Celebrating our industry It is with great pleasure, and relief, that I write about the awards night just gone. Without a doubt, we had some fantastic winners and many high calibre runners up. The evening went like clockwork and my sincere thanks goes to all involved from our entrants, to our sponsors, the judges and the teams at MBA and BDW special events management. Without them the night wouldn’t have been the success it was.

Housing affordability Much has been said about housing affordability and we are constantly bombarded with how much housing costs have gone up. Our residential builders say that they can build a house cheaper than they could 15 or 20 years ago, this is due , not only to reduced cost of materials but also to the types of materials now available the technology to assist in the

Setting the record straight Master Builders ACT has written to Labor MLA’s correcting a Unions ACT letter that suggested we had abandoned our concerns for safety and suddenly become part of the Liberal Party.

The claims are errant nonsense.

While we have become accustomed to the routine abuse of safety statistics in attacks on our membership, the claim that we are now acting as the ‘industrial wing of the Liberal party’ is new.

While the Unions ACT letter is a none-too-subtle attempt to intimidate Labor MLAs into restricting contact with the MBA, it did provide a useful opportunity to correct the record. We told MLAs we must and will call out behaviours that erode safety in our industry. For a decade or more the local militant construction union routinely concocted safety grounds to shut down construction sites in pursuit of industrial and commercial interests. These attacks on safety were deeply resented by construction teams, and became a central reason for industry-wide rejection of the 2016 union EBA.

It is also not true. Far from representing any political party, or even big business, we are first and foremost advocates for the small businesses which comprise an overwhelming 93% of our membership. Many of these businesses are built off the back of trade qualifications and experience; small teams working hard to make a go of it in our local industry and community. We remain today, as we have for 92 years in the Territory, firmly non-partisan in the clear understanding that the interests

Proof of this sincere desire to engage on safety came last year when we sought out a meeting on safety and subsequently agreed to sponsor a Unions ACT ‘safety walk’. We never believed walking around the lake would make anyone safer, but we agreed to pay $7500 to sponsor the event in an act of good will. It’s proved a poor investment.

Along with asinine and grammatically challenged claims that we believe safety is a ‘myth’ the most oft quoted example of our abrogation of safety is in the rejection of two of the 27 recommendations of the ‘Getting them home safely’ report.

That’s got nothing to do with politics. No other jurisdiction in Australia formally invites a third party into the tender process. The MoU demands “participants must be contributing to the decision making process not only in appearance but in fact”. While acknowledging the ultimate decision rests with the Minister, it unambiguously gives unelected people power over how tax payers’ dollars are spent in the Territory. It’s wrong.

We reminded MLAs that the two recommendations in question, required that MBA ACT develop ‘safety frameworks’ to cover our entire industry, from backyard decks to high rise apartments and everything in between. We were given four months over Christmas to deliver. Our deadline fell three months before the ACT Government had even responded to the report.

The MoU appears to have emboldened some in the union movement to take this a step further. Not content with deciding all tenders, they now want a say in who our elected representatives can talk to. We understand it’s not what’s asked but what is delivered that’s important. We’ve seen no indication that our local MLAs have been intimidated or influenced in any way by the letter.

Crunch time is here As members are well aware – the negotiations of EBAs in Canberra have been a fraught affair since the end of the Trade Union Royal Commission in late 2015. Prior to the Royal Commission, the vast majority of Canberra construction businesses usually signed the pattern union agreement without question – this was just the way things were. A necessary price of doing business in Canberra. But the 2015/2016 union pattern EBA failed. Many local businesses opted to sign Company Specific EBAs in order to distance themselves from the problematic industrial arrangements the union EBAs entailed. Many opted to do company specific EBAs out of sheer disgust at the scale of wrongdoing revealed in the Trade Union Royal Commission. Many businesses have understandably waited to see what would happen with the long discussed new building code.

Whether it was intended or not - this disallowance motion essentially acted as a delaying tactic for the CFMEU. In April 2017 CFMEU Secretary Dave Noonan stated the union would “resist by all means available the imposition of the code and will continue to fight for the repeal of the ABCC legislation.” This was taken by Industry to mean that the union would not be a party to 2016 Code compliant agreements, and this is effectively what has played out. It is no secret that Master Builders has long encouraged the use of Company Specific EBAs as these are without doubt the best industrial arrangements for your business in the current environment. However, the bedrock of IR law is freedom of association, and some members may wish to have a union EBA for a variety of reasons.

We got the answer to that question in December 2016 when the Australian Senate approved the Code for the Tendering and Performance of Building Work 2016 (the 2016 Code). Sadly the first version of the 2016 Code effectively had its teeth pulled due to a ridiculously long transition period. A transition period in which business could get ready was no doubt appropriate, but two years was simply absurd. Happily, a late Christmas present came with the news that Senator Derryn Hinch had thought better of the delayed transition period of two years – so in February 2017 he shortened that transition period to nine months from the introduction of the 2016 Code. 31 August 2017 would be the new date on which the 2016 Code would come into force.

Master Builders has sought information from the CFMEU as to whether or not they will make 2016 Code compliant agreements – we have received no clear response. Given their previous statements and subsequent actions, the only safe assumption for local business is that the union will not make EBAs which are 2016 Code compliant.

That time is now upon us! After 1 September 2017, businesses that do not have 2016 Code compliant industrial relations arrangements will not be awarded Commonwealth work. (NB: This includes non-Commonwealth work where the Australian Government’s contribution to the project is at least $10 million; or, is at least $5 million and this represents at least 50% of the total construction value. This may include some ACT Government work).

Businesses have three possible options to fix this problem and stay 2016 Code compliant:

Shortly after the 2016 Code was made law, ALP Senator Doug Cameron put on a motion in the Senate to disallow the 2016 Code – this was a curious move – a disallowance motion is essentially a slip rule which enables the Senate to pull an instrument that was just made into law. On 9 August 2017 the motion to disallow the Code for the Tendering and Performance failed to pass the Australian Senate.This means the 2016 Code is here to stay.

Many local businesses are still sitting on their 2013 union EBAs. These are not good enough. The 2016 Code forbids written unregistered agreements between employers and employees – even if it is to grant a pay raise. Therefore it is not practical to simply remain on these EBAs indefinitely.

Terminate your old EBA and go back to the award. This can be a tricky process and usually requires an appearance in the Fair Work Commission.

2.

Replace your old union EBA with a Company Specific EBA. MBA can assist with this process.

3.

Approach the union to see if they will make a 2016 Code compliant EBA.

For the reasons discussed above, option 3 may not be viable. The 2016 Code transition deadline is fast approaching. For companies with EBAs made after 25 April 2014 – you are rapidly running out of time to make a 2016 Code compliant EBA. Health and Safety Representative (HSR) Training A person conducting a business or undertaking is not required to have an elected health and safety representative as part of their activities, however, if a worker requests a health and safety representative be elected, the person conducting a business or undertaking must comply. Health and safety representatives play an important role in support person conducting a business or undertaking in complying the legislative requirements in consulting with works [s47(1) Work Health and Safety Act 2011 (ACT)].

Refresher training is aimed at ‘refreshing’ the knowledge of the worker after the initial training has been completed. It will keep health and safety representatives up-to-date with any legislative changes. It will also allow health and safety representatives to improve their skills and knowledge in the activities performed regularly, and refresh their skills and knowledge in activities not preformed regularly.

Represent the workers on health and safety matters Monitor the activities undertaken by the person conducting a business or undertaking to comply with the Work Health and Safety Act 2011 Investigate complaints from workers about health and safety, and Inquire into anything that appears to be a risk to the health or safety of workers from the conduct of the person conducting the business or undertaking

It should be noted, a person conducting a business or undertaking must allow health and safety representatives paid time to attend training. Training should be arranged within three months after the request for a health and safety representative is made. The person conducting a business or undertaking must pay the course fees and any other reasonable costs associated with the health and safety representative’s attendance at the training.

Untrained health and safety representatives can perform all other functions. Health and safety representatives are entitled to attend an initial training course of five days. They are also entitled to one day’s refresher training each year, with the first refresher training commencing one year after the

NAWIC (ACT) launches 2017 CEO Shadow Program by lauren gray

On Thursday 29 June, the National Association of Women in Construction (ACT) launched its ‘CEO Shadow Program’ representing a unique opportunity for aspiring female leaders to learn firsthand from some of the most dynamic and successful leaders in the construction industry.

The program commenced with a ‘meet and greet’ hosted by Wisdom Learning, in which the Shadows met their CEO’s and participated in a structured development session to kick off the program. Jemma Butt, Project Engineer at GEOCON who is participating as a Shadow in the program, says she hopes to gain an understanding of the reality of being a CEO in different organisations within the local construction industry. Jemma said ‘I think this program is an invaluable opportunity to learn about different career pathways to the CEO role, based on the mentors’ experience and their knowledge of the industry.’ At the program’s launch, Jemma said she was most excited about being exposed to the different ways of approaching corporate management and work-life balance. As part of the program, shadows have the opportunity to spend two full days with their respective CEO’s to gain an appreciation of the activities and problems faced on an ‘average’ day of a senior leader in the company. In looking at the driving force behind the program, Lisa Dart, President of NAWIC ACT says she was always very fortunate in her career to have always had the support and comradeship from managers, peers and colleagues. Lisa says she launched the program to open the doors for women in the industry to experience the mentoring and sponsorship that she continues to receive, ‘I took a tested framework and with the help of Jana Clyde at Wisdom Learning, who now facilitates the program, we modelled the program to fit the vision I had for the Program here in the ACT.’

to her that there was an eagerness on behalf of leaders to share knowledge and experience, and provide unconditional support and guidance. Participants will have the benefit of leadership development training by Wisdom Learning, to complement their ‘shadow’ days with the CEO’s. Ms Dart says it was important for both the CEO’s and the Shadow’s to work toward ‘key learning outcomes’, hence the development sessions incorporated into the program. Ms Dart says ‘I wanted the group to connect and create a lasting support system and reference point. I wanted it to be a journey that was fun, rewarding and memorable. I wanted it to open opportunity for our potential future female leaders.’ This is the second year that the program has been running, and Ms Dart says she’s proud to see the return participation of last year’s CEO’s as ‘this signifies to me that the program is a success and the industry endorses the philosophy of the CEO Shadow Program.’ The program will conclude on 24 August with a graduation and reflection session, and shadows will be awarded Certificates of Participation at the annual NAWIC (ACT) Awards for Excellence on 15 September. NAWIC thanks its sponsor of the program, the Training Fund Authority, for its invaluable support. Lauren Gray, NAWIC (ACT) Committee Member, Senior Lawyer at Meyer Vandenberg Lawyers. Lauren is also participating as a ‘Shadow’ in the CEO Shadow Program.

Lisa Roberts, Co-founder, Owner and Managing Director of Provincial Plants and Landscapes, who is offering her time as a CEO in the program says she would have loved the opportunity to pick the brains and model the behaviour of other successful professionals through a program like the NAWIC CEO Shadow program. At the launch of the program, Lisa said ‘I’m sure it could have saved me a lot of time, mistakes and stress by delving into the workings of an inspirational organisation and seeing what it takes to be a CEO and leader and how to grow a great business and life without having to reinvent the wheel.’ Ms Roberts describes the CEO Shadow Program as an innovative and flexible way to ‘learn a lot and receive a lot quite quickly’, saying it is a ‘win-win for both parties who each teach and learn, share and develop.’ Ms Dart says she has crossed paths and worked with many successful and influential leaders in this industry and it became very clear

Master Builders ACT sign memorandum to improve mental health among tradies

OzHelp celebrate 15 years of supporting construction workers OzHelp CEO Tony Holland with MBA Executive Director Kirk Coningham after signing the MoU

The 15 year partnership between OzHelp and Master Builders ACT was sealed with the signing of a Memorandum of Understanding (MOU) on 22nd August and aims to improve mental health and prevent suicide amongst Canberra’s construction workers. Master Builders ACT is a foundation member of OzHelp and has remained a strong continuous supporter of OzHelp since its commencement. Signing of the MoU cements the commitment to provide FREE ongoing mental health services to all members including Workplace Tune-Ups, Counselling and A.L.E.R.T workshops to name a few. The construction industry employs more than 14,000 people across the ACT and region, making it the second largest employer in the Territory and the statistics surrounding suicide in this industry are quite confronting with construction workers more than twice as likely to suicide as other people in Australia, and apprentices in construction two and a half times more likely to suicide than other young men their age - according to recent reports from Mates in Construction and PricewaterhouseCoopers in April 2017. With these facts in mind, it becomes increasingly important for employers to understand and support their employees and to consider that the people they employ are likely to have experienced mental illness at some point. Tradie Health Month provides a timely reminder to all members of Master Builders ACT about workplace mental health and are encouraged to book their workplace in for a FREE Workplace Tune-Up screening as a starting point.

On Friday August 11, one of Australia’s leading mental health charities celebrated 15 years. Master Builders ACT, along with the CFMEU and the ACT Government combined to provide a service to focus on reducing suicide in the Building Industry, follow the death of three young apprentices in 2000. MBA ACT and OzHelp have been partnering in the life saving work that is provided to the building industry in Canberra and we are proud to formally acknowledge the long association with this outstanding organisation. The photos on this page show many old faces FROM THE EARLY DAYS INCLUDING David Dawes and Gary Humphries, as well as many current members of the building industry there to offer their support. Guest Speaker - Allan Sparkes CV,OAM,VA Allan is one of Australia’s most highly decorated citizens. He is one of only 5 Australians in the past 42 years to receive Australia’s highest bravery decoration and civil award, the Cross of Valour (CV). He is also the recipient of the Medal of the Order of Australia (OAM) for service in support of mental health organisations and the community. In August 2016, Allan was awarded Australia’s 4th highest bravery decoration, the Commendation for Brave Conduct for saving the life of an aboriginal man who had fallen onto the path of an oncoming train at Redfern Railway Station. Allan is also one of only 10 Australians to be awarded the Queens Diamond Jubilee Medal along with other significant awards for bravery and service. Allan is a corporate speaker, an international yachtsman who has sailed across the oceans of the world and a best-selling author with Penguin Books Australia, His book, The Cost of Bravery, was published in 2013 and reprinted in 2015. His great friend, Mr Ray Martin AM wrote the forward for the book. To resolve these issues SHAPE, proposed to extend the existing building using modular construction technologies over an existing slip road. This provided staging space to then progressively refurbish the entire emergency department leading to a significantly less disruptive and ultimately far improved result. Construction commenced in a staged manner and included an 800m2 extension over an existing road, a 470m2 extension of the existing resuscitation bays into the Ambulance Forecourt (while maintaining Emergency operations within both spaces) along with 2000m2 of refurbishment.

Interim Emergency Department Expansion project originally began as a feasibility study of the extension to the existing building to accommodate a Paediatric Streaming area for young children receiving emergency care. The initial study was identified that it was impossible to deliver the proposed scope within the confines of the existing building fabric without causing severe disruptions to the operations of the Emergency Department which simply was not allowable.

Lovegrove Park is an all-abilities playground situated in Googong. The playground was specifically designed to accommodate children with a range of abilities. Custom designed equipment installed includes slides, rides, and various other features incorporated to ensure no child would be excluded. There are also BBQ’s and shelter for families to enjoy a day out. Glascott Landscape & Civil were engaged to construct the playground having delivered multiple stages at the Googong Township. Construction included earthworks, stormwater installation, electrical, irrigation, Palisade fencing, carved totem poles and a big mounded slide. To encourage community involvement in the construction of the playground, Glascott engage with The Anglican School Googong where teachers, students and their families were invited to a BBQ and to paint the totem poles that formed the boundary fence, leaving their mark on the playground.

Canberra Contractors was required under Throsby Stage 2 Residential Estate contracted recommended obligations to broadcast by hand or mechanical spreading 83,696 kg of Superfine lime & Gypsum to, the project verges and open space covering 104,620 m2.

Downer EDI Works - Red Zone Mission Possible Downer has identified plant / pedestrian interaction as one of their major hazards in the workplace. As a result, Downer held a forum comprising of employees from all elements within Downer to implement a control that is both practical and easy to understand.

Mission Possible – Red Zone, was introduced to over 3000 people within 6 capital cities and 7 regional hubs nationwide, covering the whole Downer Australia roads business to help ensure the safety of employees, clients, subcontractors and members of the public.

IC Formwork - Wayfarer by GEOCON GEOCON nominated IC Formwork for their proactive approach to controlling risk of falls through the erection of formwork frame at heights greater than nine metres at the WayFarer project. After a number of pre-construction meetings and consultation between IC Formwork and GEOCON, ICF organised a workshop at their own premises to assess which process of erecting frames would best eliminate or reduce the risk of fall. Once the preferred method was agreed by both parties, IC Formwork focussed on developing a safe method, with the SWMS including a step by step process using photographs to make it easy for workers to understand and implement.

As a result of IC Formwork’s careful planning, attention to detail, and communication methodology, the safety outcomes with respect to reduced injury from falls at the Wayfarer project were significant: no fall-related incidents from formwork installation were recorded for the duration of the project.

Mr Fluffy is the name of a company that installed loose fill asbestos insulation in Canberra homes in the 1960s and 1970s, primarily into roof spaces and wall cavities. Prompted by growing public concern about the health hazards of asbestos, a 1988 audit identified most of the homes in the ACT that were affected. The ACT Government conducted a clean-up of these houses between 1989 and 1993. The clean-up proved to be ineffective in that residual asbestos was subsequently found in dwellings previously thought to have been fully “cleaned�. Following concerted public pressure, the ACT Government moved to demolish all 1,022 asbestos-affected properties.

“Manteena and Brema had an unenviable task to safely demolish the ageing Currong Apartments in the middle of the city and adjacent to another block of apartments that were literally a lane way apart from the work. The team spent an enormous amount of time planning every detail ready for demolition which was complicated by asbestos finds of significant risk to workers and the community as well as the challenge of tens of “sharps” finds each day. The team designed a special excavator with camera and water spray heads that could reach to the highest floors and munch through the structure and safely deposit the emulsified material to the ground. Workers were provided with special clothing to protect them from the cold and exposure to the materials. Safety was the first and only priority and was achieved without recourse to non - compliance of WHS regulations.” Judge Denis Wilson

New Transition Arrangements for LVC Schedule 1 Fees Announced Master Builders ACT has received confirmation from the ACT Government of extended transition arrangements for the new LVC Schedule 1 fees for a variation to limit the maximum number of dwellings permitted on the land under a residential lease. Last month, the local property and construction industry was shocked to read about a significant increase to the LVC which would apply to certain residential leases. Under the announced changes, the codified Lease Variation Charge required to enable unit titling on certain residential leases would have increased to a flat fee of $30,000 per dwelling (up from $7,500). We have now received formal advice by letter dated 18 July 2017 of an extended transition arrangements. The advice reads: The previous LVC Schedule 1 fees will apply to properties purchased between 1 July 2016 and 30 June 2017.This is conditional upon the applicant submitting the Development Application (DA) by 30 September 2017, and the DA being lodged with all required information (that is, having passed the completeness check) by 30 June 2018.The Disallowable Instrument will be updated to reflect these arrangements. In cases of lease consolidation where the final property in a consolidation was purchased between 1 July 2016 and 30 June 2017, proponents can also apply to have the previous LVC Schedule 1 fees apply.These requests will be considered by the Treasurer on a case-by-case basis, and should be forwarded to him directly. As above, this arrangement is conditional upon the DA being submitted by 30 September 2017 and lodged with all required information (that is, having passed the completeness check) by 30 June 2018. In addition to these changes, the government has committed to:

Review of the LVC Schedule 1 scheme in 18 months’ time, and A deferred LVC payment arrangement following consultation with industry in coming weeks.

The extended transitional arrangements will assist industry members that had already purchased properties by giving them an extended period of time to submit a development applications. However, the MBA remains concerned at the quantum of LVC and its impact on achieving the government’s urban renewal and housing affordability policy objectives. We remain committed to working with the Government to ensure appropriate policy settings are in place to encourage a diverse supply of quality affordable housing in the ACT. If you have a project that you believe is affected by the new LVC charges, we recommend you contact the Environment, Planning, and Sustainable Development Directorate as a priority to discuss the applicability of the transition arrangements. COLD WEATHER CONCRETING PRACTICES Care of fresh concrete seems to be something people are most concerned about during summer. Unfortunately the winter months can offer just as many issues with the effects of wind on rates of evaporation, frozen substrates and overnight frost having a huge impact on the concrete’s performance.

Even with low temperatures, the air can remain very dry and wind alone can impact on the rate at evaporation related to cracking in concrete. Curing is still necessary, even in the colder months, to protect your concrete.

It is recommended that concrete remains protected from freezing for at least 24 hours after it is placed. Freezing in this time can have effects on strength gain and expanding water can cause delamination and flaking of the surface.

The effects of rain on freshly placed concrete may only be some slight surface imperfections caused by the impact of the rain. It can also result in more serious issues when the water:cement ratio is increased to the point where sections surface delamination and loss of strength occur. As a general practice never work rain water back into a concrete surface.

With thicker slabs it’s important to protect the concrete from thermal cracking. This can occur when the external/surface temperature of the concrete falls too quickly compared to the internal temperature of the concrete section. Curing blankets, thermal formwork and other protective measures can be taken to mitigate this risk.

Sometimes it feels like the only way to get a true result on the right weather for concreting is to carry a small weather station around with you. Even if you can access site specific data you might need to phone a friend at NASA to work out your cracking potential through the Evaporation Calculation of E = 5 ([Tc + 18] 2.5 -r [Ta + 18] 2.5 ) (V+4) x 10 -6 Now you can fit it all in your pocket thanks to the Cement Concrete & Aggregates Association (CCAA). Their new Smart Concreting App offers site specific weather information and an overview of cracking potential based on your actual pour location. This free App provides an overview of current weather conditions for any given location alongside an overview of best practices to achieve a desired outcome. The App even offers a week’s forecast to assist with planning your pour and putting measures in place such as the use of wind breaks, aliphatic alcohol or the dreaded “no pour day”. MBA Representing Member’s Views to the ACT Government by michael hopkins Deputy Executive Director

The MBA team has been busy over the last quarter working with the ACT Government to review draft building and planning laws, advocating for red tape reduction, driving building quality reforms, making submissions to a number of committee inquiries, and advocating for greater transition arrangements for new taxes. Below is a brief summary on these efforts.

Exemption Declaration Factsheet After working with MBA Landing and Planning Group, the Environment Planning and Sustainable Development Directorate (EPSDD) have released a new Exemption Declaration Factsheet. An overview of these application processes was presented by EPSDD staff at the MBA office on 24 August. Check out the Events page on the MBA web site for further information. New Transition Arrangements for LVC Schedule 1 Fees Announced Industry has received confirmation from the ACT Government of extended transition arrangements for the new LVC Schedule 1 fees for a variation to limit the maximum number of dwellings permitted on the land under a residential lease. Last month, the local property and construction industry was shocked to read about a significant increase to the LVC which would apply to certain residential leases. Under the announced changes, the codified Lease Variation Charge required to enable unit titling on certain residential leases would have increased to a flat fee of $30,000 per dwelling (up from $7,500). We have now received formal advice by letter dated 18 July 2017 of an extended transition arrangements. The advice reads:

The previous LVC Schedule 1 fees will apply to properties purchased between 1 July 2016 and 30 June 2017.This is conditional upon the applicant submitting the Development Application (DA) by 30 September 2017, and the DA being lodged with all required information (that is, having passed the completeness check) by 30 June 2018.The Disallowable Instrument will be updated to reflect these arrangements. In cases of lease consolidation where the final property in a consolidation was purchased between 1 July 2016 and 30 June 2017, proponents can also apply to have the previous LVC Schedule 1 fees apply.These requests will be considered by the Treasurer on a case-by-case basis, and should be forwarded to him directly. As above, this arrangement is conditional upon the DA being submitted by 30 September 2017 and lodged with all required information (that is, having passed the completeness check) by 30 June 2018. DA red tape reduction - owners details Delays lodging and assessing development applications can be costly, frustrating and time consuming. The MBA is currently working with ACT Government on a number of administrative improvements to minimise these frustrations. One of the most common red tape issues occurs when the owners detail on DA forms do not match the ACT Government land register because of time delays registering new owners details. We are currently working with the Directorate on an administrative solution to this common problem.


Building Quality Reforms

Getting Home Safely Review

Improving building quality is a high priority advocacy issue. In response to the MBA’s on-going advocacy efforts, the Government established the Building Regulatory Advisory Committee (BRAC) to oversee reforms to the building regulatory system.

MBA has been actively involved working with RMIT and WorkSafe ACT on the review of “The Getting Home Safely Report”. MBA has responded to the online survey conducted by RMIT and have encouraged MBA members to participate in the survey. In addition to the online survey, MBA and a number of our members have contributed to the focus groups organised by RMIT researchers.

In recent BRAC meetings, the wide ranging recommendations previously announced by Minister Gentleman have been narrowed to focus on the builders licensing recommendations (including investigation of trade contractor licensing), and the introduction of continuing professional development training for the construction industry. The MBA is supportive of government focusing on these key priority actions and will work with government to ensure these measures improve building quality, without imposing an unnecessary cost burden on industry. Pre DA Community Consultation Guidelines for Prescribed Developments The ACT Government is seeking industry feedback on draft predevelopment application (DA) community consultation guidelines. Pre DA consultation by the developer is required under Section 138AE of the Act for prescribed developments. The prescribed developments that will be captured by the guidelines include:

a building for residential use with 3 or more storeys and 15 or more dwellings; a building with a gross floor area of more than 5,000m2; if the development proposal is for more than 1 building - the buildings have a total gross floor area of more than 7,000m2; a building or structure more than 25m above finished ground level; a variation of a lease to remove its conce ssional status.

Submissions have recently been made to a number of Legislative Assembly Committee Inquiries. Inquiry into the extent, nature and consequence of insecure work in the ACT This inquiry will investigate insecure work in the ACT, including Group Training organisations and Labour Hire Firms. A copy of all submissions to this inquiry, including the MBA ACT’s submission, is now publicly available on the Legislative Assembly web site. Hearings into the inquiry will be held in September. Inquiry into the Planning, Management and Delivery of Road Maintenance in the ACT A submission from the MBA’s Civil Sector Council has been made to highlight the importance and value to the Territory of continuing to use local contractors to undertake road maintenance. Submission to ACT 2017-18 Budget The MBA’s submission to the ACT budget was submitted in July. Our submission focused on the capital works program, the land release program, and the unexpected Lease Variation Charge increases. A copy of the MBA’s Summary of the ACT budget for the Construction Industry is available on the MBA web site. Inquiry into Housing in the ACT An inquiry into housing in the ACT has been announced by the Government. This is an important inquiry which will allow the MBA to contribute solutions to the ACT’s increasing housing policy issues, including land affordability, planning and building restrictions, housing diversity, and taxation policies. Submissions are due in October 2017, with a final report anticipated to tabled on the last sitting day of 2018. Canberra Building News I edition 3-2017

Meyer Vandenberg’s Special Counsel, Wendy Meredith said “we often see many young clients starting out in their own business who aren’t sure about the structures and agreements they need for their business to grow. Often these documents contain guarantees which can take a variety of forms. Jamie Lucas from BellchambersBarrett Accountants said, “many new businesses believe they cannot afford legal and accounting advice when they are first starting out business, thinking they can always get advice a few years down the track when the businesses cash flow has improved. However, getting good taxation advice up front can save new businesses thousands of dollars, and will put in place good business management practices from the beginning”. What many small businesses don’t realise is that they may need to submit company financial statements in order to be pre-qualified for ACT Government or Commonwealth Government work (even as a subcontractor), if they are applying for home warranty insurance, or in some cases even if they subcontract to a large private sector head contractor. Stewart Ball from Dun and Bradstreet, said “Governments and insurers typically look for positive Working Capital and positive Net Tangible Assets, as signs of a healthy businesses. Meyer Vandenberg Lawyers It was an action packed financial year for our building regulatory regime. Not only did we see the first tranche of what we hope will be broad ranging positive amendments to our Building Act 2004, but the ACT Supreme Court has been busy putting its own spin on the way that legislation currently operates. Helkeast Pty Ltd v Ruckschloss [2017] ACTSC 65

Dunn v Hanson Australasia Pty Ltd [2017] ACTSC 169

This case involved a claim in negligence against Ruckschloss, the engineer, for defective design of a building. Ruckschloss brought an interlocutory application arguing the claim was statute-barred as a result of the provisions in the Building Act which limit claims for ‘building actions’ to 10 years from the certificate of occupancy.

This is an interesting decision for a number of reasons, but particularly important for its analysis of the overlapping provisions relating to apportionment of liability.

Acting Judge Walmsley however found that the work of an engineer in preparing design plans and a certificate relating to structural sufficiency was not ‘building work’ or ‘construction work other than building work’, and therefore not covered by the Building Act. By analogy the same reasoning would apply to architects and other consultants not required to be licensed under the Construction Occupations Licensing Act. The limitation period therefore did not apply, and the plaintiff was entitled to pursue the claim.

The case involved a development on a block in Macgregor. The land was originally owned by Ms Cai, who engaged Hanson Australasia Pty Ltd to build the residence. Mr Lau was the director of Hanson. Mr Howard was appointed as certifier. Ms Cai then sold the house and land to the Dunns, with settlement to occur on completion of the build. This happened in 2010. When defects emerged, the Dunns sued everyone involved. They sued Hanson for breach of statutory warranties and also misleading and deceptive conduct under the (then) Trade Practices Act 1974 (Cth) (TPA) for misrepresenting that the house would be built properly. They sued Mr Lau, the director, for ancillary liability under the TPA. They sued Ms Cai for breaching conditions of the contract for sale that the house would be constructed in a proper and workmanlike manner including all specified inclusions. And they sued Mr Hanson for negligence in his duties as a certifier.


The claim against the certifier was settled prior to hearing for the sum of $75,000 – presumably because an insurer was involved. Default judgment was awarded against the vendor / developer who did not take any active part. The builder and its developer consented to liability, with damages to be assessed. The decision therefore focussed on the assessment of damages and the application of the overlapping pieces of proportionate liability legislation. Relevantly, the Building Act in relation to ‘building actions’, the TPA in relation to misleading and deceptive conduct, and the Civil Law (Wrongs) Act 2002 in relation to claims arising out of a failure to take reasonable care.

After finding that the loss suffered by the Dunns relating to defects was $346,770, and their losses relating to missing inclusions were $39,440, the court found that the liability for defects should be split 85/15 between builder and certifier for breach of statutory warranties & negligence. However this finding was irrelevant. The claim against the certifier had settled, and the court went on to find that the builder and its director were also each jointly and separately liable for the full defects amount $346,770 as a result of misleading and deceptive conduct. The vendor / developer was also separately liable due to breach of contractual warranty for the full amount of the defects, plus the missing inclusions, totalling $386,210.

Justice Mossop found that: • The claims against the builders for breach of statutory warranties and the certifier for negligence were ‘building actions’ and therefore the Building Act apportionment applied. They were not claims arising out of a failure to take reasonable care and therefore the Civil Law (Wrongs) Act was irrelevant. • The claim against the vendor / developer was not a ‘building action’ because it did not arise out of a construction contract, but a sale of land contract. It was also not a claim arising out of a failure to take reasonable care, or a claim under the TPA. Therefore no apportionment applied. • In respect of the TPA claims for misrepresentation against the builder and the director personally, they were not ‘concurrent wrongdoers’ in the sense that made the claim apportionable under the TPA. There were not two different acts that made both parties liable – rather both were jointly and separately liable for the same misrepresentation.

The practical effect of these findings is that the Dunns can now choose who to pursue, up to the full amount of the award against that party. Further Building Act changes The changes that were notified in August 2016 have been described as the ‘first tranche’. A large number of the changes, particularly the extension of statutory warranties to all residential buildings regardless of height, are yet to commence. These are due to commence by default on 19 August 2017. The first tranche of changes largely set up a framework for further regulation to be made, including for guidelines and codes of practice, and standard form residential contract terms. There has been little published by the ACT Government in relation to the ‘second tranche’ of changes to our regulatory regime. Hopefully the momentum has not been lost as there is still a lot to be done to rationalise our legislation.

National Update Technical Services Australian Building Codes Board Master Builders Australia has opportunity to make comment on fire safety in high rise buildings, in relation to changes proposed in the second Building Codes Committee meeting of 2017 following the Lacrosse Apartments fire in Melbourne. The Public Comment Draft of NCC 2016 Volume One Amendment 1 was released on the 14th August. This amendment is a result of a Building Ministers’ direction to the ABCB to expedite completing and adopting actions involving changes to the NCC from the comprehensive package of measures for fire safety in high rise buildings. Master Builders Australia generally supports the changes proposed. However, we will be having a closer look over the coming weeks. Those with an interest in providing comment are encouraged to contact Max Rafferty and Alex Waldren in the National Office by 30 August 2017 for inclusion of any comments in a National Office submission. Adoption of the amendments is anticipated in March 2018, following consideration of responses received. The Amendment primarily clarifies existing provisions of Volume One and includes:

The introduction of a new Verification Method for testing of external wall assemblies for fire spread. This includes a new testing standard, AS 5113, to be used as part of the Verification Method, which achieves equivalence to the Deemed-to-Satisfy Provisions by including additional fire safety measures within the building (e.g. an enhanced sprinkler system) as a condition of using an AS 5113 tested wall assembly; Increased stringency for the sprinkler protection of balconies of residential buildings through referencing of a revised AS 2118; Clarifying language within the code relating to the use of external wall claddings and attachments; and Revision of the NCC’s evidence of suitability provisions. The ABCB is also pursuing a number of additional measures to address the non-compliant use of external wall claddings. These include: Communication of the national ABCB Advisory note – Fire Performance of External Walls and Cladding, which will be updated to reflect any changes associated with the out-of-cycle amendment; Development of an evidence of suitability handbook, which includes the introduction of voluntary Product Technical Statements as a form of documentary evidence; Improvements to the CodeMark Australia product certification scheme; and The development of education and training materials.

The current Performance Requirements of the NCC relating to preventing the spread of fire within and between buildings and allowing occupants of buildings adequate time to escape, along with the requirement for external walls in buildings of Type A and B construction to be non-combustible if using a Deemed-to-Satisfy Solution, will not change. New Housing Finance Continues To Beat Expectations In June Finance commitments for new dwellings jumped 3.6 per cent in June 2017, supporting an outlook for a sustained level of new housing construction activity for the rest of 2017. These latest statistics provide further support for our outlook for new housing construction to keep at high levels for the rest of the year, before we see some weakness emerge next year as the pipeline of apartment construction activity (particularly in Sydney) starts to thin. Investment housing also had a positive month, with investment fixed loans increasing by 1.6 per cent. But more importantly, investor loans into the construction of new dwellings jumped by over 26 per cent, to record the highest month for investor activity into new housing construction since November 2016. Victoria, Queensland, the NT and the ACT all recorded positive growth in the value of housing commitments.

Industrial Relations Government listens to Master Builders - confirms changes to stop super-union Master Builders has welcomed news that the Government has responded to our advocacy about the proposed MUA/ CFMEU/TCFUA ‘super-union’ and union officials who repeatedly break the law without apparent consequence. The Government introduced a bill to amend laws that affect Registered Organisations (‘ROs’) to prevent unions from merging if they have repeatedly breached the law. The Bill will also toughen laws relating to officials who repeatedly break the law without consequence by giving the Fair Work Commission and Federal Court powers to deregister unions and disqualify officials. This is the most significant and positive outcome for workplaces in the building and construction industry since the ABCC was reestablished.

These were some of the questions posed to a Construction Technology Workshop facilitated by the CBR Innovation Network and Master Builders ACT in July.

Master Builders ACT Executive Director Kirk Coningham opened the workshop by acknowledging that design and construction principles were developed centuries ago, and remain in practice in the modern day building industry. “The local ACT industry is well placed to build upon those tried and tested construction principles with current day technology.” “The ACT can be a construction innovation leader because of the quality of our education establishments, the commitment of our local construction industry and talent of our tech entrepreneurs. Already Canberra had produced local success stories such as SignOnSite, developed by Mitch Harmer”, said Kirk. Another example of new technology is Building Information Modelling (BIM). BIM technology is already used by many global contractors and is gradually emerging in more Australian projects, especially for the Defence industry.


The University of Canberra’s Robyn Hardy said “Building Information Modelling (BIM) is arguably the most exciting development in the construction sector in the last decade. Visualisation of projects via 3D, 4D and 5D modelling capabilities enhances the quality of communication, enables coordination of the project process, can reduce the number of errors and clashes, should minimise rework, improve logistics and supply chain systems and deliver precise project information.” The University of Canberra has incorporated BIM into a number of different subject areas in its Building and Construction Management Degree programs as well as introducing a specific new compulsory unit of study in BIM. Very early in their study program, Building students are introduced to 3D drawing tools. This is complemented with scheduling and costing tools in subjects such as Project Management, Quantity Surveying and Contract Administration. In their final year, students complete a dedicated unit in BIM where they learn about the theory and concepts of BIM, its adoption levels, the current standards and guidelines of BIM implementation and construction project coordination using BIM. Students are taught how to apply this knowledge in a real case study in 3D, to integrate the model with the time dimension to generate 4D, grasp 5D BIM via cost integrated modelling and run technical clash detection. “Finally, the UC’s staff are seeking to promote innovation and technology adoption even more broadly through the planned introduction of new subjects and programs, such as a Graduate Certificate of BIM and a Master’s degree of BIM in the near future”, said Robyn. Local construction companies should also be on the lookout for new technology to help with the running of a small business. One local entrepreneur is Michael Monck, the founder of Lockr. Immediacy required in releasing incident information While discussing current issues with a representative from a large national construction company, the representative mentioned a recent incident that had occurred on one of their sites. The incident, a near miss, occurred while workers were following an innovative process the company had developed. During the investigation it found process was implemented through on-the-job training with poor record keeping of the training occurring and the process had deviated from what was original intended.

Before the investigation had been officially completed, the company had written a formal procedure, developed a training program schedule for the whole company, and started ‘rolling out’ the training.

The second is a Weekly Incident Summary produced by the NSW Resources Regulator’s Mine Safety unit. The report provides information on reportable incidents and safety advice for the NSW mining industry. The summarised incidents are ‘incidents of note for which operators should consider the comments provided and determine if action needs to be taken’. This report again lists the incidents in table form under the following headings: Incident type; Summary; and Comment to industry. The Comment to industry gives the report it usefulness by providing recommendations to the mining industry based on the preliminary investigation findings, and relating these findings back to the requirements on the relevant Acts, regulations, Codes of Practice, Australian and International Standards, and industry standards. While in some cases the comments are ‘motherhood’ statements, others provide information on corrective actions to be implemented.

The discussion then went on to the recent newspaper reports of a retaining wall collapse at Kingston. It was noted, while information on the incident was public, nothing had been released by WorkSafe ACT. This again highlights the calls by Master Builders ACT for more immediacy in releasing information on incidents, especially recommended corrective actions. While no two incidents are alike, and the circumstances leading up to each incident are varied and often complex, the learnings from each are applicable across the entire construction industry. This is especially true for near misses, as they are ‘a free learning opportunity’. Subscribing to a wide variety of newsletters (including all states and territory work health and safety regulators), two regulator reports provide relatively current information. The first from WorkSafe Victoria is linked to their Safety Soapbox, which is published fortnightly. The report is a list of all notifiable incidents to WorkSafe Victoria from the construction, utilities and mining sectors during the previous two weeks. The report simply lists all notifiable incidents

Refresher training is training aimed at “refreshing” the knowledge of the worker after the initial training has been completed.

As our understanding of how the Work Health and Safety legislation sets minimum standards to protect workers and others, and our health and safety management practices mature, the vexed question of refresher training raises its ugly head. Where this important part of ensuring worker competency once existed in the “if we have to” category, it now needs to be considered to reduce risks so far as reasonably practicable.

Refresher training is training aimed at “refreshing” the knowledge of the worker after the initial training has been completed. Some refresher training is required by law, such as Health and Safety Representatives [Reg21(1)(b) Work Health and Safety Regulation 2011 (ACT)] and first aid (First Aid in the Workplace Code of Practice). These requirements have been set by the legislature (through the Intergovernmental Agreement for Regulatory and Operational Reform in Occupational Health and Safety) and are based on the assertion that unless refreshed the knowledge level required to keep these workers or others healthy and safe will be reduced over time. Setting blanket legislative requirements such as those mentioned above can be beneficial, as it ensures a minimum level of competence is maintained. The question needs to be asked, how is this time lapse between training events determined? One worker may be extremely competent at the time of their mandatory refresher, whereas another worker’s level of competency may have diminished in a matter of days after the initial training. Sound familiar? The problem is making

specific training mandatory may lead to a tick box and off the shelf training philosophy, with a perception all is OK. Beside the mandatory requirements, when is refresher training necessary? The standard reply when the requirement for refresher training is questioned is “it’s industry best practice”. Industry best practice normally comes from the practices of large organisations or so-called industry leaders specifying a mandatory refresher training period for their workers, or as a result of international legislative requirements filtering through large multinational corporations. Generally, these industry leaders have identified, after a set period, the chances of a worker failing to remember particular elements of the training has diminished to a point where the risk has increased to an unacceptable level, justifying the refresher training. The theory of skill fade1 reinforces the fact that knowledge retention diminishes over time. There are many possible reasons for this, including the quality of the training, relevance to workplace activities, the use of skills attained, a lack of a training needs analysis and knowledge prioritisation2. But this reinforces that fact skill fade does exist.

A normal reaction whenever refresher training is raised is: “I’ve been doing this for 20 years, why do I need refreshing?”. This, of course can be dismissed: after long periods of doing the same tasks, shortcuts, workarounds and complacency do set in. Exacerbated by legislative changes, technological advances and/ or the development of improved systems—the level of risk to workers and others increases. In order to manage health and safety effectively, an effective health and safety management system should be developed, implemented, maintained and reviewed. An important element of the management system is active monitoring, review and risk assessment. Through this process, gaps in workers competency can be identified and remediated through training. Over time, the results of the active monitoring and review of risk assessment may indicate that training needs to be refreshed or refresher training needs to take place. For example, refresher training may be required where the scope of the work performed has increased as the worker becomes more experienced, or refresher training may be required where a previously trained worker has not undertaken the work for some time. Refresher training may also be required in other circumstances, such as a change to the method of work and/or the environment in which the work is performed.

Simple HR Solutions to Reduce Business Risk by SHARON COSTIGAN

Regardless of how small your business is, if you have employees you have employment-related risks and liabilities. From unfair dismissal claims to wrong hires, the potential for problems is high and the impact can be big.

It’s not uncommon for a business owner or manager to spend hundreds of hours a quarter on a government enquiry and thousands of dollars on penalties and law suits, not to mention suffer the longterm effects of a damaged business reputation caused by a poor HR practices. But there are easy ways to dramatically reduce your risks. Even without an HR department you can – and should – implement HR systems or frameworks to protect your business. Below are a few of the top risks I see affecting businesses and simple solutions for prevention. 1. Staff don’t understand their employment conditions Solution: Put them in writing. Create a letter or contract of employment which clearly demonstrates employment conditions that include award, enterprise agreement, award free and links to the National Employment Standards. 2. Workplace investigation prompted by an employee complaint Solution: Establish an employee file that contains a copy of each employee’s application, signed contract, tax form, Superchoice form, position description and evidence you supplied the Fair Work Information Statement. Over time this file should also contain copies of other relevant documentation such as induction records, training certificates, letters and leave forms. 3. Wrong hire

4. Underperforming employee Solution: Create a simple performance review process.You are probably doing this every day with your staff anyway, you just aren’t documenting it. A performance management framework helps you work with a person who isn’t doing well to improve their performance. If, after instigating measures for improvement, your employee still isn’t cutting it, then the framework can support you to help them exit your company in a fair, ethical and compassionate way. 5. Employees not working consistently or making up the rules Solutions: Make sure you have sound policies and procedures in place so everyone knows what is expected, what their obligations are under a range of legislations and standards, and are all working consistently. And have a simple induction program that shows your staff have been inducted into safety and other workplace requirements and file evidence of completion. 6. Staff don’t have the right to work in Australia Solution: Implement a simple work rights register where you check work rights prior to employing someone. Keep up-to-date with visa requirements via the Department of Immigration and Border Protection website.
