am supposed to be going to Turkey tomorrow. I have packed my bag, filled the fridge with delightful ready-meals for my students and have made sure the house is spick and span and all the bathrooms have an adequate supply of loo roll. My students use a ridiculous amount of loo roll and I have to replace them so frequently that I wonder if they’re supplementing their diet by eating the stuff. I have even primed The Big Son as to when and how he should take out the rubbish and recycling, so that I don’t have to return to a Matterhorn-sized pile of empty ready-meal packets in the corner of the kitchen after a week away. Brighton itself has indeed been a Matterhorn-sized rubbish tip recently. I am rather inclined to support the bin-men in their plight as too many companies – Government funded or not – these days are moving the goal posts in order to diddle their employees and too many employees roll over and accept it. So go bin men! At least the seagulls are enjoying the smorgasbord of detritus available on the street... So, rubbish collections or not, I’m ready to go to Turkey, apart “I have even primed from the tiny fact that I am currently awaiting the results of The Big Son as to when a blood test to see whether or not I have malaria. I was taken ill at and how he should take work yesterday and have all the out the rubbish” symptoms of malaria, which could just as easily be all the symptoms of flu, or at least a very heavy cold. Being as I’ve spent five weeks of this year in West Africa being an unwilling meal-plan for a variety of mosquitoes, even though I’ve been taking anti-malarial drugs, I thought it best to make sure that I don’t have malaria, as it can be very serious if left untreated. Left untreated in the UK it would be bad enough, but left untreated in a remote part of South West Turkey would probably be much worse. So I’m sitting on my bed, watching daytime TV, which I haven’t watched since Philip Schofield had black hair, and waiting to call the surgery at 5pm to see if my test results have come back. I was informed that the results might not be back until tomorrow morning, which will make for a bit of a mad dash to Gatwick to catch my flight if they are negative. I am hoping to get away, as with all the rubbish on the streets and this sudden humid weather, you never know what you might catch...

Robert Nemeth visits Highdown Towers

A

talk at Hove Gardening Club about a fairytale house on a hill, surrounded by perhaps the finest chalk gardens in the country, inspired me to travel straight towards Worthing to explore. The distinctive house, Highdown Towers, was constructed in 1820 to the west of Goring, 100ft above sea level. It is reached via a long straight driveway to the north of the Littlehampton Road. It was the home of Sir Frederick and Lady Stern, who were responsible for transforming the disused chalk quarry above the house into a packed network of winding walks and light-filled clearings. The white chalk cliffs of the quarry are now barely visible behind luscious green trees and shrubs everywhere. Much was experimentation to see which plants worked best in this demanding chalky, and windswept, spot. Sir Frederick received his knighthood in 1956 for, unsurprisingly, services to horticulture. Upon his death in 1967, Lady Stern donated the house and gardens to Worthing Borough Council which took over the gardens the following year. From 1991-98, the house served as a nightclub called Sterns and, later, the Mansion House. The story goes that the council gave permission for the enterprise thinking that it was to be some sort of country club. They couldn’t have been more wrong – some of the raves finished at 6am. Highdown Towers features two storeys, though there are two notable exceptions. First, as the name of the house suggests, the building incorporates a tower. The pebbledashed extrusion, which stands out from the rest of the knapped flint structure, incorporates an extra storey. Second, the house is today known as the Highdown Hotel and offers 16 bedrooms with conference facilities. I wasn’t expecting though, whilst exploring a curious set of unwelcoming steps leading into the ground in front of the house, to find the hotel’s largest conference room hidden within a secret level below the house’s lawn. The steps were some sort of fire exit. Highdown Gardens are free to enter and include a number of breathtaking examples of rare trees (such as the constantly peeling Paper Bark Maple), colourful shrubs, climbing roses and – my favourite bit – rock pools with an adjoining cave. robert@buildingopinions.com, www.buildingopinions.com

Building evolution Deacon & Richardson celebrates 30 years & takes a look at the evolving role of the architect

D

eacon and Richardson is celebrating 30 years in architectural practice this month, in which time the practice has completed over 3,000 projects in the Sussex area. The team reflects on how the practice of architecture has changed. Has the role of the architect changed? The main services of an architect have remained unchanged. We have always offered our clients a vision of what is possible with their buildings and their budgets; every project is unique and is managed and supported by the wide variety of experience and skills that we offer within the practice team. The building process has however changed considerably since we first started. There is more legislation, building codes are stricter and construction is more complex. We are always updating our knowledge base and strive to stay up to date with the latest changes and innovations. We have also embraced changes through the years and have adapted our role to include numerous services beyond the traditional scope of an architect. We offer Interior Design services, Party Wall Surveying, CDM (Health and Safety) services and Sustainable Homes Assessments providing our clients with a simple “one stop shop”. Have there been changes to the way the architect works? When we started out 30 years ago we used drawing boards. Since then the computer has become increasingly prominent and we are able to co-ordinate and design buildings much more efficiently and accurately. The advance of 3D software has been of real benefit to our clients, they are now able to fully understand and experience our designs before building commences. Are buildings now different? Evolving building codes and regulations have certainly improved the performance of buildings for the better. Our clients’ awareness of architectural style has increased, introducing a renewed debate about traditional versus contemporary. We strive to design buildings that are functional, sustainable and attractive. Is it becoming harder to obtain Planning Permission? Since 1983, we have found that the process of obtaining Planning Approval has become much more challenging. Through careful and considered design we maintain a high success rate of achieving Planning Approval. What is the future role of the architect? Sustainability will play an increasingly large part of an architect’s brief and Deacon and Richardson find this both challenging and exciting. We embrace the advent of new technology but will never underestimate or forget the importance of our clients’ objectives.

t used to be that we were concerned with when we would die. A greater issue facing many people in retirement now is how long will I live, and will I have built up enough money to fund me through my retirement? You are about to embark on the longest holiday of your lifetime with the funds that you have accrued throughout your working life. At some point in the future you may also have to fund for long term care needs. There are four main areas of concern for the retiree when looking at investing for future income:1 How long you will live for? 2 Investment Performance 3 Low Interest Rates 4 Inflation Risk

Will your money last? Statistics show that one in every four 60 year old men, and one in every three 60 year old women will live for at least another 35 years. This is a long time for savings to provide an income.

Investment Performance Bearing in mind that your money needs to potentially last 35 years, you will need to look at some potential growth from the investment of your money. To obtain some growth you must also take some risk with how the money is invested. Stock markets can provide the potential for growth but unpredictable market conditions can seriously affect the values. When markets are increasing its good news as your capital should be growing, and if taking income, your investment is less likely to erode. In falling markets the opposite is the case.

Low Interest Rates In the past when interest rates have been higher, people have held more of their capital in cash deposits as the returns have been sufficient to meet their on-going income needs. In the current low interest rate environment which has seen the Bank Base Rate sit at 0.5% for the last four years, people have the choice of either depleting capital or take some additional risk in order to generate some capital growth.

Inflation Risk This can have a large impact on your retirement plans. It can creep up on you without realising the impact that it has on the buying power of your money. With an average inflation rate of 3% over a 30 year period, a £100,000 sum will depreciate to the equivalent of £44,198. There are a number of options available to investors in retirement which can potentially address income shortfalls, but inevitably the prospect of higher returns and higher levels of income do go hand in hand with an increase in the amount of risk taken. he recent story of Charles Saatchi’s violence towards his wife Nigella Lawson made headlines around the world. Nigella is one of a number of women who have suffered physical violence at the hands of her partner. Research shows that one in three across the world has suffered physical or sexual violence. Almost half of all women affected by domestic abuse suffer from depression, and a woman who has been abused is 15 more times likely to misuse alcohol and nine times more likely to misuse drugs. They are also much more likely to suffer from sexually transmitted diseases

as well as unwanted pregnancy and abortion. These insights are shocking. Violence against a woman has a significant impact not only on the woman but on society generally. It is interesting to note that one in six men are also the victims of domestic abuse and such victims are also more likely to misuse alcohol and drugs than people who have not been abused.

Business aid Samantha Dickinson of local solicitors Dean Wilson LLP answers questions on employment law. This week: Protected Conversations Q. What is a Protected Conversation? A. The concept of Protected Conversations arose out of the Government’s perception that employers were afraid to manage employees as they feared that anything said could be used against them in subsequent Tribunal proceedings. It was thought that the law needed to be changed so that a manager and an employee could sit down together and have a frank conversation behind closed doors without either party being able to use that conversation in litigation. Q. Can I now have one of these conversations with my staff? A. Not yet, no. The Government have been rather vague as to when the law on Protected Conversations will come into force, saying only that it will be Summer 2013. There is no

commencement date yet. If the circumstances are right, you can have a “without prejudice” conversation with an employee now but the rules of “without prejudice” conversations and Protected Conversations are different. Q. Is a Protected Conversation inadmissible in all Tribunal claims? A. The way the legislation is currently drafted provides that such conversations are only inadmissible in ordinary, unfair dismissal claims, unless there has been “inappropriate behaviour”. This means that where an employee alleges they have been unfairly dismissed, for example because of their pregnancy, the rules as to Protected Conversations will not apply. In these circumstances a Tribunal can hear evidence on any discussions between the parties and will take those discussions into

account when deciding whether or not a dismissal is fair. Q. Will this actually help employers or employees? A. It’s difficult to say. I expect there will be many cases before the Tribunals dealing with whether a particular conversation was in fact a protected one before a Tribunal can even hear the substantive issue. Protected Conversations may also encourage employees to bring discrimination claims so as to get the detail of the Protected Conversation into the evidence before the Tribunal. There is also an exception in the rules in that anything which is said or done that the Tribunal believes is “improper or was connected with improper behaviour” is not protected. How this will be interpreted remains to be seen and is likely to lead to increased litigation in the Tribunals
