nce again, we start to feel the usual cool, invigorating breeze blow on our faces that marks the end of the summer break, bringing with it a spirit for renewal. This year, we have made the most of the rising winds to update the contents of Flydoscope. The “City Guides” section has become “Travelblog.” It is still full of great ideas for your next trips and is based on the digital version of the Luxair Travelblog (travelblog.eu). Luxembourgish and regional news still has pride of place in your magazine, from now on they will be presented as topical features on aviation, culture, society and business. In this edition’s aviation section, you will get a glimpse at what goes on within the Cargocenter, which is already celebrating its 20th year of service in 2016. Hard to believe, isn’t it! Nevertheless, the Group’s news still remains at the heart of your Flydoscope. You will be able to see for yourselves that the Flydoscope spirit has not changed. It is there to inform you and entice you, as well as being your in-flight companion and our first information relay.

Luxembourg’s reputation as a world-class centre for alternative investment fund administration is booming, and we are playing our part. For investments in real estate and private equity we provide the structures and processes to acquire, hold, manage and divest a range of assets. We serve alternative investment funds, asset financing companies, M&A companies, oil and gas companies and securitisation vehicles. Having spent the summer maintaining their equipment, checking that their sound and lighting facilities are in good working order, cleaning their auditoriums and refining their communications initiatives, the various cultural institutions across the city are ready for the start of the new academic year. From the Philharmonie to the Grand Théâtre, across cultural centres, concert halls and theatres, programmes of events are set to resume around mid-September. Diaries at the ready!

n tant que directeur du département de la photographie du Museum of Modern Art (Moma) à New York, e d w a r d s t e i c h e n a conçu de nombreuses expositions. La dernière, The Bitter Years, a été réalisée en 1962 et rassemble plus de 200 images issues de la documentation produite entre 1935 et 1944 par la FSA (Farm Security Administration) sur l’Amérique rurale lors de la Grande Dépression. Roy Stryker, Walker Evans, Dorothea Lange ou Arthur Rothstein ont sillonné leur pays pour constituer un recueil bouleversant de l’Amérique en crise. Le château d’eau de Dudelange, construit en 1928 et reconverti en espace d’exposition pour le Centre national de l’audiovisuel, accueille une sélection de la collection The Bitter Years. Les tirages originaux restaurés et fragiles sont exposés en alternance suivant l’accrochage thématique et le concept historique développé par Edward Steichen pour le Moma. Le nouvel accrochage est l’occasion de visiter ce lieu spectaculaire.

A

s head of the photography department at New York’s Museum of Modern Art (Moma), e d w a r d s t e i c h e n has certainly designed his fair share of exhibitions. The last one, The Bitter Years, was produced in 1962 and featured over 200 images taken from the documentation produced between 1935 and 1944 by the FSA (Farm Security Administration), depicting rural America during the Great Depression. Roy Stryker, Walker Evans, Dorothea Lange and Arthur Rothstein travelled the length and breadth of the country compiling a deeply moving account of America in crisis. The château d’eau (water tower) in Dudelange, which was built in 1928 and has since been converted into an exhibition space for the National Audiovisual Centre, houses a selection of pieces from The Bitter Years collection. A number of fragile and restored original prints are exhibited in turn, in accordance with the themed-based display and historical concept developed by Edward Steichen for the Moma. The new display is the perfect opportunity to visit this spectacular venue.

ike Bourscheid was chosen by a panel from among 24 candidates to fly the flag for Luxembourg at the next v e n i c e b i e n n i a l , in May 2017. A performing artist, sculptor and photographer who spends his time between Luxembourg and Vancouver, he has developed a hybrid practice that is inspired by both autobiographical aspects and social analysis. Humour, irony and self-mockery are among the key elements on which his approach is based and are used to highlight social and political issues. His multimedia productions are based on personal experiences and reflection upon themes relating to the criticism of society. Bourscheid uses humour and irony to address, and indeed to challenge, a number of deep and complex themes and uses the art of performance and cross-dressing to raise questions regarding gender, the oppression of minorities, family and religion.

Artiste performeur, sculpteur et photographe vivant entre Luxembourg et Vancouver, il développe une p ­ ratique hybride, inspirée par des éléments autobiographiques et par une analyse sociale. L’humour, l’ironie et l’autodérision sont des aspects fondamentaux de sa démarche et pointent des enjeux sociaux et politiques. À l’origine de ses productions multimédias sont des expériences personnelles et des réflexions sur des thèmes axés sur la critique de la société. En recourant à l’humour et à l’ironie, Bourscheid parvient à aborder des thèmes profonds et complexes, à les questionner. Il utilise l’art de la performance et du travestissement pour poser des questions sur le genre, l’oppression des minorités, la famille ou la religion.

Le CinEast est le rendez-vous des films d’Europe centrale et orientale. CinEast is a key event in the calendar for anyone with a taste for Central and Eastern European films. The CinEast festival has been striving to offer Luxembourgers the best in cinematic production from Central and Eastern European countries since 2008, and this 9th edition of the event will consist of around a hundred screenings and a variety of associated events. The festival focuses on recent productions, many of which will be previewed at the event, as well as classics, and this year’s chosen theme will be “Far from home”, featuring a large number of films relating to the plights of refugees, expatriates and migrants and the issue of integration.

Depuis 2008, le festival CinEast s’efforce d’offrir au public luxembourgeois le meilleur de la production cinématographique des pays d’Europe centrale et orientale. Cette 9e édition proposera une centaine de projections ainsi que de nombreux événements parallèles. Le festival se concentre sur les productions récentes, souvent primées, ainsi que des classiques. Cette année, le thème choisi est « Loin de chez soi », avec un grand nombre de films autour du sujet des réfugiés, d’expatriés, de migrants et d’intégration.

Pour Lionel Loueke, « le son de sa guitare est pur et rafraîchissant. Je suis certain que nous entendrons de plus en plus parler de lui. » Depuis deux ans, le guitariste luxembourgeois Greg Lamy se produit entre autres avec l’auteur-compositeur et chanteur italien Marco Massa, avec lequel il s’est déjà produit (en quartet comme en duo) dans de nombreuses salles de concert en Italie ainsi qu’au Luxembourg.

“Greg Lamy is a guitar player whose refreshing and pure guitar sound gives birth to multiple melodic climates, underlined by a most fluid style, a musician with a promising future,” says Lionel Loueke. For two years he has been performing together with the Italian singer-songwriter Marco Massa, among other projects (both with his quartet and in duo), with whom he performed in different venues in Italy and in Luxembourg.

Le Luxembourg City Tourist Office propose un nouveau circuit touristique : « Top City Views ». Ce parcours permet de découvrir les plus beaux panoramas de la capitale – notamment depuis la Corniche ou le nouvel ascenseur du Pfaffenthal. Le tour permet de voir les sites historiques remarquables, que ce soit au centre historique, classés au patrimoine mondial de l’Unesco, ou dans les faubourgs. Des visites guidées et un dépliant sont disponibles en français, anglais et allemand au bureau du LCTO, place Guillaume II, à Luxembourg-ville. The Luxembourg City Tourist Office is now offering a new tourist trail of “Top City Views” that will enable visitors to discover the most beautiful views of the capital, notably from the Corniche and the new Pfaffenthal lift. The tour will include extraordinary historical sites, from the Unesco world heritage-listed sites of the city centre or the surrounding neighbourhoods. A series of guided tours and leaflets are available in French, English and German from the LCTO on place Guillaume II, Luxembourg City.

M

embers of the ECPAT network strive internationally to eliminate the sexual exploitation of children. In 1996, the network created the Code in collaboration with the World Tourism Organisation (WTO), to bring together stakeholders of responsible, sustainable tourism and provide them with a practical tool to prevent and combat child sex tourism. LuxairGroup signed the Code of conduct this summer. “We’ve had a very active partnership with LuxairGroup since 2009,” explains Thomas Kauffmann, executive director of ECPAT Luxembourg. “The fact that the group has decided to sign the Code is a step forward, which shows its further commitment to protecting children and to fulfilling its responsability towards them.” As every member of the Code, LuxairGroup will comply with and implement six criteria, for example establi­shing a policy and procedures against the sexual exploi­tation of children and training employees in children’s rights, prevention and how to report suspected cases. Travellers will also be given information on these issues.

es membres du réseau ECPAT travaillent à travers le monde pour mettre fin à l’exploitation sexuelle des enfants. En 1996, le réseau a créé le Code en collaboration avec l’Organisation mondiale du tourisme (OMT) et d’autres organisations afin de réunir les acteurs du tourisme responsable et de leur fournir un outil concret pour prévenir et lutter contre le tourisme sexuel impliquant des enfants. LuxairGroup a signé ce Code de conduite cet été. « Nous avions déjà un partenariat très actif avec LuxairGroup depuis 2009, explique Thomas Kauffmann, directeur exécutif d’ECPAT Luxembourg. La signature du Code est un pas de plus, qui montre la volonté du groupe à vouloir s’engager davantage et être responsable envers les enfants. » Comme chaque membre du Code, LuxairGroup va respecter et instaurer six critères, tels que la mise en place de politiques et procédures claires contre l’exploitation sexuelle des enfants et la formation de son personnel aux droits des enfants, à la prévention et au signalement des cas suspects. Ces informations seront également fournies à ses voyageurs.

D’autre part, nous avons la chance d’être un territoire qui accueille de nombreux sièges de grandes entreprises, ainsi que quelques fortunes. Luxembourg compte sur son territoire de nombreux amateurs d’art et collectionneurs. Nous devions donc réaliser un événement à la hauteur de nos ambitions, qui sont à la fois nationales et internationales. » Par ailleurs, Luxembourg est un pays fortement international et accueille de nombreux résidents venus de l’étranger. Ceci se ressent également sur le marché de l’art, puisque plusieurs galeristes étrangers se sont récemment installés à Luxembourg : Bernard Ceysson (Galerie Bernard Ceysson), Nordine Zidoun et Audrey Bossuyt (Zidoun-Bossuyt Gallery), Michael Krome (Krome Gallery), Renaud Bergonzo (Wild Project Gallery), Hervé Lancelin (Galerie Hervé Lancelin), etc. Toutes

Les membres du Club peuvent ainsi bénéficier de conseils et d’achat auprès de galeristes, mais ont aussi accès à des experts de différents secteurs, qui travaillent de manière indépendante, professionnelle et qualitative. Ces services sont en particulier destinés aux entreprises de la Place qui ont en leur possession des œuvres d’art ou à celles qui souhaitent commencer une collection.

Cette plateforme permet également à une vingtaine de jeunes galeries d’avoir un espace de présentation sans avoir à payer un stand traditionnel, ce qui est onéreux pour une petite structure. C’est donc une accessibilité à double sens, à la fois pour les clients qui peuvent acquérir de l’art de qualité à prix raisonnable et pour les galeries qui peuvent présenter leurs artistes à moindres frais. » On pourra ainsi y découvrir une pépinière de talents représentés par des galeries, collectifs et espaces de projets issus des scènes locale et régionale. UN ÉVÉNEMENT CONVIVIAL Mais Luxembourg Art Week est avant tout conçu comme un événement convivial. Sur le site de la Halle Victor Hugo, on trouvera aussi des commodités comme un bar à champagne ou un food truck. « Les visiteurs peuvent venir découvrir l’art contemporain dans une ambiance décontractée et festive, faire des rencontres, passer un moment agréable. Comme Luxembourg Art Week reste à une échelle raisonnable, il est possible d’apprécier l’ensemble du programme sans s’épuiser. Cette dimension conviviale est très importante à mes yeux, car les collection-

director and owner of the Nosbaum Reding Gallery in Luxembourg. Happy and satisfied with the success of the first edition and its 7,000 visitors, he has decided not only to continue with this experiment but indeed to make it bigger this time around.

Également dans la Halle, le Casino Luxembourg - Forum d’art contemporain délocalise son InfoLab le temps de l’événement pour proposer un espace de documentation spécialisé en art contemporain. « Luxembourg Art Week est aussi un moment intéressant pour les entreprises, souligne Alex Reding. C’est l’occasion pour elles de participer à un événement de prestige, d’inviter leurs clients, de faire découvrir Luxembourg sous un autre jour, de réaliser des circuits ‘art’ dans nos différentes institutions et galeries en ville. Il y a donc de nombreux événements corporate qui sont organisés. » Cette forte implication des entreprises se retrouve également dans une autre nouveauté : le Club des amis de Luxembourg Art Week, une plateforme spécialisée pour les besoins des collectionneurs (voir notre encadré). Une manière de ressentir les bénéfices de Luxembourg Art Week tout au long de l’année.

Qu’est-ce qui vous a amené à Luxembourg et plus particulièrement à la Brasserie-Restaurant Kennedy ? Le multiculturalisme. Vivre au Luxembourg et travailler à la BrasserieRestaurant Kennedy me permet de m’enrichir quotidiennement de toutes ces cultures. De plus, le challenge de répondre aux attentes de cette clientèle internationale me passionne. Quelle est la création culinaire de votre carte dont vous êtes le plus fier ? D’où vient votre passion pour la cuisine ? Cette passion est née lorsque j’étais enfant et plus particulièrement sur le chemin de l’école. En effet, je passais chaque jour devant ce restaurant et je voyais, à travers les vitres, des cuisiniers travailler des produits frais tout juste réceptionnés. L’envie de sublimer ces produits est aussitôt apparue.

Where does your passion for cooking come from? This passion came when I was a child and especially on the way to school. Indeed, I was walking past a restaurant every day and I could see, through the windows, cooks working with fresh products just delivered. The desire to sublimate those products appeared immediately. You are a frequent traveler. How did your experiences influence your cuisine? I spent many years travelling and working in different countries all over the world: France, Madagascar, Spain, Indonesia, Germany, Denmark. This gave me the opportunity to discover new products and new flavors. My cuisine was influenced thanks to this cultural enrichment and is now characterized by both classic and innovative dishes with a touch of each country. What is the first dish you made? Spicy Indonesian chicken, a dish we were used to enjoy with my family. What brought you to Luxembourg and more particularly to the Brasserie-Restaurant Kennedy? Multiculturalism. Living in Luxembourg and working at the Brasserie-Restaurant Kennedy allows me to enrich myself of all these cultures every day. Moreover, the challenge of meeting the international clientele’s expectations is fascinating. Which creation from the menu are you the most proud of? Surf & Turf: Slices of rare beef fillet, sautéed gambas with Asian vegetables, soya and oyster sauce served with jasmine Thai rice. Customers love it! And regarding the deserts? Toutefois, certains « visiteurs » ont marqué plus que d’autres, comme le passage d’un rhinocéros blanc ou l’atterrissage du légendaire Antonov AN-225.

As for the type of goods handled in the Cargocenter, they have gone through different fashions. “Once, the pallets and containers were loaded with video recorders, then we filled planes with smartphones and flat screens. For years we also had the traditional ‘Beaujolais nouveau’ weekend, with a number of shipments for Japan…” When making your way around the pallets and the never-ending ballet of forklifts, it quickly becomes clear that the men and women who work here have seen everything, shipped everything and that nothing can unsettle them. However some “visitors” have been more memorable than others, like a white rhinoceros or the legendary Antonov AN-225.

Whereas Cargolux is an airline specialised in transporting the freight – among the world’s leading ones.” Even though Cargolux is by far the platform’s biggest client, the Cargocentre also works with many other airlines, like Qatar Airways, Silk Way West Airlines, AirBridgeCargo, China Airlines and Atlas Air, but also with a number of the world’s largest air carriers based in Luxembourg. To fulfil its operations, LuxairCARGO also regularly works with local authorities: Customs, Food Security Division and ASTA, the Grand-Ducal Police force, Radiation Protection Division, the Veterinary department and the Transit Licenses Office. The whole world transits through here and it’s hard not to be enthralled by it. Every day, carriers capable of transporting over 100 tonnes of freight arrive from, and take off to, every continent. It’s near impossible not to be impressed by how the facilities have been made in a way to accommodate any type of cargo in optimal conditions. In fact, there’s no way around it: even after 20 years, the Cargocentre remains truly captivating. 

his is a big step towards the reliance in the use of digitalisation to serve businesses in Luxembourg, by ensuring its safety and reliability. Launched in May 2012, the ISO 22301 certification attests to the management of sensitive information and business continuity, and strengthens companies in terms of reliability and quality. The demanding process to obtain the internationally recognised label took EBRC and Arendt Services 12 months since inception. To date, fewer than 1,000 companies are certified in Europe, of which Luxembourg now hosts two. KEEPING DIGITAL DATA SAFE “A major business concern today is ensuring business continuity in the event of a crisis,” explains Yves Reding, CEO of EBRC (European Business Reliance Centre, PSF certified). The partnership of IT service provider EBRC and business facilitator Arendt Services has allowed the two companies to address this concern and provide a reliable answer to their international clients. Set up in 2000 with the aim of being a European centre of IT excellence in the management of sensitive information, EBRC has achieved this goal via an impressive trajectory and has received over 60 international technical and professional certifications and awards. t follows that in times of significant innovation, the law must extend to encompass related developments whilst remaining both authoritative and dependable. Technology plays a significant role in the advancement of civilisation, and has a far-reaching impact on virtually every aspect of daily life. Lawyers are certainly not exempt from the acceleration of technological advancement which appears to have reached fever pitch – resulting in a stream of new services, platforms and products to the market. Faced with competition from new players such as legal start-ups, legal professionals are having to re-think their roles. Digital, structural modifications impact upon client relationships and when it comes to legal advice, lawyers may have no choice but to evolve. Who better to shed light on this legal and digital entanglement than Rosario Grasso, president of the Luxembourg Bar Association since September 2014? “My two-year mandate actually comes to an end on 15th September,” he explains “and it’s been a tremendous experience.” He discovered his passion for the law at the tender age of 8 when he was taken to tribunals by his aunt, one of the first women to practice as a lawyer in southern Italy, “although the desire to help and defend people is probably hard-coded into my personality,” he muses. Admitted to the Luxembourg Bar in 1991, he’s witnessed an enor-

mous amount of change over the last 25 years; “When I started, around 280 lawyers were admitted to the Luxembourg Bar – today we are 2,300. The structure of the profession has also changed since most lawyers were practicing in groups of areas such as civil, commercial and labour law. As time has passed, we’ve seen more and more highly specialised, qualified lawyers working in anything from civil to administrative law and of course banking and finance, where around half of all our lawyers are currently focused.” Since 1991, the pressure to specialise has clearly increased and Grasso points out that cases involving data protection and intellectual property for

example, demand highly experienced lawyers who are familiar with the associated laws and innovations. KEEPING PACE WITH TECHNOLOGY The internet and the wealth of knowledge it contains has shaped client expectations. “Clients have become more critical and can research their lawyers in advance to understand in which areas they are working and how effectively.” He points to the legal 500 website by way of example which assesses the strengths of law firms in over 100 jurisdictions and highlights the teams providing the most cutting edge advice. When asked whether the legal

profession is keeping up with the pace of digital innovation, Grasso pauses. “That’s a tricky question but I would say yes. I’m aware that there are other individuals who try to appropriate what we are doing, using the internet as a legal platform from which to deliver virtual legal advice.” He explains that according to the Luxembourg law of 10th August 1991, governing the legal profession of lawyers, only lawyers can offer legal advice. He continues; “But certain other professionals may under very specific circumstances, proffer advice if it is an ‘accessory’ activity to their own.” Banks, unions and insurance companies are among the bodies falling within this category but Grasso is quick to explain that if the person or body is not authorised, then they risk being sued or indicted for committing a criminal offence. Suddenly, everyone’s an expert with access to an extensive library of online knowledge, but it needs to be carefully assessed and disseminated. “The Automobile Club of Luxembourg has taken the opportunity to post contract templates on its website, aimed at people wishing to buy or sell their cars. These templates have been approved by lawyers or legal services so it’s not a problem, but they are not for use under other circumstances,” he says. “In fact we have files in which clients have copied inappropriate contracts for personal purposes and the contracts were deemed incompatible.” BUSINESS SUCCESS ENTAILS MOVING WITH THE TIMES So what of the benefits presented by technology; “We are fully aware that new web technologies and algorithms are useful. It’s far easier today to research case law via officially and formally recognised websites than it’s ever been. 15 years ago this was unimaginable - I often had to visit the Memoriale

where laws were published or walk to the court and national libraries.” Grasso laughs as he reflects upon the past. “Definitely there are advantages,” he says. “There are now links you can click on that provide the entire historical process of a law and its amendments. The profession has changed – tag sheets that were once written manually are now computerised and 8090% of firms have invested in the required software.” He believes that keeping up with technology is essential for a law firm’s longterm survival. “Our lawyers are regularly trained by IT staff and have been adapting for some years, becoming more and more efficient. The Luxembourg Bar invested around €2 million in new technologies including its own cloud,” he explains. “This guarantees client confidentiality and together with the Ministry of Justice, we are working towards a paperless environment by 2023. We have to keep pace and not be where we were 20 years ago. I see lawyers of more than 70 years of age, on their smartphones and communicating by email. 30 years ago you

received a letter and replied to it a week later; today you have to respond immediately or risk losing a client to another firm.” He is only too aware of the height of client expectations and highlights the fact that following the Lehman Brothers crisis, most clients refer to several lawyers to check levels of expertise and price indications before committing – often trying to negotiate capped fees. Looking to the future, Grasso sees the role of the lawyer becoming increasingly specialised – delving deeper into specific “sub areas” within administrative and labour law, citing data protection as an example. “Specialisation is the future of our profession, and technology will continue to influence the way in which lawyers work,” he asserts. “The internet has increased transparency, which is great news for our clients who wish to benefit from good service at a competitive price. The internet will continue to empower lawyers to work more efficiently, which will impact on the time spent and potentially drive down fees.” The digital future, it seems, is bright.

remain a popular choice. The cross-border fund specialist Luxembourg is benefiting and is beefing up its offering to fund managers. 110

P

ressure to minimise the fees charged by investment fund managers has grown recently. The costs of “alternative” products such as hedge funds, private equity funds, real estate funds and the like have been under the spotlight, as these products are particularly costly to run. From time to time news emerges that large institutions are set to scale back their commitment to alternatives, but the overall evidence points to increased demand as investors seek original ways to generate financial returns. For example, total assets managed by the top 100 alternative investment managers globally reached $3.6 trillion in 2015, an increase of 3% on the previous year, said a recent survey by the consultancy Willis Towers Watson. ADAPTING TO GROWTH Further evidence is the buzz around the Luxembourg alternative fund sector. The specialist in cross-border distribution saw net inflows of €6.4bn into alternative investment funds (AIFs) in the first quarter of this year, out of a €43.4bn increase across

Europe, said the European Fund and Asset Management Association (EFAMA). This resulted in total assets under management for AIFs in Luxembourg of €549bn, equating to 10.7% of the European market. This market share was two percentage points higher than that of Ireland, the Grand Duchy’s friendly rival in the cross-border fund business. A total of 4,411 AIFs are domiciled in Luxembourg, the second-highest figure in Europe, with these funds run by more than 820 authorised or registered managers. If one includes funds sold to retail clients, regulated under the EU’s UCITS directive, Luxembourg had total assets under management of €3.34trn in Q1 2016: 26.0% of the European market. Such is the demand for AIFs in Luxembourg, that a lengthy backlog has developed at the local regulator, the CSSF. It is struggling to process requests swiftly, with some fund managers forced to wait months before being able to bring new products to market. The Reserved Alternative Investment Fund (RAIF) law that came into force on 1st August should ease the pressure.

The problem originates with Luxembourg having added an extra layer of regulation to its interpretation of the EU’s Alternative Investment Fund Managers Directive. EU law only requires that the management company be regulated, but Luxembourg also insists that the fund be supervised. The industry argued that this was often not necessary, as the vast majority of AIFs are sold to sophisticated investors (institutions or very wealthy individuals) who do not need regulatory protection. LISTENING TO CONCERNS The Luxembourg government responded to these concerns, worked with the industry and introduced the RAIF. Similar in structure to the country’s venerable Specialised Investment Fund (SIF), the RAIF does not need prior approval and on-going supervision by the regulator if the end investor is demonstrably “sophisticated”. Instead, AIFMD compliant fund managers (which can be based in any EU country) must submit regular reports to the CSSF about their RAIFs. With

this in place, the RAIF is then granted an EU passport enabling it to be marketed without restriction across borders. “I understand from many industry colleagues that there is significant interest and demand for the RAIF,” said Denise Voss, chairman of the Association of the Luxembourg Fund Industry (ALFI). “Managers can set up their alternative investment funds as Part II UCIs, SIFs or SICARs if they prefer direct supervision of the fund by the CSSF,” she said, but “alternatively they can set up their alternative investment fund as a RAIF, thereby reducing time-to-market.” OPPORTUNITIES FROM BREXIT? Brexit may also present some longer-term opportunities to the Luxembourg alternatives sector. For retail funds, the UCITS market is open to international players seeking to sell throughout Europe and beyond. Funds managed in the US, Switzerland and other non-EU jurisdictions are domiciled in Luxembourg or Dublin, the two main cross-border hubs and single market access is assured. The UK outside the EU would be able to follow a similar course, simply by conforming to European regulations. The Alternative Investment Fund Managers Directive is less welcoming. Since coming into force in 2011, only fund managers based in the EU have relatively straightforward access to the marketing passport. This document enables them to sell around the single market without needing to gain regulatory approval in each country. However, non-EU countries have to find a way around this, with a favoured technique being to use in each member state of private placement regimes which mimic fund structures. CHANGED ENVIRONMENT There is the possibility of nonEU countries being granted a marketing passport. The European Securities and Markets

Authority (ESMA) first gives a recommendation and then the EU decision-making bodies need to act. Last summer, ESMA said that Switzerland, Jersey and Guernsey were compliant with EU rules and could be given EU-market access, and Canada and Japan were added to this list in July this year. Applications from other countries (including the USA, Cayman Islands, Australia, Hong Kong and Singapore) received only qualified approval. At any rate, the Commission, European Council and European Parliament have not moved on last year’s recommendations, so short-term access for non-EU jurisdictions is unlikely. Moreover, after Brexit there could be a hardening further of the EU stance, not least because the UK was the main large country pushing for a more liberal regime in EU decision-making forums. The conclusion may be that non-EU fund managers come to think that they should establish a solid presence within the single market. Luxembourg would be one of the candidates for such a move. Over half of alternative fund managers in Europe are based in the UK, with 19% located in Switzerland. “It is certainly too early to say what the impact on UK AIFMs would be, but if some decide to seek a EU hub, Luxembourg would be a clear choice,” Denise Voss remarked.

The Digital Lëtzebuerg initiative is a clear indication of the Luxembourg government’s desire to accelerate the digitalisation of the economy. One of the principal avenues consists of enhancing the appeal of creative start-ups from abroad and improving their local development. 114

lthough the Big Four might not be a young company’s instinctive first port of call, these larger corporations have programmes dedicated to promoting the appeal of Luxembourg for international start-ups. The aim is invariably to connect key companies with startups and to facilitate unrivalled support – both professional and financial – for innovative leaders at the beginning of their business launch. To this end, EY Luxembourg launched EYnovation in July 2015, the successor to its privileged partnership with Europe4StartUps. “Luxembourg started to develop 15 years ago in the areas of innovation and technology. The nation began to be able to offer broadened expertise and attract companies from the technology, media and telecommunications (TMT) sectors such as Amazon, Ebay, Skype, Paypal, Rakuten and so on. Little by little, the Grand Duchy has become a TMT centre

and hub built on the foundation of SES, RTL, Millicom and others alongside its traditional financial background,” explains Olivier Lemaire, technology media & telecom leader at EY Luxembourg. A COLLABORATIVE OPEN PLATFORM “Luxembourg is branding itself as a start-up nation and its ecosystem is developing rapidly. It has become much more active, with its many incubators, acceleration platforms and co-working spaces as well as significant support from the government, the University of Luxem­bourg and large corporations to advance and encourage innovation start-ups,” says Hélène DelamareGutton, EYnovation project manager at EY Luxembourg. Many years ago, EY Luxembourg started looking at how to assist the development of start-up companies to boost small entrepreneurs to develop innovative ideas. “Now all the pieces are here but what is still missing

is how to find funds, and more funding is needed in Luxembourg. In essence, I believe that you will find funds if you have good ideas. We don’t raise funds for start-ups but we try to match them with fund providers using our network,” states Olivier Lemaire. At EY, the will is to help start-ups in different ways in addition to the typical services that they offer. “We give startups access to our thought leadership materials and local or international industry experts as well as to our global EY network. We also give them access to our client base,” says Olivier Lemaire. “For example, if we can introduce a start-up to an executive at an established corporation with whom we work, such a connection can give them a leap start. We associate the start-ups to our brand and in doing so we demonstrate our confidence in them. It’s about providing an open platform for connecting people. Being backed by EY is a gateway of oppor-

PARTNERSHIPS IN THE ENTREPRENEURIAL ECOSYSTEM EYnovation is managed by Hélène Delamare-Gutton along with Anthony Cannella. The team is made up of five partners and 10-15 managers and senior managers who are all part of the TMT practice at EY Luxembourg spread across EY service lines: transactions, advisory, assurance and tax. The dedicated EYnovation team is fully active within the firm meaning that all managers come from different practices and are well-connected. “Everybody continues their regular assurance, tax, or advisory job alongside being involved in EYnovation. This is exciting as the links are very much alive: they bring start-ups into contact with clients that they work with on a daily basis,” says Hélène Delamare-Gutton. EYnovation can take on between 10 and 15 start-ups at a time. In order to be selected, startups must have a proof of concept, a legal entity set up and be ready to start generating revenue. Innovative ideas are a must, with a link to technology a close second. A focus on the TMT industry and fintech is most typical but the biotech and greentech industries are slowly starting up. Candidates are invited to pitch their idea in front of a jury composed of EY TMT partners and managers. “We want to have a good connection with the start-up from the outset. The idea, the proof of concept and the team are all important. But ultimately it comes down to personal fit,” says Hélène Delamare-Gutton. Once selected, each start-up gets an individual EY coach for six months, free of charge, acting as a point of contact to whom they can raise technical questions. Bringing innovation to EY Coaching involves business plan strategy sessions, working with senior advisors, being connected with experts. In addition, EYnovation offers start-ups customised

services adapted to their needs, their stage of growth and maturity. Being a member of the EYnovation community provides start-ups with access to exclusive events, offering an ideal opportunity for networking. Hélène Delamare-Gutton adds: “There are also dedicated start-up events that can provide an informal setting where the purpose is to meet each other in a stimulating environment.” Olivier Lemaire declares: “EYnovation is also about partnership. Typically, a start-up is looking for infrastructure and we are an open platform that can offer that. We have partnerships with most of the players in the entrepreneurial ecosystem in Luxembourg, from IT infrastructure providers and incubators to communication agencies. We want to work in a collaborative way and to open doors rather than work isolated behind closed ones.”

“Furthermore, EYnovation is a way to develop our own staff. They work regularly with young entrepreneurs, which enables us to grow. In some cases, we buy the services of the start-ups who are part of EYnovation. Becoming a client is a great way to support them and likewise brings innovation to our services,” says Olivier Lemaire. The benefits demonstrably work both ways: “One EYnovation participant in the fintech sector has turned into an audit and tax client. It was a very successful case and they are now an established company moving to the next level of growth.” “We believe that EYnovation also contributes to the Luxembourg community and economy. We invest a lot in terms of time and manpower dedicated to the start-ups and believe it is part of our corporate responsibility and our contribution to the nation,” concludes Olivier Lemaire.

SAFETY COMES FIRST For your own safety, we would like to inform you about applicable rules on our flights and to remind you that the instructions of the crew have to be followed. Please, note that: - all Luxair flights are strictly non-smoking (including electronic cigarettes); - the use of handheld games, media players, hearing aid, pacemakers or cameras is authorised during all flight phases (take off, landing and in flight); - the use of remote control toys, hoverboards, personal air purifiers, two-way radios or transmitters is prohibited during all flight phases (take off, landing and in flight); - the use of all electronic devices is prohibited during take off and landing, due to possible interference with aircraft navigation equipment; - devices that transmit or receive calls or texts must remain switched off during the flight. Exception: Devices equipped with a flight mode, which must be enabled prior to departure. Devices not equipped with a flight mode must be switched off. Following captain instructions, the crew can ask to stow away and/or switch off your electronic devices at any moment due to specific operational requirements.

Nous rappelons que : - tous les vols Luxair sont strictement non-fumeurs (idem pour les cigarettes électroniques) ; - l’utilisation de jeux portables, de lecteurs multimédias, d’appareils auditifs, de pacemakers et d’appareils photographiques est autorisée pendant toutes les phases de vol (décollage, atterrissage et en vol) ; - l’utilisation de jeux télécommandés, d’hoverboards, de purificateurs d'air personnels, d'émetteurs et de transmetteurs radio est interdite pendant toutes les phases de vol (décollage, atterrissage et en vol) ; - l’utilisation d’appareils électroniques est interdite au décollage et à l’atterrissage en raison des risques d’interférences avec les équipements de navigation de bord ; - les appareils pouvant transmettre ou recevoir des appels ou des SMS doivent rester éteints durant le vol. Exception : Seuls les appareils équipés d’un mode avion, qui doit être activé avant le départ. Les appareils ne disposant pas d’un mode avion doivent être éteints. Suite aux instructions du commandant de bord, le personnel de bord peut vous demander de ranger et/ou d’éteindre vos appareils électroniques à tout moment en raison d’exigences opérationnelles spécifiques.

CONSUMPTION OF ALCOHOL Consumption of alcohol aboard a Luxair airplane is only allowed if beverage is delivered and served by Luxair crew. Alcohol that has been purchased in the Tax Free Area of the departing/transit airport has to be kept within the sealed transparent Security Tamper Evident Bag (STEB) delivered at the counter of the tax free shop until arrival at destination airport. The crew will refuse and prohibit the service of alcoholic beverages to passengers aged under 16 as they are not allowed to order or consume alcohol.

LA CONSOMMATION D’ALCOOL La consommation d’alcool à bord d’un avion Luxair est uniquement autorisée si la boisson est fournie et servie par le personnel navigant Luxair. Des boissons alcoolisées achetées dans l’espace hors taxes de l’aéroport de transit ou de départ doivent être conservées à l’intérieur des sacs transparents inviolables scellés (STEB) fournis au comptoir du magasin hors taxes jusqu’à l’arrivée à l’aéroport de destination. Le personnel navigant refusera et interdira le service de boissons alcoolisées aux passagers de moins de 16 ans, ces derniers n’étant pas autorisés à en commander ou à en consommer.

Parlons de votre toute première expérience de vol... J’ai volé pour la première fois en 1972. J’avais 14 ans et je me suis rendu avec mon père en avion jusqu’à Londres. Super souvenir, super ville. C’est de là que vient ma passion pour l’aviation. Quelle est votre destination de voyage préférée ? Avezvous un coup de cœur à partager avec nos lecteurs ? Pendant 20 ans, j’ai fait des séjours de recherche en Inde et j’y retourne depuis souvent en avion, que ce soit en vol direct ou via Bangkok, Kuala Lumpur ou Singapour. J’ai toujours été particulièrement attiré par Hanoï, une métropole asiatique très authentique et pleine de vie, dans laquelle on peut côtoyer l’histoire récente et plus

ancienne du Vietnam. Ses environs offrent également toute une série de destinations fascinantes pour des escapades. On peut profiter du magnifique paysage dès l’atterrissage. Imaginons que vous soyez libre de choisir la personne que vous voulez pour concevoir l’avion de vos rêves ; de qui s’agirait-il et à quoi ressemblerait l’avion ? L’avion de mes rêves est un avion qui me permettrait d’observer attentivement les paysages en dessous de moi et dans lequel j’aurais tout le temps et le loisir de profiter de la vue. J’imagine d’ailleurs davantage un vieux biplan qu’un jet ultramoderne (bien que je préfère nettement le confort des avions modernes).

Let’s start talking about your very first flight experience ever... I flew for the first time in 1972, when I was 14 years of age and flew to London with my father. Great memories of a great city. From then on my passion for aviation grew. What’s your favourite city to travel to these days? Any local “coup de cœur” to share with our readers? I made a few research trips to India over the space of 20 years and I’ve been flying back there regularly ever since, either directly or via Bangkok, Kuala Lumpur or Singapore. Hanoi has always particularly appealed to me, as a very authentic Asian metropolis that is bustling with life, where Vietnam’s recent history sits alongside its ancient past. The surrounding areas also offer a plethora of fascinating destinations to visit, and you can really appreciate the magnificent landscapes there as soon as you land.

Now let’s imagine you would be free to choose anyone you want to design the airplane of your dreams: who would it be and how would you expect the plane to be? My dream aircraft would be an aircraft that would allow me to carefully observe the landscapes below me and one that would give me the time and the opportunity to enjoy the view. I’m also thinking more of an old biplane than an ultramodern jet (although I certainly prefer the comfort of modern aircraft).
