connection with an assured tenancy of a property or a property that is, has been or is proposed to be let under an assured tenancy.” However, an agent does not need to publicise the rent payable to a landlord, the tenancy deposit which is taken as security against damage or violation of the tenancy agreement, and any fees, charges or penalties which the letting agent receives from a landlord under a tenancy on behalf of another person. For example should a letting agent recommend a gardener for a property and arrange to pass the fee from the landlord to the gardener without taking a cut or adding a fee for this service there would be no requirement to
publicise the fee charged by the gardener. The fees which should be displayed must be on show at the agent’s office in such as way as it will be seen by customers. “Ideally someone walking into an agent’s office should be able to see the list without having to ask for it and if someone does ask it should be clearly on view and not hidden for example in a drawer” says the guidelines. The advice also emphasises that “the list of fees must be comprehensive and clearly defined; there is no scope for surcharges or hidden fees. New EU laws could see UK homeowners stranded on their lender’s expensive Standard Variable Rate (SVR) when their mortgage comes to an end and Fox & Sons advises shopping around to check that you are on the right deal and the right rate. The EU ‘Mortgage Credit Directive’ comes into force in

March 2016 but can be backdated by six months. The directive, which is in effect an extension of the mortgage affordability criteria that was introduced last year, has stringent rules to check whether borrowers can afford their mortgage deal not just now but if interest rates are to rise. Currently lenders can bypass these checks when an existing homeowner is remortgaging but under the new EU rules, they won't be able to do so. “It is certainly worth reviewing
FEES TEMPLATES READY FOR DOWNLOAD IN RESPONSE TO CONSUMER RIGHTS ACT set of ‘fees templates’ have been created for letting agents to download ahead of the legal requirement to display details of all charges on websites and in offices from May 27 2015. The Association of Residential Letting Agents has created the templates in response to The Consumer Rights Act which makes the requirement legal from Wednesday. isitors to Brighton & Hove may be forgiven for thinking that we haven’t yet had a chance to tidy up after last month’s Artists Open Houses event. Modern art around the city has been imaginatively decorated since around the year 2000 by seagulls, rusting balconies, and blocked hoppers. Promoted on Grand Designs and by idealistic planning officers and overoptimistic developers, once plain facades, originally blank canvasses, could easily be mistaken for exhibits in the Tate Modern. Whether it be the mansions of Tongdean and Withdean, or new homes in little industrial pockets in built-up areas, properties continue to receive the white render treatment. This goes for renovation, conversion and new-builds. In most cases, white render is highly inappropriate. Many a decent house in Tongdean and Withdean has been spoilt in fact by acres of added render that is already showing signs of deterioration. The 1980s and 90s saw a resurgence of brick as the building material of choice. This may well have been in response to the concrete of the 1960s and 70s. Accordingly, the 2000s saw, and the current decade continues to see, white render as the standard finish – a seemingly modern answer to the pastiche of the previous two decades. In the right environment, white render is bright and clean. The problem is that our often harsh weather is not conducive to such an environment. Whereas brick, stone, glass, slate and zinc require little maintenance, white render requires painting every five years. Not all of us have the time, money or inclination to do this. The Regency period saw render promoted as a direct response to the cost and availability of stone. However, their product was far superior and the building owners far wealthier.

LH LETTINGS NEWS NEWLY ELECTED GOVERNMENT SHOULD MAKE REGULATION OF LETTING AGENTS A PRIORITY ith the general election behind us and a clearer direction ahead for the housing industry, property specialist Leaders is urging the government to improve standards for the millions of landlords and tenants in the private rented sector (PRS) by bringing in formal regulation of letting agents. Leaders’ Chief Executive, Paul Weller, said: “More people and families than ever before now use the PRS and the services of letting agents. Yet the vast majority are unaware that letting agents are not regulated by the government and that anyone can set up a letting agency, with no experience, knowledge of lettings law or client money protection in place. “Letting agents can hold hundreds of thousands of pounds in rent which they are supposed to protect. But without regulation, there is no way to enforce this and there have been countless cases of letting firms losing their clients’ money, using it for their own ends, or completely disappearing with it, leaving landlords and tenants badly out of pocket. Too many people have suffered at the hands of agents like this, as well as incompetent and unscrupulous agents who fail to provide a decent standard of service. “This needs to be tackled urgently,” Mr Weller argues, “and the only way to do so is to make it mandatory for agents to abide by an agreed

code of conduct, be professionally qualified with a sound knowledge of the laws governing lettings and to have client money protection and professional indemnity insurance in place.” As it stands, only agents that are members of self-regulating professional bodies, such as the Association of Residential Letting Agents (ARLA) and the Royal Institute of Chartered Surveyors (RICS), sign up to a code of conduct which protects consumers from bad practice. The rest can get away with cutting corners and as a result, can often afford to undercut good quality agents on fees to attract unwitting tenants and landlords. “The new Conservative government has put forward some promising policies on housing which we believe will be good for the market,” continued Mr Weller. “These include the promise to build 200,000 new homes which will be available at a 20 per cent discount to firsttime buyers under the age of 40; and the launch of a new Help to Buy ISA for first-time buyers which will enable them to save up a subsidised deposit to buy their own home. “There is now a golden opportunity to make a positive difference to those renting and letting. Proper regulation is essential to stop rogue agents taking advantage of the thriving rental market. Good agents have been crying out for this for years and, as the numbers of those renting and letting continues to rise, the need for it grows ever stronger.” www.leaders.co.uk

AGENT FEE RULES COME INTO EFFECT s from last Thursday it is now a statutory duty for letting agents to fully publicise the fees they charge to landlords and tenants. Under the Consumer Rights Act 2015, agents must prominently display a list of their fees at each of their offices as well as on their website. Guidance for the new requirements has been issued by the Department for Communities and Local Government with input from the Advertising Standards Authority. The guidelines state that: “All fees, charges or penalties (however expressed) which are payable to the agent by a landlord or tenant in respect of letting agency work and property management work carried out by the agent in connection with an assured tenancy. This includes fees, charges or penalties in connection with an assured tenancy of a property or a property that is, has been or is proposed to be let under an assured tenancy.” All fees must be shown inclusive of VAT but agents do not need to publicise the rent payable to a landlord or the tenancy deposit which is taken as security against damage or violation of the tenancy agreement. The requirements will be enforced by Trading Standards and any agent that does not comply could be fined up to £5,000. “Lower penalties will only be applied in extenuating circumstance which will not include ‘I did not know about the law’ or ‘I did not know what to do,’” said Sean Hooker, head of redress at the Property Redress Scheme. “The fees should be clear and specific without surcharges or hidden costs. Generic terms such as ‘administration fee’ are no longer acceptable and all charges should be displayed inclusive of tax.” Letting agents are now also required to display which of the three redress schemes they have joined (The Property Ombudsman, The Property Redress Scheme or Ombudsman Services: Property) and whether they have Client Money Protection (CMP).
