In a world obsessed with youth, but one where young people will find it increasingly difficult to get on the property ladder, it was good to see that for an older generation there are great options that offer a level of security and comfort whilst at the same time respecting that we don’t want to be shipped off to the suburbs but still enjoy the city centre lifestyle that we have grown to love. If you are of a “certain” age then take a good look at what is on offer, it can make an awful lot of sense.

Barratt Homes has signed an agreement – the first of its kind in the UK – with the RSPB to boost natural habitats at its developments in Lindfield using updated landscaping and new guidance. e have seen huge transformation in the pub industry over recent years and regularly hear the sad news that another community pub is closing down. But change in the sector is nothing new as the case of Osborne Mansions on St Catherine’s Terrace in Hove demonstrates. When ‘The Sussex’ was opened in 1855, it was known to all as ‘The Sussex Hotel’. The words are emblazoned around the building to this day but few use its complete name. This may well be down to convenience, but it is certainly also because the building no longer serves as a hotel. There are many similar examples around the town where pub and hotel were one and the same. Across the road is of course the now derelict St Aubyns Hotel (‘the Alibi’) and nearby are the Cliftonville Hotel (‘The Station’) and The Ship Inn (‘The Ginger Pig’) are no longer hotels of course. The freehold of The Sussex is today owned by pub giant Mitchells & Butlers who bought from Bass Taverns. Permission was granted in 1926 to turn the building’s thirty hotel rooms, across four floors, into four flats. Seven of these are now for sale through Goldin Lemcke (the other four have already been sold off on long leases). The suggestion is that the two flats might become a single fivebedroom penthouse with roof terrace and sea views. Much work would be required but it is certainly possible and, indeed, desirable. rtists have long flocked to Brighton and with the large skies and extraordinary light at sunset, I can see why the city has inspired generations of painters and photographers. Two of Britain's most famous painters, Constable and Turner, both visited, sketched and painted here in the 1820s (and in fact Constable lived around the corner from British Airways i360 in Silwood Road). Both made Brighton's first pier, the Chain Pier, the subject of their work, which opened in 1823 but was destroyed by a storm in 1896. One of the things I love about this city is the creative buzz and from the outset, we felt it important to reach out to the artists in the city to involve them in the project. When our hoardings went up we invited local graffiti artist Aroe and It makes for his friends to come down to a defining paint our boards. The results were structure in a impressive and so when we picture, or work added more hoardings last summer, Aroe returned with of art in any a group of other local artists medium including Gary, Rebus, Jiroe, Vodka, Morf, Warg, Ster and Past, as well as artists from further afield. You can still see their vibrant, eclectic artwork on the beach level of our site today. Lisa Holdcroft, a Brighton-based cartoonist best known as the illustrator of the Cheeky Guide, has been documenting the construction of British Airways i360 in a unique way by turning the engineers and every construction milestone into a series of wonderful cartoon drawings. Another local artist, Patrick Turner-Lee, has been creating oil paintings of the tower and surrounding landscape. He walks his dog on the racecourse each day and the tower build last summer really inspired him. He said, "I think it [British Airways i360] is great for artists because like the London Eye and Gherkin, it makes for a defining structure in a picture or piece of art in any medium." To build or not to build – do we really have a choice? righton & Hove city is currently going through a period of change, the results of which could be a significant step towards how the city can cope with future growth plans, as a destination to either live or work and to test general ambition of its Council, residents and employers. The Local Plan is shortly to be adopted and this will set the model until 2030 for homes and jobs. There is a decision making process on various potential developments which will have a huge bearing on the way the city operates, attracts visitors, the infrastructure and to cope with the demands of residents – and it all seems to be happening at once, although that is the way it has been perceived. Is it a case of the City Is it a Council being proactive in trying to solve the problems case of under the ever changing the City regime or has it been forced Council being upon them due to years of proactive in lack of attention? If you read the local trying to solve newspaper, listen to the radio the problems? station, jump in a taxi or just engage with your local business, you will hear an opinion on what is happening at the moment. Great topics of debate about new developments, transport solutions, the financial plight of our City Council and more, but that surely has to be good for the City.

Consultation is key to evolving and it would be a huge mistake if decisions were not allowed to be out in the public domain. This brings me to my first issue – why is the decision making process on one of the city’s major projects being dealt with behind closed doors? The King Alfred is a development project like no other and will, or should, provide community facilities, alongside housing for everyone to enjoy. Yet public consultation was pretty minimal and the jury is still out as to whether the new scheme delivers on the original planning brief. Design is always a subjective matter, but is this really good enough for our prime seafront? Let us hope there is an opportunity for public consultation with both the Council and chosen developer, to listen to the needs of the paying public. We cannot afford to get it wrong. Never underestimate the influence of public opinion. The same applies to the need for more housing. The Sackville Tower and the Astoria sites have notably been subject to recent criticism on development proposals. There should be an open debate to find the correct solution and decent quality sustainable design – but let’s face it, not everyone is going to be satisfied. The NIMBYs must wake up to change and both of these sites go a long way to providing homes at all levels of the housing ladder. The outlying urban sites however, may need to be dealt with more sensitively. Our green spaces do need protection and we must work harder to find brownfield sites which are more suitable for change of use. Protecting redundant commercial buildings in a secondary area is a nonsense when a mixed use scheme with increased housing

A DESIGN LANGUAGE Follow me: @SamerbagaeenH here is a trio in Brighton that professes to know all there is to know about design, even when city officers recommend refusing what is a hideous piece of architecture on design grounds. Our trio are city politicians and the building in question is the Albion-proposed low-rise, (what appears to be) white render, poor quality architecture that Brighton and Hove should not be embracing. This is a theme picked up in a previous column: the city needs better and the city deserves better architecture, better design and not another low rise horrid piece of architecture – if we can even call it that. Football stadiums are about spectacle and this is certainly what this hotel is not about. This story broke in the same week that we saw released sketch images for the new Hove neighbourhood, Court Farm House. The best comment I came across describing this particular development was “Eye-catching development? Eye-catching? Should have gone to Specsavers” by an Argus reader. That’s then two designs in one week that promote a new design language for the city, a block shape with white or grey render and a flat roof. The danger here is that a Council desperate to build 13,000 homes it knows it has no chance of building in our lifetime will jump at the idea. What’s even worse is that architects who should know better, Conran and Partners director, should be setting the tone, sensibly, for what is to come for the rest of Toad’s What’s Hole Valley. What’s being proposed even there so far is a low density neighbourhood that, if applying criteria worse is by architects like Lord Richard Rogers, that will fail in terms of density, services and architects housing design. The city’s big players also need to up their game. In Cambridge, the University is driving the city’s major expansion as it realises the importance of providing affordable homes for its staff if it is to continue to complete globally. Like Brighton and Hove, Cambridge also has an affordability issue and has admitted as much unlike Brighton and Hove who continues to bury its head in the sand lagging in the fourth division! www.samerbagaeen.com

managed – which is more than what you can say for many private landlord houses. It makes sense to build close to existing academic buildings and to create student quarters in areas of the city. Not a week will pass without my office taking a call on a commercial property with the individual wanting a city base as they originally studied in the area. Finally, Brighton seafront, between the Palace Pier and the Marina, what a disaster area. A total lack of investment for many decades has left us in this position and we must act swiftly and plan thoroughly to resolve the problems – but let us learn from some of the previous mistakes and make time for public consultation and plan for the long term future. A mix of viable uses on the various independent sites can open up some great possibilities for the now closed Victorian arches. CUPBOARD LOVE ANDREW KAY LOOKS AT BEAUTIFULLY DESIGNED AND BUILT KITCHENS FROM DMB SOLUTIONS ith regularity I meet up with James Powell, the man behind DMB Solutions, and it’s always a pleasure to talk to him about where his business is, the current developments they are making and projects that they are working on. Over the years I have made site visits to see what they do and I have always been impressed by the quality of the work and the standard of design ideas that they create. I am often invited to see projects done on a grand scale, and it’s hardly surprising, after all any company will surely want to show off their best and most exacting work. Over the years DMB Solutions have invited me to see a wide range of the works they have undertaken, from the small scale with tight fixed budgets to the large and luxurious. It has become clear to me that no matter what the scale of the job, they will still invest the same amount of care and attention into delivering the best design solution and build quality possible. That said, DMB do focus on larger restoration, renovation and new build projects and are unlikely to pop round to build a set of shelves or a wardrobe. Their latest move is to offer a full kitchen design and build service. Until now they have been happy to work with clients and existing kitchen companies, but for some have felt that they could actually incorporate that service using their existing skills and in doing so offer clients a higher standard of kitchen for a far more competitive price. James explains that many of the higher specification materials and appliances can be sourced by them directly from the manufacturers and here excellent savings can be made. It means that DMB Kitchens can make you a bespoke kitchen to the very highest standard as part of their overall design and build service. Of course, as a serious foodie, I wanted to see exactly what he meant. I love to cook but sadly for me have never had the kitchen of my dreams. Having seen the kitchen in the pictures on this page I now have serious kitchen envy. It was so beautifully thought out and designed. The finishes were not only beautiful but extremely practical and the space – well it was a very large space – but it had been so cleverly utilised that I was hard pressed to find any fault. In the end I

merely dismissed their chosen toaster as one that despite being a style icon, I find to be less than easy or efficient. James laughed, I was picking a tiny hole and one that was hardly his decision. Over a coffee we talked about the design and consultation process. He is very committed to the idea that a good design is one that satisfies the needs and dreams of each individual client. Whilst as a team they are often able to make suggestions that will improve on a customer’s wishes, at the end of the day they want that customer to be happy. He is, though, keen to offer within a budget the best and most innovative solutions that are currently on the market, as I was to see. The kitchen I saw, whilst being a sleek and minimal masterpiece, was a technological marvel with the majority of the state of the art facilities directly controllable from a smartphone. This included extraction, heating, music and media and a multitude of other modern technologies. James clearly loves to utilise new developments and this was a triumph of new technologies. Wonderful stuff, but did it work as a kitchen? Well I could see that it clearly did, and a family kitchen too with areas for dining, relaxing and entertaining built into the overall project. It was all I could do to stop myself popping on an apron, raiding the huge refrigerator and preparing dinner. James and his Company, DMB Solutions, have always impressed me, and the clients that over the years I have met and interviewed have always been equally impressed. He takes pride in his workforce, all of whom are employed full time by the company, and he is proud of the excellent work that they do. The new move into bespoke kitchens is a logical progression for the firm and one that will offer future clients the opportunity to have the kitchen of their dreams built by a company that comes with the very highest reputation. The following is an actual example of what can, and often does, happen if the rules aren’t followed. “My neighbours and I made a verbal agreement before my builders started. However they later changed their mind... not only that they have been really hassling me calling me at all hours constantly changing their minds and in short doing my head in! They have threatened me with legal action and say they will take out an injunction to stop the work. I got a solicitor’s letter this morning.” So – what is the Party Wall Act and how can you find out if you are affected? Amongst other things, the Act allows “Building Owners” to carry out building work affecting “Adjoining Owners”. The Act defines and limits what can be done, sets out procedures and timetables for carrying out work, settling disputes, rectifying defects, allowing access and allocating costs. Crucially, when you appoint a Party Wall Surveyor, who incidentally you cannot sack, they are not acting as your “consultant” as say an architect, or accountant might, but acting under the Act to settle a dispute.

Can I act as Party Wall Surveyor myself? No one “party” to the work can act for themselves. Building Owners often want to save money by serving the initial Notice but frequently this does not contain all the required information and is therefore invalid. Who’s going to pay for this? Typically the person doing the work pays for everything, including the adjoining owner’s surveyor’s fees. How can I find a suitable Party Wall Surveyor? The Faculty of Party Wall Surveyors, the Pyramus & Thisbe Club, and Brighton Building Control all keep lists of local surveyors. This all sounds expensive and time consuming, is it really necessary? There are no fines for not complying with the Law under the Party Wall Act but if you start work your neighbour may serve an injunction on you to stop. As with most building work, if you think the cost of getting it right is high, wait until you see the cost of getting it wrong! hen you read this, I will almost definitely be in Cuba. I thought it better to write my column and get it sent while I am here in the 21st Century, rather than leave it to chance and the vagaries of the newly available and mortifyingly unreliable Cuban wi-fi. In a pleasingly – if frustrating – ironic mimicry of the actual Cuban highway, traffic on the electronic highway seems unlikely to reach its intended destination with anything approaching alacrity. Last time I was in Cuba, I spent a very dull morning in the ‘computer room’ of a 5 star hotel attempting to send a column and ending up helping various tourists with their internet endeavours. It is a morning that I am not likely to repeat on my next trip. I am mainly going to Cuba to commence my property search, but am sure to spend a great deal of time in pensive contemplation on one of the many beaches as, along with a handful of my Cuban friends, I am planning another road trip to a part of Cuba I haven’t yet seen. Meanwhile, my ‘Cuban in Europe’ boyfriend has, after two days of tortuous (for me) silence, reappeared in wholesale fashion on all of my electronic media. 1877 large scale map that was the first of its kind produced by the Ordnance (part of the Army) surveyors, which was measured and drawn by hand and must have taken ages as all the back gardens are as they would have been and not guessed. In this map you can spot the Children's Hospital and the housing built on the original Brighton Workhouse, and on where Vines Mill was as is now Vine Place. These large scale maps are 1:500 which means one inch (2.54cm) of the map is equivalent to 41.66 Feet (12m) of distance on the ground (sorry about the explanation but I'm sure you know what I mean!). The detail is fantastic and there are 54 individual sheets covering the whole of Brighton and Hove in 1876, which if I had a wall measuring 11m x 8m I could join them all up for a great piece of local historic beauty – with the precision and detail that was the Cartographers skill in the late Victorian period. the changes take effect would be £15,704. But the new rate, effective from 1 April, would mean a £31,127 tax duty bill. The average cost of a property in the South East is £261,581. On such a property, Stamp Duty would come in at £3,079 right now, but would rise to £10,926 if bought as a second home after 31 March. Since the Chancellor announced the hike in Stamp Duty, there has been evidence of many buy-to-let investors rushing to the market to buy properties before April. Over three quarters of respondents to a recent Royal Institution of Chartered Surveyors' Residential Market Survey said they expect to see an upturn in sales to buy-to-let investors in the coming months. In January, the Association of Residential Letting Agents warned that buy-to-let landlords were 'storming the UK housing market'. The Chancellor has claimed that the new surcharge on Stamp Duty for landlords and those buying second homes will raise £1 billion for Treasury by 2021

Before 31 March 2016, the Stamp Duty bill on a property of such value would be £1,265.00, but just a day later it would jump to £6,913 if bought as a second home – a rise of £5,648. In London, where average prices are much higher at £514,097, the tax duty bill before

BUSINESS AID WHAT IS THE POSITION ON ZERO HOUR CONTRACTS? here is much debate about what a zero hour contract is and whether or not they should be unlawful. It is accepted a zero hour contract is defined as a casual contract under which the employer does not guarantee any minimum number of hours and doesn’t have to offer any work to the worker. In return, there is no obligation on the worker to accept any engagement offered by the employer. Zero hour workers are not entitled to be given notice and have no right to redundancy pay or to claim unfair dismissal. Despite the talk about banning zero hour contracts, workers have some statutory employment protection: Workers on zero hour contracts are entitled to be paid the National Minimum Wage; workers on zero hour contracts accrue holiday and are entitled to take paid annual leave or be paid in lieu when the engagement terminates; exclusivity clauses in zero hour contracts are unenforceable; and from January 2016 any dismissal of a zero hour worker for breaching an exclusivity clause (i.e. for working for another employer in breach of the purported exclusivity clause) is automatically unfair. Similarly subjecting the worker to a detriment is also unlawful. Are these rights without teeth? There has been a significant reduction in claims to the Employment Tribunal since fees were introduced in 2013. Figures vary, but the drop seems to be generally accepted to be between 60-70%. According to statistics, in 2015

around 744,000 workers were on zero hours contracts. If these workers are being ill-treated, how easy is it for them to enforce their rights? How practical is it for a worker on a zero hours contract, probably earning the minimum wage, to bring a claim to the Employment Tribunal? Such a worker would have to pay a Tribunal issue fee of £250 and a hearing fee of £950; or apply for remission (waiver of some or all of the fee) from fees. All in all, exploited zero hours workers probably feel pretty powerless.
