Arocs ticks all the boxes

M

ercedes-Benz has launched its new Arocs range of vehicles which offer what it calls a ‘previously unparalleled’ variety of vehicle models to match customer requirements in the diversified construction sector. The new dump trucks, all-wheel drive dump trucks, cement mixers,

semitrailer tractors and dropsider chassis vehicles are available as two, three and four-axle models with 16 power output levels, ranging from 175 kW (238 bhp) to 460 kW (625 bhp). From the outset, all engines have been designed to meet the future Euro 6 emissions standard. All engines are available with a powerful, turbocharged

decompression engine brake. The driver can activate it in three stages via a steering column switch. Due to the considerably larger displacement of 15.6 litres, the engine brake on the OM 473 significantly outperforms its renowned, powerful counterpart on the OM 471: it achieves up to 460 kW (625 bhp). All Arocs variants are fitted as standard with Mercedes PowerShift 3 transmissions with eight, 12 or optionally 16 gears. A manual double H-gearshift with pneumatic shift assistance is also available, in ninespeed and three optimally tuned 16-speed variations. Merc is also offering a choice of seven cabs in a total of 14 variants. The range comprises 2.3 m wide cabs featuring short or medium lengths, and a variety of heights to accommodate ease of access and different engine tunnels. Within the range, Merc has also developed the Arocs Loader and Arocs Grounder. Design of the Arocs Loader

was focused on reducing kerb weight. The result provides payload-optimised 4x2 semitrailer tractor units which are among the lightest vehicles in the construction sector, as well as 8x4/4 cement mixers with a 32-tonne maximum permissible weight. With a particularly low kerb weight of a maximum of 9250 kg, Merc stated these vehicles are able to supply 8 m3 of ready-mixed concrete on every trip. The Arocs Grounder is designed for operating in extremely difficult conditions, such

as in quarries or on building sites. Fitted with a host of technical measures, such as a longitudinal member thickness of 9 mm, the Grounder is robust and also features high levels of stability and a high load-carrying capacity. Both the Loader and Grounder belong to a broad collection of vehicles comprising the Arocs family, which range from a maximum gross vehicle weight of 18 tonnes in the case of the twoaxle models, through to 41 tonnes for the off-road four-axle models making up the Grounder series.

But Volvo stressed far more lives would be saved if more people used their seat belts – something not even half of the truck drivers on European roads do. Ninety-five per cent of the truck drivers who died in road accidents were not wearing seat belts, Volvo said. “As long as people are injured in road accidents, we will continue to pursue higher safety levels. Firstly by making our trucks safer for drivers and other road users, and secondly by spreading knowhow and by impacting patterns of behaviour and persuading more people to use the seat belt,” Almqvist said. The report also revealed drinking and driving is not one of the major causes of road accidents involving truck drivers. Only 0.5 per cent of truck drivers

involved in serious accidents were under the influence of alcohol. The corresponding figure for accidents involving passenger cars varies between 15 and 20 per cent. Heavy trucks are involved in 17 per cent of all fatal accidents and seven per cent of accidents resulting in personal injuries. The majority of accidents resulting in truck driver injuries are singlevehicle incidents in which the truck drives off the road. More than half of all serious accidents with trucks consist of collisions between cars and trucks. “Access to facts about accidents is immensely valuable for our ongoing safety work, helping us make the right priorities in our product development. For instance, we have further enhanced safety levels in our latest truck models with a range of support systems that improve visibility, alert the driver or focus the driver’s attention if something is not right,” Almqvist concluded.

he Military Work Placement Scheme launched in November to fund companies to provide work placements for ex-Armed Forces personnel has proven a success, according to Skills for Logistics. SfL said the current ratio of 30 per cent job offers to placement represents a significant endorsement of the government-funded scheme by employers. These jobs range from senior director positions through operations management to driving. “We are seeing fantastic enthusiasm for the MWPS following its formal launch,” said Mick Jackson, CEO of Skills for Logistics. “We have received enormous support from employers with over 2000 registers placements. “Companies include Kuehne + Nagel, TNT, Norbert Dentressangle, Boots and DHL. Employers clearly want to get involved in the scheme and have access to the excellent resource offered by men and women leaving the Armed Forces. There is demand for work placement opportunities across the whole spectrum of logistics roles, from warehousing to driving, traffic office to import/export. Jackson said that alongside the large companies wishing to get involved in the scheme, SfL was also building on work carried out in local areas with local hauliers and logistics operations. “The logistics sector as a whole has a requirement for skilled labour, particularly to fill acute driver shortages,” he

The report was produced by the Accident Research Team at Volvo Trucks and is based on its own investigations of accidents, as well as data obtained from various national and European authorities. It describes why accidents with trucks occur, their sequence and what can be done to reduce the risk of accidents and their consequences. “Ninety per cent of all truck accidents stem entirely or partly from the human factor – for instance, when one or more of the drivers of the involved vehicles are distracted or misjudge their speed,” said Carl Johan Almqvist, traffic and product safety director at Volvo Trucks. Between journeys, guests also enjoyed ‘hot laps’ of the Oulton Park circuit in two-seater racing cars piloted by professional drivers. Star Letter We run a haulage business based in the Bristol area that has been unfortunate enough to have suffered a fine for having a duty of care – and I would like to bring to people’s attention just how much it can cost to care. We made a delivery to a company on the Trinity Distribution Park in Felixstowe back in November. We made our delivery on a semi-lowloader trailer, which involved the use of a bolster to transport part of the load level with the neck of the trailer. We off-loaded as normal and squared away the trailer and kit. Unfortunately, as our driver drove away from site, he noticed the ratchet strap securing the bolster to the trailer had released itself. My driver pulled over immediately to re-secure the bolster before leaving Trinity Distribution Park and entering the public highway. No sooner had he stopped, a van from a company called Proserve pulled up and the van driver said: “You can’t stop here, mate.” My driver said sorry, but he needed to re-secure the bolster to the trailer as the strap had come loose, and did not want it to come off the trailer on their property or on the public highway as it could cause damage to the road surface – or even worse, cause an accident and delays. The bolster weighs around 200 kg, so it’s not

TRAMPING TERM The word ‘tramping’ is being misused throughout the transport industry, as it should be used to describe the activities of some lorry drivers. Tramping has replaced the term ‘night out’, so whomever started to call nights out tramping obviously thinks it’s called this because one wakes up in his cab having spent the night like a tramp.

We can tell this from our tracker report, which we did offer to send to Proserve and Bidwells, who are the landlords of Trinity Distribution Park in Felixstowe. In the four minutes, Proserve had photographed our vehicle – and you can clearly see our driver on the back of our trailer securing the bolster to the trailer, and not just sat in the cab drinking tea. He had stopped for the legitimate reason of having a duty of care to other road users. For being conscientious of other people’s property and

other members of public, the driver/company was fined £300. This equates to £75 a minute. This is more like private highway robbery. We had tried to explain the situation to Proserve and Bidwells, and had offered to send the report from our tracking system that he had only stopped for four minutes to secure the strap, but were informed the fine still had to be paid. The actual transport meaning of the word ‘tramping’ refers to drivers who delivered the actual vehicle, and made their own way back – often using his trade plates to let other drivers know he was a tramper. If you look up the word ‘tramper’, it means ‘ramble, hike or walk’ – which is what a tramper driver does. It does not mean someone who sleeps overnight in his cab. The latest edition in Patrick W Dyer’s At Work series of books looking at specific truck manufacturers and models, this hardback looks in detail at the development of Seddon’s premium commercial vehicles over their 13 years of production from 1975-88. Over its 144 pages, the book presents a series of over 200 stunning photographs (many of which sourced from the Seddon Atkinson Historic Archive) of the 400, 401 and 4-11 models. The 400 was the first of Seddon Atkinson’s new truck range, and was created as Britain’s answer to the European commercial vehicles (led by Volvo and Scania) that had gained favour with British operators and were threatening the domestic market. The model achieved much success, and the 401, launched in 1981, built on its predecessor’s strengths and included a number of new

features that were suggested by drivers including a reworked and restyled cab. In 1986, the company updated its entire range and the new trucks were designated with a -11 suffix. However, most changes to the 4-11 (as compared to the 401) were cosmetic, leaving internal components and layouts largely unaltered - though it did pack a powerful Cummins Super E400 engine capable of 388 bhp and 1200 lbf.ft of torque at 1300 rpm. All of the accident victims mentioned in these articles are clients of my firm, Hinchliffes Solicitors. They have kindly given permission for the disclosure of their details, and in particular their real life experiences of incidents resulting in personal injury claims, and the steps taken to make a successful accident compensation claim. All of these clients contacted my firm after seeing our details in Truckstop News. In this article I highlight an accident that occurred in a HGV tractor and trailer park, the main cause of which was a lack of adequate lighting. I am sure that insufficient lighting in such areas is not uncommon, but when this is coupled with poor ground conditions such as potholes, debris on the floor, low walls and fences, this makes the risk of injury much greater. As with previous articles, the common trend remains the effect on the injured person’s life, and although using the existing process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation. Please remember that significant changes to personal injury law come into effect on 1 April 2013. After this date it is likely that solicitors will no longer be able to offer a service where clients keep 100% of their compensation. The Government’s ill considered action means that the guilty party (or more usually their insurers) will in future only have to pay a fraction of the injured person’s legal costs. As a result most successful claimants will lose up to 25% of their compensation as they will have to pay part of their own solicitor’s costs. Therefore, if you have had an accident and are unsure whether to make a claim, act now.

Driver’s Hours Compliance In this month’s column, I hope to clarify some points on drivers’ hours compliance which have been raised since last month’s column. In relation to daily rest being taken while part of a ferry or train journey, the Regulations do make a provision for this. This still seems to be causing some confusion, so to ensure this is crystal clear, I will look at the exact wording of the legislation. At the outset, the legislation states the objectives of the legislation. This states the Regulation aims to improve social conditions for employees who are covered by it, as well as to improve general road safety. It does so mainly by means of the provisions pertaining to maximum driving times per day, per week and per period of two consecutive weeks, the provision which obliges drivers to take a regular weekly rest period at least once per two consecutive weeks, and the provisions which prescribe that under no circumstances should a daily rest period be less than an uninterrupted period of nine hours. Since those provisions guarantee

adequate rest, and also taking into account experience with enforcement practices during the past years, a system of compensation for reduced daily rest periods is no longer necessary. In relation to daily rest, the following definitions are made clear: ‘rest’ means any uninterrupted period during which a driver may freely dispose of his time; (g) ‘daily rest period’ means the daily period during which a driver may freely dispose of his time and covers a ‘regular daily rest period’ and a ‘reduced daily rest period‘. ‘Regular daily rest period’ means any period of rest of at least 11 hours. Alternatively, this regular daily rest period may be taken in two periods, the first of which must be an uninterrupted period of at least three hours and the second an uninterrupted period of at least nine hours. ‘Reduced daily rest period’ means any period of rest of at least nine hours, but less than 11 hours. Under Article 8 of Regulation 561/2006, it states that: 1 A driver shall take daily and weekly rest periods.

Parliament has recognised the inherent dangers caused by drivers of motor vehicles when using mobile telephones while driving and brought forward specific legislation. There has been an unacceptable increase in the number of vocational licence holders using mobile telephones without a hands free device while driving large goods and passenger carrying vehicles. This practice is unacceptable and presents an undue risk to road safety. Studies have indicated that even the use of hands-free devices can distract a driver to the extent that they may be prevented from applying the requisite care and attention. A report for an offence received from an enforcement agency that a vocational driver has used their mobile telephone while driving without a hands free device in the last three years will result in that driver being called to a hearing before the traffic commissioner. Each case will be decided on its own facts and merits and the presiding traffic commissioner will be keen to ascertain the reason the driver is engaged in the telephone call. In cases where drivers are speaking with their employers or their customers, the traffic commissioner may consider the effect this might have upon the operator’s repute”. The report also outlined 12 recommendations, including road collisions connected to building sites should be reported as if they were workplace accidents, and that contractors set out safe delivery routes which avoid narrow roads, risky junctions and schools. he very first new Volvo FH has taken to the roads. Owner JeanPierre Ducournau received the keys in a ceremony at the Volvo Truck Center in the French town of Roissy-enFrance, just outside Paris. “We’re delighted and proud to be the first haulage firm to get to drive the new truck,” said Ducournau, who runs Transports Ducournau with his sons. “The new Volvo FH is as attractive inside as it is on the outside. I was really surprised by its comfort and the impressive visibility from behind the wheel.” Ducournau had been waiting for his new truck since September, when he secured the winning bid of €150,000 (£130,000) via a Volvo Trucks charity auction on eBay. “It’s a really great truck, but then I wasn’t expecting anything other than top quality,” Ducournau said. Ducournau said he found the new Volvo FH’s road-holding to be particularly impressive. “It’s undoubtedly the very best available in a heavy commercial vehicle. Even though this is a truck, it has the same comfort as a limousine,” he commented.

Almost all the trucks in the Transports Ducournau fleet are Volvos, and over the years he has operated many different Volvo trucks - from an F89 purchased in 1974 to today’s modern FH. Today his current fleet totals over 300 vehicles. “I’m both happy and touched. This is the truck the entire industry has been waiting for so eagerly; it represents the future for the truck industry,” said Jean-Noël Thénault, president Volvo Trucks in France. The new truck will primarily cover longdistance routes between Alpes-Maritimes and Var in Southern France, and haul cargo in the Paris region In March, Ducournau will travel to South Africa to hand over the money from the auction to Star for Life. The organisation runs an educational programme aiming to stop the spread of HIV among young people.

eady mix concrete supplier Free Flow Concrete Ltd has taken delivery of its first Renault truck – a Renault Kerax 430.32 8x4 with Optidriver+ automated gearbox. The Euro 5 EEV truck was supplied through Renault Trucks Essex and joins the company’s fleet of three Scanias. The new Renault Kerax is fitted with a Reimer R950 mobile batching plant, supplied and fitted by Mastercrete Ltd. It will be used to supply and mix a range of concrete for local building projects in the Worcestershire area, including foundations, garage bases, flooring, commercial and agricultural requirements. Free Flow Concrete owner, Simon Lang, said: “Historically we have always had Scanias, but we were offered the chance to trial a demo Renault Kerax tipper. LWC DRINKS TOASTS 45TH ISUZU

T

he latest Isuzu 11-tonne rigid to go into service with drinks distribution company LWC Drinks marks the 45th new Isuzu in the Manchesterbased company’s 105-strong commercial vehicle fleet. The vehicle, already in operation, is delivering kegs, cases, wines and spirits to customers nationwide. LWC Drinks Ltd is a long-standing customer of Isuzu Truck, having purchased its first vehicle back in 2004. The company said Isuzu’s proven reputation for unrivalled payload and vehicle reliability has ensured the marque has consistently featured in the drink company’s fleet over the past eight years. According to LWC Drinks’ transport manager, Dave Barnes: “We aim to get the maximum amount out of all our distribution vehicles, in terms of a reliable performance over a long vehicle life. The Isuzus have been outstanding performers for sure. In fact, one of our first Isuzus is still running in the fleet after eight years of extremely hard toil.”

LWC currently operates 10 Isuzu Forward F110.210 11-tonne rigids, all fitted with curtainside bodies and rear tail lifts. This is in addition to 35 Isuzu Forward N75.190 7.5-tonne curtainsiders. Isuzu Truck’s dealer, Warrington Vehicle Centre, supplied the latest vehicles. For its intensive distribution operation, payload and product reliability are essential factors behind the company’s decision to specify Isuzu for its fleet. “We get a five-tonne payload from the 11-tonners and 3.3 tonnes of payload from the 7.5-tonners, with the vehicles generally fully laden at the start of their journeys,” Barnes continued. “Isuzu’s product reliability is undoubtedly impressive, as we very rarely have any problems with them. They are rugged trucks and totally reliable, which is what we look for when specifying any new vehicles in our fleet.”

CRASH-FOR-CASH SCAMMER JAILED

A

criminal gang member who deliberately caused a crash with a truck to make fraudulent insurance claims has been jailed. Tariq Mehmood was sentenced to 12 months in prison at Harrow Crown Court on Friday, January 25 for conspiracy to defraud and dangerous driving. Ansab Rizwan and Ihtisham Gondal received suspended sentences and 180 hours of unpaid work each for their parts in the scam, while Nasser Khan received a 12-month community order and 100 hours’ unpaid work. CCTV footage from the truck’s in-cab camera helped expose the scam, with footage showing a black Volkswagen Golf working in tandem with a blue Mercedes to induce the crash. Travelling in convoy, the Golf – a decoy car – brakes hard and late to turn into a side road. The Mercedes that is following then performs an emergency stop, which causes a rear-end shunt by the HGV. Towergate Insurance, the truck operator’s insurer, referred the case and CCTV footage to the police. A joint investigation by the Metropolitan Police’s Operation Catcher team and the Insurance Fraud Bureau (IFB) linked members of the criminal gang to induced crashes in Bedfordshire, and also identified an associated claims management company, which has since ceased trading. Ben Fletcher, head of operations at the IFB, said: “Crash-for-cash is a menace to our society. Fraudsters are putting innocent motorists in danger by deliberately causing crashes across the UK. This type of fraud is also costing the insurance industry almost £400 million every year, which in turn inflates premiums for honest policyholders. “Working alongside the Metropolitan Police, the IFB helped to build evidence against the

four men convicted today. The sentences passed are testament to the insurance industry’s determination to help the police catch and convict fraudsters. “The IFB continues to up the ante on organised criminal gangs targeting the insurance industry. By 2014, the Bureau is forecasted to manage fraud investigations worth in excess of £160 million, which could translate to over 90 police operations. Our objective is to stop these scams at the source by taking out the organisers.” DI Dave Hindmarsh of the Metropolitan Police said: “This case demonstrates the organised nature of these criminals, further highlighting fraudsters do not respect the geographical boundaries of police services and will often travel some distance to commit these offences. “Today’s sentences should serve as a reminder to anyone considering fraud, that the Metropolitan Police’s Operation Catcher team work in partnership with many organisations to catch and prosecute offenders.” Full footage of the scam, as caught by the in-cab camera, can be viewed on YouTube at http://tinyurl.com/c3nxt5j

LICENCE REVOKED OVER SAFETY CONCERNS

A

North East haulage firm is to be stopped from running HGVs after the region’s traffic commissioner, Kevin Rooney, ruled it had engaged in a “systematic abuse” of its licence authority. The haulage industry regulator told Mirfield-based Taz Distribution Ltd it will lose its licence to operate HGVs from March 2, 2013 in a written account of his findings following a public inquiry. Mr Rooney also made an order to disqualify director Mehmud Ahmed and the company from holding another licence in England, Scotland and Wales for six months. The directions came after VOSA investigated the company’s vehicle safety and driver standards. A vehicle examiner from VOSA told Mr Rooney the operator had failed to make all of the relevant safety inspection paperwork for its HGVs available. He also judged daily defect reporting carried out by drivers on vehicles – to visually identify any faults – was poor. In addition, the examiner reported on an incident in November 2012 when a company vehicle lost two wheels. The VOSA officer

told Mr Rooney a further two wheels on the vehicle also had 10 out of 10 wheelnuts loose. Mr Ahmed had told VOSA the vehicle had been hired in just a few days earlier, but the traffic commissioner dismissed this claim as the vehicle was in full livery and displaying the company’s operator licensing disc. The operator’s representative asked Mr Rooney to consider how a firm reacted to a wheel loss incident was important. He presented evidence from an external contractor that in this case it was not possible to say why the wheel became detached. But in his written decision, the traffic commissioner set out the potential consequences of such an incident. “The saving grace is that, when the wheels did come off, they hit only a crash barrier and not a person, for they could easily have been killed,” Rooney said. At an initial hearing in October 2012, concerns were raised about the company having run more vehicles than it was allowed to. Under questioning from the traffic commissioner, director Mehmud Ahmed said the business was only operating the five

vehicles it had been given permission to run. However, at a second hearing following further investigations by VOSA, Mr Ahmed admitted what he had said at the first hearing did not appear to be true, though he noted extra vehicles were not used deliberately. A VOSA traffic examiner identified the company had used one vehicle over its limit on 11 days. He also found over 50,000 km was unaccounted for as a result of missing driver records, and it was highly likely extra vehicles had been used on many more occasions. The TC noted a conviction for one of the company’s drivers for two counts of not making a record of his driving duty, and that the company had already appeared at a public inquiry, when it originally applied for the licence. In his evidence, Mr Ahmed told the TC he was willing to take advice from professionals and had sent all of his drivers on mandatory industry training, more of which was due to take place in February. He had also engaged an external consultant to carry out audits on his

business to make sure it was compliant. The wheel loss incident had horrified him, and he wanted to do things right. But in his written decision, Rooney criticised Mr Ahmed’s approach to his operator’s licence. “Mr Ahmed responds when things go wrong, but he does not make the necessary systemic improvements for the changes he makes to stick and for improvement to be sustained. Nothing has changed. I’m left to conclude nothing will, and this is not an operator I can trust to be compliant. “This is an operation that needs to come to a halt.” The traffic commissioner also concluded Mr Ahmed’s justification for using extra vehicles was not plausible and constituted a “systematic abuse of the licence authority”. “Whether or not he had spare vehicles sat in the yard, I find it highly unlikely he had spare drivers sat alongside them. Putting an extra articulated vehicle on the road needs a considerable degree of organisation. That it could happen as an accident more than 11 times in the space of a year beggars belief,” he concluded.

Temporary fixes have just escalated the problem over the years, and our highways have now got more holes than Swiss cheese. “Unless more permanent repair materials and methods are adopted immediately, Britain may never again be able to get through a winter without having to contend with a Third World road network.” Potholes are created when moisture seeps into cracks in the street surface and freezes, cracking open the road when it freezes and expands. Last year was the secondwettest since records began in 1910, with an average of 1330.7 mm falling on the UK. Combined with heavy snowfall and freezing temperatures, UK weather has created the ‘perfect pothole storm’, destined to tear apart the second-rate Stone Mastic Asphalt now used as standard for road repairs.

RENAULT TO HALL FOR HOLLOWAY

est Midlands-based haulage company Joseph Holloway Ltd has invested in 12 new Renault Premium 460.25 6x2 tractor units in the last 12 months, all supplied by Renault Trucks Midlands. Following the success of these vehicles on the road, the company has a further two Renault Premiums on order and is looking to replace its entire 25-strong Scania fleet with Renault. The Renault Premiums are all pulling tipping bodies for the bulk haulage of recycling materials, scrap metals and waste on behalf of customers across the UK.

Joseph Holloway MD, Matt Holloway, said: “When looking to update our fleet last year, we trialled a Renault Premium demonstrator. Our drivers were pleased with the comfort and handling of the Premium and fuel economy was also impressive. The Renault Premiums on our fleet continue to run at about 6-7.5 mpg, which is a good return for a tipper truck. “Half our fleet of 25 trucks are now Renault and, following the successful performance we have seen over the last year, we are looking to eventually run an all-Renault fleet.” Joseph Holloway is planning to replace its 25-strong Scania fleet with Renaults

EXHIBITION PUTS THE ‘ART’ IN STOBART

I

mages of the iconic Eddie Stobart truck fleet will form an artistic exhibit for the first time in a photographic installation named Fleet by artist Dmitri Galitzine. Part of Galitzine’s God Save the Village Green exhibition, Fleet represents his first solo outing in London, and is running from February 8 to March 16 at Camden’s Cob Gallery. The exhibition attempts to reveal an overlooked England outside the country’s major cities. “I was interested in understanding how a haulage company could captivate a nation,” Galitzine said. “There is a romance attached to the Eddie Stobart brand that engages people from childhood.” In producing Fleet, Galitzine collated an archive of over 3000 photographs taken by the growing community of ‘Stobart Spotters’ haulage enthusiasts. ‘Spotters’ were invited to upload their photographs to a dedicated website and, in doing so, collate a comprehensive archive of ‘the fleet of 2011’.

TRAILER SALES ON THE DECLINE

r ansport consulting group CLEAR’s latest Trailer Market Forecast Report for Western Europe has revealed sales of heavy goods trailers fell by 6.3 per cent in 2012, while heavy truck demand fell by more than nine per cent. The fall was almost universal – only Norway and Denmark had increased trailer demand. The worst performing markets were Italy, Portugal and Spain, which saw falls of between 20 and 40 per cent. CLEAR said the economic outlook for the next five years has

been downgraded every year, which will inevitably have an impact on long-term trailer demand. According to the report, GDP growth for the region is forecast at only 0.2 per cent in 2013, but will average 1.5 per cent in the three subsequent years when investment growth will average 3.2 per cent. CLEAR said there will be growth in trailer demand in the second half of 2013, followed by more solid growth through to 2016. The report includes data on the demand for road transport in the Big 7 West European economies,

From 2013 to 2016, trailer demand will grow in every country in almost every year. CLEAR’s Gary Beecroft said: “By the third quarter, the worst of the current dip in trailer demand will be behind us. But a return to the trailer demand levels of 2007/8 is unlikely in this decade.”

Warnings are issued when maximum time limits draw near. At the end of each set period, a report file is generated. The driver only has to press one of four icons: driving, available, short break or long break. This will start the stopwatch, and at the end of each activity, the driver presses the same button again to stop the time and touch another to indicate a new activity is underway. The data recorded is then transferred to a virtual notebook which lists the activity along with its start time, end time and how long it lasted. At the end of the day or assignment, drivers can make corrections if any errors were made, and the data can then be emailed to fleet managers. Time Book is available to download now for free from the Apple App Store and Google Play.

FRENCH BREATHALYSER FINES DELAYED

T

he French minister of interior has announced an indefinite delay on the fines for motorists – including truck drivers and motorcyclists – who do not carry a breathalyser kit with them in their vehicle. Previously, it was decided fines would be issued from March 1, 2013. Currently, all drivers in France, including motorcyclists, are required to carry a breathalyser kit and the €11 fine for not carrying a breathalyser would have been applicable to all road users, except for those on mopeds. Anyone driving in France is already required to carry a warning triangle and a fluorescent safety vest to use in an emergency. Additionally, UK motorists and motorcyclists must display a GB plate.

B&Q bags biomethane fleet

E

uropean Bio-LNG provider Gasrec has announced a new partnership with B&Q, one of the largest home improvement retailers in the UK. Gasrec is helping B&Q to lead the way in creating a greener fleet with the arrival of 50 dual-fuel lorries powered by biomethane – natural gas produced by waste. The eco-friendly fuel used to power the lorries comprises 60 per cent biomethane, the natural green source of renewable energy produced from organic matter such as household food waste and sewage. The use of this natural gas on the UK’s roads helps to reduce pollution and cut waste. B&Q is committed to reducing its CO2 emissions from business travel and haulage to 50 per cent by 2023. Currently B&Q is tracking at 36 per cent, and the company said it is well on track to meet the deadline ahead of time. B&Q’s new Dual Stock Holding Distribution Facility in Swindon is among a number of initiatives driving this achievement. This new site allows B&Q to hold the same product in the north and south of the UK, greatly reducing the number of miles travelled to store by its lorries. B&Q has introduced 50 new dual-fuel tractor units at the facility following a successful trial last year. The 25 Mercedes-Benz and 25 Volvo units are powered by Gasrec’s Bio-LNG – a proprietary blend of liquid biomethane (LBM) and liquified natural gas (LNG). To reduce travel carbon emissions by a further 11 per cent, the home improvement retailer has now received a planning consent to invest in its own biomethane gas filling station at the Swindon Distribution Centre. The facility

will be supplied, serviced and maintained by Gasrec. Commenting on the partnership, Gasrec’s commercial development manager Doug Leaf said: “B&Q has taken the lead in utilising what is now a widely available fuel in the UK which delivers savings in both cash and carbon terms. The combination of B&Q’s desire to achieve its environmental goals while saving money with Gasrec’s low carbon, future-proof fuel solution is now becoming best practice amongst other retailers.”

B&Q’s retail logistics service manager Michelle Thomas said: “We’re pleased to announce the introduction of 50 dual fuel lorries, which is helping us meet our 2023 deadline to cut transport carbon emissions ahead of time. “Other initiatives include 500 new double-decker lorries and the replacement of 78 smaller energy-efficient delivery vans. We’re also strengthening our focus on transporting more of our products by rail to save on road miles.”

Volvo Trucks has lifted the lid on its all-new FH series of heavy trucks, designed with the driver in mind and a focus on fuel economy.

Details were scarce when we went to press ahead of the official launch on September 5, but the Swedish manufacturer told Truckstop News the new FHs will be available in both Euro 5 and 6 form, and pack a vast amount of upgrades and improvements. Leading the charge for fuel efficiency is Volvoʼs new I-See function (Truckstop News, issue 301). The system, which works alongside the I-Shift automated transmission, is claimed to cut consumption by five per cent by storing information about the route the truck drives along. “The next time the truck uses the same route, I-See operates the accelerator, gears and brakes to ensure progress is as economical as possible,” said Claes Nilsson, president, Volvo Truck Corporation. An additional five per cent saving in fuel use is possible with Volvo Trucksʼ new Fuel Package. This package encompasses training and monthly assistance – Fuel Advice – and its aim is to cut fuel costs by changing driving styles and increasing knowledge of how to drive for maximum fuel-efficiency. Safety is high on the agenda, An all-new cab structure features more upright A-pillars, which give the cab an additional 1 m3 of interior space. This means an extra 300 litres (10.5 cu ft) of storage capacity, as well as greater comfort on board.“The cab is optimised both for work and leisure time,” Nilsson said. “A better bed, integrated parking cooler, new lighting and low noise levels among other features, all increase the chance of pleasant relaxation and a good nightʼs sleep, which in turn means drivers are less tired and more alert.” Production of the Volvo FH will start in spring 2013 for the European market.

Q I run a small business comprising three trucks used for haulage. I obviously buy Public Liability insurance. Our indemnity limit is £2m. Do you feel that’s an adequate limit or should we think about increasing it? A

In the event of a serious incident, £2m may not prove to be adequate. Even the smallest company engaged in straightforward work should be thinking about buying at least £5m cover. A larger company may well feel it needs substantially greater cover than that. Ask your broker for advice relevant to your own particular business and circumstances.

Q One of my drivers was recently prosecuted for dangerous driving after the load he was carrying in a curtain-side trailer moved while he was driving. He thinks he did all he could do to make sure the load didn’t move. Obviously that wasn’t enough. Obviously we don’t ever want this to happen again. What advice can you offer? A The HSE publish an excellent guide on curtain-side load safety that can be viewed on-line or down-loaded from their website. The Road Haulage Association has also just published a secure loading guide that members can access via the RHA website. Q We run a small transport company. Our broker has tried to sell us Directors’ and Officers’ Liability insurance cover. As all the shareholders are directors, we’ve said we don’t need the cover because we as directors are never going to accuse ourselves of committing a ‘wrongful act’. Do you feel our decision is prudent or are we missing something?

A In our opinion, it isn’t just allegations made by shareholders that should concern you. Legislation associated with running a company has increased considerably over the last few years. Government departments might decide to take action against or prosecute directors for alleged breaches of legislation such as the Companies Act, Health & Safety at Work Act, the Insolvency Act, the Data Protection Act, the Company Directors’ Disqualification Act, the Company Securities (Insider Dealing) Act or EU directives or regulations. Liability might also arise, for example, through employees alleging breaches of employment law, for example unfair or wrongful dismissal, sexual or racial discrimination, or harassment, through creditors taking action for debt default or ‘wrongful trading’, or through competitors or customers alleging anti-competitive practices. Being a small company, it’s relatively easy for regulators, investigators or third parties to apportion blame back to a decision taken by a director, a decision for which you might be held personally liable meaning your personal assets could be at risk. Given the above, our advice as your insurance broker would be to buy the cover and to additionally consider purchasing corporate liability cover that several Directors’ and Officers’ Liability insurers offer. Ask your broker for advice. Q

blaming the damage on our trees and is holding us responsible. The trees are growing by themselves. How can we be held responsible for the damage?

settlement that they are proposing be used to reinstate the building. Do they have the right to insist that the money be used to repair the damaged building?

A Damage caused by the encroachment of tree roots is an actionable nuisance and claims can be legitimately brought under statute, on the grounds of negligence, or as a private nuisance. The claimant has to show that they have an interest in the subject matter of the claim (for example, that they are the owner of the house that’s suffering from subsidence), that there has been tree root encroachment, that damage has actually been caused by the encroaching roots, and that it would have been foreseeable that encroachment and resulting damage could occur. Our advice would be to place the matter into the hands of your public liability insurer as soon as possible and let them get involved in defending any legal action that’s being taken against you.

A Yes, they do have that right. One of the surviving components of the Fires Prevention (Metropolis) Act 1774 is the right of an insurance company to insist that monies be used to reinstate a building rather than being banked as a cash lump sum that can be used for other purposes.
