ork began on the local bus company’s large depot on Conway Street near Hove Station in 1939. The style of architecture is unmistakable and has many similarities with the King Alfred and 4 Grand Avenue which were both completed that same year. A monolithic appearance with acres of dark brick and a particular attention to symmetry characterise the buildings of the day. The depot took a year to build and includes offices, workshops and storage areas. There was originally a coachworks on the site but this was closed down in 1969. Conway Street itself was developed from the 1870s and there were certainly stables there already when a number of local horse bus companies combined in 1884 to become Brighton, Hove & District United Omnibus Company (not quite as catchy as Brighton & Hove Bus and Coach Company). Pubs, barracks, laundries, blacksmiths and stables created quite an odour and lead to complaints about smells. The walk down the steps from Goldstone Villas was compared to a descent into hell. Being huge, fairly undeveloped and near a station, the depot is a property developer’s dream or, in the case of Andy Lambor, a nightmare. Andy spent years building up a portfolio in the area that, when combined with the bus depot and several other key plots, could have been the biggest scheme in the city for a number of years. Towers, a cinema, employment space and homes were proposed. It was sadly not to be. The upside is that the bus company is staying in Hove and huge investment is now taking place. My recent tour, given by the company’s Business Development Manager, Patrick Warner, was something of an eye-opener in that I saw several of the hidden areas that most will never get to see. The most interesting area was the pits below ground where mechanics can work below the buses. It was a job at Huet Car Audio in Hove that brought me down from London all those years ago. Seeing layers of Snap-on tools (the best) in glorious red cabinets did bring back memories – and, indeed, serve as a reminder that these guys take serious pride in their work. Another fascinating spot is the control room which shows the locations of every moving bus in the city. On that Friday afternoon, with a crash on the A27 and the start of halfterm, ‘chaotic’ was something of an understatement.

Victoria Wright of local solicitors Dean Wilson LLP discusses ‘Without Prejudice’ I see ‘Without Prejudice’ and ‘Without Prejudice save as to costs’ on some letters and not on others I receive in respect of my Employment Tribunal case. What does it mean and do I need to put it on letters too? ‘Without Prejudice’ is a phrase used in settlement negotiations that basically means ‘off the record’. What it means is that the letter, about a settlement, cannot be shown to the Employment Tribunal during the hearing. So an employer can propose on a ‘Without Prejudice’ basis that it is prepared to pay £5,000 in return for the claimant withdrawing the claim. The claimant cannot then say to the Tribunal: “look, you must find in my favour because the employer was prepared to offer me £5000, so my version of events must be correct”.

So whether stated to be ‘Without Prejudice’ or not, a genuine attempt to settle a dispute will not be put before the Tribunal as evidence of an admission made by that party. The rationale for the rule is the public policy of encouraging parties to settle their disputes out of court. The idea is that the parties can speak freely during settlement negotiations without the fear that what they have said will be used against them at the hearing. It is hoped that this will enable them to put their cards on the table and this will lead to a settlement. ‘Without Prejudice save as to costs’ is used when one party wants to make a without prejudice settlement offer, but reserves the right to show the letter to the Tribunal at the end of the hearing, when it makes an application for costs. The argument will be that

the opponent refusing the offer of settlement amounted to unreasonable conduct. Unreasonable conduct can be a basis for awarding costs, although it is still very rare for a costs award to be made. Conversations through Acas are without prejudice or off the record and again, anything said during those negotiations will not be put before the Tribunal. Since May 2014, Acas Early Conciliation has been compulsory for almost all Employment Tribunal claims. The process is designed to resolve disputes at an early stage and will ideally avoid the need for Tribunal proceedings and incurring the cost of tribunal fees (£160 or £250 to issue the claim depending upon the type of claim, followed by a hearing fee of either £230 or £950). See www.acas.org.uk. If in error a ‘Without Prejudice’ letter finds its way before the Tribunal, it will just disregard it.
