Workers Compensation Savings By Heather Blumenthal, Operations Manager

Per California Employment law the Tahoe Keys Property Owners Association (TKPOA provides the required California Workers Compensation Insurance that provides coverage to employees who are injured during the course of employment.

The TKPOA has seen a reduction in insurance premium cost, which is determined based our Experience Modification Rate that results from the amount and severity of Workers Compensation claims filed in a 5-7 year period. TKPOA has been successful in decreasing the number of claims filed through improved Monthly and ongoing Safety Programs and communication with Staff.

• For the June 1st, 2022-May 31st, 2023 renewal

period, TKPOA’s Experience Modification rate has decreased 0.05 (0.75 to 0.70) resulting in a flat renewal in our renewal rates offered by TKPOA’s current carrier QBE. For the 2022-2023 renewal period there has been an industry wide increase in the Homeowners Association Class Code for Workers Compensation premiums which has resulted in a slight increase to TKPOA’s total annual premium to $47,933 for this renewal term from $45,750 for the expiring term For the June 1st, 2021-May 31st, 2022 renewal period, TKPOA’s Experience Modification rate decreased 0.06 (0.81 to 0.75) resulting in a 7% decrease in our renewal rates offered by new carrier QBE. For the June 1st, 2020-May 31st, 2021 renewal period, TKPOA's Experience Modification rate decreased by 0.17 (0.98 to 0.81) resulting in a 16% decrease in our renewal premium offered by our current carrier, Benchmark Insurance Company. For the June 1st, 2019-May 31st, 2020 renewal period, TKPOA's Experience Modification rate decreased by 0.23 (1.21 to 0.98) resulting in a 25% decrease in our renewal premium offered by our current carrier, Benchmark Insurance Company.

The TKPOA has been working with Hays Companies – Insurance Broker since 2016 and they have continual delivered on improved coverages at lower costs for our Keys Breeze

workers compensation package. Hays Companies went out to a approximately 8 carriers to obtain bids for the 2022-2023 TKPOA's Workers Compensation Insurance Policy, with QBE remaining the most competitive. Based on working with Hays Companies, they have assisted in reviewing and responding to all and any claims and offer recommendations to improve safe work practices. Since 2015 TKPOA Staff’s “Work SAFE” Program has consistently kept employees trained monthly on safe work practices. Through these efforts we have been able to collectively save $87,850 dollars since 2015, and achieve the lowest Workers Compensation expense and MOD Experience rating to date since 2014. The credit goes to the TKPOA Staff for their ongoing commitment to safe work practices and continually creating a safe work environment. Since 2015 TKPOA Management Staff has implemented the “Work SAFE” monthly safety program with employee incentives for each quarterly milestone passed each year without an accident resulting in lost workdays. The Board of Directors has supported and approved this “Work SAFE” program each year since 2015 and the managers and supervisors have implemented it with the monthly safety meetings and additional tailgate safety meetings in the summer months. In the end it has resulted in a substantial cost savings for the TKPOA, employee reward and recognition and a of course a safe working environment.

We would like to remind all TKPOA Property Owners of the rules associated with the use of the pedestrian gate at Lighthouse Shores (LHS) Lot C and Lot A. Through recent Tahoe Keys Property Owners Association (TKPOA) Security Patrols and reviewed Security Camera footage, there have been violations of the Superior Court Case SV-92-0066 Judgement by TKPOA Property Owners and their guests in violation of the following: • Bringing dogs into LHS on or off leash. • Allowing Guests or Vacation Renters to use their TKPOA Member Photo ID card for access to LHS Lot C without the immediate presence of the TKPOA Member • Trespassing on the adjacent LHS Properties THE RULES The rules are straightforward. TKPOA Members should observe the following provisions pursuant to Superior Court Case SV-92-0066: • TKPOA Members with a valid TKPOA Member Photo ID card and guests in the immediate presence of their sponsoring member will be permitted access. Access is only permitted to TKPOA property owners using their photo Member Access card issued by TKPOA. This card is not transferrable; it is not to be loaned or used by anyone other than the property owner to whom it is issued. If you have lost your card or wish to have another one issued, please visit the Pavilion office. • There are no dogs or bicycles allowed, no exceptions. This is clearly posted on the gate and there are bike racks inside the gate. • Access through this gate is allowed from 7:00AM9:00PM except during the summer, during which time the hours will be extend to 10:00PM

your dog, TKPOA members and their guests please keep your dog on a leash. Dogs are welcome on their leash at the Pavilion Beach area. NO TRESPASSING When entering through the LHS pedestrian gate, you are on Lot C which is a narrow lot with Pope Marsh on the left and private residences on the right. TKPOA does not own the properties to the right of Lot C. This is private property and the No Trespassing law per California Penal Code 602PC applies. The City of South Lake Tahoe Police Department will be called for trespassing on these properties. The TKPOA has clearly marked the property lines on the right of the lot. The left side of the lot has a chain link fence all the way down to the beach on the Pope Marsh side. Lot C can be used to access Pope Marsh on the left, however access to the beach on the right is prohibited as this is private property and to do so is considered trespassing (CA 602PC). Access to the right is also a dead end at the West Channel Bulkhead. During Lake Tahoe high water events there is typically no Public Trust beach access. To access Lot A at the end of the LHS roadway at the West Channel Bulkhead, you should walk down the LHS paved roadway.

Pursuant to the Superior Court Case SV-92-0066 Judgement the TKPOA is responsible for the maintenance and security obligations in enforcing this judgement, and at this time the enforcement of these violations including trespassing violations on the adjacent LHS property will be pursued. Based on TKPOA Security Patrols and pedestrian gate Member Card reader identification system, the TKPOA has issued warning notices and in some cases, NO DOGS fines, to those members in violation of the LHS Gate Access as specified in the Superior Court Case Judgement. No Dogs or other pets allowed in LHS. Please remember The TKPOA Board of Directors will continue to utilize the dogs must be on leashes throughout the TKPOA per El Member Discipline process in accordance with Civil Code Dorado County Ordinance Title 6 – Animals, Chapter 6.04. At the May 18th, 2022 Board of Directors Meeting, the Board approved a revision to allow watering for new and/or reseeded turf for owners that have reduced their property’s landscaping turf to no more than 25% of the total landscapable area of their property. This Emergency Rule Order will extend to all TKPOA Common Areas, all Cove Townhome landscaping, all Single-Family home landscaping, and commercial water customer properties landscaping. 10.3 Exemptions from Irrigation Schedule. No exceptions to irrigation schedule for new plant material (including new turf), other than drip irrigation systems as reviewed by Architectural Control and per the prior irrigation rule schedule. Drip irrigation systems must comply with the Irrigation Limits listed in Section 10.1.

Exclusions to the definition of a property's Total Landscape Area includes impervious areas such as, structures, driveways, walkways and hardscape patios and decks. Additionally, BMP infiltration trenches and landscaped areas supplied by drip irrigation would be excluded.

10.03a Drip Irrigation Schedule • Even Numbered Street Addresses: Monday, Wednesday, and Friday • Odd Numbered Street Addresses: Sunday, Tuesday, and Thursday • Landscape irrigation on Saturday is prohibited.

This temporary relief measure is applicable only to new sod or seeding of turf and does not apply to existing lawns.

10.03b Turf Reduction Exemption The Board of Directors, at the request of the Water Conservation Committee, will allow temporary relief from the Emergency Landscape Irrigation Rule for newly-installed turf provided it does not exceed 25% of the property's Total Landscape Area.

10.4 Prohibited Activities. No Owner, nor an Owner’s tenant, contractor, employee, or agent may engage in any of the following activities: Irrigation is Prohibited on Memorial Day Weekend, July Fourth Weekend, and Labor Day Weekend Allowing water to flow over the ground surface or from sprinklers onto surfaces that are not able to absorb water or onto neighboring properties.

The temporary relief would allow new sod to be irrigated twice a day for Days 1 thru 14 and once per day for Days 15 thru 21 and on Day 22 going forward owners will need to follow the Emergency Landscaping Irrigation Rule.

Wildfire Mitigation Wildfires are a part of the reality of living in California. Many summers, smoke smothers our beautiful outdoor playground for days, weeks, or even months. Numerous natural causes may result in the ignition of wildfires. Although Liberty has no control over Mother Nature, we have implemented a Wildfire Mitigation Plan to reduce the risk of an electrical infrastructure-ignited wildfire. Liberty updates its Wildfire Mitigation Plan annually and provides progress reports to the California Public Utilities Commission (CPUC) on a regular basis. “Hardening and upgrading infrastructure and continuing our robust vegetation management practices helps reduce the need for Public Safety Power Shutoffs (PSPS),” explains Eliot Jones, Sr. Manager of Wildfire Prevention. A PSPS is used as a last resort to turn off electricity when fire weather conditions pose an elevated risk. “The wildfire mitigation plan and infrastructure improvements are a process, “Jones states. “It can’t all happen overnight, but we have made significant progress and continue to invest appropriate resources in the program.” In 2021 alone, Liberty

In light of another below-average snowpack and continued drought conditions, we will likely face another severe fire season and elevated potential for PSPS events throughout the summer and fall. Keys Breeze

Should fire conditions warrant a PSPS, Liberty wants you to know what to expect so you can be better prepared. No single factor drives a PSPS. A combination of factors reaching or exceeding set thresholds may determine whether a PSPS will be initiated. Some of these factors include:

Low Humidity Levels – Potential fuels are more likely to ignite when there is a lower amount of water vapor in the air. Forecast Sustained Winds and Gusts – High winds can result in several factors that may cause a fire to ignite. Sustained winds can also cause a fire to spread and even throw embers into the air, creating additional fires. Dry Fuel Conditions – Trees and other vegetation act as fuel for wildfires, and fuels with low moisture levels ignite easily and allow fire to spread rapidly. Red Flag Warnings – The National Weather Service issues these warnings to alert of the onset, or possible onset, of critical weather or dry conditions that may lead to swift increases in wildfire activity.

How Will We Know if a PSPS is Activated? Advance notification is critical in any PSPS scenario, and Liberty will attempt to alert customers, public safety partners, the community, and others at the earliest opportunity. When possible, Liberty will directly notify customers of a PSPS approximately 48 hours before power is shut off, 24 hours before power is shut off, just before power is shut off, during the PSPS, and once power has safely been restored. We strongly encourage customers to call Liberty at 1-800-782-2506 to confirm or update their contact information. If you have a friend or loved one with access and functional needs, help them update their contact information, and consider adding yourself as a secondary contact. on electricity may be eligible for the medical baseline allowance, and those enrolled may also receive priority PSPS information. Call 1-800-782-2506 to see if you qualify. In addition to direct PSPS notifications and updates, Liberty will post outage updates on our website, www.libertyutilities.com, as well as on Facebook (@ LibertyUtilitiesLT) and Twitter (@LibertyUtil_CA). How do I Prepare? Once you have confirmed your contact information is current, PSPS preparation is not much different from any other power outage preparation. Here are some tips:

Plan for medical needs that may be impacted by a power shutoff, including medications that need refrigeration or devices that require power. Be sure to register any medical-related energy needs at 1-800782-2506. Create an emergency kit, including flashlights, batteries, first aid supplies and maps of the local area. For additional emergency kit necessities, consult Ready.gov. Store non-perishable foods and water to support your family and pets for a minimum of 48 hours. Keep a full tank of gas or a fully charged battery for your vehicle, as gas and charging stations may be affected by a power outage. Keep cash available, as ATMs and credit card machines may be unavailable during a power outage. Be sure phones and other critical electronic devices are charged and consider investing in a backup battery or power source, potentially one that can recharge with solar.

PRESIDENT’S MESSAGE By: Dave Peterson, Board President

Today is a beautiful spring day in the Keys. People have put away their winter gear and are transitioning to summer. It’s a wonderful time to be here! Here is an update on some of the issues the board is working on: 1. Aquatic Weeds. The biggest thing happening in the Keys is the Control Methods Test (CMT). The Water Quality Committee and our team of consultants took a hard look at forecast hydrology and all of the other precursors to the test, and recommended to the Board that we go forward, so the Board authorized all of the contracts necessary to accomplish the test. Crews have been hard at work constructing barriers, blocking culverts, placing monitoring equipment, and performing background monitoring. Herbicide application will be done in several locations within the west lagoon system and Lake Tallac in late May. This CMT is a large-scale program to help us and our partners in government figure out how to manage the weeds all over the Keys, including the east channel. It benefits us all. The cost exceeds the special assessment we did a few years ago, so the board authorized borrowing about $1M from common reserves to keep the ball rolling. The Water Quality and Finance Committees are working on a plan to fund the shortfall, and we will likely be looking at another special assessment. If so, it will go out for member vote. The good thing is that TRPA is picking up more than half of the cost of the CMT, but our share is still underfunded. More to come on that between now and July. Boating and water fun are restricted in the test areas, as you no-doubt know. Please help us in urging family, neighbors, tenants, and others to respect the restrictions so that we don’t mess up this costly test program. Recreation will be fully restored in early July. 2. Water Company. The Water Conservation Committee held a town hall meeting in May on our new “Tahoe Keys Landscape Conservation Idea Book”, which was developed with funding and major assistance Keys Breeze

from TRPA. The book provides lots of good ideas for how to re-imagine our landscapes to be less turfcentric, more water efficient, and more maintenance friendly. I’d encourage all of you to download it from the TKPOA website and take a look. The committee also recommended changes to our emergency order on irrigation to relax restrictions on drip watering, and to allow more frequent watering during the establishment period for replacement turf, as long as the turf area is reduced to no more than 25% of your available landscape area. You’ll see the update to the emergency order in the mail, Keys Breeze, and eblast. The Water Conservation Committee also recommended that the board hire a design firm to develop a landscape master plan for all of our common areas, so we are in the process of soliciting proposals. Once we select a design firm, there will be an outreach effort to get member input throughout the design process. Irrigation has begun, and most people are sticking to their assigned time slots, which is successfully spreading Keys water demands around the clock. Our wells are handling the load without problems, and all water served meets all safe drinking water requirements. Success, so far! The weekend of July 4 is usually the peak demand time for us, so the Emergency Order prohibits watering that weekend. Please do what you can to help us “beat the peak” over the holiday weekend. 3. Garbage, Bears, and Trees. We moved the Pavilion dumpsters to the Water Company property on Texas Ave. for second homeowner Sunday service. This has been successful so far. We had a townhall meeting in late May focused on garbage service, because positive changes are afoot to move toward outdoor enclosures with wheeled totes at single family homes. More to come as that program develops. Bears have come out of hibernation, and are roaming the Keys again. The board in February authorized the California Department of Fish and Wildlife to use our common areas to trap and relocate “Hank the Tank”, and also to tag any others caught. is important to prevent mistaken identity in future incidents. The trapping program we authorized does not include killing the bears; just catch, tag, and haze. So if you see bear traps, please respect the process and stay clear for everybody’s safety.

As many of you know, mature trees have been falling over in the wind throughout the keys. Some damage has occurred, but it’s remarkable that it hasn’t been worse. Many, if not most of the trees are healthy conifers, so it doesn’t appear to me to be pest or drought stress. The wind was horrific this winter, and some of these trees may have outgrown their shallow

On May 25th, 2022, the Tahoe Keys Property Owners Association (TKPOA) received final approval from the Lahontan Regional Water Quality Control Board (LRWQCB) of the submitted Aquatic Pesticide Application Plan (APAP) Amendments 1 and 2, allowing the Control Methods Test (CMT) to move forward as scheduled. The 2022 CMT Boating Restrictions Emergency Rule has also been officially changed based on this approval on May 25th, 2022, which includes the new location of Site 14. The TKPOA has installed the turbidity curtains to align with this approved Site 14 move, and the extent of Restricted Area A (RED) has been decreased.

The number of water quality monitoring, aquatic plant, and other sampling data points that will be collected is forecasted at over 25,000 for 2022. The CMT will test two herbicides in 13 sites and UV-C light in 9 sites of approximately one acre each. The 13 herbicide test sites have been divided into three large ‘test areas’ – Area A, B, C and the data collection and compliance monitoring points are indicated on the adjacent map: “Tahoe Keys Lagoons CMT, Nonherbicide/Herbicide and Rhodamine Monitoring (National Pollutant Discharge Elimination System (NPDES) Compliance Map”. The CMT will cost the TKPOA and the TRPA collectively over $3.0 million dollars. For TKPOA, this is funded by the Water Quality Third Payment Special Assessment, and a proposed TKPOA Water Quality 2022 Fourth Payment

Special Assessment (RESOLUTION TKPOA #2022-0427) pending membership vote. The TRPA is funding it’s portion with Environmental Improvement Program funding from the Lake Tahoe Restoration Act. Boats and other watercraft docked prior to May 9th, 2022 may remain moored, but cannot be operated, from May 9th, 2022 to as late as mid-July 2022.

Any interference with these tests sites by homeowner or outsider swimmers, pets, boats, sailboats, personal watercrafts, kayaks, canoes or stand-up paddleboards and similar watercraft could compromise the entire CMT and result in significant financial impact to TKPOA plus years of delays to solving the weeds problem. The next major notification from TKPOA will be when the turbidity curtains can be removed by Treatment Areas A, B, C and/or Sites, to open boating back up for the summer. TAHOE KEYS PROPERTY OWNERS ASSOCIATION VISION STATEMENT

At the January 19th, 2022 Board of Directors meeting, the TKPOA Vision Ad Hoc Subcommittee presented the Board with a draft revised Mission Statement and Vision Statement for the Tahoe Keys Property Owners Association.

Why is a Vision and Mission Statement Important? It is easy to think that a Vision and Mission Statement are interchangeable, however, they are not. An organization’s Vision Statement looks forward and creates the image of the ideal state and objectives that the organization wants to achieve in the future whereas a Mission Statement, summarizes the goals and values of the organization. Having these two important business statements assists an organization, such as the TKPOA, in decision-making, setting goals, and attracting future job candidates and homeowners. What is the Vision Ad Hoc Committee? In late 2020, the Board of Directors established the Vision Ad Hoc Committee to assist the Board with TKPOA’s re-boot and charting of a new course in a post-pandemic world. The Committee was tasked with creating TKPOA’s new vision through an updated Mission Statement, Vision, and Values and with determining methods of communication to provide this new Vision to the TKPOA Property Owners and the greater community. Committee members have included Peter Grant (2020-current), Joy Curry Norem (2020-current), Connie Haverty (2020-current), Sean Ward (2020), Arlene Olson (2020), Nate Summer (2020), Keiron McCammon (2020-current), and Steve Shepherd (2020-current). The Committee’s January 19th, 2022 presentation was a culmination of the Committee’s hard work with support from Staff in the last year to create and new vision for the Tahoe Keys. After the Committee’s presentation, the Board voted to unanimously approve TKPOA’s new Vision and Mission Statements Keys Breeze

TAHOE KEYS PROPERTY OWNERS ASSOCIATION MISSION STATEMENT The Tahoe Keys Property Owners Association is a well maintained and operated recreational-oriented residential association of 1,528 homeowners on the shores of Lake Tahoe. The TKPOA strives to be: 1. A safe and welcoming community boasting a wide range of exceptional amenities, services, activities and facilities for homeowners and their guests to enjoy. 2. A community and association committed to protecting and enhancing the outstanding natural beauty and resources that surround it. 3. A unique setting for lake, boat, and outdoor lovers alike to relish, enjoy and appreciate all that Lake Tahoe has to offer. With the approval of the new Vision and Mission Statements, the Vision Ad Hoc Committee has begun working on next steps for communication and implementation, including continuing work on a draft Values Statement for future Board review and approval with support from Staff in the last year to create a new vision for the Tahoe Keys. The Finance Committee reviewed the April 2022 financial statements on June 1st, 2022 and passed a motion recommending that the Board approve them as well. Once the Board of Directors approves them, the financial statements will be posted on the TKPOA website. The Finance Committee also reviewed 2023 Budget Planning report by Ken Silveira and the Budget Development Schedule and discussed a report from the insurance brokers on potential insurance rates for the upcoming policy renewal on October 1st, 2022. The Finance Committee next meets on Wednesday June 29th, 2022 at 10:00 AM.

ACC Rule of the Month - Fire Pits and BBQs By: Linda Callahan, Architectural Control Department Manager Tahoe Keys Property Owners Association Architectural Control Rules (ACR) and CC&Rs 15.09 Use of charcoal or wood BBQs on decks or near combustible surfaces within the town home subdivisions is strictly prohibited. 15.10 Fire Pits: Only LP gas or natural gas fire pits are permitted in single-family home subdivisions. CC&Rs Article VIII Section 13. Barbecues. There shall be no exterior fires whatsoever except barbecue fires contained within receptacles designed for such purpose. City of South Lake Tahoe No Open Burning The City of South Lake Tahoe does not allow any open burning within the city limits. The exceptions to this are gas fireplaces and BBQ’s that use either LP gas or charcoal. NO BURNING OF WOOD, LEAVES, PINE NEEDLES, YARD WASTE OR BRUSH. South Lake Tahoe Fire Rescue does not currently have a Fire Marshal. The fire prevention duties have been assigned to the Building Department due to budget cuts. All new construction and business inspections are conducted by the City’s Fire Inspector, who works out of 1052 Tata Lane within the Building Department.
