The new year began with some political drama, as last-minute negotiations attempted to avert sending the nation over the “fiscal cliff.” Technically, we actually did go over the cliff, however briefly, as a host of tax provisions and automatic spending cuts took effect at the stroke of midnight on December 31, 2012. However, January 1, 2013, saw legislation--retroactively effective--pass the U.S. Senate, and then later the House of Representatives. The American Taxpayer Relief Act of 2012 (ATRA) permanently extends a number of major tax provisions and temporarily extends many others. Here are the basics. Tax rates For most individuals, the legislation permanently extends the lower federal income tax rates that have existed for the last decade. That means most taxpayers will continue to pay tax according to the same six tax brackets (10%, 15%, 25%, 28%, 33%, and 35%) that applied for 2012. The top federal income tax rate, however, will increase to 39.6% beginning in 2013 for individuals with income that exceeds $400,000 ($450,000 for married couples filing joint returns). Generally, lower tax rates that applied to long-term capital gain and qualifying dividends have been permanently extended for most individuals as well. If you’re in the 10% or 15% marginal income tax bracket, a special 0% rate generally applies. If you are in the 25%, 28%, 33%, or 35% tax brackets, a 15% maximum rate will generally apply. Beginning in 2013, however, those who pay tax at the higher 39.6% federal income tax rate (i.e., individuals with income that exceeds $400,000, or married couples filing jointly with income that exceeds $450,000) will be subject to a maximum rate of 20% for long-term capital gain and qualifying dividends. Alternative minimum tax (AMT) The AMT is essentially a parallel federal income tax system with its own rates and rules. The last temporary AMT “patch” expired at the end of 2011, threatening to dramatically increase the number of individuals subject to the AMT for 2012. The American Taxpayer Relief Act permanently extends AMT relief, retroactively increasing the AMT exemption amounts for 2012, and providing that the exemption amounts will be indexed for inflation in future years. The Act also permanently extends provisions that allowed nonrefundable personal income tax credits to be used to offset AMT liability. 2012 AMT Exemption Amounts Before Act

Married filing separately $22,500 $39,375 Estate tax The Act makes permanent the $5 million exemption amounts (indexed for inflation) for the estate tax, the gift tax, and the generation-skipping transfer tax-the same exemptions that were in effect for 2011 and 2012. The top tax rate, however, is increased to 40% (up from 35%) beginning in 2013. The Act also permanently extends the “portability” provision in effect for 2011 and 2012 that allows the executor of a deceased individual’s estate to transfer any unused exemption amount to the individual’s surviving spouse. Phaseout or limitation of itemized deductions and personal exemptions In the past, itemized deductions and personal and dependency exemptions were phased out or limited for high-income individuals. Since 2010, neither itemized deductions nor personal and dependency exemptions have been subject to phaseout or limitation based on income, but those provisions expired at the end of 2012. The new legislation provides that, beginning in 2013, personal and dependency exemptions will be phased out for those with incomes exceeding specified income thresholds. Similarly, itemized deductions will be limited. For both the personal and dependency exemptions phaseout and the itemized deduction limitation, the threshold is $250,000 for single individuals ($300,000 for married individuals filing joint federal income tax returns). Other expiring or expired provisions made permanent • “Marriage penalty” relief in the form of an increased standard deduction amount for married couples and expanded 15% federal income tax bracket • Expanded tax credit provisions relating to the dependent care tax credit, the adoption tax credit, and the child tax credit • Higher limits and more generous rules of application relating to certain education provisions, including Coverdell education savings accounts, employerprovided education assistance, and the student loan interest deduction Temporary extensions • Provisions relating to increased earned income tax credit amounts for families with three or more children are extended through 2017 • American Opportunity credit provisions relating to maximum credit amount, refundability, and phaseout limits are extended through 2017 • The $250 above-the-line tax deduction for educator classroom expenses, the limited ability to deduct mortgage insurance premiums as qualified residence interest, the ability to deduct state and local sales tax in lieu of the itemized deduction for state and local income tax, and the deduction for qualified higher education expenses are all extended through 2013 • Charitable IRA distributions (IRA holders over age 70½ are able to exclude from income up to $100,000 in qualified distributions made to charitable organizations) are extended through 2013; special rules apply for the 2012 tax year • Exclusion of qualified mortgage debt forgiveness from income provisions extended through 2013 • Exclusion of 100% of the capital gain from the sale of qualified small business stock extended to apply to stock acquired before January 1, 2014 • 50% bonus depreciation and expanded Section 179 expense limits extended through 2013 This information, developed by an independent third party, has been obtained from sources considered to be reliable, but Raymond James Financial Services, Inc. does not guarantee that the foregoing material is accurate or complete. Protein Option



Beans are a good source of protein and are a healthy addition to our diet. As this recipe is written, it is quick and easy to prepare, and the exact type of beans isn’t as important as the variety. Most stores have bags of mixed dry beans that if soaked and cooked ahead could replace most of the canned beans and save some money without sacrificing taste or quality. This recipe is set up for a 7 qt. crock pot, but you can keep adding ingredients in proportions to each other and fill a 3 gallon roaster oven for a large crowd. For those of you worry about flatulence, just add a few Beano pills at the beginning of the cooking process and enjoy without recrimination.

Bill’s Bandito Beans

2 lbs. of your favorite Brats, cut into 1” pieces 1 can wax beans, drained -15 oz. 1 can cut green beans, drained -15 oz. 1 can lima beans, drained -15 oz. 1 can red kidney beans, drained -15 oz. 1 can Garbanzo beans, drained -15 oz. 1 can Black beans, drained -15 oz. 1 can BBQ baked beans with liquid -15 oz. 1 can chili beans with liquid -15 oz. 1 cup brown sugar, packed 1 cup good mild BBQ sauce 1 sweet bell pepper, diced (red or yellow add color) 1 medium onion, diced 1 or 2 jalapeno peppers, diced (seeds removed)

Add all to crock pot and stir to blend. Cover and cook on low heat setting for 3 or 4 hours, the beans are already cooked and the veggies don’t need cooking so you are just cooking to meld the flavors. If you wish to increase the recipe you can add any variety of different beans you like. If you increase the recipe you should change the other ingredients accordingly. You may want to use more BBQ sauce; if so, add it just before serving. As always, we would like to share your favorite recipes and or thoughts on nutrition. Dear Dave, My wife and I are 70, and we have $950,000 in annuities in the market, plus $68,000 in our emergency fund. The only debt we have is our mortgage. I’m considering converting our stocks to a money market account to lower the risk. What do you think? ~Howard Dear Howard, There are two sides to this. One is the asset allocation method, where as you grow older you move away from equities like mutual funds toward safer, more conservative investments like money markets, bonds and certificates of deposit. This is standard financial planning theory. I disagree with that theory, and here’s why. Statistics show that if you make it to 72 years of age and are in good health, you have a high probability of living into your nineties. If you’re making around one percent on your money market and inflation is four to five percent, then your money isn’t going to be worth a lot. You need to outpace inflation, at least with your investments, in order to break even. You might move some cash over to money markets and CDs for your own peace of mind, but I’d also recommend growth and income mutual funds along with some balanced funds. You want the entire group to be hitting the four to five percent range over the next several years, so you can at least keep up with the rising costs of gas and bread. In my mind, you’re avoiding one type of risk by moving everything to money markets, but you’re taking on a different kind of risk—the chance you’ll get tackled from behind by inflation. My advice is to balance things out so you can sleep better at night, but at a pace where you and your money stay ahead of the curve! ~Dave Dear Dave, My wife just had our first child. This definitely falls under the heading of “emergency” in my mind, so pay the bill and jump back into rebuilding your emergency fund. You’ve done a good job of saving on $25,000 a year, but let’s look around and see what you can do about making more money, too. Additional classroom education or extra training in your field could increase your income pretty quickly. Your emergency fund probably needs to be a little bit bigger as well, and it’ll be a lot easier to make this happen if you’re bringing in more cash. I’m sure you’re a hard-working guy, but the truth is it’s going to be pretty tough for even a small family to make it on what you’re bringing home now. Ramblings of a Conservative Cow Doctor

you will always have something to discuss over dinner.

Wives’ Tales Which Come and Go I really should not let this cat out of the bag because there are veterinarians who still use this old wives’ tale, but I will. For those of you unfamiliar with which end of the horse gets up first, colic is a general term referring to a pony with belly pain. Because it can be caused by things varying from gut spams to intestinal blockages to twisted segments of the bowel, horses can exhibit signs as subtle as yawning to as severe as violent thrashing. Fortunately, 90 percent of colics are minor, self-limiting gut spasms. This leaves 8 percent caused by obstructions which may, or may not pass without professional assistance and finally, 2 percent with critical twists or displacements of the gut. The challenge facing a veterinarian is diagnosing which of the three general types of colics is causing the problem. Because the odds favor spasmodic colic, ususally a little pain killer and time is all that is needed to for old Sea Biscuit to race again. Administering the pain killers keeps most horses comfortable for 12 hours; that is easy. Prescribing the proper dose of time is where many veterinarians fall back to the old wives tale by asking the owner to walk the horse to stimulate gut motility; something walking does not do. The truth is, the walking treatment is not for your horse, it’s for you. Without such orders, nervous owners tend to hang on the barn telephone calling the doctor with minute by minute updates such as, “He pooped!” or “He spoofed!” (“Spoofing” is defined on page 145 of my first book Ramblings of a Conservative Cow Doctor.) The proliferation of cell phones, and now Obamaphones for poverty stricken horse enthusiasts, means the walking colics wives’ tale has lost its desired effect, as most people can walk and talk, and drive and talk, and text and walk, and text and talk. This altering of wives’ tales brings me to my point. Taking the opposite path in politics, something which began as an absolute truth, over time became a meaningless wives’ tale; a tragedy which is destroying America. capitol, raised their right hands, and swore their Oath of Office to “support, protect and defend the Constitution of the United States and the Constitution of the State of Montana.” The instant we put the period at the end of the “so help me God” part, every issue should become, and once was, a question of constitutionality. Sadly, such is no longer the case. I have witnessed elected colleagues from the left side of the aisle dismiss challenges to the constitutionality of their positions by satirically asking, “Which constitution are we using?” This is the reasoning progressive Supreme Court Justice Ginsberg used when she recently dismissed our US Constitution as being outdated. Progressives would love to replace our constitution which purposely limits government, with one to expand government. If President Obama has an opportunity to replace a single conservative Supreme Court justice with a progressive one, the balance of power flips and our divinely inspired Constitution becomes a meaningless relic, easily erased from the history books. Tyranny will rule for centuries. Political moderates on my team side-step their oath by committing themselves to the principle of compromise. Reaching across the aisle to help the progressives redistribute wealth is held in the highest possible esteem and moderates justify their actions saying they “know how to take care of the people back home.” With every compromise, freedom fades and government grows. Sadly, less than 25 percent of elected officials honor their oath of office. Such a small percentage is horse poop and why the analogy to the old wives’ tale of walking colics fits so well. Montana’s 63rd Legislative Session has begun and I feel honored to be in the trenches with the 25 percent who truly honor their oath. In the near future, when the excrement hits the fan and it will, find those patriots, and get them on your speed dial. America will need them to lift our great constitutional republic from the ashes.
