PATERSONS PICKS UP FMX QUINTET F ive new Volvo FMX 8x4 tippers have been put to work by Rigside, South Lanarkshire-based operator Patersons Quarries Limited. “We took drivers off our other make tippers, all of which were registered during 2015,” said transport manager, Gordon Carlton. “Within the first few days of operation, reaction to the new FMXs was amazing. All were reporting a noticeable increase in fuel economy, with a truck straight out of the box, and a big difference in cab comfort. “Some have noticed how relaxed the driving experience is with Volvo’s I-Shift automated gearbox, and others are sensing reduced levels of tiredness after a full day shift, meaning they go home feeling more refreshed and ready for family life,” he added. “With the current nationwide shortages of experienced professionals, happy drivers are good news to me.” Supplied by Volvo Truck and Bus Centre North & Scotland, Glasgow West with full R&M packages, the five FMX tippers were specified with Day cabs over Volvo’s 11-litre D11K370 diesel engine which produces a

maximum of 370 bhp between 1600-1900 rpm. Carlton reported the powerplant as being well on top of Patersons Quarries’ 32-tonne tipper operations across central Scotland and northern England. He said he also expected the boosted fuel returns to improve further as the trucks bed in. The 12-speed I-Shift gearboxes come with Volvo’s Distribution and Construction software packages, while for off-road quarry work, Carlton opted for X-High B-Ride suspension and straight front axles. The FMXs’ ground clearance is also complemented by a highmounted 330 litre fuel tank. Patersons Quarries fitted Weightlifter alloy tipper bodies to the five new trucks, giving a kerbside weight of around 12.1 tonnes, and feature high sides and three-point contact, plus access steps for safety. Hyva hydraulics and a Dawbarn automatic sheeting system round off the load-carrying specifications. A Volvo reversing camera and Smart Witness front-facing and vehicle perimeter camera system are included as part of the company’s standard safety features. TRUCKERS WARNED TO BE AWARE OF DANGERS OF PRESCRIPTION DRUGS
I
n light of drug-driving prosecutions reaching an all-time high last year, the Freight Transport Association (FTA) is warning that motorists need to be aware of laws regarding prescription drugs that came into force in March 2015. The Association said that while drink-driving limits are well known, many drivers may be unaware of changes to the law in England and Wales on medications including diazepam and temazepam. Limits were introduced for eight commonly-prescribed drugs and anyone whose driving is impaired through exceeding the limit can face prosecution. The penalty for drug-driving is the same as for drink-driving in England and Wales – an automatic ban of at least a year, a fine and up to six months in prison. Lower alcohol limits were introduced in Scotland in December 2014, and FTA said it is important to be aware of the changes. A report by the comparison website confused.com highlighted a 144 per cent increase in drug-driving prosecutions in 2015, while one in eight motorists admitted feeling affected by prescription drugs and over-thecounter remedies such as hay fever tablets.
new training initiative called Driving Ambition has launched with the aim of training people in the North West for a new career in the commercial transport industry. The initiative opens up opportunities for local people to train as part of an intensive skills programme to be ready for work as drivers. Claimed to be the first of its kind in the North West, the first 100 people to sign up at the firm’s Widnes Business Park training and test centre can take advantage of a scheme that could see them pass their LGV test in eight weeks for £1900. Claimed to be half the price of similar training courses, the initiative also enables those looking for work as a driver to become proficient in less than half the time it currently takes – namely eight weeks. The one-stop-shop training and testing centre in Widnes is the only one of its type in the region to employ its own DVSA-approved examiners. This investment helps to cut test waiting times to three days, ensuring upwards of 20 people are able to pass through the training centre’s gates each week to become qualified drivers. The first trainees are already approaching the end of their course and will be looking to secure permanent LGV driving jobs with a range of local employers. The move by Driving Ambition is aimed at tackling UK-wide demand for qualified drivers – logistics and transport operators are currently struggling to recruit, and

it’s estimated an extra 150,000 trained drivers will be needed by 2020. The centre features the latest driver training equipment and facilities to fasttrack people through the LGV qualification as quickly as possible. This includes classrooms, an outside manoeuvring area, a new fleet of training vehicles as well as a team of experienced instructors to equip candidates with the skills, experience and certifications for a commercial vehicle driving career. The centre is DVSA-approved to ensure people can be trained and tested as an integrated package, which should help to relieve the bottleneck on test availability. Adrian Daulby, Driving Ambition’s director of operations, said the investment had been made to help keep the regional transport industry moving with the skilled drivers it needs. “Our training programme provides a springboard for those looking to either get back into work as drivers or start a new career in the commercial transport sector,” he said. “With the six-figure investment we’ve made and our own onsite DVSA examiners, we are offering a unique opportunity for people to gain job ready skills at a fraction of the cost of alternative training courses and in considerably less time. It’s a win-win.” Driving Ambition is a one-stop-shop training and testing programme that enables people to gain their CAT C and C+E licences. Once qualified, Driving Ambition’s resourcing team work closely with newly qualified drivers to identify the right opportunity for them and place them into work.

Letter SHOW STOPPERS! On Sunday, April 24 the Solway Vehicle Enthusiasts Club hosted a gathering in conjunction with the National Drive-It Day. Owners of classic cars and lorries and modern vehicles combined at the Lockerbie Lorry Park, Hangingshaw Farm, Johnstonebridge, Lockerbie to mark the event locally. The venue provided an excellent backdrop for the occasion, giving substantial area to display the larger vehicles and offering spectators plenty of scope to view the exhibits. Police Scotland was on hand to provide road safety advice, and Dumfries and Galloway Blood Bikes took advantage of the occasion to promote their work. The event was extremely well
attended and there was consensus that the Lorry Park, a new location for the Enthusiasts Club vehicle shows, was ideal and the show a great success. At the end of the show, the prize-giving ceremony saw Best in Show awarded to a pristine Scania articulated truck. Other prize categories included Best Classic Car, awarded to Barry Warters, a Best in Lorry Section and Best Motorcycle, Bus and Working and Classic Van. ontinuing his review of compensation claims, Steven Hinchliffe looks at a situation experienced by a reader of Truckstop News who was seeking an award of Personal Injury compensation. In this particular case we will look into the claim in detail and in this part examine the initial steps taken, and then look at the outcome in the next issue. We will also look at the planned “reforms” the Government proposes to introduce in 2017 and the effect this will have on lower value Personal Injury claims. All of the accident victims mentioned in these articles are clients of my firm, Hinchliffes Solicitors. They have given permission to disclose details of their real life experiences resulting in Personal Injury claims, and the action taken to make a compensation claim. In this two part article I highlight a road accident involving a head on collision. Fortunately my client’s injuries were not serious, but if the accident was to happen following the proposed increase in the Small Claims limit from £1,000 to £5,000 and other changes planned by the Government in 2017, would he then have a claim worth pursuing at all?

As with previous articles, the common factor is the often significant effect on the injured person’s life (physically, emotionally and financially) and although using the existing legal process to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can help not only by providing financial awards of compensation, but also requiring the guilty party to arrange and fund medical and rehabilitation treatment. In cases where the other party accepts responsibility for the accident but it may take some time before the injured person fully recovers, it may be possible for part of their compensation to be paid on account to make life a little easier, pending the final valuation of the claim. CASE STUDY - HEAD ON COLLISION - PART 1 In June 2014 HGV driver Mr P B Hanson of Great Yarmouth was driving north on the A11 near to the RAF station at Mildenhall, which is currently made available to the United States Air Force although they are due to leave the station between 2020 and 2023. A car was coming from the opposite direction and drifted across the road, colliding with the front of the truck being driven by Mr Hanson. The driver of the car was an American serviceman. The Police gave him a roadside breath test, which he just passed, so whether his drinking was the cause of his inattention or if he just forgot to drive on the correct side of the road is unclear. This claim looked bound to win resulting in Mr Hanson receiving compensation for his injuries, which were principally to his neck and is commonly called a “whiplash” injury. As Mr Hanson had been fortunate and not suffered any serious injuries, our initial thoughts were that he could expect to receive compensation of between £1,500 and £2,500, depending on what the medical evidence that we would obtain for him revealed. He also had to take time off work losing income and incurred other expenses, which could be claimed as part of the overall case. All was in order, and once we had discussed our contractual documents with Mr Hanson and fully advised him about the process, a
Steven Hinchliffe claim was made against the other driver and in the usual way this was processed by his car insurers. What about his legal costs? Until March 2013 we, like other solicitors, could guarantee to clients that they would keep 100% of their compensation because the legal costs in bringing a successful claim were paid by the opponent’s insurers. As a result of rule changes imposed by the Government, from April 2013 in cases such as this solicitors could only recover a modest part of their costs from the opponent. From then on we could only assure clients that they would keep at least 75% of their settlement figure, as they were required to make up part of the costs shortfall from their compensation and we would then write off the balance. From 2017 the Government proposes to completely ban all claims for minor soft tissue injuries (ie whiplash), and also remove the obligation on opponents to pay any legal costs at all where the amount recovered for all other types of injury is less than £5,000. This will affect around 80% of all Personal Injury claims. Returning to Mr Hanson’s case, does he have a happy outcome? According to the European Commission, the road safety statistics for 2015 published by the Commission in March this year demonstrate European roads remain the safest in the world, despite a recent slowdown in 12 - Accident Spot Feature in Truckstop News - Issue 369.indd 1 reducing road fatalities. Some 26,000 people lost their lives on EU roads in 2015, which is 5500 fewer than five years previously in 2010. However, the number has remained static when compared to 2014. The European Commission estimates 135,000 people were seriously injured on EU roads. The average EU fatality rate for 2015 was 51.5 road deaths per one million inhabitants. The UK figures were 29 road deaths per one million inhabitants. The statistics reveal the number of road fatalities still varies greatly across the EU, though this gap is becoming smaller every year. Some traditionally wellperforming countries recorded less progress while three of the Member States with the highest number of road deaths improved their road safety situation. The social cost (rehabilitation, healthcare, material damages, etc) of road fatalities and injuries is estimated to be of at least €100 billion. Clearly every effort to address road safety must be maintained. One method of addressing road safety is to tackle the issue of drivers being distracted. Driving requires continuous attention to the road and traffic, as well as good vehicle control. Not paying full attention

can lead to a loss of control, thus putting the driver and other road users in danger. Drivers get distracted when they are occupied with other activities. Their attention can be attracted by people or activities inside or outside the car. They may also become tired or daydream. In terms of tackling distraction, according to the European Commission, measures to address the issue generally fall into five categories: legislation and enforcement, driver training, publicity campaigns, technology-based measures and actions connected to road infrastructure. Target groups and areas for such measures include drivers, transport companies, roads and vehicles. Much of the focus of work related to distraction has been on car drivers, as they are the road user group liable to cause the largest number of distraction-related collisions. However, the risk of distraction among nonmotorists such as pedestrians and cyclists, as well as among motorcyclists, has also increased with the proliferation of mobile technologies.

84% OF DRIVERS TO VOTE ‘OUT’ IN BREXIT SURVEY

eturnloads.net has conducted an independent survey of HGV drivers in the UK in relation to the EU referendum. Over 500 UK-based truck drivers took part in the survey, and the results showed a whopping 84 per cent of HGV drivers intended to vote ‘Leave’. According to the survey, 10 per cent of HGV drivers are still undecided on how to vote, while 19 per cent feel leaving the EU could harm the UK haulage industry. A larger percentage of drivers aged 35 and under would vote to stay in the EU when compared to drivers over 35. “This survey has resulted in some interesting findings,” said returnloads. com sales & marketing manager, Matthew
Spendiff-Smith. “The vast majority of the HGV drivers who took part will be voting to leave the EU. “The main comments we received for their reasoning was that while in the EU, foreign drivers working in the UK are keeping wages low and keeping some UK drivers out of work. “Other areas of concern included immigration, too much regulation and people not wanting the UK people to be controlled by an unelected power that may not have the UK’s best interests at heart,” Spendiff-Smith added. “Six per cent of those who took part are undecided, and this is mainly due to the lack of clear information available on how it would affect them directly. “Only 10 per cent will be voting to stay in the EU; a few respondents feel that if we leave the EU, we will still have to pay and accept EU conditions if we wanted to trade with them, but the UK will no longer have any say. “Other feel that if we leave the EU, prices for goods and services across the country will increase,” he concluded.

CAR CRIME UP AS POLICE STOLEN VEHICLE UNITS ARE CUT

he International Association of Auto Theft Investigators (IAATI) UK is warning motorists of a recent increase in car crime, which it claims is linked to the loss of specialist police Stolen Vehicle Units (SVUs). “Vehicle thefts are already increasing and the inevitable result of cutting more SVUs will be a widening of the gaps in police knowledge and skills,” said IAATI UK president, Justin Powell. “In short, the wheels will come off. “Whether we are talking about the targeting of modern classics, such as Ford Escorts and
Land Rover Defenders, or tech-savvy criminals using electronic compromise to steal cars worth hundreds of thousands of pounds each, it usually involves organised criminal gangs. “Vehicle crime, as well as being a problem in itself, is also a key enabler of other serious crimes, including terrorism,” he added. “It is therefore imperative to keep up the pressure on these networks. IAATI promotes joined up thinking, a partnership approach, between law enforcement and the private sector, which is essential in tackling all areas of vehicle crime across the globe,” Powell concluded.
Wincanton employees are raising money for the British Heart Foundation and Transaid

incanton employees have undertaken a cycle ride of 999 miles and 57,000 ft of climbing between Land’s End and John O’Groats to raise money for the British Heart Foundation and Transaid. The mammoth charity cycle took place at the end of April and visited a number of Wincanton’s logistics sites throughout the UK. “We wanted to do something really special to mark Wincanton’s 90th year, and what could be more special than taking on the legendary Land’s End to John O’Groats challenge?” said Adrian Colman, CEO of Wincanton.
“It’s a great opportunity for Wincanton colleagues all over the country to get involved, in whatever way, in a ‘heart healthy’ event which actively supports the wellbeing of our colleagues.” Wincanton said it was aiming to raise £30,000 for the two chosen charities. DAF CHIEF CALLS FOR COMMON APPROACH FOR CITY OPERATIONS
T
he industry and government must work together to tackle the issues of clean air, the safety of vulnerable road users and traffic congestion, according to DAF Trucks UK chief Ray Ashworth. The Clean Air Zones on the cards for Birmingham, Leeds, Nottingham, Derby and Southampton, announced by the government in December, are likely to mark the start of a pattern of restrictions for operators in cities across Britain. “Euro 6 is becoming the standard cities are demanding,” Ashworth said at a pre-CV Show media reception. “But I would like to see one standard for the whole country, not diversification per city. “Give us a problem and we will solve it. Euro 6 solves the clean air issue, and manufacturers have proven the test cycle for trucks at Euro 6 meets the required standards. The test cycle for diesel cars at Euro 6 is not the same, and we need to be clear about that so HGVs are not tarred with the same brush.” But Ashworth said when it comes to the issue of road safety, the time has come for politicians and legislators to take the lead. “There are a number of possible solutions to increasing safety for vulnerable road users,” he said. “Keeping trucks out of congested areas at peak times and encouraging deliveries at flee-flow times; increasing the number of nighttime deliveries using silent trucks; keeping trucks in the inside lane of a two-lane highway – these may be radical solutions that will segregate trucks and cyclists, but perhaps that what we need.”

OSMONDS ADDS ANDOVER STEPFRAMES TO TRAILER FLEET

ent-based Osmonds Transport & Planing has taken delivery of two new step-frame trailers with beavertails from Andover Trailers – continuing a working relationship between the two companies which has lasted almost three decades. The new 56- and 73-tonne step frames join four Andover Trailers’ products currently in operation with the road planing and plant-moving specialist, which ordered its first trailer from Andover in 1988. Both trailers feature a new generation of box-section slide-out side extension designed to be stronger, simpler to use, easier to clean and which is now galvanised to ensure a long life in service. Also new to the design is the installation of 10-tonne rated RUD swing-up lashing loops and M36 load securing points built into the load bed to accommodate 14- or 16-tonne screw-in RUD lashings for easier load securing. Both trailers have been built with 1m wide power toe ramps with sliding width adjustment and knife edge toes, to accommodate a wide range of cargoes. This includes an extensive fleet of Wirtgen
cold-milling machines operated by the company, which range in size from 15 to 36 tonnes, plus any heavy plant being carried by the transport division. The SFCL56 and SFCL73 step-frames are equipped with three and four SAF axles respectively, with a rear-steering capability. Disc brakes, Andover’s own safety-light system and robust 285/70R19.5 tyres – the largest fitted to any step-frame in the Andover Trailers range – add to the specification. Finished in ‘midnight blue’ paintwork, they have also been pre-fitted for a working at height safety system on the neck to allow for easy retrofitting at a later stage. Both trailers will cover more than 50,000 miles annually and are in operation across the South of England up to seven days a week. Established in 1975 and operating from Brenchley, Kent, Osmonds Transport & Planing runs an extensive fleet of road planing machines, tippers, road sweepers, step-frames and low-loaders. The company is also a member of the Association of Planing Contractors.

The main award was presented to Giorgio personally by Princess Anne, The Princess Royal at the Microlise Transport Conference 2016, held at the Ricoh Arena in Coventry in May. Giorgio was previously a van driver for Culina’s Corney & Barrow operation out of Hoddesdon. Giorgio has also driven rigid vehicles before progressing to driving articulated vehicles, which he has been doing for just over a year now. “Giorgio is a prime example of what we are achieving here at Culina. Our national and local programmes are enabling Culina to train and develop the most professional drivers in the industry,” said Thomas van Mourik, Culina Group CEO. “Our drivers are an absolutely key component of our company. Culina stands or falls by the quality of the drivers we recruit and train. Giorgio is a testament to the high quality driver training provided by Culina Group. Indeed, this year three Culina drivers were shortlisted into the final 22 drivers for the Microlise Driver of the Year award. This was from a total of 110,000 drivers

Cherry picked premiums

I recently bought a cherry picker, and to add it to my truck policy, I have been quoted just under £3000. However, the man I bought it from said he was only paying about £700 to insure comprehensive, any driver. Can you give me your thoughts, please?

A cherry picker or lifting platform would normally be classed as a Special Types vehicle, and as such would be considerably cheaper to insure than if it were under a normal truck insurance policy. My first guess is your current broker has assumed you wished it to be added to your truck policy and not considered the possibility of starting a separate Special Types policy. Of course, there may be additional reasons for such a difference in premium, such as whether the previous owner has full noclaims discount if you do not, or maybe the vehicle’s use is different under your ownership than his. Either way, I think you will find it should be insured under a Special Types policy, which would in normal circumstances be substantially less than a truck policy. Just a point to add – and that is if this is your first cherry picker, please ensure your liability insurers are made aware of the type of work you will be carrying out with this vehicle.

Spare truck query

I own three trucks, but will only be using two, keeping one as a spare. At the moment, I have all three insured under one policy, but it seems crazy to be paying for something I am not using. The spare vehicle is only worth about £4000 so I am not bothered about insuring it against fire or theft, but my broker says it hardly makes any difference if I insure it road-risk only. Your advice, please.

One option is that you ask your insurers for laid-up only cover; however, the negative to this would be the vehicle would have to be SORNed, and my guess is you might need to use it at short notice in case of a breakdown or the servicing of one of your other two vehicles. Also, remember that by reducing the cover to third-party only, then that carries through to the trailer you are pulling, so if the trailer is owned by a customer this could also cause problems. You may be entitled to further discounts on all three vehicles if you only have two drivers, for example, as this would prove that only two out of the three vehicles could be on the road at any one time. Different insurance companies will look upon your situation in different ways, so I can only suggest you ask for alternative quotes nearer the time of renewal to compare.
