2012 Year-End Tax Planning

Given the current level of uncertainty, year-end tax planning for 2012 is extremely challenging. With a host of major tax provisions expiring at year-end, and new taxes taking effect January 1, 2013, some year-end moves have the potential for significant savings. But will new legislation change the tax landscape once again? It’s impossible to say for sure. Your best bet is to evaluate your tax situation now, consider your options, and stay on top of late-breaking legislative developments. Higher tax rates a significant consideration A fairly common strategy at year-end is to try to shift income into the following year by, for example, deferring a year-end bonus, or delaying the collection of business debts, rents, and payments for services. This year, however, you have to consider any income timing moves very carefully. That’s because federal income tax rates are scheduled to jump in 2013. We’ll go from six federal tax brackets (10%, 15%, 25%, 28%, 33%, and 35%) to five (15%, 28%, 31%, 36%, and 39.6%). The maximum rate that applies to long-term capital gains will generally increase from 15% to 20%. And while the current lower long-term capital gain rates apply to qualifying dividends, starting in 2013, dividends will be taxed as ordinary income. Could the current federal income tax rates be extended yet again? Of course, but it’s far from a certain bet. That means any moves you contemplate have to be considered in the context of several “what-if” scenarios. New taxes also a factor New Medicare taxes created by the health-care reform legislation passed in 2010 take effect January 1, 2013. Beginning then, the hospital insurance (HI) portion of the payroll tax--commonly referred to as the Medicare portion--increases by 0.9% for high-wage individuals. Also beginning in 2013, a new 3.8% Medicare contribution tax is imposed on the unearned income of high-income individuals. Who is affected? The 0.9% payroll tax increase affects those with wages exceeding $200,000 ($250,000 for married couples filing a joint federal income tax return, and $125,000 for married individuals filing separately). The 3.8% contribution tax on unearned income applies to some or all of the net investment income of individuals with modified adjusted gross income that exceeds $200,000 ($250,000 for married couples filing a joint federal income tax return, and $125,000 for married individuals filing separately). Make sure to consider whether you’ll be affected by these new taxes in 2013. Keep in mind also that the current 2% reduction in the Social Security portion of the Federal Insurance Contributions Act (FICA) payroll tax is one of the tax provisions that expire at the end of 2012. Revisiting Roth conversions If you’ve been debating whether to convert a traditional IRA or 401(k) account to a Roth account, it’s worth giving the matter another hard look before the end of the year. When you convert a traditional IRA to a Roth IRA, or a traditional 401(k) account to a Roth 401(k) account, the converted funds are subject to federal income tax in the year that you make the conversion (except to the extent the funds represent nondeductible after-tax contributions). With tax rates set to go up next year, waiting to do a conversion could mean that your immediate tax hit for doing the Roth conversion goes up as well. Converting now can also have a long-term benefit--future qualified distributions from Roth IRAs and Roth 401(k)s will be free from federal income tax. That could make a big difference in retirement if you’re paying income tax at a higher rate at the time. Whether a Roth conversion makes sense for you depends on a number of factors; but if it makes sense for you, it might pay to think about acting this year, rather than waiting. One more thing to consider. If you convert a traditional IRA to a Roth IRA and it turns out to be the wrong decision (e.g., current tax rates get extended, and you think you would have been better off waiting to convert), you can recharacterize (“undo”) the conversion. You’ll have until October 15, 2013, to recharacterize a 2012 Roth conversion--effectively, treating the conversion as if it never happened for federal income tax purposes. Looking closely at itemized deductions It’s sometimes possible to accelerate or defer deductions so that they can be claimed in one year instead of the other. For example, you might be able to accelerate deductions into 2012 by paying some deductible medical expenses, interest, or state and local taxes before the end of the year. Or, with higher tax rates coming next year, you might consider trying to postpone deductions so that you can claim them in 2013 rather than 2012, since a dollar in deductions will be worth more if the tax rate is higher. There are a couple of things to keep in mind, though. The first is that, as things stand right now, in 2013 most itemized deductions (and personal exemptions, for that matter) will once again be phased out for individuals with higher adjusted gross incomes (AGIs). The second is that, starting in 2013, the itemized deduction “threshold” for claiming unreimbursed medical expenses increases from 7.5% of AGI to 10% of AGI (there’s a temporary exception for individuals who are 65 and older). If your itemized deductions are going to be limited in 2013 because of these changes, deferring deductions to 2013 might not make sense. AMT--a big wild card If you’re subject to the alternative minimum tax (AMT)--essentially a separate federal income tax system with its own rates and rules--it gets even more complicated. AMT effectively disallows a number of itemized deductions, making it a significant consideration when it comes to year-end planning. And, while a series of temporary AMT “fixes” have increased AMT exemption amounts since 2001, forestalling a dramatic increase in the number of individuals ensnared by the tax, the last such fix actually expired at the end of 2011. As things stand now, the AMT exemption amounts that apply for 2012 and 2013 are significantly lower than for 2011. As a result, unless Congress retroactively changes the AMT rules, it’s estimated that more than 30 million taxpayers (roughly 20% of all taxpayers) will be hit by the AMT in 2012. Other important changes The earned income tax credit, the child tax credit, the adoption credit, and the American Opportunity (Hope) tax credit all revert to prior, lower limits and (less generous) rules of application. Also gone in 2013 is the ability to deduct student loan interest on student loans after the first 60 months of required repayment. Tax changes that were originally made to address a perceived “marriage penalty” also expire at the end of 2012. If you’re married and file a joint return with your spouse, you’ll see the effect in the form of a reduced 2013 standard deduction amount, as well as in lower 2013 tax bracket thresholds in the tax rate table (i.e., couples will move into higher rate brackets at lower levels of income). I’m on a rant today. Awhile back I saw a doctor on TV talking about a study that says we would receive health benefits if we would drink at least four cups of coffee a day, but we shouldn’t use cream or sugar because they are “bad” for us. However, I can remember when they told us that the only thing good about drinking coffee was the cream and sugar we put into it. This is about the fourth time the medical authorities have changed their position, so how can we know they are right this time? Let me explain what I see wrong with this. He did explain that this doesn’t work for decaf, so they must assume that it is the caffeine that confers the benefit. Caffeine is an excitotoxin and almost with out exception excitotoxin effects are dose related; they stimulate our neurons from a point of benefit to damage to destruction depending on dosage. So the information we need is, “What is the proper dosage for each individual’s response in order to stay within the safe dosage range?” Four cups a day doesn’t confer enough information to make a good judgment call. How strong should the coffee be? How large a cup are you using? How much does the individual weigh? All of these things factor into determining how much caffeine it will take to help us or harm us. Then this doctor indicates cream and sugar are bad for you—how can he possibly know that with out knowing each individual’s caloric needs? I’m not saying coffee is bad for you. What I am saying is that we are being fed a lot of bad or incomplete information from authorities who are supposed to be protecting us. This opens the door to the bigger discussion of how much of what we are being fed by the scientific community is accurate information, and how much is from research that is designed to prove a pre-existing hypothesis in order to secure funding. Let me relate another story for you. Mary and I recently spent ten days at the Free Enterprise Radon Health Mine in Boulder, Montana where we met people from Alaska and Illinois who had been to the mine as many as 13 times. You don’t come that far and that many times without receiving some benefit. Mary and I feel we received benefit from our stay at the mine, and the owner Pat Lewis Anderson has a huge book of written testimonials from people all over the world. However, the EPA (Environmental Protection Agency) requires my son who is a spec home builder to install a radon removal system in every home he builds to the tune of about $5,000. The EPA has made the claim that at least 20,000 lung cancer deaths a year are caused by Radon gas, but when asked for proof they can’t produce one single shred of evidence; their reasoning is all based on conjecture. When you also consider that lung cancer was not an above average problem with the miners who worked the mines most of their lives, you can easily come to the conclusion that the EPA is enforcing its authority using faulty information. In most of the United States there is a policy of checking on any stalled vehicle on the highway when temperatures drop to single digits or below. About 3:00 one very cold morning, Montana State Trooper Allan Nixon responded to a call about a car that was off the shoulder of the road outside Great Falls, Montana. He located the car, stuck in deep snow and with the engine still running. Pulling in behind the car with his emergency lights on, the trooper walked to the driver’s door to find an older man passed out behind the wheel with a nearly empty vodka bottle on the seat beside him. The driver woke up when the trooper tapped on the window. Seeing the rotating lights in his rearview mirror, and the state trooper standing next to his car, the man panicked. He jerked the gearshift into “drive” and hit the gas. The car’s speedometer was showing 20, 30, 40, and then 50 MPH, but it was still stuck in the snow, wheels spinning. Trooper Nixon, having a sense of humor, began running in place next to the speeding (but stationary) car. The driver totally freaked out, thinking the trooper was actually keeping up with him. This went on for about 30 seconds, and then the trooper yelled, “PULL OVER!” The man nodded, turned his wheel, and stopped the engine. Needless to say, the man from North Dakota was arrested and is probably still shaking his head over the state trooper in Montana who could run 50 miles per hour. Who says troopers don’t have a sense of humor?

It was a flashy, purple ’71 Dodge Charger and because he washed and waxed like it was his girlfriend, it was his girlfriend. Troy parked his Dodge on the side street outside his house directly behind my veterinary clinic, and one afternoon, a Montana wind forced him to choose between his dignity and his girlfriend. His dignity blew away and he told me this story never realizing it might someday appear in print. After opening my clinic and placing a thousand dollar dog food order, Science Diet sent me this free, three by four, metal road side sign. For a year or so, the sign swung back and forth with the wind slowly wearing its suspending eyelets dangerously thin. On the day of record, Troy had just stepped out of the shower and was wrapped in a towel, when he looked out his window to see a gust of wind tear our dog food sign free from its eyebolts and start it cartwheeling down the road. He paused for a second, before calculating the sign was perfectly aimed at the front bumper of his Charger. Experts advise one should not panic in the time of crisis, but this was a dang good time to panic. Troy did. Tightening the towel around his waist with both hands, Troy kicked open his kitchen door and exploded out into the yard. In two giant leaps, Troy landed in front of his car and intercepted the sign milliseconds before it would have slashed his girl across her fender. He exhaled a sigh of relief the instant a second gust of wind swept down the street encouraging the sign to strain against Troy’s grip. For two seconds it was a gut wrenching battle between man and road sign, and Troy struggled with the strength of a dozen gladiators. Thinking the sign was near surrender, Troy relaxed the instant a third gust of wind stripped him of his towel and sent it flying towards North Dakota. Just like everyone’s recurring nightmare, now our hero was standing completely naked in the middle of the street, in broad daylight. He bent the sign around his midsection before sprinting back into his house and this brings me to my point. Embarrassing global warming data has been published and progressive global warming prophets, who have been lining their pockets promoting this scam, are now left naked, standing in the middle of the street, if the public cares to accept the truth. Sadly, with respect to man caused global warming, so many people have accepted the lie as the truth, the lie has become the truth and it is the truth which is viewed with skepticism. Go figure. This October, the United Kingdom’s Meteorological Office reluctantly published data from 3,000 worldwide measuring points revealing global warming actually stopped 16 years ago. Because this occurred in spite of man’s increased carbon emissions, Professor Judith Curry, the head of Georgia Tech’s climate science department, dismissed the computer models progressives used to predict global warming as being “deeply flawed.” This is the politically correct way of saying they are a fraud. Unlike Troy who had nothing but the sign to cover his dignity, progressives are clamoring to cover their nakedness in any way possible. Most will plow forward and ignore the contradictory data as this technique has worked so well in the past. Let’s look at what this fraud has cost in just the last four years. Everyone knows the solar panel company, Solyndra, went bankrupt. Do you realize there are 35 other green companies who tucked 3.552 billion stimulus dollars in their wallets and either snuck out the bankruptcy exit, or are working their way towards it? This entire climate change, green energy scheme is a scientific and economic hoax, so patriots must dispose of its elected advocates this election cycle before it leaves us naked in the street. Chris Preputin, the owner of Custom Collision Repair in Richman Insurance Havre, pairs his years of auto body experience with a top notch team of highly trained, highly skilled workers. It’s a winning solution. LEWISTOWN: Preputin’s first job in auto body was for Bob Patera as a technician. Snowy Mountain Motors Chris never imagined that twenty years later, he would own the very shop he Lewistown Rental started out in, but that’s exactly what happened. Since his purchase of the company in 2007 business has boomed. CCR began as a one man show; now Duane Sparks Chevrolet eight dedicated individuals have joined his team, and two major additions to the facility have doubled the size of the shop. On the latest addition, Preputin hired CHINOOK: Ryan Reibsome inspects a decal on a vehicle a consulting company to help design the shop to allow for optimal vehicle flow. Jamieson Motors that is fresh out of the new paint booth at Custom Preputin states, “We need to move every car five times. We take a vehicle Collision Repair. American Garage, LLC apart, do body work, prime and final sand, paint, then put it all back together. It’s important that this all happens efficiently.” TURNER: Perhaps the most significant improvement to the facility, however, is the new paint booth that was installed as part of the Reed’s Ag Enterprises ~ latest addition. Manufactured in Italy, the new system is at least five years ahead of anything else on the market. In an effort to be Turner Supply more “green” the booth is designed for water borne paints, but the more immediate benefit is that it will bake to factory tolerance, dry and cure in fifteen minutes, where the old system used to take three to four hours, or sometimes overnight to all day. The first HAVRE: vehicle was painted in the new booth on October 31st. North Star Dodge In the end, though, it’s all about customer satisfaction. Custom Collision Repair performs a long list of services, including Custom Collision Repair windshield replacement, auto body repair, auto accessories, custom paint, collision repair, estimates, and big truck collision repair, which includes semis, campers, trailers and grain trucks. Basically, they service anyone with a running vehicle, whether it’s a Havre Muffler & Brake car, semi, tractor or snowmobile. They’ve even painted guitars. The folks there are all about helping their customers in any way they can and steering them in the right direction. CCR is known for going above and beyond for their customers, including giving Havre Ready Mix, Inc.~ Baltrusch Construction, Inc. rides when they drop off a vehicle or pick it up. Chris has a huge soft spot for kids. Therefore, he focuses most of his community giving to kid-oriented programs like ~Havre Sand & Gravel, Inc. the Boys & Girls Club and after-school athletics programs like soccer and hockey. Chris has an incentives program going for a Pacific Steel & Recycling handful of kids where they earn cash for good grades. A ‘C’ grade earns a student $1 from Custom Collision, a ‘B’ earns $3, and an ‘A’ earns $5, but a ‘D’ or ‘F’ grade means the student owes money. The Custom Collision shop is close to where lots of kids Tilleman Motor Co. live, and Chris is known to open up the shop on Saturdays to allow area youngsters to work on their bikes, as long as things aren’t too busy there. They get to do things like tighten chains and adjust handlebars. RUDYARD: Another group of folks that CCR supports heavily are Veterans. “This country wouldn’t be as good as it is without our McNair Furniture Veterans,” says Preputin. Accordingly, his business is a big supporter of the Veterans Affairs, especially for disabled vets, the MALTA: Veterans of Foreign Wars, Vietnam Veterans and provides support to the Military Order of the Purple Heart. Radio Shack Malta Preputin notes that his dream job (if he ever were to win the lottery) would be to do exactly what he does now, but to be able to work on cars for 10% of the actual cost. He’d love to be able to fancy them up and do the more artistic projects without First State Bank the financial parameters that limit his customers options. The reality, however, is that it all costs money and the CCR team works hard to create a polished product for the best Great Northern Hotel & Restaurant ~ Maltana Motel economical value to the customer. Helping him do that are his highly talented staff. His most senior employee is Josh Obergfell, who’s been with him from the beginning. Josh is his “go-to” super high-collision guy. He’s the one who can fix the car that was Crossroads Coffee ~ driven into the Grand Canyon. Rob Azure, who has owned his own body shop in Harlem is super help all the way through, and Feigel Photo even helped to take Chris’ place when he was injured snowmobiling. Rob handles the parts end of things, which is an intensely huge aspect of the business, and deals with insurance companies. Ryan Reibsome is, according to Preputin, the most talented Liquor Haven ~ Travel Haven natural painter he’s ever met. Ryan does every job right with super high quality. Caleb Young is the youngest of the bunch, and acts as the second painter in command. While new to the auto body world, he knows cars inside out. Caleb enjoys work so Mint Bar much that he sings while he works. Jesse Baldwin is another auto body expert who also works on the collision side. He’s great at breaking things down to figure out anything. CCR recently sent Jesse to earn certification in Paintless Dent Repair. Office R & G Feeds manager is a weak term to describe Kim Turner, as she really is the “hub of the wheel” for everything that happens at the shop. HINSDALE: Her meticulous work ethic and organizational skills help everything run smoothly. Recently, Preputin hired his daughter Ryann to Stoughie’s Bar & Grill help out in the part time in the office and handle the social media and online marketing for the company.
