My mother wants everything, except for her home, left to my brother and I when she dies. She would like her long-time boyfriend to have her house. We don’t have a problem with this, but it has not been written into her will. Her mind is still sound, so does she need to officially update the will?

I’ve been following your plan, and I’m ready to start investing. Do employer contributions count toward the 15 percent you recommend putting into retirement? Brenda Dear Brenda, Investing 15 percent of your income in retirement accounts is Baby Step 4 of my plan. That means you’ve already paid off all your debt, except for your home, and you’ve increased your $1,000 beginner’s emergency fund to a fully-funded emergency fund of three to six months of expenses. Way to go! I want you to control your destiny, so employer contributions do not count toward the 15 percent I recommend setting aside for retirement. The first thing you should put money into is a matching retirement account. If you’ve got access to a 401(k) — and your employer offers a match — you should do that up to the match before anything else. It’s nice if your company will match up to a certain point, but chances are that will still mean you’ve got some work to do. To make up the remainder, you could look at a Roth IRA. Then if the Roth, plus what you invested previously to get the match doesn’t equal 15 percent, you could see about a 403(b) or go back to your 401(k) to complete the 15 percent.

Dawn Dear Dawn, Yes, the will needs to be changed to reflect her wishes where the house is concerned. Since she’s still able to make decisions independently, the will should be legally updated to reflect exactly what she wants to have happen with every piece of her estate. It’s fine if she wants to give her boyfriend the house. It’s your mom’s will, and her estate, so she can do pretty much whatever she wants. She could also leave what’s called a life estate that says her boyfriend gets use of the home while he’s alive. Technically, in this kind of situation the house would be left to you, but he would legally have use of it during his life. Upon his death, the home could then revert to you or your brother. —Dave

Q: This is my information. I was applying for another position and saw this

one. It has been in the job SPARC for awhile. The problem might be, not being rude just wanting to help, that it a person with a 1099 work from home would work for this. Maybe try that and see if you hire someone. I am interested cause I worked on the medical fi eld professional for while. I went to Concordia University but did not fi nish. So that is why I was telling you that could be the problem I studied this at Concordia. The classes are great. Well anyway consider me, and you won’t be sorry but I know if HV to go by the rules just in case here is my information. I work from home as we speak and would like to understand the process of applying. I am not trying to not do the rules or go by the rules. - Channelview, Texas Reader

A: I took the liberty of correcting some grammatical errors in your email, but you have so many abbreviations that your email is extremely hard to grasp. For instance, I do not understand what you mean by “do the rules or go by the rules.” I do want to caution you: You included copies of both your Social Security card and your Texas Drivers License, but you should never share that information with people you don’t know. If you review the ad, you will see that it is very specifi c and the requirements are not able to be changed. Obviously, it is not an easy position to fi ll, but it is defi nitely not a 1099 position. JobSparx makes it a practice to accept only those ads that include a base salary, and that eliminates most 1099 jobs. I just read an email from a company that is doing a lot of hiring, and it included some great advice: •

Do not apply to more than 3 jobs at the same company because most companies are seeking subject matter experts instead of a “jack of all trades.”

Make sure to review the job description prior to applying and make sure your experience is a match for the job requirements. If it is not a match, your resume will be discarded.

Q: Apparently I don’t know how to shake hands! I was at an interview last Tuesday, and when I shook hands with the lady who was in charge, she said, “I guess you don’t shake hands with very many women.” It really made me mad, and I wasn’t even able to concentrate on the interview. Is there a special way that I should shake?

healthy office

A lot of people get sick in the workplace because of their food choices. Most of them are not conscious about what they put into their bodies during the day. Sure, they eat tons of fresh fruit for breakfast and a healthy ratio of good food for dinner but during the day, they mindlessly snack on chocolate bars, cookies, hot dogs and burgers. This is because most people think that brown bagging or packing lunch is a lot of hard work. With the conveniences we have now, it’s easy to pack a healthy lunch to keep your body energized throughout the day. Here are some ideas:

fruits

Apples, oranges, bananas, berries, watermelons, melons and pineapples are just some of the fruits that you can take in your lunch box. To avoid browning, cut an apple using an apple cutter and wrap a rubber band around it to keep the pieces together. Come lunch time, you will still have fresh apples. Cut up oranges into thin wedges for easy eating. Cut up pineapples into rings or tidbits and add it to your salads. As for berries, you can freeze them overnight for a cool snack on hot summer days. You can also mix them with yogurt for a frozen yogurt treat. Buy whole fruits and cut them up yourself to save money.

Give your regular coffee a break and pack some freshly squeezed fruit juice or a protein-packed shake. Personal blenders are now available everywhere. Steamed vegetables are great for lunch. They fill you up and give you the energy to get through your day. Broccoli, cauliflower, carrots and chayote are great for packed lunches. Baked sweet potato sticks are a super snack that will give you an energy boost in the afternoon. Stir fried vegetables and rice make for a filling lunch. Boiled edamame sprinkled with pink salt boosts your immune system and gives you energy. It also helps with digestion.

whole grain bread

If you are not allergic, change your regular white bread to dark, whole grain bread. Look for “100% whole wheat” or “100% whole grain”. Aside from bread, you can also bring tortillas or pitas.

cheese

There’s a reason why kids’ lunch boxes are always packed with cheese. They give you calcium (which adults also need to avoid osteoporosis), protein, zinc, phosphorus and vitamins A and B12. Did you know that calcium is one of the nutrients lacking in an average American diet? It is recommended that persons aged 9 and above eat at least 3 servings of milk, yogurt or cheese daily so pack some of your favorite cheeses in your lunch box. Grate them and sprinkle on your salads, add in your sandwiches or just snack on string cheese. If you are lactose intolerant, cheddar and Swiss cheese have very little to no lactose at all. A lot of people don’t like tofu because it’s tasteless but did you know that tofu absorbs the flavor of the ingredients you mix it with? You can make some teriyaki tofu just by frying some tofu cubes and mixing it with the sauce. You can put tofu in stir fries. For soups, use soft tofu.

fish

Tuna is a very popular lunch box staple. You can cook it in different ways. You can put it in salads, sandwiches, wraps and pasta. Baked salmon or salmon teriyaki is a good alternative when you get tired of tuna. Just add vegetables and rice and you have a complete meal. Other fish dishes include fish sticks, fried fish, sweet and sour fish (instead of pork) and steamed fish.

There are so many varieties of pasta out there that you can surely add pasta in your repertoire of packed lunches every week. Organic, glutenfree pasta is also now readily available if you are gluten-intolerant. You can use tomato sauce, cream sauce or just olive oil. Pack the sauce separately to avoid soggy pasta.

snacks

Hard boiled eggs, nuts, celery sticks, cucumber sticks, baked corn chips, low-sodium pretzels, popcorn, carrot sticks and dips are just some healthy snack choices. Cut up tortillas into triangles and bake them until they are crunchy. Pack with some cheese or ranch dip. This is a great alternative to potato chips if you are craving for something crunchy.

Chicken is another lunch box staple. It’s easy to prepare and very versatile. You can put it on salads, wraps, sandwiches and more. You can grill it, fry it, roast it and bake it. You can shred it and put it in soups. You can put it in pasta. The possibilities are endless! Chicken can be used in different kinds of dishes so stock up on different cuts (fillets, small cut-ups, shredded, minced, whole, etc.) and you can have a whole week’s worth of packed lunches and dinners. Choose lean cuts of pork and beef for your dishes. Avoid eating too much red meat to keep your heart in tip-top condition.

One of the best things about packing your own lunch is you get to eat a full course meal without spending a lot. Now that beats burgers and fries any day! For dessert, you can pack some plain dark chocolate or cherries dipped in dark chocolate, fruit cups (make sure the fruit is not soaked in syrup), fruit leather or rollups (you can make these at home with only 1-2 ingredients), nutty dark chocolate barks, all-natural fruit gummies and home baked goodies such as cupcakes and muffins. Pack some lunch box ice packs if you don’t have a fridge in the office to keep food cool and to slow down bacterial growth. If bringing a sandwich, it’s best to pack the ingredients separately and just assemble in the office so that your vegetables will remain crisp and the bread won’t get soggy. Don’t forget to pack extras as you need to refuel your body throughout the day. You might also get stuck doing some overtime work, so instead of going to the vending machine, you can be sure that you have something good to nibble on. If you have allergies and you want to bring ready-made lunch packs, read the label first to be sure that what you’re buying is safe. With all these tips, you have no excuse not to eat healthily. The key is having a plan. Write down the meals that you want to take for the week, make a grocery list, buy them and prepare the dishes on Sunday night. 5.COMMUNICATION SKILLS. Regardless of how automated the workplace becomes, it will always be vital to communicate with colleagues and customers on a human level. Most technology will be used to assist employees, not replace them. And AI is a poor substitute (so far) for the personalized communication that so many customers expect.

6.DRESS FOR SUCCESS. Don’t assume that dressing sloppily is a good idea because some successful entrepreneurs wear sweatshirts and tennis shoes. On average, professionally dressed employees are better positioned to advance their careers than those who dress like middle age frat boys in a misguided effort to look cool.

7.BE VERY ADAPTABLE. Job responsibilities and descriptions may be much more fluid in the future. If you’re the type who can only handle one responsibility, or focus on one task at a time, you may not go far. Those who do go far will do what it takes to help the company succeed, regardless of whether the tasks are listed in their job descriptions. Companies will always need people to manage and use new technologies. In most cases, these tools will merely assist human beings rather than pushing them out the door. This isn’t to say that some people won’t be displaced. But if you follow the advice above, it’s less likely that you’ll lose your job to a piece of software. Instead, you’ll be working with that robot or AI software to achieve tasks that might have been impossible just a few years earlier. VOL. 23 ISSUE 1128

Do I have a Right to get

Overtime Pay?

Most employees do have a right to overtime pay, when they work over 40 hours in a given week. For each overtime hour, the law requires that they get one-and-one-half times their regular pay.

The law requiring overtime pay -- called the “Fair Labor Standards Act” -- was passed in 1938, during the Great Depression, when jobs were scarce. The idea was that making overtime hours more expensive for companies would encourage them to hire more workers rather than work their current employees longer hours. While the law applies broadly to most employees, it does not give everyone a right to overtime pay. First, the law only applies if you are an “employee.” That means that if you are an independent contractor in business for yourself, you have no right to overtime pay. How do you know whether you are an employee or an independent contractor? It’s not always an easy question to answer. It depends on the type of job you do. In the eyes of the law, you are more likely an employee, rather than an independent contractor, if: •

You have a “permanent” job with your company, rather than one with an end date

You get trained or instructed by the company on how to do your job, and are supervised in how you do it

Your work schedule is set by the company

You work on the company’s premises

The work you do is central to the company’s business (for example, you work for a bakery and your job is making the bread)

You do the same job done by employees of the company.

But these are just some factors that may be relevant. Ultimately, the question is whether you are in business for yourself (and thus an independent contractor) or you depend for your livelihood on the company you work for (and are thus an employee). Note that just because your company may call you an independent contractor doesn’t mean you are one. Companies often improperly label workers who are employees as independent contractors -- doing so can save them a lot in taxes and benefits. There’s a long list of employees who have been improperly labeled as independent contractors: FEBRUARY 16,delivery 2018 drivers, am52estate real agents,

bulance dispatchers, nurses working for a health care service, temps working for an employment agency, even dancers at a night club. But even if you are an employee, as opposed to an independent contractor, that’s not the end of the story. You may still have no right to overtime pay if you fall into one of the many loopholes contained in the Fair Labor Standards Act. For example, if you are a manager who spends most of your time supervising others, or if you spend most of your time performing important administrative work related to the operation of the business, you may fall into the law’s “executive” or “administrative” exceptions. If you do, you have no right to overtime pay. But just because you may have the word “manager” in your job title and your employer doesn’t pay you overtime, doesn’t mean you don’t have a legal right to overtime pay. Assistant managers or office managers, for example -- depending on their job duties -- may be legally entitled to overtime pay. The law also denies overtime pay to “professional” employees. This “professional” exemption generally applies to people whose jobs require long years of extra schooling -- such as doctors, lawyers and accountants -- or whose jobs require artistic creativity or talent -- such as painters or musicians. But having a college degree or using your talents on the job doesn’t necessarily deprive you of the right to overtime pay. For example, courts have found newspaper reporters to be entitled to overtime pay despite their education and their writing skills. Another important loophole exists for what the law refers to as “outside” sales reps -- those workers who spend most of their time on the road, visiting customers. This exception, however, is limited. For example, it does not apply to a delivery driver whose primary duty is driving, as opposed to selling. Nor does it apply to pharmaceutical “sales” reps who visit doctors offices promoting certain drugs, but who don’t actually sell the drugs to the doctors. Even if you fall into one of the exceptions to the Fair Labor Standards Act, which is a federal law, you may still have a right to overtime pay under the law of your state. For example, certain states require overtime pay for longdistance trucker drivers, even though federal law does not. While most employees have a legal right to overtime pay, it may be difficult to tell in a given situation whether a person has such a right. You can’t necessarily rely on what your company says.
