GBA GRABS DAF TIME-SAVERS
M
eeting demanding time-critical delivery requirements for the automotive, aeronautical and pharmaceutical industries is a key element of the work that will be undertaken by a pair of Euro 6-compliant DAF XF460 tractor units that have just joined the fleet of GBA Services. The company, which operates throughout the UK and mainland Europe from its head office in Lancashire and depots in eight other UK locations, is trialling the trucks six months ahead of Euro 6 becoming mandatory to better inform its future purchase decisions. GBA Services specialises in express services and the movement of sensitive equipment and highvalue goods, and runs a fleet of over 200 vehicles. Both of the new XFs will be used on continental work covering at least 200,000 km annually. The
large amount of space and generous double bunks in the DAF Super Space cab were important factors in choosing the model, as the trucks will be double-manned on longer runs. Managing director David Birkbeck cites other key considerations as being the exceptional fuel economy of DAF XF105s in the fleet, and the need to maintain high environmental standards in line with the requirements of many of its blue-chip customers. “Our customers, particularly those in the pharmaceutical industry, expect cleaner trucks – and these Euro 6-compliant DAFs fully meet their expectations,” he said. “On time-critical work, we also need to ensure first-class reliability and support should a problem occur. We receive both of these from DAF through its trucks, the UK DAF dealer network, and DAFAid for Europewide roadside assistance.”
RUSSIAN ACCIDENT SCAM IS ON THE RISE
Police and insurance companies are battling ‘injury-for-cash’ scams in the UK
C
rash-for-cash scams are already costing UK motorists £400 million a year – but a new report from dashboard camera firm PoliceWitness has suggested ‘injury for cash’ could hit the UK much harder. With increasing poverty and the direct effects of austerity measures affecting countries worldwide, people are literally throwing themselves in front of passing vehicles to claim personal injury compensation. So prolific is the problem in Russia that over 50 per cent of vehicles now have dashboard cameras installed. Popular with scammers in Russia, the set-up sees one criminal acting as a pedestrian, who then deliberately runs into the oncoming path of a truck or bus to gain compensation for injuries. In one recorded incident, the individual was literally bounced from the side of a vehicle, which continued on its journey (the scammer on this occasion was not seriously hurt). According to PoliceWitness boss Matt Stockdale, the UK’s ‘no win – no fee’ insurance culture is literally a
haven for those who wish to defraud the system. Video evidence can provide a strong defence against fraudulent injury-for-cash claims, and truck operators and drivers are being urged to install dashboard-mounted cameras in their vehicles to safeguard against such claims being found in the scammer’s favour. The cameras can prove the innocence of the driver and the wrong-doing of the pedestrian if the matter goes to court. “The UK’s doors are wide open, and with that comes new ways to defraud the UK public and its infrastructure,” Stockdale said. “It will not be long before the Russian scam is prevalent over here. “Drivers must protect themselves from being ridiculed and conned by people who are only bothered about obtaining money through their wrongdoing. “PoliceWitness.com urges drivers to take matters into their own hands and install a dashcam to prove their careful driving. It could be the only thing to stop this appalling crime from affecting them.”
The two new DAF tractor units are FT XF two-axle models for operation at 40 tonnes gvw. Power is from the 12.9-litre MX340 engine rated at 460 bhp (340 kW) at between 1500-1900 rpm, and which has a flexible torque output of 2300 Nm at between 10001400 rpm. “Driver retention is also something we have to take into account, and the new XF is very well specified to keep our drivers happy with features such as air conditioning, a pollen filter, fridge, comfortable high-spec seats and an auxiliary heater,” Birkbeck added. “We’ve also opted for the 12-speed AS-Tronic gearbox for safer two-pedal driving and more consistent fuel efficiency between different drivers. And the MX engine brake assists on long or steep descents, reducing brake fade and wear on the service brakes.”

ROAD RAGE STILL AN ISSUE
N
ew research by Admiral has found that motorists are still seeing red behind the wheel. According to the insurance provider, the main causes of road rage are being cut up by drivers (67 per cent), drivers not indicating (65 per cent) and the general rudeness of other motorists (61 per cent). Driving too slowly (43 per cent) is seen as more annoying than driving too fast (30 per cent). Nearly 1 in 10 of drivers have been threatened with physical violence, and just over half of the drivers questioned agreed road users are generally less courteous than five years ago. Of the 3120 drivers questioned by YouGov for the Admiral Survey of UK Motorists, nearly half (48 per cent) admitted to experiencing road rage, with almost a third (32 per cent) of these saying they get it more than once a week. Over a fifth of road rage sufferers have argued with another motorist because of road rage, while 36 per cent admitted it makes them drive more aggressively. Almost one in 10 said they’ve followed another driver as a result. While both men and women get road rage, the study found men are more likely to drive aggressively, have arguments, follow drivers and make offensive gestures as a result of their road rage. Admiral spokesman James Carnduff said: “It’s bad enough letting yourself be annoyed by other road users, but following them – or even worse, reverting to violence – is ridiculous. Getting angry doesn’t achieve anything other than raising your blood pressure and negatively impacting your driving.” Kevin Clinton, head of road

safety at the Royal Society for the Prevention of Accidents (RoSPA), said: “Safe driving requires concentration, observation and anticipation as well as a responsible attitude to other road users. This is often easier said than done: our driving can be affected by our mood, the behaviour of other people and frustration caused by traffic delays. “Unfortunately, some drivers can take their stress out on other people, which can lead to serious and sometimes fatal accidents.” Admiral enlisted transport psychologist and behavioural expert Dr Peter Marsh to explore what motorists can do to combat feelings

of road rage and why drivers get angrier in cars. Dr Marsh said drivers think of their vehicle as their personal territory which, as humans, they are programmed to defend. Vehicles give drivers a sense of mastery and selfcontrol. When this is threatened, they can get frustrated and resent the loss of control. Drivers feel safe and protected enough to be aggressive before making a quick escape. Dr Marsh suggested drivers open their windows to reduce their sense of invulnerability, and urged them to stay in control by paying attention to their emotions and not get affected by other motorists.

TRUCKERS GIVE HEALTHY SNACKS THE GREEN LIGHT

all-Ex has helped to unearth the truth about truckers’ snacking habits, dispelling the stereotypical image of the chocolate-munching truck driver in the process. The European palletised freight network joined forces with vegetable grower Freshgro to survey over 300 of its drivers (Truckstop News, August). The UK snack market is worth over £2.4 billion, but Freshgro said it is trying to improve the choice of healthy options for consumers. Finding snacks that are tasty and healthy is a challenge to many and is particularly a tough task if a person’s job means they are constantly on the road – which is why the company turned to Pall-Ex for help. Of those surveyed, 63 per cent of drivers said there is not enough choice of healthy snacks to buy when on the road. When asked what they currently snacked on in a working day, 71 per cent said they eat sandwiches, followed by 49 per cent eating fruit and vegetables, and 35 per cent eating crisps. A total of 52 per cent of truckers who felt there wasn’t enough choice eat fruit and vegetable snacks during their working day and, of these, 94 per cent brought their fruit and vegetable snacks from home.
“All the evidence shows we are fast becoming a nation of snackers, but it’s essential we start delivering a broader range of healthy options for consumers who are on the go,” said Freshgro’s Martin Evans. “Interestingly, the survey showed only 29 per cent of truckers who buy snacks during a working day eat fruit and vegetable snacks. Is this because there is a lack of choice?” Within many of Britain’s service stations and convenience stores, there are often a limited number of snacks that are quick, mess-free, healthy and – most importantly – tasty. Adrian Russell, managing director at Pall-Ex, added: “The survey results make for interesting reading and certainly help dispel some of the stereotypical views of trucker’s eating habits. “As a company, we’re fully behind promoting a balanced lifestyle for all members of staff and support any initiatives that result in a happy, healthy workforce.” Freshgro handed out its new Chantenay Carrot Snacks to all participating Pall-Ex drivers. A
Fraserburgh haulier who was jailed after using a device to breach driver’s hours regulations has been told by Scotland’s traffic commissioner, Joan Aitken, that he will be disqualified for life from the haulage industry. The TC told George Davidson, 59, that he would also be disqualified from driving HGVs and could not re-apply for his professional licence until his 75th birthday. During a public inquiry on July 18, Miss Aitken heard evidence from a VOSA traffic examiner, who stopped Mr Davidson on June 28, 2012 in Cumbria. The VOSA officer told the TC that an examination of Davidson’s tachograph records revealed 69 instances where the records had been falsified. He also noted Davidson had breached driver’s hours regulations, including failing to take legal breaks, daily and weekly rest offences and excess driving time. Davidson’s vehicle was subsequently taken to a tachograph centre, where it was examined. This revealed the vehicle had been fitted with a device that allowed the tachograph record to be interrupted, which would effectively manipulate the record. The operator denied knowing about the device, but did admit to using a magnet – another device which can be used to interrupt a tachograph. In evidence to the traffic commissioner, Davidson said he knew using a magnet was bad and said he had done so because he was delivering fresh produce. He also

claimed he was sorry for using the device and was a good, courteous driver. At the time of the hearing, he was working as a tipper driver. The VOSA officer told Miss Aitken he did not accept Davidson’s evidence that he was unaware of the manipulation device. The TC said she had no hesitation in believing the evidence from VOSA and Cumbria police. After concluding the inquiry, Miss Aitken said Davidson’s willingness to falsify his records had shown he was a person who was capable of deceit and untruthfulness. She also rejected the claims about his driving standards. “I find he is a risk to road safety and he is as likely to suffer fatigue as anyone else, all else being equal. That he has such a deluded opinion of himself makes him a risk,” Aitken said. “There is no evidence to support any finding that he could ever be a compliant operator,” she added, noting Davidson’s previous conviction for tachograph offences and disqualification from operating HGVs. “Given that a previous long disqualification did not cure him, the period of disqualification has to be for life. He has lost his professional competence and repute. No way could he ever be trusted to be transport manager on any other licence, so I will not detain myself in exploration of any rehabilitative measures which might bring him back into the fold. He is beyond the fold,” she concluded.

highly accurate dynamic weighbridge installed by axle weighing specialist Axtec is helping the UK’s only remaining volume truck maker, Leyland Trucks, to meet the recent European Community WVTA (Whole Vehicle Type Approval) regulations. The Axtec 4000 weighbridge has been installed at the company’s showcase assembly plant in Lancashire, where it is being used to weigh every vehicle built as required under WVTA. The vast majority of trucks produced by Leyland are DAF-badged and are sold throughout the EC and worldwide. The Axtec 4000 dynamic axle weighbridge is the most accurate of its type in the world and holds two test certificates: one for accuracy to within 0.5 per cent, and the other to within 0.25 per cent. It is the principal weighbridge used by VOSA across its national network of roadside enforcement weighbridges. Major benefits to Leyland Trucks are the small footprint of the Axtec 4000 and the speed and accuracy with which it can weigh

a vehicle with any number of axles. The plate over which the vehicle being weighed travels is flush to the ground and occupies a space of just over 2 m2, compared to around 45 m2 for a conventional plate weighbridge. Weighing all the axles on a vehicle, whether a two-, three- or four-axle model, is carried out at walking pace and takes less than half a minute. The installation was calibrated using Axtec’s specially designed testing vehicle based on a DAF XF105 tractor unit. Built at the Leyland plant, this unique vehicle has been designed to provide the different configurations of truck required for testing dynamic weighbridges. Keith Gresham, Axtec managing director, said: “We are delighted to have been chosen by Leyland Trucks to carry out this installation. Their plant at Leyland is regarded as the most efficient truck assembly operation in Europe, and I believe our 4000 dynamic weighbridge is contributing to this high level of efficiency by providing very accurate data to assist the company in conforming with the WVTA legislation.”

&H Logistics has signed a contract hire deal with Asset Alliance Ltd for the supply of seven trucks and three trailers. The firm, based in Glasgow, will take delivery of seven Mercedes-Benz Actros 6x2 trucks, two 18-tonne curtainsiders with column tail-lifts and one 7.5-tonne curtainsider with column tail-lift. Four of the trucks are for immediate delivery, with the others following in October. All will be fitted out in the M&H colours. M&H has six depots throughout Scotland and access to a fleet of over 200 vehicles involved in collection and delivery via the Fortec network. The firm is also a main
sponsor of Hamilton Academicals football club. John McLaughlin, head of sales for Asset Alliance, said: “We are very pleased to have signed this agreement with M&H and hope it is the first of many. “The contract covers all maintenance and administration – all M&H need to do is supply the drivers. “We have a number of deals in the pipeline and are also dealing with more and more enquiries about fleet management, fuel management and fuel purchasing, which is becoming a critical issue again with the prospect of an increase in the price of diesel to come.”

CALLS FOR CLARIFICATION OVER DCPC
T
he BVRLA has urged the Department for Transport to officially confirm it will relax the Driver Certificate of Professional Competence (Driver CPC) requirements for rental and leasing staff. The government is consulting with industry on widening the scope of Driver CPC exemptions. Although the DfT and the transport minister have put forward proposals for some exemptions for the rental and leasing sector, there has been no firm statement. With just a few weeks to go until the Driver CPC regime is introduced, the BVRLA and its members need clarity. The association has called on the DfT to relax the rules to ensure most employees driving commercial vehicles or minibuses between branches, collecting or delivering them or taking them to roadworthiness tests will not have to hold a Driver CPC. The exemptions proposed by the DfT would cover drivers travelling within 50 km of their base without passengers or goods, not operating for hire and reward, and driving as an incidental part of their job. The BVRLA has asked the Department to increase the distance restriction to give firms greater flexibility.

If the minister was to approve the exemptions, it is unlikely the required legislative changes will be made before the Driver CPC becomes mandatory for minibus drivers in September. The BVRLA has sought assurances that enforcement action will not be taken against rental and leasing company employees who have not completed the required training. So far, the DfT has only been able to assure the association that any enforcement would be ‘targeted and proportionate’ and would take the proposed exemptions ‘into account’. “We understand the Department is doing it all can to fast-track the changes, but with only weeks before the legislation comes into force, it’s paramount the Department clears up this uncertainty,” said BVRLA chief executive, Gerry Keaney. “Approving the changes would be a victory for common sense and would ensure the rental industry in particular can continue to provide consumers and businesses with cost-effective, convenient access to commercial vehicles and minibuses up and down the country.”

GODFREY GRACE 1950 TO 2013
Vintage Lorry Funerals took Truckstop News reader Godfrey Grace on his final journey on June 12 in Hungerford. Godfrey was born on May 31, 1950 – the sixth of seven children – in a cottage in Hungerford Marsh. He attended the local school, which he left with no qualifications, following in his father’s footsteps to become a farm worker. In 1970, he passed his HGV Class 1 working for a Membury-based company, and Godfrey enjoyed his trips that took him to all parts of the country. During the mid-1980s, he had problems with kidney stones, and not wanting to be away from home, he started a taxi business which grew to three cars. However, long hours caused him to re-evaluate his career path. In the early 1990s, Godfrey went back on the road for Beck and Pollitzer, working primarily on the Crown Paints and Courage Brewery contracts. Godfrey did agency driving for Woolworths and Iceland before joining BOC Transhield in 1997 at Thatcham, which became GIST Logistics.
At GIST, Godfrey delivered to M&S stores south of the M4, concentrating on Hedge End Store in Southampton, where the large daily volume was ideal for his lifting-floor double-decker with 110 roll cages (the picture of which was kindly supplied by Gray & Adams). Godfrey built up a close relationship with Hedge End staff and supported the site’s prostrate cancer charitable events, growing a moustache one year and dyeing his hair black another year. Godfrey was the sort of bloke who would help anyone. He loved dogs and cats, including Jess – a 10-year-old three-legged cat who lost a leg due to cancer. Godfrey was a good photographer and focused on wildlife scenes, red deer in the New Forest, and seals with their pups off the Cornish coast. On April 1, 2013, Godfrey didn’t feel 100 per cent well but still went to work and did his normal trip to Hedge End. However, when he got back to Thatcham, he didn’t feel right and was sent home before he had chance to tip his roll cages.
This was the last shift he worked, as a chest X-ray and a CT scan revealed that tragically he had a very aggressive form of lung cancer. He passed away on his 63rd birthday, and many of the people who attended the funeral were stunned that someone who had been a great character should suffer such a dramatic decline in health in such a short time. The family floral tributes included a GIST lorry and a cat, for which the appropriate background was provided with a carton of cream and a bowl. It was a totally fitting final journey for Godfrey – however, it was even more appropriate when the 1950 Leyland Beaver left the estate using the same road on which Godfrey had made his final trip in his Mobility scooter. Godfrey is deeply missed by Beverley, his partner of 22 years, his two daughters Sarah & Lindsey, Beverley’s family Clive & Kim, and seven grandchildren. High, Wide & Heavy 2 Author: David Lee Publisher: Roundoak Publishing: Web: www.nynehead-books.co.uk ISBN: 978-1-871565-56-0 Price: £29.95 This book is the follow-up to the David Lee’s first compendium of oversize load movements, and offers almost 50 per cent more pages of upscaled imagery in what amounts to a hefty hardback tome. The book features photographs of outfits from over 160 heavy haulage firms (mainly British in
origin, though there are some European operators included in the line-up that are moving machinery in the UK), and each page sports either a full-frame shot or two smaller pictures – each with a caption detailing the truck, operator, the load and its destination (if known). The pages are divided into chapters specialising in load type. Subjects on offer include excavators, crushers and screens, dumptrucks, loading shovels, bulldozers, piling rigs, boats, generators, military loads, wind farm components, railway stock, cranes and support vehicles, and more. Aside from a lengthy introduction and dedication from the author on the opening pages, the book is essentially a pictorial reference of UK-based oversize load movements – which is a slight disappointment, as its extended length (pardon the pun) means flicking through 240 pages of photos can start to wear after a while.
CONCEPT CONUNDRUM I have a question for you or your readers. As a teenager in the early ’80s, I remember seeing a tractor unit that coupled up to a trailer – BUT the trailer coupled up via a PTO (or similar) and the trailer wheels were driven by a propshaft, etc. I’ve never seen anything like it since, and at the time I was a van/7.5-tonner driver, but I thought how brilliant would that be in the snow or just bad weather in general? Does anyone know anything about it? Let’s face it, what a simple idea! All that extra traction. After all, tractors do it. I was living in the Worcester area at the time, and I’d love to know if it was a prototype or if anyone else ever saw it – or even drove it. And I’d love to know why it never took
FACEBOOK FIASCO I was recently invited by a fellow driver to join a closed Facebook group which features old and new photographs of Scottish trucks. The participants seem to be a mixture of working and retired drivers, and some truckspotters who like taking truck pictures. Unfortunately a small, but vocal minority seem to have missed the point of a photosharing group and are being a bit precious by claiming ‘copyright’ on photographs posted there. I was subjected to a lengthy and abusive diatribe after posting an old black-and-white snap of a well-known fleet which I had copied from another local Facebook group site. That person only backed off when it was pointed out by another group member that the photograph was taken before he was born, so his claim on the copyright was more than a little fanciful. Ownership of printed work is one issue, but pixels present a whole new area of argument. Some have taken to placing large watermarks across their pictures to prevent copying. Fine, but it does little to enhance the viewer’s enjoyment of the truck photo. Discreet watermarks are just as effective and don’t spoil the view. I think that if you want to retain the rights to your work, don’t post it on the internet then cry foul when it is reposted elsewhere! xcellent reliability and dealer service has seen tank container haulier H&P Freightways add a further 17 Renault Premiums to its growing 71-strong allRenault fleet. The Premium 460.25 tractor units, with ADR and discharge equipment, were supplied through Renault Trucks distributor, Thompson Commercials Hull. The trucks will transport tank containers loaded with bulk liquids, powders and gases on behalf of major international blue chip companies. They will operate from all the major UK ports to locations throughout the UK. Simon Page, director, H&P Freightways, said: “We took our first Renaults 20 years ago and have since replaced the other marques, such as Mercedes and Iveco, to become an all-Renault fleet. All of the trucks are Renault Premiums and we have always found it to be a good, reliable vehicle. “The other reason we moved to Renault is the excellent back-up service we receive from Thompson Commercials. As well as tank container haulage, H&P Freightways also offers warehousing from its 30,000 sq ft storage area, alongside distribution, repairs, lifting and cleaning services.

lipper Logistics has taken delivery of its first six new Stralis Hi-Way (AS440S46TX/P) 6x2 twin-steer tractor units, increasing the percentage of Ivecos in its fleet to 80 per cent. The new Stralis Hi-Ways, which were delivered by local Iveco dealer Northern Commercials, will be used exclusively for Hobbycraft store deliveries after the Leedsbased logistics firm secured the national distribution contract for the UK’s largest arts and crafts retailer. Five of the vehicles will be based at Hobbycraft’s Burton-on-Trent distribution centre, delivering to sites across the UK, and one will be based at its Enfield depot to service the South East region. Each of the tractors are powered by EEV-rated FPT Industrial 10.3-litre Cursor 10 engines, which are capable of producing up to 460 bhp between 1550-2100 rpm, plus 2100 Nm of torque between 1050-1550 rpm. They are also fitted with Iveco’s EuroTronic automated transmissions as standard.All of the vehicles, which will carry the company’s livery, are supplied on four-year Iveco Elements repair and maintenance contracts. Sean Wilson, national contract manager at Clipper Logistics, considered four manufacturers before deciding to go with Iveco. “The key benefit to choosing Iveco is that it is a vehicle we know and trust,” he said. “The new Stralis Hi-Way is very driver-friendly and the upgrades to the cab and styling build on what is already a top-quality product.” In particular, the new Stralis Hi-Way’s modern and spacious cab, complete with an improved

aerodynamic central grille, bumper and redesigned air deflectors, has been designed to deliver greater fuel efficiency and increased driver comfort. Another key addition is Iveco’s Driving Style Evaluation tool, which is fitted in all of the new vehicles, enabling drivers to improve their driving performance in real time and, as a result, to optimise their fuel efficiency – a tool which Iveco says can generate fuel savings of between 5 per cent and 12 per cent. The new tractors, which are additions to the Clipper Logistics fleet of more than 250 vehicles and 100 trailers, will be kept in service for at least four years and are expected to clock-up between 120,000 km and 130,000 km per annum. They will operate five days per week, with some units being double-shifted for trunking work at night.

It was only a couple of miles from home and I had washed her open top sports car that morning, as I thought some fresh air would be a good thing. In fact, the weather was scorching hot and it would have been more comfortable in my car with the air conditioning running! We arrived after lunch and parked in a large field that was being used as a car park. As it had been hot and dry in the days leading up to the event the ground was hard and very dusty. So much so that the gleaming paintwork of the car was soon turned grey with the dust, making my earlier car cleaning rather a wasted effort. It was no wonder that the trucks on display at the event were being constantly polished. Sun hats were the order of the day and visitors who went without

compensation claim. All of these clients contacted my firm after seeing our details in Truckstop News. In this article I highlight a fairly common situation where a driver is required to deliver and unload a lorry or trailer that has been packed by someone else - either a fellow employee of the same company, or by an employee of an entirely different company perhaps even based abroad. It is often the case that your own employer will be held responsible for compensating you for an injury caused by a defective load, no matter who packed it. If you are self employed or an agency driver, you also benefit from the same rights enjoyed by the employees of the company you are contracted to work for. However, it is worth noting that if you were in charge of loading the vehicle the accident may be found to have happened entirely due to your negligence, in which case a claim for compensation would probably not be successful. As with previous articles the common trend remains the effect on the injured person’s life, and although using the process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation. As previously indicated, under the current law and procedures the basic aim of an accident claim is to try and return the injured party to the position that he or she would otherwise have been in had the accident not happened.

Without this level of awareness the employer’s insurers will almost certainly try and exploit any perceived deficiencies or weakness in the case in an effort to avoid having to pay the injured person their rightful compensation. In Mr R’s claim, the allegations of breaches of Regulation were as follows:(a) Failed to take suitable and sufficient steps to prevent the item within the trailer from falling, contrary to Regulation 10(1) of the Work at Height Regulations 2005. (b) Failed to take suitable and sufficient steps to prevent our client being struck by the item, contrary to Regulation 10(2) of the above Regulations. (c) Failed to ensure that the trailer was loaded in such a way as to prevent unintended movement of the contents, contrary to Regulation 10(4) of the above Regulations. (d) Failed to ensure the trailer was loaded in a safe manner. (e) Exposed our client to a danger or a trap and a foreseeable risk of injury. He suffered a painful cut to the top of his head and, as was later confirmed in the medical report obtained in support of his

Once this was available and had been approved by Mr R, a copy was sent to the insurers, together with details of his very modest financial losses incurred as a direct result of the accident. Settlement negotiations then started, with offers and counter offers being put forward by both sides. Within a few weeks it was possible to reach an acceptable settlement at a total figure of £2250, the vast majority of which was to compensate Mr R for his pain and suffering. He kept the full sum recovered, as my firm’s costs and the expenses we had incurred in dealing with the claim (eg paying for his medical records and the medical report) were subsequently negotiated with the insurers and paid separately. Fortunately, despite the accident circumstances Mr R suffered only a relatively minor injury, and this was reflected by the level of compensation he recovered. His employer’s insurers took a sensible approach to the claim and handled matters with reasonable efficiency, which meant it was possible to reach agreement and for Mr R to be in funds in just under six months from the date the first letter was sent to his employer. This also had the effect of keeping the legal costs to a minimum.

Parliament has recognised the inherent dangers caused by drivers of motor vehicles when using mobile telephones while driving and brought forward specific legislation. There has been an unacceptable increase in the number of vocational licence holders using mobile telephones without a hands free device while driving large goods and passenger carrying vehicles. This practice is unacceptable and presents an undue risk to road safety. Studies have indicated that even the use of hands-free devices can distract a driver to the extent that they may be prevented from applying the requisite care and attention. A report for an offence received from an enforcement agency that a vocational driver has used their mobile telephone while driving without a hands free device in the last three years will result in that driver being called to a hearing before the traffic commissioner. Each case will be decided on its own facts and merits and the presiding traffic commissioner will be keen to ascertain the reason the driver is engaged in the telephone call. In cases where drivers are speaking with their employers or their customers, the traffic commissioner may consider the effect this might have upon the operator’s repute”. So you are likely to be called to a hearing in order to show cause why an order should not be made. The guidelines which a traffic commissioner will be considering are to suspend vocational entitlement for 14 days, 21 days if driving a commercial vehicle, to commence with immediate effect. For a second and/or subsequent offence to multiply accordingly, for example, second offence in a commercial vehicle 2 x 21 days.

Following a recent query regarding the rights of employers to make deductions from workers’ wages in respect of damage caused to company vehicles, I think it may be helpful to set out the current legal position. Under section 13(1) of the Employments Rights Act 1996 (“ERA”), it is unlawful for an employer to make a deduction from a worker’s wages unless the deduction is required/authorised by statute and/or the worker’s contract of employment, or alternatively where the worker has consented to the deduction. Furthermore, it is unlawful for an employer to receive a payment from a worker unless the payment is required/authorised by statute and/or the worker’s contract of employment, or where the worker has given their prior written consent to the making of the payment (section 15 ERA). What this means in practice
is that all workers and not just employees are protected from these deductions – ie, it includes any individual who has entered into “any other contract... to do or perform personally any work or services”, unless that individual is carrying on a “profession or business undertaking” and the other party to the contract is “a client or customer” of that undertaking (see section 230 ERA). The most common deductions which are authorised by statute include deductions for income tax and national insurance contributions under the Pay as You Earn system (PAYE). Other deductions which are authorised by statute include those which are authorised by a Court Order – eg, where a Judgment has been obtained against an individual, and it is Ordered that it be discharged directly from his wages by that individuals employer (under the Attachment of Earnings Act 1971).

The legislation defines this offence as follows: No person is to drive a motor vehicle on a road if he is using a hand-held mobile telephone or a hand-held device of a specified kind. No person is to cause or permit any other person to drive a motor vehicle on a road while that other person is using a handheld mobile telephone or a hand-held device of a specified kind. No person is to supervise a holder of a provisional licence if the person supervising is using a hand-held mobile telephone or a hand-held device of a specified kind at a time when the provisional licence holder is driving a motor vehicle on a road.

ollowing significant investment in both its fleet assets and advanced driver training in 2012, Bibby Distribution has stated it has reduced its total diesel consumption by two per cent. The drop in fuel usage is combined with a reduction in fleet size of 4.8 per cent over 12 months – made possible by more efficient scheduling and routing of vehicles. Commenting on the achievements to date, Iain Speak, Bibby Distribution CEO, said: “It’s imperative we measure and manage the impact of our operations on the environment. This is not only a
moral obligation, but reducing our CO2 emissions generally provides a cost benefit as well. “It can also act as a differentiator when we are tendering for business or developing an existing account,” he added. The company’s fuel saving achievements follow an 18-month period which has seen it roll out a host of new environmental initiatives, including the introduction of 20 aerodynamic teardrop trailers and training in Safe and Fuel Efficient Driving (SAFED) techniques for more than 400 drivers. Across the Bibby Distribution fleet, 90 per cent of vehicles now
feature automatic transmission which optimise fuel-efficient running, plus it is operating in excess of 750 high-cube, double-deck trailers to maximise the volume of freight that can be transported in a single truckload. By the end of 2013, Bibby will also have 25 longer semi-trailers (LSTs) in service – and the company is lobbying to have its allocation of LSTs increased. They are one of the few operators to effectively deploy its full allocation. “In the coming years, our new Transport Management System will provide us with the operational visibility to drive even

‘revolutionary’ new safety system to help HGV drivers cover their loads without having to work at height is being piloted with the use of trailers supplied by ATE Truck and Trailer Sales Ltd. The new system, which can be fitted to either curtainsiders or flatbeds, has been developed by Freight Secure Systems based at Basildon in Essex. Having worked on its designs and come up with working prototypes, FSS then looked around for trailers to fit them to. Darren Hall of FSS said: “Initially we were going to buy a new trailer, but I decided to have a look round and see if I could get one second-hand. I visited ATE at its Wolverhampton base, was shown round all the stock and decided to take a refurbished trailer. “I explained what we were trying to do, and they then delivered to our specifications on budget and three days ahead of schedule. “As a result of that, when it came to fitting out a second trailer, going back to
ATE was the natural choice.” FSS displayed its FS100 and FS200 designs in a product launch at MercedesBenz UK headquarters in Sheffield at the end of July. The event was attended by representatives from VOSA, the Health and Safety Executive, the Road Haulage Association, the police and Manchester College. VOSA inspectors have recently been cracking down on operators carrying insecure loads. The FSS systems are designed to offer a simple solution to the problem of making sure loads are held safely. James Jenkins, managing director of ATE Truck and Trailers Sales, said: “We were delighted to be able to help FSS with this project. Anything which improves safety in the haulage industry is to be welcomed. “Hopefully FSS will attract a large number of orders, and we’re certainly ready to supply them with as many trailers as they need.”

DRIVERS MUST PREPARE FOR FRENCH ROAD TAX
T
he French government is poised to introduce a new form of road tax – designed to fund public infrastructure projects – from of October 1, 2013. Known as the ‘Ecotaxe’, the tax will be operated and managed by Ecomouv, a subsidiary of the Italian toll road operator Autostrade. Approximately 15,000 km of national, regional and local roads in France will be affected by the new tax – and many of these roads are strategic transit routes already used by many European transport companies. In many cases, the tax covers roads which allow hauliers to travel throughout France without having to use some of the expensive motorway toll networks. The government in France is hoping to take advantage of the large number of French and international vehicles which avoid the toll roads by ensuring all trucks travelling in the country contribute to the maintenance of the road network. The Ecotax will be applied to all vehicles with a gvw over 3.5 tonnes. Road users will be liable to pay the government a fee per kilometer determined by the characteristics of the vehicle they are travelling in. Factors taken into consideration for the calculation of the fee include the overall weight of the vehicle, the Euro classification of the vehicle, and the number of axles on the vehicle (including the trailer). The French government is looking to raise

Measures have been taken to ensure any road users, both national and international, will be heavily penalised with on-the-spot fines up to €750 if their vehicle is not fitted with a recognised payment device. There are currently over 10,000 vehicles that will be affected by this change, which means haulage companies travelling in France must be well prepared in advance. There are two recognised payment options: pre- and post-pay. Prepay devices can be collected from any Ecomouv point of sale, and the device will need to be credited and fitted in the windscreen before the journey commences to avoid potential fines. Post-pay devices are available from a selection of companies and allow vehicles to travel across the entire motorway toll and Ecotaxe networks in France without having to stop and re-credit the device before each journey, saving a driver’s valuable time. In addition to this, some post-pay devices will also provide users with a fixed rebate of 10 per cent on their Ecotax usage. HERMES ON HAND FOR EX-ARMY WORKERS
C
onsumer delivery specialist Hermes has linked up with Royal Logistics Corps and the Logistics Guild to help find employment for military personnel faced with redundancy. The company kicked off a series of events with a two-day workshop for 80 men and women based at the Duke of Gloucester Barracks in South Cerney near Cirencester, Gloucester, to provide advice and guidance about working within the supply chain sector. The team from Hermes provided a series of presentations that outlined some of the opportunities that exist within its transport, warehouse and delivery operations, along with the wider supply chain industry. Soldiers also received practical assistance on how best to seek employment, as well as help with CV writing and interview techniques. The workshop will be followed by an event organised by the Logistics Guild and Hermes that will take place at Hermes’ national distribution hub in Nuneaton, Warwickshire that will provide a detailed overview of the company’s operation and insight into the parcel delivery lifecycle. The soldiers will have the opportunity to talk with employees in a wide range of roles to get an understanding of potential career paths. The Guild is a shared network of resource set up for those working in any aspect of logistics and has been working with the British Army – and in particular, the Royal Logistics Corps – for several months promoting benefits of Logistic Guild Membership. This includes training and development opportunities, Guild recruitment services, Guild member benefits and the Military Work Placement Scheme – a Logistics Guild initiative developed especially to help ex-military personnel find work within the civilian logistics industry. The Logistics Guild said it is committed to working very closely with top civilian employers

such as Hermes to ensure ex-servicemen and women can find rewarding careers where they can effectively use the valuable, transferable skills learned in the service, in the civilian logistics sector. By working with leading organisations such as Hermes and the Logistics Guild, it will be possible for my people to exploit the skills and expertise they have gained in the Army to find jobs within industry’s supply chain.” Jane Naumkin, HR director at Hermes, said: “We hope this relationship with the Royal Logistics Corp will help some of the military personnel faced with redundancy to find a new career path within the supply chain. By providing a better understanding of the opportunities that exist within Hermes and the wider sector, we can support their transition from military to civilian life.” Hermes said it will also donate all fees received from the Ministry of Defence to Help for Heroes, the charity formed to help those who have been wounded in Britain’s current conflicts.

T
he first Mercedes-Benz New Actros tractor units to wear the colours of Gloucestershire bulk haulier T Barry have made a flying start, setting new standards for fuel efficiency from the outset. Leading the way is the operator’s 510 bhp New Actros 2551 flagship. Within 10 weeks of entering service, the firm said it was returning 6.97 mpg, compared to a fleet average of 6.4 mpg. T Barry’s second New Actros, a 2542 model with 420 bhp version of the straight-six engine, arrived six weeks behind the first. It is now averaging 6.91 mpg. “Bulk haulage will never be the most fuelefficient of applications, so a saving of half a mile per gallon is worth a great deal,” said company MD, Bob Barry. “In fact, it equates to about £4600 a year for a single vehicle. Multiply that by the 20 tractors on our fleet and you’re talking about £92,000 – that sort of figure can make all the difference to our bottom line.” Both trucks are fitted with wind-cheating, 2.3 m-wide StreamSpace cabs (a 2.5 m version is also available) and have been supplied by Rygor’s Swindon branch, the operator having taken advantage of the competitive funding available from Mercedes-Benz Financial Services. Rygor Swindon has also just supplied T Barry with a pair of 440 bhp tractors from the current Actros range. These 2544 Long Distance units are the subject of a CharterWay

contract hire agreement from MBFS. The company operates a couple of eightwheeled rigids alongside its tractor units, and provides regular work for a number of ownerdrivers. In addition to its bulk tipping fleet, it runs a general haulage operation, using curtainsider trailers and a quartet of ‘spot-hired’ 6x2 tractors – three of them Mercedes-Benz Axors. However, the four trucks just delivered by Rygor following successful trials by T Barry of a couple of demonstration units fitted with tipping gear, represent the operator’s first investments in vehicles bearing three-pointed stars for many years. “We’re very pleased with our latest Mercedes-Benz trucks and particularly the New Actros, which look great and have been a big hit with the drivers,” Bob Barry concluded.

wansea-based vehicle transporter specialist KHL Logistics Ltd has cited its strong relationship with Volvo dealer Truck and Bus Wales & West as a key reason that Volvo FMs continue to form the backbone of the company’s car transporter fleet. KHL Logistics, which has been in business for 25 years, currently operates 11 trucks – of which seven are Volvo FMs. Director Alf Leswisse said the nearby Truck and Bus Wales & West workshops are open until 10 pm Monday to Friday and Saturday morning. This, he said, suits the operational profile of the fleet where the Volvos are on tramping duties during the week, returning to
base only for the weekends. The company currently favours the 11-litre Volvo D11C450 engine rated at 450 bhp with automated I-Shift gearbox. The FMs are expected to give 10 years of reliable service before being defleeted, Leswisse said. Both the 13- and 62-plate 4x2 FMs that recently joined the fleet are equipped with LOHR’s Eurolohr 300 transporter bodywork, fitted by Belle Trailers. Typically, the FMs carry 11 medium-sized family saloon cars of different makes. According to Leswisse, the company is so pleased with the performance of the Volvos and the dealer back-up that an order for a new-model Euro 6 FM is about to be placed.
BAKER’S DOZEN FOR DSL T
he proven success of the incumbent Isuzu 7.5-tonne rigids in its fleet was a key factor behind the decision made by Deborah Services Ltd (DSL) to specify the Isuzu marque again when it came to replacing the majority of its lightweight delivery vehicles. Following a successful growth period for the company, DSL has replaced its existing 7.5-tonners with 13 new Isuzu Forward N75.190 4x2 rigids, all fitted with Easyshift automated transmission. Gary Clark, DSL’s transport manager, said: “When we were looking to replace our 7.5-tonne trucks, we carried out our research over a number of different models. At the end of the day it was the Isuzu N75.190 specification that ticked all the right boxes. “The vehicles we have replaced were the earlier design of Isuzu cab model and the reasons why we chose Isuzu again is because of the excellent dealer service we receive, along with economical fuel consumption and the best-in-class payload.” All the new trucks have been supplied to DSL by Isuzu Truck’s long-standing dealer Warrington Vehicle Centre, and all of the vehicles are now operating from DSL Hire

MITCHELL SERVES UP MAN CHAMP

ohn Mitchell Haulage & Warehousing of Grangemouth, Stirlingshire has named its latest MAN truck in honour of Wimbledon Champion, Andy Murray. Since 1968, every John Mitchell truck has carried an individual fleet name prefixed by the word ‘Grange’ – and the latest arrival, ‘Grange Murray’, also sports a Wimbledon badge alongside the moniker. A group of future tennis champions from Dunblane Sports Club took a few minutes out of their summer holiday training schedules to give the new MAN TGX 26.440 tractor unit an official send off, en route to delivery in Grangemouth. The truck also passed
Dunblane’s specially painted gold post box, which commemorates Andy Murray’s gold medal in the London 2012 Olympics. John Mitchell Haulage & Warehousing was founded in 1956 and is still family-run by second generation, Iain Mitchell. The company operates from a 15-acre site in Earls Road Industrial Estate, Grangemouth with a fleet of 120 vehicles and 250 trailers. With each vehicle expected to cover in excess of 50,000 miles per annum over a fiveyear working life, the Isuzu rigids have three different body lengths to suit the varying range of contracts undertaken by DSL. Three of the vehicles have front-mounted Atlas cranes that are fitted on to 18 ft plant equipment flatbed scaffolding bodies, while the remaining flatbed scaffolding bodies are a mix of 21 ft and 24 ft bodies, all manufactured by Bespoke Bodies and Plant Equipment. Two of the new Isuzus are now based at DSL’s Luton and Bow branches and have been built to the Cross Rail contract specification. This specification includes a side scan safety device, which warns cyclists and pedestrians that the vehicle is turning left, as well as an audible reversing alarm. Safety of DSL personnel out on site is paramount and, with this in mind, the body specification for all 13 new Isuzu trucks now incorporates a purpose-designed, detachable edge protection system, which has been specifically designed for driver safety if access to the bed of the vehicle is required.

An additional advantage to us is image – not only do our Scanias look good on the road, they also impress our customers.”

LE, one of the world’s largest heavy transportation and lifting companies, recently placed an order worth millions of pounds with Nooteboom Trailers for 16 vehicles for the transport of wind turbine parts. Almost all the extendible semi low-loaders (mostly eight-axle) and four-axle Quatro extendible Telesteps have by now been delivered and put to work to carry out the complex logistics of this operation. ALE will be erecting wind turbines in the Eastern Cape and West Coast regions of South Africa. It concerns several wind farms with more than
200 wind turbines manufactured by, among others, Suzlon, Nordex and Vestas. The components of these turbines are transported over land from various ports to their destinations. Jan Yntema, director, ALE South Africa said: “We can see important long-term opportunities in South Africa for wind energy, and therefore we made sure to choose the best trailers there are for this application. LGV TRAINER OFFERS ‘GUARANTEED WORK’
T
he LGV Training Network is offering drivers guaranteed work with its sister business ADR Network on successful completion of Class 1 training. Candidates are benefitting from the demand for drivers posed by ADR Network, which in addition to offering a guaranteed job, is offering the opportunity for the newly qualified Class 1 drivers to repay the training fees (£995, including VAT) over a sixmonth period at no extra cost. The pass rate for the conversion course is currently 86 per cent. The business has its base in Hertfordshire, but is providing driver training courses across the country to meet the operational needs of its logistics and retail customers. To date, training has been completed
with three of ADR Networks’ major clients at various locations across the country. Commenting on the launch of the package, Peter Howitt, LGV Training Network director, said: “Our sister business ADR Network – and indeed the logistics profession as a whole – are in serious need of a new crop of Class 1 drivers. The total pool of active drivers is a small one, and something needs to be done as the average age of Class 1 drivers is creeping up. “We have made a positive move that has been well received by Class 2 drivers who can see the financial benefits of moving up to Class 1, especially when it is backed by the offer of a job at the end of the process.”
Typically, newly qualified drivers are moving into their new jobs supported by a ‘buddy scheme’ to help transfer the knowledge of experienced drivers. The LGV Training Network has successfully trained 18 drivers, of which 10 have now completed the buddy program and are now working for ADR Network. The remaining eight are due for completion over the coming weeks. With new training vehicles arriving, the business is on track to introduce 50 new Class 1 drivers into the market by the close of the year. Q Sometimes when I’m driving my truck I come over feeling very sleepy even, though I stick to the driver’s hours regulations. What advice do you offer drivers to help them deal with the problem? A The advice offered by the Department for Transport Think! Campaign includes trying to take a 15-minute break every two hours, and if you do start to feel sleepy, find a safe place to stop as soon as you can – but not on the hard shoulder of a motorway. Then drink two cups of coffee or a highcaffeine drink and rest for 10 to 15 minutes to allow the caffeine to take effect. It’s important to remember caffeine and short rests are only a ‘quick-fix’; the only real cure for sleepiness is proper sleep. And if you think there’s any possibility you are not getting a proper night’s sleep because of a sleep disorder, go and see your doctor as soon as possible. Q I use RHA Conditions with all my customers. Occasionally I have to collect trailers from UK ports that have arrived on ro-ro ferries. I was recently involved in an accident that resulted in one of these trailers overturning. I wasn’t expecting a huge problem from an insurance perspective until my customer tried to hold me liable under CMR which I don’t have cover for. I’ve tried to argue that as I was only moving the trailer in the UK, then a settlement under RHA Conditions should be acceptable, whereas my customer insists I’m legally liable up to the limit set out under CMR. Who’s right and what is my potential liability under CMR? A CMR creates a statutory liability and applies to every contract for the carriage of goods by road (with
the exception of carriage under international postal conventions, funeral consignments and furniture removal) in vehicles for reward from one country to another provided that at least one of the countries has signed up to the convention. The term ‘vehicles’ means motor vehicles, articulated vehicles, trailers and semi-trailers. CMR applies to the entire journey so that means CMR does apply to the load on board the trailer you collected. Liability for compensation under CMR is based on the value of the goods at the place and time at which they were accepted for carriage. Compensation is limited under CMR to 8.33 ‘Special Drawing Rights’ per kilogram of gross weight. At today’s exchange rate, that equates to a liability of around £8187 per tonne as compared with £1300 per tonne under standard RHA Conditions.
Q I’m an owner-driver. I’m concerned that if my truck was off the road for any length of time after being involved in a crash where there was no one else to blame, how would I afford to hire another one while mine was being repaired? A Insurance products are available that are designed to provide income protection in just these sorts of circumstances albeit you may find that cover only begins once your truck has been off the road for repair for more than, say, two weeks. Ask your broker for advice.
Q I’m a skip operator. When I leave a skip for a customer at the side of the road, if someone was to run into the skip and make a claim against me because, say, they felt the skip wasn’t lit up properly, would it be truck insurer that would

A Cover for liability relating to detached skips will normally be picked up under a Public Liability policy rather than under your motor policy. Ask your broker to check and at the same time make sure the indemnity limit you’ve selected is adequate given some local authorities insist that skip operators leaving skips in their area have a minimum indemnity limit of, say, £5,000,000.
Q I recently had problems with an insurance claim because my insurer said that although I’m an RHA member, I can’t just assume my customers know I’m using RHA Conditions. What advice can you give to help me get the message over to my customers?
Q My truck insurance policy excludes cover for use ‘airside’ and use at ‘hazardous sites’. Are you able to explain what is meant by ‘airside’ and ‘hazardous sites’? A Insurance policies typically define ‘airside’ as that part of an aerodrome or airport provided for the take-off and landing of aircraft on the surface, aircraft parking aprons including the associated service roads and ground equipment parking areas, and those parts of passenger terminals which come within the Customs examination area. The term ‘hazardous sites’ typically includes power stations, nuclear installations, refineries or bulk storage or production premises in the oil, gas or chemical industries,

A We suggest you take the following steps before moving goods for a customer, or if this isn’t possible, to at least fax your Conditions and then follow up in the usual way: • Make a senior person responsible for issuing Conditions of Carriage • Display a copy of the RHA Conditions in public areas of your premises • State on all documentation including letters, faxes, e-mails, quotes and invoices that all business is transacted subject to RHA Conditions of Carriage (insert 1998 or 2009 Edition as appropriate), modified only to the extent of any agreed load limit variations and that copies are available on request • Ensure you do not rely on e-mailing Conditions to customers or putting them on your website
