Aft er oo DESPATCH & COURIER NAVAL OFFICER CHOKES TO DEATH ON BOARD INS KOLKATA WHILE TWO OTHERS SUFFER FROM SUFFOCATION AFTER CO2 GAS LEAKS DUE TO A MALFUNCTION ON BOARD THE SHIP

I

By Vishnudas Sheshrao

n another blow to the Indian Navy, a naval officer died and two other staffers of the Mazagon Dock Limited (MDL) died due to suffocation after carbon dioxide (CO2) gas leaked due to a malfunction on board INS Kolkata, the indigenously built Kolkata-class guided missile destroyer at the Mumbai Port Trust (MbPT) on Friday. INS Kolkata, whose keel was laid down in September 2003, was undergoing trials and tests for sea-worthiness and war capabilities, before being formally commissioned into the Navy as a warship. As part of trial, there was a firefighting exercise in progress on board INS Kolkata on Friday afternoon, when an unconfirmed quantity of CO2 accidentally leaked due to a malfunction in the gas chamber. A navy officer who was in the proximity of the area where the gas leaked suffered

due to suffocation and was rushed to St. George Hospital where he was declared brought dead. Officials identified the deceased as Commander Kuntal Wadhwa. Two other personnel of MDL too developed complications from suffocation. However, both are reported to be stable. CO2 extinguishes flames and some fire extinguishers, specially those designed for electrical or chemical firefighting, contain liquid CO2. International Maritime Organisation (IMO) standards also recognise CO2 use for fire protection of the ship's hold and engine room and it is standard practice in various navies across the world. INS Kolkata was supposed to be commissioned into Indian Navy in 2010, however, the project was delayed by the Defence ministry. Navy officials said, “A committee has been appointed to investigate into this unfortunate incident.”

Sassoon Library and Reading Room, an exhibition has opened, focusing on the building, using drawings, old and new photographs and text to underline its his-

torical context. The exhibition, which has been curated by Prof. Mustansir Dalvi of the College of Architecture, will be on till May 22, from 10 am to 7 pm everyday. The building, designed in the Edwardian Baroque style, is 104 years old. It was built by George Wittett, whose other iconic gems on the coty include the Gateway of India, the city museum and Ballard Estate. The exhibition itself comprises

This exhibition is a part of the centenary celebrations of the institution which is drawing heavily on its archives and books and inviting prominent architects to participate in a lecture series. The collection of drawings and old photographs detail aspects of the building that most people fail to notice, and also explain how an extra floor was added on without changing the overall look of the structure, by raising the roof as

architectural drawings and photographic documentation. When Wittet built it, 78/3 D N Road was meant to be a laboratory for ceramics attached to the College of Art, where students experimented and created beautiful pottery that achieved fame as Bombay Pottery. When the demand for this pottery declined, in 1913 it was converted into the College of Architecture and began to house the architecture course that had been started in the campus five years before.

well.Interestingly, at first the School of Architecture was only meant to train draughtsmen, who worked for European architects. Within the next decade however, the School had come into its own, and its students were regarded as highly skilled and fully qualified to design the city's office buildings, residences and cinema houses. "Art deco in Bombay is designed by Indian architects and - since it was the only school of architecture at the time - JJ alumni," says Dalvi.

That’s only for the AAP’s aggressive followers!

SALUTING WOMEN

NO MOUNTAIN HIGH ENOUGH I

n all walks of life, Indian women are proving to be as competent as, or probably better than, their male counterparts. They are definitely more hardworking, as these pictures taken by our ace lensmen AZAD SHRIVASTAV and SUSHIL KADAM attest. They are pilots who jet across the skies, or conveniently guide the monorail or trains along their tracks. They ride their bikes or drive their autorickshaws with equal aplomb. While others stand firm, guiding traffic. No work has ever been demeaning, and they can be cobblers, construction workers or cane basket makers, doing their bit, and more, to keep the home fires burning, multi-tasking it all with the travails of motherhood.

BMC’S GREEN INITIATIVE

Afternoon Despatch & Courier www.afternoondc.in

MUMBAI | SATURDAY, MARCH 8, 2014

Civic body to provide eco-friendly natural gas to Hindu crematoriums, replacing use of wood

By Khushboo Panjabi

N

atural gas will soon replace wood at crematoriums as a result of the green initiative taken up by the Brihanmumbai Municipal Corporation (BMC). The civic body intends to provide piped natural gas (PNG) or compressed natural gas (CNG) as these fuels are environmentally cleaner, eco-friendly and cheaper too. According to the civic officials, the shift to natural gas will be environment-friendly in more ways than one, with the decline in dependency on wood going a long way in saving the green cover. The use of CNG or PNG in crematoriums will be effective in reducing air pollution. The major advantage of natural gas is that the furnace needs to be switched on only when required. The standing committee on Wednesday had cleared the pro-

posal to reimburse gas supply bills of three private Hindu crematoriums in Ghatkopar (east) – Rs.3.50 lakh, Mulund (west) – Rs.7 lakh and Banganga – Rs.3.50 lakh. The BMC spends Rs. 2,000 per funeral on firewood in private crematoriums. The use of CNG will drastically reduce this expenditure to Rs. 630 per funeral. However, a senior civic official said, “The private crematoriums should fulfill certain conditions to avail free gas supply. The trust running the private Hindu crematoriums should install and maintain gas pyres on their own. There should be a separate gas connection for the pyre.” In all, there are 182 crematoriums in the city, out of which 136 belong to the civic body, while 46 are private. Out of these, seven are joint crematoriums where funeral services of Hindus, Muslims and Christians are held.

Members of the Police Reforms Watch at a press conference held at the Mumbai Press Club, on Friday. Continued from pg 1 « said Julio Ribeiro, retired Mumbai police commissioner, who along with the Police Reforms Watch (PRW) and the Commonwealth Human Rights Initiative (CHRI) has strongly urged that the Maharashtra Police (Amendment) Ordinance 2014 (promulgated by the Governor on February 1) should be made to lapse, as it fails to follow the scheme as laid down by the Supreme Court directives on police reform. To insulate the police from unnecessary interference, the Supreme Court had recently ordered each

state to create a multi-member State Security Commission. The Commission’s recommendations had to be binding. PRW is an umbrella of various voluntary groups and activists committed to monitoring the implementation of police reform and to facilitate advocacy and interactive engagement at the level of the government, police, media and citizens. “We call on the State Government to draft a comprehensive new police law for the state,” Ribeiro said. Maja Daruwala, Director of the Commonwealth Human Rights Initiative, spoke of how Maharashtra

had been totally reluctant to comply with the Supreme Court directives on police reforms for which it was criticised and pulled up by the apex court in 2010. She says, “Pushing through this Ordinance in its current form will be a huge mistake. It is a weak cosmetic sop which in the guise of “reform” only entrenches political control over policing. The need now is to press the state government to initiate a wide process of public consultation to draft a new Police Act for the state. The people of the state must have a say in their police law. Policemen and women of all ranks must be able to give inputs for this law. This is the only way forward”. Dolphy D’Souza, Convenor of Police Reforms Watch, Mumbai said, “This Ordinance must lapse and not be brought back. We need reformed and improved policing that is fully accountable for everyday performance and all wrongdoing. Police reform cannot be done behind closed doors by a small set of bureaucrats and politicians. Wide public participation is essential for democratic police reform”. philip.varghese@afternoondc.in

The voter population in the island city district which was 27 lakh in 2009 has now decreased to 23 lakh. She attributed the phenomenon to migration of city voters to Mumbai Suburban district and other neighboring districts. As per the 2011 census, the decedal growth of population in the island city has shown a negative trend. Besides, many infrastructural projects have seen people being rehabilitated to the suburban districts. In all, names of 6,54 lakh voters have been deleted in three phases since 2013. The Mumbai City district has two Lok Sabha constituencies of Mumbai South and Mumbai South-Central.

Naik lambasts Mumbai Cong-NCP MP's Storm brews between BJP-Sena for under-utilising MPLADs fund By A Staff Reporter

F

ormer BJP MP Ram Naik yesterday lambasted five Congress MPs and one NCP MP from Mumbai for not spending Rs.42.90 crore out of the total MP Local Area Development Fund (MPLAD) allotted to them thus depriving Mumbaikars of local development works. Speaking to newspersons here he argued that the six Congress-NCP MPs were allocated Rs.19 crore MPLAD Funds each in the last five years. However, they spent just Rs.11.85 crore. Naik stated that the MPLAD funds are meant to be used for works like constructing public libraries, community halls, providing computers in

closed that the allocation and disbursement of MPLAD Funds is done by the department of Programme and Implementation of the Parliament. Naik said that each of the six MPs failed to utilise Rs.7.15 crore from the Rs.19 crore fund. He added that the six MPs owe an explanation to Mumbaikars. Naik stated that the funds are directly sent to the district collector who allocates them according to the proposals put up by the local MP. The BJP MP Ram Naik senior BJP leader argued that as per the principle of acschools, gymnasiums and countability to the voters, other works of public use these MPs must explain which otherwise cannot be within a week as to why they executed by the government. failed to utilise their funds The senior BJP leader dis- fully.

S

torm is brewing between long standing saffron allies – the BJP and Shiv Sena over contesting the ensuing March 20 Legislative Council elections. Speaking to newspersons here yesterday, leader of opposition in legislative council Vinod Tawde remarked, “Sena did not consult us while fielding two candidates for legislative council elections. We sacrificed our Rajya Sabha seat for them, but they have not sacrificed one legislative council seat for us”. Earlier in the afternoon, Tawde along with Mumbai city unit president and MLC Ashish Shelar called on Maharashtra Navnirman Sena (MNS) chief Raj Thackeray at

his Krishnakunj residence in Dadar to enlist his party's support for the MLC elections. Speaking to newspersons later, Tawde stated that the BJP is falling short by 15 votes for its second candidate and hence they had called on the MNS chief whose party has 12 MLAs in the lower house. He clarified that they had not gone to ask the MNS chief to not field candidates against the BJP-Sena candidates. Former party president Nitin Gadkari had met Raj Thackeray earlier in the week regarding this. Replying to queries over the party's attempt to woo MNS to the BJP-led NDA fold, Tawde suggestively re-

marked that “one would see the political situation after the Lok Sabha elections changed.” Replying to queries over his own candidature for the legislative council elections, he said that if the party is able to manage the required quota of votes then he would not contest the polls. If the party fails to do so, then he might decide on contesting to leverage his position to enlist support from other political parties. He added that he was also planning to meet Samajwadi Party state president Abu Azmi, Jana Surajya Shakti president Vinay Kore, PWP leader Jayant Patil to enlist their support for the two candidates for the legislative council elections.

Cong list of candidates for LS poll delayed due to internal bickering By A Special Correspondent

G

rowing disputes among the leaders has forced the Congress to hold the list of their nominees for the Lok Sabha elections in the state. Internal bickering and disagreement over many names has left screening committee in a quandary delaying the announcement. Significantly, all other parties, the BJP, Shiv Sena, NCP and even a new outfit Aam Admi Party (AAP) have declared most of their candidates. The dispute is over 10 out of the total 26 seats that the Congress will contest in the state. The list is in the last stage of finalising

before the screening committee. The release of the names has been put on hold by the party high command. There were disputes over the nominees for Pune and Nanded. Suresh Kalmadi, who was involved in the multi-crore Commonwealth Games scam, is insisting that either he or his wife should be considered for the Pune seat. He is mounting pressure on the party and on the other, Congress VP Rahul Gandhi has taken a firm stand against such leaders. Rahul has made it clear that candidates involved in scams should not be considered. At the same time, Ashok

Chavan's demand for nomination from his hometown Nanded was another problem that the party faced. Chavan apparently feels that either he or his wife, Amita, should be considered. The governor refused permission to the CBI to prosecute Chavan for his involvement in the Adarsh case. From South Mumbai Milind Deora is set to be renominated, from North Central Priya Dutt and from North West Gurudas Kamat, but from North Mumbai and South Central Mumbai, no decision has been taken. In South Central, while sitting MP Eknath Gaikwad is

likely to be renominated, Mumbai university former vice-chancellor and Rajya Sabha member Bhalchandra Mungekar has been trying his best for nomination. This matter has reached the Congress president's 'court'. In North Mumbai, there appears to be uncertainty over renomination of Sanjay Nirupam. In Wardha, sitting Congress MP Datta Meghe has sought nomination for his son Sagar, while Charulata Tokas, daughter of late Prabha Rau, has also staked her claim. In Nagpur, besides sitting MP Vilas Muttemwar, Minister of State for Finance Rajendra Mulak is also in the fray.

For Kejriwal, zero success in Gujarat A

am Aadmi Party (AAP) leader Arvind Kejriwal wants the red carpet rolled for him wherever he goes across India. He wants all doors to open, heads of state to set aside their busy daily schedule and meet him if he asks for a meeting. It is clear he is a politician who thinks a lot about himself. He was disappointed when BJP's prime ministerial candidate and Gujarat Chief Minister Narendra Modi did not respond immediately after he asked for a meeting. Modi said a meeting can be held only if an appointment is made, Modi must have evidently had several engagements for the day – appointments fixed days before. He said he had no time to meet Kejriwal. The latter must have been quite shaken by the 'insult' hurled at him. Kejriwal comes in a convoy of ten cars and proceeds towards the residence of the chief minister. He is stopped by the police in Gandhinagar. The police rightly told him that when he makes an appointment, they will let him see the chief minister. Arvind Kejriwal has been in Gujarat for three days and during this time he has claimed he has made extensive study and found that all is not well with Gujarat, there is no development and governance, farmers' land is forcibly taken away and given to industrialists. According to him, Modi has lied to him about growth and governance in Gujarat. After making all these charges against Modi, how could he have expected a quick meeting with him? What is possible, however, is that Kejriwal knew that Modi would be upset about what he had said and would not meet him. Kejriwal's unsuccessful Gujarat tour has shown that the only place where the Aam Admi Party has some support is in Delhi. The AAP defeated only the Congress party in Delhi. People regarded the Congress as corrupt. AAP demolished the Congress, but not the BJP. People replaced the Congress with the AAP, but BJP got more seats than the AAP. The AAP does not have a ghost of a chance of defeating the BJP in Gujarat. It is only perhaps in Uttar Pradesh where the political scenario is chaotic and where freak wins can happen that Aam Admi Party may get a seat or two!

G. RAMACHANDRAN was a very popular chief minister of Tamil Nadu. He was a fierce champion of Tamil-speaking people of Sri Lanka. It was a well-known fact that he was providing secret assistance to the Liberation Tigers of Tamil Eelam (LTTE), the Tamil-speaking rebels who were involved in a war with the Sri Lankan government. Before he took over the rule in Tamil Nadu, he was a successful, popular film hero. He was admired by many women. At that time, there was a young actress – quite beautiful, successful and slim. As in Bollywood today, heroes and heroines used to have close connections. M.G. Ramachandran and this beautiful, successful, slim girl had a lot of rapport – screen rapport. That girl is today the chief minister of Tamil Nadu. Jayalalithaa Jayaram – there was only a single “a” in the name then – Jayalalitha. And today she is beautiful, successful and – fat. She is making waves in the political scenario. She is hell-bent on becoming the Prime Minister of India. And she seems to be quite confident that she can make it. She has promised people across the country with many freebies. It is amazing how she has done that. There is little doubt that she could look like a prime minister should, but she will find it difficult to win over people and parties for her prime ministerial endeavour. She caused a big surprise when forged an alliance with the Communists – CPI and CPM. From the start, it was known that the two could not get on together. She fell perhaps into the prime ministerial trap which the Communists laid for her. The Communists knew that as a national party, they do not have any chance – by themselves. They must have promised to make her the prime minister. What brought about break-up between 'Amma' (as she is popularly known in Tamil Nadu) and the Communists is not known, but one fine morning there was announcement that the alliance had fizzled out. Jayalalithaa seems to have now new supporters: West Bengal Chief Minister Mamata Banerjee has openly supported her as the PM. In the next few days, we will know about the new alliance which Jayalalithaa has forged. Another politician – former chief minister of Uttar Pradesh – has also hinted she would join the alliance. The three women may not be ruling India, but they can have at least strong, effective opposition group in Parliament. It would be quite good perhaps if the President, Prime Minister and the Chief Justice are all women.

Many years ago she’d told me ‘Bob, you’re so lucky, you have three mothers!” She had meant my mother, her elder sister and herself. yes I have been well loved, but that’s not the only thing that comes to my mind as I sit here reminiscing about an aunt who I loved so very much: What comes to my mind is an evening I spent with her a few years ago. “Aunty Margie,” I’d asked, “Do you know how much you’ve helped my mother and each one of us her family?” My aunt had looked at me with a smile and shook her head. “Do you know how you opened your home to the four of us when my father’s business had collapsed? How even though your house wasn’t a palace you made room for your younger sister’s family, even giving up your bedroom for us?”

Cong is not a party, it is an ideology: Rahul “THE Congress is not a party, it is an ideology” – Thus spoke Rahul Gandhi. The Congress party like all other political parties is involved in alliances with parties with vastly different ideologies. In fact, no party has any ideology. A major part of this ideology appears to be corruption. Three leaders who have been found corrupt – with positive proof – are being given poll tickets by the Congress party. Kalmadi's wife, Bansal and Ashok Chavan. They appear to have stopped at giving ticket to Kalmadi, but they are giving it to his wife. The last minute effort by the Congress to wipe out the corruption taint is pathetic. What is most surprising is that the party is providing now more proof of corruption. The BJP is not giving up the corruption charges. As it is, the voter in the country is against the Congress. It is to be seen whether he will be able to change the image of the Congress. If he goes on talking about ideology, there is little chance of his bringing about a U-turn for his party’s ideology.

AAP's accusations and fights THIS refers to your editorial 'Poll scenario: Avoid accusations sans proof' (ADC, March 1) which sends out a timely warning to politicians "to exercise restraint and not think that in elections too, all goes well like in war". You have rightly drawn attention to the fact that the AAP chief "has been firing charges not only against politicians, but also against industrialists and business folk without a shred of proof" and has said that it was time somebody took him to court. LIKE Mumbai University, even the Maharashtra State Education Board is erring time and again, and has put students under unnecessary pressure. Getting a hall ticket with errors is indeed worrisome. First of all, getting a hall ticket is a difficult proposition, and then getting one with errors adds to the tension of the students. In addition to this, Mumbai University's time tables and test centre allocation is also in disarray. Tension is mounting up from the word go, as the centres allotted may be in a remote place and reaching the spot will not be easy during the examinations. Again, the address of the centre may not be complete, and searching for the place on the day of the examination will be an ordeal. Throw out anti-national elements SEDITION charges against some Kashmiri students for shouting anti-national slogans against our country while cheering for the Pakistan team at a Meerut College is apt, and one wonders why it is unacceptable to J&K CM Omar Abdullah who has protested against it. Pakistan played better cricket against our team, and we as a sports loving nation acknowledge it. But staying in our country and shouting pro-Pakistan slogans, while abusing our nation is unacceptable, and

those found guilty should be severely punished. Why don't such people cross the border and become Pakistani citizens if they are so fond of that nation? Also, people like Omar Abdullah have always shown moral support to certain section of people fron the valley who indulge in anti-national activities on the flimsy grounds of humanity and morality. Omar Abdullah loves to be in the news and people should not take his views seriously.

APROPOS 'All set for Lok Sabha poll' (ADC, Mar 6), the edit piece reveals certain important aspects of the ensuing Lok Sabha (LS) polls in India. The Election Commission (EC) is apprently apprehensive about conducting polls in sensitive locations like J&K, where militants or hard core terrorists may upset the apple cart of the elections taking place smoothly, if the security system is not foolproof. This is the same in Jharkhand, where Naxals or Maoists may get involved to jeopardise the polling. If this is not enough, the EC also has to assess the expenses incurred by candidates, in order to check whether they spend as stip-

ulated, or flout regulations. An apt mechanism needs to be in place to detect any over spending by a candidate, as it will lead to illegitimate expenses. The other most important point is that each contestant's candidature is required to be thoroughly examined to ascertain that he or she has never been involved in corruption, rape, murder or any condemned act, as currently, many such tainted elements exist in the government. FILM REVIEW

What A Waste

Gulaab Gang

At: Cinemax and other cinemas Directed by Soumik Sen Cast: Madhuri Dixit, Juhi Chawla,Tannishtha Chatterjee, Divya Jagdale, Priyanka Bose and others Rating: ½

T

here is a scene in Soumik Sen’s Gulaab Gang, in which a female politician wants to humiliate a minion, and makes him crawl between the legs of a woman, who stoically lifts her sari and spreads her legs—makes you wonder just who is

being humiliated here and why. In another scene, a bunch of vigilante women want to punish a man, so they make him wear a sari and dance, underlining the common notion that there’s no worse insult for a man than to be called a woman. So how come this film dares to say that it espouses the cause of women? The film does take its idea of a gang of pink sari clad women from Sampat Pal’s much documented and feted Gulabi Gang (see Nishtha Jain’s superb documentary released last month), but then goes on to make complete hash of it. Sen’s film has no sense of the region, the problems of rural women or even how the system functions in the vast Indian mofussil belt. All he does is collect a gang of women in pink homespun saris led by Rajjo (Madhuri Dixit) in lowbacked ikat blouse, break into dance or get into totally unbelievable action sequences. Just who is this Rajjo (there is a

clumsy flashback about a kid determined to study and her nasty stepmother torturing her) and what she is all about, you never know. Why this woman who is not even known to the collector of the region is such a threat to an all-powerful politician Sumitra (Juhi Chawla, dressed like Sushma Swaraj) is not clear either Once in a while a woman is battered, raped or killed, the man is attacked by the Gang (Chatterjee, Divya Jagdale, Priyanka Bose, etc) and elsewhere, Sumitra sneers or snaps at her cowering followers. There is not much plot, no character development, and certainly no social comment. Juhi Chawla steals every scene she is in, while Madhuri Dixit struggles with an ill-defined role; her only brief seems to have been “be a heroine” so she wears an ‘R’ shaped bindi, lots of kohl, sets her hair in waves and has a kid pay tribute to her stardom by humming “Ek Do Teen.” The best bits of this film are in the promos— that’s all there is to it.

GRAVITY Rs. 599/Cast: Sandra Bullock, George Clooney Director: Alfonso Cuaron

G

RAVITY won seven Oscars last weekend, and though there are many who find the film slightly boring, it has a great message behind it. Space missions are taking place almost every year, and thanks to all that, we have GPRS and the latest technology in place. But no one has really thought about the damage that space missions do when they leave tons of trash behind in space. By this we mean junk, usually harmless, which when left unattended can run into other junk or space shuttles and cause a huge catastrophe for future space missions. This then is the bottom-line of Gravity that takes a look at the debris left behind by space missions and how dangerous it can be for astronauts in the future. The movie is also a great education tool for youngsters. Veteran astronaut Matt Kowalski (George Clooney) and first time astronaut/scientist Ryan Stone (Sandra Bullock) are busy fixing an extended arm of the Hubble Space Telescope. Both are doing their job and at the same time having a whale of a time enjoying the view of Earth. Kowalski and Stone also share a few jokes with their counterparts down in Houston. Suddenly Houston issues a warning to abort the mission and return to Earth. The reason is that

ilmmaker Subhash Ghai is unperturbed with the failure of his recent films and says a lot of hard work goes in the making of movies which do not succeed at the box office. Ghai, 69, has given some memorable films like 'Kalicharan', 'Karz', 'Hero', 'Karma', 'Ram Lakhan', 'Saudagar','Khalnayak', 'Taal' and 'Pardes'. But, his last few films like 'Kisna', 'Black and White' and 'Yuvvraj' failed to create magic at the box office. "I make a film only when the subject touches my heart. Every time I

deliver a flop the media says my career is over. When 'Krodhi', 'Kisna' released they said the same thing but I bounced back every single time. Everyone goes through ups and downs. There is a difference between a film that doesn't work and a bad film," Ghai said. "We need to believe in ourselves rather than to listen to what other people say about us. I will keep making films till my heart asks me to stop. No film is good or bad. Some films work, others don't. Re-

POOR

member, even films you label as 'bad' have been made with a lot of hard work," he said. Ghai feels these days a lot of women-centric films are being made as the social awareness of the people has grown. "Due to education and growing social awareness, everyone is trying to create awareness and that is why we see so many films made on women. My films like 'Ram Lakhan', 'Taal', 'Pardes' and others had women playing a central role. The girl's strength should come out

the Russians who sent a rocket to destroy one of their own malfunctioning satellites has blasted and the debris from the blast is heading their way. Before Kowalski or Stone can make it inside the space shuttle, chunks of satellite hit and destroy the spacecraft and kill the other crew member. With the shuttle destroyed, Kowalski and Stone try to reach a Russian space station over 1500 kilometres away, where they hope they might get a chance to make it on a life pod. But oxygen in the astronauts’ suits is low. Will Kowalski and Ryan make it to the Russian station and return back to Earth or will they perish in space? Starring Rishi Kapoor, Mithun Chakraborty, Chandan Roy Sanyal and newcomer Mishti, the film's trailer was launched here last evening. "I have made this film with lot of passion. The trailer will tell you that it is a typical Subhash Ghai film. It has romance, social cause, concept and masala," he said. 'Kaanchi' is set to hit theatres on April 25 and Ghai insists he did not plan to release it during the elections. "I never make a film keeping the release date as a target. It is just a coincidence that it is releasing during elections," he added.

LEGAL

Your society’s secretary can inspect your flat for repairs

MUMBAI | SATURDAY, MARCH 8, 2014

EXPERT SPEAK Gajanan Khergamker

is a media-legal consultant on Housing, Intellectual Property, Medico-legal, RTI and Consumer Law issues

CONSUMER FORUM ORDERS CHS TO COMPENSATE FOR ‘DEFICIENCY’ IN YET another landmark decision, a consumer forum has ordered a cooperative housing society in Mumbai’s Chembur to pay nearly Rs one lakh in compensation to a member. Interestingly, the compensation paid for “the damage caused to his flat by renovation in the flat above.” The decision will have serious ramifications in societies across Maharashtra while heralding the way ahead as a valid moot point for others all over the nation. While the legal process is perceived as being long drawn and cumbersome, dissuading most cooperative housing society members from moving court to avail justice, the members also consumers of a service provided by the cooperative housing society can move consumer forum. In this case, the forum held the society guilty of deficiency in service because neither did it take any action against the flat owner who caused the damage nor did it make any attempt to recover costs from him. It said, “There is no doubt that since the complainant was a member of the society, he was its consumer and the society was a service provider. It is responsible to pay the complainant.” The compensation to be paid by the erring society, Mithul Enclave Housing Society Ltd, includes Rs 55,000 as repair costs and Rs 44,500 for litigation costs, mental harassment and as interest. In the complaint filed before the Additional Mumbai Suburban District Consumer Disputes Redressal Forum, Bhimrao Jogdand said flat owner Bhalchandra Patil began extensive renovation inside his flat in 2006 resulting in leakages in his flat below. On August 24 that year, Jogdand wrote to the society about the problem. He informed Patil, too, and sought reimbursement of the repair costs. In May 2007, as is usually the case with cooperative housing societies across Mumbai, the society told Patil he was responsible for the damages and would have to compensate Jogdand. Patil did not and the society absolved itself of all responsibility. Jogdand finally sent registered notices to both in 2009 yet got no response. He then filed a complaint. The society and Patil filed independent replies denying the allegations. Both claimed Jogdand’s flat was damaged because it had been lying unused for long. After taking into consideration photographs of the damaged flat submitted by the complainant along with copies of the correspondence, the forum accepted that the renovation had caused the damages. It also observed that despite notices, the society made no attempt to stop the work in Patil’s flat and neither did it complain to civic authorities. Hence, the society was guilty of deficiency in service and would have to compensate the member for the losses suffered. For members who suffers losses due to inaction on the part of the cooperative housing society’s managing committee which choses to look the other way each time a civic anomaly occurs and a member goes about making structural changes causing damage to others, the decision is a precedent of sorts. The Jogdand’s decision is a case in point when it comes to deciding similar matters. Queries may be mailed to gajanan@draftcraft.in

Following letters of repair works pending in my premises, the society’s secretary has said he will be checking my flat for need of repairs with two other managing committee members as he is empowered to do so under the law. My query is, can the secretary come inside my home to check on repairs, by law and who will have to bear the cost of the repairs? - Vasant Gala, Mulund

According to bye-law number 156, every member of a cooperative housing society should allow the secretary of the society to examine his or her flat to check and report about repairs that need to be undertaken. The secretary of the society can be accompanied by any other member of the committee to ascertain the amount of repairs that need to be carried out in a member’s flat. After carrying out such examinations, the secretary should make a report to the committee indicating within it the particulars of the repairs that need to be carried out by the society at its cost and those by the members at their cost. Besides the secretary of the society no other society member has the right to violate the privacy of other members by asking for an examination of his or her flat. Once the managing committee of the society receives such a report, the committee should ascertain the cost involved in the repairs that are required to be carried out by the society as specified under bye-law number 160 (a). The committee can then issue a notice to be served to the concerned member to announce their intention to carry out such repairs. The member concerned should allow the workmen – engaged by the society directly or through its architect – access to his flat for the purpose of carrying out repairs. If the concerned member fails to provide access to such workmen without any reasonable or convincing reasons, the secretary of the society has the authority to enter into such flats and carry out the work under the supervision of the member of the committee duly authorised by it in that behalf or the architect appointed by the society. Very often though, there are many repairs that need to be carried out by members at their own cost. In such cases, the committee can serve a notice to the concerned members. The notice should clearly indicate the particulars of the repairs necessary to the member’s flat and call upon the member to carry out the repairs in his flat this own cost and to the satisfaction of the architect approved by the society. The notice can also include a time period within which the concerned member should carry out these repairs. If a member fails to comply with the notice, the secretary of the society or the architect appointed by the society has the right to enter into such a flat and cause the repairs to be made after giving due notice to the member concerned. The amount spent by the society on such repairs would then be recoverable

APPROACH CONSUMER COURT TO ENSURE DELIVERY! Can one approach a consumer court to ensure a builder pays compensation to a flat purchaser? What are the duties of a builder? - Kanti Shah Consumer Courts have directed builders / developers to pay compensation to flat purchasers on account of failure of the builder to complete their statutory obligations. Flat purchasers have paid huge sums of money to acquire flats and despite paying full amounts to builders, builders do not comply with their statutory obligations. It is the duty of the builder to: Give Statement of Accounts. At times the accounts submitted by builders are bogus. Work done at site and expenses like salary are billed to the society. It would be in the interest of the society to minutely scrutinise account statements given by builders. Submit the building completion certificate. On an average, 95% of buildings may not possess the building completion certificate. Execute the conveyance of property in favour of the cooperative society. Hand over the original documents of title and property to the society. As per the provisions of the MOF Act, the builder / promoter has no right to accept more than 20% of the sale price before executing a written agreement. The written agreement must mention (a) Date by which the possession will be given, (b) Carpet area of the flat, (c) Percentage of undivided interest in com-

mon areas and facilities, (d) Title Clearance Certificate, (e) Property Card or extract of record of right, and (f) Plans and specifications of the flat as approved by concerned local authority. Disclose carpet area of the flat in advertisements issued by builders. In a landmark judgement of M/s Sharma Properties Pvt Ltd v/s Prerna Cooperative Housing Society Ltd delivered by the National Commission in 2003, a builder was directed to pay a sum of Rs 7,50,000 plus Rs.250 per week till he obtains the Occupation Certificate. The Metropolitan Magistrate Court at Andheri passed an order sentencing the builder to six months simple imprisonment. The Metropolitan Magistrate while delivering the judgement in the case of Torana Cooperative Housing Society Ltd V/s Shri Hiraji Dinanath Jamsandekar and Smt. Hemlata Jamsandekar held that one of the purposes of this punishment was to send a clear signal to persons who are hold a similar intention. Office bearers of the society should call upon the builder to comply with the statutory obligations and if necessary can initiate action against the builder for his various acts of omissions and commissions. Very often, when a property is being developed, the builder insists on financial compensation to give NOC for TDR matter. However, if the purchasers are united and take steps to obtain the conveyance, they stand to gain in the long run. Cooperative societies should make it a point to complain either to the Housing Department, Maharashtra and / or the office of the Police Commissioner and / or the Crime Branch if the builder has not complied with the above said statutory obligations.

TetraVex is a challenging brain teaser. The object of the game is to fill the grid with the tiles so that the patterns on the adjacent edges of each tile match, much like aligning domino tiles. The object of the game is to place all the tiles in the grid so that the figures on the adjacent edges of each tile match. You can place any tile anywhere in the grid, but you cannot place a tile in the grid if its edges do not match all of its neighbors. Find a digit that occurs only once on a given puzzle. You know that this digit must lie along the outer edge of the grid, since there are no other tiles that can match it. You can simplify solving by cutting out the nine squares and juggling them in the grid.

Seeta Patel, Aditi Dhumatkar and Mugdha Joshi receive Hokey Pokey's Woman Icon of Sport Award from Indu Shahani.

‘Indian swimmers are breaking barriers’ Aditi Dhumatkar has been upping her tally of medals in the pool ever since she competed in various swimming contests. Currently holder of three national records who has won 45 gold medals at the national level, the freestyle swimmer from Bandra is getting ready for the eagerly awaited Commonwealth Games and the Asian Games later this year. Aditi spoke about being the fastest swimmer in Maharashtra, breaking numerous records in the pool and her future in swimming.

How does it feel to hold so many national and state records ? It actually feels really good. It's the fruit of hard work and it's a feeling of great accomplishment. It is very motivating to go one step further and improve your own records. It's like I have already done this, I have to do better it. It is a source of motivation and it also gives you a sense of achievement. Do you feel there is lack of competition in the Indian arena?

S

There is definitely lack of competition among people my age in Mumbai, but the younger lot is coming up really well. So they are challenging me and also my coach says ‘Never be satisfied with what you achieve’. So here in the city, there is lack of competition but there is a lot of competition in the country.

Recently you completed 5000m in just 59:52 minutes at Khar Gymkhana. How does it feel to become the first Indian women to complete 5000m within an hour? It is not something I expected to do. I am a sprinter and a middle distance swimmer, but my coach has trained me so well that I completed within one hour. After I completed 4000m I looked at the clock and thought I can break the record and I challenged myself . I felt really good because my coach is someone who rarely praises me and he said I surpassed his expectations and that was the icing on the cake. Will India secure a medal in swimming in Commonwealth Games?

Why not? Every year Indian swimmers are breaking barriers, we are pretty close to international level swimmers. So a medal is a possibility in the near future. Is the environment conducive for women swimmers who are pursuing this sport? Our federation is pretty gender neutral and it is performance based. So if you do well, they help you. If the federation makes better use of pools like Balewadi [Pune] for training it would help in the development of swimming.

Who is you idol? From the swimming world I don't really have an idol and especially as it is Women's Day among Indian athletes I look up to Saina Nehwal and Mary Kom.

What international events you intend to take part in this year? There are some events coming up in Dubai and Singapore and I want to perform my level best. I also want to make it to the Indian contingent for the Commonwealth Games.

15-year-old Seeta Patel is a gold medallist at the Commonwealth Karate Championship in Edinburgh which spurred her on to bag medals at most of the Gojukai Championships. The young lass speaks about how the sport has helped women protect themselves and made them strong to take on the world in an otherwise male dominated bastion.

How does it feel to be a winner at the Commonwealth Karate Championship? It feels amazing. I was told that my gold medal at the Commonwealth Karate Championship is one of the first. It is one of the moments I will never forget in my life an it will stay with me for ever.

How is the federation encouraging women to take up karate? The federation is doing more than enough to encourage women. We have so many girls who take up this sport. There are so many girls from my school, there are so many girls from all over Mumbai who have taken up this sport.

How does karate help women? It helps you in many ways. It teaches women to be more powerful, it teaches you discipline and to stay calm. Who is your idol? Me in five years.

What is your message for all women on Women's Day? Make your self heard. There is no one hear who can stop you. You need to empower yourself, believe in yourself and know that you are capable of everything.

Entry in the national squad is my goal: Mugdha

he is among the brightest players Mumbai has to offer, skippering the Mumbai twenty 20 side to a convincing victory over Delhi during the Inter State Twenty 20 competition which concluded last month in Mumbai. Mugdha Joshi won praise for her leadership skills despite having a paltry outing during the season. Speaking on her leading the Mumbai side to victory, Joshi said that it was a team effort

which helped them get the hands on the trophy. “It was really a team effort. The team combined well according to the situation and we won,” said Joshi at a felicitation function at a Hokey Pokey outlet in Churchgate on Friday. Despite India lagging behind countries like Australia and England in international cricket, the young lass from Ahmednagar said that Indian cricket is slated to prosper in the coming years. “I

think the BCCI [Board of control for cricket in India] is doing a lot for women's cricket and in the coming years women's cricket is slated to prosper,” she said. While the ultimate dream of a budding athlete is to play at the highest level, Mugdha too didn't mince words while speaking about her ultimate ambition. “Some day I want to be selected in the national squad,” added Mugdha who idolises Australian skipper Michael Clarke.

On the eve of International Women's Day she said that the stereotype of parents not allowing their children to mix education with sports should be left in the backyard and put forth the case for young girls taking to sports at an early age. “I feel sports is good for all of us. Girls enjoy playing sports and would hope young girls pick up a sport early in their career,” said Joshi who is currently pursuing her chartered accountancy.

VENGSARKAR CALLS FOR THOROUGH INTROSPECTION IN OVERSEAS DEBACLES SPORTS

MUMBAI | SATURDAY, MARCH 8, 2014

UMBAI: Former chief selector of the Indian team, Dilip Vengsarkar has called for a fresh introspection in the string of losses overseas by Indian cricket team where they were humiliated by England, Australia, South Africa and New Zealand after returning winless in all those tours. The former Indian skipper said that coach Duncan Fletcher has disconnected himself from the local tournaments in India and does not have confidence in the newer lot who have been chosen by the BCCI selection committee. Vengsarkar said in the upcoming five-match Test series against England after India suffered a complete 4-0 white-wash at the hands of the English, the current situa-

tion of the Indian team was a matter of 'huge concern'. “It is disappointing since we have lost everything abroad and he hasn't been here to watch local fixtures because unless and until he knows which players are doing well in the domestic cricket, only then he [and the team] will be able to perform. But he has only been there for the international matches, after the event [is over] he goes back home. I don't know what is there in the contract, if he has to watch or not local matches. Ishwar Pandey has not been watched by him hence he has not been picked. It is important that the board includes that coaches should watch local matches in their respective contracts contracts,” Vengsarkar said on the sidelines of the unveiling of the Twenty 20 Cricket World Cup at the Bombay Gymkhana on Friday. “It is a matter of huge concern because India will be playing five Test matches in England and that is going to be tough for India,” he added.

INDIAN BOWLERS LOOK TIRED With poor show by the pacers overseas and their inability to extract purchase from the wickets, Vengarkar said the overworked bowlers looked 'tired and jaded' and what India needed was a fresh pace attack who would bring in results. “Same bowlers are bowling in all forms of the game. We don’t have options. Our bowlers look tired and jaded. We need bowlers who are fresh and who will do well. You have to have options for everything but unfortunately we don't have options at that level,” he said.
