In October, the U.S. Supreme Court paved the way for the release of videotapes from the 2009–2010 Proposition 8 trial that led to the legalization of same-sex marriage in California. The decision not to appeal it made by supporters of Prop. 8 came after a 12-year effort by KQED and its counsel, Thomas R. Burke, who argued for the release of the tapes, which document an important historical moment in the fight for LGBTQIA+ rights in California.
Prop. 8, which passed in 2008, banned same-sex marriage in California. The subsequent trial, Perry v. Schwarzenegger, questioned whether Prop. 8 violated the U.S. Constitution. Judge Vaughn Walker ruled in favor of the right to same-sex marriage, but said at the time that videotapes of the trial would remain sealed for ten years. As the court-ordered embargo on the tapes neared expiration, KQED filed a motion with the Ninth Circuit Court to unseal them. The motion was granted, then appealed by Prop. 8 proponents with the U.S. Supreme Court declining to take up the appeal.
The effort to make these historic tapes public was spearheaded by Scott Shafer, senior editor for KQED’s politics and government desk and co-host of the Political Breakdown podcast. Shafer covered the Prop. 8 trial and subsequent contest over these tapes extensively for KQED. As KQED Chief Content Officer Holly Kernan noted, “If our systems work behind closed doors, with no press or public access, we have no idea how decisions are made, nor what arguments are leading to these decisions. KQED wants more sunlight on our legal system, and we will fight on behalf of the public to get that access.”

La Otra Mirada, Season 2
I’ve just been loving the gorgeous new Walter Presents Spanish-language program La Otra Mirada. Season 1 follows Teresa as she flees scandal in Lisbon to teach at an all-girls boarding school in Seville. Season 2 continues the story, as both Teresa and her students continue to grow and gain independence — even as they struggle against societal expectations. Following their stories is such a delight, and I’m so happy that Passport members will get early access to all of Season 2 starting December 9, ahead of its broadcast premiere on December 15. If you want to catch up on old episodes, Season 1 is also available on Passport. —Emma Casley, KQED TV Programming Associate

RADIO SPECIAL
Night of Ideas
The last week of December may be the most liminal piece of time on the calendar. Ideas, questions and plans all seem to float in the air. This is an ideal time to revisit the Night of Ideas, which returned as an in-person event this year at KQED. The talks and performances explored the theme of “(Re)building Together: Where Are We Going?” There was plenty to consider: a lingering pandemic, threats to democracy and global conflicts. These are serious subjects, approached with a sense of optimism and resolve. We may not be able to say exactly where we’re going, but we have an abundance of that most-precious cargo: ideas for getting there. Night of Ideas: (Re)building Together airs on Wednesday, December 28, at 10pm, with a repeat at 1am on Thursday morning. Listen on KQED Public Radio 88.5 FM or on the KQED streaming app. —Devin Holt, On-Air Digital Programming Assistant

Hail, Hail, Freedonia! Groucho and Cavett Star in a New American Masters Documentary
You, ahem, bet your life I was excited to learn that two greats are together in a new documen tary: American Masters: Groucho & Cavett. Every time one of the Marx Brothers movies, or later Groucho's quiz show, flickered on televi sion in my childhood home, channel surfing stopped. The king of witticisms, goofy songs and innuendo, Groucho always inspired groan ing belly laughs. Then there’s Cavett, who’s now in his eighties, former host of The Dick Cavett Show. A comedy writer from Nebraska, educated at Yale, Cavett had a smart, low-key, take-no-bull style and often had guests you wouldn't see on other talk shows. In addition to Groucho, they included Janis Joplin, whom he
clearly admired, and Georgia Gov. Lester Maddow, who stormed off the stage in an argument over bigotry.
Who knew that Groucho and Cavett were pals — or the story behind and extent of their friendship? In this documentary, Cavett takes a look back on their friendship using clips from the show and rare recordings. Fun and fascinat ing with a few cringeworthy moments, it’s well worth a watch if you’re a fan or want to know more about these two. American Masters: Groucho & Cavett airs on Tuesday, December 27, at 8pm on KQED 9 —Ellyn Hament, Managing Editor
DID YOU KNOW? Late-Night Talk Shows
• No, it wasn't Joan Rivers: Stage and film actress Faye Emerson is widely believed to be the first woman to host a late-night talk show, The Faye Emerson Show, in 1949.
• Arsenio Hall was the first Black person to host a late-night talk show, The Arsenio Hall Show (1989), which attracted a young, diverse MTV-generation audience.
• In 1972, Johnny Carson moved The Tonight Show from New York to California. The move is considered instrumental in shifting the television industry's power to Los Angeles.

SATURDAY NIGHT MOVIE
On the Town
Saturday, December 10, at 8pm on KQED 9
In this classic film from 1949, fun-loving sailors Gabey (Gene Kelly), Chip (Frank Sinatra) and Ozzie (Jules Munshin) have 24 hours of shore leave in New York City and they want to make every second count. There’s dancing, romance and great scenes of the city. And the score is part of the American songbook: Leonard Bernstein wrote the music with lyrics by Betty Comden and Adolph Green.
