UPN PUSHES INTO EUROPE

P

allet network operator UPN has launched a new range of European palletised freight services. The new service will allow 65 UPN depots to supply a full range of services to 26 European countries, all from within the UPN system. All countries will be served direct from UPN’s hub at Fradley Park, Lichfield. Key to the launch is a new webbased portal, developed in-house by UPN, which links all the depots in real-time and provides instant pricing, quotes and online ordering, making consignments simple to manage and far less time-consuming to process. The new systems even include full auto postcode look-ups for every destination, which the company hopes will completely eliminate mistakes from the process. “UPN has focused very hard on the UK over the last decade and is growing at twice the speed of the rest of the sector,” said UPN sales director, Andrew Spencer. “But we never stand still and have been researching the European market for the last couple of years, before deciding what we needed to do for our depots and our customers to fundamentally improve their customer experience. “We have looked at what the other networks offer, as it was essential we had to offer something significantly better if we were to make in-roads quickly and ensure we maintain our success rates of over 99 per cent.”

UPN’s research highlighted a key issue facing depots – namely, the time taken to specify and price European freight deliveries was too great, relative to the income it generated. In some cases, UPN depots offered the service as a loss leader to keep a loyal customer. Once this key issue was identified, the main effort was from IT to specify and build a back-end system that could collate large amounts of data and calculate detailed quotes in seconds. Using the new system, UPN depots just login online and input freight details for any European destination. A detailed quote is built by the system in seconds and it

can be emailed automatically to the customer. By delivering such massive time savings, UPN can set new price points for European freight. The company said this will open the doors for smaller manufacturers and online sellers, giving them access to new markets and opportunities. Major suppliers have always had good access to Europe and can negotiate good rates. Now, with the UPN model, medium and small enterprises can start to trade across borders and can send smaller consignments across Europe costeffectively and safe in the knowledge their freight will arrive. UPN’s new service is designed to make sending pallets to Europe a quick and easy process

MILESTONE DRIVER GOES THE DISTANCE

A

Grocontinental driver has reached an impressive milestone of 40 years and four million miles on the road. Sixty-year-old Brian Evans joined the company in 1973 at the age of 20 and has witnessed unprecedented changes in the transport industry during his long career. He puts his success down to adapting to new technology and driving regulations. “I’ve always had the view that you go with the flow, or get out!” Brian said. Regularly spending four nights a week away from home as a continental driver, Brian joined the company when his dad, Sam, approached owner Ray Grocott to find his son a job. “My dad saw Ray at the weekly cattle auction and asked him whether he would give me a chance. I started as a yard lad and then trained to be a driver when I was 21. Ray always liked things just right, but he would always roll up his sleeves and help out in the yard.” Brian’s career has taken him all over Europe – and he was also involved in Grocontinental’s trips to Eastern Europe to deliver aid to poverty-stricken families in Romania in the 1980s. The trip demanded four days on the road: “We visited orphanages in Romania and the things I saw

there will remain with me forever. Anything we had with us, we just gave away. I remember giving a little girl a packet of crisps, and 50 young children came from nowhere and swarmed around her.” Brian is delighted with the high-tech vehicle he now drives, but highlights his early days on the road weren’t quite as luxurious. “Today we’ve got the best of the best vehicles with great equipment including comfortable beds, air conditioning and microwaves.

“The vehicle I drove at the start of my time as a driver had one small bunk and no air-conditioning. On our trips to Spain in temperatures approaching 90 degrees Fahrenheit, we had to create our own cab air-conditioning. This consisted of filling two five-gallon drums up with water and sticking them in the temperature-controlled trailers we were pulling. We’d then wait for the water to freeze, then carry the drums into the cabs so they would cool the air a bit so we could get a good night’s sleep. “When we left the yard each Sunday night ready for our long trips, Ray Grocott would always come to see us off. All the drivers had CB radios then to keep in touch. No mobile phones in those days!” To celebrate his 40-year milestone, the directors of Grocontinental presented Brian with a commemorative watch, a VIP trip around the DAF factory in Preston, and a book featuring photographs of his career. He also recently took delivery of a new DAF truck that features a special plaque denoting his 40 years on the road with the company. Speaking about Brian’s achievement, Ray Grocott, Grocontinental’s chairman, said: “Brian’s record is to be massively

Arora was sentenced to a term of eight months’ imprisonment for each offence, running concurrently, at Ipswich Magistrates Court on August 9, 2012. At a hearing into his conduct as a professional driver last month, the traffic commissioner examined evidence presented by the Vehicle and Operator Services Agency (VOSA). A traffic examiner from the enforcement body told the TC his investigation into Arora’s driving duties began after a police encounter with the driver in August 2010. After inspecting his tachographs, the VOSA officer concluded Arora had used another driver’s name to conceal his own excessive hours and insufficient rest. Under EU regulations, the maximum daily driving time is nine hours, which can be increased to 10 hours twice a week. On one occasion, which the traffic commissioner

highlighted in his decision, Arora drove for 18 hours and 20 minutes within a 24-hour period. During his evidence, Arora told the regulator he was “anything and everything” to do with the company he worked for, Ocean Xpress Logistics Ltd. Although his wife was listed as the firm’s director, Arora oversaw the running of vehicles under the licence and was listed as the company’s secretary. He admitted to the TC that he knew his actions had been wrong, but had felt under pressure to recoup losses following a period of absence from the business to attend to personal matters. The prison sentence, Arora added, taught him a lesson. He had also made changes to the business since being released, including employing a new director and transport manager. The TC acknowledged those points and a positive reference from the National Offender Management Service, but concluded the offences, which were committed over a period of four months, represented serious misconduct as a professional driver. As a result, he had to take action and order a period of disqualification. “I realise this will deprive Mr Arora of his current employment. But he made the conscious decision to falsify his tachograph records and to continue to do so over a considerable period of time, knowing he was putting others as well as himself in danger by these actions,” the TC said.

SCANIA STREAMLINES NEW RANGE

cania has revealed its new Streamline range of G- and R-series longhaulage trucks that have been optimised for low fuel consumption and feature new low-drag looks and full air deflector kits. The Swedish commercial vehicle manufacturer has also unveiled a new version of its Opticruise automated transmission, which features a choice of performance modes – including a new Economy mode, fully integrated with Scania Active Prediction, to maximise fuel savings. Scania is also offering potential fuel savings of up to eight per cent for longhaul trucks with its range of new, more efficient second-generation Euro 6 engines. Corresponding savings for Euro 3/4/5 are up to five per cent. Henrik Henriksson, executive vice president in charge of sales and marketing at Scania, said: “Scania has invested a lot of ingenuity and know-how in perfecting the truck range for Euro 6, and we are very pleased with the results. “Scania’s long-standing focus on fuel economy pays off handsomely and our customers can be confident we do our utmost to keep them competitive in the transport business.” Lars Stenqvist, senior vice president 1

Star Letter The pressure on the driver of a large vehicle to get to his destination before a compulsory rest period is due could distract him from being a safe driver to a similar extent as using a mobile telephone. The driver may get engrossed in engineering ways to save time, and in doing so may be distracted from the primary task in hand. The threat of the penalties involved if he contravenes the driving time regs (eg monetary fines, licence endorsements, loss of licence, loss of employment/livelihood, prison sentence etc), would all be looming in his mind, making it difficult for him to concentrate. If a contravention did take place, the fear of detection would remain with him for up to 12 months, as a driver’s hours inspection could still render him accountable. Driving a large vehicle is a complex task in today’s busy traffic environment and requires total concentration to drive safely and economically, without trying to get to a certain place within a certain time with

All the safety benefits of driver’s hours being expounded by government and road safety organisations may not contribute as much to road safety as is being claimed, but in many instances could have quite the reverse effect. Licence issues

I thought I would share this, although I guess it will not affect too many people. Last year in August, I completed my fifth and final DCPC module. By November I had still not received my DCPC card, so contacted the DVLA. It passed me onto the DSA, which it seems deals with the DCPC. The DSA told me the reason I had not been sent a card was that I still had a paper driving licence, and did not have a photo card licence. I was annoyed nobody had told me the reason for not sending it out, and was told to receive my card I needed to change my licence for a photo card one, as my DCPC card needed to have a photo on it. I went back to the DVLA and asked about changing licences, and was told it could be done online, and there was no need to send a photo in as it could be taken from my passport photo. I then asked the obvious question: If the DVLA can get my photo from my passport to issue a Driver Card, why couldn’t the DSA? The answer was: “That’s just the way it’s done!” I have never seen the need to change my old paper licence, and I never had a problem when producing it to people such as the police – and that includes all of Europe, Scandinavia and Russia. I also object to the fact that

once I have paid to get a card licence, it will need renewing every five years, at more cost to myself, but my paper licence does not run out until 2038. It may seem petty, but I would like to hang onto my paper licence as long as possible; at least until I am told that legally I have to change it. I even presumed in 2009, when I surrendered my licence to get speeding points put on it, that it would come back as a card licence; but it didn’t. So if it is good enough for the police in every country I travel in, and the law courts in UK, why change it at cost to myself? I have appealed to the DVLA/ DSA and stated that when I took my DCPC modules, I was not told at any point I would not be issued a card, nor have I seen that written anywhere in any publication or on the DVLA website. They replied that to receive a card, I would have to hold a photo card licence. No exceptions. So my question is this: Do I need a DCPC card? After all, I have completed the required 35 hours of ‘training’, and that is logged on the DVLA system. When you get stopped by the police/ VOSA, the information they need regarding licence etc is held on computer now, so won’t they be able to look up if I have done my 35 hours’ ‘training’ in an instant? Any help on this would be

First up, over 60 European cities have been modeled (with countries including England, Belgium, Italy, the Netherlands, Germany and France for starters, complete with famous landmarks and structures), along with thousands of miles of real and well-known road networks. The graphics also look superb - but crucially, behind the gloss resides a very good game mechanic. Players start out as an employee for a haulier, and are tasked with moving fairly simple loads from point to point using a fleet truck. As you progress, your skills increase and you can earn more money by taking on more difficult cargoes and journeys, until eventually you have enough dosh to buy your own truck and start out on your own. At this point the game expands massively, as you can now spec up your vehicle (most

of the main manufacturers are represented, including Scania, Volvo, MAN and Renault) with a host of performance or cosmetic upgrades. Over time, your business will expand and you can hire additional drivers, expand your depot and buy more trucks to rake in even more profits. It’s addictive stuff, to be sure - but the best part is the simulated driving. The trucks are modelled in great detail and respond well, and the feeling of successfully threading your rig through the simulated towns, cities and countryside without coming a cropper with the (sometimes busy) traffic is rewarding. The title even features fully functioning GPS, plus an excellent in-game MP3 player so you can listen to your own tunes on the road. Brilliantly, it also lets drivers listen to internet radio while at the wheel via a built-in tuner - so you can still listen to Pop Master on Radio 2 while cruising along the motorway. Be warned, though before you know it, you’ll have been playing for hours. Rating: «««««

WATER DEAL FOR ROBINSON RENAULTS

ast Yorkshirebased Robinson Contract Services Ltd has invested in six new Renault Premium Lander 430.32 8x4 bulk tippers to service a new contract awarded to the company by Yorkshire Water. The vehicles, a mix of low-roof and highroof sleeper cabs, were supplied through Renault Trucks dealer Thompson Commercials Hull and join a 12-strong, predominantly Renault fleet. The new Renault Landers have been fitted with Weightlifter 32 m3 plank-sided bulk tippers with airlocking tail-doors and Harsh K110 under-floor tipping gear. Robinson Contract Services provides recycling services for the whole of the Yorkshire Water region, which sees the new Renault Landers hauling over 350,000 tonnes of biosolid products per year. In addition, the vehicles also transport Robinson Contract Services’ own quarry materials, such as lime and aggregates, as well as agricultural fertilisers. As with previous articles, the common trend remains the effect on the injured person’s life, and although using the existing process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation. WHAT IS THE LAW? The Provision and Use of Work Equipment Regulations 1998 are designed to prevent injury to workers caused by defective work equipment. All employers must ensure that work equipment is safe for the use intended, and that regular maintenance and repairs are done to keep it in a safe condition. Parliament has recognised the inherent dangers caused by drivers of motor vehicles when using mobile telephones while driving and brought forward specific legislation. There has been an unacceptable increase in the number of vocational licence holders using mobile telephones without a hands free device while driving large goods and passenger carrying vehicles. This practice is unacceptable and presents an undue risk to road safety. Studies have indicated that even the use of hands-free devices can distract a driver to the extent that they may be prevented from applying the requisite care and attention. A report for an offence received from an enforcement agency that a vocational driver has used their mobile telephone while driving without a hands free device in the last three years will result in that driver being called to a hearing before the traffic commissioner. Each case will be decided on its own facts and merits and the presiding traffic commissioner will be keen to ascertain the reason the driver is engaged in the telephone call. In cases where drivers are speaking with their employers or their customers, the traffic commissioner may consider the effect this might have upon the operator’s repute”. I was asked to provide some information about international driving. The first request was to clarify whether, if a driver is banned from driving in Britain, will that also apply to Ireland? The second query was in relation to letters of attestation for sickness etc. In respect of the first query, the process is called ‘mutual recognition’. Mutual recognition of driving disqualifications came into effect between the UK and Northern Ireland on October 11, 2004 and was extended to include the Isle of Man on May 23, 2005. From January 28, 2010 a similarly significant development came into force, this time concerning mutual recognition between the UK (comprising England, Scotland, Wales and Northern Ireland) and the Republic of Ireland; the purpose being to keep disqualified drivers off UK and Republic of Ireland roads. Under the agreement, a UK resident driver disqualified for

serious motoring offences in the Republic of Ireland will no longer escape punishment when they return home, as they will be disqualified in the UK. Similarly, a Republic of Ireland resident driver disqualified for serious motoring offences in the UK will no longer escape punishment when they return home, as they will be disqualified in the Republic of Ireland. The objective to be achieved will ensure disqualified drivers are not able to escape their disqualification, and will ensure dangerous drivers are kept off the roads. The agreement has its foundations in the 1998 European Convention on driving disqualifications. The Convention provides for six agreed kinds of conduct which will be internationally recognised for the purposes of driving disqualification. The Convention automatically comes into force across all Member States only when all original signatory

n a move to significantly reduce lead times for a range of waste and construction vehicles, Volvo Trucks is working in partnership with four key bodybuilders to provide selected vehicles complete with bodywork. After a successful initial scheme with Thompsons, Volvo has extended its programme so customers can now opt for an FMX 8x4 fitted with a Thompson Loadmaster steel tipper, an FMX with a Boweld Taperlite steel body, an FL 18-tonner with Hyva skip-loader or an FM equipped with a Boughton Engineering Hooklift. In a little over a year, three new Volvo FMX eight-wheelers have joined the tipper fleet of Glasgow-based J&M Murdoch, and in each case the company has been able to take full advantage of Volvo’s ‘ex-stock’ availability of fully bodied vehicles. “In our business, we need to be able to react quickly to new opportunities,” said director Andrew Murdoch. “This in turn means that when we want new trucks, we want them as quickly as possible. With the Volvo key bodybuilder programme, we can get a new tipper on the road in about 10 days, rather than the standard order to delivery time of around three months. FIRST BEVAN/SC RIGID REEFERS HIT THE ROAD

ent-based CVME Truck Rental is running the first two rigid reefers built by Bevan Group in co-operation with Schmitz Cargobull. The 18-tonne chassis cabs have temperature-controlled 7.5 m bodies and are now working for one of CVME Truck Rental’s leading customers – a national high-street department store chain. The bodies were assembled at Bevan’s production facility in Oldbury, West Midlands, using designs, components and materials supplied by Schmitz Cargobull – including unique features such as bolted and galvanised sub-frames and high-performance FERROPLAST panels. The bodies are fitted with singletemperature refrigeration units, but have moving bulkheads with thermostatic fans that allow for dual-temperature operation. The trucks are also equipped with temperature recorders and 1.5-tonne tuckaway tail lifts. Schmitz Cargobull is best known in the UK for its refrigerated semi-trailer product line, while Bevan’s expertise is in the manufacture and marketing of all types of dry freight bodywork. The co-operation between the two companies offers operators of temperaturecontrolled distribution fleets the guarantee of high-quality rigid reefer bodies backed up by high-quality aftercare. The proven Schmitz Cargobull design attributes, coupled with Bevan’s attention to detail, premium build quality and rapid turnaround times, mean customers are guaranteed a first-rate service. i s Royal Highness the Prince of Orange officially started production of the new DAF XF on Wednesday, April 3 at commercial vehicle manufacturer’s factory in Eindhoven, the Netherlands. The new truck, developed to meet Euro 6 emissions standards, represents an investment by DAF of around €1bn to develop an entirely new Euro 6 vehicle range and to prepare its production facilities in Eindhoven and Westerlo in Belgium for the new generation of trucks. Euro 6 comes into force in the European Union on January 1, 2014. Compared with the current Euro 5 standard, the new legislation requires nitrogen oxide (NOx) emissions be reduced by a further 77 per cent, while soot particle emissions must be cut by 66 per cent. The new emissions legislation was a main driver for DAF to develop a completely new vehicle series of which the XF, the new flagship model designed for long-distance transport, has now officially entered production. “We are incredibly honoured that His Royal Highness officially started the production of the new DAF XF,” said Harrie Schippers, president of DAF Trucks NV. “Developing a brand-new generation of market-leading Euro 6 vehicles and preparing our production facilities for this

new generation is the largest project in our company’s history. “The visit of the Prince of Orange is a wonderful recognition for all of the 8000 DAF employees involved in the Euro 6 project, both in the Netherlands and abroad. The visit beautifully coincided with the fact that exactly 85 years ago, Hub van Doorne laid the foundations for our current company.”

ridgestone has added a dedicated trailer product to its economical truck tyre range in the form of the new ECOPIA H-TRAILER 001, which has been designed to achieve increased fuel savings in highway operations. Bridgestone said the new tyre combines the levels of durability, wear, handling and retreadability of its predecessor, the R109 Ecopia, while also providing substantially lower rolling resistance, and enhanced grip and braking response in wet-weather conditions. By incorporating Bridgestone’s exclusive NanoPro-Tech compound which reduces energy loss, the ECOPIA H-TRAILER 001 has improved rolling resistance without compromising other tyre performance areas such as drive traction, wet grip and mileage. The tyre also features a waved belt, which increases casing stability and durability to allow for higher load capability and casing retreadability. Bridgestone said independent road tests showed ECOPIA H-STEER 001 and ECOPIA H-DRIVE 001 provide 18.9 and 26.5 per cent lower rolling resistance respectively than the previous ECOPIA series, leading to 4.4 per cent lower fuel consumption. Together with the ECOPIA H-TRAILER 001, Bridgestone said highway operators could save up to five per cent of fuel with the

combination of the new trailer tyre with the ECOPIA H-STEER 001 and ECOPIA H-DRIVE 001 compared to the previous ECOPIA series. “Thanks to an optimum balance between rolling resistance and mileage durability, the new ECOPIA tyres are the answer for fleets that want to reduce operating costs, both in fuel reduction and for lowering the cost per kilometre,” said Harald Van Ooteghem, senior manager marketing planning, Bridgestone Europe.

Boyle directors fined & jailed

T

wo former directors of a transport company have been ordered to pay £1,835,793 by HH Judge Hughes following a Proceeds of Crime Act (POCA) hearing at Carlisle Crown Court. On March 25, 2013, 67-year-old Patrick James Boyle and 38-year-old Mark Anthony Boyle, who are both from Newry, Northern Ireland and former directors of Boyle Transport Limited, were found to have benefitted from their criminality to the sum of £10,016,810. On May 2, 2012 Patrick Boyle and Mark Boyle were handed two-year and 18-month sentences respectively at Carlisle Crown Court, after they pleaded guilty to conspiring with drivers to make the false tachograph records on February 18, 2011.

After a year-long investigation, it was revealed each digital tachograph owned by the company had been interfered with and the drivers had, in fact, been driving up to 22 hours per day (the law states the maximum should be 10 per day) and failing to take their lawful breaks. Heather Cruickshank, VOSA’s operations director, said: “Operators and drivers should be in no doubt that if they choose to work outside the law, there will be serious financial consequences – as this case highlights. “VOSA’s number one priority is road safety, and our investigators will always seek to take robust action against those who risk the lives of other road users through arrogance or just blatantly ignoring the rules.”

The company, which was established in Caerphilly in 1993, provides a full range of services to commercial vehicle operators including repair, maintenance

and a 24-hour breakdown and recovery service. There is also an ATF lane at the new premises, providing pre-booked MoT testing by VOSA inspectors. It also provides service and maintenance across South Wales and southern England for transport refrigeration unit maker Carrier Transicold. Managing director Mark Lovering said: “We’ve been working with Iveco for 10 years now, covering the area as an authorised repairer. “Ultimately, we had the connections and the understanding of the Welsh market it was looking for. Now we’ll be selling the full range of award-winning Iveco vehicles and providing spare parts and repairs too from our complex in Bedwas, which is just 10 minutes from the M4 and the A470 and easily reached from all over South and Mid Wales,” he concluded.

ne of the UK’s leading textile rental providers is cleaning up with a new 7.5-tonne Fuso Canter that’s being double-shifted to do the work of two previous vehicles. Fenland Laundries of Skegness, Lincolnshire is using the Canter 7C18 to make trunking runs to and from Sunderland at night, and local deliveries and collections during the day. Fitted with a GRP box body with side door by Lincoln Commercial Bodies and a 1000 kg capacity DEL tail-lift, the truck works for the company’s Micronclean division, which provides ‘cleanroom’ garments to clients in the pharmaceutical and micro-electronics industries. Fenland Laundries is so impressed with its latest vehicle that it has already placed an order for a further three identical units. Group transport & logistics manager James Bell said: “We make a regular night-time trunk from our main pharmaceutical-grade laundry plant in Skegness to a depot in Birtley, near Sunderland.

“This work was previously undertaken by another 7.5-tonner, but it was bigger than we needed. The Canter, by contrast, is perfect for this job. It’s relatively compact for a vehicle in this weight category, and this means that as well as being highly manoeuvrable, it’s also very cost-effective to operate. Although Fenland Laundries commissioned the Canter for this trunking role, the operator quickly spotted an opportunity to gain extra productivity from its latest acquisition. “The fact it’s not too big meant we could also use it during the day to do the work of one of our vans,” Bell continued. “A traditional 7.5-tonner would struggle to access some of the tight locations to which we deliver, but the Canter has no such problems. “We’ve therefore been able to remove a rented van that was working at full capacity and struggling somewhat anyway, and instead assign its work to the Canter as well. The result is a more efficient use of our fleet assets.”

Eastern trailer demand on the up

A

new forecast report issued by consultant group CLEAR shows heavy trailer demand in Eastern Europe fell by 4.7 per cent in 2012 – though this was a better outcome than was anticipated halfway through 2012. In particular, Turkey and Poland had stronger second halves to the year. But the picture is far from uniform, with some countries outperforming expectations whereas others are stuck in the doldrums. A variety of market drivers are operating in the region. According to CLEAR, the sluggishness of the West European economy is affecting exports from the East. Some countries are suffering from the hangover arising from the 2009 recession. Others expanded so rapidly in the period from 2004 to 2008 that they have enough equipment to meet the demand for transport. Political instability is also affecting consumer and business confidence in some markets. Gary Beecroft, managing director of CLEAR, said: “Despite the 2009 recession

and the weakness of trailer demand in 2012, Eastern European is forecast to return to the pre-crisis level of demand seen in 2008. The size of the trailer parc has increased every year since the 1990s.” Croatia, the Czech Republic, Hungary and Slovenia are forecast to have GDP growth well below the regional average over the five years to 2017 covered by the report. Of these countries, the Czech Republic will exhibit reasonable trailer market growth during the forecast period, having sunk to such a low level by 2010. The out-performing countries in terms of GDP growth will be Russia and Turkey. These two will provide most of the growth and most of sales of trailers in the region. Poland and Ukraine will be the other most significant sources of growth in trailer demand. Even in some countries that are underperforming economically, trailer registrations are increasing due to the demand for international transport to, from and through the country, even if national transport demand is stagnating or falling.

Q I have some lifting machinery that needs statutory inspection, which is arranged through my insurance broker. I recently found out some defects have been reported to the Health & Safety Executive. I‘m furious with our broker that the firm they selected disclosed information to another party without our consent. Our broker says that’s normal if serious defects are found. We think it’s a breach of confidence. Before we take this further, what’s your understanding as regards this issue? A Inspections are carried out to make sure equipment is safe to be used. If an inspection identifies defects that make the equipment potentially unsafe, then a copy of the report has to be provided to the relevant enforcing authorities; it is not a matter of discretion or discussion. That being the case, the firm carrying out the inspection was absolutely right to report the defects to the HSE. Q We currently buy ‘all-risks’ full-responsibility goods in transit cover as we don’t use conditions of carriage. There was a claim recently involving a load being badly damaged in a crash. The load was worth around £100,000. Half the consignment was damaged and we submitted a claim for £50,000. We thought we’d be covered as our policy has a load limit of £50,000 but instead, our insurer has applied ‘average’ and has said that as the load limit was set at only half what the consignment was worth, they’re only paying half the claim, so just £25,000. That leaves us £25,000 short of what our customer is expecting from us by way of a settlement for the damage. Our broker says this is a fair and correct

settlement. What’s your advice as regards re-arranging our cover?

A Your insurer appears to be offering the same settlement as any other insurer would offer in similar circumstances. What this highlights is the danger of not using conditions of carriage and instead relying solely on ‘all-risks’ cover. From a conditions-of-carriage perspective, even if you don’t use the likes of RHA Conditions, then at the very least you should be contracting out of liability for consequential losses (as these won’t be picked up under your ‘all-risks’ cover) and incorporating into a contract a limit any one consignment that dovetails with your insurance cover. Our advice from a cover perspective would be to use, assuming you’re an RHA member, the RHA Conditions of Carriage and then if your customer wants you to insure for an amount in excess of the standard £1300 per tonne limit under RHA Conditions, to arrange hauliers’ liability transit cover with an appropriately increased per tonne limit. Q We employ half a dozen

drivers. Whenever we recruit a driver, we check their licences and tell them that if they ever get a conviction for a driving offence, they must tell us. Recently we discovered by chance that one of our drivers was convicted for a serious driving offence involving his own car, but he never told us meaning we could have had a serious problem if he’d been involved in a crash when driving one of our trucks. What do you recommend we do to avoid this type of problem?

What is meant by periodical is open to debate; some say at least every six months. What we recommend is that companies use the likes of The Licence Bureau who provide a driving licence verification service which simplifies and reduces administration for you whilst at the same time providing the security of checking the driver by directly accessing licencing or other authorities’ records. Q From time to time, when a regular driver is away on holiday or if we’re very busy, we use a couple of friends with LGV licences to help us out. Are those friends likely to be automatically covered under our motor fleet policy? A Only those persons or classes of persons detailed on your certificate of insurance and / or schedule of insurance are authorised to drive your vehicles. Particular care is required if, for example, your policy restricts use to drivers between the ages of 25 and 65 with at least two years relevant experience. Be aware that drivers’ age restrictions are not shown on certificates of

motor insurance. Instead, they are shown in the policy wording or schedule. If you require cover for anyone not currently authorised, your insurer must first be advised so that appropriate cover can be arranged. That of course means disclosing any accidents and/or convictions that they may have experienced. Our advice would be to treat those friends in exactly the same way as you would treat your regular drivers from an insurance disclosure and occupational road risk perspective. That way, as and when you need to use their services, you know exactly where you stand from an insurance perspective.
