HAMPTONS INTERNATIONAL ANNOUNCE WINNER WITH THE NEW DREAMWORKS ANIMATION FILM, HOME

amptons International is delighted to announce the winner of its drawing competition centered on the award-winning estate agency partnership with DreamWorks’ Animations HOME. HOME, which was released March 20th and quickly took the number one slot at the UK Box Office, follows the story of Oh, a

being human, and together they discover the true meaning of the word HOME. As part of the campaign, local primary schools and children’s after-school activity clubs were encouraged to create their own motion picture by entering the “Draw Your Perfect Home” competition. The competition entries were featured in the window of the branch for the local community to view and admire. Visitors to the branch were invited to cast a vote to choose their favourite drawing. The winner, Maria Veness, was awarded a HOME animation goodie bag, with merchandise and tickets for her family to see the film at a local cinema. Maria was then entered into a further prize draw to win the chance of having her bedroom decorated in the style of HOME, complete with the

expert help of an interior designer, decorator and £1,000 to spend on soft furnishings and materials. The ultimate winner was Jemma Eike, age 6, from Preshute School in Marlborough. A separate competition continues to run up until the 13 April whereby anyone who instructs Hamptons International to sell or let their home will be placed into a prize draw to win the ultimate electrical bundle to kit out their new home. Residential for sale and to let boards have been brought under planning control within most of the central conservation areas of Brighton & Hove, replacing previous controls which were restricted to a small number of the city’s historic squares. This was confirmed by the Secretary of State, who agreed with the council and local residents that these areas contain good historic architecture, including some of the highest quality, and that such boards do cause significant problems. Brighton & Hove City Council brought in controls (Regulation 7 Direction) which apply to all residential properties in the following conservation areas: Cliftonville, Denmark Villas, Willett Estate, The Drive, The Avenues, Brunswick Town, Montpelier and Clifton Hill, West Hill, North Laine, East Cliff, College and Kemp Town. In the Regency Square Conservation Area, only Regency Square, Bedford Square and Norfolk Square are included, and in the Valley Gardens Conservation Area, the direction only applies to the area from St Peter’s Place northwards. The direction came into force on 20 September 2010 and is made under the Town and Country Planning (Control of Advertisements) (England) Regulations 2007.

The effect of the direction is that no residential sale or letting boards may be displayed on the street frontages of the above properties without express consent. And quite right to I hear you say and it seems that the agents in the City are adhering to this. But when it comes to the areas outside the conservation areas the proliferation of agent’s boards in some parts of the City is certainly making areas look untidy. Marc Cox, sales director at Mishon Mackay says: “You don’t need to spoil the look of a street in order to find a buyer. Too many boards have a negative effect on a neighbourhood and can make it look shabby and rundown” Cox has called for a complete ban on boards and explains why: “It is a contentious issue with some agents who want them and a large

the regulations are adhered to and in brief these are the board regulations which all agents should adhere to: For residential for sale & to let boards, the board must not exceed 0.5 of a square metre, or a total area of 0.6 of a square metre for two joined boards You may only display ONE for sale/to let board on each premises, a ‘back to back’ for two agents advertising the same property is allowed. If there is more than one property for sale or to let at a premises i.e. on a block of flats, it is illegal to have more than one board up. No advertisement board is allowed to extend outwards from the wall of a building by more than 1 metre and must be removed not later than 14 days after completion of the sale or granting of the tenancy. Sawyer goes on to say “New restricted zones within parts of the city centre may have to be considered. There are many attractive period buildings not within conservation areas. Boards divide opinion. At the most recent B&HEAA Council meeting we discussed balloting our members for their views on this. One thing is for sure. Why did cricket umpires Peter Willey and George Sharp lose their age discrimination claims? In March, cricket umpire Peter Willey (a former England test cricketer and chairman of umpires) and his colleague George Sharp lost their age discrimination claim against the England and Wales Cricket Board (ECB). The basis of their claim was that they were forced to retire at 65. Unlike other forms of direct discrimination (treating someone less favourably because of their race, sex, disability etc), direct age discrimination is capable of being objectively justified. In this case, the ECB successfully argued that sacking umpires at age 65 was objectively justified to ensure

opportunities for succession planning and appointment of new umpires. The ECB also argued that it was common sense that umpires should retire at 65 because after that age they would find it difficult to react quickly enough and to stand up for long periods of time, although it agreed that there is no scientific evidence that umpires' performance deteriorates once they reach a particular age. In 2020 the state retirement age for both men and women will increase to 66 and between 2026 and 2028 it will increase to 67. The arguments for succession planning and encouraging new talent are not new ones. Clearly an organisation wants to have a steady turn over of new talent and does not want there to be a log-jam of staff in their sixties, the consensus is that the younger staff will simply leave if they cannot see

the potential for progress. To justify direct age discrimination, the employer must show that the policy is in pursuit of legitimate social policy aims, and not merely its own private interests. Social policy aims include those related to employment policy, the labour market or vocational training. Such aims are distinguishable by their public interest nature from purely individual reasons particular to the employer's situation, such as cost reduction or improving competitiveness. There is a balance to be struck between a career path with the potential for suitable opportunities arising with some certainty and managing this expectation with the retirement of staff who have reached a certain age. It may well be that in sectors where there are very few employers or limited professional opening, such as for a cricket umpire, it is easier to rely upon objective justification, as long as the employer can demonstrate social policy aims.

he interior of St Mary’s Church, at the foot of Upper Rock Gardens in Kemp Town, brings together Byzantine, Classical, Gothic and what I interpreted as medieval details. A visit from me to the ‘Cathedral of Kemp Town’ was well overdue. The church’s roof consists of 27 different slopes, I was told by Churchwarden Katherine Prior. The red-brick Grade II* listed building appears large from the outside but even more so within, perhaps because it is set into a steep hill. St Mary’s is the second church on the site. The first, dating from 1827, was a Neo-classical take on the Temple of Nemesis. It fell down in 1876. St Mary’s opened in 1878 to the designs of architect William Emerson. A clock tower was planned but never completed (a similar story to that of All Saints and St Patrick’s in Hove). The baptistry takes influence from ancient Byzantium. High above, the capitals on the top of huge columns are Classical; the vaulting throughout is Gothic. The chandeliers have a medieval feel. The best view is from the organ loft above which looks down onto the altar. The appearance of the church changes throughout the day as the sun graces different stained-glass windows. Two caught my attention. The first, dating from 1906 and showing St John and St Mary before the Crucifixion, is by Charles Eamer Kempe, a famous glass maker and the youngest son of a cousin of Thomas Kemp, the developer of Kemp Town. The second, ‘The Tempest’, used fragments of an earlier window that was destroyed during the Great Storm of 1987. St Mary’s was recently granted Heritage Lottery Funding for investigative work in advance of a large restoration project. Here’s some old news It’s nothing new so there’s no excuse: Tenancy Deposit Schemes have been a legal requirement since the Housing Act of 2004, and only the most unobservant landlords can claim ignorance. Yet it’s still easy to forget: you have 30 days to protect your tenant’s deposit in an approved scheme and notify them that this has been done, yet it can still be so easy to miss deadlines. Here’s an elephant trap One potential elephant trap is that the clock starts ticking from the date you receive the deposit, not the date the tenancy commences. Make sure you plug this date into your online calendar and set a few email reminders to be triggered. Here’s a problem So you haven’t protected your tenant’s deposit in a timely manner? Let’s look at what this could mean.

10 point checklist for new landlords on the rules & regulations of letting

Many people are turning to the property market for a second income by becoming ‘part time’ landlords. However, a significant number do not know or comply with the myriad legal obligations involved in lettings. 1. Your hands are now tied. You cannot now legally repossess your property where there is ‘no fault’ at the end of the tenancy using a Section 21 notice (Notice of Possession). This means there will be a lot more hoops to jump through and hurdles to overcome. 2. You could lose the deposit. Your tenant may make an application to the Court to seek a return of the deposit. If you are at fault this is most likely to be granted, leaving you with no security against damage or unpaid rents. 3. You could be left out of pocket. The Court can actually instruct you to pay the tenant treble the deposit amount as a sanction against your failure to comply. Here are some workarounds First, you can return the deposit to your tenant. Be honest: tell them you have made a mistake and return their deposit in full. Of course, you are left without a security deposit but you can now serve a valid section 21 notice should you need to. Second, you could simply take what’s coming. If your tenant has made a claim you can just see it through, take the hit and, once the Court has made its decision, you can once again serve that notice legally. Finally, you can ask your tenant to surrender the tenancy, return their deposit

Gas, fire, furnishing and electrical safety requirements It is the landlord’s responsibility to ensure all gas appliances, electrical equipment, furniture and soft furnishings are maintained in a safe condition and that they all comply with the appropriate regulations; the tenant must also be provided with the correct current documentation. 2. Energy Performance Certificates (EPC) All properties being marketed as available to let are required to have an Energy Performance Assessment carried out and a certificate produced. 3. Tenant vetting Every tenant should go through a thorough vetting process; this should include a detailed assessment of the tenant’s ability to afford the rent, credit and ID checks, proof of residency and references from employers and former landlords. Stringent checks should also be carried out on guarantors if required. 4. Inventory and schedule of condition A professional inventory and schedule of condition at the start of the tenancy is essential to ensure that you have an accurate record should you need to make a claim against the deposit for damage. 5. Tenancy agreement Tenancy agreements protect your interests as a landlord and must comply with residential letting legislation. They must be easy to understand, written in plain English and contain no unfair terms or conditions. 6. Correct buildings and contents insurance Most ordinary home insurance products do

and start a new agreement with them all over again. You never know, some folks are very obliging! Here’s to letting without fretting The simplest way to avoid any of this is to not let it happen in the first place. Tie a knot in your hanky, set up an email reminder or, better still, avoid all the hassles of tenants and lettings, but still make money from your properties, by chatting to me about our Rent Guarantee Scheme. Taxation on lettings income Any profit made from letting a property is subject to UK income tax, whether the landlord lives in the UK or not, and must be reported in a Self-Assessment Tax Return.
