Overcome Joint Pain for Improved Quality of Life In an active lifestyle, joint health is a top priority. Your joints—hips, knees, ankles, shoulders, elbows, wrists— allow you to perform sports and daily activities and are needed to move and thrive. Over time, an active lifestyle may lead to wear and tear—the eventual breakdown of protective cartilage—causing friction in the joints. This friction ultimately results in joint pain and injury. Living with pain is a life changing condition, as it’s often paired with restrictions in mobility and daily activities, dependence on pain medication, anxiety and depression, and poor perceived health or reduced quality of life. Though joint pain presents in many different forms, so do the treatments and prevention strategies. Depending on the cause of the pain, people may find relief from exercises to strengthen particular muscle groups; injections of anti-inflammatory steroids or other medications; platelet-rich plasma, where a patient's own platelets (a type of blood cell) are injected into an injured tendon or cartilage; nerve ablation, where precisely controlled heat is used to temporarily disable nerves causing the pain; and arthroscopy, a surgical procedure used to view, diagnose, and treat problems inside a joint. When lifestyle modifications and minimally invasive procedures aren’t effective against joint pain, joint replacement surgery is another option. Joint replacement is a procedure in which some (partial replacement) or

all (total replacement) damaged parts of a joint are removed and replaced with man-made parts. The goal is to restore function and reduce pain and inflammation. This surgery can be performed on the shoulder, elbow, wrist, and ankle, with the most frequently performed joint replacement surgeries on the hips and knees. Joint replacement surgery has improved and evolved over time. Innovations in robotic technology now enable orthopedic surgeons to have improved precision that reduces trauma on the bone and tissue during surgery, resulting in more accurate results and a better experience for patients. Barton Memorial Hospital is one of the first hospitals in the Lake Tahoe and Carson City areas to offer Mako SmartRobotics™, a robotic system used in total knee, total hip, and partial knee joint replacements. 2022-2024 Board of Directors Election By Kirk Wooldridge, General Manager

For the 2022-2024 Board of Directors Election, there are four board positions up for election. For this election we have ten candidates that have been placed on the voting ballot: Greg Daum, Peter Grant, Melvin Meyers, Robert Meyers, David Peterson, Dooley Riva, Jim Siegfried, James Treanor, Sean Ward, and Pete Wolcott.

p.m. on Monday September 12th, 2022 if you elect to return this Secret Ballot by mail. If you elect to return this ballot in person at the Pavilion Office, the Secret Ballot must be inserted into the ballot box prior to 5:00 p.m. on Wednesday September 21st, 2022. If you elect to return this ballot at the Board Meeting, it must be turned into the Inspector of Elections no later than 5:05 p.m. on Wednesday, September 21st, 2022.

The Voting and Election Rules that were adopted by the Board of Directors of Tahoe Keys Property Owners’ Association on May 22nd, 2015 comply with the requirements of the Davis Stirling Civil Code section 5105(a). Section 2. Qualifications for Candidacy and Election to the Board: Candidates for the Board must be Members in Good Standing and must meet any other qualification or restrictions set forth in the Bylaws. “Member” means a person who holds legal title to the property (i.e., is named in the deed for the property). Voting Ballots were mailed out July 15th, 2022. You can view each candidates’ self-nomination form “Statement of Candidacy” on the TKPOA website at www.tkpoa.com, and they were also included in the Ballot package. TKPOA also held a “Meet the Candidates Forum” on July 21st, 2022 at 6:00 p.m. as a scheduled Town Hall Forum. All ten Candidates attended and answered a variety of write in questions from members in attendance and formatted questions specific to the Association and how they plan on serving the Tahoe Keys. This “Meet the Candidates Night” Town Hall Forum Recording is posted on the TKPOA website, www.tkpoa. com, under Documents>>Town Hall Forums>>Town Hall Forum Recordings. The Board of Directors two-year terms that are ending this year are Dave Peterson – President, Bonnie Halleran -- Vice President, Keiron McCammon -- Director, and Steve Shepherd -- Director and their terms end on September 21st, 2022. These Board members are eligible to rerun for the Board for another term and Dave Peterson has submitted a Self-Nomination form for reelection for the 2022-2024 term. Board Members who still have one year left on their two-year term are Treasurer – Ken Silveira, Secretary – Joy Curry Norem, and Director – Joby Cefalu, and their terms end in 2023. The Record Date for this Annual Election has been set by Board Motion as July 6th, 2022, any TKPOA members with suspended voting rights on this date will not be eligible to vote in this election. The balloting period for this election will close at 3:00 Keys Breeze

The balloting period may be extended by the Board of Directors if sufficient Secret Ballots have not been received to establish a quorum. Four Board of Directors seats are up for election. Please do not vote for more than four candidates. If you vote for more than four candidates, none of your votes in the director election will be counted. Once your Secret Ballot is cast, it cannot be revoked. A Secret Ballot is "cast" when it is received at the location designated by the Inspector of Elections. The 59th Annual Membership Meeting will be held Wednesday September 21st, 2022 at 5:00 p.m. at the TKPOA Pavilion located at 356 Ala Wai Blvd, South Lake Tahoe CA 96150. The Election Ballots will be opened and counted at this board meeting by the Inspector of Elections and designated volunteers. The Director Election Results will be announced and during this Board meeting, Directors will be seated. At the June 15th, 2022 Board of Directors Regular Open meeting the Board appointed Tania Green – California Notary Public to serve as the Inspector of Elections for this Director Annual Election, mailed ballot will be addressed to the Inspector of Elections, TKPOA Board of Directors Annual Election 1034 Emerald Bay Road South Lake Tahoe CA 96150. The Board also approved a motion to set the Record date for the TKPOA Property Owner Voting List for “2022-2024 Annual Board of Directors Election” as July 6th, 2022. Currently the TKPOA is seeking TKPOA Volunteers to assist the Inspector of Elections for this ballot count on September 21st, 2022. with ROD to coordinate the 2021 review effort and to implement many improvements from that review process leading to the preparation of the CC&RS 2022 for a membership vote.

To assist members with voting, the Committee has developed a Questions and Answers document and a A Town Hall Forum has been scheduled for August 18th, Summary of Key Changes posted on the TKPOA website. 2022 from 6PM-8PM. How Your Landscaping Affects Lake Tahoe The Tahoe Keys Property Owners Association (TKPOA) Board has lifted last year’s outdoor irrigation restrictions, which means you are suddenly faced with a decision. How should you revitalize your yard? Conservation landscaping is the best choice for the environment. These practices lessen watering and fertilizer use, filter stormwater, maintain fire defensible space, and provide habitat to pollinators and beneficial insects. Conservation landscaping can help protect Lake Tahoe’s unique environment while offering an attractive and desirable aesthetic that reflects the individual character of one’s property. To make it easy, TKPOA and the Tahoe Regional Planning Agency (TRPA), partnered to develop the Tahoe Keys Landscape Design Book for conservation landscaping ideas. As properties resume watering their landscapes, please adhere to the TKPOA watering schedule and landscaping requirements, including the use of phosphorus-free fertilizer. Irrigation systems that overwater lawns and landscaping can generate excess runoff, that transports sediment, pesticides, and nutrients to gutters, and storm drains. because storm drains in the Tahoe Keys convey untreated runoff directly to the lagoons and ultimately out to Lake Tahoe. Studies show that stormwater contributes to approximately 10 percent of the nutrients that drive weed growth. The two primary aquatic invasive plant species of concern, Eurasian watermilfoil and curly-leaf pondweed, grow abundantly with excess nutrients, like nitrogen and phosphorus found in fertilizer. Overwatering may contribute to favorable conditions for algal blooms and aquatic weed growth, which works against the ongoing investment TKPOA, its members, and partner organizations make to control Aquatic Invasive Species in the Tahoe Keys. The City of South Lake Tahoe (CSLT) Stormwater Ordinance was put in place with the purpose of protecting and enhancing Lake Tahoe and aims to reduce pollution discharged from urban areas. When landscape irrigation and lawn watering runoff contain pollutants, such as sediment, pesticides, or fertilizers, and enter the Storm Drain System, it is a violation of the Stormwater Ordinance. CSLT and TKPOA may issue citations and fines to properties observed to be in violation of the Ordinance and TKPOA Operating Rules.

On July 20th, 2022 during the Open Board Meeting, the Board of Directors approved to continue this Emergency Rule Change to Section 10 Water Conservation Rules for Landscape Irrigation for all water serviced properties and commercial customers. This emergency rule shall be in effect for 120 days, from July 30th, 2022 – November 29th, 2022. Starting April 1st, 2022 Landscape Irrigation lawn, turf, and plant material including shrubs, flowers, trees, and foliage is allowed. At the May 18th, 2022 Board of Directors Meeting, the Board approved a revision to allow watering for new and/or reseeded turf for owners that have reduced their property’s landscaping turf to no more than 25% of the total landscapable area of their property. Landscape Area, then the owner would be allowed to water twice a day to prevent the top 2 inches of the soil from completely drying out until the grass grows to a height of 1 inch (usually 3 to 4 weeks) at which time the owner would need to change their irrigation schedule to follow the Emergency Landscape Irrigation Rule.

10.3 Exemptions from Irrigation Schedule. No exceptions to irrigation schedule for new plant material (including new turf), other than drip irrigation systems as reviewed by Architectural Control and per the prior irrigation rule schedule. Drip irrigation systems must comply with the Irrigation Limits listed in Section 10.1.

Exclusions to the definition of a property's Total Landscape Area includes impervious areas such as, structures, driveways, walkways and hardscape patios and decks. Additionally, BMP infiltration trenches and landscaped areas supplied by drip irrigation would be excluded.

10.03a Drip Irrigation Schedule • Even Numbered Street Addresses: Monday, Wednesday, and Friday • Odd Numbered Street Addresses: Sunday, Tuesday, and Thursday • Landscape irrigation on Saturday is prohibited.

This temporary relief measure is applicable only to new sod or seeding of turf and does not apply to existing lawns.

10.03b Turf Reduction Exemption The Board of Directors, at the request of the Water Conservation Committee, will allow temporary relief from the Emergency Landscape Irrigation Rule for newly-installed turf provided it does not exceed 25% of the property's Total Landscape Area. The temporary relief would allow new sod to be irrigated twice a day for Days 1 thru 14 and once per day for Days 15 thru 21 and on Day 22 going forward owners will need to follow the Emergency Landscaping Irrigation Rule. Should an owner decide to re-seed their turf and it is reduced to a maximum of 25% of the property's Total

Future of Tahoe Keys Water Company By Keiron McCammon, Board Member

During July’s Board Meeting Farr West presented the results of their analysis of the long-term operations and maintenance options for our Water Company. As I’m sure you recall, we faced a crisis last year when one of our three wells was taken offline due to excessive levels of uranium. It was feared a second well would soon meet a similar fate, leaving us with one operating well as we headed into the peak demand of the summer irrigation season. This crisis necessitated an emergency landscape irrigation ban to ensure our limited capacity of safe and uncontaminated drinking water was available for household use. At the same time, we started work on short and intermediate-term mitigation projects to stabilize our water supply. The good news is that these mitigation projects were a success, with all three wells running again (with reduced capacity) and a new intertie with Lukins Brothers Water Company (LBWC), which has allowed us to restore limited irrigation this summer, per the published schedule. However, while uranium treatment is in place at two of our wells, it is a stop-gap, not a permanent solution.

The short and intermediate-term projects were intended to stabilize our water production and buy us time to identify the long-term direction for our Water Company. At the end of last year, the Long Term Facilities Plan, commissioned at the beginning of that year, was finally completed. Among many recommendations, it identified several options for the future of our Water Company, from continuing to operate independently to outsourcing its management to consolidating with another water company. The Board felt that whether we should remain in the water business as an Association or not trumped everything else. Therefore, we engaged Farr West Engineering to research our options, culminating in the presentation of their findings during the last Board meeting. Farr West developed a non-economic evaluation matrix of the governance alternatives for our Water Company. They created weighted criteria covering technical, managerial, and financial considerations against which they scored each option (putting aside upfront costs on the assumption each option makes the necessary capital investments).

If consolidation is indeed the preferred path, then we need to negotiate the economic realities of this option compared to continuing to operate independently, ultimately bringing it back to homeowners. Unfortunately, I’m afraid our water costs will increase whichever option we all choose as homeowners (and metered usage is coming).

• Remain independent; • Consolidate with STPUD, our local public utility (who already owns our sewage system); • Consolidate with Lukins Brothers Water Company (LBWC), a private local water company; • Consolidate with Golden State Water, a private national water company; • Consolidate with Liberty Utilities, a private national utility company. • And scores each against the identified technical, managerial, and financial criteria resulting in a final weighted score.

I want to acknowledge our debt of gratitude to Jennifer Lukins and Lukins Brothers Water Company (LBWC). Not only is our intertie with LBWC proving invaluable this summer, seeing us through peak irrigation demands, but Jennifer stepped in at the end of last year as our acting Water Company Manager. She is a big part of why all three of our wells are operational again and why our Water Company operations and staff have stabilized after a year of turmoil.

Based on Farr West’s expert opinion, STPUD ranks the highest with a score of 95, followed by the private national companies, Golden State Water and Liberty Utilities, with scores of 74 each, then LBWC with a score of 59, and finally remaining independent with a score of 53. Our Water Company Committee reviewed this evaluation and recommended a consolidation with STPUD. Then, should this prove uneconomical or infeasible, seek consolidation with LBWC (preferring a local company

The Official Communication and Electronic Notice to TKPOA Property Owners By Kirk Wooldridge, General Manager Beginning this past January 1st, 2022, there has been a change in the Davis Stirling Civil Code, that now requires Associations to request members' preferred delivery method (email, mail, or both) for notices and disclosures. In addition, Associations must annually give notice that members are not required to provide their email address to the Association (Civil Code §4041). This notice must be given no later than 30 days prior to mailing the annual budget report (we also call this the “Annual Disclosure”). If a preferred method is not selected by a member, then notices and documents must be sent by First-class mail, postage prepaid, registered or certified mail, express mail, or overnight delivery by an express service carrier (Civil Code §4040). This is currently the practice of the Tahoe Keys Property Owners Association (TKPOA) in following this Civil Code §4041 requirement, in providing the Annual Disclosure Mailing and “Official Notices” via Postage Prepaid Mail and in the Keys Breeze. (This has also been the practice for the past seven years, once the Keys Breeze went to a monthly publication in 2015). The new provision in this 2022 Davis Stirling Civil Code Keys Breeze

(Civil Code §4045) As stated above this would then allow the TKPOA to cut down on it’s direct mailing by Postage Prepaid to TKPOA Property Owners, which will result in an overall cost savings, of postage, mailing material, TKPOA Staff, Volunteers, Contracted Companies time and effort to produce these mailings. As of July 20th, 2022 the TKPOA Board of Directors have provided the TKPOA Staff “Board Direction” to begin this process of notification to members using the TKPOA Website, but also continuing our current practices. Because this change cannot “officially” take place until the “TKPOA Annual Disclosure” is issued in November 2022. The Keys Breeze can also continue to be used for the “Official Communication” for notification to the TKPOA Property Owners, in combination with this new notification method of posting items on the TKPOA Website, currently and officially after November 2022. Ideally this method would be utilized for limited rule changes of no more than a page of copy. In doing so, the TKPOA again will save money on direct mailing and staff costs to prepare rules change mailings.

The Keys Breeze publication also meets the standards of the Corporations Code §5016. The monthly Keys Breeze Magazine is printed on recycled paper with soy-based ink and has been for the past 10 years.

To clarify in the last four years the Keys Breeze publication has “paid for itself” as it has done so in the past four years and many of the previous years. Through the advertisers the Keys Breeze is published monthly to all TKPOA Property Owners free of charge. There are no line item expenses in the TKPOA Budget for the Keys Breeze production. The only cost to the TKPOA is the TKPOA Staff, and Board Members personal time in writing the articles and occasionally the cost for a special photograph, layout, or artwork, which is minimal. With publication of this August 2022 Keys Breeze issue the TKPOA has completed over four years of monthly publications with our current publisher Just Imagine Marketing, Kathy Hess-Slocum. What is the Architectural Control Committee (ACC)? By: Linda Callahan, Architectural Control Department Manager

The Architectural Control Committee (ACC) consists of a group of appointed volunteer homeowners who are responsible for reviewing ACC applications. This is a freestanding committee. The ACC meet once a month through winter and every two weeks, spring through fall for a total of eighteen meetings annually. The general purpose of the ACC is to ensure compliance with aesthetic standards established by the association. In the townhome subdivisions, ACC is primarily focused on improvements that impact the communal areas such as window replacement, balconies, and patio areas. Townhome landscape projects are also reviewed by the ACC. Within the single-family home subdivisions, the committee is primarily concerned with exterior aesthetics. Those matters would include but not be limited to landscapes, fences, driveways, boat docks and roofing. The ACC department staff is responsible for maintaining the standards set forth by the Architectural Control Committee, Governing Documents and the Association Covenants, Controls and Restrictions (CC&Rs). Staff routinely patrols the association, recognizes, records, and generates violations to non-compliant properties. The staff also reviews application submittals to confirm the provided information is correct and all criteria are met for consideration. Staff follows up on projects to assure they have been built according to the submitted and approved plans. Staff is responsible for preparing agendas and recording minutes for the Committee meetings. Staff also maintains and updates ACC documents in homeowner lot files. CMT Water Quality Update Harvesting Operations are underway. The Harvesting team, consisting of one Harvester and one skimming team, started in the East Marina during the end of July and the beginning of August. Harvesting Operations run from 8:30 to 3:30. As in typical years past, the TKPOA AIS Team has taken monthly water samples due to requirements for an existing LFA permit. The results from the July sampling indicated that there are toxic algae present which triggered the WQ Team to put up “Caution” signage around the LFA Site #26 area (Traverse, Slalom, and Christie) on July 18. The UV-C contractor has completed the first round of treatment on all the “UV-C Only” sites - Sites 22, 23 and 24. As the turbidity curtains will remain installed until late August, the UV-C contractor and the TKPOA WQ team are working together to find a solution on getting the UV-C boat to enter the Restricted Area A. Once it enters the area, the boat will treat the “combo” sites (UV-C and herbicide) to complete the total UV-C treatment of the CMT Project. Extension to restrict boating activity of any kind in the following West Lagoon and Lake Tallac areas identified as Treatment Areas A, B, and C from May 9th, 2022 to August 19, 2022. For more information on the updated Emergency Rule, please visit keysweedsmanagement.org. Though the turbidity curtains will remain in place until August 19, 2022, the CMT project has been successful thus far. The two herbicides, Endothall and Triclopyr, are appearing to be effective against their respective target species - Eurasian Watermilfoil and Curlyleaf Pondweed. The turbidity curtains will be removed once both herbicides have completed their respective degradation cycles and are reported as non-detect. To help speed up the degradation of these herbicides, the TKPOA Water Quality Team has installed numerous aerators around the lagoons and are also running the Omnicat throughout Restricted Area A.
