert, member of SOuL (Smiling Out Loud) StreetLightUSA, located in Glendale, serves girls age 11 – 17 who have experienced sexual trauma. Its programs help girls find a new way forward so they can become independent and successful young women. In 2008, leaders from across Arizona began to explore the possibility of providing services to child sex trafficking victims. In 2009, StreetLightPhx received a $750,000 grant from HUD and support from ninety churches to buy a facility. In 2010, a property was found in Glendale to house up to 48 girls. In 2011, StreetLightUSA opened and served seven girls. The number served rose steadily from 41 girls in 2012 to over 260 in 2014. Over the past five years, SOuL has donated $10,000 to StreetLightUSA. Inspired by an NBC “Making a Difference” segment, we gathered for potluck luncheons. After sharing great food and conversation, each of us contributed what we would have spent to go out to lunch. Additional funds were raised in part through community bake sales, wine events, book sales, a dance, casino night, and more. Thank you, Corte Bella residents, for supporting our efforts!
Recently five SOuL members visited the Glendale facility. We spent an hour of fellowship with the girls enjoying root beer floats and an animated game of charades. As heart wrenching as it was to grasp what these girls have experienced, we were so impressed by their positive attitudes, enthusiasm, and respect for each other and the staff. What can you do to help these young women? You are eligible to receive an Arizona state tax credit ($400/individual, $800 joint) for donations to StreetLightUSA under Qualifying Foster Charitable Organizations (QFCO). Beginning with the 2016 tax year, QFCO’s are separate from the Qualifying Charitable Organizations such as St. Mary’s Food Bank. Corte Bella Crafters Marlene Chumbley The Corte Bella Crafters are a group of mostly women that knit, crochet, quilt, make cards, scrapbook, color, paint, make yoyos, embroider, needlepoint, and the list goes on. We meet on the 3rd and 4th Wednesday of every month in the Bella Stanza room from 12:30 to 4:30 pm (subject to change). We will be having various classes throughout the year such as wire bending, wreath making, card making, garden art, etc. Come on over and see what we do and learn some new crafts, too. And if you don’t have a craft you’re working on, come on over anyway, and see what we’re doing and visit with us. Minnesota “Norwegian” Whist Ross Mason This game is very popular in Minnesota, USA, where it is just called Whist. It seems certain that it was brought there by settlers from Norway. It is extremely similar to a Scandinavian game, often listed in English language card game books under the name Norwegian Whist. The main difference from the European version is that in America a black card indicates that one wants to play “high” (aiming to win tricks) and a red card is a vote for “low” (avoiding tricks), while in Europe red means high and black means low. This is a social game and relatively easy to learn. There are four players in two fixed partnerships. Partners sit facing each other. The game is played clockwise. A standard 52 card pack is used. The cards in each suit rank from highest to lowest: A K Q J 10 9 8 7 6 5 4 3 2. There are no trumps. All cards are dealt. High / Low Bid Each hand is played either “high” or “low”. If it is played “high”, the partnership that takes at least 7 of the 13 tricks scores points. If it is played “low”, a partnership must take 6 or fewer tricks to avoid losing points. All four players indicate whether they wish to play the hand as “high” or “low” by simultaneously placing a card face down in front of them. A black card indicates that they wish to play “high”; a red card indicates that they wish to play “low”
Starting with the player to the left of the dealer, each person turns over their bidding card in turn. If the card is red, the next player to the left turns over their card. If any card is black, all revealing of bid cards stops and the hand is played “high” or “grand”. Only if all four bidding cards are red is the hand played “low”.

Corte Bella Drop Toppers Nancy Wendler On August 15, the Drop Toppers took their annual run to Flagstaff to escape the heat. We spent two hours at the Lowell Observatory taking tours of the facility and listening to a lecture about the telescope. The Lowell Observatory was established in 1894, placing it among the oldest observatories in the United States, and was designated a National Historic Landmark in 1965. In 2011, the Observatory was named one of “The World’s 100 Most Important Places” by TIME. It was at the Lowell Observatory that the dwarf planet Pluto was discovered in 1930 by Clyde Tombaugh. After the tour, we headed to lunch outdoors at the Oakmont Restaurant where we were joined by Corte Bella residents who summer in Flagstaff...a total of 24 had lunch on a chilly afternoon. Sunday Cabaret with Route 66 August 20 More than 80 Corte Bella residents filled the Anacapa on this warn Sunday evening to enjoy bistro food prepared by Chef Dan and his crew while dancing to the fine sounds of the Route 66 band. The dance floor was the place to rock out with this trio’s renditions of the good music of the ‘60s.There was something for everyone’s taste – from rock to soft ballads and music perfect for line dancing. Once again, the Anacapa is the place to be for cabaret night!
Corte Bella Celebrates Labor Day Monday, September 4 This annual event brought 102 Corte Bella residents together to mark the end of summer and launch the busy months of autumn activities and events. Chef Dan and the Anacapa staff prepared an amazing buffet. The “Thaddeus Rose Duo” played the tunes CB folks like to hear and there was dancing until the lights went off. As always, the decorations were delightful.

Arizona Diamondbacks’ Baseball at Chase Field Thursday, August 31 Rousing choruses of “Take me out to the ball game” could be heard while 32 Corte Bella residents rode the bus into Phoenix to see the D’backs take on the Los Angeles Dodgers. Great seats, a closed stadium roof with cool temps, D’backs bucks to redeem for food and drink plus the good company of friends and neighbors made this day game enjoyable for all. And a three game “sweep” of the Dodgers was the icing on the cake!
Bright and early in the morning, a hardy group of 40 Corte Bella residents boarded the bus to make the trek to the Wild Horse Pass Casino in Chandler, all the way on the other side of the Valley of the Sun. This monthly excursion (HOA sponsored event) allows folks to try their luck at the casino, enjoy the many amenities of the casino resort and even shop at the Phoenix Premium outlets located nearby.

It wasn’t long ago that cell phones were not welcome on the golf course. The PGA Tour did not allow fans to bring cellphones on the course until 2011; the British Open followed in 2012. Many of you may remember Phil Mickelson sending a text to PGA Commissioner, Tim Finchen, in 2012 about the distraction caused by fans taking photos on their cell phones. Today cell phones are a part of golfer’s equipment. The Golf Genius app is used by Corte Bella golfers to track scores. Other apps function as rangefinders, handicap trackers and provide golf rules and etiquette. PGA Tour Mobile and LPGA Now help us keep up with our favorite players and know leaderboard standings in an instant.
Keeping your phone charged while playing golf is easily solved by installing a DC/12-volt socket, commonly known as a cigarette lighter, in your golf cart by your local golf cart dealer. With a charger in your golf cart, you don’t ever have to worry about low battery power on your phone. Another huge benefit of installing a charger in your golf cart is the ability to participate in the annual Corte Bella holiday golf cart parade in December. With an installed DC/12-volt socket, you can purchase a power converter from several retailers, such as Walmart. Once you plug the power converter into the DC/12volt outlet, you can place holiday lights on your cart. There are also battery-operated holiday lights as well. Pickleball Pete Carolyn Pakan Hi Corte Bella dwellers. I’m Pete the pickleball. I hang out, literally, in tubes on the pickleball courts waiting for someone to take me out. I look like a wiffle ball, but those are my distant cousins. I do have relatives that are different colors and my indoor relatives have different holes. You always have to have a few oddballs in the family. Actually I’m a mutant. I used to be much harder, but I would crack in the winter, and now I’m a little too soft and I lose my bounce. Various labs are competing to make me “just right.” I even heard one of them hired Goldilocks to help in the research! Pickleball, named after a dog named Pickles, is a fun game played on a court about ¼ the size of a tennis court. Because of the size of the court and the rules, players are young and old, men and women, really strong and not so much, all playing with and against each other. A game is only up to 11 points and lasts about 15 minutes. It’s kind of a cross between tennis, badminton, and ping pong. There’s even a kitchen on the court. Don’t worry you
don’t have to cook to play. Sometimes the players slam the ball, YEEHA, sometimes they caress me and dink the ball, OOOH, or they can lob, WHEE, and when they put a spin on me I get dizzy! I get really lucky when a player yells “I got it” and then completely misses me. We all laugh when that happens. I have so much fun out on the court. Actually I was hoping for a little rest during the hot summer, but NOOOO. The CB pickleball club plays all through the summer from 7 – 10 a.m. Monday - Saturday. Some even play on Sunday. I thought that was a holey day…Get it? There’s another group that plays Sunday, Tuesday, and Thursday evenings from 7 – 9 p.m. Sheesh, it’s over 100 degrees and that doesn’t stop them. Others play when they get a group together. You can hear them laughing and complimenting one another on good play. They crack me up. (We balls do crack you know.) Pick up a paddle at the rec center and join us. We’ll help you play. Or sign up for our clinics that are on Oct. 21, Nov. 18, and Dec. 16 to learn to play or improve your game. See you on the courts! October Overseeding Debbie Parks-Dube Through the month of September, we had a crew cleaning up the red rock areas. Those of you that live on the golf course probably saw the workers behind your homes. If you were out of town for the summer and are just getting back to Corte Bella in October, you will notice the trimmed trees and cleaned up red rock areas. October is the month the Corte Bella golf course goes through the overseeding process. While many of you are not golfers, everybody enjoys the beauty the golf course and common areas add to the community, and it is most likely why you purchased a home here. Below is a summary of what goes on in the overseeding process all around the Valley to get the grass nice and green for the winter months. Bermuda grass is the staple for all golf courses in the Phoenix area in summer. It can take the desert’s hottest weather as long as it has sufficient water. During winter it is dormant, meaning it turns yellow and appears dead. However, below the surface it is alive and waiting for next season’s warmer weather. Bermuda usually starts to slow down and go dormant in September and starts growing again in May. This life cycle makes it ideal for golf courses because Bermuda does not have to be replanted each year. However, to keep golf courses vibrant and green during the winter months, Rye grass will be planted successfully over the dormant Bermuda. When high afternoon temperatures start to kill the winter grass in May, the Bermuda grass takes over again.
Bermuda grasses ability to spread out can be both a blessing and a curse. On one hand it will quickly fill in any damaged areas, but on the other hand it can spread into areas that it is not desired. The reason brown patches sometimes appear are due to the grass becoming so thick that the leaves are only at the ends of the stalks, forming a sort of canopy. If allowed to grow taller than recommended, all the leaves get scalped off during mowing, leaving nothing but brown stalks. This is one of the problems aerification can rectify by thinning out and helping the roots grow deeper into the soil which promotes a longer more resilient root system. Rye is the most popular winter grass used in the Phoenix area. Rye grass will stay a lustrous dark green until the middle of May, before quickly dying off as temperatures approach 100 degrees Fahrenheit. The optimal time to overseed Bermuda with Rye is from early to middle October. Plant too early and the sun can bake the seedlings. Also, when the weather is still hot the Bermuda is still growing and will compete with the Rye seedlings. Plant too late and germination is slow because the weather isn’t warm enough. So, there is a relatively small window of opportunity. This year the golf course will be closed for overseeding from October 2nd – October 19th and will reopen on the 20th. •
