hecking your vehicle is safe and roadworthy before driving it on the road is an essential part of a driver’s working day. For goods vehicles over 3.5 tonnes, it’s a legal requirement for a check to be done on the overall condition of the vehicle each day it works.

Defects must be noted, reported and resolved. These days, most companies will

have a system in place where defect sheets are filled in and handed to the person in charge of transport either each day, at the end of each week, or simply when a defect is found. If no defects are found, a report does not need to be kept, as it’s considered a ‘nil report’. Checksheets which do have defects listed on them have to be kept for 15 months.

First up, observe the vehicle as you approach it for anything obvious – leaning to one side, a flat tyre, bits of bodywork missing, torn curtains etc. If it looks OK, hop into the cab, making sure the steps, door and grabhandles are in working order.

Essentially, it means certain items can be listed as defective, but the vehicle can still be used while repair is organised. For example, a single broken curtainsider strap or a dented side rail is not going to mean the vehicle is no longer safe to use.

However, it is important to ensure the items are repaired at the earliest opportunity.

Driver essentials

Every lorry driver will need certain equipment to help them do their job, for example a hard hat and waterproof gear are vital for those who deliver onto building sites.

Here’s a few simple items which will help you carry out checks, and keep the vehicle safe.

■ Two items that should be part of every driver’s ‘toolkit’ are a torch and a pair of handling gloves. It will often be dark when carrying out checks, and even a little LED pen torch will help greatly when you’re looking underneath vehicles. Gloves? Well, lorries are generally covered in all sorts of grime, so it pays to keep a few pairs handy in the cab!

■ An item to operate the brake pedal to enable you to check to see if the brake lights are working is helpful for daily checks. You can actually buy something called a ‘brake pedal depressor’ or similar, but to be honest a block of wood wedged between the pedal and the seat does exactly the same job – and, of course, for a fraction of the cost.

■ A bottle of glass cleaner and kitchen roll/cloth is a big help for cleaning

■ A bottle of screen wash. One of our pet hates – empty windscreen washers! An old two-litre pop bottle with some ready-mixed can come in very handy – especially if the last kind soul to use the truck emptied them and didn’t think to tell you about it.

■ Screwdrivers and spare bulbs. Selfexplanatory, although if you’re expected to change bulbs, you may need some basic training on how to access them.

In the cab, insert either your digital tacho card or analogue tacho disc and set the mode to the ‘crossed hammers’, which indicates ‘other work’. Check the tacho calibration plaque is in date (usually found on the door or thereabouts), the display for any messages, and the time is correct. It’s surprisingly common to find a tacho showing the wrong time – this needs to be reported on your checksheet, as it is an offence for which the driver can be held responsible.

While in the cab, start the engine, then hop outside and check for excessive smoke that could potentially indicate a problem.

Think the Driver CPC is a waste of time? This course begs to differ – it teaches drivers how to properly control a skid and reduce the risk of rolling a truck on the road, and

here’s a huge number of DCPC courses available to drivers looking to brush up their professional skills and achieve the required 35 hours of periodic training ahead of next September’s deadline. Some courses, like those which shore up understanding of working time regulations, tachograph use, or eco-driving are of obvious benefit; while other subjects can vary widely and should be carefully assessed before a driver exchanges his hard-earned money for a spot in the classroom.

But one practical course, offered by CRYdel with the support of Mercedes-Benz Driver Training, is particularly beneficial for all drivers (though we admit it’s not cheap, with places costing upwards of £430 +VAT). It not only demonstrates how to properly control a truck in the event of a skid, but also offers drivers the rare chance to safely roll over a tanker, demonstrating just how easy it is to cause a potentially fatal and hugely expensive accident – and more importantly, how to avoid it.

Steer or stop?

The course takes place at the MIRA Proving Ground on the outskirts of Nuneaton, Warwickshire and begins with a classroombased discussion of what to do and what not to do when approaching an unforeseen obstacle in the road.

According to course leader Dean Jordan, a driver’s natural inclination to jam on the brakes and swerve around the hazard can do more harm than good. The laws of physics dictate a vehicle’s tyres have a finite amount of grip. If a driver brakes and steers at the same time, that grip is split between the two actions – so if 80 per cent of grip is used for braking, then there’s only 20 per cent left for steering, which is most likely not enough to get you out of trouble. advice, therefore, is that in extreme situations, a driver should either brake OR steer, and not try both at the same time. “It’s counter-intuitive, but safer,” says Dean. Of course, some situations require a driver to do both – and in those circumstances, brakes should be released a few seconds before steering is attempted, to give the wheels time to spin up.

Also of vital importance is declutching during emergency manoeuvres (if you’re running with an automated ’box, it should be flicked into neutral to guarantee disengagement of drive). Otherwise, the truck is still being told to move forwards, which will further reduce the amount of grip available for braking or steering.

Brakes should not be feathered either, as it can confuse ABS/EBS systems. “If you need to brake, keep your brake on and let the technology do the work for you,” says Dean. Regaining control when negotiating bends is also covered. The procedure to

correct oversteer is to declutch/engage neutral, then if necessary counter-steer into the skid. To correct understeer, decelerate (lift foot of accelerator, rather than engage braking) and if necessary alter steering.

The theory set out, it’s time to put it into practice on the skid pan. MIRA has a specialist low-friction circuit and MercedesBenz provided us with New Actros tractor units to use for the exercises. During the session, course members are encouraged to create a skid by entering the pan at speed, then applying some steer until the tyres lose their grip.

Once skidding, the driver has to regain control of the vehicle and successfully avoid an obstacle (in our case, traffic cones). It’s certainly entertaining – but at the same time, the skills course members develop during the exercise will increase their chances of avoiding an skid accident when back out on the road.

Tipping point Once we’re done on the wet-handling course, it’s back to the classroom for some eye-opening lessons on how to avoid rolling a truck on the road. In the UK, there are 12,000 rollover accidents each year involving vehicles over 3.5 tonnes, and on average each accident costs a staggering £1 million to clear up.

There are three contributing factors in a rollover incident: speed, centre of gravity, and the radius of the turn. If a vehicle’s centre of gravity is high (for example, if the load is top-heavy), then it will require less speed to roll over. There’s also no way for the driver to know his trailer is tipping over until it’s too late, as there’s no sensation of the movement inside the cab.

“This is because rollovers start from the rear of the vehicle, and the last wheel to leave the ground is usually the one under the driver,” says Dean.

Most tanker rollovers occur just after a driver has negotiated a roundabout and starts to accelerate away, which can increase the movement of product that has already been set in motion during the previous turns. “Traffic lights on roundabouts are also a contributing factor,” says Dean, “as drivers are tempted to accelerate into a bend in order to beat the lights. You’d never accelerate into a bend under normal circumstances.”

So what can be done to prevent a rollover from happening? The most important thing is to make sure roundabouts are approached slowly. If you’re coming in too fast, it’s better to stay straight and jam on the brakes to provide maximum grip for slowing the vehicle. It might mean the truck goes straight over the roundabout, but this, says Dean, is preferable (and safer) to rolling over. “And if a rollover is going to happen anyway, braking will reduce the chance of things on the street entering the cab and killing you,” he points out. A sobering thought, indeed.

The theory is sound, and it becomes crystal clear once a driver initiates a rollover on the test track. Using a specially kittedout artic tanker with outriggers, Dean asks us to put the truck into a turn to simulate a roundabout. Travelling at what feels like a comfortable and safe speed (around 18 kmh), all appears fine. T

he official advice on reversing goods vehicles is that it should be avoided whenever possible. Employers are encouraged to remove the need for reversing both on and accessing/ exiting their premises. In a perfect world, we would all drive in one gate of a site, load/ unload and then go straight back out the other end. As we all know, the world is not perfect and all across the land are places that were never designed with big trucks in mind.

What might have been fine for a Thames Trader with a few sacks on its back 50 years ago is hardly ideal for an artic with 45 ft curtainsider trailers – but them’s your apples.

There are places where pedestrians wander about, places where you have to reverse out onto the road, places down urban streets with cars parked everywhere – and we all just have to get on and deal with it.

We’ve all seen it before – a bloke in a hard hat out in the road, tentatively stopping traffic before waving a lorry off a building site. While it’s better than nothing, it’s not ideal and there’s training available for those who need to guide vehicles onto the public highway.

The training for a standard vehicle banksman will not generally include any authority for the banksman to become involved in the direction of vehicles on the public highway. Any banksman asked or required to assist in this area must act with great care and avoid unnecessary obstructions to other road users.

Don’t get too close

The last thing a banksman wants to do is to get too close to the vehicle. For starters, the driver may not be able to see you, and you then also run the risk of being run over or crushed. Stay clear of the vehicle, so that the driver can see you at all times.

Additional courses are available for ‘Public Highway Banksman’. This will generally be for qualified vehicle banksman to stop traffic on a public highway for short periods of time to allow site deliveries to be completed. There are legal requirements for stopping traffic on the public highway, signage requirements along with safe systems of operation and signal. Courses will also end with practical and theory tests.

To do their job, banksmen have to stand close (but in a safe position) to where a vehicle is reversing, which can put them at risk. Using banksmen to control reversing operations can put the banksman in the potential danger area of a reversing vehicle. Every year, banksmen suffer serious and fatal injuries while at work – don’t crush or be crushed!

Guiding from the front

Many sites will have signs telling drivers there is no reversing on site without a banksman, or that all drivers must report to reception. At any unfamiliar site, it’s well worth checking it out first before potentially blocking the place up by driving into an area you shouldn’t be accessing.

Some banksman training will teach you to manoeuvre vehicles from the front, and in some instances this system is more suitable than standing to the rear of the vehicle.

Standing well back, you will have an excellent view of what is going on around you.

Obviously this will not work so well when backing a truck out of a warehouse door or onto a road, but it comes in handy and the technique is used by the Armed Forces.

We’re sure you have your own ‘favourites’ in terms of the worst places you’ve come across for reversing, but here are a few of ours…

START MOVING/ END OF MOVE Hand raised in the air. Can also be a thumbs-up.

TRAVEL TOWARDS ME Both palms facing upward, moving arms in upward motion.

TRAVEL AWAY FROM ME Both palms facing downwards, moving arms in downward motion. Alternatively, use pointing fingers from head height, as from a distance it may be possible for the driver to get the palms up/palms down signals the wrong way round.

Many timber/builder/plumber merchants will have their warehouse door adjacent to their car park, which means not only do you have pedestrians to deal with, you’ll also have builders’ vans. They will park them everywhere, thinking nothing of blocking off your tail-swing room, or boxing you in altogether. Or resting timber on the side of your trailer while they slot it out the window of their van. Beware!

Blinds will twitch and neighbours will come out to observe you attempting a 60-point turn at the bottom of a cul-de-sac without making a foot-deep divot in their lawn with your 22.5 inch wheels, or knocking down the overhanging branches of Victor Meldrew’s prize cherry tree. The plus point is if you time it just right, you can really annoy school-run mums in Chelsea Tractors, as the last thing they expect to come face to face with is you. ■

Cannabis is the most commonly traced drug in drivers. Even though the effects fade after a matter of hours, it can be detected in the blood for up to four weeks. In theory, this can compromise the driver if they’re tested positive.

When we are talking about drugs, it doesn’t necessarily mean controlled substances such as cannabis. There are loads of medicines available from supermarkets, pharmacies and service stations. But do you know exactly what’s in them, and the effects they can have on you?

Some prescription and over-the-counter medicines used to treat conditions such as colds, coughs, hayfever and general pain may affect your ability to drive.

SIDE EFFECTS

Some medicines can make you: drowsy or tired; dizzy; lightheaded or faint; unable to think clearly; have reduced coordination, including shaking and feeling unstable or shaky; edgy, angry or aggressive; sick, nauseous or otherwise unwell; have blurred or double vision. If you experience any of these effects, or other effects that make it difficult to drive, speak with your doctor or pharmacist before driving.

COUGH REMEDIES

Be particularly wary of some cough medicines, as they can make you very drowsy – which can be dangerous if you’re setting off an a long haul up the motorway. Medicines will be labelled that they may cause drowsiness, and some of the stronger variants will be available via a pharmacy only. If you’re unsure, ask a pharmacist to recommend which medicine would be best for you.

KNOW THE CONTENTS

Many cold and flu tablets contain paracetamol, which is dangerous if taken in too large a dose. Many also contain caffeine, so be wary that if you’re taking them and drinking your usual coffee, they may have an

adverse effect (see notes on caffeine on the next page). Some prescription-only painkillers such as Tramadol can also have powerful effects, and you should tell your GP about your occupation during your appointment.

CONSIDER THE COMBINATION

The effect of a medicine on your driving may be more if you: take two or more medicines that have similar effects on your driving; start a new medicine; take more than the prescribed or recommended dose of your medicine; drink alcohol at the same time; are tired; are older.

The Alcosense website (www.alcosense.co.uk) has lots of useful information on alcohol, and it details what happens when your body processes alcohol.

When you drink, alcohol is absorbed into the blood stream through the stomach and small intestine. The more you drink, the more is absorbed. After about an hour, the alcohol is distributed equally around the blood stream.

As blood flows round the body, approximately 90 per cent of the alcohol it contains is broken down into water and carbon dioxide by the liver in a process called oxidation. The remaining 10 per cent of the alcohol is passed through the lungs and kidneys. A healthy liver typically breaks down alcohol at a rate of one hour per unit of alcohol, but the more alcohol consumed, the longer it can take for the liver to process each unit.

When you stop drinking, your level of intoxication may stay constant – or if you have been drinking heavily, it could even increase for around two hours afterwards. This is because of the time it takes for alcohol to reach the blood stream from the time you actually had the drink. If you have eaten food, this can also increase the time as the release of alcohol into the blood stream can be slowed by being absorbed by the food in the stomach. This is the reason Alcosense does not recommend the use of its breathalyser just after finishing drinking, because there are so many factors that influence the reading. Which drivers need to acquire a Driver CPC qualification?

All professional truck drivers will need to hold a Driver CPC qualification if they wish to continue driving professionally after the deadline of September 9, 2014.

Are any drivers exempt from DCPC?

Some drivers may be exempt from having to gain a DCPC qualification depending on the work they do. For example, those driving vehicles with a maximum permitted speed not exceeding 28 mph are not required to hold DCPC, and the same goes for drivers of vehicles that are used to carry materials or equipment to be used by the driver in the course of their work – so long as the driving of the vehicle is not deemed to be the driver’s main activity.

Obtaining a Driver CPC qualification does not generally require the driver to undertake and pass any tests; they simply have to attend the courses and accrue a total of 35 hours of training.

Some course leaders ask attendees to complete a quiz-style test at the end of the session, but this is informal and the results do not affect a driver’s acquired hours.

What will happen if I drive professionally after the deadline without a valid DCPC qualification?

A

Truck drivers caught driving professionally after the September 9, 2014 deadline without a valid Driver Qualification Card (DQC) could face a fine of up to £1000 and run the risk of having their vocational licence suspended or even revoked. Operators can also be severely penalised for permitting their drivers to work without a DCPC qualification.

Volvo Trucks has lifted the lid on its all-new FH series of heavy trucks, designed with the driver in mind and a focus on fuel economy.

Details were scarce when we went to press ahead of the official launch on September 5, but the Swedish manufacturer told Truckstop News the new FHs will be available in both Euro 5 and 6 form, and pack a vast amount of upgrades and improvements.

Leading the charge for fuel efficiency is Volvoʼs new I-See function (Truckstop News, issue 301).

The system, which works alongside the I-Shift automated transmission, is claimed to cut consumption by five per cent by storing information about the route the truck drives along. “The next time the truck uses the same route, I-See operates the accelerator, gears and brakes to ensure progress is as economical as possible,” said Claes Nilsson, president, Volvo Truck Corporation.

An additional five per cent saving in fuel use is possible with Volvo Trucksʼ new Fuel Package. This package encompasses training and monthly assistance – Fuel Advice – and its aim is to cut fuel costs by changing driving styles and increasing knowledge of how to drive for maximum fuel-efficiency.

Also of benefit to drivers are improved seats and driving position, optimised to provide a better view of the road. This is aided by an increase in the cabʼs usable window area and an innovative slimmer rear-view mirror design.

Stalks and controls are arranged in priority so the most important ones are now closest to the driver, and the steering wheel now has a neck tilt function – another world-first in the truck world.

This means an extra 300 litres (10.5 cu ft) of storage capacity, as well as greater comfort on board.“The cab is optimised both for work and leisure time,” Nilsson said. “A better bed, integrated parking cooler, new lighting and low noise levels among other features, all increase the chance of pleasant relaxation and a good nightʼs sleep, which in turn means drivers are less tired and more alert.”

Production of the Volvo FH will start in spring 2013 for the European market.

he saying ‘the customer is always right’ has undoubtedly been questioned by all of us at some point in our careers.

But the indisputable fact is the customer comes first. At this point in time, the economy is weak, all areas of industry are feeling the squeeze and none more so than road transport. There’s a lot of organisations out there providing similar services, and margins are already cut to the bone. This is why good customer service is crucial.

What are the definitions of customer care and customer service? Well, you can find any number of them via Google – but we think this sums it up best: “Customer service is the provision of service to customers before, during and after a purchase. Customer care is the client’s perception of how well you supply those goods and services.”

Simple? Not quite – there are thousands of books on the subject, but there are a few basics that are invaluable and will serve you well.

As a driver, you will come into contact with customers – possibly more than

anyone else in your company. Whether you’re aware of it or not, you play a vital role in representing your organisation.

The odd thing is that while office and sales staff will often be treated to courses and training on how to interact with customers, deal with problems and put across a positive image, it’s unlikely drivers get the benefit of this.

Many training companies are now offering Driver CPC courses for Customer Care, some of them will be a full day duration, while others may take place over half a day and are combined with another subject. We reckon it’s well worthwhile taking a closer look at this often overlooked part of the driver’s working life.

At Truckstop News, we’ve spent time in offices, in warehouses and on the road, and it’s only too easy to end up with a fractious relationship between the three – and that’s before you even factor in the external customers. Yep, even the guy on the forklift or the person on the phone in the office who sends you all over the place; they are in fact customers. The people you work with within your company are considered internal customers, while those who pay for services

from the firm are external – the end user, the person or company who is waiting for the load to arrive.

As a driver, it’s fair to say we are right at the sharp end. We’ll get it in the neck even if it’s not our fault. You’ll no doubt have been there – too late, too early, wrong thing, thing is damaged, bits missing, paperwork wrong

and so on… It’s enough to get even the most laid-back driver stressed.

So what we’ll run through here are some of the basics that will make your life a bit easier, your job that bit more enjoyable and will help you represent your company the best way you can.

KEEPING CUSTOMERS ON YOUR SIDE 1

Worth the effort

It’s estimated a customer who has had a bad experience will tell at least 10 people about it – and then those 10 people may tell other people, and so on. Then there’s the power of the internet, where anything you can think of can be reviewed and discussed via any number of websites and forums. So it’s as important as ever to keep customers happy – and work hard to help unhappy ones. It costs five times as much to gain a new customer as it does to keep an existing one.

Dealing with upset customers

Right, so you’ve arrived at a customer’s place and the delivery is (just for example) incomplete (it could just as easily be broken, or simply the wrong thing). What follows is some helpful information to help you help the customer, and hopefully convert a potentially stressful situation into one that has a positive outcome.

Listen attentively

Listen to your customer and show concern. If they can see you have an understanding of their problem and are sympathetic towards them, this diffuses anger. Advise the customer you are sorry about the inconvenience and will do what you can to help. Showing a sincere interest and that you’re willing to help – that you’re on their side – will help with getting cooperation. Use their name (surname

initially unless they say otherwise), eg Mr or Mrs Smith.

Don’t say: “Sorry pal, I’m just the driver, got nothing to do with me.”

Do say: “I’m sorry about this Mr Smith, I understand your issue and will do what I can to help.”

Take responsibility

Don’t just shift the blame and make excuses – it doesn’t matter who caused the problem, even if it was those numbskulls in the warehouse who got the order wrong.

Take responsibility and do whatever you can to solve the problem as quickly as possible.

Don’t say: “To be honest with you, this company is a bunch of idiots. They never get anything right.”

Do say: “I can phone the depot and explain the problem, and we’ll see what can be done.”

Take notes

Note down what the customer tells you if necessary and make sure you understand exactly what is wrong.

Don’t say: “So are there bits missing or something then, pal?”

Do say: “Just to confirm, there were three pallets ordered, but only two have arrived?

Which part of the order is missing?”

What do they need?

Find out what the customer wants – they have a problem that needs to be solved

Good relationships with warehouse staff may well mean you get loaded and unloaded quicker and easier

as quickly as possible. Do they need the balance of the order immediately? Is there an alternative? Work towards a solution they want.

Don’t say: “Hold on while I get out my magic wand…”

Do say: “What would be the best way to resolve this issue for you, and can we offer an alternative?”

Get their support

Get the customer on board. Propose a solution and gain the customer’s support, or put them in touch with someone who can resolve their problem. State your solution in a positive manner. If it is acceptable, act promptly.

Don’t say: “Here’s 50p, phone someone who gives a toss.”

Do say: “I’ve got someone from the office on the phone now who will be able to help organise the rest of your delivery.”

Tell it like it is – nicely

If it boils down to there not being an easy remedy and you can’t meet the customer’s request, say so – but don’t say they’re wrong. Sometimes the customer will know there’s nothing you can do, and all they want is for someone to listen to and respect their point of view – and if nothing else, at least you can do that. Be considerate of their feelings, and courteous.

Don’t say: “Well there’s nowt I can do, so I’m offski.”

Do say: “I’m sorry the delivery was short, I’ll make sure the right person deals with it and we get this sorted for you.”

NEW PERSPECTIVE

We spoke to John, an experienced driver who spent 20 years on the road before moving into a management role with a builder’s merchant. “Having spent a lot of time on the road, and then moving to the other side of the fence, I understand how difficult and frustrating it can be at times for drivers to deal with all sorts of different people over the course of a week. Most of the time, there’s never any training given – it’s a case of get loaded, get on the road and get the stuff delivered. If only it was that simple.

“I’ve complied a few common-sense tips for drivers that I think might help. There’s a number of customer service courses available on DCPC and I think it’s a useful subject to cover. There’s a lot of cynicism in the industry from drivers, and I can’t blame them. From pay, conditions, rules and regulations, you name it – there’s so much drivers have a right to be frustrated about.

But drivers are so often the front-line troops and the face of a company. I think it’s important for employers to treat their drivers like they would their customers – as a happy, motivated driver is worth his weight in gold.

“Much of what I hear, though, is ‘we’re nothing but a number’, and ‘if I don’t do it, then there’s another guy just waiting for my job’. Hopefully the Driver CPC will help change attitudes across the industry, but I think it’s going to be a very long haul.” Here are John’s tips…

YOUR OWN COLLEAGUES

“It’s well worth getting to know the guys in the yards or warehouses, or wherever you load from. Taking the time out can mean you can get your wagon loaded better. Forklift drivers don’t always appreciate how stuff comes off at the other end, but I found once I got to know people better, we were able to help each other out.

“Talk to the people in the office, too. When I was delivering building materials, I had to ask umpteen times for the guys taking the orders to give me full contact information so I could phone ahead to make sure people would be ready to take the delivery – which they really appreciated. I also developed a good relationship with the transport manager, and was able to re-route certain deliveries as I knew I could get them done quicker, or that a customer would prefer a different time.”

PLACES YOU DELIVER TO

“When arriving at a premises, it’s never worth not kicking up a fuss if they can’t unload you as quickly as you’d like. If you do know you’re stuck for time and they’re not doing what they should, phone the office and get them to deal with it.

Nothing will put warehouse staff on a go-slow better than a stroppy lorry driver hopping about and wanting to be tipped right away.

“Take the time to talk to people and the places you deliver to and get to know them. I’ve been in situations where there’s been a couple of trucks waiting before me, but I’ve been tipped first as I’ve only got one pallet on. You’re also more likely to get a cup of coffee and a biscuit if you are waiting!”

THE END USER

“Some of us will deliver to homes and offices and so on, directly to the people waiting for the goods. All I can say is, smile, be polite, use their surname until they tell you otherwise, and don’t just dump the stuff and do a runner. It’s surprising how good feedback can find it’s way back to bosses. On one run I was doing for an agency, it seemed like the old driver did nothing but complain and speak in grunts, so when I appeared with nothing more than a ‘Hello’, ‘Goodbye’, ‘Please’ and ‘Thank you’, within a week I was offered a permanent position as customers had got in touch to say how much better the new driver was!”

PROBLEM SOLVING

“Urge the customer to get in touch with the right person if they aren’t happy. A while back, I was delivering to a site about 40 miles from base, and whenever I got there, the guys on site would be unhappy as they’d have been promised the goods first thing in the morning – which I knew was a promise we couldn’t keep, especially when the TM was putting two drops on before them! I told them I was sorry, and I would say to the office the customer wasn’t happy, but explained it would be much more effective if they spoke directly to them – complaining to the driver in this case would simply not do any good.”

DON’T WORRY, BE HAPPY

“Smile! It’s surprising how much better your day will go if you smile and

adopt a cheerful attitude when you’re in contact with customers. In jobs where we’re dealing directly with members of the public – eg, when delivering goods to their homes or premises – people generally appreciate seeing a happy face.

Sometimes you even get lucky and get a tip. ‘There you go son, get yourself a pint!’

As that supermarket says, every little helps.”

LOOK SHARP

“These days, many companies will provide uniforms for their staff. Image is important, and there’s no more obvious example than that of Eddie Stobart. Say what you like, but you can’t deny its policy of clean wagons and smart-looking staff has served the company well. As a driver, you can help improve the image of your company. If the uniform is supplied, wear it

– and keep it in good condition. If there’s no uniform available, take into consideration the work you’ll be doing.

When I was delivering domestic appliances, our own staff would have uniforms, but when someone from an agency came in to cover, you’d often see a huge difference in how they’d turn out.

Some guys would turn up in torn, paintcovered jeans and muddy old rigger boots – and they’d be dragging those boots through people’s houses. And then there was this one guy that used to drop off radiators to a plumber’s merchant on a Friday. I’m pretty sure he left the yard on a Monday and didn’t have a bath until the following Saturday. We nicknamed him ‘Pepe Le Pew’, and he really was NOT a good advert for his company. God help whoever got his truck when he was on holiday…”

hroughout the recession there has been a marked reluctance by much of the UK workforce to pursue a work related accident claim for injury compensation for fear of being unfairly treated, earmarked for redundancy, or not being able to obtain agency work because of a claims history. This remains the case today, even though people with a long term working relationship with their employer will likely have the benefit of full employment protection rights.

the relevant limitation period is approaching a claim can still be made, and supported by details recorded in medical records or accident book entries if witness evidence is difficult to obtain. Such cases can be more problematic for the injured person’s solicitor, but when my firm has been contacted at the 11th hour, as long as we felt there was a reasonable chance of recovering compensation for the client we have agreed to take the case on and got the Court process underway within days.

Although few employers welcome having to deal with an accident claim, it is rare for them to be vindictive in this situation as this could open them up to the prospect of an Employment Tribunal hearing.

Problems are less likely to arise with larger companies, but it is in respect of the smaller employer that personal relationships are at most risk. My firm is very conscious of this and all of the claims we make on behalf of clients are put forward in a professional, nonconfrontational manner, focusing on facts not personalities. Upsetting your opponent is unproductive and will potentially make the situation worse for all concerned.

If you were injured in an accident at work a couple of years ago it may be that you did not feel comfortable in claiming against your employer and by doing so put your job at risk. It might have been the case that your employer was not at fault as the accident happened at a customer’s premises, but you did not want to put your employer’s contract with them in jeopardy. Lots of issues play on the minds of workers in this sort of position and it is not surprising that most work accidents do not result in a compensation claim. However, if your injuries have had a significant affect on your life and you have not yet fully recovered, or if your employment position is now more secure or you have changed jobs and want to review your decision - all is not lost.

Under UK law an adult injured in any type of accident (whether at work, on the road or elsewhere) usually has three years from the date of the accident in which to make a claim for compensation against the responsible party. For children this period does not start until their 18th birthday. There are shorter timescales in certain circumstances, such as if the accident happened on a plane or a ship. However, whatever period applies if the claim has not been settled and Court proceedings not started by the time it expires, it is generally too late to proceed. In lawyer language, the case has become “statute barred”.

It is always best for a claim to be started as soon as practical after the accident, when everyone’s memory of what happened is still fresh and written records are more likely to be available. However I accept that this is not always possible, for a variety of reasons. Even when

This is not the case, for as long as they had insurance cover (which is required by law) the claim will be picked up by their insurers. In practice, most accident claims are handled (and paid) by the insurers of the person or business at fault, making the process more detached from your opponent and removing the personal element.

Steven Hinchliffe accident. Often the largest part of the financial losses is lost income while you are unable to work. The more severe the injury the greater its value, but also more time is needed off work and the loss of wages increases. Many working people do not receive sick pay and if no money comes into the household for even a couple of weeks, bills can go unpaid and domestic tensions mount. Those who criticise people injured in accidents for claiming compensation from the party at fault (and also the solicitors who represent them) have certainly not experienced the trauma and stress that can be caused to both the injured person and their family in this situation.

Another important aspect to a claim is to consider what medical treatment the injured person may require to enable them to return to work as soon as possible. This is something that my firm explores with the opponent’s insurers at the earliest possible stage, and have often secured funding for physiotherapy sessions, MRI scans and even private surgery.

As long as you are still within the timeframe for making an accident claim, it is always worth seeking legal advice from a professional.
