KQED Wins a Motion to Unseal Historic Same-Sex Marriage Trial Videotapes In July, nearly a decade after Proposition 8, which banned same-sex marriage in California, was struck down in San Francisco, a federal judge here ordered that video documentation of the trial be unsealed. The ruling came after KQED and its counsel Thomas R. Burke argued that the tapes should be available to the public.

In recent years, some Prop 8 proponents have argued that the court should extend the seal, and a virtual court hearing was held about it in June. In his ruling, District Court Judge William H. Orrick argued that the motion contained “no justification, much less a compelling one, to keep the trial recordings under seal any longer.” “It’s incredibly important to have it be open, not only for the historical record, but so the people can see this particular trial video,” said Burke. “It’s one of the only federal trial videos of its kind ever in the United States.” KQED Senior Editor Scott Shafer helped advance KQED’s effort, as well as Burke. Prop 8 proponents appealed Judge Orrick’s decision to the Ninth Circuit Court of Appeals. The court has since issued a temporary stay of the unsealing order and has imposed an expedited briefing process for the appeal.

In 2008, Prop 8 banned same-sex marriage in California. The trial of Perry v. Schwarzenegger was later held to determine its constitutionality. Tapes of that trial, which were made at the behest of Honorable Vaughn Walker, the judge who led those proceedings, were to remain sealed for ten years from the end of the trial.

The Pulse: The Impact of Police Violence on Health

COVID on Campus Airs Wednesday, September 2, at 8pm The coronavirus pandemic represents the greatest challenge to American higher education in decades. Many colleges and universities are closing or dramatically cutting their offerings. Students’ lives and academic plans are in turmoil. Millions of students are going to class online, many for the first time. It’s a time of intense difficulty, risk and potential promise. This special from APM Reports explores the issues facing institutions, students and families.

Airs Saturday, September 5, at 6pm The killing of George Floyd by police officers in Minneapolis has sparked another wave of national outrage over police brutality and violence. Protesters have taken to the streets demanding an end to police violence, and the movement is asking for police departments to be defunded or completely abolished. In this special, we explore what policing could look like and the role research and science might play in serious reform. We talk with experts about the effects police violence is having on Black Americans’ health — both mental and physical. It’s not only the actual violence, but also the constant fear of violence and fear of being stopped and arrested that’s causing stress and anxiety. We hear ideas for reform, along with how we can improve, or even reinvent, American policing.

Building the American Dream: The Little-Known Story of Immigrant Construction Workers

There are stories we may not have heard before that are important to know. Learning about them opens our eyes, and in so doing can help move the country forward toward a more just and equitable future. Building the American Dream is one of these little-known stories. In this documentary, the mistreatment of immigrant construction workers steps into the light. The film, a new VOCES special from Latino Public Broadcasting, takes us to Texas, the site of a massive construction project called the “Texas Miracle.” However, what’s happening there is far from miraculous for some. The film captures the rise of a workers’ movement fighting widespread constructio industry injustices, which include unpaid wages and deadly working conditions. We meet several of the people affected and, through their personal stories of courage, resilience and community, we learn some eye-opening truths about immigrants who are working on this project. Building the American Dream airs on Tuesday, September 15, at 10pm on KQED 9. The film is part of a series of shows scheduled this month for Latinx Heritage Month. —Ellyn Hament

KQED’s New Member Information Policy KQED has updated its membership list policy, which outlines the use of our list while ensuring our active control in safeguarding against unauthorized use. While the policy hasn’t changed our practice of exchanging your name with other nonprofits, KQED’s participation in cooperative databases to identify best prospects for new members as well as reactivation of former members is new. By participating, you may receive fewer solicitations without jeopardizing critical revenue support for KQED programming. As always, we value your contribution and understand if you don’t want to participate in either of these programs. If you’d like to opt out of list exchange or cooperative database activity, please contact Member Services at 415-553-2150 or email member@kqed.org and we’ll update your account information to reflect your preferences.
