rivers that have passed their test since the introduction of Driver CPC are being urged to check they have completed all of the required theory and practical elements, including the ‘Initial’ Driver CPC parts. If not, drivers wanting to drive a lorry, bus or coach for hire or reward will not have obtained their full Driver CPC qualification and could be driving illegally. The warning was issued by Tachodisc MD Karen Crispe, who said that when DCPC was introduced in the UK, holders of a full PCV licence before September 10, 2008 or a full LGV licence before September 10, 2009 gained their Initial Driver CPC through ‘acquired rights’. These drivers had until September 10, 2013 (PCV) or September 2014 (LGV) to complete 35 hours of periodic training to maintain their CPC. However, for new drivers wanting to drive professionally after this implementation date, the Initial Driver CPC qualification was introduced as an addition to the driving test, and requires the driver to complete four theory and practical tests. The periodic training then has to be completed within five years from the date of passing the test. “It has recently come to our attention via our training school that there are a number of LGV and PCV drivers who have unintentionally not completed modules 2 and 4 of the driving test, which means they are not fully qualified to drive professionally and could be driving illegally,” Crispe said. The confusion may stem from the fact the driver receives their driving licence for successfully completing parts 1 and 3 of the

test. “The feedback we have received from drivers is they genuinely believed they were qualified because they had a physical driving licence,” Crispe said. “They had all overlooked parts 2 and 4 of the test, thinking they were optional. “However, under the new EU Directive, parts 2 and 4 are only optional for drivers wanting to have a vocational driving licence (or when driving vehicles exempt from CPC). They are NOT optional for professional drivers who want to drive lorries, buses or coaches for a living – these drivers must pass all four modules – 1, 2, 3 and 4 – to comply with Driver CPC rules.” The driving test comprises four sections: Part One, Theory test (this includes two separate tests: multiple-choice and hazard perception); Part Two, Driver CPC theory case studies; Part Three, Licence acquisition (practical test of driving ability); and Part Four, Driver CPC practical test (vehicle safety demonstration).

Star turn for MSL MSL Transport reckons its New Actros are proving particularly fuel-efficient

roxburn-based MSL Transport has taken delivery of two new MercedesBenz 2545 GigaSpace tractor units and a pair of 2545 BigSpace rigids delivered by Western Commercial, along with two 2546 tractors from the current Actros range. “I’ve always had a soft spot for MercedesBenz trucks,” said director Dave Sharp, whose company operates from the town’s East Mains Industrial Estate. “They have proved excellent in terms of reliability and high-quality engineering.” The latest arrivals have joined a fleet of 12 trucks dominated by Mercedes-Benz. Most are double-shifted – MSL collects and delivers consignments ranging from a single pallet to a full load in the daytime, and trunks to a depot in Telford during the night. Its New Actros are powered by 330 kW (450 bhp) straight-six engines, driving through Mercedes PowerShift 3 automated transmissions. “It’s a really well-designed truck and looks great in our colours,” Sharp continued. “Like

most operators these days, though, our biggest concern is fuel. Our tractor units don’t run heavy, but we pull very high capacity double-deck trailers, which are a big drain on a vehicle’s fuel economy because they are so tall. “Even so, our New Actros tractors are averaging 8.8 mpg, and with standard trailers they’re recording 9.9 mpg – which is certainly ahead of our average. The rigids, meanwhile, are averaging about 9.5 mpg, which is very good considering they’re on multi-drop work with constant stopping and starting.” MSL has already ordered another pair of New Actros 2545s with range-topping GigaSpace cabs, and these will also wear the company’s distinctive red and white livery with high-visibility reflective lettering. “As well as achieving excellent fuel returns, the New Actros are very popular with our drivers, who really appreciate the large, comfortable and well laid out cabs,” Sharp added.
Truck deals signal UK recovery?
surge in the demand for trucks could be strong sign the UK economy is beginning to turn a corner, according to vehicle solutions business Motiva Group. The company has revealed contract hire for HGVs has almost doubled in 2013, and similarly encouraging figures are being reported from businesses across the country. Peter Davenport, managing director of Stoke-on-Trent-based Motiva, said he believes the trend paints an encouraging picture for the UK as a whole. “The number of truck contract hire deals we did this year was massively up on the previous 12 months,” he said. “Our M-Way truck solutions arm completed a total of 48 contracts for HGVs in 2012, and we’ve already taken more than 80 in 2013. We expect to take between 95 and 98 orders by the end of the year. “There has been a definite turnaround within a 12-month period, with companies now showing much greater demand for new trucks on their fleet,” Davenport continued. “It’s a particularly positive and concrete sign that the UK economy is starting to move in the right direction.” Davenport said it is understandable that companies were reluctant to invest in
new vehicles during a period of economic uncertainty. “A lot of people weren’t sure which way the market would go and, because of that, they were extending old hire contracts and continuing to run the same trucks,” he said. “But now things are beginning to pick up and it seems most people can see some light at the end of the tunnel. “Companies who held on to their fleet through uncertainty can now see a stronger future, and it looks like they’re deciding now is the right time to renew their fleet.” The surge in HGV contract hire deals could also be put down to a natural consequence of leaner times in the past – and on legislation demanding sustainable fleets. Businesses that would normally change their vehicles in year five may have held on longer due to the recession. But those trucks may now be reaching the end of their useful life and showing signs of unreliability. “There is also an issue with the rules over emissions, particularly in London,” added Davenport. “Older and less-sustainable vehicles need to be replaced to avoid the potential for extra charges, and those running ’05 or ’06 plates would probably be looking at that right now too.”

Held at the Oulton Park race circuit in Cheshire, the event gave invited guests their first chance to put the vehicle through its paces on UK roads. New Actros is the ultimate premium truck for longdistance transport. From the outset, designers and engineers were determined to provide the best possible comfort, driving dynamics, safety, productivity and operating economy, as well as a sweeping range of cab sizes, engine ratings and options, allowing customers to tailor vehicles perfectly for any application. The current Actros holds the Guinness World Record for fuel economy at 40 tonnes gvw, but road tests have shown the new model is seven per cent more frugal when specified to meet Euro 5 emissions regulations, while the ultra-clean Euro 6 version shows a four per cent improvement. The 81 guests took turns to head out on a 17-mile test drive, carefully chosen to simulate a variety of typical driving conditions. The route included single- and dualMark May reckons the new Mercedes-Benz Actros is ʻbrilliantʼ. carriageway roads. Each of the four demonstrator trucks provided for the event made 10 journeys - a total of almost 700 miles covered on the day. On each trip, the mpg figure achieved was recorded and at the end of the day the winner was Craig Stewart, logistics manager at Widnes-based Ray Stewart Haulage, who averaged an impressive 11.4 mpg in the 510 bhp V8-powered Actros 2551, and 11.8 mpg in the 450 bhp Actros 2545 model. Between journeys, guests also enjoyed ‘hot laps’ of the Oulton Park circuit in two-seater racing cars piloted by professional drivers. All vehicles include a semi-automatic gearbox, which will help to enhance driver comfort and safety, particularly as Safetykleen vehicles are increasingly operating in urban areas where routine traffic congestion means stop/start driving is commonplace. IVECO CLEANS UP WITH NEW DEAL
K parts washing and hazardous waste management company Safetykleen has expanded and upgraded its fleet with 85 new vehicles from Iveco. The deal, which marks one of the largest orders to be placed for Iveco’s new Eurocargo medium truck range, will consist of 61 3.5-tonne trucks, 21 seven-tonne trucks, six 15-tonne trucks, four 26-tonne tankers and three 44-tonne tractor units. The new trucks will gradually be rolled out over the next few months and will be spread across Safetykleen’s nationwide network of 19 branches and waste transfer stations, and form part of a 248-strong commercial vehicle fleet. The latest Iveco vehicles, which have been taken on a contract hire basis through fleet services firm Fraikin, were chosen for their environmental performance, safety features and comfortable design. TNT TRUCKS ARE COOKING ON GAS
P
rins Autogas UK and TNT Post have signed a record-breaking contract for one of Europe’s single biggest orders for HGVs to be converted to an alternative fuel. TNT Post has chosen Prins Autogas UK to fit the cost-cutting, carbon-reducing technology to 80 of its 120-strong fleet, including all the company’s articulated HGVs. Southampon-based Prins Autogas said it estimates TNT Post will benefit from an annual net saving of 8-10 per cent on fuel costs. Conversions started in January 2013 and were completed by April 2013. Prior to fleet roll out, TNT Post trialled the system for 12 months, where it found the Prins Autogas system was reliable and compatible with the company’s HGV fleet. The test HGV faced detailed examination at one of Europe’s leading test tracks, the Millbrook Vehicle Test and Development Facility in Bedfordshire, and included tests by TNT Post against a standard vehicle. Will Putter, commercial director Prins Autogas UK, said: “TNT Post UK gave Prins UK the opportunity to prove the Prins DieselBlend LPG product on its Renault Premium 460 HGVs for reliability and savings, and we passed with flying colours. “This is great news for the haulage industry that a brand like TNT Post has adopted our product. ive men from Newcastle Upon Tyne have been arrested by officers from HM Revenue and Customs (HMRC) after an investigation into the suspected illegal importation of seven million cigarettes. The men, from Heaton, Gateshead and Elswick, were arrested on October 1 at an industrial unit in Darlington after customs officers intercepted a lorry carrying seven million duty-free cigarettes, which had been described as barbecue equipment. The cigarettes are estimated to be worth £1.5 million in unpaid excise duty and VAT. HMRC assistant director Jo Tyler said: “These men have been arrested on suspicion of the fraudulent evasion of duty, and we urge anyone with information about people dealing in illicit cigarettes and tobacco in the North East to contact us on 0800 59 5000.” The men have been questioned by officers from HMRC and released on bail pending further enquires.

ive Euro 6 compliant Volvo FH tractor units have entered service with ambient, chilled and fast-moving consumer goods (FMCG) supply-chain specialist Fowler Welch. The trucks are working out of the company’s flagship Heywood Ambient National Distribution Centre in Lancashire. Fowler Welch MD, Nick Hay, said the company will be replacing 100 trucks in 2014 as part of its fleet renewal programme. He believes gaining early experience of Euro 6-compliant trucks in advance of the main purchasing round next year is an important part of the decision-making process. “We need to get to know and understand Euro 6 technology,” he said. “We’re delighted Volvo is the first manufacturer to put Euro 6 trucks into service with Fowler Welch in advance of next year’s fleet replacement programme.” Nick Hay described the company’s 400-strong truck fleet as one of three ‘crucial’ controllable operational cost elements for the business. “Although drivers constitute one of those elements,” he said, “we focus very hard on ensuring they are happy with the kit. It’s vital we provide trucks that are safe and comfortable.” Hay said the other key operational costs

As a result, driver training is essential to controlling costs. “We are heavily focused on mpg together with reducing the environmental impact of the fleet,” Hay said. “Early adoption of Euro 6 is an important step towards that. DRIVING THE EXPERIENCE GAP
I just wanted to say I used to loved reading Truckstop News and Trucking magazine when I lived in the UK, but I moved to the States at the end of 2011 and can no longer get hold of the publications. I used to have the entitlement for driving trucks, but I just never got the chance as I was in the Catch 22 position of having no experience (or not enough), and other excuses the companies or agencies would come up with. But this not why I am writing. The reason is that over the years, I have come back home to the UK from time to time and noticed ads from trucking companies from here in the US and Canada
going to the UK to recruit drivers, and I was just wondering how the companies get around the rules? The reason I thought I would ask is the fact I have been in contact with a number of trucking companies here in the States who will train an individual to get their commercial driving licence, but all those I have come across have required a person to have held a State driving licence for a year, and in some cases two years. So I was wondering how they get around this rule when they recruit from the UK, because the individual will have to have a car licence first? Mark Hosbrough By email

THROWING LIGHT ON THE PROBLEM I have enclosed a letter that is a response to the recently implemented crackdown and campaign by Norfolk and Suffolk Police in relation to Section 24 of the Road Vehicles Lighting Act. Dear Sir, As CEO of HGVparking.com I have a vested interest in the recent crackdown on the implementation of Section 24 Road Vehicles Lighting Regulations. My service (www.hgvparking.com) has always aimed to provide lorry drivers with adequate overnight parking. Being a lorry driver myself, I am very well aware of the difficulties that drivers face when staying away from home in a lorry. I will cut to the chase and say this recent ‘crackdown’, while clearly enforceable by law, is untenable in that the amount of lorries one could potentially move on of a night simply will not have a home elsewhere in “dedicated parking areas”. It is a simple matter of displacement. I credit you with sufficient common sense to know this. So my question is, aside from having swathes of HGVs with flat batteries through winter, to what end is this campaign? The simple answer that I am sure springs to your mind as well as my own is to either park elsewhere, or to park according to regulations with sidelights on. Clearly, as we already said, there are not enough dedicated parking spaces for the amount of lorries staying overnight in the Norfolk/Suffolk area. So this by turn forces lorries still to park on road areas where drivers are subject to lighting up at night. This is fine aside from the obvious potential for flat batteries. It’s also fine during the summer months; but during winter, when dusk to dawn is protracted somewhat, this is less than desirable option. Even from a view of road safety, which is the angle you are taking on this surely, having unnecessarily parked vehicles due to flat batteries and those that come to their rescue is surely a less than desirable option. To have drivers running their engine at night to charge their batteries is also something you must not want to

SAFETY GOES HAND IN HAND Hopefully, none of us set out in the morning with the intention of using our vehicle to do damage to anyone else’s property or being. This in mind, I see there are a number of public funded bodies who appear to be of the mindset that their roads are populated by deranged killers, hell-bent on causing havoc across their fair city. I am of course talking of The Mayor of London, Boris Johnson and TfL, who collectively appear to wish to rid their roads of the very vehicles that supply the life blood of the city in which they live. If we are to continue to supply goods and services to within their area of control, we are being told we will have to meet more stringent criteria so as to minimise our impact on vulnerable road users – which is fine, because as technology moves forward, safety systems improve and make the roads safer for everyone. Now, there is one slight problem with this whole picture. The vulnerable road users who we are trying to protect seem to have a deathwish all of their own. They are not content to share the road with other road users; there are some who think it’s OK to lean on my vehicle at

Does a rest period require that a driver start his engine periodically? The law would suggest this is classed as ‘work’ anyway, and in contradiction to the very thing the driver is trying to do in the first place! I can’t argue that you should not uphold the law, it is what we all want. But my worry is the implementation of the crackdown. We are only a small way into your campaign and already I hear of drivers being woken in the night to be presented with tickets. This is not in lay-bys or high safety risk areas. This was on a quiet industrialised area. How this pertains to road safety, I would like to know. To wake a driver in the middle of the night is subjecting that driver to a loss of rest, resulting in tiredness during the following working day. This is an abuse of road safety, surely? I can see that drivers in the case may have been parked in contravention to the Act you are trying to uphold, and so you are doing nothing ‘wrong’, but is this the right way to go about it? Drivers do not park where they do in lay-bys or desolate industrial parks because they enjoy it. They are trying to earn a living, trying to keep the country moving through these difficult financial times. Not just for their own pockets, but for their employers, and ultimately for the good of British industry. For the good of us all. To penalise a driver for parking with the most mild of infringements when clearly they have tried to park considerately and safely, is flying in the face of all that we work for every day. It rubs people up the wrong way, and it shows your forces in a bad light. A cynical person would say this is monumental coincidence that it comes
within weeks of certain truck stop owners complaining of ‘illegally’ parked goods vehicles and blaming this for a fall in business. I would not suggest such a thing myself, but the timing of the campaign is woeful in the least. If bringing drivers onside with a view to road safety was the aim, then would there not be a much better way of going about it? I would welcome an open and honest discussion on how to achieve this – and so would 99 per cent of drivers. Perhaps the campaign is to highlight that the lack of overnight lorry parking facilities in the area, to which I would agree wholeheartedly. But is it fair then to use lorry drivers as the fuel for this inevitable fire? I say inevitable fire because I simply can not see how this could end in a way that is benefits anyone. Lorry parks may be full, but still there will be a need for more parking. Lorries may park with lights on down a deserted industrial area, but who will this benefit? Are other motorists so perplexed and endangered by unlit heavy goods vehicles at night that officers must go door-knocking at 1 am on a tiny side road leading nowhere? Lorries may park in laybys adequately lit, but motorists will still have accidents. Is the campaign the best way to reduce collisions? Why target lorry drivers in such an affronted manner? When it comes to road safety, you will find the overwhelming majority of drivers will support you without question. In this circumstance, I can categorically say you have the potential to put against you a huge section of society in one questionably though- out swoop. Even after writing this letter with a completely open mind, and playing devil’s advocate throughout, I still question the point and the method of this campaign. To top this, when one of their own and the man who could be held loosely responsible for increasing the number of cyclist – namely, Sir Bradley Wiggins – has the good sense to suggest all cyclist should take some responsibility for their own safety by wearing some form of headgear, he is shot down in flames. The cycling lobby are, of course, armed with the knowledge that no matter what happens in the event of collision between one of them and one of us, we will always be in the wrong no matter how many safety systems we fit. The only problem with this is that in the event of a coming together, the vulnerable cyclist is always going to come of worst; so with all the good will in the world, the only decision left is which member of the cyclist’s family gets the insurance payout. GOV BIKES OUT SAFETY CAMPAIGN
A
campaign to raise awareness of cycle safety in London is being rolled out in cities across the UK, according to a recent announcement by road safety minister Robert Goodwill. The poster campaign, which aims to cut the number of cyclists killed or injured, will target road users in five cities: Leeds, Manchester, Bristol, Birmingham and Cambridge. According to government figures, the number of cyclists killed in the UK increased from 107 in 2011 to 118 in 2012, and the five cities have been chosen because they have the highest rates of accidents involving cyclists outside of London. The posters, which were first used in London during the summer, use images to warn both motorists and cyclists to watch out for each other – for instance, as drivers open vehicle doors, at junctions or on narrow roads. “The UK has some of the safest roads in the world, but a number of cyclists are still killed or seriously injured every year and we are determined to tackle this,” Goodwill said. “This campaign aims to make motorists aware of the need to look out for cyclists, ensuring they take extra care when turning at junctions, for example, and encourages cyclists to think about the dangers that they could be unaware of when they are riding.” The government is spending £278 million on its mission to support safer cycling, including £35 million to tackle dangerous junctions. In addition, nearly all of the projects being funded by the department’s £600

The Stena Hibernia will be introduced onto the route from Tuesday November 5, and will initially operate eight sailings per week for freight customers. MARAUDING MONSTER TRUCK KILLS EIGHT

ight people – including at least one child – have lost their lives after a monster truck crashed into a spectator area during a stunt show in Mexico. The out-of-control truck smashed through safety barriers and into a crowd of people standing 10 m away, who had gathered to watch the vehicle perform a range of stunts as part of the Extreme Aeroshow at El Rejon Park near Chihuahua in early October. According to footage recorded by onlookers, the driver of the monster
truck appeared to lose control of the vehicle after leaping a row of crushed cars. Some witnesses reported seeing the driver hit his head on the roof of the truck during the jump, which caused his helmet to come off. Prosecutors are also investigating whether the driver was unable to release the accelerator due to a mechanical fault. A total of 80 people were hurt during the accident, and the rest of the threeday show was cancelled as a result of the incident.

ontinuing his review of successfully completed accident claims, Steven Hinchliffe looks at a situation experienced by a reader of Truckstop News that resulted in an award of personal injury compensation. All of the accident victims mentioned in these articles are clients of my firm, Hinchliffes Solicitors. They have kindly given permission for the disclosure of their details, and in particular their real life experiences of incidents resulting in personal injury claims, and the steps taken to make a successful accident compensation claim. All of these clients contacted my firm after seeing our details in Truckstop News. In this article I highlight an accident at work that resulted in a truck driver suffering extensive crush injuries to his right leg. Recovery from the injury was not straight forward, and was not helped by the failure of his employers’ insurers to deal promptly with issues relating to the claim. As with previous articles, the common trend remains the effect on the injured person’s life, and although using the existing process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation. CASE STUDY - ACCIDENT AT WORK In September 2011 we were contacted by Mr R Strong of Abergavenny, who told us that the previous month he was instructed by his employers, Digby Plant Ltd, to collect 2 railway trailers and a railway excavator. He was required to load them onto a low loader that had 2 levels, and had to use the excavator to place the 1st trailer onto the upper level by the headboard. However, it was too long for the upper level, with 1 set of its wheels suspended in the air leaving the trailer resting on its underside. Parliament has recognised the inherent dangers caused by drivers of motor vehicles when using mobile telephones while driving and brought forward specific legislation. There has been an unacceptable increase in the number of vocational licence holders using mobile telephones without a hands free device while driving large goods and passenger carrying vehicles. This practice is unacceptable and presents an undue risk to road safety. Studies have indicated that even the use of hands-free devices can distract a driver to the extent that they may be prevented from applying the requisite care and attention. A report for an offence received from an enforcement agency that a vocational driver has used their mobile telephone while driving without a hands free device in the last three years will result in that driver being called to a hearing before the traffic commissioner. Each case will be decided on its own facts and merits and the presiding traffic commissioner will be keen to ascertain the reason the driver is engaged in the telephone call. In cases where drivers are speaking with their employers or their customers, the traffic commissioner may consider the effect this might have upon the operator’s repute”. So you are likely to be called to a hearing in order to show cause why an order should not be made. The guidelines which a traffic commissioner will be considering are to suspend vocational entitlement for 14 days, 21 days if driving a commercial vehicle, to commence with immediate effect. The common ground for the queries is that all the decisions have involved the loss of a driving entitlement on medical grounds. The purpose of this article is to give a broad overview of some of the issues involved. This is definitely an area of law where you need advice specific to each individual. Decisions regarding removal of driving licence entitlements can be complex and emotive, and any appeal is not to be entered into lightly. Anyone considering an appeal needs a realistic assessment of the prospects of success. If an appeal is unsuccessful, there is a possibility of being responsible for legal fees of the both parties, so I suggest advice is always sought before embarking on an appeal. Also, I suggest that as much information
as possible is communicated to DVLA to explore the possibilities that a decision might be addressed without the need for an appeal. Once the DVLA has made its decision, the reasons will be set out in writing and the licence-holder notified of the appropriate grounds of appeal. Upon receiving such notice, there is the option of asking the DVLA to reconsider its decision. To do so, it would be necessary to be able to produce a favourable medical expert’s opinion that states you are able to drive safely. The guidelines set out in “At a glance guide to the current medical standards of fitness to drive” outline how the DVLA would make a decision, and so any instructed expert should be shown this document. Please note the standards for LGV and PCV licence-holders are much stricter than those for normal domestic use (and are set out

CL Transport – which delivers enough milk on behalf of Arla Foods each week for 61 million cups of tea – has added 100 temperature controlled units from Carrier Transicold UK to its fleet. The family-run company’s latest order includes 60 PIEK-certified Vector 1550 City units, which can operate at a noise level below 60 decibels – the equivalent of a normal conversation. This makes PCL the country’s largest operator of Carrier Transicold PIEKcompliant transport refrigeration technology. “We chose Carrier’s PIEK-certified Vector 1550 City units as both PCL and Arla Foods take environmental responsibility very seriously,” said Shaun Stephenson, director, fleet and compliance, PCL. “The Vector 1550 City unit allows us to minimise the risk of noise disturbance on routes where we deliver to urban and residential areas.” The Vector 1550 City units adhere to Europe’s most stringent noise-abatement standard by reducing the sound emitted by the standard Vector 1550 model by more than 10 decibels, while providing the same key advantages of low fuel consumption, impressive reliability and lightweight design. PIEK standards were established in the Netherlands in 2003 to respond to growing concerns from local government and supermarkets, and stipulate that noise levels

The company collectively makes more than 8000 deliveries nationwide each week, travelling 240,000 km.

All three new drive tyres carry M+S (Mud + Snow) sidewall markings as a sign of enhanced grip and traction during winter. The 295/80 and 315/80 drive tyres also meet the new 3PMSF (3 Peaks Mountain Snow Flake) standard. “Taurus tyres are manufactured in Michelin Group factories within Europe, each meeting stringent environmental and quality management standards,” said Peter Fairlie, group sales director of ATS Euromaster. “This gives customers the reassurance they are buying quality tyres purpose-built for European road and climate conditions.”

HMRC shutters fuel laundering plant
A
laundering plant capable of producing over 9.1 million litres of illicit fuel a year and potentially evading around £5.9 million in taxes and duty has been dismantled by HM Revenue and Customs. Officers from HMRC and police in Northern Ireland searched premises in the Kilnasaggart Road area of South Armagh and discovered the laundering plant inside an agricultural shed. Officers also found more than 10 tonnes of toxic waste at the site. “Every illegal laundering operation typically generates tonnes of toxic waste, involving significant safety and environmental issues,” said Pat Curtis, national oils coordinator for HMRC. “As taxpayers and local ratepayers, not only are we missing out on the stolen tax that ends up the pockets of the criminals, but we are also paying the substantial clean-up and disposal costs.” Officers also seized pumps and other equipment associated with the fuel laundering process, along with two commercial vehicles.

Collett MANs up for heavy lifting
H
eavy transport and abnormal load specialist Collett Transport has taken delivery of another 10 specialist MAN units, taking the firm’s fleet size past the 50 unit mark – and MAN’s presence within it to 85 per cent. At the same time, the Collett Group, which has its headquarters in Halifax, has opened a new Port & Heavy Lifting facility in Grangemouth to supplement its existing facility in Goole. Collett’s latest hardware comprises TGX 8x4 tractor units and rigids: one V8-powered 41.680 8x4 tractor rated at 250 tonnes, two 41.540s at 180 tonnes, two TGX 26.540 6x4 tractors rated at 160 tonnes, and three TGX 26.4480 6x2 mid-lift tractors at 80 tonnes. Two TGS 26.360 tag-axle 6x2 rigids were also delivered, one with a front-mounted crane and one with an extended chassis with rearsteer axle and rear-mounted crane. “By delivering solid, reliable levels of performance, the MAN product proves itself time and time again,” said company MD, David Collett. “We’ve used MANs since 1992 and each successive model has been an improvement on the last. “Over this time, we have developed a close relationship with MAN, and we know we can

chmitz Cargobull has introduced a new pivoting circulation wall for its S.KO COOL reefer trailers which it claims drastically reduces the average cleaning times from approximately 15 minutes, to just one minute. Transporting food requires the highest hygiene standards in the cargo area, and when trailers are being used to carry sensitive goods such as hanging meat, the necessary regulations can only be fulfilled through frequent cleaning immediately after unloading. For some operators carrying multiple loads during a given shift, this can mean the cleaning cycle must be repeated several times per day. Disassembling the standard circulation wall in a reefer trailer takes approximately 15 minutes. But thanks to the new pivoting circulation wall, Schmitz Cargobull said it can reduce this time to roughly one minute for a typical driver. Derek Skinner, technical director at Schmitz Cargobull UK, said: “The faster cleaning process stands to save fleets a significant amount of time. The pivoting circulation wall can be easily opened and shut using a snap

truck driver has used his lorry and impressive skills behind the wheel to save the life of a diabetic man who suffered a seizure while driving in Scotland. According to a report in the Daily Mail, 46-year-old Bob Rennie, who drives for Hebrides Haulage, was travelling south on the A82 in Dunbartonshire when he noticed the car in front of him start swerving erratically. Rennie used the horn of his DAF CF rigid to alert the driver in front and other road-users of the danger, but the Peugeot showed no sign of stopping and continued to weave across the white lines and into oncoming traffic, then back onto the lefthand shoulder – where it narrowly missed colliding with trees lining the road. “At first I wondered if he was drunk,” Rennie told the Daily Mail, “but then I realised it must have been a health issue. “My concern was to make sure no cars overtook and got between me and him, and that everybody in the vicinity was safe.” After following the car for nearly four minutes, Rennie took advantage of a break in oncoming traffic to overtake and position himself in front of the out-of-control car, which he then managed to bring to a stop by braking slowly.
“I don’t know if the driver was going in and out of consciousness, but he obviously became aware that something was in front of him and that made him slow down and stop at the side of the road,” Rennie said. “I jumped out and ran right over to him. He was just sitting there as if he was dazed. He wasn’t aware of what was happening.” After another truck driver called for an ambulance, the car’s elderly driver, who was on holiday with his wife, was given insulin by paramedics who found he had suffered a diabetic seizure while at the wheel. “They said he had low blood sugar,” Rennie continued. “It was a very, very hot day, which didn’t help. “They were a lovely couple, so nice to speak to,” he added. “I stayed with them for about an hour. He was still in the ambulance when I left. The man phoned me later that night from his hotel to say thank you. I hope he is still on the mend. Hampshire cops crack down on bad driving
T
ruck drivers and motorists have been caught on film performing a range of driving offences – such as accessing social media, filling out paperwork and applying make-up while at the wheel – by Hampshire police officers prowling the area’s main road arteries in an unmarked lorry. Officers from the Hampshire Constabulary’s Roads Policing Unit recorded 227 offences during Operation Tramline, in which the police surveyed the actions of motorists from the elevated position of a Scania HGV cab. The five-day operation ran from September 23-27 and focused on drivers travelling along the M27, M3, M4, M40 and A34. In the footage, which has been posted on YouTube, a truck driver is seen brushing his teeth at the wheel – with toothbrush in one hand and bottle of water in the other – while other motorists perform similarly distracting acts – including operating laptops, using mobile phones and reading and sending text messages. “Distracted driving is proven to be a significant factor in many of the collisions on our roads,” said operation co-ordinator Sergeant Paul Diamond. “The vast majority were holding phones in their lap and accessing applications or texting with their hands held low – this is incredibly dangerous both for the motorist and for other road users. “Driving distracted is one of the ‘fatal four’ causes of road deaths and collisions in Hampshire and the Isle of Wight,” he added. “Through innovative use of equipment and technology available to us, we will continue to crack down on this and will repeat Operation

Other dangerous behaviour spotted during the operation included a total of 25 lorry drivers using their phones, with another six being distracted by other means; two van drivers reading newspapers while driving; one person reading a map on the steering wheel; two drivers using iPads (one on the steering wheel) while driving; one driver using a laptop; one van driver seen accessing Facebook on her mobile phone while driving on the M27; 126 motorists using their mobile phones; and 25 people distracted by other means. All drivers were issued with notices that will result in a £100 fine and three points on their licence. Some will be able to negate the points if they elect to attend a driver awareness course. Uptime assured for new Morris Volvo
L
eading recycling and bulk haulage solutions provider Allan Morris Transport is operating the first new Volvo truck to join the company’s Deesidebased 26-strong fleet since 2003. Supplied by local Volvo dealer Thomas Hardie Commercials, the Globetrottercabbed new FH features Volvo’s D13C Euro 5 engine rated at 460 bhp and the twopedal I-Shift automated transmission. The truck is being maintained on a fouryear Volvo Gold contract at Thomas Hardie Commercials’ nearby Deeside workshop. A unique feature of Volvo’s Gold contract is Uptime Assurance. This promises 100 per cent uptime and is made possible thanks to the Telematics Gateway (TGW), which allows the workshop remote access to the truck.
According to Allan Morris managing director Terry Axon, Volvo is currently the only manufacturer offering Uptime Assurance. On fuel performance, Axon reports the FH is achieving in the region of 8.5 mpg. This, he said, puts it towards the top of the company’s fuel usage league table. A hydraulic ‘wet-kit’ is fitted to the tractor unit, which is on steel wheels. Payload, when coupled to its Legras walking-floor bulk trailer, is reported to be 27 tonnes. “Twenty seven tonnes is where we expect it to be,” said Terry Axon. “Due to the nature of some of the materials we transport, such as paper and packaging for recycling, our trucks tend to ‘bulk-out’ before they ‘weigh-out’.”

TC revokes ‘abused’ licence
T
he North East of England traffic commissioner, Kevin Rooney, has revoked the HGV licence held by a Milnsbridge business after finding it had been abused for a number of years. The licence, in the name of John O’Donnell, trading as M O’Donnell & Sons, was terminated immediately following a public inquiry in Leeds. Rooney concluded the misuse of the licence by other parties had to be brought to an immediate end. During an inquiry on October 9, 2013, the industry regulator heard O’Donnell had formed a limited company in 2008, but failed to apply for a new licence, as required. He continued operating using his sole trader licence, despite needing authority in the name of the new business, M O’Donnell & Sons Ltd. Operator licences are not transferrable. However, that company subsequently went into liquidation. O’Donnell then hired his vehicles to another firm – Colne Vale Contractors Ltd – formed by one of the directors of M O’Donnell and Sons Ltd, along with Colin Thwaites. Thwaites had been employed as a transport manager by O’Donnell, although he resigned that post May 2013. The issues came to light after one of the vehicles hired to Colne Vale Contractors Ltd was stopped on May 3, 2013 in Greater Manchester. Checks by VOSA examiners revealed defects on the vehicle, including one

item that was considered safety-critical. A traffic examiner also found the driver, Colin Smith, did not have the appropriate entitlement to drive the vehicle. In addition, the vehicle was displaying a licence disc issued to John O’Donnell, even though it was being operated by Colne Vale Contractors Ltd. At the hearing, Thwaites gave evidence to the commissioner and admitted he had used the licence issued to O’Donnell in ignorance. The regulator concluded Thwaites could and should have prevented the issues that arose, noting he had failed to check Smith’s licence. But the commissioner added he had been impressed with the frankness Thwaites displayed at the hearing. He had also responded promptly to the matters once they had been brought to his attention. The commissioner noted he had made an application for an operator’s licence in the name of Colne Vale Contractors Ltd and granted it permission to run HGVs. Thwaites gave a commitment to complete a refresher course on transport manager duties with one of the industry trade bodies. John O’Donnell did not attend the hearing. “This licence has been abused for a number of years,” Rooney concluded. “The operator may have been able to explain why, but he chose not to appear. I am satisfied the level of abuse is such that I as a regulator have no confidence nor influence over the safety of vehicles being used under the licence.”
Merc reveals new heavy-haulers
ercedes-Benz has unveiled it’s updated Actros-SLT tractor unit – the first heavy-duty tractor on the market that meets Euro 6 emissions standards – and new Arocs-SLT variant. Developed and produced by Molsheimbased Custom Tailored Trucks (CTT), though overseen by Merc’s factory in Wörth, the SLT takes over the mantle of top-of-the-range heavy hauler from the Euro 5 Titan model, which will still be manufactured for non-European and overseas markets in Euro 3-5 varieties. Merc is offering the SLT with the latest version of its 16-speed Powershift 3 automated transmission, programmed with a special Heavy mode designed to pull loads of up to 250 tonnes. A turbo retarder clutch is also fitted as standard, which

functions as a wear-free aid when pulling away, and an effective brake. In terms of power, the new SLT features Merc’s OM 473 Euro 6 in-line six-cylinder engine, rated at 625 bhp (460 kW) and providing 3000 Nm of torque at 1100 rpm. The Actros-SLT comes with air suspension and can be specified with either GigaSpace or BigSpace cabs, while the Arocs-SLT is fitted with steel suspension and can be ordered with BigSpace (2.5 m) or StreamSpace (2.3 m) cab as required. Mercedes-Benz said both the Actros and Arocs SLT models are available to order immediately, with delivery commencing in December. All-wheel drive variants of the Arocs-SLT will start arriving from April next year.

M Downton Ltd has purchased C&H (Hauliers) Ltd, rescuing 180 jobs and saving the £23 million turnover business from liquidation. C&H’s parent company, The Charles Gee Group, went into administration on Monday, October 21. Downton confirmed the deal on Friday, October 25, following negotiations with administrator FRP Advisory, and will take over all of C&H’s operations, effective immediately. Andrew Downton, managing director, CM Downton Ltd, said: “The Downton Group has been looking to expand its business through either acquisition or mergers, and the C&H business was a perfect match. ontinental is expanding its range of trailer tyres to include a tyre with an increased load index designed specifically for regional delivery operations. With a five-tonne load capacity, Continental said its HTR 2 XL 385/65R22.5 with load index 164 is a good option for fleets serving retail chains and food logistics companies who need to deliver all over the country. While a 275/70R22.5 dual fitment is usually used for city operations, the new HTR 2 XL in size 385/65R22.5 is a super single tyre. The high load-carrying tyre features long service life and reduced rolling resistance. This, said the manufacturer, is reflected in noticeable fuel
and cost savings. The firm’s trailer tyre is aimed at increasing fleet efficiency and lowering overall costs due to increased sturdiness, long service life and retreadability. The HTR 2 XL can be used across the UK and Europe in both regional and urban traffic, as well as in long-distance haulage on motorways. The EU tyre label gives the new trailer tyre a B classification for energy efficiency and a C for braking in wet conditions.

Details were scarce when we went to press ahead of the official launch on September 5, but the Swedish manufacturer told Truckstop News the new FHs will be available in both Euro 5 and 6 form, and pack a vast amount of upgrades and improvements. Leading the charge for fuel efficiency is Volvoʼs new I-See function (Truckstop News, issue 301). The system, which works alongside the I-Shift automated transmission, is claimed to cut consumption by five per cent by storing information about the route the truck drives along. “The next time the truck uses the same route, I-See operates the accelerator, gears and brakes to ensure progress is as economical as possible,” said Claes Nilsson, president, Volvo Truck Corporation. An additional five per cent saving in fuel use is possible with Volvo Trucksʼ new Fuel Package. This package encompasses training and monthly assistance – Fuel Advice – and its aim is to cut fuel costs by changing driving styles and increasing knowledge of how to drive for maximum fuel-efficiency. Details were scarce when we went to press ahead of the official launch on September 5, but the Swedish manufacturer told Truckstop News the new FHs will be available in both Euro 5 and 6 form, and pack a vast amount of upgrades and improvements. Leading the charge for fuel efficiency is Volvoʼs new I-See function (Truckstop News, issue 301). The system, which works alongside the I-Shift automated transmission, is claimed to cut consumption by five per cent by storing information about the route the truck drives along. “The next time the truck uses the same route, I-See operates the accelerator, gears and brakes to ensure progress is as economical as possible,” said Claes Nilsson, president, Volvo Truck Corporation. An additional five per cent saving in fuel use is possible with Volvo Trucksʼ new Fuel Package. This package encompasses training and monthly assistance – Fuel Advice – and its aim is to cut fuel costs by changing driving styles and increasing knowledge of how to drive for maximum fuel-efficiency. FTA: Polictians should not dictate training
T
he Freight Transport Association (FTA) has urged Brussels to recognise the freight transport industry is best placed to identify driver training – not politicians – in a response to a consultation from the European Commission on the future of Driver CPC. Within its submitted response to the EC consultation on the Driver Training Directive, the FTA emphasised driver training requirements should be freight industry led, and acknowledged the need for Driver CPC to be improved. However, FTA said many operators are using it to deliver effective, professional training. It stated that adding additional constraints could hinder responsible, professional vehicle operators from training drivers in the knowledge and skills they need to do their job effectively.
James Firth, FTA’s head of road freight and enforcement policy, said: “FTA is mindful that driver training must be right for the individual driver and their requirements. We realise this may not be an easy problem to solve, but do not believe the answer should be ‘one-sizefits-all’, as it usually becomes ‘one-size-fits nobody very well’. “If the specific training content is defined by politicians – either in Brussels or Westminster – we run the risk of every driver investing time and money on redundant training,” Firth added. “For instance, a driver in the retail sector should not be forcibly required to be trained in loading and securing aggregates. “There is certainly a challenge still in engaging drivers fully with DCPC, but insisting upon irrelevant training is a sure-fire way to alienate them further.”
TJ’s Trakker takes charge
I
veco has secured a conquest order from TJ Transport for a Trakker Hi-Land 8x4 rigid tipper – one of the first examples of Iveco’s new Trakker model to enter operation in the UK. Featuring a low-roof sleeper cab, the new Trakker is powered by a 410 bhp, 12.88-litre Cursor 13 engine and has a revised cab design similar to that of the Stralis – but packaged to suit the needs of operators accessing construction sites, landfills and similar off-road locations. The new vehicle is the customer’s first Iveco eight-wheeler and was delivered by local dealer Hendy Van & Truck, and supplied on an Iveco Elements repair and maintenance contract. It is an addition to TJ Transport’s 80-strong fleet which includes rigid tippers, some of which feature crane-mounted bulk material grabs, together with tractor units operating with a mixture of tipper and roll-on roll-off trailers for large scale waste disposal. John Gosling, managing director of TJ Transport, said he considered at least four other manufacturers but decided to go with Iveco. “Primarily we needed a tipper TJ Transport’s new eight-wheeler is one of the first new Trakkers in the UK
that is robust and can easily deal with the demanding nature of our operation, much of which is aggregate delivery and muck away services from construction sites,” he said. “We were very impressed with what Iveco had to offer in terms of product and service back-up and look forward to seeing how the new vehicle performs on and off the road.” The tipper will operate 5.5 days per week with some double-shifting. It is expected to clock up 100,000 km per annum and will be kept in service for at least five years, with all maintenance undertaken through the Iveco dealer network. Operating in the company’s traditional blue and white livery, the new vehicle is mounted with a Wilcox aluminium body and features rear view cameras to ensure maximum safety and precision when reversing. The new tipper is powered by an EEVrated between 1380-1900 rpm, plus 2100 Nm of torque between 900-1380 rpm. This engine features a fixed-geometry turbo and a waste-gate valve, and provides plenty of power and torque for even the most demanding terrain.

Coyle’s up for Andover step-frame Coyle has been dealing with Andover for 20 years

amily-run Coyle Haulage has added a new four-axle Andover Trailers stepframe trailer to its fleet to help deliver a range of heavy road construction equipment throughout the UK. The new step-frame is the eighth piece of equipment owner John Coyle has specified from the Hampshire-based manufacturer, having first ordered an Andover Trailers low-loader in 1993. The bespoke-built SFCL67 trailer features a low-profile neck, 8 inch slideout extensions to the deck, bridge and beavertail, a removable top-deck stop bar, and hydraulic power toe ramps designed to release the toe cable and clamp it into the main ramp so both can be lifted under an overhanging machine. Each ramp is operated by a separate control. The 13.2 m long trailer – worth more than £60,000 – also features two fixed and two steering BPW axles with the rear axle lifting for maximum manoeuvrability, plus BPW air suspension with manual raise and lower control. The specification also includes a pair of heavy-duty hydraulic steady legs located under the beavertail to ensure a stable
platform for loading and unloading on uneven ground, while the floor is constructed of 38 mm hardwood with 3 mm steel underlay welded down in the outer bays to ensure a long working life. The new trailer will operate with a Scania R620 Topline tractor unit and is expected to remain in service at London-based Coyle Haulage for at least eight years. “We’ve been commissioning the team at Andover to build bespoke trailers for our fleet for the last two decades,” said John Coyle. “They have retained our business as the equipment is reliable, durable and built entirely to meet the needs of our business.” To ensure maximum visibility, the trailer features LED rear lights, stalk lights, wide load marker boards, yellow conspicuity markings along both sides and strobe beacons which can be operated from inside the cab. “We’ve been working with Andover for so long they know what we want almost without us having to ask,” Coyle added. “The team really make the whole trailer ordering process easy and we have never been disappointed with one of their products in the 20 years we’ve been doing business together.”
English-only driving tests in 2014
T
he government has announced that driving test candidates will no longer be able to use foreign language voiceovers and interpreters on test from April 2014. Currently, people whose first language is not English or Welsh can request prerecorded voiceovers for the computer-based car and motorcycle theory tests in 19 different foreign languages. Candidates can also use approved interpreters on theory tests and practical tests. But the new move, announced in October by road safety minister Robert Goodwill, follows a public consultation that revealed the majority of respondents supported the withdrawal of all foreign language assistance during testing. “We want to make sure all drivers have the right skills to use our roads safely and responsibly,” said transport secretary, Patrick McLoughlin. “One area where we can help

ensure this is by requiring all test candidates to take the test in English or Welsh, the national languages. “This will help to ensure all new drivers will be able to understand traffic updates or emergency information when they pass their test. It will also help us to reduce the risk of fraud by stopping interpreters from indicating the correct answers to theory test questions.” The Driving Standards Agency (DSA) consulted earlier this year on a series of proposals reviewing the level of foreign language support available to candidates. This was in response to concerns about potential road safety implications and the risk of fraud, as well as the cost of providing translations. The response to the consultation was positive, with more than 70 per cent of respondents supporting the withdrawal of foreign language voiceovers and interpreters on tests. The consultation received close to 2000 responses.

EAR Scotland has invested in a dozen new tippers fitted with Hyva underfloor three-way tipping gears, which allow the trucks to tip their loads off either side of the vehicle as well as from the rear. Working in conjunction with DAF LF55 chassis and steel dropside bodies, the Hyva UMB129 tipping gears offer a high payload capacity and will be used to carry everything from road stone and tarmac to traffic cones and roadsigns. “The tippers we really want are those that are the easiest to operate and most the most economic to own,” said Kevin Parkins, fleet manager for BEAR’s North West Contract. “They also need to combine safety and

ational and international haulier TAS Transport has placed one of the first orders with Renault Trucks for a new Euro 6 Range T tractor unit. The Renault T460 6x2 with sleeper cab will be delivered in January 2014 by Renault Trucks distributor Norfolk Truck and Van. It is the fourth Renault truck to join TAS Transport’s 50-strong, predominantly Mercedes fleet since it took its first Renault Premium in May this year. The truck will come with a two-year R&M contract package and Fuel Eco package, including Optifleet telematics and Optifuel driver training, which Renault is providing free of charge on all new orders placed before the end of 2013.

The new truck will undertake long-distance operations on behalf of the Palletways network. TAS Transport MD, Terry Stevens, said: “Since adding the first Renault to our fleet this year, we have been very impressed with the fuel consumption and have seen an increase in the mpg we are achieving. However, we are even more excited about the fuel returns promised with the new Range T. “With regards to our drivers, we have had nothing but positive feedback from them in regards to the new Premiums, with easy to drive, comfortable sleeper cabs offering a good panoramic view,” he added. “Again, we are looking forward to even greater comfort from the new Range T model, which is extremely spacious and almost a ‘walk-around’ cab.”
Haz Environmental’s new TGS 8x4 is fitted with Whale vacuum tanker kit

est Midlands waste management and recycling company Haz Environmental has taken on a new MAN TGS 32.360 8x4 with specialist vacuum tanker equipment from Whale Tankers. The eight-wheeler, acquired on a lease agreement through MAN Financial Services, joins two MAN 26-tonne 6x2 curtainsiders – with a third due to enter service in January 2014. “We already operate two very good-quality MAN trucks on our fleet,” said managing director, Gary Perks. “From a management point of view, the decision to stick with MAN was an easy one. “However, our drivers ultimately make the final choice on new vehicles. Happily, their unanimous decision fell in favour of MAN. “Image is very important to us too,” he added. “The MAN-Whale combination certainly offers a striking on-road presence, and I’m very happy our customers can see Haz Environmental uses high-quality products.”

TEESIDE TYRE TRIAL PUTS MICHELIN ON TOP

eesport-based Containerships has moved to a Michelin policy for its tractor units after running an inhouse tyre trial comparing the cost per 1000 km between fitments from four different manufacturers. Fleet engineer Gordon Aitchison set up the trial to determine the optimum tyre policy for his 60-strong fleet of 6x2 mid-lifts, and said the results have identified significant annual cost differences of more than 20 per cent between different 295/80R22.5 premium brand tyres. “You have to look at the total value of ownership – not just the purchase price,” Aitchison said. “We ran this trial on our own vehicles, doing regular daily work, and the results were conclusive – fitting Michelin tyres will save us money.” The trial found fitting the latest generation Michelin regional steer tyres would deliver 32 per cent more mileage (an extra 64,326 km) compared with the average of the competitor tyres trialled. The Michelin drive tyres – using a regional tread pattern which has since been superseded – were found to return 38 per cent more mileage (an extra 78,404 km) compared with the average of the competitor brands. “When we evaluate tyre costs, we look at the total casing value,” Aitchison said. “With a steer tyre you are not just investing in a tyre for one life; you are buying a casing which should be capable of being remoulded and used again. If you can feed the drive axle with Remix tyres, it can have
a very positive impact on vehicle operating costs.” The trial saw Containerships running test sets of Michelin X MultiWay 3D XZE steer tyres and XDN2 Grip drive tyres, the latter of which has now been superseded by the X MultiWay 3D XDE to complete the latest Michelin regional tyre offer. Containerships sources its truck tyres from ATS Euromaster in Middlesbrough, which also handles its tyre fitting and servicing requirements. This sees Containerships, Michelin and ATS Euromaster working collectively towards joint tyre management targets which will help to further reduce vehicle operating costs. It involves a mobile ATS Euromaster tyre technician visiting the Containerships depot every Saturday to check pressures, regroove, twin and turn tyres on the rim – helping to maximise tyre life. The Containerships fleet comprises predominantly of Volvo and Mercedes-Benz tractor units covering up to 160,000 km a year. They are used for the movement of containers from port to their final destination, and vice versa, handling cargo between Russia and the Baltic, Europe, UK and Ireland, as well as between North Africa and the Mediterranean. The fleet spends the majority of its time operating at up to 44 tonnes with skeletal trailers, plus some general haulage work with curtainsiders. All of the company’s trailers are supplied on full-service lease agreements which include tyres.

POLICE GET WIND OF BEAN THEFT
A
Scania carrying thousands of tins of baked beans had part of its load stolen while parked up in a lay-by on the A441 at Cookhill, near Redditch, Worcestershire. Thieves cut a large hole in the trailer’s curtains and made off with a total of 6400 tins of Heinz Baked Beans with Sausages, according to West Mercia Police. The incident happened while the driver was asleep in his cab between 8.45 pm on Monday, October 21 and 5.30 am on Tuesday, October 22, “Police are appealing for information, especially about anyone trying to sell large quantities of Heinz baked beans in suspicious circumstances,” a police spokesman said. The product code on the stolen cans is 71517000, with an expiry date of March 31, 2015. The police has asked that anyone with information should contact police on 101 or call Crimestoppers on 0800 555 111.

ADR Network is currently recruiting LGV Class 1 drivers for a new depot in Avonmouth. The depot is operating a brand new fleet of vehicles that are kept in amazing condition.
With some overtime readily available ADR Network drivers in the Bristol area are typically earning £580 per week.
The Biggest Agency in the UK ADR Network is the UK’s largest driving agency specialising in HGV Class 1 and 2 drivers with some 468 drivers based in the South West, a region that is a major hub for ADR Network. exceptions and exclusions that will inevitably restrict your ‘all-risks’ cover. If in any doubt, ask your broker for advice.
A Policies written on an ‘all-risks’ basis do not provide cover against every eventuality and in part it’s for this reason that ‘all risks’ transit cover is now tending to be called ‘full responsibility’ cover. For example, even with ‘all-risks’ cover, there will be conditions, exclusions and policy limits that restrict the cover provided. If the load limit is inadequate, ‘average’ will apply meaning if the limit is for example half of what the consignment was worth, only half the claim will be met. For that reason, you really need to agree contractually with your customers what the maximum value will be for any one consignment and agree the load limit with your insurer accordingly. Cover for consequential losses are typically limited to one or two times the carriage charges relating to the consignment that has been lost or damaged and that cover will be conditional on you having contracted out of liability for consequential losses. Q A little while ago, one of my drivers was a victim of a ‘round-the-corner’ trick. He’d arrived at the gates of the premises where he was due to deliver a consignment, only to be told by a person at the gate that the warehouse was full and that he should unload the consignment literally around the corner and that they would take the pallet in on a forklift truck as soon as they’d re-organised their warehouse. Later in the day, a rather irate customer rang me to ask where the pallet was. That’s when we realised my driver had been conned into off-loading the pallet and that it had since disappeared. The worst part about it was that when I went to claim, my broker told me I wasn’t covered for losses of this type and that this type of cover isn’t available. Can you insure against this type of risk? A Prevention is always better than cure and taking every precaution to avoid crimes of this type is obviously wise. That said, cover for theft by bogus sub-contractors is available from certain insurers. If your current broker is unable to arrange this type

Q We’ve recently had a problem with a key customer of ours failing to pay us for the haulage services that we have been providing. The problem has been resolved but if this ever happens again, are we allowed to actually hold on to a consignment until we get payment?
Q My broker recently wanted to switch my cover to a new, cheaper insurer, but before switching me, she pointed out that the new insurer’s policy says that if a vehicle is driven in a way likely to affect safe driving or control, there won’t be any cover. That being the case, I decided to stick with my existing insurer. I could have saved a fair amount of premium if I had switched. Does that clause really mean that if for example my truck was to collide with the vehicle in front, the insurer could say I was driving unsafely because I must have been driving too close to the vehicle in front, or not concentrating properly, and not pay the claim?
A Firstly, make sure you are using appropriate conditions of carriage. RHA members who use the Association’s RHA Conditions of Carriage 2009 version can exercise both a particular lien on the consignment and a general lien for sums unpaid on any invoice. These Conditions state that if the lien is not satisfied within a reasonable time, he carrier may sell the consignment, or part of it and apply the proceeds towards any sums unpaid and expenses, including the cost of insurance, relating to the retention and sale of the consignment. That said, liens remain a contentious area of law and the legal position can be less than straightforward. Our advice would be to ask a specialist transit lawyer for advice before exercising any rights of lien that you may have.
A There is a risk that an exclusion worded in this manner could be used to avoid various claims such as the type of incident that you have described. Switching to the cheapest insurer isn’t always the wisest course of action and your decision to remain with your existing insurer may be a sound decision.
Q I’m an owner driver. Most of my work comes from working as a sub-contractor for a couple of large companies. One of those main contractors requires us to indemnify them as the principal in case a claim relating to work we’ve carried out is pursued against them as the primary contractor.
