PROJECT BRIGHTON > Fiona Martin, of Martin Searle Solicitors, discusses their campaign to end disability discrimination in the workplace

T

hroughout October, Martin Searle Solicitors were campaigning to end disability discrimination at work by providing a free telephone advice service for employers and employees concerned about their workplace rights or obligations. Martin Searle Solicitors are committed to equality in the workplace and their regular campaigns highlight the discrimination still faced by certain groups such as women taking maternity leave and those with disabilities. Fiona Martin, Head of Employment Law at Martin Searle Solicitors, says: “It says a lot about the poor state of our working culture that disability discrimination is still a common feature. This is partly due to employers’ lack of knowledge about their duties to make Reasonable Adjustments. “We are also seeing employers cynically targeting employees on long term sick leave who are benefiting from full contractual pay. HR Departments are dismissing, without following a fair ill health capability process and fully aware that they are not fulfilling their legal obligations, in order to save money.” Martin Searle Solicitors’ employment law team are concerned that discrimination is particularly rife in relation to mental health issues. Mental illhealth often goes unspoken and unacknowledged with work colleagues and HR 4 | LATEST HOMES

departments likely to be more open about physical ailments than they are about discussing mental health issues. Referring to someone’s mental health can be seen as a criticism or inference that someone is weak or unstable. Depression and conditions such as bipolar disorder are ‘hidden’ because to admit to suffering from these conditions may mean facing social stigma and even workplace discrimination.

“ Many mental health conditions are invisible, they meet the disability criteria under the Equality Act 2010 ” While many mental health conditions are invisible, they meet the disability criteria under the Equality Act 2010. This is a physical or mental impairment which has a long term, substantially adverse effect on the employee’s ability to carry out daytoday activities. Proper assessment of such impairments not only provides employees with protection from discrimination, it also informs employers about Reasonable Adjustments they should make to overcome the disadvantages disabled workers experience at work on a weekly basis and this appears to be increasing since the introduction of Employment Tribunal fees. Some employers may be aware that fees deter employees from bringing claims. LATEST TV | VIRGIN MEDIA 159 | FREEVIEW CHANNEL 7

However, what they are not factoring in is the drop in morale when other employees’ see their vulnerable colleagues treated unfairly.” Fiona continues: “Equality in the workplace underpins good employment relations and ensures fairness. Employment disability legislation has been put in place to provide an ‘equal playing field’ so disabled people are not disadvantaged.

“ Equality in the workplace underpins good employment relations and ensures fairness ” Unfortunately, this legislation is being ignored. “Stereotyped views, where disabled employees are viewed negatively, ignores the fact that many of us may become ‘disabled’ at some point in our working life, whether this be through physical injury or mental health problems, such as anxiety and depression. Their employment team know from experience, that with proper support and Reasonable Adjustments, most employees continue to be valuable members of staff. For free and confidential advice on disability rights and obligations, employers and employees can call Martin Searle Solicitors’ disability legal helpline on Mondays and Thursdays throughout October from 4pm to 6pm on 01273 609911, or email info@mssolicitors.co.uk.

CITY PLANNER > More schemes but nothing built Samer Bagaeen MRTPI FRICS

T

his is another one of my columns about the future shape and form of our city & region. Newspaper headlines are telling us of more schemes that will never see the light of day. The Argus, on October, 19, has two: one is about a £795m scheme set to create thousands of new homes and jobs; the second about opposition to the development. Developers Lightwood Strategic, have again proposed new plans for 45 homes on the Downs border site of Meadow Vale in Ovingdean. Can they succeed this time round? Kemptown MP’s are already against it.

“ The government appoved a fracking scheme up north, won’t be long until that happens down here ”

At least the weekend pedestrianisation of East Street on Saturdays and Sundays is to be made permanent, following a successful trial. That made the papers on October, 14. This same date brought us the news that Eastbourne was about to start the £44m work on the arts and tennis centre. The Government approved a fracking scheme up north on October, 6. Won’t be long before that happens down here. Headlines on September, 30, told us that the £100m regeneration scheme of Circus Street is now almost a year behind schedule and has stalled, almost two years after planning permission was first given. September, 21, came with a headline about the £280m road scheme that will shave six minutes off the time of a journey on the A27. One local MEP wanted the money spent on sustainable transport options (?) and the local council’s environmental and community services select committee refused to back it! www.samerbagaeen.com, @samerbagaeen LATEST TV | VIRGIN MEDIA 159 | FREEVIEW CHANNEL 7

THE ISSUE

A CLEAN SWEEP > The back end

W

e spend a lot of time here explaining how important it is to make sure that your home is presented looking its best if you are planning to sell or let it. All of it is true – and especially at this time of year. Yes, the hour has gone back, the daylight hours are shorter and things are looking, well let's say they are looking less pretty at this time of the year, and particularly outside. Inside you can make things look good by following our previous advice on lighting things up. Once again, go round every room and check that all your lights are working and turn them all on. Outside things are different. Leaves are falling, plants are dying or dying back and there is a good chance that everything will be wet. First job is to pull up and get rid of anything that is not meant to survive over winter. Dead plants give an impression of neglect and decay so out with them. Second job, cut back

“ Get rid of anything that is not meant to survive ”

anything that is getting straggly and out of hand. If you are not sure then ask a gardening friend or take a look online, trim and tidy is the key here. If you, or your neighbours, have trees then your biggest problem is going to be autumnal leaves. Get that broom out and sweep them up, compost them if you can and bag them up if not. The longer you leave leaves on the ground at this time of year the more likely they are to create a mess. Remember that rotting leaves can very quickly stain paving and decking so get rid of them, even if this means a daily sweep up. A good sweep of any decking is not a bad idea either and it might help to hold back that green blight that can strike as the weather gets wetter. This of course applies to both the front and the back of your house, remember that kerb appeal really counts. Trees in the street can be an ongoing problem in autumn and sweeping up is the only answer, but don't just sweep onto your neighbour's frontage, or into the gutter where they can block the drains, bag them and get rid of them. Burning them is a bad choice too, bite the bullet and bag 'em. Oh and while you’re at it, check any garden lighting is working – and turn it on. Show off your garden spaces no matter how small and do it with style.

n Friday 28th October, His Royal Highness The Duke of Edinburgh officially opened British Airways i360. His Royal Highness took a flight on the observation pod before unveiling a plaque in our beach building and signing the Visitors’ Book to commemorate the occasion. The construction of the BAi360 has been a great example of British design and engineering, which is something that Prince Phillip has always @Eleanor_Harris championed. His Royal Highness is officially involved in more than 25 engineering institutions worldwide, including the Royal Academy of Engineering and the Institution of Structural Engineers. He chaired the judging panel for The Prince Philip Designers Prize for over 50 years, which rewarded the innovation and creativity of designers and engineers shaping daily life.

“ We are hoping to inspire the next generation of engineers ” With an overall height of 162m and an observation pod that rises from ground level to 138m above Brighton beach, British Airways i360 is a feat of engineering, which already holds the Guinness World Record for the World’s Most Slender Tower, with a diameter of just 3.9 meters at its widest point. It is the world's first vertical cable car and world's tallest moving observation tower. Our chief engineer John Roberts was President of the Institution of Structural Engineers 19992000 and awarded the Gold Medal 2005. John has given talks to engineering students at Brighton University. We are hoping to inspire the next generation of engineers and will be launching schools curriculum material later on this school term focused on maths, science and technology. CUSTOMER SATISFACTION > There's no sitting still for Phillips & Still

W

alk along any street in any town or city and look in the windows of estate agents, one unifying factor will soon become apparent. Estate agents are proud of what they do, proud of what they achieve and proud to tell us so. And why would they not, we are all proud of our achievements and accolades. This is why agents are keen on their industry awards and who can blame them. Right now Brighton agents Phillips and Still are very proud to have received no less than five new awards. These awards have come from the website allagents.co.uk, so we went along to ask Chris Still and business partner Richard Phillips why they are so delighted. Chris explained “There are many many awards out there and they are all very important indicators of a company's standing within the business. Why we are so pleased with these particular awards is that they are voted for online by customers, both buyers and vendors who feed back their personal experiences to the website. To be given these accolades by the public feel very special and we see it as an indicator that we are doing things right.” In the 2016 awards Phillips and Still were given five. Chris Still won the allagents.co.uk Gold People's Award for customer experience in BN1 and Richard won the silver award again for BN1. They also won Best Estate Agent in Brighton, Best Estate Agent gold for customer experience and a Silver award for Best Estate Agent in East Sussex. 8 | LATEST HOMES

Both Richard and Chris are very pleased to have gained this recognition and share in that achievement with their team Jason Bolze, Alice King and Sanaz Baheran. It's an independent and happy team and there is a definite sense of teamwork and a relaxed but professional atmosphere in their central Western Road office close to Norfolk Square on the border of Brighton and Hove.

“ No less than five new awards ” The awards are of course great news but how do they feel about the current property market? "Things are in fact better right now than we might have expected' says Richard. "The market is certainly different but that is not necessarily a bad thing. We are finding that people are being very realistic about pricing. If anything we have to manage people's expectations of what their property is likely to achieve. And of course if prices are not rising fast for vendors, it also means that when they come to buy the price that they will have to pay is equally uninflated. We are very honest with vendors and give them our reasoned and reasonable valuation of what they should achieve, at the end of the day it is their choice. Last year sales moved very fast, we were seeing properties come to market and sell in two weeks whereas now it might take one to two months." LATEST TV | VIRGIN MEDIA 159 | FREEVIEW CHANNEL 7

008_009_LH803_PhillipsStill_Layout 1 28/10/2016 13:31 Page 2

"Yes" adds Chris "But we should also say that whilst a vendor may not see massive numbers of buyers at viewings, those buyers that are out there are on the whole serious buyers who really are in the market to busy and have the finances in place. Fewer buyers, if those buyers are serious, leads to fewer disappointments." It's great to talk quite so frankly with two property pros who are being so honest about how things are right now. And it's not based on disappointing performances over the last few months but on a good continuing record of successes. "We have a good number of properties on our books right now and a good number of enquiries to view them." So what does make Phillips & Still stand out? We liked the smart but informal approach that they use, friendly and fair. They are hard working too and at least one of the two directors will always be on hand, even at weekends. They have also just launched their brand new website, www.phillipsandstill.co.uk. "We have invested in making it easier to use, user friendly, and we offer free online valuations to give vendors a ball park price – with no commitment!

“ They are hard working too and at least one of the two directors will always be on hand ”

"We are also exclusively sales, we believe in that focus and giving our full attention to the sales market and our customers. We like to see ourselves as businesslike but informal, less corporate than some of the larger chain national agencies. Staying focused and retaining our independence means that we can be friendly and informal. And we are the decision makers. We never have to refer to people in offices nationally who may not even understand the local market." So do they have plans to expand? "We're driven and ambitious yes, right now we are happy with where we are, what we are doing and how we do it – but watch this space!" 01273 771111 westernrd@phillipsandstill.co.uk

A five star review Chris & Richard are truly excellent at what they do. They're both consummate professionals and are always onhand to offer help, support and advice. Throughout our purchase they've been a pleasure to liaise with, and go above & beyond what one would normally expect from an estate agency. I've already recommended them to friends & will continue to do so. Thanks again guys! Ed Isaacs LATEST TV | VIRGIN MEDIA 159 | FREEVIEW CHANNEL 7

For the Allsop family, their dreams were made true by DMB Solutions

M

itsie and Marc Allsop moved into their Hove home five years ago. Their search for a new home had proved to be a long journey. They had looked at over 40 properties before being shown their current home, and on first glance they were ready to reject it along with the others. Mitsie tells the story: “From the front it looked so tiny, a new build in a very traditional cottage style. To be honest we were about to dismiss it, despite it ticking so many of the boxes that we wanted ticked, especially the lovely secluded location that was still so close to the city centre. When we walked inside, though, we knew right away that this would be our new home. With four bedrooms, a garage & vast amounts of really unexpected living space it was perfect for us all. “We have lived here for about five years now, and happy as we were with the property we had always thought about expanding the living area in a quite dramatic way. “The property already had a conservatory across the back but that was not really what we wanted – we had a vision of a large open space that retained the height and opened our home right up onto our garden. The conservatory we realised wasn’t functional, but we were also aware that as the property is in a conservation area there would be both restrictions and challenges. But that said, we had our hearts set on getting rid of the conservatory and having that one big, open space.”

10 | LATEST HOMES

Having decided exactly what they wanted, and with a clear vision and a determination to get exactly that, they set about finding a builder who could do the work for them in the way that they wanted it done, and to their exacting standards. It proved to be a difficult task.

Most impressively everything came in absolutely on budget, we were blown away by that

“We saw a string of builders but the answer was always the same. What we wanted was not going to be possible, the engineering was impossible, the steels required would be too big; all in all, they sought to offer us a compromise.” Compromise was not, however, part of the Allsop vocabulary, and they continued to search. Eventually, Marc found DMB Solutions by looking at websites for local building companies. “We met with James Powell of DMB and immediately knew that he could see the potential that we could see. He came out and looked at the space and did a proper survey, he got an engineer involved and very soon they said that they could achieve what we wanted and for a better budget and offering far better value. We saw that James has a great sense of how a space can work and excellent design ideas. He managed to find a way to retain the height of the space by modifying the structural engineering – in simple terms, he managed to find a way to give us what we wanted and make that dream come true.” So did DMB undertake the whole process? “They did all of the structural work, plastering, flooring and the decor. We already had people that we wanted to use for the garden decking outside and the built in furniture, and to their credit DMB worked with those companies very openly and very well, to get the very best result for us. I'm not sure that you would get that kind of co operation from most builders. They made the whole process as seamless as possible.

“In terms of schedule, there were one or two hold ups, but even with Christmas on the horizon they pulled out all the stops to make sure that we had a comfortable living space in which to enjoy the holidays. “Up until then of course we basically had to live upstairs, as the works were on such a large scale, with the giant steels having to be lifted by crane over our roof and into the garden behind. “They were excellent, too, at keeping us updated weekly with progress reports, and sent an email schedule and plans for the upcoming days. They were very open in those progress reports and never hid away any possible delays. “Most impressively, everything came in absolutely on budget and we were blown away by that. You always have a contingency plan but the fact that we didn’t need to use it meant that we could really have what we wanted when it came to the builtin furniture and the quality decking. “We had seen testimonials and pictures of work DMB Soutions had done on their website and we were impressed by that – but now having had them work in our home we are more than impressed. It’s a great team and you need that as you have to live with them, every day, for months. They were respectful of our privacy and our home, they worked cleanly and we really felt that we could trust every one of them. “The moment we got word that they could start we also got the news that our youngest son could have some much needed surgery.

They were wonderful with him, and given the needs of a three and a half year old who had just had both legs in full plaster casts and could not walk, they were so lovely with him, and we were so glad that we did not postpone the work – or the surgery. “All in all we are thrilled with the result. James Powell and his team of professionals at DMB Solutions have delivered our vision to a standard, a budget and a time scale that is truly impressive.” Impressive it is, too. The work has clearly been executed to a very high standard with no compromises to that clean lined vision. It is a masterpiece of modern building that blends seamlessly into the existing structure, looking for all the world like it is part of the original design. Beautiful bifold doors open right back to engage the interior with deck and garden beyond. A large modern hearth offers another focal point and the large Lshaped space is versatile; space to lounge, to dine, to play and to simply relax looking out onto the garden. It is, in summary, a very beautiful home occupied by a very happy family. DMB Solutions, 48 Borough Street, Brighton, BN1 3BG 01273 777459 dmbsolutions.co.uk

JUST HOW GUARANTEED IS YOUR RENT? > Ahmed Khalil explains how Khalil Properties can offer rent all year round Guaranteed rent: it sounds too good to be true, doesn’t it? Especially if it is guaranteed with no void periods, no prospect of rent arrears, no commission to pay, no agency setup or renewal fees and no need to deal with tenants or ongoing maintenance. Yet, this is exactly what my Rent Guarantee Scheme offers you. It takes all the insecurity and hassle out of renting your property. Let me explain how it works. • I lease your property for a flexible period of between three and five years. • During this time I guarantee your rent will be paid on time every single month – regardless of whether your property is occupied or not. • I’ll deal with the day to day maintenance of your property and every aspect of tenant relationships. • At the end of the lease you’ll get your property back in the same condition as it was at the start.

It’s that simple. But when I explain the concept to landlords I am often asked just how guaranteed the rent will be. The answer is 100% guaranteed. There really are no fees or hidden costs. The problem is, you see, that there are other schemes with similar names that sound the same but offer something completely different. One such example is the widespread ‘offer’ of guaranteed rent insurance. This is an insurance product that promises to pay out if your tenant does not. Its cover and benefits, though, fall far short of my guarantee. Let’s put them head to head so you can see what I mean. Guaranteed Rent Insurance versus Khalil’s Rent Guarantee Scheme Rent Guarantee Insurance Monthly premiums Covers individual tenancies but not void periods An excess is usually applied Can take up to three months for pay out The landlord retains responsibility for property maintenance Legal compliance and disputes are the responsibility of the landlord Khalil’s Rent Guarantee Scheme No fees Guarantees no void periods Every month’s rent is paid regardless Rent is paid on time every month – and starts as soon as the contract is signed (rather than when the first tenant moves in) Property maintenance, such as electrics, plumbing and handyman work, is covered and carried out at no extra cost Ongoing gas safety checks are covered, as are legal fees and court attendance should eviction be required As you can see not all rent guarantees are the same. If you are looking for a way to rent without risk, and let without loss, then give me a call today and guarantee yourself an income without encumbrances. For more information call Ahmed Khalil on 01273 573960, visit Khalil Properties at 124 Lewes Road, Brighton, BN2 3LG or find us online at www.khalilproperties.co.uk.
