Andrew Kay says let them eat cake – if he can find the baking tins, that is
M
oving home is a stressful experience and that’s a fact. It’s expensive and tiring and you lose stuff. I know this only too well. Over the years I have lost so much stuff that it makes me want to weep. Mind you, I like a good weep. I spent Saturday morning crying over the demise of Schmeichel – I know, how sad am I? I decided to lift my mood by doing a spot of baking. I don’t know what it is about baking but it’s the best kind of therapy I know: soothing, focusing and with the reward of foodie treats at the end. With the imminent arrival of a coeliac friend for lunch I was “The kitchen looked in pursuit of the perfect gluten like Armageddon and I free pudding. I wanted a dessert that looked and tasted was covered from head sinful but one that she could eat without risk of her throat to toe in gloop and closing and her lips looking ground almonds with a like Tina Turner’s in full pout. The answer came in the form of a mad recipe, Spanish fine meringue topping” in origin I believe, that involved boiling and pulping oranges. I found several variants online but finally settled on one from the BBC website. Now baking is a messy business, and I have to confess to being a messy cook, but this recipe stretched the concept of mess. I have never seen so many pans, bowls, whisks and spoons needed to make one cake. The kitchen looked like Armageddon and I was covered from head to toe in gloop and ground almonds with a fine meringue topping. Eventually I had measured, boiled whisked and folded, and I had a fine looking and tasting batter ready for the baking tin and hence, to the oven. It was only then that I realised I had not seen any of my baking tins and moulds since the move. I opened draws, rummaged in cupboards but they were, like mother Hubbard’s, bare. Somewhere along the line I have misplaced a huge plastic hopper filled with a fine assortment of cake tins and moulds. The cake though is worth the effort, despite the mess and time involved, and it went down a treat. I only wish I still had my cake tins because it didnt look as good as it might have, having been baked in a roasting tin.

The Landlady The Landlady has a lucky escape

A
T
s a fairly proficient landlady, I am often rather alarmed when I hear about tenants living in squalid and potentially dangerous properties, who are too afraid to challenge their respective landlords about their living conditions. In some cases, the local council have to get involved and force the landlord into rectifying these issues. Perhaps many tenants do not realise that the law is very much on their side and they should not have to tolerate what amounts to bullying behaviour from their landlords. As a person who seems to traditionally end up running the freeholds of various properties, I know only too well how disinterested many landlords are in their rental portfolios, as long as the money keeps rolling in. For example, I am organising the painting of the Communal Hallway in Hastings at the moment and have had no response from fellow lessees regarding what colour I should paint below the dado... Taking all the above into consideration, I was rather alarmed to this week discover a potential time-bomb ticking away in my own house. I awoke on Tuesday morning to three missed calls from the tenant who rents the ground floor flat in my house. I always switch my phone off at night to deflect potential calls from deeply unsavoury friends of mine who often telephone from the Lion and Lobster to urge me to go down there, which always ends in (my) tears. With each call, my tenant left increasingly frantic messages. I bolted straight down there as soon as I received the messages to find out exactly what had gone on. Apparently, my tenant had been awoken at 2.30am by the sound of ‘roaring flames’. Under further inspection, there were indeed roaring “There were flames shooting up from behind the back of the cooker. The tenant quickly threw water onto the flames and put the indeed roaring fire out, then called the emergency flames shooting up services as she could smell gas. The emergency gas people came out and from the cooker” discovered that a live wire behind the gas cooker had been arcing off the gas supply pipe and had eventually melted it, then set fire to it. What are the chances of that? To put it in perspective, it is the equivalent of lighting a live gas supply in the middle of a pile of wood. The scary thing is that the live wire must have been there since I bought the flat in 1999. I have had at least eight gas safety checks since then, which haven’t picked up on the problem. Scarier still, the tenant had been away for the two days prior to the conflagration and had only returned that evening. It doesn’t bear thinking about what would have happened had she not been there, as although I have smoke alarms in my flat, they wouldn’t have gone off until the entire ground floor had burnt out. Fortunately, I was able to get the gas supply back on and the offending wire removed the same day. My tenant and I agree that we must have some sort of angels watching over us...
he Seaside Smile, as performed by music hall artiste Vesta Tilley, would have been an appropriate accompaniment to the recent grand unveiling of two commemorative plaques at St Aubyn’s Mansions in Hove. Vesta Tilley was once a resident of St Aubyn’s Mansions as was Dame Clara Butt. The unveiling ceremony in August to show off the two new blue plaques to commemorate the ladies’ respective stays at the building was carried out by the Deputy Mayor, Cllr Geoff Wells, and was, indeed, a fun occasion. It was not until afterwards though that it was discovered that Vesta’s plaque featured an incorrect date. St Aubyn’s Mansions is the mustardcoloured mansion block on the Hove seafront adjacent to the King Alfred site. It was built in 1899 to the designs of Lainson & Sons as part of an ambitious scheme that was never completed. It consists of four principal floors with two flats per floor; eight in total. “Vesta Tilley (Lady de Frece) 1864 – 1952 Music Hall Artiste Lived Here” is the inscription “The plaque on the plaque to the right of the building’s front door. Vesta bought 8 St Aubyn’s Mansions, on featured an the top floor, in 1947, aged 83, as a holiday incorrect date” home. She became ‘Lady de Frece’ when her husband, the music hall owner Walter de Frece, was knighted in 1919 for services to the war effort. The couple’s honeymoon after their marriage in 1890 was spent at the Grand Hotel in Brighton and Clara regularly performed at the Hippodrome on Middle Street. “Dame Clara Butt (1872-1936) Recitalist and Concert Singer Lived Here” reads the inscription on the plaque to the left. Dame Clara lived in 4 St Aubyn’s Mansions, on the first floor, from 1903 to around 1906 with her husband, Kennerly Rumford. Her grand piano was kept in their large hallway. The plaques were paid for by both the residents of St Aubyn’s Mansion and Brighton & Hove City Council. Thankfully, the type of commemorative plaque favoured by the council weathers well. The two St Aubyn’s plaques need to be extremely durable. After all, St Aubyn’s Mansions is one of the closest buildings to the sea in the whole of the city. November saw the replacement of Dama Clara’s first plaque with a second which states her correct birth date of ‘1872’ instead of ‘1848’. I certainly smiled. I
’ve already bought my Christmas presents. What’s wrong with me? That’s when you know you’re getting older... Once upon a time, I’d be so embroiled in Christmas partying I’d buy whatever was left in the shops on Christmas Eve! Hang on, is this getting old or am I getting smart? After all, I’ve bought all my presents discounted, in the ‘sales’. (when isn’t there a sale on these days?... Gotta love a recession!) I’ve saved myself a fortune; well, probably enough to pay for all the stuff I ended up “I hid it so well even I buying myself while shopping for others... It was couldn’t find it” like a game of “one for them, one for me, one for them...” To be honest my Christmas shopping started off as “one for me, one for me” but I managed to adapt it eventually and present shopping is done. What I’m learning though, is that if you buy presents too early you just end up seeing more stuff weeks later and spending more! I’m single handedly keeping the economy going. I’ve found a ‘Hello Kitty’ coat I bought in June for my child’s birthday in August, I somehow forgot about... I hid it so well even I couldn't find it. How much stuff should one buy a child for Christmas? I don’t want to spoil her but I want her to feel like something special is happening. Maybe if I let her eat biscuits on the sofa she’ll know it’s Christmas! Maybe if I don’t bark at her to wear something warm she’ll know it’s Christmas. “Take those flip-flops off! Its not summer/your birthday/Christmas!” I want to hide the flip-flops; they are the bain of my life. She wants to wear them 24/7. It’s November, it’s one degree out there in open-toe land. She should wear a T-shirt that says “I’m not cold” she says it so often. Well I am. So I bought a woolly hat and she sweetly says: “Can I wear it?” She gets so hot in it, she takes off her coat which I then have to carry, while walking home with my cold ears. I then buy myself gloves (while Christmas shopping for everyone else; “One for me, one for them”). My daughter spots my gloves: “Can I wear them?” Of course, I had no idea ‘Miss Hot All Year’ needed them. They are black and fingerless. My daughter now looks like a market stall holder. When we get home she does pull ups off the wrought iron bed. She looks like a boxer preparing for a match. I try to claim my gloves back but she says she likes them – “except I would like them with finger bits on.” So I tell her I will buy her some kids’ mitts with finger bits and I try to get mine back. “No I want these!” Grrr. If you are buying me a Christmas present please buy something my five year old can't borrow.

I
once met Chewbacca in a caravan. Well, that isn’t strictly true. I wasn’t in a caravan, but he was, and I queued up outside to get his autograph. This was at a village fete in 1978. Queuing also featured when I went to see Return Of The Jedi, and we arrived late at the cinema for The Empire Strikes Back. With films not being shown for ages on TV after they were released, it was another seven years before I saw the first 20 minutes. My memories of The Phantom Menace are too fresh (and painful) to talk about. All of these recollections are overshadowed by the frequency with which Star Wars has intruded in The Boy’s lifetime. The DVDs came out in the week of his birth – I watched them through bleary-eyed tiredness – and from that moment, the whole galaxy has never been very far away at all. I owe this column to Star Wars too. I speculatively sent in a short piece about explaining badly to a four year old which order the films came in. The editor said she liked it, and contacted me four months later asking if I wanted to write a column. Over the two and a half years I’ve been writing Distracted Dad, I’d guess that Darth Vader is mentioned in eleven different columns, Star Wars in about twenty five. Just for comparison, France gets two mentions, and world poverty just the one (in my column on “pastry”). The Star Wars universe is how The Boy measures the future. He grades his own growing up in terms of lego models that are becoming within his age range, and knows that 12 is when he can – legally – watch Revenge Of The Sith. It is also The Boy’s small talk. Only today, he’s asked me complicated questions about Grand Moff Tarkin as we headed for Southwick Square. I’ve also this week listened as The Boy discussed the pros and cons of minor characters. E.G Kit Fisto (yes, exactly, who’s heard of him?) Star Wars also marks out the year. Halloween has been influenced. One “The Star Wars universe costume was the Rancor is how The Boy measures Monster, complete with authentic twig that gets the future” stuck in his mouth, and another costume, Darth Vader (No.1 choice for the last couple of years). Christmas too doesn‘t get off scott-free. The Boy was lucky enough to meet Father Christmas on a train carriage once. He was silent as Father Christmas asked a number of questions: “Do you have a chimney?”, “Have you been good?” etc, but he did offer up his only two words when asked what he wanted for Christmas. Very deliberately, The Boy announced: “General Grievous”.

Q. Over the last two or three years one of my employees had gradually let it be known that he is gay. This did not cause any problem amongst the existing staff and he did not suggest that he wanted to make any of this confidential. We have subsequently taken on a new employee who has been told by the other employees that this individual is gay and regrettably this new employee has started to harass the gay man. Are we as employers responsible for this harassment? A. In a rather surprising decision, in my view, in the Court of Appeal this July it was held that if the gay person had not required his
disclosure to remain confidential he could not complain if that fact was disclosed to a new employee and that employee harassed him. The Court of Appeal also placed heavy emphasis on what the intention was of the so called “harasser” whereas before cases had suggested that the intention was irrelevant and it was the effect that was important. Q. Presumably in that situation the employer cannot be liable if the employee in question cannot be held liable. A. Unfortunately all these cases depend upon their particular facts and it is difficult to lay down hard
and fast rules about that. In another situation it could be decided of course that words said by the gay man, although not specifically requiring confidentiality, made it clear that he did want it kept confidential. It is difficult therefore to give general advice. However, the main point to concern employers is that under the Equality Act 2010 an employer is liable for “anything done” by one of its employees and it does not matter whether it is done with the employer’s knowledge or approval. However there is a defence for the employer if it can show that it took all reasonable steps to prevent the particular employee from behaving in the way he did.

Reasonable excuse The law says that the penalty for submitting a late self-assessment tax return may be rescinded where there is ‘reasonable excuse’. No surprise that HMRC’s opinion of reasonable excuse is fairly biased, but in a recent tribunal one judge said of the taxman that his action “smacks more of the conduct of a disreputable debt collector than of responsible conduct by an organ of the state”. Pretty strong stuff. HMRC will hopefully re-think its position as a result, so consider appealing a penalty if you have good reason. Entrepreneur’s Relief Until recently, the sale of your company in exchange for shares and other securities in the takeover company was ignored for CGT purposes on the grounds of it being a ‘paper-for-paper’ transaction. The problem then arose that any sale of new shares was potentially liable to 28 per cent CGT. The good news is that recent tax changes mean you can now elect to dis-apply the rule and take advantage of 10 per cent Entrepreneur’s Relief. Tax-effective repairs The taxman will always want to argue that repairs to capital assets
are replacement or improvement. Any ‘repair’ costs are then considered capital in nature and, in the case of property, you may not get the tax relief for some time. Key issues to be aware of are: a) you are allowed to use better materials; b) keep as much of the original asset as you can, and; c) don’t unnecessarily improve the function or performance of an asset.
This is not Wrong PAYE Code Operating the wrong tax code for an employee is one mistake that crops up frequently and which HMRC will use to make you liable for any underpaid taxes. Inform HMRC that you are correcting on a ‘week 1/month 1’ basis if you spot a mistake as this avoids a big tax hit for your employee and contacting HMRC should demonstrate reasonable care. New penalty rules The taxman continues to whittle away at increasing his penalty regime of indirect tax collection through the back door. In his latest initiative he has withdrawn the zero-penalty for a late 31 October paper tax return where there is no tax liability and future late papernil-returns will be subject to the £100 penalty.
And finally… Thinking about 2011, we started in recession, rallied slightly, and now look set to exit going into another one. Despite all this, though, there is still good reason to be ebullient. Money may be tight but this can often be a very good time to start or ramp-up a business. There are always opportunities... and often more so in a downward economy.
