FROM POST-SOVIET TO N EW EU ROPE LVIV LEADS UKRAINE'S HISTORIC TRANSITION

wenty-two years ago this month, I received a letter that changed my life. The news it conveyed was at once exhilarating and intimidating – a job offer with the British Council in western Ukraine. At the time, I was a history student in my final year at Liverpool University with vague notions of a future career in international relations. The opportunity seemed too good to be true, despite the fact that I knew little about Ukraine and had never even heard of Lviv. The few cultural reference points available to me were all rooted in Cold War stereotypes of totalitarian terror, drab conformity and bread queue misery. Needless to say, I was in for quite a surprise. When I duly arrived in Lviv four months later, I was staggered by the fairytale beauty of the city and fascinated by the turbulence of an entire society undergoing fundamental change. Back then, Lviv was a somewhat dark and brooding place that often felt as if it had leapt straight from the pages of a Gothic novel. It was impossible not to be enchanted, but there was also a strong sense of a lost city in search of itself.

This coming month, I have the pleasure of welcoming some of my old Liverpool University friends to Lviv. The city they will encounter is a very different place to the 1990s

vintage I first discovered. It is still as elegant and aristocratic as ever, but today’s Lviv also boasts a sparkling vibrancy that was altogether absent during those early post-Soviet years of economic gloom and identity crisis. Once a forgotten backwater on the fringes of an extinct authoritarian empire, the city has become the swaggering standard-bearer of Ukraine’s European integration ambitions. The Russocentric clichés of old are long gone, replaced by a quintessentially Mitteleuropa vibe that underpins one of the most exciting tourism industries in the entire region. Evidence of this historic transformation is everywhere. Lviv’s once ramshackle city airport is now among the fastest-growing air hubs in Eastern Europe. Dining out is no longer a matter of choosing between the same handful of semi-plausible restaurants. Instead, the Leopolitan gastronomic scene is expanding at such a blistering pace that it is literally impossible to keep up. Meanwhile, foreign faces have lost their novelty value. Back in the 1990s, Lviv’s expat community was small enough to fit into a single bar (and often did so). Today, the city boasts one of Ukraine’s largest international business communities. This cosmopolitan collection of investors, IT innovators, executives and entrepreneurs rubs shoulders with flocks of tourists

from across the EU and beyond. Contemporary Lviv is both emphatically foreigner-friendly and strikingly self-confident. These changes are not merely skin-deep. They reflect a city coming of age in a country that is finally emerging from the Soviet shadows and finding its voice on the international stage. The challenge now is to maintain this momentum. Ukraine’s integration into the European community of nations is still very much a work in progress that will continue for generations to come. As Ukrainians seek to reconnect with the wider world, they need look no further for inspiration than Lviv. встрійський диригент, композитор та імпресаріо Маттіас Кендлінгер добре відомий в світових музичних колах як засновник і організатор оркестру K&K Philharmoniker, балету K&K Ballet, Українського національного хору Львів, а також фестивалю Tiroler Beethoven-Tage. Створені ним колективи з величезним успіхом виступають на сценах найкращих концертних залів Європи – Парижа, Берліна, Копенгагена, Мадрида та у знаменитому Wiener Musikverein. Маттіас Кендлінгер народився в австрійському Тіролі 1964 року. Він виступав з концертами по всій Європі до 1994 року, а потім вирішив заснувати власну музично-маркетингову компанію DaCapo. ustrian conductor, composer, and impresario Matthias Kendlinger is the man behind the K&K Philharmoniker, the Austrian K&K Ballet, Ukrainian National Choir Lviv, and the Tiroler Beethoven-Tage. His ensembles have earned him rapturous “bravos!” and standing ovations at some of the finest concert halls in Europe, including in Paris, Berlin, Copenhagen, Madrid, and Vienna’s famed Wiener Musikverein. Born in the Austrian state of Tyrol in 1964, Kendlinger began on the accordion at the age of five. He performed across Europe until 1994, when he founded his DaCapo musicmarketing firm. In 1997, he was instrumental in establishing the Tyrolean Festival Erl, renowned for its interpretations of Wagner. He made his move to Lviv at the turn of the century and formed the K&K Philharmoniker and Ukrainian National Choir Lviv. Since its inception, the K&K Philharmoniker has produced several live CDs from the hundreds of concerts they give each year across Europe. The illustrious Ukrainian National Choir Lviv has spawned the careers of many esteemed soloists and continues to delight audiences at opera festivals across the continent. They’ve even been invited by the Pope to perform at the Vatican! Kendlinger made his debut with the baton at the Leipzig Gewandhaus in 2004 and has become an acclaimed conductor, including standing ovations in renowned halls like Paris’ Mogador Theatre. One of his earliest pieces to gain attention was his symphonic version of ‘Der Verlorene Sohn’ (The Lost Son), which premiered at the Gewandhaus in 2006. He moved to the Musikverein in 2007 and the Mogador in 2008, before premiering his ‘Prasident Obama-Marsch’ at Berlin’s Konzerthaus in 2008. His extensive discography includes recordings of Beethoven, Dvorak, Tchaikovsky, Orff, Wagner, Strauss, and some original works.

Сьогодні це один з найпопулярніших оркестрів Європи, який планує свій графік виступів за два роки наперед, і продовжує виступати на найбільших музичних сценах понад 100 раз на рік. His K&K Philharmoniker celebrated its 15th anniversary in Lviv in 2017 with a jubilee concert. Since becoming one of Europe’s hottest ticket orchestras, the group now books its schedule two years in advance, allowing them to continue to perform on the biggest stages over 100 times every year. Kendlinger brings his orchestra home to Lviv several times each year and even created his own Matthias Kendlinger Music Festival to coincide with the group’s 15th anniversary in 2017. Leopolitan classic music lovers and guests of the city are always delighted by performances by the K&K Philharmoniker, the K&K Symphoniker, and the Ukrainian National Choir Lviv, and will be pleased to see all these groups at the third edition of the Kendlinger Music Festival which will take place during 9-13 July.

EURO 2020 QUALIF YING IN LVIV 7 & 10 June at 21:45 at Arena Lviv (199 Stryiska St.) The Ukrainian national football team is returning to Lviv after a strong start to the EURO 2020 qualifying tournament. Ukraine currently leads Group B after a two-game road trip that saw the team beat Luxembourg and draw Portugal. Lviv hosts the Serbian national team on 7 June and Luxembourg on 10 June. Both games are at Arena Lviv and will start at 21:45. Ukraine has made the EUROs

three times, including the last two tournaments. Lviv hosted games when Ukraine cohosted in 2012 and Lviv was the site of the national team’s crucial playoff win against Slovenia to qualify for EURO 2016. In fact, the national team has never lost in the Western Ukrainian capital, winning 14 games and drawing twice. The road to EURO 2020 looks good for Ukraine – even if the team falters

in Group B against Portugal, Serbia, Lithuania, and Luxembourg, Ukraine is in a prime position to qualify through the Nation’s League, after winning their League B group last year against Czechia and Slovakia. ВІДБІРКОВИЙ ЕТАП ЄВРО 2020 У ЛЬВОВІ 7 і 10 червня о 21:45. Стадіон "Арена Львів" (вул. Стрийська, 199) Збірна України з футболу повертається до Львова після сильного старту в кваліфікаційному турнірі Євро-2020. Україна зараз є лідером групи B після двох ігор на виїзді – з перемогою над командою Люксембурга і нічиєю з командою Португалії. На стадіоні "Арена Львів" 7 червня відбудеться зустріч з національною збірною Сербії, а 10 червня – з командою Люксембурга. Початок обох матчів о 21:45. Наша збірна виступала у

чемпіонаті Європи тричі, включаючи два останні турніри. У Львові вже проходили матчі Євро-2012, і Львів став місцем перемоги національної збірної над збірною Словенієї, що дала можливість претендувати на ЄВРО-2016. Цікаво відмітити, що наша збірна жодного разу не програла на львівському полі, виграла 14 разів і двічі зіграла внічию. Шанси української збірної на Євро-2020 виглядають добре – навіть якщо команда зустрінеться з

проблемами в групі B у матчах проти команд Португалії, Сербії, Литви та Люксембургу. Lviv’s long and proud motoring heritage dates back to 1930 – before the city was even part of Ukraine – when an international Grand Prix was held in the city. That’s why the ZAZ-Kozak Zaporozhets automobile club decided to bring back the Leopolis Grand Prix festival – an international festival of vintage cars and races. The original closed-circuit race was organised on a track that is still known as the ‘Lviv Triangle’, from Vitovskoho to I. Franko to Stryska and Maidan Heroes. Known as one of the most difficult tracks in Europe due to its considerable elevation and cobblestone surface, the GP attracted some of Europe’s top teams.

Unfortunately, the original GP was canceled in 1934 due to the economic and political crisis of the time. This year, the Leopolis Grand Prix festival will feature not only the races around the ‘Lviv Triangle, but plenty of other events, including a classic car show at the B. Khmelnytsky Culture & Recreation Park, a parade of vintage vehicle through the city centre, cool contests like ‘Most Elegant Driver’, concerts, and entertainment for the kids. Львів завжди був європейським містом, і технічний прогрес його не оминав, тож коли у Монте Карло 1929 року відбулись перші перегони автомобілів вулицями міста, у Львові теж вирішили не відставати й організували кільцеві перегони, не гірші й не простіші, ніж на Лазуровому Березі (!). Lviv’s popular Pravda Beer Theatre is sponsoring the two-day Brewers and Restaurateurs Summer 2019 Forum in Lviv from 18–19 June. With brewers, brewing technologists, restaurateurs, beer traders, brewery heads, and beer equipment manufacturers from around Ukraine and Europe, the forum is a great networking opportunity for chefs and beer lovers alike. The Children’s KinoFest is an annual festival of international films designed to support the creation and discussion of thoughtful, provocative, and intelligent film for youth aged 4-18. Since its inception in 2014, Children’s KinoFest has become the largest and most respected film festival in Ukraine specifically dedicated to children and their families. Each year children’s films from dozens of countries reach more than 40,000 people through festival screenings in Kyiv and a tour of 20 Ukrainian cities, including Lviv. This year’s festival will take place from 31 May – 9 June. The festival will open with Colin McIvor’s family film ‘Zoo’, a story of animals being rescued from the local zoo in Belfast during WWII. The film was named Best Family Film by a youth jury at the Seattle International Film Festival. Another highlight will be the Swedish horror movie about ghosts, ‘Room 213’, named the top children’s film at the Toronto International Film Festival. Young viewers might be interested in one of the two cartoons being screened, including ‘The Stolen Princess’ and ‘Pipi, Pupu, and Rosemary: The Mystery of the Stolen Music’. A special event at this year’s event will be the screening of the classic comedy ‘The Circus’ to honour the 130th anniversary of the birth of Charlie Chaplin. As part of the event, the Top 10 finalists for the children’s short film will be screened in front of a jury vying for the chance to win prizes between 5,000 and 20,000 UAH. As always, the festival will close with the winner of last year’s Grand Prix – ‘Guard Outpost’ by Ukraine’s-own Yuriy Kovalyov. The UnderHill Music Festival combines modern electronic and pop music from artists from around Ukraine and across Europe. Located in the village of Pidhirya in the Ivano-Frankivsk region, the UnderHill Festival will dazzle attendees over the 15–16 June weekend with three scenes: UnderDay, UnderNight, and UnderGround. Some of Ukraine’s biggest artists will grace the stage, including Dzidzio, Skai, Druha Rika, Olya Polyakova, and Boombox. Під Дубом, 7Б) Дитячий кінофест – це щорічний фестиваль міжнародних фільмів, метою якого є підтримка створення та обговорення продуманого, провокаційного та інтелектуального кіно для дітей та юнацтва віком 4–18 років. З моменту свого створення у 2014 році, "Дитячий кінофест" став найбільшим і найповажнішим кінофестивалем в Україні, присвяченим дітям та їхнім родинам. INTERNATIONAL MUSIC FESTIVAL “VIRTUOSOS” 16 May – 9 June at the Lyudkevych Concert Hall at Lviv National Philharmonic (7 Tchaikovsky St.) and venues around the city Lviv is famed for its many musical festivals and this year the city will delight music lovers with another edition of the Virtuosos Academic Music Festival. First launched in 1981, this classic music festival remains a highlight of Western Ukraine’s cultural calendar. Wednesday, June 26 15:00 – Florian Favre Trio (Switzerland) Florian Favre began classical piano training at the age of eight. His father composed for a brass band, so Favre didn’t discover blues scales – which led him to jazz – until he was 12. With his nimble fingers, charm, and musical candour, Favre has already earned a firm place in Swiss jazz. Alongside Manu Hagmann on bass and Arthur Hnatek on drums, he formed his trio in 2013. Their sound has surprising twists, lyrical passages, and rhythmical sensitivity, making their performances a perfect mix of playfulness and accuracy, juvenile verve, and worldly-wise confidence.

17:00 – Be 4 Quartet (Lithuania) The Be 4 Quartet features saxophonist Kestutis Vaiginis and bassist Domas Aleksa, keyboardist Tomas Dičiūnas and prcussionist Augustas Baronas playing their own original mix of modern jazz and world classics seasoned with experimental electronica. Their music includes catchy melodies, Latin, and African rhythms, each reflecting the dynamism of the modern world. Each of the group’s musicians are famed in Lithuania and abroad due to their solo and collaborative work on many other projects.The concert will be conducted with the support of the Embassy of Lithuania and the Lithuanian Honorary Consulate in Lviv.

Renaud Garcia-Fons is a French double bass player and producer also known as the Paganini of the Double Bass. He added a fifth string to the instrument, revealing new possibilities to display his virtuosity. In Lviv, Garcia-Fons will present a project that will take listeners on a journey from the melodious Paris of the past to the restless and cosmopolitan Paris of our times. The program will present waltzes, ballads, jazz, and classical music in modern arrangements. The concert will be conducted with the support of the Embassy of France, French Institute, and Alliance Francaise in Ukraine.

Saxaphonist and composer Amit Friedman is one of the leading jazz musicians in Israel. His music is based on jazz traditions and infused with elements of Middle Eastern music. His ear-catching compositions combine sophistication and simplicity. He has recorded three albums to date – ‘Sunrise’, ‘Long Way to Go’, and ‘Unconditional Love’ – and continues to teach and popularise jazz among youth. The concert will be held with the support of the Embassy of Israel.

Thursday, June 27 15:00 – Month of Sundays (Austria) The Month of Sundays have crafted a sound that is both eclectic and refined. The quartet was founded in Vienna in 2013 and creates contemporary chamber music. They are currently working on their second studio album, ‘Time and Ruins’. Combining minimalism, post-rock, and jazz, their songs reflect attention to detail and focus on the thoughtful coordination of musical content and form. The concert will be held with the support of the Austrian Cultural Forum in Kyiv and representative offices of OeAD in Lviv.

17:00 – TNMK – Jazzy DeLuxe (Ukraine) TNMK, or Tanok na Maidani Kongo (Dance on the Congo Square), is Ukraine’s most successful hip-hop group. They are known for their clever lyrics, mixing hip-hop with rock, funk, and jazz, and playing real instruments on their albums and at their shows, instead of using samples and drum machines. TNMK has performed at some of Central and Eastern Europe’s biggest concert festivals, including Sziget, Zakhid, Tavria Games, Chervona Ruta, Faine Misto, Bandershtat, and now Leopolis Jazz Fest.

Saturday, June 29 15:00 – Claudia Campagnol (Denmark) Claudia Campagnol is a talented singer, multi-instrumentalist, and composer. Her music is a mix

of pop, R&B, jazz, and soul. She has worked with stars like Stevie Wonder, John Blackwell, Peter Bernstein, and Nils Landgren. Her debut album, ‘I’m Strong’, was released this spring and features stars like bassist Jimmy Haslip, drummer Winnie Coliut, and trumpeter Gerard Presener. The concert will be supported by the Embassy of Denmark.

17:00 – Klein (Luxembourg) After playing the sideman in many bands, Jerome Klein decided to create his own group – Klein. His new group features an array of contrasts in a minimalist setting, slipping into a misty mood of melancholy and dark tones. In this almost pure setting, his music surprises with loud splinters of light, explosive energy, and even euphoria.

Saturday, June 30 15:00 – Ayse Tutuncu Quartet (Turkey) Ayse Tutuncu is a Turkish pianist whose work represents a beautiful synthesis of jazz, traditional Turkish music, Western rock, and classical. Since starting with the band Mosaic in 2004, she has released four studio albums, including the 2005 disc ‘Carnivalesque’ on the EMI / Blue label. Her program will consist primarily of original compositions, with some songs by the band’s other musicians. The concert will be held with the support of the Embassy of Turkey and the Yunus Emre Institute.

17:00 – Djabe (Hungary) Djabe is a fusion band from Hungary. Since it was founded in 1996, the band has performed in 42 countries around the world and won many international awards. The group’s last three albums were released by British label Cherry Red Records to considerable global success. Since 2003, they regularly collaborate with popular progressive rock guitarist Steve Hackett, best known for his days with the iconic English group Genesis. Середа, 26 червня 15:00 – Florian Favre Trio (Швейцарія) Флоріан Фавр почав свою класичну фортепіанну підготовку, коли йому було вісім років. Його батько писав музику для духового оркестру, тому хлопець не знав про існування блюзу, який привів його до джазу, аж до 12 років. Але далі все пішло, як треба, і юний Флоріан своєю чарівністю і музичною відвертістю впевнено посів своє місце у швейцарському джазі. Разом з басистом Ману Хагманном та ударником Артуром Гнатеком він створив власне тріо 2013 року. Їх звучання має дивовижні повороти, ліричні пасажі і ритмічну чутливість, що робить їхні виступи ідеальним поєднанням грайливості і точності, юнацької впевненості та життєвої мудрості.

Квартет був заснований у Відні 2013 року і виконує сучасну камерну музику. Зараз вони працюють над своїм другим студійним альбомом Time and Ruins. У Їхній музиці помітні включення популярних мелодій, латинські та африканські ритми, які відображають динамізм сучасного світу. Кожен з музикантів групи відомий у Литві та за її межами завдяки своїй сольній та спільній роботі над багатьма іншими проектами. Концерт відбудеться за підтримки посольства Литви та почесного консульства Литви у Львові.

15:00 – Квартет Аміта Фрідмана (Ізраїль) Саксофоніст і композитор Аміт Фрідман – один з провідних джазових музикантів Ізраїлю. Його музика виходить з джазових традицій і пронизана елементами Близького Сходу. Його композиції поєднують в собі вишуканість і простоту. На сьогодні він записав три альбоми – Sunrise, Long Way to Go та Unconditional Love – і продовжує викладати й популяризувати джаз серед молоді. Концерт відбудеться за підтримки посольства Ізраїлю.

17:00 – ТНМК – Jazzy DeLuxe (Україна) ТНМК, або Танок на Майдані Конго, сьогодні є найуспішнішою хіп-хоп групою в Україні. Вони відомі своїми інтелектуальними текстами, вільно змішують хіп-хоп з роком, фанком, джазом і грають на реальних інструментах у своїх альбомах, не використовуючи семпли і драм-машини. ТНМК виступав на деяких з найбільших фестивалів Центральної та Східної Європи, включаючи Sziget, Zakhid, Таврійські ігри, Червона Рута, Файне Місто, Бандерштат, а також Leopolis Jazz Fest.

LVIV SOCIETY LVIV’S 763 RD ANNIVERSARY Lviv celebrated its 763rd anniversary with a festive program over the rainy 3–5 May weekend. Public concerts, street performances by musical groups, sports events, exhibitions, cultural initiatives, and holiday fairs were in store for those that braved the weather. Celebrations started with an impressive street parade through the city centre that featured over 3,000 participants, including knights on horseback, the Cheremosh folk dance group, the Leopolitan Fanfares brass band, famous athletes, foreign guests and, of course, actors playing King Lev and Queen Constance. The Lvivska Sotka cycling marathon attracted over 1,000 participants, while Lviv’s Korolivsky Lev highlighted the festival of majorettes. Leopolitans and guests of the city were treated to a variety of cultural delights on 5 May on Rynok Square and in Sykhiv (one of the city’s biggest districts). One of the most popular included the spectacular 3D mapping that was projected onto the walls of the Nativity of the Most Holy Mother of God Church (Rizdva Presvyatovyi Bohorodytsi). Happy Birthday Lviv!

Концерти, виступи вуличних музик, різноманітні спортивні заходи, виставки, культурні ініціативи, святкові ярмарки були приготовані для тих, хто не побоявся негоди. Спочатку вулицями міста пройшов незвичайний вуличний парад у складі понад 3000 учасників, серед яких були, зокрема, лицарі на конях, народний танцювальний колектив "Черемош", духовий оркестр "Львівські фанфари", відомі спортсмени, іноземні гості та, звичайно ж, сам король Лев і королева Констанс. У велосипедному марафоні "Львівська сотка", приуроченому до Дня міста, взяли участь понад 1000 найвитриваліших спортсменів, а на Сихові пройшов фестиваль духових оркестрів та мажореток "Королівський Лев". Також 5 травня на площі Ринок і також на Сихові (одному з найбільших районів міста) львів’ян та гостей міста пригощали різноманітними культурними делікатесами. Найбільше уваги привернула вражаюча тривимірна картина, яка проектувалась на стіни церкви Різдва Пресвятої Богородиці. З днем народження, Львове!

BATYARS ON BICYCLES Lviv’s popular Batyars on Bicycles retro bike ride returned to the city on 4 May. Modelled after London’s famed Tweed Run, Lviv’s event is designed to pay tribute to the city’s past, especially the Batyar culture that used to flourish here. Now in its sixth year, participants dress in their best tweed suits, furs, bow ties, and jaunty flat caps to showcase Lviv’s retro style. Many Leopolitans used the opportunity to dive into authentic Batyar style and remained jolly despite the rainy weather. Participants first joined a festive parade and later cycled through the city’s iconic landmarks before making a short stop for some tea.

Від учасників вимагається небагато – більш-менш старий велосипед (по-львівськи – ровер), стилізований одяг і хороший настрій. Цього дощового дня у Львові не бракувало ані батярів (хоч і несправжніх), ані роверів (часом дуже справжніх). Усі з задоволення проїхались вулицями Львова, кланяючись та посміхаючись навсібіч, а також зробили невеличку зупинку, щоб попити гарячого англійського чаю.

LVIV CELEBRATES “WET MONDAY” Leopolitans once again got wet and wild on April 29th for the one-of-a-kind postEaster celebration of Wet Monday. Hundreds of Leopolitans and guests of the city took to Rynok Square to douse each other in water as part of the Easter celebrations. This is for the sixth time already that this tradition which is part of both the Greek Catholic and Orthodox Easter celebrations is featured as cultural initiative in Lviv. Local “Lvivvodokanal” company arranged special areas with water reservoirs and water gates with sprinklers, that gave all participants possibility to enjoy this jolly celebration. The kick off to the celebrations was given by lviv’s city mayor Andriy Sadovyi, who addresses participants with short speech and later, together with his sons took active part in this water rave!

MISS LVIV 2019 GRAND FINALE Lviv’s luxurious Opera & Ballet Theatre hosted the grand finale of the Miss Lviv 2019 beauty pageant on 16 April. Hundreds of Lviv’s most beautiful girls attended the casting where 14 of our most talented were selected to compete in the finals. The glamorous production featured a creative show by the Voskresinnia theatre, performances by MamaRika, Artem Pivovarov, Denys Rekonvald, Bakun, and Antytila and, of course, the pageant itself. Host Timur Miroshnichenko provided the questions for the charming contestants to show that our Leopolitan ladies are as intelligent as they are beautiful. Some of the

region’s most prominent businesspeople, politicians, actors, artists, designers, and modelling agency directors were on hand to help select the winners. Olena Firut, a 19-year-old student and future lawyer was crowned Miss Lviv 2019 and will represent the region in the Miss Ukraine pageant later this year. Marta Martsynyak, an I. Franko University student, and Antonyna Stupar, a Lviv Medical University student, were named first and second vice misses. Vitaliya Onysyk also walked away with plenty of prizes after being named Miss Photo based on an online vote. Congratulations to all the ladies!

To mark this year’s Lviv City Day, Mayor Andriy Sadovyi recognised the contributions of 33 of the city’s most accomplished citizens with special titles and awards during a special city council meeting on 3 May. Yevhen Kurash, an ATO soldier and deputy commanding officer of the 80th Lviv Air Assault Brigade, was named Leopolitan of the Year. Three people were awarded the title of honourary Lviv citizen – His Beatitude Sviatoslav, the Patriarch of the Ukrainian Greek Orthodox Church; and Metropolitan Makariy and Patriarch Filaret of the Orthodox Church of Ukraine. The family of sculptor Volodomyr Odrekhivsky was named Noble Leopolitan Family. He is the son of Vasyl Odrekhivsky, famous scuptor and member of Ukraine’s National Union of Artists, and Maria Bayko, a soprano singer and People’s Artist of Ukraine. Lviv’s Golden Coat of Arms was awarded to 90-year-old Oleksandra Serbenska, Professor in the Faculty of Journalism’s Department of Broadcasting and Television. Congratulations to all those recognised and thank you for your continued contributions to making Lviv the best place to live in Ukraine!

Золотим гербом Львова була нагороджена 90-річна Олександра Сербенська, професор кафедри радіомовлення та телебачення факультету журналістики. Lviv held its annual Spring Business Forum from 11–12 April. This year’s topic, ‘Ukraine in 2019: A new period of uncertainty, or new possibilities’, tackled issues like Ukrainian economic development through export studies, a qualitative analysis of business in Ukraine, and establishing cooperation between entrepreneurs, foreign investors, and political authorities from across Ukraine. Representatives from leading banks, successful entrepreneurs, foreign financial and investment firms looking to begin business projects in Ukraine, and local authorities, including Lviv Region governor Oleh Synyutka were in attendance. The interesting list of speakers included Danish Business Association president Lars Vestbjerg, SoftServe president Taras Kitsmey, Kredobank chairman Grzegorz Szatkowski, Mukko chairman Mykola Kmit, and Dragon Capital chief economist Olena Bilan. HD Partners Legal Company managing partner Volodomyr Glaschenkov opened the forum with a welcome speech, while delegates closed the event with a business-breakfast at Lviv’s Citadel Restaurant on 12 April.

Lviv Half Marathon: Run the World

Lviv hosted the ‘Run the World – Lviv Half Marathon’ last month, where racers competed in one of many distances, including the 3 km charity run, the 10 km race and, of course, the 21 km course. There were also special races for the kids of 100m and 300m. The half marathon is one of athletics’ fastest-growing sports, with new races popping up all over the world. Mayor Andriy Sadovyi greeted over 2000 runners and took part together with his three sons in the charity run. A Ukrainian record was set when 41-year-old Zoreslav Kainskyi finished the 21 km course while wearing an 8.5 kg bulletproof vest. Ukraine’s Women Wrestlers Best in Europe Fans at the European Wrestling Championships in Bucharest became rather familiar with the Ukrainian anthem as three Ukrainians topped the podium in five events at last month’s event. Oksana Livach, Iryna Husyak, and Lviv’s-own Alla Cherkasova showed they are primed for next month’s European Games with splendid performances in Romania. Livach took a 6–4 lead with less than 15 seconds left to win her first European title in the 50 kg division, while Husyak had less trouble controlling Bulgaria’s Evelina Nikolova in the 55 kg final, winning 10–4. Hot off of being named Ukraine’s ‘Sensation of the Year’ at the Heroes of Sports event in Kyiv last month, reigning world champion Cherkasova topped Czechia’s Adela Hanzlickova in an entertaining 68 kg event, winning 11–6. Oksana Livach and Alla Cherkasova were named Lviv’s April Athletes of the Month for their exceptional performance at European Wrestling Championships! Congratulations to all the ladies!

Оксана Лівач перемогла болгарку Міглену Селішку в поєдинку з рахунком 6:4 менш ніж за 15 секунд і здобула свій перший європейський титул у категорії до 50 кг, а Ірина Гусяк переборола іншу представницю Болгарії Евеліну Ніколову у фіналі до 55 кг, з рахунком 10:4. Визнана минулого місяця "Сенсацією року" чемпіонка світу Алла Черкасова перемогла Аделу Ганзлічкову з Чехії у фіналі турніру в категорії до 68 кг з рахунком 11:6. Борчинь Оксану Лівач та Аллу Черкасову було визнано найкращими спортсменками Львівщини за підсумками квітня за прекрасний виступ на на чемпіонаті Європи з боротьби. Вітаємо наших дівчат!

Минулого місяця у Львові пройшов львівський півмарафон Run the World, де бігуни змагались на кількох дистанціях, включно з трикілометровим благодійним забігом, 10 кілометрів і звичайно ж, 21 кілометр. Там були також спеціальні змагання для дітей на дистанції 100 і 300 м. Півмарафон – це один з видів легкої атлетики, що найшвидше розвивається по всьому світу. Міський голова Андрій Садовий привітав понад 2000 бігунів і взяв участь у благодійній акції разом з трьома своїми синами. На змаганнях був встановлений рекорд України, коли 41-річний Зореслав Каїнський подолав дистанцію 21 кілометр, несучи на собі броньовану камізельку вагою 8,5 кг. Lviv’s Halychanka Ukrainian Handball Champions

Lviv’s Lions starts the season Lviv’s American football team – the Lions – returned to action at Yunist Stadium on 5 May, as the team kicked off the Ukrainian League of American Football in style. Finalists last year, the team kept up their high level of play with a 21-0 shutout of the Kyiv Slavs. The team is under new guidance this year, as Erdal Birinci and Burak Inanc of Turkey were brought in to lead the team. The Lions currently sit in first place in the Western division with a 2-0 record. Other teams in the Western division include the Slavs, Kyiv Capitals, Uzhhorod Lumberjacks, and Vinnytsia Wolves.

Lviv’s Halychanka women’s handball team won their fifth Ukrainian Super League championship after defeating Uzhhorod’s Karpaty 25–16 (10–8) on 16 April. The superior play of Ukraine’s top team saw our ladies lead the way in the regular season too. The Halychanka have become one of Lviv’s most popular and successful teams over the last few years and have developed a passionate and dedicated fan following. MOVE TO LVIV He finished his secondary education in Krakow in 1910. According to a colleague, Banach was very good in math and sciences, but graduated without distinction. He chose to study engineering at the Lviv Polytechnic University (1910-16) and while the world was crumbling around him, he spent his time tutoring, building roads, and attending math lectures. It was at one of these lectures at the Jagiellonian University in Krakow that Banach met, by chance, Steinhaus – a mathematician recently employed by Lviv University. Impressed by the young Banach’s talents for math, he shared with him a problem he was working on and couldn’t solve. They solved the question together, published it in 1918, and a lifelong collegial friendship was born. He even introduced Banach to his wife, Lucia Braus, who he married in 1920.

MATH WIZARD Stefan Banach founded modern functional analysis and made major contributions to the theory of topological vector spaces. In addition, he contributed to measure theory, integration, and orthogonal series.

TODAY'S FOCUS: ‘FREEDOM OF TRANSIT’ OBLIGATIONS IN TRADE REL ATIONS BET WEEN UKRAINE AND RUSSIA

Historically until the 19th century, cartographers referred to unmapped, i.e. unexplored land as “terra incognita” or “terra ignota”. This Latin notion can also apply to other ambits, including the lack of precedents in the realm of well-documented rules of international trade law. By and large, this circumstance occurs when the use of the non-tested legal provision materialises for the first time. While it is certainly not a frequent occurrence, the complexities that are inherent to post World War II international trade rules create the need to interpret them in specific instances. In this context, countries may be determined to interpret one-sidedly the objectives pursued by drafters of the basic and even more sophisticated legal instruments, as is the case with articles in the General Agreement on Tariffs and Trade (GATT).

The Dispute Settlement Body of the World Trade Organisation (WTO) approved on 26 April 2019 the so-called Panel Report in a case with these characteristics between Ukraine and the Russian Federation.

It simply means that either side to the dispute is entitled to institute an appeals procedure against the ruling. In practice, it is not rate that both sides initiate appeals procedures which must be based strictly on points of law.

In this particular case, known as “Russia – Measures Concerning Traffic in Transit”, Ukraine requested consultations with the Russia Federation in September 2016. With this request, Ukraine claimed that Russia had adopted a series of national laws and regulations that were inconsistent with WTO provisions on traffic in transit by road and rail. To sum things up, Ukraine denounced Russia’s bans and restrictions applied since 2016 to transit from Ukraine across Russia and destined to Central Asian countries, which had been part of the USSR. The GATT defines specific obligations for its member countries. These include the obligation of any WTO member country to ensure freedom of transit through its territory, via the routes more convenient for international LVIV TODAY | May 2019

EXPERT OPINION The United States, however, found the Panel’s analysis unpersuasive and problematic for systemic reasons. Other matters related to freedom of transit must still be tackled between Ukraine and Russia in the coming months. Exports of Russian energy products, especially natural gas, through pipelines on Ukrainian territory still constitute a large share of Russia’s exports, but the interested companies Naftohaz Ukrayiny and Gazprom are faced with numerous controversies.

Russia, on its side, relied on the dispute that arose with Ukraine after the annexation of Crimea in March 2014. The legal measures attacked were among those that it considered necessary for the protection of its essential security interests. Russia asserted further that it took these measures in response to the emergency in international relations that occurred in 2014, which presented threats to Russia’s essential security interests. It also claimed that the determination of whether any action is necessary for the protection of a WTO Member’s essential security interests are at the sole discretion of the Member invoking the national security exception to WTO general principles. Russia also claimed that the WTO Panel lacked jurisdiction to evaluate such measures. Both countries, Ukraine and Russia are not only Member Countries of the WTO but also parties to the Treaty on a Free Trade Area between the Members of the Commonwealth of Independent States and to the Treaty on the Establishment of the Eurasian Economic Union. The sole jurisdiction of the WTO Dispute Settlement Body for the dispute between Ukraine and the Russian Federation is enshrined in the WTO legislation. LVIV TODAY | May 2019

In the end, the Panel found that it had also jurisdiction to interpret the WTO national security exception and that Russia met the requirements for invoking the relevant GATT article establishing that national security exception. So, WTO Member Countries are not entitled to elude the control of the WTO Dispute Settlement Body when designing and applying measures in the context of the national security exception. The Russian Federation considers the outcome of the dispute to be well-balanced, although its view of the exclusive discretion of countries to adopt national security measures failed.

During the visit representatives of business sector in Zakarpattia region had an opportunity to find out more about the compliance policy from Advice Group, and also thanks to Energoatom be introduced to the case study of the implementation of the Integrity & Compliance policy positive influence on the business results of the enterprise.

“Integrity and transparency are today’s global trend in the business environment and it’s a pleasure to know that there are companies in Ukraine which already can share their example and successes by implementing these practices” – said Anton Podilchak during the meeting in Uzhhorod. On Friday, according to the Association’s traditions, regional companies were invited to business breakfast. Together with representatives from Zakarpattia Customs, participants discussed the issues of customs value, identifying the product code and post-audit questions, as well as issues of queues at borders and permits for international transportation. During three days, representatives of the Association had an opportunity to understand better the pros and cons of business environment in the region. Among the challenges named by companies were also mentioned shortages of personnel, queues at the borders of the Czech Republic and Slovakia, illegal deforestation, environmental issues and road quality issues, etc. Summing up the business visit, in general it became clear that the regional business are in a need of collective protection of their interests and communication platform, and EBA could be a good instrument for them. EBA SPECIAL HOW TO BE MORE PRODUCTIVE? TA R AS Y URY N TS’S SECRETS OF PERSONAL EFFICIENCY At the end of the day, we are almost always tired, but there is a difference when we know that most of our tasks from the list have been completed, or we keep saying to ourselves: "I did nothing, and again nothing happened." Once during the conversation, Taras Yurynts, director of the Guldmann Ukraine company, member of the Regional Coordinating Board of the EBA Western Ukrainian Office, mentioned that he has his own planning system for the whole year, which inevitably intrigued us. We persuaded Taras to tell us more about his planning system. And we decided to organize a closed meeting on effective planning and personal planning tools with Taras. Now we share some key tips that have been obtained. 1. Start planning We will achieve our goals faster as soon as we stop postponing, and always searching for ideal moments, ideal goals, ideal planning tools, necessary amount of funds, etc. I list my goals at the beginning of the year, then I break them down into goals for each quarter, month, week and a day. I am too optimistic, and I plan more than I can really manage, so it is better to plan less. But I always want to do more :) 2. Find your planning tool "I work with Excel files. Also, for convenience, I transfer the tasks into my notes on mobile phone." 3. Act "We can permanently postpone, and if we plan at least 50% correctly, it might encourage us to work, and adjust the road", – Taras advises. 4. Identify priorities If we talk about priorities for a day, I dedicate one hour in the morning to plan my daily goals. I prioritize tasks and put on the first place either very important tasks that are urgent, or those that can be completed quickly. Usually, in the morning we are fresh and full of strength, so it is better to finish small tasks and delete them from the list in order to proceed to the next tasks. 5. Find sources of energy replenishment "I identified three main sources of energy for myself: intensive sport, regular nutrition during the day, and sleep," Taras shared. At the same time, he stressed that there is a certain amount of reserved energy, which allows us to move without recharging, but it would not be enough for a long run. 6. Remember that something can go wrong and it's okay The list of tasks should not limit us. Some things can go wrong and we must be ready for this. If one believes that everything will go smoothly, it is easy to lose motivation at the very beginning. Anyone can take small steps in planning and observe the results. Let’s plan and do more, but with pleasure!

I was informed recently that an encumbrance was imposed on the real estate of our Ukrainian subsidiary. How can I check this information and how shall I proceed to cancel such encumbrance? Dear Michael, checking for encumbrances on real estate does not require much effort. Such may be found in the State Register of Proprietary Rights to Real Estate (hereinafter – the “State Register”), which is a unified state information system processing, saving and providing information on registered proprietary rights to real estate and their encumbrances, objects and subjects of such rights. The State Register contains following sections: • • • •

Real estate object; Ownership title; Other proprietary rights; Encumbrances on rights to real estate.

In order to obtain an extract from the State Register on proprietary rights of your company, you may apply to the public registrar (including the notary) or register on the official website of the Ministry of Justice of Ukraine and get the document online, in electronic form. A public registrar will print out an application and register it in the special database. You as an applicant shall provide the public registrar with your ID, information on your company and corresponding real estate object, sign the mentioned application and pay corresponding fee (UAH 50 or UAH 80). The public registrar shall provide you with the extract in paper form. To obtain such an extract online, in electronic form, you shall register on the official website of the Ministry of Justice of Ukraine using an electronic digital signature, and indicate your general information, as well as information on your company. An extract from the State Register in electronic form will be provided after payment of an administrative fee via Internet using popular payment systems (UAH 20). The encumbrances imposed on proprietary rights to real estate of your company (if such exist), subjects of such, as well as documents forming their ground, will be found in a separate section of the extract from the State Register: “Encumbrances on rights to real estate”. In order to cancel an encumbrance you shall apply to the authority, which imposed such, for a document that shall indicate the termination of the ground for this encumbrance. The cancellation of all encumbrances except of those, which were imposed based on the documents issued by the State Enforcement Service, may be registered by the public registrar (including the notary). 2011–2018
