Gov cracks down on bad drivers C areless drivers who put other road users at risk face onthe-spot penalties under new measures announced in June by road safety minister Stephen Hammond.

The changes are set to be enforced from July will give the police powers to issue fixed penalty notices for careless driving, giving them greater flexibility in dealing with less serious careless driving offences – such as tailgating or middle-lane hogging – and freeing them from resource-intensive court processes.

The fixed penalty will also enable the police to offer educational training as an alternative to endorsement.

Drivers will still be able to appeal any decision in court.

Existing fixed penalty levels for most motoring offences – including using a mobile phone at the wheel and not wearing a seatbelt – will rise to £100 to bring them into line with the penalties for similar non-motoring fixed penalties.

Stephen Hammond said: “Careless drivers are a menace and their negligence puts innocent people’s lives at risk. That is why we are making it easier for the police to tackle problem drivers by allowing them to immediately issue a fixed penalty notice rather than needing to take every offender to court.

“We are also increasing penalties for a range of driving offences to a level which reflects their seriousness and which will ensure they are consistent with other similar penalty offences.”

The crackdown on mobile phone use while at the wheel has been particularly welcomed by the AA. Edmund King, AA president, said: “It is worrying that three quarters of drivers see others using mobile phones behind the wheel on some or most journeys. This epidemic of hand-held mobile phone use while driving has already cost lives and our members have demanded

ith the current football season draws to a close, East Midlands Renault Trucks dealer RH Commercial Vehicles (RHCV) has announced it is supporting an innovative community initiative to prepare for the start of the next season.

RHCV recently helped deliver some unusual new equipment to Notts County Football Club, which also appeared on the TV. Students from Nottingham University created new lighting rigs from recycled material to encourage grass growth for problem areas of the pitch at Notts County’s ground Meadow Lane.

As part of this community initiative, Nottinghamshire police supplied highly specialised lamps Renault Trucks dealer RHCV delivered specialised lighting rigs to help the Notts County football team’s pitch recover

which had been seized in cannabis raids. Local firms supplied free workspace to be constructed, and a golf club supplied wheels for the rigs.

These new lighting rigs, which effectively produce a false sunlight and encourage grass growth, should see a dramatic improvement in the level of remedial work that the groundstaff are able to carry out on the pitch during the forthcoming season.

Paul Pearson, RHCV commercial director, said: “We are a local, familyrun business and so doing our part to help in this project can only help to serve the wider community. We were more than happy to lend a hand in this endeavour.”

The students produced four lighting rigs in total – two with

retractable arms that will serve large parts of the pitch, and two smaller builds that will be used primarily to encourage grass growth in the goalmouth areas of the Meadow Lane playing surface.

Wear on the pitch, particularly in the area in front of the Derek Pavis Stand, has been an on-going issue for Notts and several ideas have been tried in the past to alleviate the problem.

Stadium manager Greg Smith said of the new lighting rigs: “We’d really like to thank RHCV for their help in delivering these huge rigs. It’s been a great project for me to work on, with some brilliant individuals and it’s inspiring that there are people out there in Nottingham to help support the club.”

However, the Freight Transport Association has called on government to issue clear, transparent guidance to police forces

in identifying careless driving. While the FTA said it supports the increase in fixed penalty values in line with accumulated inflation, it also expressed concern the changes had been left for so long with sudden increases so as to catch up with inflation.

Malcolm Bingham, FTA’s head of policy for roads, said: “While calculating inflation over a 12-15 year period is a mathematical issue, it becomes difficult to convince the public the large increases are in line with inflation. We therefore would support a better system of review of penalties, say, on a two-yearly basis.”

The fixed penalty for careless driving will be £100 with three points on the driver’s licence. The most serious examples will continue to go through court, where offenders may face higher penalties. There are no changes to penalty levels for parking offences.

Charity ride off to flying start

team of motorcyclists is embarking on a 3400mile circuit of Great Britain to raise funds for the Helicopter Emergency Medical Service (HEMS).

With an average of around 45 per cent of air ambulance call-outs being to attend road traffic accidents, the service is of particular importance to roadusers – and the bike riders are hoping to gain support from the nation’s truck drivers to help them reach their goal of £32,000 raised for the charity helicopter network.

Tour organiser Phillip Summerfield said: “We are asking people to consider supporting our efforts to raise funds and awareness of the air ambulance services that provide vital emergency medical assistance for every person, in every part of the country.

“These charities are not supported in any way by the government or National Lottery funding, and rely entirely on charitable donations to stay in operation. And at a cost of around £1000 to £1700 per mission, and £1.3 to £3 million per year to keep a single HEMS unit in operation,

these charities need sustained support from the general public.

“This is why we wanted to set up the fundraising site so that donors can select their preferred service in any part of the country. However, through this event it would be nice to think we have managed to raise awareness of the scale of HEMS operations in Great Britain.”

The tour kicks off on Saturday, June 22 from East Midlands Airport and will take the riders anti-clockwise around England, Scotland and Wales to visit 20 charities across 30 bases, two hospital helipads, one hospital pad under construction (including two current landing sites) and three Scottish NHS bases (working in conjunction with SCAA). The route will also visit Land’s End and John o’ Groats, and is due to finish back at EMA on Friday, July 5 after completing a full circuit of the country in 14 days.

ongested roads across England are to be tackled with £165 million of funding, transport secretary Patrick McLoughlin has announced.

The statement marks the second tranche of funding from the £190 million Local Pinch Point Fund, first announced in December 2012. A further 62 schemes have now won department funding, bringing the total number of schemes financed by the fund to 72. Combined with local contributions, the total investment rises to more than £300 million.

The successful schemes include improvements and upgrades to vital roads and bridges, new access routes and enhancements to address congestion at local traffic hotspots. Many of the schemes will help enhance provision for buses, as well as improving facilities for cycling and walking.

“This government is taking action on both jobs and growth,” McLoughlin said. “The schemes we have announced are designed to target key bottlenecks around the country, making life easier for the thousands of motorists and businesses who use the local road network every day.

“Investing in these schemes shows the government is serious about accelerating growth where it is needed most. These schemes have the potential to help create more than 100,000 jobs and around 100,000 new homes. I look forward to seeing works underway as soon as possible.”

ritain’s roads could see a cut in sign clutter if they were to adopt simple join-the-dots, colour-coded route marks, according to the Road Safety Markings Association (RSMA).

New marking technology means permanent or temporary markings can be laid for just a few hundred pounds – replacing unsightly forests of signs and providing clear information on roads and pavement instead.

While permanent markings provide attractive alternative signage for tourist attractions, temporary markings, using a resin that can be softened with a mild detergent and then removed with a low-pressure water spray, are ideal for one-off events such as summer festivals and shows. The temporary markings meet the requirements of the Environment Agency, and waste can be allowed into rainwater drains.

“It is time we addressed the proliferation of road signs and signposts throughout the UK, particularly in our historic towns and cities and picturesque villages. Just look at an average-sized city like Sheffield, for example, which has an astounding 28,000 street signs and 18,000 items of street furniture,” says George Lee, national director of the RSMA.

Between journeys, guests also enjoyed ‘hot laps’ of the Oulton Park circuit in two-seater racing cars piloted by professional drivers.

New route marking methods could see a reduction in roadside signage

The Campaign to Protect Rural England has long pressed for a reduction in the number of signs. The CPRE’s senior transport campaigner, Ralph Smyth, said: “A sign added here and a sign there over time can become a forest of traffic signs.

Darts champ throws open new truck stop

O

ne hundred and 80 truckers tackled five times darts World Champion Eric Bristow at the launch of a refurbished truck stop.

The truck drivers got a shock when they turned up at the Road King New Hollies Truck Stop near Cannock, Staffordshire, to find crafty Cockney Eric, 56, waiting for a game of darts.

Eric, from Leek, Staffs, said: “I used to call in this place a long time ago with my driver – you wouldn’t recognise it now.

“The truckers were queuing up for a game and I was dying for a big breakfast – I had the mega feast at £5.50 – not even I could manage the Belly Buster at six quid.

“Last year I was in the jungle for I’m A Celebrity Get Me Out Of Here! and I was dreaming of breakfasts like this back then.

“It is far better than Rosemary Shrager’s cooking in the jungle – and she was a celebrity chef.

Among those to give Eric a run for his money was wagon driver Jason Foxall, 40, of Dalaston, Walsall, who said: “I’ve never played darts with a world champion before – this place is a lot better than it used to be.”

Retired policeman and trucker Bob Hill, 69, of Kingswinford, West Midlands, beat Eric with nine darts and said: “I used to play football until I was 51, but darts clearly should

Specified to work in conjunction with the company’s huge 70 cubic yard bulk trailers, the new 6x2 tractors feature Globetrotter XL cabs and are powered by the 13-litre Volvo diesel rated at 500 bhp. The Swedish company’s I-Shift automated gearbox was also specified.

“Perhaps it’s a coincidence but, although we have nearly 20 vehicles in the fleet, the acquisition of the first of the new pair increases the number of maximum capacity artics to 13 – and that has to be lucky for us,” said Mike Barnsely. “And the 13-litre Volvo diesel, especially the 500, comes with an awesome

reputation for performance and economy.

“Our Volvo trucks have done us proud for almost 30 years, and we have every reason to believe the latest version will exceed our expectations by a comfortable margin.”

The spacious XL cabs incorporate many useful driver amenities, such as full leather trim, under-bunk refrigerator and integral cab phone. In addition, a complete cab and chassis makeover was carried out by Tor Trucks to ensure continuity with the traditional, yet distinctive Barnsley livery.

Supplied by the Avonmouth-based dealer Truck and Bus Wales & West, the new 4.1 m wheelbase Volvos were retrofitted with a PTO and pump and chassis-mounted hydraulic oil tank.

Bookie Fred Done, co-owner of the Betfred empire, took a gamble on buying the truck stop and pulled in his sporting pal Eric Bristow for a game of arrows with the truckers to launch it. In the first few months

Fred, who took on the Bristow challenge but failed to hit the bullseye, said: “I get the same buzz out of this place as when I opened my first bookmaker’s shop in Odsall – and I’ve got 1365 of those now.

“We aim to give people good service, good surroundings and good value and the money usually follows from there. I’d hope to open up around 50 nationwide in the next five years.”

astleigh-based AFS Haulage has replaced two older vehicles with a pair of Iveco Stralis Hi-Way tractor units in the company’s striking red livery.

The flagship long-haul Ivecos were selected for the 38-strong fleet based on the performance of the customer’s existing EcoStralis tractor unit, which has consistently returned 8.6 mpg versus a fleet average of 8 mpg – despite operating exclusively with a double-deck trailer. Other tractor units pulling double-decks in the fleet average just over 7 mpg.

AFS Haulage MD Andy Seagrave said: “The soaring cost of diesel means it is more important than ever before to take fuel performance into account when ordering new vehicles. You can’t presume all trucks perform the same – a difference of just 1 mpg can have a huge impact on operating costs.

“We have high hopes for these two new Stralis as they feature many of the same fuel-saving features as our existing EcoStralis, combined with a more aerodynamic cab and Iveco’s innovative Driving Style Evaluation tool. They have all the makings of being an ultra-fuel efficient force on the fleet.”

The Driving Style Evaluation tool is accessed via a dashboard-mounted colour touchscreen and allows the driver to improve their driving performance in real time. The Italian manufacturer said it can generate fuel savings of between five per cent and 12 per cent – superior to any single technology solution.

Supplied by Hendy Van & Truck, the Stralis Hi-Way 6x2 twin-steer tractors (AS440S46TX/P) will be used for a combination of local daytime work mixed with night-time trunking, or general haulage where the driver is away for at least three to four nights a week.

Both trucks are powered by EEVrated FPT Industrial 10.3-litre Cursor 10 engines, capable of producing up to 460 bhp between 1550-2100 rpm, plus 2100 Nm of torque between 1050-1550 rpm.

The engines are driven through automated EuroTronic transmissions.

AFS Haulage will keep the Stralis Hi-Ways in frontline operation for the next six years, prior to being moved onto local work. They have been supplied on Iveco Elements R&M agreements, which will see all servicing and maintenance undertaken through the Iveco dealer network.

Opencast Images: An Informal Look at British Coal Opencast Sites 1986-1994 Author: Dave Wootton Publisher: Old Pond Publishing Web: www.oldpond.co.uk ISBN: 978-1-908397-42-3 Price: £24.95 This book by Dave Wootton offers an interesting pictorial look at the workings of major British surface coal mines during the eight-year period up until British Coal Opencast (BCO) was privatised in 1994.

In researching the book, the author visited 24 sites around the

terms, they have never made any difference to the outcome of fuel duty, as the government announces it, waits for the uproar, then at the appropriate time says it is deferred or cancelled to gain public support.

Then it adds up all of the 3p per litre rises and tells you this is what you have now saved thanks to its policies – the rises you never actually received, so it cost you nothing and you save nothing.

Never once has any of the above been accredited with being responsible for getting fuel duty dropped. In fact, I cannot think of one thing that is accredited to these sticker-issuing non-entities.

If you think there is any financial incentive (for you) to being a member of the above organisations, then think again. You are continuing to fund them for supplying you with something you can source for free on the internet.

You are just paying for nobodies to become self-promoting somebodies who have well-paid salaries and pensions. That money would be better spent within your own company.

Proudly displaying their company logo on your vehicle or website gives you no credibility whatsoever; that ship has long since sailed.

Fuel for the average SME is 50 per cent of the revenue of a well-utilised vehicle, so it is your biggest company overhead – and making it show as 40 per cent to make this look better is just not correct practice. Know your costs, as fuel is now attributing to thousands of businesses trading insolently, which we all know is against the terms and conditions of your operator licence – but many have personal guarantees they are trying to honour (now there is a story for another day!).

FUEL UPS AND DOWNS

Yet again fuel is dropping in price slowly and rising in price twice as quickly – just when you thought you were going to feel the short-term gain.

I review the pricing from nine different fuel providers every Saturday morning for the forthcoming week. Constantly it is the same provider week in week out that remains competitive for me, but they happen to be French and an association I have had since 2005 when France was my mainstay business.

One of the largest providers and the one 500 yards from one of my operating centres is 6p per litre more expensive. The rest fluctuate within a penny per litre of each other.

But my French card is piggybacking on the main UK Fuels network, so how can it be that it is consistently cheaper?

When I ask the others to price match, they say they are selling cheaper to get your business, and we will not match that price. But remember: going to different garages to save a penny a litre is not really cost-effective. So we have very few choices.

Miss a payment for whatever reason and the credit insurer could force the hand of the card provider and tell them to withdraw your facility.

If you are an owner-operator, it may be the only card you are able to obtain is that one, and fuel is the catalyst of your business. No fuel, no work.

So when the government tells us to expect fuel duty rises in the forthcoming budgets, we start to panic – unless, like me, contracts have built in fuel duty escalators.

Out come the saviours of our industry – Fair Fuel UK, the RHA and FTA – jumping on the bandwagon of how they will lobby the government to get it abolished. In simple

Having been made redundant last August, I thought gaining another job within the transport industry would have been easy. Think again. I have been with a couple of agencies since then with no chance of a full-time job.

What I have seen is the steady reduction of pay rates from over £9 an hour to £8 – and even less in some cases – for a Class 1 driver. There almost seems a case of collusion between agencies, as all are offering the same rate.

A local company is only paying £8 for continental driving, and that is across the board with no extra for overtime. I feel the low rates are a direct fault of local agencies’ low rates for drivers. But there a couple of fairly large companies paying less than £8 an hour, which I believe is pathetic in this day and age.

POLISH STORY

My name is Simon and I’ve been living up north in Scotland for eight years now (I’m originally from Poland). I have decided to write and share my passion for transport and trucks, as some of my dreams came true here in the UK. I was born in 1978 in Poland, and at that time my country was governed by Communism and the transport scenery was very limited. I’m not sure if you ever heard about Polish trucks like Star, Jelcz, Russian Kamaz, Zil (probably you know those ones) or Czech Liaz, Tatra etc. One exempt was a company called PEKAES, which was owned by government (it was not possible to have private transport or a haulage company, or to have your own truck either, though the situation changed after 1990). PEKAES in late 1970 and ’80 used to have beautiful yellow Volvo F12 and F16, and Iveco Turbo Stars mostly, and few depots in Poland. The only reason they had a decent fleet was that they were going abroad, I suppose. Every time I saw those trucks on the road, my heart rate increased and I couldn’t stop dreaming that it was me behind the wheel in the future.

Well, I stick to my dreams and after my primary and high school (meantime, our political situation changed for better and we became independent in 1990), I went to college and took a six-year course (two parts, three years each) with qualifications gained as a vehicle technician. Big advantage of the college was I had an opportunity to get my driving licence at a very low cost, including HGV and PCV, as the course was dedicated

This new book from Old Pond Publishing presents a detailed pictorial look at the world of custom truck design in Western Europe and the United States of America.

Put together by French authors Ferd De Martin and Xavier Stéfaniak, this 160-page hardcover book takes a close

to a wide range of vehicle maintenance and repairs. But then the education system changed and government scrapped this licence scheme, and even though I started to work as a mechanic, I would have to save every month’s salary for a year to get my HGV/PCV licence – and I couldn’t afford that.

Thanks to my uncle, who was an HGV/PCV driver, my dream never ended as I was helping him to maintain his coach, as he had small private transport business.

In 2005, I decided to emigrate, took my savings and arrived in Scotland. I have to admit I was lucky finding a job after few days, and I worked in a garage as a mechanic, trying to improve my English.

In the winter of 2007, I noticed in a local newspaper that Stagecoach was looking for trainee drivers, so instant decision: I applied for the job, went through the interview with positive results, an started my training.

At Stagecoach, I met wonderful people including driving instructors Neil and Tom (who run an HGV driving school), and after two weeks I had a driving test – which I failed (four minors and I went over the white line at the junction). But the second time I passed, and I felt great having a professional entitlement.

I have been driving buses and coaches for over five years now, all over the country, but I’ve been still looking at nice trucks on the road every day.

Last year I decided to spend some money and go for my Class 2, which I passed first time. I think a big advantage was that I’d already been driving coaches for few years, and I chose Tom as an instructor. I was thrilled. I said to myself I will go for Class 1 in a few months, but Tom encouraged me to do it as soon as possible as I was well prepared for it. So as you can imagine, I listened him and went for it – and passed first time. I can’t even describe my feelings; I was so happy. I’ve been dreaming for so many years, and eventually my dreams came true.

I have passed three big driving tests (PCV, HGV Class 2 and 1) here in the UK, and I can tell you that DSA examiners were very helpful – but on the other hand, very demanding and professional. I admire and respect them for what they do.

In next few months, I’m hoping I will find a job in the haulage industry and will be enjoying hard trucker work. At the end of my email, I would like to thank you for great newspaper (superb job), which I’m picking up every month.

elton Mowbray, Leicestershire-based transport operator Charles Brown & Son Haulage Ltd has become the first UK operator to fit Westlake tyres to its fleet since Vacu-Lug was appointed sole UK distributorship for the brand.

To date, Charles Brown & Son has fitted Westlake units to the steer axles of six Scania tractor units out of its fleet of 16. As the initial batch have now proven themselves in service across a variety of demanding transport applications, the company’s remaining vehicles will also be equipped with Westlake tyres

as replacements become due.

“We undertake general haulage, fridge work, waste and bulk tipper work and run our fleet hard, with some vehicles covering up to 3000 km a week,” said Charles Brown & Son transport manager, Paddy Conboy. “Consequently, we need tyres which are versatile, durable, reliable and competitively priced. In Westlake, we have found all these demands are met by a single tyre range, hence our commitment to them for the future.”

Westlake tyres span a wide variety of operation types – and with a choice of 17.5 inch, 19.5 inch and

22.5 inch rim diameters, its products are suitable for drive and steer axle applications for light, medium and heavy commercial vehicles.

TC REFUSES TRUCK RETURN

A

local scaffolding business got “caught out” after one of its vehicles was detained for running illegally, the traffic commissioner for Scotland has ruled.

Joan Aitken told Lindsay Scaffolding Contracts Ltd, of Lauriston Street, Edinburgh, that it had taken a risk in the face of commercial pressures after using a vehicle to transport materials without permission on multiple occasions.

Her findings follow a hearing into the company’s application for the return of its vehicle. The HGV was impounded by VOSA on April 5, 2013 in Ferry Road. After hearing evidence from the company, and a VOSA traffic examiner, Miss Aitken refused to return the vehicle to the company.

During the hearing, the TC noted the firm, and a previous company, had applied for and held licences to run HGVs in the past. One of those applications was refused at a public inquiry in October 2011, when a deputy TC ruled directors Grant Lindsay and Valerie Lindsay could not be trusted. Evidence considered at that inquiry revealed both had been complicit in running vehicles without authority.

At the impounding hearing, Miss Aitken was told by the VOSA officer about further evidence of illegal operation. Records from

the digital tachograph on the impounded vehicle confirmed it had been driven on 63 days between December 15, 2012 to April 5, 2013.

Director Grant Lindsay acknowledged and accepted his company required a licence to operate legally, and conceded he had been disrespectful to the TC. He also admitted the company was desperate to be able to serve existing contracts, and that he had allowed vehicles to be used for certain jobs without authorisation.

Lindsay added he had made a fresh application for an O-licence, which was under consideration at a separate inquiry, and outlined his plan to allow matters to progress, including an agreement with a haulage company.

Issuing her decision in writing after the hearing, Miss Aitken concluded Lindsay’s application for the return of the vehicle and his evidence had been about one thing: the financial difficulty that would be caused by the vehicle’s detention.

“He was caught out, quite simply. He took a risk in the face of commercial pressures and operated unlawfully, with the result that VOSA impounded the vehicle. Against that clear state of knowledge, I cannot find any ground on which this application can succeed.”

ontinuing his review of successfully completed accident claims, Steven Hinchliffe looks at a situation experienced by a reader of Truckstop News that resulted in an award of personal injury compensation.

All of the accident victims mentioned in these articles are clients of my firm, Hinchliffes Solicitors. They have kindly given permission for the disclosure of their details, and in particular their real life experiences of incidents resulting in personal injury claims, and the steps taken to make a successful accident compensation claim. All of these clients contacted my firm after seeing our details in Truckstop News.

In this article I highlight another road accident where the innocent driver’s vehicle was hit from the rear by another vehicle. This is commonly known as a “rear end shunt” and can leave the injured person with significant symptoms, even when the impact occurs at a relatively slow speed.

As with previous articles, the common trend remains the effect on the injured person’s life, and although using the existing process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist

in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation.

Legal responsibility for a rear end shunt usually rests with the driver of the vehicle approaching from behind. That driver may be distracted by other things happening on the road and fails to notice that the vehicle ahead has slowed down or even stopped. This is particularly so at junctions or roundabouts, where a watchful eye also has to be kept for traffic approaching from the right. Another common situation here is when all the vehicles in the line stop safely and the driver at the rear expects the vehicle in front to move, but it does not and the driver behind (who is still looking to the right) collides with it.

Even the most cavalier of drivers knows they must leave an adequate distance between themselves and the vehicle in front, so they can brake safely if the vehicle ahead has to slow down quickly.

You have probably experienced tailgaters, particularly on the motorway, whose antics are a major cause of accidents at high speed, the consequences of which can be catastrophic for both them and other road users. Sections of many motorways have painted chevrons on

By this time steps were already well underway for Mr R to be examined by an ENT surgeon so that a comprehensive medical report, setting out full details of the injuries and their consequences, could be obtained. Once this was available and had been approved by Mr R, a copy was sent to the insurers, together with details of his very modest financial losses incurred as a direct result of the accident.

Settlement negotiations then started, with offers and counter offers being put forward by both sides. Within a few weeks it was possible to reach an acceptable settlement at a total figure of £2250, the vast majority of which was to compensate Mr R for his pain and suffering. He kept the full sum recovered, as my firm’s costs and the expenses we had incurred in dealing with the claim (eg paying for his medical records and the medical report) were subsequently negotiated with the insurers and paid separately.

Fortunately, despite the accident circumstances Mr R suffered only a relatively minor injury, and this was reflected by the level of compensation he recovered. His employer’s insurers took a sensible approach to the claim and handled matters with reasonable efficiency, which meant it was possible to reach agreement and for Mr R to be in funds in just under six months from the date the first letter was sent to his employer.

This also had the effect of keeping the legal costs to a minimum.

He received £2,650 for his injuries and £600 for his financial losses (mostly comprising lost wages), making £3,250 in total.

ecently in the press, there has been notification of the government’s plan to increase fixed penalties for certain motoring offences. One of these offences is using a mobile phone while driving. The legislation defines this offence as follows: “No person is to drive a motor vehicle on a road if he is using a hand-held mobile telephone or a hand-held device of a specified kind. No person is to cause or permit any other person to drive a motor vehicle on a road while that other person is using a hand-held mobile telephone or a hand-held device of a specified kind. No person is to supervise a holder of a provisional licence if the person supervising is using a hand-held mobile telephone or a hand-held device of a specified kind at a time when the provisional licence holder is driving a motor vehicle on a road.

“A person does not contravene any of these provisions if, at the time of the alleged contravention:

Under the Road Vehicles (Construction and Use) Regulations a mobile telephone or other device is to be treated as hand-held if it is, or must be, held at some point during the course of making or receiving a call or performing any other interactive communication function. An “interactive communication function” includes the following: sending or receiving oral or written messages; sending or receiving facsimile documents; sending or receiving still or moving images; and providing access to the internet.

One of the offences some drivers have committed is using a mobile phone while driving. The legislation defines this offence as follows: No person is to drive a motor vehicle on a road if he is using a hand-held mobile telephone or a hand-held device of a specified kind. No person is to cause or permit any other person to drive a motor vehicle on a road while that other person is using a handheld mobile telephone or a hand-held device of a specified kind. No person is to supervise a holder of a provisional licence if the person supervising is using a hand-held mobile telephone or a hand-held device of a specified kind at a time when the provisional licence holder is driving a motor vehicle on a road.

If you’re caught using a hand-held mobile phone or similar device while driving, you can expect to get an automatic fixed penalty notice. This means you’ll get three penalty points on your driving licence and have to pay a fine of £60. However, your case may go to court. If it does, you may also face disqualification from driving on top of a maximum fine of £1000. If you were driving a PCV or heavy goods vehicle, you could face a maximum fine of £2500.

Also if the matter were considered of a serious nature you could face prosecution for other road transport related offences, which carry more serious sentences.

Parliament has recognised the inherent dangers caused by drivers of motor vehicles when using mobile telephones while driving and brought forward specific legislation. There has been an unacceptable increase in the number of vocational licence holders using mobile telephones without a hands free device while driving large goods and passenger carrying vehicles. This practice is unacceptable and presents an undue risk to road safety. Studies have indicated that even the use of hands-free devices can distract a driver to the extent that they may be prevented from applying the requisite care and attention.

A report for an offence received from an enforcement agency that a vocational driver has used their mobile telephone while driving without a hands free device in the last three years will result in that driver being called to a hearing before the traffic commissioner. Each case will be decided on its own facts and merits and the presiding traffic commissioner will be keen to ascertain the reason the driver is engaged in the telephone call.

Merc’s specials evolve

C

ontinuing its Euro 6 offensive, MercedesBenz has revealed the latest Unimog all-terrain vehicle, the Unimog implement carrier and the Econic - which makes the German company the only vehicle manufacturer in Europe to offer Euro 6-compliant products in all categories of the light, medium and heavyduty segments, as well as in the special-purpose vehicle sector.

“In a wide variety of applications, the three new model series impressively demonstrate the leading role the Unimog and the Econic play in innovation,” said Yaris Pürsün, head of Mercedes-Benz Special Trucks. “We’re convinced the new vehicles will set standards

and substantially contribute to the business success of existing and future customers.”

Mercedes-Benz Special Trucks invested around €135 million in the three completely new vehicle concepts for its Euro 6 range – and the launch introduces the new BlueEfficiency Power medium-duty engine generation in special trucks, now it has been proven in regular Merc trucks.

The four and six-cylinder engines have outputs ranging from 115 kW (156 bhp) to 260 kW (354 bhp), which combine low fuel consumption with extremely clean exhausts.

These engines make the Unimog more efficient, despite the extensive design changes

that were implemented to ensure compliance with Euro 6. In the Econic, the engines are claimed to reduce fuel consumption by up to four per cent.

Mercedes said the new generation of Unimog all-terrain vehicle, Unimog implement carrier and Econic have substantially increased performance and efficiency, while also being easier to operate.

In addition to new engines for all model series, the Unimog all-terrain vehicle boasts a revamped mid-engine concept, and the Unimog implement carrier driveline features a new seamless change between the infinitely variable

speed hydrostatic drive and mechanical drive providing all-round visibility, and new hydraulic systems for implements and performance that make the vehicle significantly more efficient to use.

The new Econic further enhances the lowentry cab concept and boasts many ergonomic improvements as a result of its new chassis, interior and exterior. Despite its unchanged payload, the truck is also much more economical than its predecessor, thanks to reduced fuel consumption and lower costs for repair and maintenance.

ummins’ Euro 6 ISB engines have successfully completed cold climate testing in Sweden and Norway as part of its three-year development programme.

Engineers carried out 6000 km of product validation in extreme vehicle operating conditions, with ambient temperatures down to -29 degrees C. The four-week test was carried out with an 18-tonne truck powered by an ISB6.7 and a 12-tonne truck powered by an ISB4.5. Both were instrumented to collect engineering data from the engines, aftertreatment system and other related truck components.

The testing team was based in Kiruna, Sweden, 145 km north of the Arctic Circle, where the average ambient temperature was expected to be -20 degrees C. The area has good roads and workshop facilities to support vehicle testing. Typical test routes were in and around the Kiruna area, as well as to Narvik in Norway. Driving conditions on the E10 road to Norway were particularly challenging.

Both vehicles were installed with advanced telemetry which measures and records more than 1300 engine and vehicle parameters on a real-time basis. This data was automatically sent via GSM equipment back to the Darlington Technical Centre every hour for review and analysis by functional specialists. After validating findings and identifying solutions in the lab, the test team on site in Kiruna were then able to make focused adjustments and modifications to the engine and aftertreatment system to further optimise performance in the cold ambient temperatures. The trucks were also left for extended periods to achieve the lowest possible system temperatures, ensuring every operator’s needs had been considered.

Cold starting was achieved down to -29

degree C with standard hardware, proving the system is robust in all European operating environments.

Throughout the test, Cummins engineering teams monitored the Euro 6 technologies to ensure emissions compliance was maintained in the challenging climate. The aftertreatment system (incorporating Cummins’ DPF and SCR technologies) has to be kept within a specific temperature band to operate efficiently. This is achieved through advanced control strategies which manipulate the engine hardware and combustion strategy to maintain exhaust temperatures in the optimum range while maximising fuel efficiency.

In addition, urea freezes at -11 degrees C, so the capability of the heating system for the Urea tank and delivery system also had to be confirmed. If the SCR catalyst does not achieve the right temperature or AdBlue is unavailable, the system cannot control NOx emissions and a fault code will be triggered.

Jonathan Atkinson, chief engineer of Product Development, said: “The testing successfully validated Cummins’ hardware and control strategy for Euro 6 in very cold conditions. This is an important step in our development programme which, combined with our hot climate work, ensures our Euro 6 package delivers for all vehicle users, wherever and whenever they operate.”

obra UK has launched Global Live Cycle Scanner, a variant of its 3G mobile CCTV system aimed at protecting cyclists. Specifically developed for HGVs, the new product has been brought to market in response to a growing need for onboard cyclist protection systems, particularly in vehicles that work predominantly in urban areas.

The Global Live Cycle Scanner features a scanner and six sensors along the nearside of a vehicle to detect a cyclist, and a live video camera to see exactly what is happening. If a cyclist enters the nearside of the vehicle, the system warns both the driver in the cab and the operator back at base with automatic alerts.

The Cycle Scanner also provides live images and a recording of every journey, providing instantly available evidence in the event of an incident, along with GPS location to show the vehicle journey and location.

Andrew Smith, MD, Cobra UK said: “The new Global Live Cycle Scanner is a must-have product for all HGV fleet operators to help their drivers who operate in busy city centres. It brings the safer HGV of 10 years’ time to today’s roads. The technology ensures cyclists are kept safe and drivers are given an added protection system to safely carry out their job.”

The Global Live Cycle Scanner is available from £899 per vehicle including scanner, sensors, live mobile CCTV system, camera and web portal (excluding installation).

SPRIDER SHAKES IT OUT

A

new system has been launched that converts an ordinary tipper truck into a complete asphalt/aggregate application system in just 15 minutes.

Called the Sprider Asphalt Application System, it is capable of work rates on hand laying of up to 30 tonnes per hour, which can enable operators to achieve significant cost savings on hand work, paver loading and difficult-to-access application sites.

Premium honours vintage livery

teel-carrying haulier A Hingley Transport Ltd has taken delivery of a new Renault Premium 460 6x2 tractor unit – and to mark the company’s 45th anniversary, the vehicle has been decorated in Hingley Transport’s original 1960s livery.

The Renault Premium with Privilege cab has a steel-carrying trailer which also features the original corporate colours. Hingley Transport has a long-standing relationship with Renault Trucks, with the marque making up three quarters of its 80-strong fleet.

Based in the West Midlands, the Renault Premium ‘Anniversary Truck’ will operate across the UK, on contract work for bluechip clients including Tata Steel and Norbert Dentressangle.

Dave Smith, finance director, Hingley Transport said: “We added the first Renault

trucks to our predominantly Scania fleet in 2000 when we were awarded a major contract with what was then Corus Steel UK Ltd. Renault has always been competitively priced, with a great total package supplied by Renault Trucks Midlands.

“Most importantly for our contract work, the Renaults have also been very reliable trucks – which is why Renault now makes up the vast majority of our fleet. It seems fitting, therefore, that our flagship anniversary truck should be a Renault.”

Hingley Transport cites a good working relationship with local dealer Renault Trucks Midlands as a key factor in the company’s loyalty. The dealer undertakes all repair and maintenance of the Renault trucks on Hingley Transport’s fleet, as well as its 150-strong trailer fleet.

Quattro steps it up

S

pecialist plant hire business Quattro Group has invested in standardising and modernising its fleet of trailers with an order for 10 SFCL 67 four-axle step frames from Andover Trailers, worth nearly £700,000.

The East London-based company is responsible for providing 30 per cent of the specialist wheeled and tracked ‘road rail vehicles’ (RRVs) used throughout the UK, as well as hiring machinery capable of dealing with a vast range of construction and civil engineering projects.

Having previously purchased second-hand trailers from Andover, Quattro Group was so impressed with their strong performance it tasked Andover with building a fleet of new step frames to a bespoke specification.

John Murphy, Quattro Group MD, said: “Our previous experience with Andoversupplied trailers demonstrated their suitability to our demanding operation. When we were looking to standardise and upgrade our fleet, Andover seemed like the perfect fit.”

Each new trailer features a low-profile neck, plus rail lines in the floor of the neck, lower deck and beavertail to allow easy loading of RRVs. The specification also includes two fixed and two self-tracking BPW axles to aid manoeuvrability and minimise tyre wear, BPW air suspension with a Wabco raise/lower valve, which can be used to lower

the trailer for loading and unloading. Slide out extensions are fitted to the deck, bridge and beavertail to assist with loading wide machines.

Worth approximately £70,000 each, the trailers are fitted with a number of safety features to meet Quattro Group’s high standards of health and safety. This includes Andover’s slide-out safety lights, halogen reversing lights, strobe beacons on the rear ramps and floodlights all the way round the trailer for safer working at night.

The trailers also feature a bespoke working at height system, which Andover has engineered for use even when the side extensions are deployed. This means when loading wide machines, such as an excavator, it can be set-up around the outside of the excavator’s tracks, to ensure maximum safety.

The 10 SFCL 67 step frames also combine hydraulic power toe ramps with Andover’s unique fuel-saving fold-forward ramps – the first time Andover has incorporated this ramp technology on a 53-tonne payload trailer. Andover’s design team worked hard to combine the two technologies, whilst also adding hydraulic sideways movement to the ramps, to enable Quattro Group to load machines of varying widths.

All 10 trailers have been supplied on a contract hire agreement by Prohire.

Drivers tackle hairy export

T

he team at Rhys Davies Freight Forwarding are no strangers to unusual cargos – but when the call came in to ship a family of woolly mammoths from Cardiff to Norway, even manager John Lyon was a little taken aback.

The hairy family of three had been commissioned by the Norwegian Glacier Museum in Fjaerland and created using fibreglass by bespoke display fabrication company, Wild Creations in Cardiff.

The life-size exhibits - the largest is almost 3 m tall - were carefully loaded onto a jumbo trailer for shipment via Tilbury to Gothenburg, and onward by road to Fjaerland. All arrived safely and were later installed outside the museum by technicians from Wild Creations.

“The job was certainly unusual, but the guys at Rhys Davies did an excellent job,” said Wild Creations’ managing director, Matthew Wild. “This was the first time we’d had items as large as this to send to Norway, and we were unsure how to go

about it and the paperwork involved. But despite the potential difficulties and the destination being very remote, it was all in a day’s work for the guys at Rhys Davies and everything went without a hitch.

“Amazingly, their forwarding manager John Lyon actually knew the area and had visited the museum a few years ago, so he knew exactly where they were going.”

Although transporting three woolly mammoths to a remote area of Norway may seem a little tricky, some of Rhys Davies’ shipments are even more challenging. For example, one customer regularly sends refrigeration gasses in 40 ft tanks to the Middle East, including Libya and Syria, so reliable contacts and an in-depth knowledge of the regulations is essential – especially in a war zone.

Other contracts handled by Rhys Davies include shipping food ingredients from the Far East, skin and beauty products from India, and transporting photocopy paper for offices throughout the world.

Our expert adviser has been providing specialist truck insurance for over 30 years Truck theft PREVENTION ADVICE Q Having recently had my truck stolen, I’m looking into how best to make sure this doesn’t happen again, and if it does, what might give me the best chance of recovering my truck. What advice can you offer?

A

Think carefully about how secure the environment is within which your truck is based and operates. For example, are your premises adequately secured?

Where is your vehicle parked and what precautions are taken when it’s unattended, both during the day and particularly at night? If someone tries to steal your truck, how visible are they to members of the public? What security precautions do you take as regards your vehicle keys?

Then there’s the security of the truck itself to consider, including vehicle locks, alarms and immobilisers. Information about the adequacy of security devices is available via the Thatcham Research website. If you feel your vehicle security may need upgrading, companies such as Maple Fleet Services may be able to help with providing appropriate solutions. And finally, should your truck be stolen despite taking appropriate precautions, there are devices available which can help locate a missing vehicle. GPS/GSM based vehicle tracking devices may be able to help, though these can be jammed and may be ineffective if a vehicle is concealed, for example, inside a building. So if stolen vehicle recovery is your principal concern, an alternative to consider (if your truck is being used within the UK) is the installation of a Tracker VHF radio signal vehicle device whose signal can be picked up by suitably-equipped police vehicles.

Employers’ liability INSURANCE NEEDS Q I’m an owner-driver. The only person who might be considered to be an employee is my wife, who takes care of the operational side of the business. Do I need to arrange Employers’ Liability insurance?

A Every business, including a family business, which is incorporated as a limited company needs to arrange Employers’ Liability insurance, regardless of size. If a business is a family business and is not a limited company, and the only people working for the business are closely related (husband, wife, civil partner, father, mother, grandfather, grandmother, stepfather, stepmother, son, daughter, grandson, granddaughter, stepson, stepdaughter, brother, sister, half-brother or half-sister), the business is exempt from the Employers’ Liability regulations.

So, providing you are not a limited company and the only person working with you is your wife, your business should be exempt from having to arrange Employers’ Liability insurance.

Damaged goods RHA CONDITIONS Q One of my customers recently hit me with a large claim for goods they claim were damaged by me whilst in transit. The damage allegedly occurred about two months ago.

I’m sure the claim is spurious - I don’t think I had anything to do with the goods being damaged, but the customer insists I’m responsible.

I operate under RHA Conditions.

writing within seven days and a claim to be submitted in writing within 14 days. That being the case, your insurer can be expected to repudiate the claim on your behalf, on the grounds your customer failed to report the damage within the required time frame.

Transit insurance CMR COVER Q I spend quite a lot of time abroad carrying goods under CMR Conditions and my transit insurance policy has been arranged accordingly. I’ve recently come across an opportunity to engage in occasional ‘cabotage’ work in France. Does my CMR cover protect me adequately, or do I need to make special insurance arrangements?

A

CMR only applies to the movement of goods from one country to another. As your cabotage work will involve haulage work between different points within the same country, CMR won’t apply.

Instead, you will be carrying under whatever conditions of carriage have been agreed locally between yourself and the customer.

Chances are you will be required to carry under conditions of carriage which your customer, rather than you, are familiar with.

You need to obtain a copy of those conditions of carriage, make sure you understand entirely what your

liabilities are under the contract, and ask your insurance provider to arrange an appropriate extension to your transit insurance policy.

Multi-drop drivers UNATTENDED VEHICLES Q I’m an owner-driver. Most of my work involves multi-drop parcel-type deliveries. Because I’m so busy, I don’t feel I’ve got the time to keep locking my van every time I take a parcel out and take it in to the customer’s premises. If I was to have some of the load stolen - or worse still, my van - would I be covered, given I’m never more than a minute or two’s walk away from my vehicle?

A Doing what you do means a claim relating either to the goods on your vehicle or the vehicle itself may well not be met, as the insurer is likely to regard the vehicle as being ‘unattended’ at the time of the loss and may also feel you have failed to take reasonable precautions to prevent a loss. What might be worth looking into is the possibility of having a good quality after-market ‘slam-lock’ fitted, which has been specially designed for operators (like you) who are engaged in multi-drop delivery work.

loss or damage to consignments we’re moving on behalf of our customers. What would happen if one of our trucks was damaged in a crash and the cargo had to be re-loaded onto another vehicle before continuing its journey? Would the ‘transhipment’ cost be covered under our policy?

A Transit insurance policies do typically cover transhipment costs, usually in the form of an automatic extension with a limit of perhaps £10,000. Wordings do vary between insurers, so check your cover carefully and ask your broker for advice.
