In the seasons of life, I’m holding spring in my arms. Camden, my first grandbaby, made her entrance into this world healthy, beautiful and loud on September 30th. In that moment, my heart bloomed. In that moment, our family was renewed. In that moment, our collective future had a pink face with kissable cheeks. I’ve never been one to sit still, but now I’m quite content to settle into a rocking chair for hours, hug her up and savor her sweet baby smell that will disappear too quickly just like this precious time. In these quiet moments, I find myself considering what legacy I want to leave her. First, there are the character traits. I want her to be loving, kind, compassionate, honest, faithful and hard-working. I want her to be secure in the knowledge she is loved, so she can be confident, bold and independent. I want her to be curious, fun-loving and adventurous. To that end, I’m looking forward to introducing her to the outdoors. In the beginning, it’ll be walks in the woods, picking up sticks, rocks and leaves, and jumping in the occasional mud puddle. Over time, though, I see us climbing rocks, riding bikes, slushing down ski slopes, pursuing deer and wetting flies. She and I—and the rest of our family, if they can keep up—are going to make memories in our special places. Special places that allow you to make memories with your special people is the reason that LAND exists. Flip through our pages and imagine the possibilities for all of the seasons of the year—and all of the seasons of your life.

--rom the time I was just a boy I have found myself surrounded by nature’s landscape, in all of its forms. From oak-filled hills to pasture bottoms, mountains dense with pines to coastal hills, Oakdale, California, offered a great place to grow up with a gun and fishing rod in hand. Hunting was instilled in me when I was young by my father, and finding ground to hunt on was an exciting challenge for my buddies and me.
Knocking on doors to gain access to pheasant hunting property came second nature back then, and Central Valley California yielded thousands of acres of private pasture ground that sustained excellent populations of healthy pheasants. We didn’t call them formal ranches, we just went down to the “Old Irishman’s” property and hunted pheasant after school, wading through the waist-high grass and busting pockets of birds with my trusty Lab. Yes they had cattle, but nothing like a major ranching operation. Just about a hundred acres, maybe 50 head of Angus and Charolais, coupled with the classic handful of hogs, chickens and a couple of border collies or heelers by their house and barn. There were hundreds of small farms along the valley floor from Bakersfield to Redding. That has changed in the last two decades and I will forever remember the fun we had as kids chasing the wily Ring-neck. Now, these properties are intensively managed almond and walnut orchards, dairies and vegetable farms. Gone are the pheasants, having been replaced by doves and various other species. Landowners were forced to grow more financially beneficial crops to meet the increasing demands from populations and taxes. Change is inevitable and growth is just going to happen. I now know that balance is the key. I’ve learned that “balance is the key.” Jon Kohler calls this the “conservation and land stewardship ethic,” which is a term of art meaning balancing nature with economic returns. Recently I traveled to Thomasville, Georgia, to film a feature with Jon Kohler & Associates for our LandLeader Television show that airs on RFDTV. I had the true pleasure of visiting the Chemonie Plantation, a traditional quail plantation that harbors wild quail, and in recent years was partially converted to a cattle operation. Jon and Erica Kohler, C.J. Brown, Walter Hatchett and the crew followed championship Pointers as they bounded through the wiregrass following their keen nose in search of a wild bob.

But just a hundred yards away and over a fence sprawled hundreds of acres of green pasture and a herd of Ultra Blacks, which is a type of Black Angus. Chemonie’s new owners created a higher yield of return so as to allow its plantation to be partially self-sustaining. In addition, the modern costs of managing lands are coming down, and the balance of recreational ground and income ground on the same property has evolved in the past decade. Jon Kohler, the leading broker in the country for plantations and a LandLeader co-founder, supported this trend. “When talking about the balance of land stewardship and the conservation
ethic, there’s a conflict. You have to balance peoples’ changing desires and economic needs, so for most people everything can’t be purely recreation. This property has been in flux since the 1830’s. At one time it was a cotton plantation, then in 1888 quail plantation asset class replaced that, and for the last 90 years Chemonie has been used to propagate wild quail populations. Now this owner has converted about 20 percent of the property to cattle operations, but not a traditional southeastern cattle ranch, more symbiotic to the land, planting legume and grasses that also benefit wildlife.” “One of our favorite things to do is to improve properties to the next higher asset class. We were joined by Tall Timbers President Dr. Bill Palmer, whose perspective on cattle conversions on southern plantations was based on understanding and deep knowledge. No doubt that habitat preservation and the conservation of quail ground and old-growth longleaf pine is pure in his passion. But he supports the practice of keeping properties from being overly commercialized. “Some properties take segments of their land and maximize cattle production, some are planting agricultural crops. Having a balance between maintaining the biodiversity and natural resources—the core for quail land—and ensuring families can afford it and keep their property means developing other ways to increase economic potential.” Dr. Palmer went on to stress the importance and realization that costs to maintain these plantations is actually going down, with modernization of farming equipment and efficiencies in crops and cattle management. Being based in Colorado and from the west coast, I never knew about the heritage of the Red Hills and the “plantation life” until working with the team at Jon Kohler & Associates. The landowners there take wildlife and land stewardship to a whole new level. Demand for agricultural ground is, of course, tied to rising and falling commodities prices. If beef prices are down, so is the demand for ranchland. If corn and wheat prices are in a slump, buyers are reluctant to invest in farm ground. Generally, commodities cycles can play out independently of one another, with demand up in some sectors and down in others, and with corresponding effects on the land market. At present, agricultural commodities seem to be in a collective slump, with products from beef to small grains expected to experience declines in 2017. This has pushed land buyers to shift their focus away from agricultural ground and instead eye investments in recreational real estate, such as hunting and fishing properties.
The recreational market is excellent and it is critical to find the highest and best use of any piece of land. –DAX HAYDEN “Today we are seeing many landowners mistakenly believe that the recreational markets are in the same place as the Agricultural markets in general,” says Dax Hayden, managing partner with Hayden Outdoors and the national director of LandLeader. “The recreational market is excellent and it is critical to find the highest and best use of any piece of land.” Hayden, whose company markets working farms and ranches as well as hunting and fishing properties throughout the Rockies and Great Plains, points out that the boom in the recreational market need not leave sellers of agricultural operations in despair. In fact, the interest in sporting properties can create an effective marketing opportunity for agricultural landowners, tapping into what Hayden refers to as a “market within a market,” provided a farm or ranch has a bankable recreational element - be it a stretch of river frontage a great pheasant population or an environment that draws trophy deer and elk.

Farmers and ranchers with such properties, Hayden says, are capitalizing on the demand for recreational ground by marketing the hunting and fishing opportunities that exist within their agricultural operations. For example, cropland with river frontage or a section of a ranch known for great elk hunting might be leased or divided from the remainder of the property and sold at a premium price per acre, generating what likely would be a muchneeded tool to keep a farmer or rancher in business. Hayden cautions that such approaches require knowledge and a great amount of caution by the landowner and the broker. Plans like this need to be strategically executed with the long term future of the property in mind. Selling or leasing the wrong portion of the property or taxing the ability of the farm or ranch to generate future
income must be avoided if possible. Doing this insures that the property will still be a viable agricultural operation. Landowners must think creatively and utilize all aspects of value. Recreational value is real and many times it can be a game changer. Still, such market-within-a-market game plans can equip land brokers not only to help farmers and ranchers weather the ups and downs of the commodities markets, but also to create capital to strengthen the long-term viability of their businesses. “As brokers,” Hayden says, “you might be able to help a family keep from losing their farm or ranch. My family has been through some hard times in agriculture and I know that saving a family operation can last for generations.”

CONTRIBUTION FROM CALIFORNIA OUTDOOR PROPERTIES In response to increased global demand for healthy, nutrient-rich nuts, much of California’s irrigated pastureland has been repurposed over the past two decades to create orchards growing almonds, walnuts and pistachios. Almond acreage alone has doubled over the last 20 years, according to the Almond Board of California, an industry advocacy group with more than a million acres currently devoted to the crop. In 2011, the value of the California almond harvest surpassed that of the state’s grape output, putting almonds second only to dairy products among California’s top commodities. Land broker Todd Renfrew, owner of California Outdoor Properties, headquartered in Vacaville, Calif., says the trend has been a dominant theme in the state’s agricultural real estate market. “A perfect example is a ranch with irrigated pasture on which you’re running cattle,” he says. “You have the grass, you have the water, you have the soil. Given the demand for orchard ground, though, those same resources can be put to use differently, and you have a much larger income stream.” Renfrew specializes in selling farms and ranches throughout California. The pasture-to-orchards trend, he explains, has played out statewide, most visibly in the agriculture-oriented Central Valley. Long one of the world’s most productive farming regions, producing everything from tomatoes to cotton, the valley is now home to more than 6,000 almond growers who, according to the United Nations’ Food and Agriculture Organization, produce 60 percent of the world’s supply of the nut. In an effort to meet global demand, many growers have expanded their operations beyond the flat farm ground traditionally occupied by orchards, planting trees in surrounding lowland hills. “Demand has driven the switchover from pasture to orchards,” Renfrew says. “There’s been a high demand for almonds, particularly in the Asian market—India and China. There aren’t that many areas in the world that can grow almonds. California’s one of them.” Despite its recent dominance in the ag market, though, the trend has shown signs of slowing. Prices for orchard ground have begun to come down, and urgency among buyers has calmed in comparison to the activity of recent years. “There’s still a big demand for almond and walnut trees,” Renfrew explains. “But buyers aren’t willing to pay as much as they have been paying.” Still, California orchard properties continue to command serious money. A buyer selecting from currently available inventory might expect to pay between $16,000 and $60,000 per acre.
Renfrew identifies other trends impacting the California land market: an increased use of mechanical harvesters raising efficiencies, and thereby profits, in the grape and olive industries; and ongoing interest among landowners in pursuing conservation easements. It is the recent break in California’s five-year drought, though, that has landowners, investors and brokers feeling most enthusiastic. “In the last few years, many properties still had the soil, but not the water,” Renfrew says. “Landowners drilled more wells, going deeper and deeper, which impacted the water table. In 2016, we had a tremendously wet year. The dams are full, so it’ll be interesting. There’s some question as to whether some of these orchards have been planted in areas where the water table might come up, and whether that will have an impact on the trees. Still, the rain we’ve had has people excited, and we’re optimistic about the market.”

It is important for all of us to work towards this balance of wildlife and production. Many times we see these two collide and not work together. This, however, does not have to be the case. I am lucky to work for companies who care about the land, the landscape and its people. It is important to always leave the land better that you found it. That is whether you own it or are just visiting. I have been reading the horror stories from the Midwest fires in Kansas, Nebraska and Oklahoma and I feel for those passionate farmers and ranchers dealing with death and devastation. I pray for those families who have lost loved ones and look towards the spring and greener grass. It’s a win-win.” Live auctions have long been a staple for marketing farmland, but now, with advent of online auctions, they are emerging as desirable marketing options for recreational properties and ranches as well as exclusive estates. “In a traditional live farmland auction, most of the buyers are local,” Hindman said. “With recreational properties, the reach has to be much broader because the people who may be interested are scattered far and wide.” For some buyers, the distance to a recreational property auction may be a deterrent. They don’t want to drive several hours not knowing whether the property will be in their price range or whether they will ultimately walk away the high bidder. ven though Anne Kania is owner of the new wingshooting retreat and shooting academy for women called Joy of Hunting, she may in fact be one of the best relationship gurus for couples.
That’s because women hunt for different reasons than men. Stacy Keogh, Ph.D., who teaches in the Sociology Department of Whitworth University, has found in a study that women’s primary motivator for hunting is to nurture and build relationships with their families. It’s also why Joy of Hunting provides a Couples Retreat that includes “. . . the other half.” Ms. Kania and her husband, Bruce, recently started Joy of Hunting as a means of getting women safely in the field through one of the most accessible forms of hunting— game birds. She also believes that developing skilled female wingshooters results in a higher percentage of ethical, humane kills for table fare. “I wanted to teach ANDREA MAHORNEY because I want people to get there quicker than I did, to get them more skilled more quickly so they really enjoy it a lot more and encourage other people to do it—to keep the hunting tradition going—and bring the hunting tradition into their lives,” she said. “We can’t teach people to do it in four days, but we can give them the background and accelerate their development.”
As part of the wingshooting retreat and academy, the Joy of Hunting’s 4,000-square-foot house doubles as the comfortable lodge. It’s located on 340 acres in the historic Yellowstone Valley hamlet of Shepherd, Montana. “The house was built to recreate a hunting lodge that Bruce loved in Wisconsin,” Ms. Kania explained. “It has gorgeous views of river and the farm. It has a lovely warmth. There’s a huge fireplace, Douglas fir beams, baby-grand piano, gorgeous front door— all of it gives this sense of artistry to the house.” Joy of Hunting is embossed on the West of Lewis & Clark, General George Armstrong Custer, the wild horses of Bighorn Canyon, the Pryor Mountains and Montana’s majestic Absaroka Beartooth Wilderness. Here in Big Sky territory, the Kanias have created a luxurious yet informal wingshooting adventure for all ladies regardless of hunting experience. The environment is ripe for success. The land has been cultivated to attract wild game birds—flatlands with draws and river bottom managed for pheasants and wetland food lots and annual rotation crops for doves, geese and snipe. At the heart of the property is a preserve for wild pheasants. “One of the key things for us later in the season is that we have geese in the area all winter,” Ms. Kania said.

From there she set out on their pheasant preserve as well as wild waterfowl and even some big game in the surrounding area. Ms. Kania now believes that hunting with her husband enabled them to understand and appreciate each other better during the early years of their relationship. And if hunting could help the Kanias, then clearly it could help other women find a new outlet to become closer with their partners who hunted.

For Ms. Kania, wingshooting around Yellowstone Valley helped her feel at home with her new American husband when she arrived in the U.S. from New Zealand in 2007. Originally from the Northeast of England, she graduated from Newcastle University with a degree in English. Afterwards, she moved to New Zealand where she worked as a training manager in a computer center and a professional classical singer. She also taught voice for many years, specializing in beginner adults and choral singers. In 2005 she met her husband. They managed a cross-Atlantic relationship for two years until she relocated to their house in Montana that he
She realized that her teaching background in high-tech and voice could be applied to empowering women in ways that aren’t always available. Her newfound dedication to hunting and passion for instructing led to her to qualify as a NSCA Level 1 Shooting Instructor in sporting clays—a discipline frequently used for training wingshooters.
A turning point for Ms. Kania in starting Joy of Hunting occurred in 2012 at Highland Hills Ranch in The Dalles, Oregon. She attended a women’s wingshooting hunt led by Elizabeth Lanier of the G.R.I.T.S. (Girls Really into Shooting). The trip had an uplifting effect, inspiring her to write an Open Letter to Women. In it she said “The fact that I felt so comfortable right away was definitely due to the openness, warmth and inclusiveness that is so special to women.”

Fellow Joy of Hunting instructor Ms. Mahorney is of a similar mind when it comes to teaching women at the Joy of Hunting. She is also a certified NSCA Level 1 Shooting Instructor, having developed her chops at the prestigious Flying B Ranch. She’s described as having “the soul of an artist, the eye of a hawk and the heart of a mom, with her families of children and dogs. She is a patient people-person and a fearless hunter.” Mr. Kania, meanwhile, served as chef, hunter, game manager, dog handler and steward of their land. In setting up their pheasant operation, he flew to England and interviewed several gamekeepers on the tricks of the trade. His passion for the environment drives the entrepreneurial side of

him through a company called Floating Island International that he started in 2005. It builds artificial wetlands islands that improve water quality. The Joy of Hunting’s hands-on courses provide yearround instruction and actual wingshooting during the season. Ms. Kania also offers a Couples Weekend for hunters with some basic wingshooting experience. Ms. Kania says that, given the way women learn, the instruction techniques at Joy of Hunting encourages lots of questions in an informal atmosphere. “We want to provide an experience that teaches women to hunt, but also creates friendships that can last a lifetime,” she said. °

It was late afternoon of the first week in June, and my client and I were overlooking a juniper-studded canyon in Edwards County, scanning the small pockets of open space that were sparsely scattered across the hillsides and along the bottom. A few does and young bucks began emerging from the thicker cover, and I was beginning to think that our chances of laying eyes on a mature male were unlikely on that outing. “Larry, I know we are running out of light, but let’s bail off the side of this hill and check out a water hole that’s down in the bottom of this canyon before it gets dark.” We had no sooner eased to the edge of an opening where we could see the small earthen hole of water when a loud roar from across the canyon broke the late afternoon silence. Larry grabbed my shoulder and asked, “What in the heck was that?” I replied, “It’s a mature axis buck. I’m hoping he is making his way to the water hole.” Seconds later three axis does cautiously made their way toward the water and I instructed Larry to get a comfortable rest across the fork of a dead juniper. The buck stepped into the opening and once again let out a loud roar. “Okay, Larry, he has good tine length, good beams, and fair mass. I suggest you take him if you have an open shot.” The Remington did its job, and minutes later we were admiring a beautifully spotted axis buck. With sweat rolling down his face and a Texas-sized grin, Larry shook my hand and said, “Since reading a magazine article many years ago that Finn Aagaard wrote about axis deer hunting in Texas, I’ve had a dream to experience it myself. I can’t thank you enough for making it happen. Out of all the big game animals I’ve taken around the world, this may be the most beautiful of them all.”

Native to India, axis deer were initially released into the Texas wilds back in the 1930s. Referred to as chital in their homeland regions, axis have done well as an exotic in certain areas of the U.S., especially in Texas and Florida. Today, axis deer are in great abundance in certain areas of Texas, found free-ranging in many counties in central Texas, and commonly found on highfenced game ranches in various regions of the state. Axis are generally not as cold hardy as native whitetails, especially when freezing temperatures are combined with moisture. A mature male may push the scales up to 250 pounds while on the hoof, typically have three points per antler side, and hunters often use main beam length as the central criteria for judging trophy size with 30 inches being the standard that many hunters hold out for, though there are some brutes that may stretch the tape to 35 inches or more. Their reddish colored pelage is laden with white spots, making them a beautiful animal. Axis are often vocal, with males making a strange and loud roaring noise during the rut, and both males and females commonly making a barking noise as an alarm signal. Adding to the attraction of the hunt, axis venison is exceptional table fare, with many people considering it to be among the best of all exotic game meats found in Texas.
Concerns are commonly expressed over the impacts that axis deer and other exotic ungulates may have on wildlife habitat and through social conflict with native wildlife species. For certain, there are some ecological downsides of these foreign species being present on other landscapes, but for many private landowners, this exotic resource creates added revenue and recreational opportunities, often incentivizing those landowners to invest money and effort into habitat management, including water development, brush management, seeding of native range plants, and other practices that are often good for the land. As with most landscape practices that involve natural resources, for every action, there are often many reactions, some of which may be good, some not so, while some reactions may simply be subject to biased interpretation.

Though axis deer do not have a synchronized breeding season, the peak of the estrus for females is during the June–July period, which is also the height of when bucks are hard-antlered. Thus, the most popular time to hunt these animals is during the summer, but since some bucks are hard antlered at any given time of the year, it’s common to have axis deer hunting scattered to some degree on a year-around basis. In Texas, since they are an exotic animal, there is no closed season and no bag limits. A non-resident license is only $48 for a 5-day period and is available over the counter. Mature bucks are relatively large bodied animals, with thick musculature frames, so having adequate caliber and bullet type is important. I suggest a minimum of a 130 grain bullet that is well-constructed and not too highly expandable.

Wildlife Systems, Inc. (WSI) is a hunting and wildlife management firm that was started in 1987. This company conducts axis deer hunts on multiple large private ranches in Texas, with most hunts being scheduled from May through July. On Tuesday, February 28, President Trump signed an Executive Order that begins to unwind the Obama administration's controversial Clean Water Rule. Also known as the Waters of the U.S. rule, or WOTUS, the regulation was written by the U.S. EPA and the Army Corps of Engineers to clarify the reach of federal regulators over wetlands and waterways under the Clean Water Act.

Legacy Ranch defining a

I
have to admit I am spoiled. In my role with M4 Ranch Group, I regularly visit and experience the wonders of some of the finest ranches in the western United States. Having explored literally hundreds of ranching properties in the past two decades, I have learned to look beyond the majestic landscapes and finely appointed ranch homes to see the significant level of investment—emotional, financial and physical—that owners have made toward preserving a ranch’s history and lands, its legacy. Ranches deemed “legacy” ranches are steeped in historical significance, natural resources and bountiful wildlife. They are often the result of careful cultivation, great effort, passion and commitment to building a lasting monument to the ranching tradition of the West. In today’s world, where commodities and resources have become largely disposable, legacy ranches represent an impressive effort to maintain and protect not only a piece of the western frontier, but a way of life. In today’s culture of rapid-pace, multi-screen and readily available information, we often hear of big business tycoons, such as Ted Turner, who own hundreds of thousands of acres of ranchland but we do not consider their dedication to preserving the very heritage and life of those lands. Such accomplished people have invested financial resources needed to amass and protect these ever rarer legacy properties, iconcic ranches such as the Wagner Ranch that spans the North Texas plain, the Vermejo Park Ranch of Northern New Mexico, the stunning Belle Ranch located in the antelope plains of New Mexico or the infamous King Ranch of South Texas. But seldom do you see a legacy ranch lying at the foot of 14,000-foot peaks or backed into 100,000s acres of public lands that include designated wilderness areas, national parks and national forests. With as few remaining legacy ranches now dotting the western plains, there are even fewer that have been built and maintained that are located in the highelevation Mountains of the West. Historically, miners typically
settled the high country or mountain regions of the West, with patented mining claims typically being only 10.3 acres. In some larger mineral strikes, hundreds of miners lived together on the multitude of 10.3-acre mineral claims, each miner working to make his stake of pending wealth. Further down the valleys from these lofty mining claims, “placer” claims began to emerge, with “placer” claims allotted in 160-acre tracts that were typically located along the high alpine valley floors. These types of land claims where originally patented in areas where the forward-thinking entrepreneurs planned to mill tons of gold or silver ore on the path to riches. Township communities formed further down the valleys to serve as supply lines for mining camps in places like Telluride, Durango or Crested Butte, Colorado. Just beyond these high alpine townships were the first deeded agricultural grounds in the West, with land parcels comprised of 160-acre homesteads, where hard-working “meat and potatoes” families worked to grow potatoes, harvest hay and run cattle. Given the history and function of land across the western highlands, settled in 160-acre increments by the West’s toughest immigrants, cowboys and dirt farmers, imagine the not-so-simple task of cobbling together rocky and treacherous sections to develop a legacy ranch. This task became even more challenging as, over time, these high country towns went from boom to bust, taking the demand for local beef and potatoes to a standstill. Many producing families did all they could to hang on, many leveraged there homesteads with the local grocer or mercantile to keep staples on the table and farms equipped. As the bills mounted and demand for goods, services and labor disappeared, many western settlers traded their land as a means of settling old debts. To this day, some of the mountain valley’s top ranching families are descended from these former shop owners. So it is with that there is a sincere lack of legacy ranch inventory existing in the high alpine mountains of the West.

So few legacy ranches can be found in mountainous regions that meet “true” legacy standard that discovering and exploring one can be the experience of a lifetime. The Wolf Springs Ranch, a high-altitude alpine ranch that lies at the base of the Sangre de Cristo mountain range, is just such a ranch. It backs into jagged peaks and spans from the bases of peaks to the expansive valley floor of Colorado’s Wet Mountain Range. My work with this ranch has given me the opportunity to truly understand and appreciate the depth of commitment needed to build a legacy ranch of such caliber. Over the course of 28 years, a forward-thinking and passionate ranch owner assembled dozens of land purchases, including land trades with the federal government, the State of Colorado and also lots negotiated as private land purchases. This decades-long commitment and dedication has resulted in the amassing of more than 55,000 deeded mountain acres, building what is seldom found—one of the largest high elevation ranches in the American West. At one point, while standing on the deck of what the land owner calls “Eagles’ Nest Cabin East,” I realized that the owner of Wolf Springs Ranch literally owns the vista, every mesa, peak, river and plain that could be seen from this cabin. In Disney’s iconic animated film The Lion King, King Mufasa tells his son Simba to look out over the African savannah, explaining that their kingdom extends to “everything the light touches.” Standing on that deck, viewing a western skyline of jagged mountain peaks sprawled out before me that overlooked green valleys dotted with blue lakes, the tremendous scale and majesty of the 55,000-acre property overwhelms. The plethora and vibrancy of the wildlife that roam Wolf Creek Ranch is unparalleled, even by Colorado standards. I was literally in awe, with the sound of dueling Elk bugles rising
from the mesa below me, and the fall Aspen colors dotting the green of the pine-covered ridges. That evening, I saw three bears, meadows filled with dozens of trophy-quality, rutting bulls and some spectacular mule deer bucks. Having been a professional outfitter for more than 20 years, with ownership of camps in the most remote parts of Colorado, Montana and Alaska, I typically bedded in a sleeping bag at least 100 nights a year for most of those 20 years. I am no stranger to experiencing breathtaking landscapes and fraternizing with trophy-caliber wildlife. Even so, experiencing first-hand the raw power of those 55,000+ deeded and contiguous acres and their estimated herd of more than 1,000 resident elk, for me, bordered on the spectacular. The Wolf Springs Ranch is so large it sets its own hunting seasons, and its owner has the right to determine which weapons will be used during those hunting seasons, with guaranteed licenses for friends, clients and family. The ranch also opens its doors each year to cow hunters who assist in controlling the herd, all while building a relationship of respect and appreciation with many of the local families. Every year, the REALTORS® Land Institute and the National Association of REALTORS® release a Land Market Survey to help buyers and sellers of land make the most informed decisions possible. With responses from land real estate professionals across the country, its results are indicative of which overall land real estate market trends to pay attention to when making investment decisions. A large percentage of the participants are Accredited Land Consultants (ALCs), the most esteemed, experienced, and well-educated brokers/agents in the industry, lending further credibility to the survey results. Now, let’s dig into why now is an opportune time to purchase land real estate. According to this year’s survey results released on February 14, 2017, the industry’s top land professionals predict an average growth in sales volume of two percent across all land types through October 2017, with a three percent growth expected in each sector for timber, residential, and agricultural greenfield development land. As far as prices of land, an increase is also seen across all sectors defined in the survey. The highest predicted sales volume increases are attributed to timberland and residential land at a rate of three percent, closely followed by agricultural land at two percent and commercial land at one percent.

Yes, these are all predictions. However, when compared with actual transaction data from respondents, the trends fall in line with past sales data. As reported in the survey, overall prices of land across all sectors averaged a one percent increase, with the highest price increases in timberland at five percent and residential land at three percent. Another important take away is that the average time on the market for a piece of land was reported as one-hundred days, selling more quickly for agricultural non-irrigated, timberland, and recreational properties. As I have mentioned in the past, I am a big fan of many classic western movies. One of my favorites is “El Dorado.” How can you not like a movie starring John Wayne and Robert Mitchum. And James Caan and Arthur Hunnicutt. And more importantly, the amazing Charlene Holt and the cutest Carey of them all, Michelle. And the golden throat of George Alexander singing the theme song. But maybe the best part of the movie was when the main bad guy Lou Grant, I mean Ed Asner gets his at the end. He actually deserved worse when you consider how terribly he treated Mary Richards on the Mary Tyler Moore Show eight decades later. So why am a talking about this movie in a great real estate magazine? The reason is because I see much about the movie in today’s land market. In El Dorado, the bad guts were trying to take the McDonald’s ranch away from them and I see similar situations today. As most in real estate are keenly aware, Congress is looking into the idea of changing IRC Section 1031. No one knows exactly what they are thinking but my money is definitely on Congress to mess things up. I have seen where there is talk of placing a one million dollar cap on exchanges to eliminating Section 1031 completely. Any changes made will not be to the benefit of land owners but rather the US Treasury...and that’s not right. So what can 156
land owners who have worked the land with their own hands seven days a week to bring value to their land, take more risks than any occupation that doesn’t include crabbing in the Bering Sea and buy every thing retail and have to sell wholesale and pay the freight both ways (quote by JFK) do if 1031 exchanges are changed. I will admit that I am no John Wayne, Robert Mitchum or James Caan but I might make a good Bull (Arthur Hunnicutt) and his horn. That’s because I am here to tell you that there are options to a 1031 exchange and in some ways, even a better option than a 1031 itself. The answer can be found in IRC Section 453. It is not my intent to go into Section 453 but rather how it can be used as a great 1031 option. Although Section 1031 has been used successfully for decades, there are pitfalls that have prevented exchanges from being completed. For example, once the property was sold, there was a 45 day period to find another property. If you couldn’t find another property in 45 days, the 1031 ended and became taxable. There is no 45 day period with our Section 453 tax deferral strategies. What if you found a great property in 45 days but couldn’t get the property closed in the 180 day period? The 1031 can’t be completed and the failed exchange becomes taxable. There is no 180 day period with Section 453.

Utilizing Section 453, there are no 45 and 180 day periods, there are no loan to value ratios to be concerned about and the property owner can sell his/her property and buy any property at any time in the future. Sounds like something Bull would blow his horn over. Another situation that we have found with 1031 exchanges occurs when there are multiple owners and of course, they all want to sell and do something different. One or more of them wants to defer taxes utilizing another 1031 and one or more wants to take the money and run. No problem for us. The sellers that want to take the money and run can do so and the sellers that want to defer taxes can do so using our Section 453 tax deferral strategies. Since I seem to be on a roll, let’s look at some other tax deferral opportunities that property owners can benefit from by utilizing Section 453. First, many land owners own property that will eventually become their retirement plan. At some point in time, the land owner would like to sell, retire and move closer to their grandchildren so they can spoil them in an effort to get even with their kids for being so rotten when they were growing up. The problem for the land owners to do so could be taxes when they sell their property. For example, let’s say for sake of discussion that the property has been in the family for 60+ years and almost all of the sales proceeds will be considered to be capital gains. When taking into account the 20 percent capital gains tax, the five to ten percent state tax in 43 states and depreciation recapture of 25 percent, that could mean a tax rate of roughly 30 percent on the sales proceeds and that could be an obstacle to selling the property. Section 453 can defer those taxes and provide the land owners when they retire with a larger retirement plan which can be passed on to their heirs if they so desire. Hide the grandkids! Many land owners are not aware that they can defer their capital gains taxes and retire using Section 453, so quite a few land owners decide to use the stepped up basis to eliminate their capital gains tax liability. This may be a good strategy but there are pitfalls here as well. For example, no one knows how long the stepped up basis will remain as part of the tax code if Congress decides to take a look at it. In addition, what will the market value for that property be at that point in time. It could be double the current market value or it could be 20 percent less. And maybe most importantly, the stepped up basis has nothing to do with the federal estate tax if it’s applicable to the situation and can be far more devastating to the family than avoiding capital gains tax.
Section 453 may be a great option. The land owner can sell now, defer taxes now, generate about a six percent appreciation every year into your savings account on the sales proceeds and there may be estate planning opportunities for the families as well. Of course, each situation needs to be looked at separately but the opportunity may be there. Another opportunity that may present itself is when selling a great high end residential property. A 1031 is not appropriate for a residential property but if the sale of a great residential property will create a large tax liability, we may be able to defer the capital gains tax and the state tax on the sales proceeds. A lot of US citizens own property in a foreign country. That property could be a hunting property in South Africa to a ranch in Argentina to a great fishing property in Norway. Whenever a US citizen sells a property even in a foreign country, there is a US capital gains tax to be paid if one is generated. We can defer those US capital gains tax. So if your family has owned a castle in Germany on the Rhine River for the past 400 years,we can defer the US capital gains tax on that sale. If you own property somewhere in Middle Earth, good luck! Although at this moment, no one knows what Congress is going to do, here is a sobering thought. Grover Norquist of Americans for Tax Reform believes that it would be a mistake to make any changes in Section 1031 but he cautions that Congress is taking a hard look and there could be changes made and those changes will not be positive for land owners. One of my current concerns is that no one seems to have any ideas what to do if Section 1031 is dramatically changed or repealed. The big qualified intermediaries seem to have no Plan B if this happens. I am not one to toot my own horn but maybe Bull will toot his for me. I hope that Congress has the good sense to leave 1031 exchanges alone but if not and even if they do, Section 453 provides much needed flexibility for the land owner. Maybe its time you get to determine how you will sell your property instead of having to jump through IRS hoops. Now go sell a great property and do it your way. Keep those taxes in your pocket for the benefit of you and your family and not give them to some member of Congress who will send your tax dollars to his district for a useless pork project and I don’t mean buying some hogs. ° LAND.COM • LEGENDARY LIVING

What is an ALC?
An Accredited Land Consultant, or ALC, is a land real estate broker or agent who has completed a rigorous Land University (LANDU) Education Program through the REALTORS® Land Institute, an affiliate of the National Association of REALTORS®. In addition, all ALCs have met a high level of experience and transaction volume requirements ensuring their expertise when it comes to conducting and closing real estate deals. On top of having a proven and unparalleled level of expertise and experience, ALCs are required to adhere to the ALC Code of Conduct, which assures high ethical standards, in order to maintain their elite status as an ALC and ensure their clients best interest take priority.
Expertise
ALCs understand the value of being the expert on all matters pertaining to a client’s transaction. Land transactions, in particular, require specialized knowledge and familiarity with the industry to competently ensure the client’s best interests are met. From understanding the various legal aspects of a transaction to applying knowledge of soil types, investment analysis, timberland valuation, recreational or agricultural land management, and more, ALCs are certified to have the expertise needed to represent their clients.
Experience
As the old saying goes, “there is no teacher like experience.” Which is why to become an ALC, applicants must submit a resume that demonstrates a minimum of two years of experience in land sales or brokerage or a minimum of three years of comparable real estate experience. They must also prove experience in at least five closed land transactions totaling $10,000,000, or a total of twenty-five separate land transactions.

One key to success that many clients overlook is having a broker or agent that is well connected with other brokers and agents across the country. Colorado RLI Chapter It’s quite obvious from the big deals already closed in Colorado just in the first few months of this year, that this will certainly be one of the best years ever for sales in the ranch and recreational real estate market. Whether it’s the fact that we have a new party in the political office, or just the fact that the election season is officially behind us, I’ve noticed several buyers pulling the trigger on large acreage purchases, that were all sitting on the fence this same time last year. From family retreats, to large hunting operations, to vacation homes that offer fabulous fly fishing, the level of activity this year compared to last year has been quite astonishing for buyers with discretionary money to spend in the Rocky Mountains. With the level of snowpack that we have across the state, irrigation season promises to be phenomenal across the Rocky Mountains. Not only will the snowpack benefit the farmers and ranchers, but it will also benefit local economies. Rafting companies will likely see record numbers this year, tourists will enjoy thrills and sensations of July white-water as if it were June, and hotels and micro-breweries will do all they can to keep up and make room for the demand that the tourists will bring. I’m quite confident the ripple effect and trickle down we’ll see from the effects of this year’s snowfall will continue to keep our regional real estate markets very strong.

In an effort to always increase their knowledge and education to better serve their clients, several of our chapter members will be gathering together in Breckenridge in May for our Spring Marketing and Education Sessions. Topics of conversation will include market trends by geographic regions, market trends by price, and the presenting of some of the best properties currently on the market by our members.
