The La Panza Ranch history is rich and fascinating. The ranch is well known for being owned in the 1860s by Drury James, uncle of the infamous outlaws Jesse and Frank James. The brothers visited and worked on the ranch in 1868 when Jesse was recovering from bullet wounds inflicted during a bank robbery. He came to bathe in the sulfur springs at Uncle Drury’s Hot Springs Hotel in nearby Paso Robles. Drury James is also credited as one of the three founders of Paso Robles. The brothers’ stay was without incident, and they left a year later.

I’m writing this on March 20. My calendar says, “First day of Spring.” The calendar lied.
The head-high snow drifts just outside my window here in Crested Butte tell a completely different story. We’ve had record-breaking snow this winter, especially this March. People have dubbed it “Snowmaggedon.”

Punxsutawney Phil probably didn’t mean to, but that rodent lied too. Spring didn’t come early. In fact, I find myself battling the urge to stand on our balcony and yell, “Hey Spring, where the hell are you?” Now don’t get me wrong. I love, love, love winter in the Rocky Mountains. I’m a fiend for the slopes and am always ready to explore the back country on our snowbikes, but now that I live in a place where there are four seasons, I want to experience them all. Some folks might call me greedy, but I prefer to think of myself as appreciative. I look forward to spring and the renewal that accompanies it. Honestly, is there anything more beautiful than the transition between winter and spring when Mother Nature trades her pristine white linens blanketing the landscape for a patchwork quilt with vibrant splashes of red, blue, yellow, orange, purple and verdant green? During my childhood a popular commercial reminded us all, “It’s not nice to fool Mother Nature.” I assume she doesn’t like to be rushed either, so I’ll try to be patient and let her take her time. A fresh start is worth wait. . . . As you’re anticipating the world’s annual rebirth, I encourage you to explore this issue to see where you might want to make a fresh start on a new ranch, farm or country estate. Four Letter Word—BOOM “BOOM!” The four-letter word that Dr. Mark G. Dotzour, real estate economist who served for eighteen years as Chief Economist of the Real Estate Center at Texas A&M University, uttered as he tried to condense the state of the U.S. economy into one word.
Each year, the finest land professionals in the country gather for a three-day conference to network, discuss relative land issues and hear from leading experts in the land industry. This year, the event took place northwest of Albuquerque, New Mexico, at the acclaimed Tamaya Resort—a fantastic facility that gracefully accommodated us in a high desert luxury setting. As always, the conference provided a mass information download from industry experts in the land brokerage community. Dr. John Newton, Chief Economist for American Farm Bureau Federation, explained the implications of the new Farm Bill. Terry Barr, a nationally recognized economist, discussed Global Challenges for U.S. agriculture and Russell W. Riggs, Government Affairs Liaison for National Association of Realtors, always provides a great update on legislative issues pertinent to our industry. This is just the start: topics such as hemp, commodity prices, developing relative marketing strategies with current technology and ecological value in land are just a few of the areas that were covered, but all helped us gain valuable market information and learn of new market resources to ultimately best serve our clients. Dr. Dotzour, a self-proclaimed pessimist, stood in front of this same crowd 12 months earlier, and his phrase then was, “clear sailing ahead.” Hind sight is always 20/20, and the proof is in the pudding. Over the last twelve months, the U.S. condition has outpaced projections. Unemployment is at a 50-year low, tax cuts have stimulated growth, and in spite of the propaganda fueled by both sides of the media, the economic indicators show we are far from a recession; interest rates will stay low and job growth will continue. He did point out areas of concern, such as over-paid, over-leveraged farm land in the mid-west will be affected with low commodity prices and segments of residential home sales that have plateaued. That being said, the overall economic condition is strong, like a rocket ship! Interestingly, Dr. Dotzour’s greatest warning to the crowd was the twist and control of the mainstream media. He pointed to segments of both sides
of the aisle producing inflammatory materials that contradict the truth of our economy. Be careful what you read and watch, and his advice: get your news from a news source (WSJ, Associated Press and Reuters), not a TV.
I have to say as the president of the Realtors Land Institute Colorado Chapter, I could not have been prouder of the great turnout by the thirty Colorado professionals that attended this meeting. The Accredited Land Consultant (ALC) is a designation that is very much earned. It is a combination of intense classwork, production requirements and panel review. An ALC is one of the very few designations recognized nationally and is a proven indicator of professionalism in the land industry. Colorado had a record number of inductees. These are my friends, and there is no one I’d rather do a deal with. Inductees for 2018: Joseph Burns - Lone Eagle Land Brokerage, Bill Davis – Keller Williams, Ren Martyn – Sotheby’s Steamboat Springs, Dan Murphy – M4 Ranch Company, Michael Murphy – M4 Ranch Company and Justin Osborn – Wells Group. Lastly, each year the National Land Conference hosts the Apex awards for the country’s top producers. This year, Robb Nelson of Mirr Ranch Group was listed in the top twenty producers overall. Congratulations, Robb, on that great accomplishment! I like the bottom line. When the economy is strong, people are happier, new opportunities arise, there is greater time to dream and create. Commerce drives freedom, and freedom allows us to own our greatest resource: the actual land that feeds us, the homes that provide us shelter, the wildlife sanctuaries to hunt in the open, fresh air. E V E R Y O N E H A S A H I D D E N T A L E N T . For some, it is a performance skill such as singing or playing an instrument. For others, it’s a marketable skill like welding, baking or artistry. And for many, it’s something simple but impressive—magic tricks, stunts or the ability to cram 23 marshmallows into your mouth without choking. Whatever your particular talent, those who are meeting you for the first time can’t usually see that talent on the surface. You must spend time with someone and get to know them before unlocking what’s inside. (People don’t cram marshmallows in their mouth for strangers.) But these talents make people fun far beyond simple socialization. They make people unique and interesting. Land is no different. And while I have never seen land sing or bake, I have seen many pieces of land with their own hidden talents, that is, attributes that make for hidden value sources for owners and sellers. Finding and taking advantage of these hidden talents can provide higher cash flow, a higher selling price, or even intrinsic benefits to landowners and sellers alike. Here are just a few examples of places to look for, and hopefully find, hidden value in your or your client’s property.
1. MINER AL RIGHTS
Oftentimes, people can’t see beyond, well, what they can see. What is contained below the surface is sometimes the most valuable part of the property. Mineral rights can be very lucrative depending on location or resource to be mined. This may be a value a buyer wants to tap right away or at some point in the future after an alternative use. For example, here in Florida there are pieces of land that are used for cattle grazing and then later for mining of phosphate. Still later, some of the phosphate land is reclaimed for reservoirs or even single-family homes. In a unique case, there is even a luxury golf course built on an old phosphate mine near Tampa. (Check out StreamsongResort.com. This may be one of the best examples of hidden value I’ve ever seen.) Mineral rights are tricky and investing in them somewhat speculative. But properly considered, their value is not to be dismissed.
2 . C O N S E R VAT I O N E A S E M E N T S
This one gets a lot of debate. Some people would argue that this isn’t hidden value, as putting a conservation on your land restricts the use, therefore devaluing it. And while I don’t disagree that selling prices for encumbered land are necessarily lower than their unencumbered counterparts, the real question lies in property use. I’ve seen cattlemen pursue easements that remove their development rights—but only on land their family has been running cattle on for 100 years that they would never think of selling. These easements include what are called “compatible use agreements” which allow them to continue running cattle at a reasonable volume. Money in their pockets, they continue to operate as they always have. It is important to understand not only your rights but also your obligations as the owner of easement land. But if those line up, the opportunity could be an attractive one.
3. MULCH
This is definitely a much smaller scale example but still worth mentioning. Do you have an area of trees on your property that you think is worthless? Hire someone to clear those trees and turn them into mulch. I have personally had clients who have collected thousands of dollars from just a few acres of pine or cypress. You don’t have to have a section full of 15-year-old pines to realize value from trees. This is certainly not a good retirement plan. But for smaller areas with no real merchantable timber, mulching is an excellent option that will provide some income.
4. LEASING: HUNTING, FISHING, C A M P I N G , AT V R I D I N G
Again, not a lottery ticket here, but you don’t always need thousands of acres to provide a recreational area for someone. I’ve seen people lease as little as 10 acres for people to ride ATVs or dirt bikes on and as little as 100 acres for people to hunt on. Usually, these are vacant land pieces within 30 minutes or so of a city for people to just enjoy the outdoors. Sometimes referred to as “play land,” pieces like these provide the city-dwellers an opportunity to get away, get dirty and enjoy some fresh air. Some landowners even provide limited use of their land free of charge to non-profit organizations. Not only is this great community involvement, but it could also provide an opportunity to deduct the fair market value of that use for tax purposes. (Not offering tax advice. Consult your CPA J.)

Culturally Modified Trees Living Sculptures Waiting to be Discovered Story by Karen Deger McChesney
Don Wells and his fellow retirees kept seeing oddly bent trees on their weekly hikes in the northern Georgia mountains. They were intrigued with the ancient giants. Wells happened to meet neighbor Elaine Jordan, who wrote a guide book, Indian Trail Trees, after interviewing Native Americans about these trees. He started taking her to the trees and photographing them. Trail Tree’itis hit and suddenly, the retired civil engineer was starting a whole new career. For over 10 years, the log home designed by Wells and his wife, Diane, has been headquarters for Mountain Stewards, known for having the only national database of these unique living artifacts. Today, the Wells still drive up to 10,000 miles a year visiting bent trees and tree researchers across the U.S. WHAT DO THESE TREES LOOK LIKE? They are those unusual trees that make you stop and wonder how a tree could have possibly curved and grown sideways, at such an impossible angle, and then turned sharply up again toward the sky. They look like sculptures. They are historical curiosities that can be found anywhere—private land, forests, city parks, front yards, golf courses. Although they are over 100 years old and have increased in diameter, amazingly, the bent portions of these trees still point in the same direction as when the Native Americans are believed to have first bent them. They ingeniously bent saplings and tied them down with a strip of rawhide, bark or tough vine, forcing it to grow into distorted un-natural shapes. Typically, the tree had a horizontal bend several feet off the ground and oftentimes, branches grew vertically from bent sections. But, why do this to a tree? Bending doesn’t kill or damage trees, says anthropologist Linda Pelon, who co-authored the book, Comanche Marker Trees of Texas with Comanche Tribal Administrator Jimmy W. Arterberry and Arborist Steve Houser. “It was a simply sophisticated way to use land,” Pelon believes. Native Americans were always walking and created these permanent living signs to navigate the American West and communicate with one another, and ultimately, keep their tribes together. It was their GPS! “Bent trees told them where to go,” says Houser, founding member of Texas Historic Tree Coalition. Often called Trail or Marker Trees, “the vocabulary on how these trees are referenced varies geographically,” says John Anderson, whose fascination with

strangely bent ponderosa pines in southern Colorado led him to write the book, Ute Indian Prayer Trees of the Pikes Peak Region. Most researchers concur that Culturally Modified Trees (CMT’s) is an allencompassing term that can be used to describe trees that have been modified by indigenous people. CMT’s helped Native Americans find what they needed to live, such as safe paths through rough forests, natural springs, river crossings, shelter and encampments, ancestor’s graves, medicinal plants, hunting areas, exposed mineral deposits (copper, salt, silver, and quartz were among many minerals mined to make jewelry; and chirt was used to make tools and weapons like knife blades and ax heads). In the Wells’ documentary, Mystery of the Trees, Tom Belt of the Cherokee Nation of Oklahoma explains the purpose: “The bending of trees were essentially part of a great highway system that allowed people from many tribes to interact with each other, and there was an inordinate amount of trade going on.” TRYING TO CATEGORIZE CMT ’S In 2007, the Wells invited researchers to share photos and officially launched The Trail Tree Project to locate, document and preserve CMT’s throughout the U.S. and Canada. Now, they have 2,570 CMT’s in their database covering 44 states. They have yet to officially identify CMT’s in North and South Dakota, Idaho, and Nevada. Looking for these trees has become a science in itself, since each tribe bent and formed them differently. Most are species that were flexible saplings and had lengthy life spans, such as red oak, bur oak, pecan, eastern cedar, and ponderosa pine (which easily live 800 years).
The research takes a village! T H E N A M E L A P A N Z A can be traced back to the early days of Spanish and Mexican settlement when the area was known as prime territory for Ursus horribilis, the now-extinct California grizzly bear. Vaqueros intent on protecting their livestock often used bits of slaughtered cattle, including “the paunch,” to lure bears, so they could be poisoned, trapped or lassoed. Some of the bears may have been caught and kept alive. In the late 19th century in frontier California, promoters pitted captured bears against fullgrown bulls in a public fight to the death. While California’s legendary Gold Rush took place from 1848–1855, the La Panza gold rush made its historical mark beginning in 1878. According to the accepted mix of legend, lore and fact, a failed mule deer hunt led to the discovery of gold. Needing to refill his larder, Efranio Trujillo mounted his horse and left his camp in search of a deer. A day of hard riding finally brought him success in the form of a young buck with barely emerged antlers. When Trujillo fired, he wounded the animal, which bounded away. Trujillo trailed the injured animal until he lost the tracks and realized the animal’s wound wasn’t life threatening. Disgruntled he stopped at a spring to

rest his horse and belatedly eat his lunch. As he bent toward the refreshing water, he saw a glittering sandbar. In that mixture of sand and precious metal, Trujillo spotted gold flakes, two or three of which were large enough to pick up by hand. Strictly speaking, though, Trujillo’s discovery was no discovery at all. The mission padres had known of gold in the La Panza hills and had Native American neophytes likely from the Chumash tribe mining there in the early 1800s. In the 1830s when secularization of the missions had taken over Church property in California, the padres had closed the mines and sworn the Native Americans to secrecy. No one swore Trujillo to secrecy, and as word of the “flakes big enough to pick up by hand” spread, the once isolated tributary of the San Juan River boomed and a boisterous mining camp was formed, complete with a saloon and dance hall. Within the next few weeks, between 500 and 600 men stampeded into the area hoping to strike it rich. The area would become one of the most important California gold fields outside the Mother Lode country. In the spring of 1879, word of the mining excitement reached Dr. Thomas C. Still, a medical practitioner from Kern County. He moved his family to the mining field. Still not only hauled and sold produce to the mining camp, he established a general store and applied for a post office permit. In November of that year, the La Panza Post Office was established. The post office was named after the nearby La Panza Ranch, which had been owned in the 1860s by Drury James, uncle of outlaws Frank and Jesse. According to stories, the duo, under false names, holed up at the ranch for a time. Their ruse didn’t fool the locals.
By the time gold fever hit the area, the ranch, which was adjacent to the gold field, had been sold to the partnership of Jones and Schoenfeld. They raised sheep and cattle. Mining camps, with their mix of prospectors, drifters, grifters and outlaws, were a cauldron for mayhem. Fortunately for area residents, Dr. Still continued to practice medicine. Many decades later, Still’s grandson, O.M. Maclean, relayed one of the many episodes of frontier medicine. One night Dr. Still was roused from his sleep by urgent, incessant knocking. When he opened the door, a man asked him to come treat a wounded friend. In answer to the question of what happened, the excited man blurted out, “I shot a man.” He caught his error and quickly said, “I mean, a man has shot himself.” Upon arriving at the wounded man’s bedside, the doctor determined the patient was in very grave condition. Despite his patient’s precarious hold on life, Dr. Still successfully removed the bullet. He instructed the patient’s friend that moving the injured man could prove fatal. The next morning Dr. Still was greeted by an empty room. The two men, on the run from the law, had disappeared because they were afraid he would report the incident to the sheriff. While La Panza generated a lot of excitement, it was not an easy field to work. Many of the streams were small and intermittent. An anonymous miner who prospected in the area published an account in the South Coast newspaper on February 5, 1879. He wrote: “Prospects of fine gold are found nearly everywhere in the streams. Evidently there are rich pockets of gold which wash into the streams and lower flats, but there is not enough water to use the hydraulic process.”
The first official report of gold production was made in 1882 when $5,000 was reportedly taken out. By 1886, the region was producing $9,164 a year, which proved to be its largest recorded annual take, but it dropped to $1,740 in 1887. The numbers continued to rise and fall each year, with the lowest annual recovery of $124 occurring in 1913, the last available report. While there was never a huge strike, it is estimated the La Panza region produced at least $100,000 worth of the precious metal. In comparison, the Sacramento Valley, which is home to Sutter’s Mill and the ensuing Mother Lode strikes, produced more than $2 billion worth of gold from 1848–1852. As gold production subsided, so did gold fever and the area’s population. Quiet returned to the region as did deer, mountain lions, coyotes and ranching. °

The county is one of California’s original counties, created in 1850 at the time of statehood. The county seat is San Luis Obispo. Mission San Luis Obispo de Tolosa was founded on September 1, 1772 in the area that is now the city of San Luis Obispo. The mission, city and county were named for Saint Louis of Toulouse, who was the young bishop of Toulouse in 1297. Obispo means bishop in Spanish, while Tolosa is the Spanish spelling of Toulouse. According to the U.S. Census Bureau, the county has a total area of 3,616 square miles, of which 3,299 square miles is land and 317 square miles is water. In 2017, the population was 283,409.

The Five Cities region, which consists of Pismo Beach, Grover Beach and Oceano (County), is located to the south. Nipomo, just south of the Five Cities, borders northern Santa Barbara County. Inland, the cities of Paso Robles, Templeton and Atascadero lie along the Salinas River, near the Paso Robles wine region. The Salinas River Valley, a region that figures strongly in several John Steinbeck novels, stretches north from San Luis Obispo County. The remote California Valley near Soda Lake is the region’s least developed area. Travels through this area and the hills east of Highway 101 during wildflower season are very beautiful, and many people incorporate wildflower viewing with wine tasting at local vineyards.

La Panza means “the paunch,” which was a portion of slaughtered beef the vaqueros used as bait to trap or poison the California Grizzly bear, common to the area back then. The historic Swenson Ranches trace their origin to Svante Magnus Swenson, the first Swedish immigrant to arrive in Texas, landing near what is now Galveston in 1838. The famous SMS brand, with two backward S’s, was one of the first registered in Texas and was derived from Swenson’s initials. Swenson, a close ally of Sam Houston, played an active role in the state’s early history. He served as Travis County Commissioner in the 1850s and as the first Treasurer of the State Agriculture Society. The Flat Top Division of the legendary Swenson Ranch was established in 1853/1854.
