ith the sudden discovery of a third mobile belonging to murder victim Esther Anuhya on Friday, the investigations have moved on to a a new track. On Friday, the Government Railway Police (GRP) of Kurla came across the third mobile inside the flat she was staying in at Andheri. Esther's body was discovered on January 16 in the Bhandup creek which comes under the jurisdiction of Kanjurmarg police station. “Interestingly, the usage of this particular mobile by the deceased was not even known to her family members,” said Shivaji Dhumal, senior inspector of Kurla GRP. This makes the police suspect the role of another person known to Anuhya, in the

BMC plans to tap energy from garbage at 3 plants

CP chief and Union Agriculture Minister Sharad Pawar has shown himself as having modest livelihood while filling his nomination papers for the biennial Rajya Sabha elections due to be held on February 7. Shiv Sena’s Rajkumar Dhoot has been wiser of the lot who has shown Rs 1 crore liabilities in the name of his wife. As against this second NCP candidate and noted criminal lawyer Adv Majeed Memon has shared the liabilities of Rs 1 crore along with his wife in his affidavit. But amongst the three who have filed their nomination papers yesterday, Pawar has total assets worth Rs 32 crores, Memon Rs 23 crores and Dhoot Rs 19 crores. Pawar (73 years) has passed his SSC in 1958, while Memon (68 years) is a BA (1969) and Bachelor of Law from Mumbai (1972). As against this Dhoot (58 years) has cleared second year of B Com (1975) from Marathwada university. he Brihanmumbai Municipal Corporation (BMC) has proposed to set up three energy plants to process 8,000 metric tonne of garbage generated every day in the city. However, it it is unclear what the BMC plans to do with the power that is generated. Additional municipal commissioner Mohan Adtani said, “There will be a qualification tender which will be issued in next 15 days and the processing plants will be set up at existing dumping grounds in Deonar, Mulund and Kanjurmarg; a sample of waste has been sent to the laboratory named ‘NEERI’ in Nagpur in order to know how energy can be generated.” P.S. Aawate, executive engineer, Solid Waste Management added, “We are re-starting the process of plants as BMC’s earlier plan to shut down the Deonar and Mulund dumping grounds is under investigation.” As BMC does not hold its own dumping ground they have decided to lease the dumping ground land to the contractor for Re.1 per square metre per annum. Aawate added, “Earlier in 200910, the project to treat around 6, 500 tonne of garbage from these three dumping grounds was stopped, hence we have now decided to generate at least 600-800 tonne of garbage per day; we also have invited opinions from across the globe for the new project. While Amul has increased the price from Friday, Mother Dairy will hike rates from Saturday. "We have increased milk price in Mumbai by Rs 2 per litre from today," Gujarat Cooperative Milk Marketing Federation (GCMMF), which sells milk under the Amul brand, told PTI. Sodhi said the prices of Amul gold (full cream milk) has gone up to Rs 46 per litre from Rs 44 per litre, while that of Amul Taaza (toned) to Rs 36 per litre from Rs 34 per litre. Amul is the largest dairy firm in Mumbai market with sale of 11 lakh litres per day, while Mother Dairy sells nearly 2.5 lakh litre a day.

AGAINST the background of the late Mohan B Samant’s paintings at the Jehangir Nicholson Gallery of the Chhatrapati Shivaji Museum, on show from October to February 10, there has been song, there has been poetry. For it is well-known that the artist, whose prolific output of modern paintings, mostly in New York, was a continuous experiment in style, technique, material and colour, loved music almost as much as he loved painting. So the collection itself, one of the finest, private has been accompanied by other forms of performing artistry, much in the way of Samant’s own loft concerts and poetry readings. Yesterday, artist Astad Deboo delivered his own tribute in a series of three works that left the tightly packed audience spellbound. It was actually signature Deboo, who has, in the course of his long career, been every bit as innovative as Samant himself. It was also an audience that was thoroughly familiar with his work, who knew what to expect and waited eagerly for their Deboo fix! Hence the first piece, a muscledefying feast of movement at a pace best described as glacial, body, hands, limbs and feet in perfect harmony, movements so slow as to make it seem as if he was flowing from Point A to Point B. In contrast the next piece saw him perched on top of an installation, a prop used to great affect as he descended in a series of carefully choreographed moves designed to display the extent to which an artist can push his body. And finally the third pieced, so full of joy as Deboo did the endless Sufi whirl that brought the

Each child we counsel, rescue, make safer, return to his family or help rehabilitate is an inspiration to try even harder. If we are to truly achieve our goal of building a child-friendly India that guarantees the rights and protection of all its children, we need to do much more”. Actually, Childline wants us to do little enough it seems. It has for the first time come out with India’s first Child Protection Calendar. Don’t use it as a desk ornament, the NGO urges. But as a constant reminder of the scale of the problem that confronts our children. Put the calendar in a place where people will see it so that they join in the fight against exploitation of our littlest ones. THE level of hilarity occasioned by Shiv Sena leader Uddhav Thackery’s confusion over what exactly happens on Republic Day (tomorrow) is both unseemly and ironic, given the fact that most people of this country are equally, if not more ignorant in the matter. For those who may have come in late, Mr Thackeray referred to the prime minister making his “last speech” from the ramparts of the Red Fort, an occurrence that takes place only on Independence Day. Being a leader very much in the public eye, he should have known better. The flip side is that a leader is no better than his constituents, sop perhaps we should not be too judgmental of him! Suffice it to say that a quick scan of students in colleges are bound to throw up the sorry fact that apart from it being a public holiday, few are aware of what it means to be a republic. Or that it is celebrated every year to commemorate the date and moment when the Constitution of India came into effect. Although India attained independence on August 15, 1947,till 1949 it didn’t have a permanent Constitution of its own and instead were functioning under the laws enacted and implemented by the British.

Thackeray. This is a day presided over by the President who makes a speech that came into force in a full-fledged fashion from on 26 January, 1950. And he does it on Rajpath, that beautiful road in the capital along which the grand parade, showcasing our military might, the glory of our Navy and the splendour of the Indian Air Force, takes place. From Raisina Hill, past Rashtrapati Bhavan and ending at the poignant simplicity
of India Gate, this is a parade to remember. Tomorrow we will celebrate the 64th anniversary of the day our country became a Republic with its own Constitution. We will hoist our own flags all over town and sing the national anthem with gusto – and for a single day, try to forget how often we and our leaders have betrayed the very Constitution that gives us so many rights, so much power.

he Mumbai Traffic Police has made elaborate arrangements for the Republic Day parade at Marine Drive this year; all preparations have been almost completed keeping in mind the huge crowd which is expected at the venue. Extra forces of the city and traffic police will be deployed.

People have been urged to avoid using their private cars, and instead use public transport like trains and buses, etc. Some VVIP and VIP car passes have been issued and made arrangements have been made for at Inox threatre, Vidhan Bhavan, Jeevan Beema Nigam, Barrister Rajni Patel Marg, KB Patil Marg, MG Road, etc. People should try to reach the venue by 8.00 am and not not carry any heavy bags or luggage; Marine Drive and Churchgate railway stations will be the best connectivity to reach at spot, Phansalkar added.

CM in talks with Accenture to create smart cities By A Staff Reporter

hief Minister Prithviraj Chavan, who is in Davos attending the World Economic Forum (WEF), held talks with officials of a global consultancy firm to set up 'smart cities' in the state. Chavan had detailed discussions (with the officials of Accenture) on having a strong implementation machinery to create good cities, a statement from Chief Minister's Office said on Friday. He deliberated on how to implement the model of smart cities in Hinjewadi (Pune) and the Bidkin-Shendra belt in Aurangabad as well as the Delhi-Mumbai industrial corridor. The statement said that Accenture officials expressed interest in the proposal and told the Chief Minister that the company's focus would be to improve the environment, standard of living and administration of cities.

ocial activist Anna Hazare on Friday came out in support of Pimpri-Chinchwad municipal commissioner, who is reportedly being transfered, saying if the government acts against the bureaucrat he would lead a people's agitation on the issue. Anna today wrote a letter to Chief Minister Prithviraj Chavan and warned of joining the people's movement to stop the transfer of the bureaucrat Shrikar Pardeshi. Citizens' groups claim that various vested interests are trying to get him transferred, as he had taken stringent action against unauthorised constructions. "Shrikar Pardeshi is known to be an efficient and sincere officer. Citizen's groups from PimpriChinchwad and Pune have met me on the issue. There
is anger and unrest among people on the reports of Pardeshi's transfer," Hazare said in a letter to Chavan. Claiming that there was not a single complaint against Pardeshi, Hazare said he was yet to complete his term as the civic chief. "Some politicians, for their own vested interests and financial gains, are trying to transfer him. Pardeshi is being transferred because he has a clean image and is transparent in his work," he said. "I expect that government to perform its duties by following law and should not act upon the high-handedness of some people...It is the government's duty to raise the morale of good officers, or else these officers may give up from the administrative service and may work somewhere else. Good officers are the asset of the society," Hazare said.

Hike pay of consumer forum members, state told By A Staff Reporter

he Bombay High Court on Friday directed the Maharashtra government to immediately increase the honorarium of members and presidents of consumer fora in the state. The direction was given by a bench headed by Justice S.J. Vajifdar on a PIL which complained about several issues, including lack of infrastructure, filling up of vacant posts of members and Presidents of Consumer Forum and insufficient salaries paid to them. The PIL, filed by Mumbai Grahak Panchayat, a leading consumer NGO, alleged that out of the 40 consumer fora in the state, 19 were dysfunctional due to vacant posts of members and presidents. The government informed the court today that they had already filled up 30 posts of president in 40 consumer fora all over the
state. However, 10 were still lying vacant and efforts are being made to fill them. The government said 34 posts of members out of the total 84 in consumer fora across the state were lying vacant and the process of appointing such members was in final stage. In Bandra Consumer Forum, where space was a major constraint, 400 square feet additional space had been provided, the court was told. Another bench hearing the same matter had earlier pulled up the government for its lackadaisical attitude regarding vacancies in the consumer redressal fora across the state. The bench had also suggested that three months prior to the retirement of a member or a president of consumer forum, the state government should issue advertisements to fill up the post and ensure that it does not remain vacant.
Customs seize gold worth over Rs48L By A Staff Reporter

hree passengers were yesterday held by Customs sleuths at the international airport here for trying to smuggle in gold worth over Rs 48 lakh. "We intercepted three passengers, all Indian nationals coming from Dubai and recovered 1905 grams of gold valued at Rs 48,22,583," an Air Intelligence Unit (AIU) source told PTI.
In the first case, Ubaid Nelliyadukkam was intercepted with six gold bars weighing 700 grams and valued at around Rs 17 lakh. The bars were concealed in three boxes containing carbon powder. The other two passengers - Assai Usman and Mohammad Jameer -- had concealed gold wires in their trolley bags. Customs officials seized gold wires worth over Rs 30 lakh from the duo.

Athawale said, “Our party workers met Election Commissioner V.S. Sampath in Delhi on this issue and registered our protest against the AAP.” He added, “Indian flag is symbol of national pride and the aspiration of the people. However, national flag is being used by some people for vested interests of their political party. Instead, AAP should have made their flag consist of brooms for themselves. We will not appreciate use of national flag for political rallies.” AAP party workers had used the national flag for their protest against Union

The State Women’s Commission (SWC) has issued a notice regarding this to Shiv Sena MLA Vinod Ghosalkar seeking his explanation by January 30. he Union Agriculture Minister and NCP president, Sharad Pawar has categorically stated that there is no Modi wave in the country. However, Pawar made it clear that the political scenario across the country is unclear and regional parties as well as new voters will play crucial role in the formation of new government. Speaking to reporters at Vidhan Bhavan yesterday, Pawar said, “I personally don’t see any anti UPA wave across India. The results of four Assembly elections cannot be the sole indicator of any particular wave. At this juncture it will be difficult to comment on emergence of third front in the country. The development will be the major plank in the run up to the coming parliamentary elections”. Pawar also mocked BJP’s Prime Ministerial candidate Narendra Modi’s development model saying that it cannot be the sole model applicable for the country as a whole. He said, “The UPA’s development model is quite inclusive and it focuses on the development of power, road, infrastructure, agriculture. I am sure that India will achieve five per cent plus growth during the current fiscal year. The agriculture growth has played a major role. The government is tak-

The NCP chief who filed his nomination for the Rajya Sabha election, also downplayed the surge in Aam Aadmi Party’s (AAP) base at the national level. The AAP’s presence is by and large restricted to New Delhi and not beyond it. “The forthcoming Lok Sabha polls will be between the Congress led UPA and BJP led NDA. However, the regional parties will also play a crucial role in their respective areas and will be the key to formation of government at the Centre. The new government at the Centre should be
stable in the larger interest of the economy and the country,” he added further. On his ambition to become Prime Minister, Pawar said, “I know the strength of my party and the seats it is contesting so there was no question of staking claim for the same. I am not available for the PM’s post”. Replying a query on the Congress party’s decision not to project Rahul Gandhi as PM, Pawar stated, “it is Congress party’s internal issue. However, he recalled that Congress has never declared party’s PM candidate in the past ahead of Lok Sabha elections.

In fact, the Shiv Sena is also speechless even as their own councillor Sheela Mhatre is ill-treated”. He added, “We will soon take this issue to the commissioner of Mumbai police Satyapal Singh if the Mayor is not going to take any call”. Rayiz Sheikh, party leader of Samajwadi Party said, “The entire holiness which the house holds regarding giving justice to the people is at stake as there is no response to this issue. Our Mayor is seen is not seen punishing the culprit, Ghosalkar”. Adarsh will never be demolished
T has become clear now that Adarsh, the controversial building in Colaba, will not be razed. The building in the military area has come up on the ground which was reserved for the widows of Kargil heroes. The government claims that the land belongs to it. There is a dispute about the claim that the ground was allocated for Kargil widows. Top leaders of the Congress party are involved in the Adarsh scam. It is alleged that sanctions were obtained from the government through unfair means. It has been also alleged that some bureaucrats and ministers are also involved. It is also alleged that several benami transactions have taken place. Adarsh, however, will stand there for ever. Efforts by activists in this regard have failed. Legal opinion has been sought. The government has ordered enquiries. And finally a report which was produced has been rejected. A storm of protest followed. The matter was discussed in Parliament. And Congress vice-president Rahul Gandhi expressed the view that the response to report on Adarsh needs to be reconsidered. It is not known whether any reconsideration has taken place. Rahul’s view was not an order. It was a remark which was casually made. After making a vague remark, the Congress vice-president, who is in charge of the Congress poll campaign, has chosen to keep mum. There is every indication that Adarsh will not be demolished. When a top Congress leader like Sushilkumar Shinde is alleged to be involved, it is certain that the Kargil widows cannot get back the ground on which Adarsh has been built. And if at all those who built Adarsh fail, it is better it is not demolished. It should be given away to Kargil widows.

RVIND KEJRIWAL’s Aam Aadmi Party (AAP) is under atack from several political parties. AAP’s success in Delhi and its threat to move to the national scenario and contest Lok Sabha elections in April-May appears to have caused considerable concern and made political parties to mount an aggressive attack on Arvind Kejriwal. During the last week – following the demand by AAP to suspend five cops for dereliction of duty, the attacks have been stepped up. Arvind Kejriwal has been compared to a ringmaster in a circus; Kumar Vishwas is a clown. Kejriwal does not know how to govern. Even Rakhi Sawant can do better. Union Home Minister Sushilkumar Shinde says Arvind Kejriwal is a mad chief minister. Another attack on Kejriwal says he is breaking laws and taking measures which are against the Constitution. The Congress, which is supporting AAP in the Delhi assembly, is a strong critic of the party. It is surprisingly supporting a party which is not fit to govern. The BJP continues to attack AAP. It is now holding dharna in 14 locations across Delhi. It wants the Delhi Law Minister Somnath Bharti to be sacked. According to the party sources, Somnath and his men raided a house where three or four foreign women were staying. The raid was carried out by Somnath because he could not get a cop to do it. The BJP has given time until January 26 for Kejriwal to dismiss Somnath Bharti. Arvind says the minister was doing his duty and the allegations made by the foreign women are baseless. If the law minister is not dismissed by January 26, BJP will escalate protest and even approach the President. It is clear what the BJP is doing is to taint the images of the AAP, the Samajwadi Party, the BSP, the Shiv Sena and to some extent the Congress. All these parties can now be expected to make efforts to cut down the popularity of the AAP. The ground reality in Delhi, however, shows a different scenario. In Delhi, the AAP is as popular as ever. It cannot be denied that the AAP has huge support in Delhi. All the below the belt attacks have not diminished people’s support to AAP. Perhaps, the popularity of AAP in Delhi has increased.

The Centre will not agree to give up control over the Delhi police. What sort of government is now in Delhi? It is nothing but a farce that the Delhi police are not under the control of the Delhi government. A Delhi policeman can refuse to take orders from any minister in the Delhi government. It looks like the ministers are under the control of the police. The police imposed section 144 in the area where Arvind Kejriwal was holding the dharna and he defied it. A FIR has been lodged against him for the ‘offence’ he has committed. The police have the last word in any matter related to law and order in Delhi. Perhaps the municipality in Delhi has more powers than the government. Without control over the police, the AAP cannot govern. And what is an amazing reality is that a Delhi cop can arrest a minister, file case against him and send him to jail. This situation is quite hilarious.
ROUND-UP A.R. Kanangi When conducting dharna, Union Home Minister Sushilkumar Shinde asked him to change the venue. Arvind Kejriwal said: “Who is Shinde to ask me go away from here? I am the chief minister and I will chose the dharna venue anywhere I like”. He has now realised, he does not have even minimum powers – with regard to law and order. The police have the power to arrest him. Clearly Kejriwal is in trouble. He has so many challenges hurled at him. He has to undertake protests, deal with summons by the police and courts. And where will he have time to deal with Lok Sabha elections?
Gandhi campaigned in the assembly elections in Uttar Pradesh. He has no dynasty charisma; in fact the dynasty factor does not work any more. The Congress will be pitted against the SP, BJP, BSP and AAP. The Muzaffarnagar riots, free holiday of MLAs at state exepense, communal policy – the tilt is in favour of minority community and no relief for the poor, have all made the UP government steadily unpopular. For the first time, a party has arrived in Amethi which appears to have real concern for the poor. How much concern Rahul Gandhi has for the poor can be seen from an incident which happened a few months ago. On his visit to UP, Rahul Gandhi stayed in a Dalit home and he talked to the housewife in it – Suneeta. This incident was photographed extensively and it got media attention. Last week, Kumar Vishwas visited the home of Suneeta. And she told him and the media that Rahul Gandhi did visit her and promised her help – but there was no sign of it. One thing has become quite clear: Rahul Gandhi is not popular in Uttar Pradesh. It is not known now whether the SP, BSP and the BJP will contest from Amethi. If they do, it will be a test case. Can the AAP fight all these three parties and win? Narendra Modi is making poll waves in UP and this shows the BJP has a big chance to win in various constituencies in Uttar Pradesh. The AAP is ruling in a state where the police can arrest the chief minister and send him to jail. This shows on the national scene it can do precious little. It is highly doubtful whether Kumar Vishwas can get Amethi for his party.

Is the RBI doing the right thing? THE decision of the Reserve Bank of India (RBI) to withdraw from circulation all currency notes before 2005 is in right direction and timely one. These notes will be legal tender till March 31 and can be exchanged from April 1 from the banks for new ones. The exchange of more than 10 notes of Rs.1,000 and Rs.500 by a person will need identification proof and resident address but it is not known if the banks have to note down details of those exchanged notes and pass them on to the relevant authorities to maximise the flush-out of black money. Those hoarding currency notes before 2005 have to get out in open to transect or exchange till March 31. I strongly feel that it will not be easy to get large volumes of currency into the system unnoticed in a short period. Even if some of it does get exchanged, the RBI will not mind it as it would have achieved its objective of getting such money into the legal system. The RBI move will also help eliminate counterfeit currency but make life difficult for those who have hoarded the currency notes and fund political parties for elections.

Rajni was on her way back home in a bus carrying other students when a man held the vehicle hostage on gun point. The robber forced the driver of the bus to keep driving the vehicle towards the outskirts of the city. Sensing danger the little children panic but Rajni who was the eldest in the group kept her calm and asked the children not to panic. The police in the meanwhile was aware that the robber was in the loose with two guns at his disposal. elson Mandela was a great leader, whose life and leadership was hugely inspiring. Justin Chadwick’s Mandela: Long Walk To Freedom, coming soon after Mandela’s death, is an apt tribute to the man—a straightforward, conventional, no- extra-frills biopic. A story full of sound and fury told with proper restraint. Adapted from Nelson Mandela’s autobiography, it traces his life from his rural roots to his political awakening, his involvement in the antiapartheid movement, his activism, rise to prominence, his arrest and long incarceration. His personal life is also documented, his great love

Mandela had spent a soul-wracking 27 years in prison; after his release he went on to negotiate with the white rulers, get elected as the first black president and govern his troubled country, with compassion

and a deep commitment to non-violence. Idris Elba’s powerful screen presence does complete justice to the part he had the great fortune to play from the age of 23 to 76—getting across Mandela’s magnetism and dynamism tempered by genuine warmth and wisdom, without which he could not have survived the brutality he and his people suffered. It may occasionally resemble a history lesson or made-for-TV documentary, and fall short of a epic (like Richard Attenborough’s Gandhi), but the viewer’s emotional bond with the story and admiration for Mandela makes up for any of the film’s shortcoming. It’s not possible to encapsulate Mandela’s life in 140 minutes, but this one concentrates on the major milestones; in any case, a film about him, made with honesty and respect, is bound to connect with the audience.

I
f it weren’t for Salman Khan’s star draw, a film like Jai Ho would have been hooted out of the cinemas after one show. So it the film does well, it’s all credit to his fan following; the director, Sohail Khan, could have handed the reins to the action director (Ravi Verma) and gone on vacation for all the work he has done. The bits in between the action set pieces are haphazard and ridiculous, making a mess of the sweet Hollywood drama Pay It Forward, which had inspired Telugu film, Stalin, which in turn spawned Jai Ho. Salman Khan has built his recent blockbuster star image on remakes of over the top Southern films, which splurge on extravagant fight scenes and elaborate dance numbers, but are resolutely old-school in every other department. In this film, Jai (Khan) is an army officer with a past. Not sure what he does, perhaps runs a garage ready to bash up wrongdoers and (because there are scenes of him has a strange collection of sun tinkering with cars), but is always glasses in lurid colours. HE classic fairy tale of Jack and the Beanstalk has been changed to the modern day adventure, with loads of special effects and wonderful audio separation that explodes across the screen in this superb new interpretation. Jack (Nicholas Hoult) is a farmhand who sets out for the market to sell his horse and cart to make ends meet. He saves a young lass Princess Isabelle (Eleanor Tomlinson) from being molested by a group of young men. But doing this good deed, someone steals his cart. He bumps into a monk who begs him to sell his horse for a handful of beans. Back home his uncle reprimands him for his foolish act. But unknown to him, the beans have magical powers that transport him to another world. Meanwhile Isabelle’s father King Brahmwell (Ian McShane) is arranging her match with a man twice her age. Isabelle runs away at night only to reach the doorstep of Jack. A thunderstorm strikes the town and Jack loses the beans. One of the beans turns into beanstalk that will allow the Giants in the sky to descend to Earth. With his house shattered, Jack searches for Isabelle only to see her pulled up
by the beanstalk. The King and his men search for Isabelle, and find Jack who tells them the story. ISSUES OF NON-COMPLIANCE BY DEVELOPERS After receiving an approval from the appropriate authority, the developer either sells or leases out plots to co-operative societies subject to developing the land in strict accordance with the terms and conditions laid down by the authority. Before starting construction, the society prepares its plans of building construction and obtains an approval from the relevant authority. However, the problem arises when the developer does not complete the construction work as assured. Concurrently, in a rush to get the occupation certificate from the authority, the members of the society do not verify whether the development of the layouts/sub-division is done as per plan. The developer, on his part, tends to ignore the problems of the members and dodges their queries.
Often, he is also prepared to forego the deposit amount paid to the authority as the cost of development lands up being higher that the amount deposited. Importantly, with the work remaining incomplete, the title to the property cannot be conveyed to the society.
DEED TO DETERMINE RIGHTS A deed is an instrument which deals with the right or interest in property. It is written in a paper, executed by a party under seal. It is delivered as his act or deed expressing that such person so named makes, confirms, concurs in, or consents to some assurances, other than by way of testamentary disposition, of some interest in the property or some legal or equitable right title or claim or undertakes or enters into some obligation duty other act effecting the legal relation or position of a party to the instrument or some other person or corporation. A deed determines the right and powers of the particular person, duties and liabilities, contractual obligations and/or fulfilment etc. Documents provide an insight into the idea and intention of the parties at the time of entering into contract. A party to the document may want to change the ideas based on a change in intention according to the changed situations and circumstances creating an issue. Investing in immovable properties for NRIs was difficult a while back. Can NRIs rent out properties they own within India and without informing the RBI? - Tina Khanna
Until some ago, investing in immovable properties for NRI’s was quite an uphill task. In the days of the Foreign Exchange Regulation Act, the buying or selling of immovable property was governed by the citizenship of a person. At present, the term Non-Resident Indian means a person residing outside India who is either a citizen of India or is a person of Indian Origin who is no longer a citizen of India. An Indian citizen who stays abroad for the purpose of employment, business or to pursue any kind of vocation outside India or under circumstances indicating an intention for an uncertain duration of stay abroad is a non-resident Indian. In addition, non-resident foreign citizens of Indian origin are treated on par with Indian NRI citizens for the purpose of many investment related facilities. To avail of a number of facilities in India such as opening and maintenance of bank accounts or investment in shares and securities in India, the term ‘Person of Indian Origin’ means a citizen of any other country other than Pakistan or Bangladesh who, (a) at any time has held an Indian passport; (b) he or either of his parents or any of his grandparents was a citizen of India by virtue of the constitution of India or the Citizenship Act, 1955 (57 of 1995); (c) is a spouse of an Indian citizen. For investments in immovable property, a Person of Indian Origin covers the same criteria. But it also debars citizens from neighbouring countries such as Pakistan, Bangladesh, Afghanistan, Bhutan, Sri Lanka, China, Iran or Nepal to be called a ‘Person of Indian Origin’. All persons whether residing in India or outside India who are citizens of the above said countries require prior permission of the Reserve Bank of India for acquiring or transferring any immovable property in India. A person of Indian origin residing outside India does not require permission to acquire any immovable property in India other than agricultural land, farmhouse or a plantation property by way of gift from a person who is a resident of India or a person who resides outside India but is a citizen of India or from another person who is of Indian origin but resides outside India. The same holds true in the case of inheritance too. This means that a person of Indian origin residing outside India does not require permission to acquire any immovable property in India through inheritance from another person residing outside India who had acquired such property in accordance with the provisions of the foreign exchange law in force at the time of acquisition. ELBOURNE: Rafael Nadal extended his mastery over long-time rival Roger Federer as he stormed into an Australian Open final against Stanislas Wawrinka in straight sets on Friday. Spanish top seed Nadal defeated the 17-time Grand Slam champion 7-6 (7/4), 6-3, 6-3 in a dominant semi-final win lasting two hours and 24 minutes on Rod Laver Arena. Federer was confident of a better showing after failing to beat Nadal in Grand Slams since the 2007 Wimbledon final, but the world number one was relentless in taking apart the much-decorated Swiss. IHTARLAM (Afghanistan): Unknown gunmen shot dead five young Afghan men playing volleyball, officials said today, but Taliban insurgents responsible for much of Afghanistan’s unrest denied any involvement in the killings. The players were gunned down in the eastern province of Laghman at about noon by attackers riding on a motorbike. “Armed men opened fire on a volleyball game. The players were young men, all innocent, and all of them were killed,” Sarhadi Zwak, spokesman for Laghman’s provin-
cial governor, told AFP. The Taliban regime between 1996-2001 banned volleyball and many other activities, but a spokesmansaid it was not responsible for the deaths.“We completely reject this allegation. We are not involved in this killing at all. Those who killed them are not our men,” Taliban spokesman Zabihullah Mujahid told AFP. President Hamid Karzai condemned the attack and said such violence would not deter Afghans’ search for peace and development.

UMBAI: Reliance 1 produced a creditable performance to snatch a four-run win against Indian Oil in a tight Group-D league match of the Rs 12 lakhs prize-money 10th All India Dr. D.Y. Patil T20 Cup, organised by the D.Y Patil Sports Academy, under the auspices of the Mumbai Cricket Association (MCA), and played at the D.Y. Patil Stadium, Nerul, on Friday. This was the second win for Reliance and they are now assured of qualifying for the quarter-finals from this group. After being asked to bat first, Reliance managed to put up a modest total of 137 for 8 wickets from their full quota of 20 overs. Apurv Wankhede 38 runs (27 balls, 3x6), Rakesh Solanki 30 runs (38 balls, 1x4), Amitoz Singh 22 (15 balls, 2x4, 1x6) and Rahul Shukla 22 (12 balls, 1x4, 2x6) were the principle run getters. For Indian Oil, Abbas Ali bowled an economical spell of 2 for 6 from two overs. He was supported by Balwinder Singh Sandhu (2/35) and Amit Yadav
(2/22). Indian Oil started the chase in right earnest were very mucontarget, but Reliance bowlers and fielder held their nerve in the end to grab a win. Skipper Aditya Tare led Indian Oil with a gritty knock of 40 runs from 23 balls and along with opener Paresh Patel who made 43 runs from 51 balls the two put up a third wicket stand of 67 runs from 48 balls to take their score to 125 for two wickets. But after Tare was run out in the 19th over they lost the next four wickets for the addition of just eight runs and finished on the losing side. Rahul Shukla also played a good role with the ball taking three for 38 from his four overs and Jaspreet Bhumra picked two for 16 to seal the win. Meanwhile, opener Mansingh Nigde’s unbeaten half century steered Jain Irrigation to a eightwicket win over Andhra Bank, for their second consecutive win in Group-A, which has assured them of a place in the quarterfinal round.

Godrej Properties Golf Challenge to be played in seven cities
MUMBAI: The annual Godrej Properties Intra Club Golf Challenge will witness seven city rounds, including stop overs at four new locations, and an increase in the total number of participating golfers to an approximate 1000. Like in 2013, the event will once again culminate in an international finals showdown in Bangkok where the respective winners from each city will battle it out. The action tees off on January 25 with simultaneous rounds at the Willingdon Sports Club in Mumbai and at the Qutub Golf Course in Delhi, the first of the new venues added to this year’s itinerary. The Classic Golf Resort in Gurgaon stages round three on February 1 followed by another double header on February 9 at Madras Gymkhana Club in Chennai and Royal Calcutta Golf Club.
