G

o Seagulls! We have been flying the Albion flag at British Airways i360 as Brighton and Hove Albion FC pushes for promotion to the Premier League. The club’s executive director Martin Perry joined Albion fan Laurence Braden from our construction team to raise the flags ahead of the crunch game against Derby on the bank holiday Monday (the result was a nail biting 1­1 draw). It's such an exciting time for whole city with the Albion on the verge of reaching new heights with Credit: Gary Eastwood promotion to the Premier League. We're proud to show our support by flying Albion flags above our West Pier tollbooths, helping to turn the city into a sea of blue and white. By the time this magazine goes to print, we will know the outcome of the last game of the season against Middlesborough. Fingers crossed – promotion would be an amazing boost for the city! Meanwhile, festival season is underway. Our consultant chefs, Steven Edwards (MasterChef: The Professionals winner 2013) and Josh Stanzl have been at Foodies in Hove Lawn, making their signature burgers from local Sussex produce, which will be on the menu at the Belle Vue restaurant at British Airways i360. > Hove lagoon future

S

alt Daisy Lake became Hove Lagoon when it was transformed from silted riverbed into miniature boating lake in 1930. Few realise that the Adur used to enter the sea from Hove. 1760 is a key date in the creation of the Lagoon as it was in that year that a cut was made in Shoreham to redirect the Adur into the sea at a different point. It wasn’t an entirely successful exercise but it did lead to marshy land forming at the Hove end. As a lake for miniature boats, the Lagoon proved to be a success. The Hove Lagoon Model Yacht Club is still operating since its formation at the same time as the Lagoon. Lagoon Watersports arrived in 1994 and has just gone from strength to strength. The cafe is now packed since being taken on by Danny Stockland and Norman Cook, and the various pirate attractions that are run by the well­known Heal family are popular with children. There are concerns though. We have a seafront in Hove, of which we should be proud, but it is architecture and proportions – rather than attractions – that make it what it is. The Lagoon is essentially its one true attraction. When compared to the funding that goes into Brighton’s amenities, such as the Level, the contrast is staggering. I organised a public meeting recently, with support from Danny and Norman – 70 people turned up and 20 volunteered to help with setting up a ‘Friends of’ group. Many feel that so much more could be done to tweak and improve. Judy Middleton wrote in her Encyclopaedia of Hove and Portslade that “the council’s attitude was that they had enough work and they did not think the Lagoon a matter of sufficient importance.” That was in 1900. ne of the most experienced and popular figures in the Sussex lettings market recently celebrated her 30th anniversary with Leaders. Jane Wilkinson, the company’s lettings director for Sussex, started at Leaders in 1986 as secretary to founder Neville Lee. At the time, the firm had a single office in New Road, Brighton and boasted a workforce of just five people. Tremendous expansion has followed over the subsequent three decades and Leaders now operates almost 120 branches across the UK and employs in excess of 1,000 people. Jane says: “Leaders started as a small family business with strong values and despite our size now, we have managed to

o, the Cuban came over from Scandinavia for a whole week. It was one of the best weeks I've had in a long long time. Instead of taking him to the normal tourist places, I took him to a variety of places that most tourists would probably avoid like the plague... In the Lion and Lobster on his first night, he asked for a typical local beer, so I ordered him a pint of Harveys. Giving a Cuban a warm beer is tantamount to killing a family member, as his face seemed to indicate. Later, a girl told him to #### off when he politely refused her advances on his way to the toilet. Quite some achievement, he thought, to be insulted so violently within the first two hours of arriving. In London the following day, I took him to Brixton market. As we boarded the number 2 bus from Victoria, we were somewhat delayed by a number of rowdy youths with dodgy bus passes having a full on fracas with the driver, who was refusing to move the bus unless they left. The Cuban looked at me quizzically. Pretty standard at school home time in South London as far as I recall, I said. In Brixton market, it began to rain, which pleased him no end as he'd been attempting to take the Mickey out of the British weather since he arrived with little success as bright sunshine had prevailed until then. On a hunt for some Cuban vegetables, we ran into an old neighbour of his from Havana, who he hadn't seen for 20 years. Talk about small world. He charmed all my children by agreeing with them that my house is freezing and my WiFi rubbish – even The Big Daughter, who usually hates everyone, especially my boyfriends. I've never been sadder to see the back of someone...

s you may or may not be aware, I love a sense of irony. When fingering through my archive and other stuff I come across some absolute gems as examples. This week I have shown a photo of Edward Street circa late 1950s, when the road widening programme was in full flight giving cause to demolish the majority of the northern side of the road – to get some more space for the extra car drivers to speed around town in. The church building you can see on the left, was in fact the Salvation Army Hall. Now, here's the irony (1) – the building and pavement that eventually replaced the hall is the 'Wedding Cake' American Express headquarters... wait for it... that's now being demolished (if only some of the other appalling 1960/70s buildings could also be knocked down, what a better looking place we would live in). But I digress. Irony (2)... road widening scheme 1960s style has now been returned to what I call road narrowing schemes! On my soap box now, does anyone ever look back historically at any of these schemes to see: (a) Why was it done in the first place? (b) Has it really been thought through as to the potential hassle it causes to the good citizens of our city just going about their business? (c) Does common sense ever prevail? Anyway back to the picture which is one of the lots in our next auction of all things Brighton, Hove and Sussex on 24th May 2016. > A billion for Brighton and Hove

T

oday the council took major steps towards bringing in more than a billion pounds of investment into our city and our seafront. This investment will deliver jobs, homes and much­needed funding for local services, as well as maintaining Brighton and Hove’s place as one of the UK’s top visitor and conference destinations. Our plans to extend Churchill Square to the sea and build a new ten thousand seat arena for concerts and conferences at Black Rock got underway in earnest this week, as part of a £540 million deal with Standard Life Investments. This will be the biggest investment in the city since the Brighton Centre was built in the 1970s, and marks our determination to compete with major cities like Liverpool, Birmingham and Manchester for conference business and major music tours. We also gave the go ahead for the “Sea Lanes” open air swimming pool complex on the former playground site on Madeira Drive, returning

outdoor swimming for the first time since the much­missed pool at Black Rock closed. This £4.5m privately­funded scheme will feature a 50m eight­lane pool, sauna, exercise studio and shops. Along with the arena, £1.7 million investment in Volks Railway and the new £1.7 million zip wire attraction, this will form the basis for our major regeneration of Madeira Drive, with our £30 million plans for the Arches due to be revealed soon. Other seafront investment, both privately and publicly funded, includes the £11 million Shelter Hall construction and road strengthening at the seafront end of West Street, 850 new homes as part of the £250 million development at the Marina, the £47 million British Airways i360 attraction, and of course the £200 million King Alfred leisure centre project. All this takes investment in our seafront over the next six years to well over a billion pounds. Add to this the hundreds of billions being invested in other projects across the city, the £150 million Preston Barracks with Brighton University that will deliver 350 new homes, the new John Lewis store, £36 million plans at City College, the redevelopment masterplan at Sussex University, and the ten­ year £486 million redevelopment of the Royal Sussex County Hospital, and it is clear Brighton and Hove will emerge as one of Britain’s major coastal cities. There will be significant infrastructure investment in our transport network and in a new centrally­located secondary school as well. At the same time we must ensure that our valued heritage is protected, and this week we took the first steps towards placing our Royal

Pavilion and our museums in a trust that will have greater freedoms to draw in the funds needed to protect and invest in our cultural assets. These projects will deliver thousands of jobs, create new spaces for businesses, restaurants and retail, draw in millions of pounds in rent and business rates to fund council services, and boost our tourist and visitor economy. Many of these projects will between them provide thousands of new homes, adding to the money we earn in council tax to help pay for some of the local council services facing cuts of over £160 million from central government. We cannot stand by and see Brighton and Hove decline and decay. Our city has always changed to meet the challenges of the times, whilst retaining its culture and heritage. Even as we face a 30% cut in our funding, we must ensure we innovate, compete and prosper as a city, and that the benefits of that prosperity are shared by all. warrenmorgan.wordpress.com

T

his week we look at enforcement. It is not exactly a big­ ticket item but it does affect each and every one of us in ways we can never imagine. We have all sat down at some point and asked: ‘If someone builds something that is different from what they got planning permission for, does that mean enforcement action will be taken automatically?’ Or ‘If someone breaks planning regulations shouldn’t they always be punished and made to remove or stop whatever they have done?’ No matter what you believe, the answer is, unfortunately perhaps, in both cases ‘no’. Enforcement action is normally taken against an unauthorised building if it was considered to result in an unacceptable harm by the Council. Additionally, carrying out building works without the necessary planning permission is not a criminal act and, initially, not subject to penalties such as fines or imprisonment. With that in mind, does planning law mean some people who break the regulations get away with it? The objective of planning enforcement is generally not to punish those who break the regulations but to remedy any harm caused by unlawful actions. However, people who do not get the necessary planning permission for something they are doing risk the possibility of serious consequences from enforcement action that can be extremely costly. We’ve all read the story of the farmer, the aptly named Mr Fidler, who built a mock Tudor castle in Reigate and Banstead behind hay bales and was threatened with prison unless he demolishes it. The council ruled out allowing the castle to stay because it breached national and local planning rules designed to protect the green belt. www.samerbagaeen.com

... and how to avoid them

O

ne of the biggest difficulties that landlords face is that things change fast. You sometimes feel like you are running just to keep up. • Rents rise and rents fall • In­demand areas suddenly become hard to find tenants for • Property prices yo­yo and the Stamp Duty burden gets heavier • Interest rates change • Compliance demands increase It’s a stormy sea that landlords must navigate to reach the distant shores of a return on their property investment. Damage and arrears Yet within these turbulent waters there are two very large rocks that have always been there as a danger for landlords. To our left we have the ominous ‘damage to my property’ and to our right, looming as large as ever, is ‘rental arrears’. Landlords’ costs are landlords’ losses A recent annual survey by Access Legal of 2,000 landlords has highlighted just how significant these two concerns remain for landlords. It suggests that the main landlord concerns are increasing upkeep costs and tenants not paying rent arrears, often even after court proceedings. The survey goes on to estimate that: • £9.9 billion is spent on damage, repairs and rent arrears by landlords every year • £4.5 billion is for damage to properties • £900 million is the cost to landlords of covering unpaid rent What this amounts to is that every landlord in the UK is losing an annual £6,600 to cover costs related to these two areas. Guaranteed rent is guaranteed income It was to address these concerns that I set up my Guaranteed Rent Scheme. I understand that landlords often have busy day jobs and just want to let their property and forget their property. They don’t want to keep pace with all the changing demands placed on them. So, I offer to deal with all of them, from tenant checks to day to day maintenance and compliance. I also understand that rent arears and property damage are 13 | LATEST HOMES

costly concerns for landlords. I would add to these, from talking to landlords, void periods, which was not explicitly picked up by this survey. ne in ten private landlords do not have a formal tenancy agreement in place with their tenants and many more could be relying on contracts that are not legally compliant. New research by Direct Line found ten per cent have no document whatsoever, while a further 58 per cent of those who do not use a letting agent choose to rely on an updated tenancy agreement from an old agent and 20 per cent have signed a contract they found online. Such contracts, even if they are signed in good faith by both the landlord and the tenant, may not be legally compliant. Using the services of such an agent is also the best way for landlords to guarantee they have complied with the law at every stage.” A failure to draw up a bespoke and legally compliant tenancy agreement can leave both parties vulnerable and potentially lead to disputes between landlords and their tenants.
