Board of Directors Regular Board Meeting. Preparation of the budget that was approved followed six months of work that began in April and is the result of significant efforts by the Tahoe Keys Property Owners Association (TKPOA) staff, the Finance Committee, the Cove Advisors, and the Board of Directors. The “Budget” actually consists of 19 operating budgets and 20 reserve funding plans. The operating budgets address the EACH YEAR, THE ASSOCIATION planned operating revenues and expenses for the four major funds (Common, Water MUST DISTRIBUTE AN Company, Water Quality, and Channel "ANNUAL BUDGET REPORT" and Lagoons), 12 townhouse subdivisions, and four single-family subdivisions. HOLIDAY LIGHTS HOLIDAY LIGHTS CANNOT REMAIN on the residence year

round. Lights should be removed after the holiday, weather permitting. According to the Architectural Control Rules Brochure (ACRB), Section 15, Misc. Provisions for Exterior Grounds, Storage and Structures, Item 15.14 reads as follows: Holiday and traditional displays vary widely. Displays and holiday decorations may be erected temporarily without a permit. Holiday decorations may be displayed no more than 30 days before or 14 days after a holiday (weather permitting). Decorations for personal events (birthdays, weddings, homecomings, etc.) may be displayed no more than three days before and three days after the event. All other displays require ACC approval and must be in harmony with the requisite occasion (as appropriate) and surrounding structures and neighborhood. Lights may not shine so brightly as to be an unreasonable disturbance to neighbors or drivers and no sound devices are permitted for any decoration. All lighted displays must be turned off by 11:00 pm. No display may obstruct the views from any other property.

This season of giving is more important than ever, as our community faces complex challenges brought on by the pandemic. To help provide additional financial resources in response to the pandemic, the COVID-19 Response Fund is the beneficiary of the Barton Foundation’s 30th Annual Gala, held virtually this year beginning November 30 through December 11, 2020 at BartonHealth.org/Gala.

Over 700 local families suffering from food insecurity issues have already been helped through generous donations to the Response Fund. Additional donations to the Response Fund will be critical this winter, as residents continue to struggle to feed their families. The Response Fund also provides essential personal protective equipment and medical supplies for frontline healthcare workers, and helps with funding for the continuous adaptation of mitigation strategies and safety equipment for residents of Barton’s Skilled Nursing Facility. The Skilled Nursing Facility is home to some of Barton Health’s most vulnerable patients. Visitation to this long-term care facility has been highly restricted since March, 2020 to protect these vulnerable community members and their care providers. Many of us miss visiting with friends and family members who are in isolation, whose health would be extremely at-risk should they be exposed to COVID-19. With the support of donations through its annual Gala, the Barton Foundation is striving to facilitate additional safe visitation options for families to visit their loved ones at the Skilled Nursing Facility. With your help and generosity, the Barton Foundation will continue its work in our community, as we support community members in need and provide medical equipment and supplies to our frontline healthcare workers.

components of the common areas and common facilities which the Association is obligated to maintain and for contingencies; (iii)An estimate of the current replacement cost of the estimated remaining useful life of, and the methods of funding to defray repair or replacement of, or additions to, those major components of the common areas and common facilities which the Association is obligated to maintain; (iv)A general statement setting forth the procedures used by the Board of Directors in the calculation and establishment of reserves to defray the cost of repair, replacement or additions to major components of the common areas and common facilities which the Association is obligated to maintain. On October 31st, 2020, the TKPOA Annual Disclosure was mailed out to all property owners. All these required Disclosure documents must be distributed by “First-class mail, postage prepaid, registered or certified mail, express mail, or overnight delivery by an express service carrier.” (Civil Code §4040.), however,

upon written consent of members, associations may distribute documents and disclosures electronically. The TKPOA will be sending out 477 2021 Annual Disclosures electronically to those members at a savings of approximately $4,000 to the TKPOA after the remaining 1,052 Disclosures were mailed. The Davis-Stirling Common Interest Development Act is the California Civil Code and (Section §5300 and §5570) contains the detailed Disclosure requirements and the deadlines for most of these required items. In addition to the required items the TKPOA has included some additional information to further lend explanation to the documents required. SEPTEMBER 16TH – JOINT BOARD AND FINANCE MEETING BOARD ACTIONS • Directed the Finance Committee and staff to update the 2021 Budget in a sixth draft based on the recommended budget reduction items to be added back into the 2021 Budget in order to maintain current services and to review other potential reductions including the estimated reduction in Association insurance premiums to offset the items added back into the proposed 2021 Budget. • Directed the Finance Committee and staff to include a 50% reduction in water quality assessments for the approximately 110 landlocked properties that do not front on any body of water and are not also a part of the Tahoe Keys Beach and Harbor Association (TKB&HA) in the sixth draft of the 2021 Budget. • Directed the Finance Committee and staff to add the Ala Wai Median Project to the Reserve Funding Plan for planned completion of Phase 1 in 2021 or 2022. • Approved the 2021 TKPOA Annual VHR Permit Fee at $525 to be prorated and billed monthly based on the City of South Lake Tahoe (CSLT) VHR Permit expiration date. • Approved the 2021 Fine Schedule. • Approved the 2021 Budget Allocation Schedules.

SEPTEMBER 28TH – JOINT BOARD AND FINANCE MEETING BOARD ACTIONS • Approved reclassifying $31,970 in legal fees for 2020 from Water Company to Water Quality and $1,143 from Water Company to Common. • Directed staff to add the Ala Wai Blvd Median Project into the Reserve Plan and increase funding to cover the project spread over five years beginning in 2022. • Approved a $9 per quarter increase in the Water Company Operating Assessment. • Approved adding the anticipated East Channel Keys Breeze

Bulkhead legal fees to the channels and lagoons Reserve Plan budget in the amount of $150,000 spread over 2021, 2022, and 2023 and to include a potential recovery of a portion of those legal fees based on an anticipated victory for TKPOA. • Approved reclassifying $50,000 to the Water Quality Operating budget for legal fees from the Common Operating Legal budget.

SEPTEMBER 30TH – EMERGENCY EMAIL MEETING #1 • Approved the Hays Companies 2020–2021 TKPOA Insurance Coverage Premiums as presented for $684,841 beginning October 1st, 2020.

OCTOBER 12TH – BOARD OF DIRECTORS MEETING BOARD ACTIONS

• Authorized the Tahoe Keys Water Company to accept the September 28th, 2020 quote from Jacobi Carbon to perform removal of spent carbon and install new carbon media for $36,165 to be funded out of the Water Company Reserves Fund. • Approved the Premium Finance Agreement with First Insurance Funding for TKPOA’s Insurance Financing Contract.

OCTOBER 21ST – EXECUTIVE SESSION BOARD ACTIONS

• Reviewed 13 personnel matters. • Approved the 2021 TKPOA holiday schedule. • Reviewed six disciplinary matters including three disciplinary hearings. • Reviewed 15 legal matters including ongoing issues with the Tahoe Keys Marina and Yacht Club. • Directed staff to schedule a Town Hall Forum the week of November 16th for those members who have Lake Tallac encroachments. • Reviewed eight contracts, no new contracts were approved.

Bylaws—Vote! By Ken Silveira Bylaws and CC&Rs Communication Ad Hoc Committee ALL MEMBERS RECENTLY RECEIVED a voting package to vote on the adoption of Amended and Restated Bylaws. This is the first update of the Bylaws in over twenty years. An update of the Bylaws had been in the works for some time, but recent changes in state law made an update necessary as soon as possible. An update of the CC&Rs is also planned for early next year. The updated Bylaws have a fresh look and reflect changes in law as well as a few recommended changes by the Board. The changes in law were primarily the result of State Bill 323, which took effect this year. A summary of the proposed changes was included in the voting package, but members should review the proposed Bylaws for themselves. To assist members with voting, the current Bylaws are posted on the TKPOA website in the Documents/Bylaws CC&R section along with other information that may be of interest and assistance. A Town Hall is also scheduled for November 10th, 2020. Please vote! The Bylaws (and state law) require a quorum of at least 1/3 of the members to participate in this type of vote. In the case of the TKPOA, that is at least 509 members. In order to be considered, mailed ballots must be received by the Inspector of Elections no later than 3:00 pm PST on December 14th, 2020. Ballots can also be submitted at the TKPOA Pavilion office in the locked ballot box located in the lobby Monday-Sunday 8:30 am–4:30 pm. Ballots will be opened and counted at an open Board of Directors meeting at the TKPOA Office on December 16th, 2020, starting at 6:00 pm. Hand delivered ballots will be accepted until 6:05 pm at this meeting. Any ballots received after that time and date will not be counted. The Board of Directors or Inspector of Elections may extend these dates up to two successive periods of thirty (30) days each if needed to obtain a quorum. If the quorum requirement is not met, another costly vote will need to be conducted in the future. By Keiron McCammon, Board Treasurer IT IS THAT TIME OF YEAR where the Board has to approve the assessment fees and budgets for 2021.

Building the budget for our Association is a long and involved process that kicked off in May with our General Manager, Accounting Manager, Board Subcommittee, Cove Advisors, and Finance Committee, all working on forecasting operating expenses for next year and updating our thirty-year reserve plans. These numbers dictate our quarterly assessment fees for the Common, Water Company, Water Quality, and Channel and Lagoons individual budgets and reserves along with the sixteen individual budgets and reserves for each of our separate townhomes and subdivisions. This year is my first year jumping into the middle of this undertaking. I must compliment our staff, Finance Committee members, and my predecessor, Jim Siegfried, for driving this process year-in, yearout. On October 21st, during the Board of Directors Regular Board Meeting, the Board approved the 2021 budget. The quarterly assessment fee for most members next year will be $735 versus $693 for this year. An increase of a little over 6% compared to the near 11% increase we saw from 2019 to 2020. Over the last two years, our assessment fees have increased double-digits year-over-year, on top of the two Water Quality Special Assessment payments ($400 each) to date, with a third payment scheduled for 2021 of up to $600. In running for election to the Board, one of my goals was to find ways to reduce costs and avoid another double-digit increase for the third year in a row. I will honestly say my results have been mixed.

We face several challenges going into 2021

First and foremost, with Measure T coming into full effect, the number of active vacation home rentals (VHRs) will significantly decline throughout the next year. This decline means less income from VHR permits, along with less revenue from selling recreation passes to those VHR guests that wish to use our facilities. If we didn’t find ways to reduce costs somewhere, all homeowners would have to make up this shortfall through an even bigger increase in our assessment fees. And since there will be some vacation rental activity next year, we arguably can’t cut all incremental costs specific to VHRs until 2022. Second, there have been numerous requests from homeowners that do not reside on our waterways to reinstate the 50% reduction in Water Quality fees that had been in place until 2017. After reviewing these requests, the Board felt that a subset of these homeowners (those that do not reside on our waterways or Lake Tallac and are not members of the Tahoe Keys Beach & Harbor Association) truly do not benefit as much as other homeowners from our water quality and weed harvesting efforts. To this end, the Board decided that 105 homeowners will receive a 50% reduction in their Water Quality fees for 2021. For these members, the quarterly assessment fee will be $677. The one four-plex and three duplex homeowners that are also considered landlocked will see a quarterly assessment fee of $925 and $770, respectively. This reduction will be something that the Board will continue to reassess each year. To partially address these reductions in income, the Board has approved limited services reductions. Mostly to those services closely tied to the costs incurred due to vacation rentals. The first is a reduction in security patrol hours. Instead of starting at 8:00 am, our security patrols will commence at 10:00 am. These hours will be adjusted for peak holidays like July 4th and New Year’s, as we do today, to ensure we have extended coverage during those times. The second reduction is to the front desk office hours at the weekends. With fewer VHR guests expected, front desk office hours will be reduced to four hours a day on Saturdays and Sundays, rather than eight hours a day. The third reduction is to close our indoor pool on Tuesdays for 32 weeks of the year between September and May, major holidays excluded. It was debated whether we should close the pool early at 8:00 pm versus 10:00 pm or close one day a week. After hearing feedback from members during several Board meetings, the Board decided that closing one day a week would be less impactful to homeowners. The fourth reduction is to eliminate the outdoor pool attendant Monday to Thursday during the summer months when this pool is open. We will still have an attendant on Fridays, Saturdays, and Sundays. These reductions will help reduce our operating costs through next year, along with various smaller cost reductions identified by our staff. Keys Breeze

Unfortunately, these changes alone were not enough to bring the assessment down to an acceptable level for a majority of the Board. The Board was split as to whether we should be making further changes (or even if we should be making the reductions outlined above). The subsequent reductions were hard to contemplate because they impact our staff directly. The fifth reduction is to implement a one-off wage freeze for all non-minimum wage employees for 2021. Minimum wage employees will receive the state-mandated increase from $13 per hour to $14 per hour. This action was against the Finance Committee’s recommendation but was supported by a majority of the Board. The sixth reduction was to eliminate hiring an Administrative Clerk, a position that has been unfilled since May this year. This effective elimination in staff means that our General Manager and Operations Manager will continue to share this administrative burden next year. Again this action was not supported by all Board members but was supported by a majority. These six changes, along with numerous smaller savings, resulted in the ninth draft of the 2021 budget that the Board approved on October 21st for a quarterly assessment fee of $735. Along with this approval came the approval of the assessments and reserve plans for each of our separate townhomes and subdivisions. Their quarterly assessments will range from $735 to $2,848. Unfortunately, a couple of our Coves face double-digit increases next year, mainly due to the funding needed for reserve projects. The “Annual Budget Report” and “Annual Policy Statement” will be included in the Association’s Annual Disclosure that will be distributed by mail in November, unless you have given written consent that such documents and disclosures can be sent electronically—something I highly encourage to help us save some trees and money on printing and postage. Next month, I’ll further break down the budget, looking at the increases related to our reserves versus increases due to the shortfall in income from operations. You can also review the approved 2021 Budget on the TKPOA website, www.tkpoa.com. The Board and staff remain committed to finding additional efficiencies and savings from here on out; our efforts don’t stop just because the budget has been set. TKPOA Maintenance & Landscaping Departments By Tom Callahan, Facilities Manager

THE TAHOE KEYS PROPERTY OWNERS ASSOCIATION (TKPOA) Maintenance Department staff is comprised of two full time, year around technicians and two full time, seasonal employees who are primarily responsible for general maintenance, repair, and preventative maintenance in common and townhome areas. We respond to all building and facility related safety and maintenance concerns. The department maintains the common areas by performing various tasks in a variety of trades including carpentry, plumbing, electrical, trash patrols, tree removal, snow removal, and painting to ensure attractive and well-maintained facilities. Areas we are responsible for include all common areas, which are made up of 12 parks, six tennis courts, four pickle ball courts, indoor and outdoor pools, children’s playground, three basketball hoops, the Pavilion building, Pavilion beach, pier, Lighthouse Shores (LHS) gates, LHS Lot A & Lot C and beach. Additionally, we provide some wildlife management (geese patrol). We also help maintain the camera system for Security and the key card system for all access gates. The West and East channel on shore navigation lights are also maintained by our maintenance team.

In addition to these maintenance duties, a large responsibility for our department includes trash removal and doggie pot patrols. Trash management and overall maintenance issues has been a huge challenge for us in 2020 with the increased traffic of the homeowners and their guests during this COVID-19 summer! We patrol 23 dumpsters and 25 trash/dog waste cans every morning Monday through Friday. All indoor and outdoor pool heaters, pumps, filters, and other equipment must also be maintained throughout the year. In the summer season, the Maintenance Department is responsible for cleaning and pool chemical balancing for the outdoor pool. We work closely with the Cove Advisors from the townhomes to maintain the 335 townhome condominiums and their common areas. All work performed is charged through a work order process. We are responsible for managing a work order process for the cove advisors. We also oversee some of the reserve projects that are approved by the cove advisors. As the Facilities Manager, I am responsible for negotiating contracts and overseeing all landscaping & snow removal contractors for the townhomes, as well as Lighthouse Shores. Working with the Cove Advisors to ensure these services are delivered as contracted. It has been and will always be my goal as Facilities Manager to be responsive to the requests of the TKPOA and be proactive in identifying areas that can be improved and kept in good working order. The Maintenance Department is responsible for the snow removal for the common area parking lots and walkways. Working in tandem with the Tahoe Keys Water Company in this regard.

The TKPOA Landscaping Department cleans, mows, edges, and maintains over one million square feet of common areas from spring to fall seasons. This breaks down into over 30 individual parcels. There are four very large parks and walkways along Ala Wai Boulevard, five large parks along Venice Drive, two parks on Texas Drive, two parks near Danube Drive, and several smaller parks in the Keys. The landscaping crew consists of four full time, summer seasonal landscapers and one full time, year-round supervisor assists with snow removal, landscaping equipment maintenance, and vehicle maintenance in the winter months and other maintenance tasks. Irrigation systems and all planters are also maintained throughout the common areas. There are 11 separate medians along Tahoe Keys Boulevard and Ala Wai Boulevard that are owned by the City of South Lake Tahoe. We manage the drip irrigation on City medians #1 –11, beginning at the Tahoe Keys Monument entry sign and maintain these medians to a natural state. This summer we have installed a paver walk and Rose Garden in the Capris Drive Park. We have also added bicycle racks, park benches, and performed some tree removals. The goal for the Landscaping Department is to continually improve the overall curb appeal of the Keys community while, at the same time, being conscious of the irrigation guidelines while reducing water consumption. Both the maintenance and landscaping departments currently work out of the Corporation Yard at the end of 2266 Dover Drive. We have completed the process of designing a new facility, and hope to break ground in 2021 for a new building on Venice Drive, near the entrance to the Tahoe Keys Marina and Yacht Club (TKM) & (YC). |

At the October 21st, 2020 Open Board Meeting, the TKPOA Board of Directors approved the TKPOA 2021 Annual Budget, approved the August Financial Statements, reviewed homeowner delinquent accounts and scheduled disciplinary hearings on delinquent accounts. There were no approvals for lien notices for delinquent homeowners to review. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments. Keys Breeze

The TKPOA 2021 Annual Disclosure and Budget was mailed out October 30th, 2020 and is also available on the TKPOA website. 477 homeowners opted to have the TKPOA 2021 Annual Disclosure and Budget sent to them via email rather than a hard copy in the mail. This is a 52% increase over last year and gives the TKPOA a savings on printing and mailing costs. If you also wish to participate in helping the Association to save money, you will find the “Consent to Receive Disclosures via Electronic Delivery� in the Annual Disclosure. On October 20th, 2020, the Finance Committee reviewed and approved the August Financial Statements, reviewed, and set for further discussion, a possible credit to TKPOA members due to the surplus from the sale of the lot on Lake Tallac. The next meeting for the Finance Committee is scheduled for Tuesday, November 17th, 2020. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).

ELECTRONIC COMMUNICATIONS By Heather Blumenthal, Operations Manager EACH YEAR IN OCTOBER, TKPOA conducts a mailing

to each member for their copy of the Annual Disclosure. This 80+ page document includes the upcoming year’s Operating Budget, Notice of Assessment Increases, Budget and Assessment Summary, Annual Update of TKPOA’s Reserve Study, and other pertinent required information for members of the TKPOA as we prepare to go into a new year. This mailing is a requirement of Civil Code §4040 for Homeowners Associations. In 2019, the costs for printing and mailing the Annual Disclosure to members of the TKPOA who had not submitted an authorization to receive the Disclosure electronically totaled approximately $9,000. Updates to the Civil Code requirements has allowed for Associations to provide members their Annual Disclosure via electronic delivery, such as email, as long as the member has provided the Association with a completed and signed “Consent to Receive Disclosures via Electronic Delivery” Form. This year, TKPOA received a total of 477 “Consent to Receive Disclosures via Electronic Delivery” forms from members in time for the mailing of the 2021 Annual Disclosure. On October 28th, 2020, these 477 members went sent an email with a link to their copy of the 2020 Annual Disclosure, resulting in an approximately $1,000 savings in printing and mailing costs after the remaining 1,052 Disclosures were mailed (compared to the mailing of the 2020 Annual Disclosure). TKPOA realized approximately $3,000 in savings for last years mailing of the 2020 Annual Disclosure (compared to the mailing of the 2019 Annual Disclosure in 2018) based on the initial start of electronic delivery for Disclosures and consent from 314 members to receive Disclosures via email as of October 31st, 2019. In order to continue to realize these cost savings, TKPOA needs more members to sign up to receive their Annual Disclosures, and other communications via electronic delivery (email) as allowed by law. Examples of other electronic communications you may receive from TKPOA include email eblasts that get you the latest and greatest information on topics such as TKPOA Board Meetings, Town Hall Forum Announcements, Weed Harvesting Schedules, current and upcoming projects, Board Elections, etc. The “Consent to Receive Disclosures via Electronic Delivery” form can be found on the TKPOA website www.tkpoa.com, requested from the front desk at info@tahoekeyspoa.org, or requested in person at the TKPOA Pavilion Office. Completed and signed forms should be returned to the TKPOA Office at 356 Ala Wai Blvd, South Lake Tahoe, CA 96150. Contact the front desk with any questions at (530) 542-6444.
