PROPERTY NEWS Tenants suffering ‘major problems’ highlights the importance of renting through a professional agent, say Leaders
M
ajor problems such as damp, mould, electrical hazards, gas leaks and animal infestation have been experienced by 61% of tenants renting in the private sector, according to a new report released by Shelter and British Gas. The report largely points the finger at illinformed, amateur and accidental landlords who are far more numerous than rogue landlords. According to the report, more than a quarter of landlords have no previous experience of letting out a property, and almost half (43%) do not regard renting as a proper business. Carole Charge, Leaders’ Technical & Compliance Director says: “This research emphasises how vital it is for tenants to be selective. Most tenants choose their agent or landlord by default, based on the property that best fits their requirements, and are not aware that landlords and agents do not all abide by the same standards. “This is because there is still no formal regulation in place to prevent landlords and agents who have no experience, qualifications, client money protection or knowledge of the law from practicing. Ironically, there are 100+ rules and regulations that a property has to pass to be let legally, yet there is no legal requirement for the people actually carrying out the letting to prove

that they understand and will comply with them.” The only way for tenants to protect themselves is to rent through an agent that is a member of a professional, self-regulating organisation such as ARLA, RICS or NAEA, which requires members to abide by a strict code of conduct. This includes making sure that rented property is safe and in good condition and that all relevant legislation is fully complied with. In addition, it means the agent will hold tenants’ deposits and all client money safely in a protected account, be trained and qualified in lettings law and abide by rules and regulations. “The lack of regulation of the market allows unscrupulous agents and landlords, as well as naïve ones, to provide substandard properties and charge extortionate fees and rents in areas of short supply,” says Ms Charge. “The public is very vulnerable to bad practise.” Unregulated agents are able to offer lower commission rates because they do not have to train staff or invest in the resources needed to maintain high standards. As a result they attract landlords and tenants with low fees because most people are not aware of the risks they face. To help tenants protect themselves, Leaders’ advice is to make sure that a chosen agent will do all the following, as part of their standard service: – Ensure that the property has passed an electrical safety and gas safety inspection and give the tenant a copy of the Gas Safety Record.

ver the past 13 years, I reckon I must have been to Hastings on business – if you can call hoovering the communal hallway business – more than 200 times on the train. Only twice out of those 200 times have I had to take a ladder with me. The first time, I was painting mine and Katy’s flat and needed the ladder in order to reach the very high ceilings. I seem to remember that the journey back to Brighton with my ladder and painting materials was fairly traumatic, due to my train being replaced by a bus. Infuriatingly, the bus driver initially refused to let me on with the ladder, which I had slung over my shoulder in the style of a very unglamourous handbag. It was not bothering anyone, apart from me, but he kicked up a fuss nonetheless. This morning, having returned from a lovely trip to Marrakech last night, I realised that I had not cleaned the communal hallway in Hastings for over a month. Furthermore, I was about to be busy for the next fortnight and today was the only day I would have enough time to do it. On this outing, I knew I also had to replace some of the lightbulbs and replace a couple of the lampshades that someone had pinched, although it beggars belief that someone who could afford a ladder would feel it worthwhile to ascend it in order to pinch someone else’s property. I therefore had to take my ladder. I rushed, handbag ladder slung over shoulder to catch the 11.32am train ... which shuddered to halt just after Eastbourne in a very alarming manner. I could feel a replacement bus coming on. After an hour and a half on the track and a further hour at the next station, the replacement bus arrived. Both the vessel and the driver were so old that I feared they may have driven me on an ice skating trip with the Brownies in 1972. The replacement bus was in need of a replacement bus. Although the ancient driver let me on with no objection, it’s the last time I’m taking that evil, portentous ladder anywhere ...

ove it or hate it, the i360 project promises to be one of the biggest engineering spectacles that we have seen in Brighton and Hove for years, and the build promises to be fascinating throughout.
I will be covering the project as it progresses, and am particularly looking forward to seeing how Brighton’s main sewer (perhaps the greatest of all local engineering feats) is diverted in January. This week’s news is the release of photographs of the principal components of the tower – 33 giant flanges and 17 steel cans. Euskal Forging, based between Bilbao and Pamplona in north-east Spain, has forged the 33 giant flanges that will be used as connecting pieces for each of the 17 steel cans that will become the tower itself. The flanges are machined to make a flat surface and then bolted inside each end of the steel cans. Accordingly, there are two flanges per can (except on the uppermost can where there is one). Each flange is forged from a single ingot of steel. The flanges were approved in early December by steel specialists Hollandia and are now to be transported to Sif Group in Roermond in the south-eastern Netherlands, where the steel cans will be bolted to them. The steel cans will be finished inside and out at Hollandia’s factory in Rotterdam, where they will also be sprayed with molten zinc and painted before being delivered to the UK by boat in 2015. As it goes, I have supported the i360 project since discussions began in 2006. If the figures are correct, it will bring tourism and regeneration to a whole part of town that has been forgotten for years – and joy to hundreds of thousands of visitors who will get to see Brighton, Hove and its surroundings in a most exhilarating manner. www.buildingopinions.com robert@buildingopinions.com

ver 5,000 estate agents entered the annual Estate Agency of the Year Awards, and over 600 leading agents from across the country attended the ceremony at the Lancaster London Hotel opposite Hyde Park, in association with the Sunday Times and The Times, on Friday 5 December. The winners of the most highly regarded awards in the estate agency industry were presented by Michelle Mone OBE of Ultimo Brands International, as well as TV newsreader Penny Smith, Alex Lowe of Google, James Micklethwaite of Rightmove and other guest speakers. The awards ceremony was the culminating event of an extremely thorough judging process by a panel of 20 industry experts, who assessed initial entry submissions before conducting an extensive review of the entrants, which included over 150 hours of telephone interviews and mystery shopping exercises. The whole of the judging process was overseen by The Property Ombudsman. Brand Vaughan’s category, ‘Small’ (2–7 offices), is the highest entered in the annual awards. With the most estate agents in the UK having this average number of offices, competition is extremely fierce. Director of Brand Vaughan, David Vaughan, commented: “We are extremely proud to be named as best Small Estate Agent in the UK and also retain our title for the best estate agents in the South East. Last year we moved into this category after opening our second office, and in all honesty we were not sure if we would come out on top as it had such strong entrants. What makes for a great student house? Experts at Brighton Accommodation Agency share the tricks of the trade
“
By hook or by crook, Brighton Accommodation Agency have become one of Brighton’s leading student letting agencies, running a portfolio of nearly 200 houses, and so I think we can speak with some authority on what makes a great student house. If you are looking for an investment property, then look no further. With rents ranging from £95 to £110 per week per room, and tenancies running for the whole twelve months of the year, you can get a fantastic return, but you must be aware that they are high maintenance properties – like anything in life, you will have to work hard to get the big bucks, and these properties are no different. First things first: location is always key. Even though we have always managed to let every single student house, the first ones to go are always those in the key positions. For us, this is anything in and around the Lewes Road area, or close to our office. This is the first area to go. Secondary areas are Elm Grove and Hollingbury, and the third area is Coldean and Moulscoombe. You will get the highest rents in the first area, and then, intuitively, it will drop slightly for the others. Next you must make sure that it is furnished correctly. We always recommend that good quality furniture is installed – this would include a 4ft bed, wardrobe, desk and chair in each room. Anything over and above that should be down to the student. Plumbing
should be provided for a washing machine, however we recommend that you do not provide one. They break down regularly, and between the students they can club together and buy one to be delivered; they will have a warranty and they can always sell this on at the end of their tenancy to recoup some of the money. We suggest a simple white colour scheme throughout, making it easier for either the students or your contractors to repair between tenancies. For our landlords we insist that they have a week’s void period every year – these properties have a lot of traffic, especially the 6/7 bedroom properties, and you will have maintenance to do both during the tenancy and in the void period. Of course, you will need your HMO (House in Multiple Occupation) Licence. Over the past three years we’ve overseen hundreds of licence applications, and they can be a bit complicated, but if you have any concerns do give us a call, and we’ll happily come over and give our opinion on what will bring your application up to speed. From a lettings point of view, the bigger the bedrooms, the easier it is to let. But most houses have bedrooms of various sizes, and the students are left to tier the rents themselves. Remember, you are letting the house as a whole unit, not individual rooms,

and thus it does not matter to you who pays what for each room – we collect the rent for the house in one payment. The tenants all sign one, jointly and severally liable assured short hold tenancy agreement, and they each have a guarantor as well. They are liable for the utilities, and for the upkeep of the property, but also you must remember that for a lot of the students this is the first time they been away from home, and so they can be higher maintenance than normal tenants. Student tenants are generally great, but they do need to be nurtured through the first few months – this is why it’s important to have an agency to help deal with unforeseen situations that can arise very regularly.
