Hamptons International launches annual ‘Draw a Christmas Cracker’ competition for local children amptons International’s Hove branch is launching its annual Christmas drawing competition, aimed at local nursery and primary school children. The ‘Draw a Christmas Cracker’ competition is open to all primary school children at Windlesham School in Brighton. Younger children from the local school are encouraged to participate in this festive competition by colouring in the Christmas Cracker, while the older children can use their creative skills to draw and decorate a cracker of their own design. All competition entries will be displayed in the local Hamptons International branch window for visitors to admire, from early December through to the New Year. The winners, who will be announced before the end of the school term, will be awarded a deluxe art kit. Two hundred pounds in prize money will be donated to the school. Paul Taggart, Manager at Hove Hamptons International, comments: “The Hamptons ‘Christmas Drawing Competition’ is popular, and we are delighted to be holding it again this year. Working with the local community is important to us. High rental demand has led to an increase in investor landlords buying properties to rent out, and thanks to improved lending options, sales have also increased to first-time buyers and families looking to climb the ladder. So, with Christmas just around the corner, how is the property market likely to be affected? Any holiday season will have an impact on the number of buyers actively looking for property as their focus is naturally drawn elsewhere. As a result, sellers often choose to wait until the new year to put their property on the sales market. However, acting earlier has some distinct benefits. For a start, you will have less competition, so those savvy buyers who want to secure their next home before the January rush will be

Many sellers will inevitably wait until the spring before putting their property on the market – which could flood the market and potentially thwart prices. However, last year’s backlog of frustrated buyers are already looking today. John Brookes of local solicitors Dean Wilson LLP answers questions on Employee Transfers on the sale of a business I’m getting my company ready to be sold. I want to know what protection my employees will have with the new owners. If you are going to sell the assets (rather than the shares) of your company, the TUPE Regulations will probably apply and their employment will transfer automatically to the new owners. TUPE (which is the Transfer of Undertakings (Protection of Employment) Regulations) preserves employees’ contracts of employment following their transfer to a new employer on the same terms and conditions of employment. They will not have a break in service and their service with you must be taken into account for all purposes by the new employer.

Is there anything I need to do before the TUPE transfer date? You will have specific consultation obligations which are set out in the TUPE Regulations. The consultation must be carried out with the employees’ representatives or the employees themselves, depending upon the size of your workforce. You also have to provide information about the transferring employees and their terms and conditions of employment to the new employer. These obligations are important to understand as if you don’t meet them, you may face claims which can result in fines being imposed by Tribunals. I expect my employees will have questions about their contracts

and about their current union. What can I tell them and when? Employees can be told that their contracts of employment can be changed in only very limited circumstances, and changes made only to ‘harmonise’ the contracts with the new employer’s existing employees are unlikely to be valid. In most cases any union which you currently recognise must be recognised by the new employer. Do the employees have to agree to transfer and what if they don’t want to work for the new employer? A TUPE transfer happens by operation of law, and not by consent or agreement. If employees don’t want to transfer, they must ‘opt out’ of the transfer (which should be done in writing). But your employees must understand that if they do opt out, their employment won’t continue with you and they will be considered to have resigned with effect on the transfer date. Neither you or the new employer will owe them payment of notice or redundancy.

Taking a trip down Electric Avenue …

A 

fter spending three days with no electricity in my little Turkish house, I decided to bite the bullet and go to the electricity people – Aydem – to find out what was going on. I suspected that I had been cut off because I had not paid the bill. My reasons for not going to Aydem sooner were many, and varied; the main one being that although I speak five languages, Turkish is not one of them. So far, my attempts at mastering the language have been centred around the important task of ordering various sizes of alcoholic beverages: ‘one glass of white wine please’, was unlikely to get me very far in the Turkish equivalent of Seeboard. Furthermore, the town where I live in Turkey is not, unlike Marmaris and Bodrum, full of Turkish locals comfortably chatting cockney rhyming slang and effortlessly quoting Delboy from Only Fools and Horses. But the thing that most deterred me from going to sort out my electricity problem was the fact that I had been in the office not six weeks earlier, attempting to pay a water bill mistakenly thinking that it was an electricity bill. So they already thought I was mad. I sheepishly approached the counter and tried to say something in Turkish – that might have actually been German – to the young girl, while I waved my bill. She typed my meter number into the computer and told me – in perfect English – that there was no debt on the bill and it should be working. I filled in a laborious form which required my even more laborious address, and a phone number. I put the phone number of my Turkish friend K, who rents out my house for me in the summer, then hared down the hill to his office to inform him that Aydem would be calling. I’d barely sat down in front of his desk, when Aydem called him to say that they couldn’t find my house. This is normal. It even took me a while to find my house, the street address being useless as most of it is a pile of rubble (in a romantic bougainvillea-strewn way). When I returned home later that evening, Aydem had taped a note to my meter, claiming something indecipherable in Turkish. I photographed the note and sent it to my friend K, who appeared the following morning with an electrician who, in the manner of most Turkish workmen, looked like a friendly walnut in jeans. He soon ascertained that my electricity cable, suspended through an olive grove, had been attacked by an olive tree and had snapped in half. A new telegraph pole would be needed to carry a new cable to the main pylon. I was surprised to learn that the bill would be picked up, not by Aydem, but by yours truly. Among the purchases for my house, I did not imagine that I would have to buy a telegraph pole. But there’s a first time for everything ...

Robert Nemeth on Whoopsadaisy Pavilion

A

recent trip to the Whoopsadaisy Pavilion got me thinking about how Preston Park and, indeed, local parks generally have changed since Victorian times. The land that became 63-acre Preston Park was purchased by Brighton Corporation from the Bennett-Stanford family in 1883 for £50,000. It was formally opened in 1884 after much landscaping. A cycling track and clock tower followed in 1887 and 1892 respectively. Historian Virginia Hinze explained to me that plans were unveiled in 1928 by the council’s Superintendent of the Parks & Gardens, Captain Bertie ‘Mac’ MacLaren, that included a six-acre lake. The lake was never built but, nevertheless, the park of today was essentially created. MacLaren used various items to decorate the park, including statues and urns from the Aquarium in Brighton that was being converted from Gothic to Classical at that time. Railings and a large entrance lodge were removed and pavilions were added. The Rotunda was added in 1929. I remember seeing the Ladies’ Bowls Pavilion being advertised by the Friends of Preston Park back in 2012 with no specific use in mind. It ended up being rented on a ten-year lease in 2013 by the charity Whoopsadaisy, which looks after children with cerebral palsy and other motor disorders. Prior to that, it had been empty for around five years. I met Caroline Matanle at the Whoopsadaisy Pavilion (great name!) who told me that around 25 children are based there. Although the building is not large, the space is ideal. The interior is bright and exciting, and was, I understand, painted by volunteers from HSBC and Lloyds. The exterior has been left as original and consists of a prominent pitched roof with generous eaves that create a colonnade. The green opposite is no longer used for bowling but now serves as a wonderful meadow. All sorts of buildings have changed use in our parks. The earliest change that I recall is the lodge at the Level being rented by auctioneers Clive Emson around ten years ago. One of the pavilions in Wish Park in Hove is now a nursery. A bowls pavilion on the Western Lawns is now home to Riptide Fit Camp (previously Riptide Gym under the Kings Road arches). Although I’ve listed several examples of bowls facilities closing, the underground hall at the King Alfred is a somewhat different story. Y

ou’ve got a mortgage and bought a property. You probably think that rent will be a thing of the past and that you will be free to allocate your money to repairs and maintenance, as and when you are able. However if you’ve bought leasehold property, you will not be the owner of the building in which the property is located. The freeholder will own the building. The leaseholders are usually required to pay all costs of insuring, repairing, maintaining, cleaning and managing the building through payment of a regular service charge. The service charge is a variable sum as costs will alter from year to year. Most

leases also require payment of ground rent, which is usually a fixed nominal amount specified in the lease. The lease will set out the dates for payment of service charge and ground rent. The freeholder is obliged to send demands for payment of service charge and ground rent in advance of the date by which the payments are due. If you fail to pay by the due date, the freeholder may be entitled to interest on the outstanding balance and may take court action to recover the arrears. There is no right to withhold payment because the building is in need of repair, however. If the freeholder is neglecting the building there is a separate legal process that you can follow to compel the freeholder to take action, or alternatively to force the freeholder to sell the freehold to a collection of leaseholders. Service charge does not cover the cost of major works such as replacing the roof or painting the

exterior of the building. For major works costing more than £250 per leaseholder, the freeholder must formally consult the leaseholders. Provided the consultation process has been correctly completed, you must usually pay in advance of the works starting. If you or a fellow leaseholder can not pay, the building may fall into ruin. The freeholder can take action to recover the cost of major works and may be entitled to interest and legal costs from you. If you have concerns about the cost or nature of the major works or that the consultation process was not followed, you can take separate action. There's something a bit Dickensian about it all; it's almost like walking through the shop door and being taken back in time, to a time where homes were 133% cheaper to purchase than they are now! We were filming there last Thursday, and while the cameras were being set up I came across a document for an ‘exceptional home’. On our Exceptional Homes feature, we look at houses that are priced at over £1million. The brochure of the home I had my eye on had an asking price of just under £1,000. If only we HAD travelled back in time!

BURIED TREASURE Andrew Bullock and Simone Thorogood are rummaging through the archives for Latest Homes Live

A

ndrew: Recurring viewers of Latest Homes Live will have noticed by now that there is a third string to the LHL bow. Andy Garth is a bit of a sidekick to Simone and I. He's almost like a third presenter, only he doesn't have to worry about reading the autocue or making sure we cut to an ad break in time. Best of both worlds! So where did we find Andy? Was he retrieved from under a stone on Brighton beach, fully formed, ready to share with us a wealth of historic knowledge and property prowess? Well, I would be wrong to give the impression that I went out when I started production on Latest Homes Live and discovered this fountain of Brighton and Hove knowledge myself. Thankfully, he was served up to me on a glistening silver plateaux, ripe for the plucking. Andy already had an excellent relationship with The Latest and Latest Homes when I sauntered onto the scene with my limited Sussex knowledge, earlier this year. With his background in estate agency, his extensive knowledge of the region, his skills as a historian and his passion for research, Andy has been

invaluable to the company. He has, by default, become Simone and I's go-to-guy. It therefore made sense that he would be a regular on the show. We actually don't know what we'd do without him. Andy obviously spends some time with us in the studio every week, shooting the property breeze and enlightening us all with lesser known facts about the area. We've also had a great time filming out and about with him, given that he knows the best places to visit, all of which are steeped in history. One of the first things I filmed for Latest Homes Live was with Andy, who took me down to the beach, up on the hills and over to the Brighton/Hove border to straddle it.

People come in and spend an hour going through the plans and old newspapers Andy's professional background is in estate agency. This means that he is the man to ask about analysing the area when it comes to letting and buying. So, we do ask. We ask a lot. On TV. Every week! Aside from this, his passion lies in the region as a place; the history, the stories, the facts, the figures. Andy took this passion a couple of years ago and set up his shop, ‘Brighton and Hove Stuff’, at 7 Western Terrace in Hove (although it used to be on Blatchington Road before he relocated). Step inside and you are met with an extensive catalogue of ephemera that you never knew existed about our fayre city. Now, I'm not Brighton born and bred, but I find myself thumbing through maps, documents, newspapers and photographs whenever I'm visiting ‘Brighton and Hove Stuff’, discovering things about places I didn't even know existed. There's something oddly mesmerising about being in a treasure trove of

Simone: I'm similar to Andy Garth in that I am obsessed with history. I find it truly fascinating. I enjoy reading true stories and visiting historic places, and I watch shows like The Tudors. Who doesn't enjoy a bit of sensationalised history? Naturally, I was very excited when Andy agreed to come on board the Latest Homes Live team. We love having him in the studio, and last week our floor manager, Sarah, who oversees our weekly episode recordings, found herself so fascinated by what Andy does that we invited her to film with us in Andy's shop. So she and I popped along to rummage through Andy's files and get some first hand history from the man himself on where Sarah lives in the city.

You'll have to tune in to find out what we learnt, but needless to say Andy educated Sarah in the history of her area, her road, and even her house. Andy was quoted in the Argus last year, saying; “It’s amazing how interested people are in this stuff. I thought it was just me. People come in for a look around and end up spending an hour going through the plans and old newspapers.” I can vouch for this. On days I have filmed at the shop, customers have come in and stayed there for absolutely ages, going through photos and plans, possibly of their own homes or the streets they live in. The shop has everything in it from ordnance surveys from the turn of the century, to auction catalogues, to 1960s holiday brochures and old concert posters of gigs that were played around the city. It's incredible to pour over some of this original paperwork, analysing what the streets looked like, seeing how so much of the city used to be rural, learning of the changes that have been made to the train station and the parks, and reading further afield, including the plans for the Royal Sussex County Hospital, which used to house an asylum! Here, you get to actually touch these amazing tomes. Yes, the internet is great for research, but at ‘Brighton and Hove Stuff’ you can physically hold a plan that (for all you know) was drawn up by Amon Henry Wilds himself!
