Both state and federal taxes come with ridiculous penalties and interest rates, and the authorities at either level have virtually unlimited power at their disposal to screw with your life if something bad happens. Melinda Dear Melinda, The first thing you need to do is contact an attorney who handles estate planning. If the accounts were opened in Florida, but you both lived in Oregon at the time of his death, technically the estate would be probated in Oregon. That may be what has to happen. If so, a judge would appoint you as executor.

As executor, you can close the accounts and disperse any money to the rightful heir—which is you. Be prepared, though. It may take somewhere between $250 and $500 in attorney fees and court costs to make this happen. If you’re lucky, you might get a simple motion from the court that would cost you next to nothing. But find a good estate planning attorney who knows Oregon law inside and out. Estate laws and probate laws differ from state to state, and Florida and Oregon both have some weird laws in these areas. This probably seems like a lot of trouble, but you have to remember the banks are simply trying to protect themselves and follow the law. Anyone could walk in with a death certificate (they’re public record), and claim to be an heir. So, they have to have a court document in order to avoid any potential liability. I’m sorry for your loss, Melinda. I know it still hurts after all this time, but you need to address this as soon as possible. I trained for the same position several years ago and in the same capacity that they are now for no compensation. At that time, I had been on the job two years and was training to work in another department in order to work extra shifts in that department. At the time employees understood the policy, and some people chose not to participate but I really needed the extra money the position would bring after training. I’m not angry that others are now being compensated, my issue is at the time we were told that we could not receive no pay. I’m guessing someone higher up determined that this could be illegal and changed the policy. The problem I am having now is that I know it was illegal, and I feel like I was cheated or used. I am not trying to be petty. We had to train for this position for a minimum of 80 hours on the weekends and sometimes overnight. I’m sure someone in management knew this was illegal and they held on to this policy for years knowing desperate employees who don’t make enough in one position would do

A: The U.S. Department of Labor says that training without pay is a violation of the Fair Labor Standards Act. Some exceptions apply but normally: “Trainees are entitled to compensation for training in all other circumstances. There is an agreed to wage for the trainee. All applicable taxes are withheld from the trainee’s pay. All FLSA guidelines for wages and overtime apply to the trainees during training. Companies face harsh penalties from the Department of Labor for violating payment guidelines outlined in the FLSA.” Even though the training was for you to work in a different department, they asked you to go out of your way and spend your own free time without compensation. If you ask inquisitively, you may be able to deﬂect any tension and anxiety that they will feel if they actually KNEW they were not following the law. I think they may have believed that they didn’t have to pay if you volunteered for the training.

And you’re right; it’s going to rufﬂe some feathers because management is hoping that no one noticed. The problem is that sometimes people act without considering consequences, and it’s possible that they would have a knee-jerk reaction that impacts your job. I think you have to be very careful in how you approach this issue. Let them know that you are totally ﬁne with the current policy where your colleagues are given comp time – because it sounds petty if you don’t qualify it that way. You only wonder if perhaps the people who were trained earlier should also be eligible to receive that comp time. I’m sorry that you feel used. It seems like the management was trying to cheap their way into training people. Maybe they have learned their lesson!

Common sense to me is if I have an individual applying for a position, and if that person has a conviction on their record, it stands to reason that person might be trying to change their life around. The rate of repeat offenders is indeed troubling, but when a man can’t even get a job in an entry level
