HGV CAMERAS HELP COMBAT STOWAWAY CRISIS
S
ales of SmartWitness in-cab CCTV cameras have shot up 20 per cent this year as more hauliers seek extra protection to guard against illegal stowaways. The 360-degree CCTV cameras and sensors can be viewed from the cab and also send text message alerts to the driver’s phone if there is a disturbance involving the lorry when the driver is away from the vehicle. “We have received an unprecedented number of orders from UK haulage firms who are having to take precautionary measures to prevent illegal immigrants from getting on board their lorries,” said SmartWitness international sales director, Mark Berry. “With our 360-degree cameras, drivers can see the whole way round their HGV and are alerted immediately on the video screens in their cabs when stowaways are trying to break in. Drivers receive a text message if there is a suspected break-in so they can take immediate preventative action.” Wakefield, West Yorkshire-based international haulier Brian Yeardley Continental said it fitted SmartWitness cameras to its 51 trucks in part due to the stowaway problem. “Last year we did over 5000 crossing both ways across the English Channel, and we had a total of five immigrants found in our trailers,” said BYC MD, Kevin Hopper. “Despite record numbers of stowaways trying to get in the UK, we have not had any incidents since fitting the SmartWitness cameras. “We take serious measures to ensure our vehicles are protected and sealed and our
drivers are fully trained and aware of the immigrant problems in Calais and other ports,” he added. “Our trucks spend 90 per cent of their time in Europe – mainly Spain, Portugal, France and Italy. We constantly try to ensure our drivers’ safety and welfare is protected and stowaways are prevented from getting on board. “Our drivers are often away for up to eight weeks at a time and it gives me peace of mind knowing that when they are parked up, the cameras are there to help protect them from stowaways and thieves,” Hopper concluded.

HAULIER’S LICENCE REVOKED AFTER “GROSS ERRORS OF JUDGMENT”
S
cotland’s traffic commissioner Joan Aitken has told a Motherwell haulage company its licence will be revoked after the firm’s director made a series of “gross errors of judgment”. Her decision follows a public inquiry in March 2015 into the operator’s licence held by Firstline International Ltd. The company, along with director and transport manager, William Lambie, will also be disqualified for two years at the end of this month. Aitken said: “I consider this to be a case in which were I not to revoke the licence on grounds of loss of repute, as well as the breaches of the licensing undertakings, then I would be undermining the purposes of the licensing regime which are road safety and fair competition.” During the inquiry, the traffic commissioner heard that Lambie’s driver card was illegally used by another individual on 36 occasions. The card had been used to disguise periods of driving and duty to avoid complying with the drivers’ hours rules (such as taking a break after 4.5 hours driving). DVLA records also revealed Lambie did not have the correct entitlement to drive goods vehicles. Lambie admitted he had not carried out the driving recorded on his card and he knowingly allowed another driver to use it. He did not disclose the identify of the driver to examiners from the Driver and Vehicle Standards Agency (DVSA).

Two drivers, Steven Lambie (from Motherwell) and Scott Henderson (from Pencaitland), who had recorded work in the vehicle after Lambie’s card was used, both denied being the user of any other driver cards. In evidence to the traffic commissioner, Lambie apologised for allowing his card to be used and said he thought it was better for the journey to be recorded than not at all. He acknowledged this was wrong. He subsequently disclosed the identity of the driver who had used his card – Craig McDonald. In a written decision issued after the hearing, Aitken noted: “What is very clear is that neither DVSA nor myself will ever know who actually undertook the driving with Mr William Lambie’s card.” She said the operator had shown disrespect to the licensing regime and added that Lambie and his company needed a “fallow period” which would allow her to readdress fair competition. Lambie was also disqualified from acting as a transport manager. Turning to the two drivers, Aitken suspended their professional driving licences for five weeks from July 31. She said: “This is to reflect the seriousness of the mobile phone offending whilst driving an HGV, and also that the drivers’ hours rules are their to protect them from the consequences of driver fatigue, as well as to protect the rest of us from such consequences.”

What’s your view? Star Letter MORNING CALL I was pleasantly surprised to receive a phone call the other day from a producer at BBC Radio Scotland. She was preparing a piece in response to a press report which stated only one in four schoolchildren would consider a career as a lorry driver. The premise was that she wanted me to contribute to a debate on the Morning Call programme and give reasons why young people should enter the road haulage industry. I burst out laughing and said I might have a problem there. “Why so?” she enquired. “Well, massive training costs, poor wages, long (very long) hours coupled to massive responsibility... Need I go on?” It must have been a slow news day, as I ended up following a piece on a famous female astrophysicist; nothing if not providing variety. The BBC was set up to inform, educate AND entertain, after all. After the presenter had given a little preamble about the present driver shortage and youngsters’ reluctance to become HGV drivers,

While I agree with the comments made by the RHA regarding the current driver shortage, the biggest problem with new driver recruitment and the existing force is wages. If we are to be considered professionals and are the backbone of the UK economy, then it’s about time we were
I pointed out that when I paid for my own driver training and test in 1979, I got my HGV (now LGV) and PSV (now PCV) licences for under £100. That was a lot of money back then, but proportionately nowhere near the three to four grand required nowadays. He quickly moved on and asked if my kids would consider it as a career. I had to tell him both my sons are HGV drivers, but only because they joined the Army and have earned their driving spurs in warmer climes. One works for one of the German discount supermarkets, the other works for a company servicing the fresh produce chain to all the retailers. As I work for a major supermarket, we keep the shelves filled between us. My boys say driving in the UK is so much more relaxed as you are not constantly watching for IEDs and dodging small arms fire. The discussion went downhill when he started harking back to the romance of the CB radio (lots-a fun in the ’80s, but the airwaves were also populated by some seriously disturbed people), and whether paid a professional income. Earning less than £10 per hour for our level of expertise and responsibility is nothing more than scandalous. Not only do we have to endure long hours and nights out away from our families, we also have to put up with poor facilities for overnight parking. We are so far behind other countries in the EU

I have since spoken to a number of colleagues who asked me why I didn’t ask this or that question, and I have tried to contact the producer with a view to a longer feature giving serious coverage to these issues. Since the start of the year, eight cyclists have died in collisions in our capital city, all of which have involved lorries. This is completely unacceptable. Accidents like this are incredibly tragic for the family and friends of the cyclist, as well as harrowing for the HGV drivers and onlookers. In this day and age, we shouldn’t fear being on our roads - regardless of how we get about. A death toll should be completely avoidable, with measures in place to keep our road users safe. Recently, various pro-cycling campaigners have rallied on the government to introduce new 24hour safety guidelines. These are great ideas in theory, especially sideguards on vehicles over 3.5 tonnes, designed to protect cyclists from being dragged under the wheels in the event of a collision, and additional mirrors. They of course come at a financial cost to haulage firms who do not already have these measures in place (particularly to the smaller haulier), but the alternative of just banning lorries in London is completely nonsensical. Shops, hotels, hospitals, nursing homes, restaurants and many other businesses would struggle to stay open. Despite these steps forward, it’s still important to recognise the responsibility lies on both sides. We’ve all seen the odd cyclist who defies danger, weaving in and out of lanes, and not taking adequate care and attention in congested traffic. I should stress that of course they are the minority of
a population of cyclists who share our roads, and this small proportion does not by any means reflect the whole. The vast majority of cyclists are unregulated. Cycle laws need to be more robust - whether that’s an insistence on protective headgear or an outright ban on wearing music headphones. But maybe we could go even so far as introducing cycling licenses and road tests for everyone who is using the road regardless of whether or not they rely on an engine? One group is not more entitled than another to use our networks, so the onus must be on both parties to be as safe and knowledgeable about the dangers of using roads, particularly in busy urban centres. We’ve already seen new, strict criteria in place to ensure only the most qualified and reliable members are part of our group - for the benefit of the end customer as well as pedestrians and other road users. Any steps that reduce the number of fatalities and serious accidents on our roads should be embraced. But, there is not one simple solution to the problem, nor does is it exclusively the duty of the logistics firms. It’s an educational challenge to improve the skills, technology and equipment of all road users - rather than wholly laying the blame at the door of the HGV driver on every occasion. The law says that under section 143(1) (a) Road Traffic Act 1988, ‘a person must not use a motor vehicle on a road or other public place unless there is in force in relation to the use of that vehicle by that person, a policy of insurance’. It goes on to state that under section 145, the policy must be issued by an authorised insurer and must insure for death or bodily injury to any person, or damage to property, caused by, or arising out of, the use of a vehicle on a road in Great Britain – ie, third party insurance. The legislation for the most common offences about which I tend receive enquiries is section 143 of the Road Traffic Act 1988. This states that users of motor vehicles to be insured or secured against thirdparty risks. Specifically that (a) a person must not use a motor vehicle on a road or other public place unless there is in force in relation to the use of the vehicle by that person such a policy of insurance or such a security in respect of third party risks as complies with the requirements of this Part of this Act, and (b) a person must not cause or permit any other person to use a motor vehicle on a road, or other public
place, unless there is in force in relation to the use of the vehicle by that other person such a policy of insurance or such a security in respect of third party risks as complies with the requirements of this Part of this Act. It goes on to state that if a person acts in contravention of the subsection above, then they are guilty of an offence. There are also additional offences which can arise, namely causing or permitting a person to use a motor vehicle without insurance. So it possible that third parties can also be prosecuted under this legislation, and not just the driver. Offences of causing or permitting the uninsured use of a vehicle should be regarded as being as serious as using a motor vehicle without insurance. If we look at Section 143 (3), it becomes clear a statutory defence may be available under certain specific circumstances. Section 143 (3) states a person charged with using a motor vehicle in contravention of this section shall not be convicted if they prove (a) that the vehicle did not belong to them
and was not in their possession under a contract of hiring or of loan; (b) that the individual was using the vehicle in the course of their employment, and that they neither knew nor had reason to believe that there was not in force in relation to the vehicle such a policy of insurance or security as is mentioned above. The courts take a serious view of offences involving using a vehicle without insurance. The offence is triable in the Magistrates’ Court. It can result in a heavy fine. The Court must endorse and may disqualify. If no there is no disqualification, the court must impose 6-8 points on the licence. When reflecting upon the seriousness of the offence, the court will consider the effect of aggravating and mitigating factors. Examples of matters which are aggravating factors are where a driver has: never passed test; gave false details; was driving a large goods vehicle or passenger service vehicle etc.; driving for hire or reward. Also any evidence of sustained uninsured use. Mitigating factors might include: where the responsibility for providing insurance rests with another; a genuine misunderstanding; a recent failure to renew or failure to transfer vehicle details where insurance was previously in existence.

VOLVO LAUNCHES TOUGH TECH FOR ROUGH OPS
I
n addition to recently introducing a heavy-duty bumper for the FH series and Automatic Traction Control for the FMX, Volvo Trucks has announced five new features available for its construction vehicles. Firstly, the Swedish manufacturer is now offering Dynamic Steering for trucks with dual front axles. In addition to lower turning resistance at low speeds, the steering wheel returns automatically to the straight-ahead position after full lock, cutting out the need for added effort in close-quarter manoeuvring. Volvo Dynamic Steering was launched in 2013 and consists of an electric motor that compensates for vibration and steering wheel movement while minimising the amount of force needed to steer the truck. Increased front axle loads are also offered for dual front axles. Heavy-duty trucks with dual front axles increase the maximum technical capacity from 18 to 20 tonnes. On a four-axle truck with a gross weight of 32 tonnes, the
load bed is longer and there is greater flexibility regarding where to place a load, such as gravel in a tipper body. Volvo said higher load capacity above the front axles also permits a greater variety of crane configurations and allows other applications with considerable weight on the front axles. For operators requiring increased gross combination weights of between 50 and 76 tonnes, Volvo is now offering factory-built fiveaxle 10x4 and 10x6 combinations. The two front axles permit up to 20 tonnes maximum load and the three rear axles can handle up to 36 tonnes. This is also suitable for concrete pumps and large crane trucks that need uniform axle load distribution. Rear air suspension in combination with driven front axle is now available for FMX, which enables the combination of an air-suspended rear axle with a driven front axle to boost ride comfort for trucks with all-wheel drive. It also offers ground clearance of at least 300 mm.
DIESEL PRICE STAYS HIGH DESPITE LOWER WHOLESALE COST
T
he wholesale price of diesel was cheaper than petrol for the entire month of June, but motorists are still paying 3p a litre more at the pumps. According to the RAC’s Fuel Watch report for June, the price of diesel has become the ‘elephant in the room’ with wholesale prices 1-3p a litre lower than petrol – yet the average price of a litre of diesel is 120p, compared to 117p for petrol. While some retailers have closed the gap between petrol and diesel on the forecourt, more closely reflecting wholesale prices, very few – if any – have moved their diesel price below petrol. In fact, the vast majority of retailers continue to keep a significant gap between the two fuels with diesel often 5p a litre more expensive. The latter group, said the RAC, may be operating on wafer thin margins on petrol to remain competitive, and trading this off against bigger margins on diesel to balance the books. “The retail price of diesel has almost become a taboo subject despite 2.4bn litres being sold in May, compared to just 1.5bn litres of petrol,” said RAC fuel spokesman, Simon Williams. “While there are twice as many petrol cars on the road, the increase in diesel usage shown in government

statistics and the new car sales figures – which show more than 50 per cent of cars and light commercial vehicles leaving the showroom are powered by diesel – confirm we are increasingly relying on diesel for both business and private use. “Not only are diesel drivers now being demonised due to the increasing concerns over harmful nitrogen dioxide and particulate emissions, they are consistently having to pay a premium for their fuel,” he added. “And all this comes after years in which the taxation system has encouraged motorists to buy low carbon dioxide emitting vehicles. This has led to a big take-up of small fuel-efficient diesel vehicles by motorists believing their choice of vehicle was good for the environment, as well as their pocket. “While retailers are obviously free to choose how much they charge for petrol and diesel, we believe motorists deserve to be treated fairly – and that means forecourt prices that reflect the wholesale market.” The RAC’s Fuel Watch report shows the price of diesel should drop by around 5p a litre in the coming weeks based on lower wholesale prices, although the motoring organisation said it had monitored prices throughout June and saw little to no forecourt price change, so it had little hope of the saving being passed on. “Essentially, what is required is a fundamental rebalance of pricing in the retail fuel market,” Williams said. “We need greater transparency and a fairer pricing model for both petrol and diesel. We realise that with more and more forecourts shutting up shop every month, fuel retailing may not be as profitable as it once was. But there seems to be a clear intention to make more money from a higher diesel price, while at the same time being seen to maintain a lower petrol price.” June saw fuel prices maintain an even keel for motorists as a result of oil prices staying flat and the pound remaining stable. The average price of a litre of petrol was 117p (14p cheaper than 12 months ago), and diesel was 120.75p (15p cheaper). Both have gone up since the early February average price lows of 106p for unleaded and 113p for diesel.

he managing director of South Wales haulier CJ Bird has secured a sponsorship deal with DAF Trucks to support his foray into off-road car racing. Motor racing enthusiasts at the recent Goodwood Festival of Speed saw firm MD Chris Bird in his Milner R5 off-road car. Competing in the All Wheel Drive Club (AWDC) championship, Bird is current leader in the 2015 championship on the back of success in 2014 – winning the AWDC championship, the Welsh Hillrally and the Scottish Hillrally. A family-run haulage company based in Llantrisant, South Wales, CJ Bird was one of the UK’s first hauliers to take delivery of a Euro 6 DAF XF tractor unit. The company now has five DAF XF Super Space Cabs and 15 DAF rigids from 18 to 26 tonnes – all supplied by local DAF dealer Watts Truck & Van Cardiff. CJ Bird’s heavy truck fleet is made up of XF tractor units, many with Super Space Cabs, and CF rigids at various weights. The company’s distribution services focus on the food packaging sector, medical supplies and exhibition equipment – in the UK, and overseas where it relies on DAF’s renowned European back-up service, ITS. “I’m absolutely delighted to have DAF Trucks on board,” said Bird. “Watts Truck & Van have been brilliant too, both in respect of my off-road racing ambitions and especially in supporting my truck fleet. “Every haulier knows how good DAFaid is,” he said, “and it’s certainly a well-oiled machine. We ask our drivers to advise us of any motoring convictions they receive, or if they are involved in an road accidents. My question is if one of our drivers fails to tell us, could this mean we as the employer are held responsible and a claim could be refused?
A

I am thinking of having cameras fitted to my vehicle at the front, rear and to the sides at a cost of around £1400. Are there any insurance companies which offer a discount for having cameras fitted? While I do not know of any specific insurance company that offers a set discount for vehicles fitted with cameras, it would probably be in any case a situation of, say, 10 per cent off the premium. You could find your current insurers are the most competitive without offering any extra discount. However, there is absolutely no question that having cameras fitted to your vehicle(s) will undoubtedly save you money in the long term, if not in the short term as well. Being able to prove your innocence in an accident by video proof is obviously the very best of defences, and if it results in claims not being made against you, the cost of having the cameras fitted will pay for itself time after time. Just a point to mention is that the price you have been quoted seems a little high, as I certainly know of a company who will supply the equipment for around £800 – and for anyone who has their system fitted, we provide a discount off their current insurer’s premium when transferred to us as brokers.
All insurance companies have different criteria, but you would expect an insurer to take the view that as long as the employer – ie, the policyholder – has taken every possible step to ensure all material facts including convictions, accidents, claims etc have been disclosed, then a claim would be settled. It is therefore essential you have stated in your drivers’ contract of employment that they have a duty to disclose such material facts and that they have signed the contract in front of you as the employer. Up until recently, it was a condition of most fleet insurers’ terms that a copy of the paper section of the driver’s licence be obtained and kept on the employee’s file at least once a year. However, now that the paper part of the licence is no longer produced by the DVLA, fleet operators will presumably need to register through the DVLA to be immediately advised of a driver’s convictions. Of course, while fleet insurers have systems in place due to the number of drivers employed within a fleet policy, exactly the same duty to disclose criteria exists even if you only employ one or two drivers.

Is it true that more white vans are stolen than any other vehicle? And if so, is this why insurance companies ask what colour your van is when they quote? Are we paying more insurance than if the van was blue or red? Good question – and in theory, if it is true that more white vans are stolen than any other colour, then surely you should be paying more for your insurance, just like young drivers pay more than older drivers. Thieves will take the most popular makes and models for engine parts etc or the goods they are carrying. They will also be attracted to vehicles which are not as noticeable, which are likely to be the main reasons why white vans – especially Ford Transits, for example – may well be at least one of the most likely to be thief attractive. A couple of interesting statistics are that signwritten vehicles and ones with personalised registration numbers are much lower on the thief attractive list for obvious reasons, as they are much more likely to be recognised by friends and family of the owner immediately after being stolen. So maybe the computer systems used to quote for van insurance also make allowance in some instances for signwritten or personalised-plated vehicles.

DVLA FLAGS UP HAULIERS FACE SOARING BRITISH LICENCES STOWAWAY FINES

auliers have been hit with fines of £12.4 million for illegal stowaways, according to new figures. They are subject to fines of up to £2000 for each person found travelling illegally into the UK – whether the driver is aware of the stowaway’s presence or not. The latest Home Office figures shows a four-fold increases in total fines to £4.2 million a year. Since the new rules were introduced in 2008, £12.4 million in fines have been handed out – and it is anticipated hauliers will face a further increase this year due to record numbers of stowaways congregating at key ports, such as Calais. More than 350 stowaways were caught in just four hours in the peak of the congestion during the strike which forced the closure of the Port of Calais at the end of June.

he DVLA has announced that all photocard licences issued in England, Scotland and Wales will now carry the Union Jack Flag alongside the existing European Union flag. The new rules came into effect on July 6, and the changes apply to all new and replacement licences issued to British drivers. Existing licences in circulation before that date remain valid and will not be recalled. “Our flag is recognised and respected around the world and is something which British people take pride in,” said transport
minister, Lord Ahmad of Wimbledon. “I am delighted to see it featured on driving licences. We are bringing the country together. Adding our national flag to British driving licences is a true celebration of one nation Britain.” The European Union flag has been displayed on full driving licences since photocards first came into use in July 1998. More than 132 million photocard licences have been issued since they were introduced. DVLA said it issued more than 10.4 million licences in 2014.
