IAM URGES DRIVERS TO KEEP SKILLS UP TO DATE

H

uman factors continue to significantly outweigh other reasons for crashes on British roads, according to new research by the Institute of Advanced Motorists (IAM) – which has led the Institute to repeat calls for drivers to look on improving driving skills as part of their ‘lifelong personal development’. Figures from the Department of Transport (DfT) show that in 2014, driver/rider error or reaction were cited as contributory factors in 74 per cent of accidents. These involved more than 117,000 casualties – with 20,830 of these occurring in London alone. Police can cite up to six factors for the cause of each accident they report. The second highest factor was ‘behaviour or inexperience’, which was cited as a contributory factor in 26 per cent of accidents, accounting for more than 40,000 casualties. In London, the number was 9508. The main contributory factors were: ● Driver-rider error or reaction (74 per cent)

● Behaviour or inexperience (26 per cent) ● Injudicious action (25 per cent) ● Impairment or distraction (14 per cent) ● Road environment contributed (13 per cent) ● Vehicle defects (2 per cent) “People often blame their car, the road, or the other driver for the accidents and near-misses they have,” said Neil Greig, IAM director of policy and research. “These figures show that in the vast majority of cases, it’s the driver or rider themselves who is to blame. “Changing attitudes is the key factor when it comes to reducing the numbers of casualties on our roads. People must accept responsibility for enhancing their own skills and recognising their limitations. “It is not enough to leave people to their own devices once they have passed their test,” he added. “Like so many other areas of life, extra coaching pays dividends – and for a driver or rider, that means keeping their skills fresh by continuous assessment.”

MARITIME & SCANIA PARTNER UP TO TACKLE DRIVER SHORTAGE

ogistics specialist Maritime Transport and truck-maker Scania have formed a partnership to tackle the mounting driver shortage by offering those interested in a career in driving an easier path into the industry. Maritime has launched a Professional Driver Scheme designed to offer newly qualified and inexperienced drivers the opportunity to sign up to a year-long course that teaches best practice through a structured training and mentorship program. “This course allows Maritime to train drivers with limited commercial experience in all aspects of our business,” said Simon Smart, MD - Containers. “Gaining employment within a reputable transport company is extremely difficult for newly qualified drivers; however, we see this resource pool as a fantastic opportunity to develop drivers into the professionals we need them to be.” As one of the commercial vehicle manufacturers offering training in the UK, Scania said it has endorsed Maritime’s scheme. “The Professional Driver Scheme has really impressed us,” said Mark Agnew, Scania driver development manager. “We feel the responsible and considered programme they offer will result

in a higher calibre of drivers on UK roads, and for this reason it compliments what we are trying to with our driver training program here at Scania.” Scania has acquired funding from the Department of Work and Pensions for licence acquisition and is currently accepting applicants for its training courses. “Scania, in our opinion, offers one of the best training courses in the industry,” said transport manager, Gary Austin. “Therefore, we are delighted it has chosen to recommend Maritime’s scheme to its successful graduates. The knowledge that a new Maritime driver has graduated from the Scania Driving School gives us the peace of mind that we are taking on a very high calibre of driver as a starting point.” Since the introduction of the Driver Certificate of Professional Competence (DCPC) in September 2014, the issue of a national driver shortage has become increasingly evident. Concerns over the ageing population of existing HGV drivers and the lack of new drivers coming into the industry has prompted debate with the government, and industry bodies are implementing a range of schemes to draw new drivers into a career in road transport.

BRIDGE SIGN REVAMP

T

he Department for Transport (DfT) has proposed a new bridge-marking system that will show both imperial and metric height, width and length limits of bridges on roads across Britain. The DfT has carried out its most comprehensive review of traffic signs since they were introduced in 1964 and is consulting on planned changes. It said a lack of understanding of imperial measurements has been implicated in incidents of bridges struck by over-height vehicles – and pointed out that during 2014-15, there have so far been more than 1600 bridge strikes throughout the UK. While highways and bridge authorities have been able to mark bridges with imperial and metric measurements in the past, this has been achieved by the installation of a separate sign. The proposed change gives the power to mark both measurements on one sign. Vehicles with an overall travelling height over 3 m must have a notice in the cab which indicates the height in feet and inches, or in imperial and metric. Younger and foreign drivers in particular are presented with a challenge when they are more accustomed to metric measurements rather than imperial, as they have to make the conversion – often with little time. The Freight Transport Association (FTA) welcomed the proposals and said signage that can be easily understood by drivers who have to negotiate low bridges and narrow spaces would be a real benefit. “While the new rules have still to be finalised, it is proposed that highway authorities will be allowed to replace the current signs as they become life expired,” said Malcolm Bingham, FTA’s head of road network policy. “FTA has urged the DfT to encourage early take-up of the new option.”

Star Letter A FRIENDLY RECEPTION While on a self-drive in Scotland a couple of weeks ago, I paid an impromptu visit to the Shotts depot of Stuart Nicol Transport in the hope that I might be allowed to take a few photos of their vehicles. Not only was I welcomed in, but Rob, who was working in the yard at the time, showed me around, gave me full details of the trucks that were there and allowed me to take whatever photos I wanted. When I first entered the depot, I was unsure of the reception I would receive – but, as it turned out, it couldn’t have been warmer. For me, this was the second such friendly reception by a Scottish haulier, as only a few of years ago I was shown around the D Steven depot in Scrabster. FALLING ON DEAF EARS? I was originally going to write a letter to encourage potential ‘new blood’ into this wonderful, fantastic and enjoyable industry we call ‘haulage’. Then I woke up and smelled the coffee. Ha! Instead, my letter will now contain a few home truths as to why ‘new blood’ do not want to pursue a career in this dying industry. Why would any young, ambitious (LOL!) man or woman want to fork out in excess of £3000 to gain a driving qualification to earn a wage working 12 hours plus when they could get a working in a supermarket for more money, without any qualification? Yes, this is a sad fact that you can now stack a product onto a shelf that’s been delivered by a professional, experienced, competent LGV driver. MAD! So ask yourself: why is there a shortage? Since I became a LGV driver in 2001, I have seen a huge decline in an industry I used to enjoy. Now it is full of rules and regulations that are constantly changing, confusing, and costly to the driver both in pocket and his future. We also spend our days having to deal with idiotic members of the public, both on and off the roads, and we are looked down upon with contempt. The general public fail to realise how important a role we play. We keep hearing about this so-called driver shortage, and quite frankly it’s getting boring. The powers that be need to listen to the drivers until standards improve – ie, wages, conditions and overall attitudes to this industry. Nobody in their right mind will want to make this their career. Above right, I have drafted a true, realistic job advert. Does this look appealing to you?

It tells the story of how Gordon and a handful of colleagues set out from Jeddah, Saudi Arabia in 1978 in a convoy of three artics, headed for Sharawrah, located somewhere south of the Empty Quarter. The journey – a 1000 km shunt across the open desert of the Middle East – should have taken seven days. But as is so often the case, things soon began to go awry – and in spectacular fashion in this case, as the lads were still battling towards their destination over two months later! This is a monumental adventure and a true testament to the spirit of ‘getting the job done at any cost’. Told with no small amount of wit and humour, Where’s Sharawrah? is an entertaining read, and a must for Middle East Run fans and trucking enthusiasts in general.

ontinuing his review of successfully completed accident claims, Steven Hinchliffe looks at another situation experienced by a reader of Truckstop News who was seeking an award of personal injury compensation.

All of the accident victims mentioned in these articles are clients of my firm, Hinchliffes Solicitors. They have given permission to disclose details of their real life experiences resulting in personal injury claims, and the steps taken to make a successful accident compensation claim. In this two part article I highlight a very common situation where an injured person makes a claim for financial compensation, and even though the insurers for the guilty party admit responsibility, they then seek to reduce the amount payable by saying that the injured claimant was partly to blame for what happened. The legal description for this is a deduction for “contributory negligence”. Insurers for parties accused of causing accidents have one aim - to pay the injured person as little as possible, and preferably nothing. Insurers commonly deny liability even in the most clear cut cases, and when they do accept responsibility one way

to minimise their outlay is to suggest some contributory negligence. Sometimes we have to advise our client that there is merit in this argument, but only where this is truly the case. Often insurers will try to seek a reduction of say 25% of the total value of a claim just to see what reaction they get. In the case I deal with below, the allegation of contributory fault raised its head at a very early stage. As with previous articles, the common factor is the often significant effect on the injured person’s life (physically, emotionally and financially) and although using the existing legal process to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can help not only by providing financial relief by awards of compensation, but also requiring the guilty party to provide the required medical and rehabilitation treatment. In cases where the other party accepts responsibility for the accident but it may take some time before the injured person fully recovers, it may be possible for part of their compensation to be paid on account, pending the final valuation of the claim. CASE STUDY - FORKLIFT TRUCK DRIVER INJURED DUE TO DEFECTIVE WORKPLACE - PART 1 Solicitor Phillip Roberts took a call from Mr K Abbott from Suffolk who told him that he had been at a timber terminal ready to unload packs of timber. As he stepped down from a forklift truck, his foot turned on the edge of a defective drainage hole and which caused him to go over on his ankle. After the accident photographs were taken showing the defect and which was then quickly repaired. Photographic evidence can be a real help to us in dealing with a claim, therefore if you are unlucky enough to have an accident do consider taking some pictures as a record of the situation at that time, just in case. Mobile phones can be a real asset in this regard, as photographs taken with them can be forwarded to us giving useful supporting evidence. This appeared to us to be a straightforward claim as the Health and Safety Regulations affecting workplace floors are very clear, particularly where workers have to carry out part of their job on foot. Therefore, once Phillip had explained

Steven Hinchliffe the claims process to Mr Abbott and he instructed us to proceed, Phillip wrote to the owners of the terminal setting out why they should compensate Mr Abbott for his accident. Within a month the company’s insurers confirmed they would accept responsibility, but at the same time suggested the compensation should be reduced by 20%. Their argument in support of this was firstly that Mr Abbott should not have stopped his FLT where he did because of the position of a nearby crane. The crane in question was some 30 feet away, posed no risk to him and played no part in the cause of the accident. Secondly, they indicated that Mr Abbott was aware of the many drainage holes in the floor, should have seen the one that caused his injury and taken greater care. In a situation like this, what should he do? Does he take the easier option and give in to the deduction sought with the guarantee that some compensation will follow, or does he fight on for the full value of his claim? The offence in question is against Section 172 of the Road Traffic Act 1988 and relates to the duty to give information as to identity of driver in certain circumstances. This section of the Road Traffic Act begins by identifying which sections it applies to. It then states that where the driver of a vehicle is alleged to be guilty of an offence to which the section applies, the person keeping the vehicle shall give such information as to the identity of the driver as he may be required to give by or on behalf of a chief officer of police or the chief constable of the British Transport Police Force. It then states any other person shall, if required as stated above, give any information which it is in their power to give and may lead to identification of the driver. A person who fails to comply with a requirement under the above shall be guilty of an offence. However, a person shall not be guilty of an offence above if the person shows they did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was. In the circumstances whereby a body corporate (such as a limited company) is guilty of an offence under this section, and the offence is proved to have been committed with the consent or connivance

of, or to be attributable to neglect on the part of, a director, manager, secretary or other similar officer of the body corporate, or a person who was purporting to act in any such capacity, they, as well as the body corporate, is guilty of that offence and is liable to be proceeded against and punished accordingly. In practice, what this means is a body corporate might be found guilty of an offence, but a linked individual, such as a director, manager or secretary, can also be found guilty if it is shown the offence has committed with their consent or connivance, or to be attributable to their neglect. In addition, where the alleged offender is a body corporate, or in Scotland a partnership or an unincorporated association, the subsection which states “a person shall not be guilty of an offence above if the person shows they did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was” shall not apply unless the alleged offender shows that no record was kept of the persons who drove the vehicle, and that the failure to keep a record was reasonable. A request under section 172 may be made by written notice served by post; and when it is, it shall have effect as a requirement to give the information within the period of 28 days, beginning with the day on which the notice is served, and the person on whom the notice is served shall not be guilty of an offence under this section if they show either that

they gave the information as soon as reasonably practicable after the end of that period, or that it has not been reasonably practicable for them to give it. The offence attracts six points and a fine. Although a limited company cannot be endorsed, if a linked individual is also found guilty of the offence, then they can receive an endorsement.

yre manufacturer Dunlop and the Road Haulage Association (RHA) chose the penultimate round of the British Touring Car Championship (BTCC) at Silverstone to launch a joint campaign aimed at bringing more new truck drivers into the industry. The campaign – called ‘HGV Heroes’ – is intended to highlight the impact the impending HGV driver shortage is going to have across the country. There are 600,000 HGV-licensed drivers in the UK with an average age of 57, around a quarter are set to retire in the coming decade – and there is already an estimated 45,000-60,000 extra drivers required to meet current demand. As there are currently only 17,000 new HGV drivers qualifying each year, the shortage looks set to increase over time. To bring new blood into the industry, the joint campaign is seeking to redefine the truck driver profession, its image and perceived earning potential; develop channels of funding for driver training; reduce insurance premiums for young truck drivers; improve roadside facilities for truck drivers; and simplify the qualification process.

Dunlop and the RHA said it chose to launch the campaign at Silverstone as it is supported by BTCC driver Tom Ingram, who has recently taken on the challenge to qualify for an HGV licence. Tom, who is sponsored by the RHA, said he found truck driving requires similar levels of skill and concentration as racecar driving – but is actually harder to grasp. To launch the campaign, Tom showcased a 44-tonne Dunlop Motorsport truck around the Silverstone track. “The road transport sector is dynamic, efficient, IT-led and a great industry in which to work,” said Marc Preedy, commercial director, Goodyear Dunlop. “Despite this, there are not enough drivers and the long-term picture indicates we have an enormous skills gap that the industry urgently needs to fill. “This has become a top priority for both the RHA and Dunlop,” he concluded.

HAULIERS WARNED TO HONOUR NEW MINIMUM WAGE

S

ome 50,000 workers in the transport sector are expecting a pay rise after new National Minimum Wage (NMW) rates kicked in on Thursday, October 1. The Department for Business, Innovation & Skills (DfBIS) said it estimated there were nearly 1.5 million workers in the UK aged over 21 being paid on or below the NMW in 2014, based on data captured in a separate ONS Annual Survey of Hours and Earnings. This includes 50,000 workers in the transport sector, which is 11 per cent of the workforce and three per cent of jobs in all sectors. But it warned 80 per cent of business sectors were unaware they could be fined for not paying the new adult rate, which increased three per cent from £6.50 to £6.70 for 21-yearolds and over on October 1. The DfBIS carried out a nationwide survey of 1000 employers, and found 30 per cent employ people on the NMW; 74 per cent didn’t know what the new hourly NMW rate was; 53 per cent didn’t know it was offence not to pay NMW or falsify pay records; 64 per cent

didn’t know they must repay workers they have underpaid; and 65 per cent didn’t know companies could be “named and shamed” for not paying. “With the vast majority of employees now eligible for the National Minimum Wage, including apprentices, it is vital businesses are aware of the new rate changes and their responsibilities to their employees who will be entitled to an increase in their pay packets,” the DfBIS said in a statement. “If you are not paying at least the NMW, you are breaking the law.” It went on to warn operators the penalty for those who have not paid employees at least the NMW they are entitled to includes a fine of up to £20,000 per worker for underpaying, and the business could be publically named. The new rate means a full-time employee, working 35 hours, will see an additional £364 in their annual pay packets. The new apprenticeship rate – the largest increase at 21 per cent – will see apprentices receive £1037 more pay.

LUTON TURNS TO DAF FOR REFUSE FLEET

L

uton Borough Council is replacing its 26-strong refuse collection fleet with new Euro 6 DAF CF 290 FAG 6x2 twin-steer rigids (23 mid-steer and three rear-steers). The 26-tonne GVW rigids feature four-plusone crew-cab conversions by Esteppe in the Netherlands, and are equipped with 21 m³ VARIOPRESS rear-end loader bodywork and Rotary 3 bin lifters from FAUN Zoeller. Supplied by local DAF dealer HTC in Luton, the new fleet is specified with conventionally mounted cabs to provide improved visibility on collection rounds in Luton, where narrow streets provide a constant challenge for drivers. “Our decision to use conventionally mounted cabs goes against the norm of the more common low-entry option,” said Simon Smith, fleet transport manager. “However, the normalheight cab on the DAF allows the driver to ‘set’ his truck with greater confidence when manoeuvring into tight spaces, while the crew-cab conversion still provides excellent accessibility for the crew. “On the streets of Luton, it’s a far better solution,” he said. Ten DAF 26-tonne CF 6x2s are now delivered into the Bedfordshire local authority, with a further nine on programmed delivery before the end of the year and the remainder over the next two years. Twenty-six DAF units make up Luton Borough Council’s interchangeable front-line fleet, whereby vehicles are required to perform a variety of tasks to suit fluctuating operational demands. Luton’s refuse collection vehicles, all with FAUN Zoeller equipment, consist primarily of DAF CF 290 FAG twin-steer 6x2s and, where

Our run took us out of the Dunstable base and onto the M1 to take in a mixed route so we could try out the various technologies. Fitted with a variable speed limiter, truck technology is becoming the driver’s friend. Part of the Iveconnect/sat nav telematics technology includes warnings about speed limits in the vicinity the truck is being driven in. This is incredibly useful if the driver becomes distracted for whatever reason – or enters one of those areas with a lower speed limit than should otherwise be in place, such as urban dual carriageways where you might expect the speed limit for trucks to be 50 mph, but could be 40 mph or even as low as 30 mph. A voice warns the driver of the speed limit if he is exceeding it. We tested this in a couple of urban areas and it works extremely well. As with other truck manufacturers, Iveco has developed its technology to such a point, it is generally accepted the driver can leave the FTP Cursor engine and automated EuroTronic transmission to sort out the gear changes without interfering. It might be the driver will take over and shift up or down a gear or two, or hold the gear he is in, if he sees a change in the road ahead the truck can’t ‘see’ and either not change gear at the right time, or change when it isn’t necessary. On this particular run, the truck performed faultlessly. The 480 bhp motor is extremely quiet while going about its business – even at full weight as it was here – with gear changes coming at precisely the right time, engine revs kept within the

Iveco claims through use of its HI-eSCR system, the higher displacement and torque of its Euro 6 engines gives the same frugal fuel consumption as the previous Euro 5 and EEV models. Much of the technology and many of the attributes used in Iveco’s EcoStralis – a truck designed to lower the total cost of ownership (TCO) for operators and reduce fuel consumption – were either incorporated into, or made available for, its Euro 6 Stralis models. Iveco famously cracked the Euro 6 nut without having to resort to adding exhaust gas recirculation (EGR) technology to its engines, sticking solely to selective catalytic reduction (SCR) instead. This has helped in a number of ways, not least with a reduction in complexity of emissions control, and in weight-saving with less equipment required to be mounted on the chassis. It also means the engine can be produced with smaller dimensions overall, helping save weight.

The 480 bhp motor is more than adequate at the UK’s 44-tonne limit and turns in an impressive performance and the tried-and-tested EuroTronic transmission is faultless in operation. Interior fit and finish is toprate and up there with the best. Iveco has clearly used past criticisms of its products to make changes that will please drivers. The dash info is clear and easy-to-read – absolutely crucial for drivers working on today’s congested roads – the interior mixes luxury with practicality, seating is superb, the bunk is extremely comfortable, with extra cushioning and support added in its design and build, and deep windows and welldesigned mirrors help with all-round visibility. A first-rate truck, if we had to give the new Stralis a rating out of 10, we’d give it 11!

amsey Timber Group of Wellington Street Sawmills in Bradford, West Yorkshire has taken delivery of two Volvo FE 6x2 rigids and an FM 6x2 tractor unit from Crossroads Truck & Bus, Birstall. The two FE rigids, powered by Volvo D8K engines producing 280 bhp, feature 28 ft (8.5 m) curtainside bodies fitted by Micra Truck Bodies of Wakefield – which also handled the necessary Whole Vehicle Type Approvals. The FM tractor unit powered by a 410 bhp D11K engine will join an earlier FM at the company hauling curtainside trailers. “The new trucks are already transporting timber components for the construction of beds all over the country, from Devon to Glasgow,” said Neil

Marklew, transport and warehouse manager. “We expect the Volvo FE rigids to cover some 50,000 km per annum, while the FM tractor unit will top 70,000 km.” All three of the new trucks feature sleeper cabs with single bunks and cloth upholstery, and are monitored by Neil through Volvo’s Dynafleet online transport information system. “I am already using elements of Dynafleet, but I’m looking forward to more advanced training so I can utilise the system to the full extent of its capabilities,” he added. rivers are being urged to make sure they keep up to date with the rules of the road, as new research shows fewer than a quarter of British road-users read the Highway Code after passing their test. In an online survey of 400 drivers, only 23 per cent said they had read the Highway Code since they passed their practical driving test. In response, the Driver and Vehicle Standards Agency (DVSA) is encouraging drivers to sign up to receive reminders and updates about the Highway Code on social media. The Highway Code already has over 50,000 Twitter followers and 38,000 likes on Facebook. According to the DVSA, the majority of people who receive updates from the Highway Code said they have used the roads differently since signing up to receive alerts, and 80 per cent said their knowledge had improved. DVSA said it has now updated the online version of the Highway Code to make it easier to find rules and see recent changes. Transport minister Lord Ahmad said: “The Highway Code is essential reading for all road

users – not just those who are learning to drive. It’s now easier than ever to keep up to date with the Highway Code and the rules of the road. “Making sure all road users keep their skills and knowledge up to date will help to keep Britain’s roads amongst the safest in the world.” Road users can keep up to date with the Highway Code and get regular reminders about the rules on Twitter (@HighwayCodeGB) and Facebook (www.facebook.com/ HighwayCodeGB). Last year, DVSA sought feedback from those who have already signed up for the Highway Code social media alert service. The results show that: ● 83 per cent of respondents said that their knowledge has improved since signing up to the service ● 63 per cent of respondents said that they have used the road differently since signing up for the alerts ● 94 per cent of respondents said that they would recommend the service to family and friends
