Ramblings of a Conservative Cow Doctor by Krayton Kerns, DVM, State Rep. HD 58

Second Opinions Over my thirty years, I have practiced with colleagues who have been co-workers, employers, employees, associates, neighbors, and consultants; the last category being veterinarians who travel great distances and charge enormous fees to repeat what you just said. All doctors develop a certain practice style; something neither good nor bad, just different. As you might guess, my approach to medicine mimics my approach to politics; I am conservative. Knowing most ailments in most species will heal on their own, I resist cleaning out my pharmacy plus my client’s wallet just to give the illusion I alone am responsible for the patient’s restoration to health. At the other end of the spectrum, are practitioners who truly believe every case is but a heartbeat away from flat-lining and only through their miraculous intervention can the patient be saved. Done properly, this approach can be economically rewarding, so I really should take a second look at my practice style, but again like politics, my convictions are firm. Let me put a face with my point. On June 23rd, 1997 a client led an injured gray mare into my clinic. The patient had been racing into the corral when she took the gate corner too tight and hooked her hip on the bolt hinge which sticks six inches through the backside of the post. I am unsure why hinge bolts are so long as issued from the factory, but if you leave the extra sticking out eventually your economic loss will be your veterinarian’s economic

gain. So you understand my treatment decision, the upper body of a horse has an unbelievable ability to heal from an open wound. You could take a chainsaw and whack off enormous pieces of flesh from your horse’s chest, ribs, and hips and then treat the wound in the worst possible manner and in six months your pony will be as good as new. Somehow, this truth remains a secret. I clipped, cleaned and explored the wound. Embedded among the dangling remnants of horse flesh were fragments of hip bone, so I extracted the freefloating pieces and trimmed away the dead and dying tissue. I explained we would leave this wound open as more tissue would die over the next week due to the crushing impact from the hard steel bolt. Nonverbal cues hinted the client disagreed and wanted sutures. Horse people love sutures. In years since, as a compromise I will agree to sutures only if I can put them as far from the wound as possible, such as in the opposite leg. Few clients choose Option B. If I compromise and put in sutures, then we would be in agreement, but both be wrong; so much for the benefits of reaching across the aisle. Later that evening, the husband and wife solicited a second opinion from a doctor who occupies an approach to medicine polar opposite to mine. More of the “cold steel is the way to heal” type, he took one look and announced “this mare is suffering arterial bleeding and needs emergency surgery.” One hour and

hundreds upon hundreds of dollars later, the gray mare walks out of surgery with sutures everywhere. The next day, word gets back to me the horse owners speak lovingly of doctor number two, but are disappointed with me. Armed with logic and experience, I requested a few moments of the owners time to futilely argue my point, proving once again Mark Twain’s adage, “It is easier to fool someone, than to convince them they have been fooled.” I wish I could say the story of the old gray mare was a onetime occurrence, but that would be lying. I stubbornly and rightly refuse to let clients force me to practice medicine in a manner inconsistent with what I know to be true. However, because veterinary medicine is a free market commodity, clients can take their animals and their wallets to whatever clinic best matches their beliefs and this brings me to my point. With the full, complete, oppressive and forever implementation of Obamacare you will get whatever the compassionate doctors at the Internal Revenue Service prescribe whether you like it or not. Using the fiasco of the Obamacare sign-up launch as an example of the quality of the new health care in America, does it not scare you that from now on there will be no such thing as a second opinion? It does me.

You don’t want to pay any more in tax than you have to. That means taking advantage of every strategy, deduction, and credit that you’re entitled to. However, the window of opportunity for many tax-saving moves closes on December 31, so it’s important to evaluate your tax situation now, while there’s still time to affect your bottom line for the 2013 tax year. Timing is everything Consider any opportunities you have to defer income to 2014. For example, you may be able to defer a year-end bonus, or delay the collection of business debts, rents, and payments for services. Doing so may allow you to put off paying tax on the income until next year. If there’s a chance that you’ll be in a lower income tax bracket next year, deferring income could mean paying less tax on the income as well. Similarly, consider ways to accelerate deductions into 2013. If you itemize deductions, you might accelerate some deductible expenses like medical expenses, qualifying interest, or state and local taxes by making payments before year-end. Or, you might consider making next year’s charitable contribution this year instead.

What if you’ll be in a higher tax bracket in 2014? If you know that you’ll be paying taxes at a higher rate in 2014 (say, for example, that an out-of-work spouse will be reentering the workforce in January), you might take the opposite tack. Consider whether it makes sense to try to accelerate income into 2013, and to postpone deductible expenses until 2014. Factor in the AMT Make sure that you factor in the alternative minimum tax (AMT). If you’re subject to AMT, traditional year-end maneuvers, like deferring income and accelerating deductions, can have a negative effect. That’s because the AMT--essentially a separate federal income tax system with its own rates and rules--effectively disallows a number of itemized deductions. For example, if you’re subject to the AMT in 2013, prepaying 2014 state and local taxes won’t help your 2013 tax situation, but could hurt your 2014 bottom line. Landscape has changed for higher-income individuals Most individuals will pay federal income taxes for 2013 based on the same federal income tax rate brackets (10%, 15%, 25%, 28%, 33%, and 35%) that applied for 2012. The same goes for the maximum tax rate that generally applies to long-term capital gains and qualifying dividends (for those in the 10% or 15% marginal income tax brackets, a special 0% rate generally applies; for those in the 25%, 28%, 33%, and 35% brackets, a 15% maximum rate will generally apply). Starting this year, however, a new 39.6% federal income tax rate applies if your taxable income exceeds $400,000 ($450,000 if married filing jointly, $225,000 if married filing separately, $425,000 if filing as head of household). If your income crosses that threshold, you’ll also be subject to a new 20% maximum tax rate on long-term capital gains and qualifying dividends. You could see a difference even if your income doesn’t reach that level. That’s because, if your adjusted gross income (AGI) is more than $250,000 ($300,000 if married filing jointly, $150,000 if married filing separately, $275,000 if filing as head of household), your personal and dependency exemptions may be phased out this year, and your itemized deductions may be limited. Two new Medicare taxes need to be accounted for this year as well. If your wages exceed $200,000 this year ($250,000 if married filing jointly or $125,000 if married filing separately), the hospital insurance (HI) portion of the payroll tax--commonly referred to as the Medicare portion-is increased by 0.9%. Also, a new 3.8% Medicare contribution tax now generally applies to some or all of your net investment income if your modified adjusted gross income exceeds those dollar thresholds.

IRAs and retirement plans a key part of planning Make sure that you’re taking full advantage of tax-advantaged retirement savings vehicles. Traditional IRAs (assuming that you qualify to make deductible contributions) and employersponsored retirement plans such as 401(k) plans allow you to contribute funds pretax, reducing your 2013 taxable income. Contributions you make to a Roth IRA (assuming you meet the income requirements) or a Roth 401(k) aren’t deductible, so there’s no tax benefit for 2013, but qualified Roth distributions are completely free from federal income tax--making these retirement savings vehicles very appealing. For 2013, you can contribute up to $17,500 to a 401(k) plan ($23,000 if you’re age 50 or older), and up to $5,500 to a traditional IRA or Roth IRA ($6,500 if age 50 or older). The window to make 2013 contributions to an employer plan typically closes at the end of the year, while you generally have until the due date of your 2013 federal income tax return to make 2013 IRA contributions. Big changes to note • Home office deduction rules: Starting with the 2013 tax year, those who qualify to claim a home office deduction can elect to use a new simplified calculation method; under this optional method, instead of determining and allocating actual expenses, the square footage of the home office is simply multiplied by $5. There’s a cap of 300 square feet, so the maximum deduction under this method is $1,500. Not everyone can use the optional method, and there are some potential disadvantages, but for many the new simplified calculation method will be a welcome alternative. • Same-sex married couples: Same-sex couples legally married in jurisdictions that recognize same-sex marriage will be treated as married for all federal income tax purposes, even if the couple lives in a state that does not recognize same-sex marriage. If this applies to you, and you’re legally married on the last day of the year, you’ll generally have to file your federal income tax return as a married couple--either married filing jointly, or married filing separately. This affects only your federal income tax return--make sure you understand your state’s income tax filing requirements. • More health-care reform changes take effect in 2014: Beginning in 2014, you’ll generally be required to have adequate health-care coverage or face a penalty tax (a number of exceptions apply). A new premium tax credit will also be available to qualifying individuals.

Expiring provisions A number of key provisions are scheduled to expire at the end of 2013, including: • Increased Internal Revenue Code (IRC) Section 179 expense limits and “bonus” depreciation provisions end. • The increased 100% exclusion of capital gain from the sale or exchange of qualified small business stock (provided certain requirements, including a five-year holding period, are met) will not apply to qualified small business stock issued and acquired after 2013. • The above-the-line deductions for qualified higher education expenses, and for up to $250 of out-of-pocket classroom expenses paid by education professionals, will not be available after the 2013 tax year. • If you itemize deductions, 2013 will be the last year you’ll be able to deduct state and local sales tax in lieu of state and local income tax. DEAR DAVE, Should term life insurance be purchased based on your current earnings or future, projected earnings? ~Dan Dear Dan, I usually recommend people have 10 to 12 times their current annual income in a good, level term life insurance policy. However, if you have a solid reason to project your income jumping significantly in the near future, there’s nothing wrong with basing your amount of life insurance coverage on that figure—as long as you can afford it. Now, when I say a solid reason, I’m not talking about having an attitude of, “I’m smart. So, I’m going to make tons more money soon.” That’s ego, not reason. But if you’re in a residency finishing your medical degree, you can realistically look at making $40,000 to $50,000 for another year or two then making the jump to $200,000. That’s the kind of logical thinking and planning I’m talking about. In that scenario, a huge jump in income is almost assured. There’s nothing wrong with going ahead and getting more coverage. The purpose of life insurance is to take care of your family if something unexpected should happen to you. You don’t want to go nuts and buy too much unnecessarily, but you should have enough to ensure that they’re well taken care of when you’re not around. ~Dave DEAR DAVE, My husband and I are debt-free except for our house. I’ve been having a discussion with a coworker over how much money to allow for fun in your budget. I think $100 for a bottle of wine is okay, but she says something like that is unreasonable. What do you think? ~Elizabeth Dear Elizabeth, It depends entirely on your financial situation. Paying $100 for a bottle of wine is pretty dumb if you make only $20,000 a year. But what if you make $200,000 a year? Quit worrying and buy the wine! When you have a great income-to-asset ratio—and you’re living debt-free, have control of your money, and are saving and investing for the future—that’s the time to relax and enjoy a few things. You’ve got to take the whole picture into account. Otherwise, you’ll get caught up in the whole envy and jealousy thing. I know a guy who makes $15 million a year, and recently he bought a $400,000 car. Now, I grew up in a small town in Tennessee. I can’t wrap my head around the idea of a $400,000 automobile. But as a ratio, that’s a very small part of his income. It would be like someone who makes $150,000 a year buying a $4,000 car. That’s a good rule of thumb for determining if something constitutes an outrageous purchase. If it’s a big-enough percentage of your income to rock your world and mess with your finances, then you’re spending too much. But to say that a certain item is too expensive or an irresponsible purchase based on price alone, that’s kind of silly. ~Dave

I would like to show you some excerpts of a study recently resurrected and posted on Medscape.com. Take note of the original date of the study. Evaluation of recovered data from the Sydney Diet Heart Study, a single blinded, parallel group, randomized controlled trial conducted in 1966-73; and an updated metaanalysis including these previously missing data. Interventions. Replacement of dietary saturated fats (from animal fats, common margarines, and shortenings) with omega 6 linoleic acid (from safflower oil and safflower oil polyunsaturated margarine). Controls received no specific dietary instruction or study foods. All non-dietary aspects were designed to be equivalent in both groups. Conclusions. Advice to substitute polyunsaturated fats for saturated fats is a key component of worldwide dietary guidelines for coronary heart disease risk reduction. However, clinical benefits of the most abundant polyunsaturated fatty acid, omega 6 linoleic acid, have not been established. In this cohort, substituting dietary linoleic acid in place of saturated fats increased the rates of death from all causes, coronary heart disease, and cardiovascular disease. An updated meta-analysis of linoleic acid intervention trials showed no evidence of cardiovascular benefit. These findings could have important implications for worldwide dietary advice to substitute omega 6 linoleic acid, or polyunsaturated fats in general, for saturated fats.” I get the feeling we have been bamboozled for about the last 50 years. Now, here’s a recipe that has some healthy saturated animal fat in it. Karen Egbert of Turner fed it to me for lunch one day, and I hounded her for the recipe until she gave it to me to shut me up. I hope you enjoy it as much as I did. 1 ½ lb. ground beef 1 medium onion, diced 16 oz. can chili beans 8 oz. can tomato sauce

Frito Pie Casserole 1 envelope taco seasoning 15 oz. can diced tomatoes 2 ½ cups shredded cheddar cheese 10 oz. bag Frito corn chips

In a large frying pan with 1 Tbsp. butter, brown beef and onion. Remove from heat and add the beans, tomato sauce, taco seasoning and tomatoes, plus ½ cup of shredded cheese; stir to blend. Cover bottom of a 9x13 Pyrex casserole dish with half of the Frito chips. Spoon chili mixture on top and bake at 350* for twenty minutes. Add remaining Frito chips and cheese to top and bake another 10 minutes or until cheese is melted. Serve with sour cream (optional). For Sale: Spacious older Saco commercial building.
