BRIGHTON PROSPERS IN NEW GROUNDSURE RESEARCH

utside of London, the cities of Brighton and Hove, Bournemouth and Cambridge have the most property development activity by area, based on new research announced today by Groundsure (illustrated in new Groundsure online interactive map). The research (1), based on sales of mapping used in the planning process (2), broadly reflects official statistics of planning applications from the Office for National Statistics (ONS), but comes ahead of the official figures for quarter one, which are due in June. Ranking UK local authorities by density of development, Groundsure found the City of Brighton and Hove to currently be the most active local authority in terms of development outside of the capital. In 2014 however, Brighton and Hove had 26.5 planning applications per square kilometre and came third in terms of density of UK property developments. The City came behind both Cambridge (top ranking, with 30.6) and Oxford (second most developments, with 27.6 applications per square kilometre). In London, north of the river leads the way, with most

developments taking place in Kensington and Chelsea (first in ranking), the City of London (second), City of Westminster (third), Islington (fourth) and Camden (fifth in the national ranking for most developments per square kilometre). Today’s development research follows last week’s Political Party Manifesto announcements, which put house building as a priority issue in the pre-election battleground. The Conservatives announced their right to buy extension for housing association tenants, whilst the Labour party promised to build at least 200,000 new homes per year by 2020 with a priority for first time buyers. In addition to current planning activity, Groundsure also investigated areas of potential future development by analysing mapping viewed on their systems, but not yet purchased (maps which are required for planning applications). The top three most viewed mapping areas (outside of London in order of volume) are Brighton (top), Worcester (second) and Worthing (third), followed by Cambridge, North Tyneside and Bournemouth, which are likely to be the next development hotspots.

Dan Montagnani, managing director of Groundsure said: “London was clearly going to have most developments underway, but we were surprised to find that, outside of London, Bournemouth is the second most active area for developments in the UK. Alongside Brighton this shows a clear demand for property on the south coast.” Montagnani added: “With the current government target of increasing the supply of housing to 240,000 additional homes per year by 2016, it’s good to see that this already active sector is likely to experience further growth after the next election. What makes a good landlord? Someone who cares about the condition of the property they’re letting and are prepared to accommodate the tenant’s needs. Victoria Wright of local solicitors Dean Wilson LLP discusses employment tribunal settlements I took my employer to an employment tribunal and won but I’ve not been paid the sum awarded – now what? Payment is due within 14 days of the judgment, unless something else is specified. If you have not been paid, you can take steps to enforce an award of compensation, costs or fees made by the employment tribunal, but the employment tribunal is not responsible for enforcement of awards. You need to think about the sum owed and the position of the debtor as this may dictate which method of enforcement you use and help you to determine if it will be a worthwhile step to take. You can enforce the debt through the county court. First of all, you will need to file a copy of the tribunal's decision at the

appropriate county court using HMCTS form N322B. Information about the methods which the county court can use are set out in form EX328 and guidance on the circumstances of the debtor is in form EX321. The common enforcement options in the county court are: warrants of execution (an authorised agent is able to take and sell the debtor’s goods); attachment of earnings orders (compelling the current employer to deduct from wages sums owed); third party debt orders (sums owed to the debtor are re-directed); and charging orders (an order over the debtor’s assets). The process can be protracted and complicated and so in April 2010, the Acas and employment tribunal fast track system was introduced to simplify and speed up the process of enforcement. It is operated by Registry Trust Ltd. You

need to complete form EX727 and pay a fee £60 fee. A High Court Enforcement Officer is allocated to the case who obtains a writ and then attempts to recover the monies owed. If the enforcement is successful, the debt owed, interest due on it and the court fee is recovered for you. Although the BIS research above may indicate this fast track system does not improve levels of enforcement, rather it gives another option allowing an alternative process of enforcement. Any party who fails to pay an employment tribunal or Employment Appeal Tribunal award in England and Wales is added to the Register of Judgments, Orders and Fines once enforcement proceedings are brought against them in the county court. The Register at www.trustonline.org.uk can be searched by members of the public and credit reference agencies.

he UK’s leading disability charity, Leonard Cheshire Disability, has launched a property search website, cantmove.co.uk, to highlight how difficult it is for disabled people to find suitable homes. The parody website has been created after research carried out by the charity for their Home

their constituency. Leonard Cheshire Disability research has found that many people are confined to a limited number of downstairs rooms and face the daily nightmare of washing in their kitchen, sleeping in their living room and being unable to get in and out of their front doors. Emma Lindsay, Campaigns Manager at Leonard Cheshire Disability, said: “We decided to develop the Can’t Move site to make the point that there is a desperate shortage of suitable homes for disabled people. A house is not a home when you have to wash in your kitchen sink

or sleep in your living room. “With the general election, this is a perfect time to highlight to all the political parties that action is needed to ensure more disabledfriendly homes need to be built.” The website is going live at the same time as the charity reveals new research on how councils are failing to adapt homes for disabled people within the one year legal limit. www.cantmove.co.uk

Truths campaign found that around 300,000 disabled people are stuck on housing waiting lists across Great Britain. HELPING RETIRING LANDLORDS STRUCTURE A STRESS-FREE RETIREMENT

A

Are you a Sussex-based landlord planning to retire this year? Brighton-based property investor Dominic Kos is reaching out to local landlords who may be considering off-loading some or all of their properties, enabling them to begin enjoying their retirement now with security and peace of mind. We asked Dominic Kos how he can help. Dominic, give me an idea of the process a retiring landlord might go through. “There are a number of things landlords will need to consider, all of which are dependent of their individual circumstances, of course. A retiring landlord may want to hold a portion of their portfolio for income during retirement and sell some properties to generate a cash lump sum. This cash might be used to purchase a retirement property to live in, fund a move overseas, clear some mortgages or other debt or to help family in some way, perhaps helping their grandchildren with university fees.”

What kind of issues might landlords face when considering retirement? “Selling multiple properties creates a variety of potential headaches. For example, a landlord with fifteen houses in Brighton might want to sell ten of them to generate some capital. Anyone who has sold their house before will know how much time and effort one property sale can take. Not to mention the stress if the buyer pulls out or the chain collapses. If you’re talking about multiple properties that is an awful lot of phone calls, viewing requests, estate agents, communication with solicitors, paperwork and so on. ” Sounds like a lot of hard work. “It is. And a retiring landlord is probably hoping to wind down their workload. Selling ten properties through estate agents could potentially drag on for many months, even years. When you consider what the estate agents’ fees might be on ten properties in Brighton at around 1.5% or even 2% + VAT a go, that’s a big hit.”

What kind of tax bill would a landlord be faced with in this situation? “A key element of our service is to help landlords structure the sale in the most tax-efficient manner. I’m not personally qualified to give tax advice, so we use property tax specialists. “We want to pay a fair amount of tax according to HMRC’s guidlines and 100% play by the rules. HMRC has tax allowances in place and we ensure our fellow landlords fully benefit from these. “We can usually purchase properties at the full market value depending on the condition, but that is only part of the service. “I am in business to help people first, and profit second. I am only interested in an ethical win-win solution. That is fundamental to my business model. Robert Nemeth is impressed by Splashpoint Leisure Centre in Worthing ollowing the success of Worthing’s first Eco Open Houses event last year, a second has impressed just as much. My column on the event one year back focused on the Lancing Beach Building – a huge eco-tistical shell of fun right on the Lancing beach. My visit this year was to an even bigger beach building – the newish Splashpoint leisure centre on the Worthing seafront. As usual, I wasn’t particularly interested in the standard brochure. It was the behind-the-scenes areas that caught my attention. Splashpoint did not fail to impress in that regard. Splashpoint opened in May 2013 at a cost of £18 million. It sets the benchmark for what a new King Alfred in Hove should be looking to achieve. Our tour with efficiency specialist Matt Roberts started to the west of the slowly-tarnishing copper, glass and polished concrete structure above an array of pipes serving the building’s ground source heat pump. The arrangement is complex as the leisure centre needs to be simultaneously heated (pools) and cooled (gyms). Beneath much of the building, and wrapping around the lower sections of the pool is a deep basement containing all manner of gadgets that keep this highly-efficient building in check. There are pipes, tanks, motors and control panels everywhere for a variety of cooling, heating, electricity-generating, air-conditioning and filtering systems. There are even huge bags that provide a home for the lane ropes that disappear down little holes at the end of the pool. Having been involved with the campaign to get a new King Alfred for Hove from the beginning, I am embarrassed that Brighton & Hove City Council has done so little to get things moving. As such, I am certainly grateful to the Eco Open Houses team for showing the public what it is possible to achieve in that regard.

EPCS ARE ABOUT TO GET A BIT MORE BITE

A

s part of a series of articles offering advice and news for local landlords, Ahmed Khalil of Khalil Properties explains how landlords whose properties are assessed poorly on an Energy Performance Certificate (EPC) could be banned from renting them out. EPCs: Changes are afoot Changes are afoot and the relatively toothless EPC is about to get a bit more bite. Find out what this may mean for you if you are letting property in and around Brighton.

Part of the fixtures and fittings EPCs are, by now, part of the letting fixtures and fittings: they have been around long enough to be simply part of the routine administrative work that is involved in letting out a property. As a piece of paperwork they have the benefit of being more colourful than much that crosses our desks and, of course, their intention to raise awareness of how energy efficient our homes are is praiseworthy. Since 2008 all landlords have had to provide an EPC to all new and prospective tenants. The EPC rates your property, on a scale of A to G, for its energy efficiency. They cost under a £100 for the assessment – which is valid for ten years – and the only additional risk a landlord has faced, up until now, is a fine from the local authority should an EPC not be made available. All this is about to change The EPC previously made recommendations only. It

highlighted how we could improve the energy efficiency of our properties, but it had no real bite. All this is about to change. Under sweeping changes to what an EPC means, and what it can be made to do, landlords in England and Wales will be banned from renting out property that is currently rated F or G from April 2018. Almost 10% of the 4.2m privately rented homes in England and Wales currently fall below the E rating. Quite a big stick Introducing the change in February, Ed Davey, the energy and climate minister, commented it was “a very big measure” and “quite a big stick”. The carrot offered is noticeably smaller, although vague promises of grants to alleviate upfront costs have been made. Landlord organisations have been tentative in their acceptance of the change as a necessary evil. The NLA’s CEO, Richard Lambert, commented that “there is a realistic prospect of landlords being able to comply”. He went on to point out that the standards to meet were “sensible rather than aspirational” and that timescales to make the changes were probably managable. Dig out that paperwork My advice to landlords is to dig out that EPC and check to see if you are going to be affected. The more time you allow yourselves to plan for improvements the less of a jolt it’s going to be. As ever with regulation changes: forewarned is forearmed.
