FIVE KEY LEGAL CHANGES IMMINENT FOR LANDLORDS

F

ive major legislative changes are due to come into effect over the coming months that landlords in England should be aware of. 1) Health and safety regulations At the time of writing, these regulations are awaiting parliamentary approval and the full details are yet to be confirmed, however it is expected that, from 1 October 2015, landlords will be required to have at least one smoke alarm installed on every storey of their properties and a carbon monoxide alarm in any room containing a solid fuel burning appliance. In addition, the TPO and PRS Codes of Conduct require co-detectors in properties with a gas appliance. Landlords found not to have installed these devices will face a fine of up to £5,000. 2) Right to rent – the Illegal Immigration Act

A trial of the ‘right to rent’ scheme – in which landlords are required to check the immigration status of their tenants – has recently been completed and is expected to be rolled out across the country by the end of the year. New powers will allow, in some cases, tenants who do not have the right to live and work in the UK to be evicted from a let property without requiring a court order. Landlords who fail to complete the necessary checks to ensure their tenants are legally able to rent their property could be prosecuted, with potential punishments ranging from four-figure fines to imprisonment for repeat offenders or those involved in organised crime. 3) Serving Notice of Possession: Section 21 Several changes are being made to the Notice of Possession under Section 21. As part of anti-

retaliatory eviction measures, landlords will be prevented from serving a valid Section 21 notice for six months if their tenant has recently complained about the state of their property and the local authority has issued a notice of improvement. There are also a number of other preconditions for serving a Section 21 due to be implemented which will prescribe whether and when a valid Section 21 notice can be served to regain possession. 4) Houses in Multiple Occupation licensing (HMOs) Currently, a house in multiple occupation (HMO) is defined as a property in which three or more people live but do not form one household, i.e. they are not related or in a relationship. This is commonly known as a house share. However, the government has suggested it will look again at the definition of an HMO so more properties fall within this designation. In addition, many

local authorities have adopted ‘selective’ licensing, requiring licensing of all HMOs and sometimes all let property within their jurisdiction. Landlords need to stay up-to-date with any changes being proposed by the local authority in which their property is located as its status may be subject to a change in the future. 5) Rogue landlord crackdown There have been clear indications the government is ready to launch new measures designed to penalise rogue landlords who blatantly flout existing legislation, allowing their tenants to live in poor and unsafe conditions. With ever-changing legislation surrounding letting, the advantages of letting through a knowledgeable and reputable agent are clear. A good agent will make landlords aware of all legislative changes that will affect them and help them to stay on the right side of the law. T

he most popular questions I'm asked at the moment are: Is the tower at full height now and when is the glass pod arriving? Well, the tower is at full height and the pod is due to arrive in early November. The curved glass has already been manufactured in Italy and the glass passenger pod is currently under construction in France by Poma. Poma is undertaking a trial assembly at present attaching the 48 pieces of glass – each a bit like segments of an orange – to a "dummy" chassis; the real chassis is already attached to the i360 tower. Once we are happy it is in perfect working order, it will be shipped to Brighton in about 30 lorries. Entirely hand made, the glass pod is already a striking structure. Our architects, Marks Barfield, went out to watch this process and David Marks described the pod as a "perfect liquid bubble" and the underside of the glass pod is mirrored glass, reminiscent of an Anish Kapoor sculpture. The i360, in engineering terms, is a vertical cable – the first of its kind in the world. We turned to world-leading cable car experts to build this, Poma-Sigma. Poma is best known as ski lift and cable car manufacturers, but they also built the 32 London Eye capsules and drive system. When completed the futuristic glass viewing pod will be incredibly spacious – approximately 10 times the size of a London Eye capsule and has the capacity to hold up to 200 people with plenty of space to move around and see the view from different angles. With a Sky Bar, it will be the perfect entertaining space to host parties, weddings and group visits. Travelling from street level (Kings Road) up to 138 metres, the viewing pod will provide a 360 degree view through curved glass, before returning to beach level. Among its other features, the i360 passenger pod will be heated and air-conditioned, is fully accessible for wheelchair users, and has bench seating for passengers. onway Street in Hove was developed from the 1870s as terraced housing and industrial premises, but was quickly notorious for overcrowding and the smell of manure. Mixeduse did not work in Victorian times. Albert Works demonstrates that it certainly can today. The Conway Street Industrial Estate has been in the press as having potential for serious redevelopment following the release of plans by developer Andrew Lambor for towers, shops and a cinema. The nearby Sackville Trading Estate was to be a housing scheme with supermarket. The Corralls coal yard below could be joined to it. The Goldstone Retail Park would have made a wonderful John Lewis. For a variety of reasons, not one of these big ideas, from a variety of sources, has come to fruition. Piecemeal development may well be the way forward. I was recently shown around Albert Works, named after Albert Street that once ran between Conway Street and Ellen Street, by Andrew Gill to see how it can be done well. The first third of the building was built by Hove Council during the 1950s. Andrew’s father, an electrical engineer, worked there and was involved with building the remaining two-thirds and ended up buying it after a time as a tenant. At that point, heavy electrical motors for the marine industry were serviced there. Lifts and cranes were in place for the purpose. Prior to the recently-completed conversion, Rentokil occupied the building (then called Gill House). It now consists of four flexible spaces for creative types and four one-bedroom flats across two storeys to the designs of Worthing-based architect Gerald Moore. Finishes are impressive and the overall design works well. Andrew believes in transforming buildings one at a time, not least because work is unlikely to be delayed. er Majesty’s Revenue & Customs (HMRC) says that more homes were sold in the UK in August than in any month since February last year. The Revenue says its seasonally-adjusted data – which to the consternation of some traditionalists is widely regarded as the best measure of transactions, ironing out discrepancies caused by atypical

summer fluctuations – shows that 106,480 homes were sold during the month. HMRC says this is the third consecutive month with a sales total in excess of 100,000, although this remains well below the pre-downturn days when monthly sales of over 130,000 were typical. The latest Revenue figures show that UK house prices rose by an average of 5.2 per cent in the

year to the end of July. Whilst the price of property coming to market during August has hit a new national record, up 0.9 per cent to £294,834, borrowing is still cheap and there is a positive sentiment aided by the ongoing postponement of rate rises from the last six-year lows. There is still a huge demand of all types of properties and there is a clear upturn of more properties coming to the market. The number of letting agents reporting rent increases for tenants has fallen month on month while the number of homes for rent is also down, according to the latest UK rental sector report. The analysis from the Association of Residential Letting Agents (ARLA) shows that for the first time this year, the number of ARLA agents seeing rent hikes for tenants has decreased from the previous month. The report also reveals only three in ten, some 33 per cent, of agents reported an increase in August. The lowest since April this year and a drop

from 37 per cent in July. Overall the picture is still very positive, more properties coming to the market and being sold, and rents staying stable giving investors a good return, so if you are wanting to move home now is the time to put your property with a good local reputable agent. Victoria Wright of local solicitors Dean Wilson LLP discusses taking on an employee Social media – dismissal of employee who made disparaging comments on Facebook was fair An employee raised a grievance about his working situation – he said he felt stressed, was being singled out and he was unhappy about the way in which matters were being dealt with. HR responded with a recommendation for mediation. In order that the mediation was not ‘all one-sided’, one of the employee’s colleagues provided copies of his Facebook pages, where he had referred to his supervisors in derogatory terms. His comments included: “why are gaffers such pr***s, is there some kind of book teaching them to be total wa****s” He also made comments referring to drinking alcohol while on standby, when employees are

required to remain teetotal. He admitted making the statements on Facebook, but said that he had not intended to offend anyone and had been indulging in banter. In mitigation, he said that his Facebook account had been hacked, his settings had been changed from ‘private’ to ‘public’ and that his comments about drinking were made in jest and in fact, he had been sober. The employee was dismissed for gross misconduct. The employer found that whether true or not, the comments had the potential to undermine confidence in the employee. It found that making offensive remarks on Facebook was unacceptable and amounted to gross misconduct. The Employment Appeal Tribunal found the dismissal to be fair. The employer had shown the reason for dismissal (conduct) and that reason

was a potentially fair one. The fairness of the dismissal itself was considered: the investigation was reasonable; there was a genuine belief, held on reasonable grounds that the employee had made the comments on Facebook; and the decision to dismiss was within the range of reasonable responses open to the employer. This was all despite the employee having: eight years’ service; consistently good performance reviews; and an unblemished record. The employer in this case had a clear policy which the employee was in breach of. The salutatory lesson is to be wary of workrelated postings on social media, take care what settings are used and in particular, to ensure that the employer’s policy is not breached.

ork begins this week on the Circus Street development in Brighton, which will regenerate the area, injecting £200 million into the economy and create 400 jobs. Partners in the scheme celebrated the start as the first machinery arrived to start the demolition of the old municipal market building. The demolition contractors are Dorton Group, based in Burgess Hill, with 30 years of experience in demolition and 40 employees, many of them local. They will complete demolition towards the end of 2015 and then construction will start early in 2016. All timber from the demolition works will be used for board making and biomass fuel. All steel will be re-used and all hard core and concrete will be kept on site to be used on the site construction of the new Circus Street development. Any waste will go to a transfer station for further sorting.

he biggest misconception people have about engineered wood flooring is that the products are invincible. When we look at stability as far as cupping or gapping, engineered wood flooring will outperform solid wood flooring, meaning you can use a wider-width product without seeing those dimensional changes as much. But that doesn’t mean we can just ignore moisture, especially relative humidity when it comes to engineered wood flooring. If a solid wood floor experiences very dry conditions, it may cause shrinkage resulting in some wide gaps appearing between the boards. But if an engineered wood floor experiences dry conditions outside the parameters defined by the manufacturer, the product may delaminate, show cracks in the face veneer, splits and dry-cupping. All of these problems would then more than likely require replacement of the affected boards or, if the problems are throughout the floor, total replacement. When buying an engineered wood floor to install, it is crucial to read the manufacturers’ instructions regarding the relative humidity parameters necessary to maintain the floor. Although your floor will come with a warranty, the relative humidity range for these warranties will vary between many products. Any residential and/or commercial properties that are maintained outside these permitted ranges for a consistent period of time will void that floor’s warranty. Of course, the quality of the product has a big role in how well an engineered wood floor will tolerate moisture swings, and there is a huge spectrum of quality in today’s engineered wood flooring market. Particularly in very dry climates, as well as installations over radiant heat, an engineered floor must be chosen carefully and the home must have a humidification system that can maintain the floor within the required range. Engineered flooring isn’t appropriate for certain climates, such as bathrooms, as it is too hard to regulate the moisture/humidity of this type of environment. Use in areas such as kitchens could be possible even though it is still a room with water risk as such, but you would need to ensure you do what’s necessary to maintain and protect the floor correctly as can be advised by supplier and/or fitter. It’s up to you to tell your landlord or letting agent so such problems can be dealt with before they grow. 5) Tidy and clean before you go! Leaving your rented home clean and in good order is vital. In many cases, tenants who fail to get their full deposit returned simply haven’t cleaned the property to the same standard as when they moved in. The property should be left as clean as you found it – from carpets and furniture to walls and appliances, and everything in between – in order to get your deposit back in full.
