Women in Construction...Absolutely The MBA is actively involved in encouraging women into the building and construction industry. We provide support during the training and education process, and continue working with these women when they’re employed in the industry. The MBA’s concerted action will significantly improve both recruitment and retention, and will inspire young women to think differently about the construction industry. It will also change society’s attitude so that women in construction becomes the norm rather than the exception. This edition features many stories of women working in the local construction industry including our own new female leaders as well as others from Asset Construction Hire and Ginninderry.
The MBA’s concerted action will significantly improve both recruitment and retention, and will inspire young women to think differently about the construction industry.
We are excited to announce that at the time of printing Canberra Builder, the MBA has been shortlisted for further evaluation under the 2018 ACT Women in Trades Grants Program. We look forward to a successful outcome in early June and to sharing the news of this new pre-apprenticeship program to commence in the second half of the year. I encourage you to read all of the articles in this issue of Canberra Builder and particularly recommend those that celebrate women in construction. Ginninderry’s balanced approach article highlights that more than 50% of their project team are women; Women are driving Asset Construction’s rental business; NAWIC’s International Women’s day (IWD) Scholarship is the most significant scholarship for female professionals in the property and construction industry. The MBA has just finalised its Workplace Gender and Equality Report and will be sharing these results soon. You’ll see that the MBA is leading by example with women holding significant positions in Senior Leadership. Not because they’re woman but because they’re the right fit. Denita Wawn CEO of MBA Australia is another great example, and I’m proud to be the first female president of Master Builders ACT. Recruiting more women will help address the skills shortage. Failure to do so will damage our future prosperity. Finally I would encourage young men and women to attend The MBA Open Day on Saturday August 25th between 10 and 3pm.

A MESSAGE FROM CHIEF EXECUTIVE OFFICER, MICHAEL HOPKINS
Strategic planning reconfirms the MBA’s vision and core values Six months after being appointed the Association’s CEO, and subsequently implementing a wide-ranging organisation restructure, I am pleased to report that all senior positions in our organisation have now been filled. The latest addition to our team is Ashlee Berry, who commenced in late April as our Legal and Compliance Director. Ashlee brings a range of legal skills to the MBA, with specific experience in the local building industry, and with an understanding of the needs of small businesses. Ashlee joins Liz Nair (Commercial Director) and Ken Crofts (Financial Controller), and myself as the Association’s senior leadership team. With a new team in place, the MBA Executive Committee, MBA Group Training Board and senior staff held a strategic planning day in late April to review and reconfirm the Association’s vision, core values and offer to members. In our more than 93-year history, Master Builders ACT has never been afraid to strive for excellence in our industry. Whether it be improving the safety culture on ACT work sites, shining a light on the practices of unions and union officials during the Royal Commission into Trade Union Corruption, or advocating for improved building quality, Master Builders ACT will always represent quality and excellence in the local construction industry. This vision and our core values were confirmed at the strategic planning day.
Demonstration of these core values, was the quality work of our local civil construction sector showcased on 11 May at the 2018 CCF Earth Awards. Examples of excellence in the entire ACT construction industry will then be on show on 29 June at the MBA Building Excellence Awards. The MBA also continues to advocate on behalf of members for improvements to the ACT building regulatory system. A number of the recommendations made by Master Builders ACT to the ACT Government have recently been confirmed at the Australian Building Ministers Forum. Improvements to the licensing system, the introduction of continuing professional development training, greater accountability of designers and certifiers, and addressing the increasing problem of non-conforming products, are all priorities for this reform. Finally, the announcement by WorkSafe ACT last month of its legal action in regard to the tragic death of a construction worker in 2016 highlights the shared responsibility of everyone in the industry to continue to improve the industry’s safety culture and outcomes. It also reinforces the strength of our current workplace safety laws and the importance of effective independent government regulatory agencies such as WorkSafe ACT to enforce them. Master Builders strongly supports the role of Workplace ACT to enforce compliance with workplace safety laws without which safety is undermined.

ACTU calling for revamp of Australia’s Industrial Relations System The Australian Council of Trade Unions (ACTU) is currently calling for a return to industry and supply-chain based bargaining, a recommendation which has caused employers across the country a great deal of concern. Secretary of the ACTU, Sally McManus first introduced this as a policy platform soon after her election to the position in 2017. Expressing dissatisfaction of the Fair Work Act, passed under a Labor government in 2009, McManus has accused the current enterprise level bargaining system of “smothering” wage growth in Australia. McManus’ statements correspond with the ACTU’s current social media campaign titled ‘#changetherules’, a title somewhat more moderate than her statements back in March 2017 urging employees to break so-called unjust laws.
It is a right that benefits both parties as it recognises that in a modern Australia, each workplace is different.
In order to place the ACTU’s criticism of our current enterprisebased bargaining system into perspective, it is worth detailing the process which must be followed for an enterprise agreement to be passed. Employers and employees may initiate bargaining where they find an aspect of an Award fails to allow a business to function as efficiently and profitably as it could. A minimum period of bargaining must pass before the agreement can be voted on. The agreement cannot pass without employees voting in favour of it. In order for an enterprise agreement to be legally binding, it must also pass through a rigorous assessment by the Fair Work Commission which certifies that employees are ‘better off overall’ under the agreement than they would otherwise have been under the relevant Award. It is difficult to see how the enterprise-based bargaining system can smother wage growth if an enterprise agreement cannot pass without employees being better off. One of the virtues of this system is it encourages flexibility which can itself assist employers to engage more workers. With declining Union membership, McManus’ statements may be nothing but sound and fury. At the end of the day, the Unions represent only a fraction of working people. However, the system we currently have in place took many years to refine and should never be taken for granted. Employers and workers should fight to protect the right to determine how best to organise their working relationship. It is a right that benefits both parties as it recognises that in a modern Australia, each workplace is different. WorkSafe ACT has confirmed that they are now rolling out the Apprentice and Young Workers Safety Program.

WorkSafe ACT is rolling out the Apprentice and Young Workers Safety Program WorkSafe ACT has confirmed that they are now rolling out the Apprentice and Young Workers Safety Program, which will include site visits throughout the ACT. Worksafe has indicated that further information and guidance material will be released in the near future. The current strategy is to concentrate on the following trades/groups: >> Electrical & Plumbing (now until June 2018); >> Construction (until October 2018); >> Hospitality (July 2018); >> Hairdressing and beauty industry (August 2018); >> Health and community workers (September and October 2018); and >> Automotive (November and December 2018). The program will focus on apprentices and young workers in core trades with responsibilities covering supervision, injuries and incidents, reporting of injuries and incidents, procedures and general education of apprentices’ in WHS. The role of supervisors will also be included. For further details on supervision please see the Building and Construction industry - Apprentice and trainee supervision guidelines on the Access Canberra website https://www.accesscanberra.act.gov.au/app/answers/ detail/a_id/3607/kw/apprentice The following information has been taken from the Building and Construction industry - Apprentice and trainee supervision guidelines.
Levels of Supervision. Supervisors must determine the appropriate level of information, training, instruction and supervision deemed necessary in order to protect workers from risk to their health and safety. This is especially the case for apprentices and trainees who, by the very fact that they are still working under an apprenticeship or traineeship scheme, will require a higher level of supervision than other workers. In determining the level and pattern of supervision for an apprentice or trainee in relation to work while in training, several factors should be taken into account. There is knowledge attained and the previous experience and training the apprentice or trainee has had relative to each particular task, skill or work function to be performed. The pattern of supervision for an apprentice or trainee will typically be direct, general or broad. For trainees completing a certificate I or II in construction it is expected that supervision will be direct/constant. For trainees completing higher level qualifications who have had previous industry experience, supervision requirements, should be applied following a risk assessment by the employer.

Increasing uptake of women in trades TRAINING UPDATE MBA has commenced the year with strong apprentice numbers both in MBA employed and user choice markets. MBA currently trains 40% of the ACT’s apprentice carpenters at our Skills Centre in Fyshwick. In addition I am proud of our commitment to attracting and supporting women in trades. MBA currently employs and trains 50% of the ACT’S female apprentice carpenters. The strength of our program weighs favourably on the block release training and flexibility of training dates. The team caters for industry peaks and accommodates employers to reschedule apprentices when required to meet workplace demands. Our trainers are all experts either currently working in industry or regularly returning to impart current skills onto aspiring apprentices entering this exciting industry.

WOMEN IN TRADES FUNDING SUBMISSION MBA has submitted an application to Skills Canberra seeking funding to support the uptake of female apprentices in the Construction industry through the Women in Trades Program Fund. The three key objectives of the program are to Increase the take up of women in a male dominated trade; Improve and expand employer-apprentice connections addressing barriers for employers and women to link and network; and contribute to the understanding of best practices for recruiting and retaining women in trades, and being able to promulgate findings more broadly. MBA has designed an innovative Work Insight Program comprising of a four week pre apprenticeship program providing exposure to the industry through, training, work site experience, engagement of industry employers, employees,

of Australian Government, State and Territory Ministers that has responsibility for building and construction matters. The report was authored by Professor Peter Shergold AC and Ms Bronwyn Weir, with assistance from the Australian Government Department of Industry, Innovation and Science.
Improving the quality of buildings and the building regulatory system has been a cornerstone of Master Builders ACT advocacy and policy for many years. Master Builders ACT released its Building Quality Policy Document in 2015, and since that time industry has led the charge for reform to the ACT building industry.
Professor Shergold and Ms Weir’s report, ‘Building Confidence – Improving the effectiveness of compliance and enforcement systems for the building and construction industry across Australia’, made 24 recommendations aimed at establishing a national best practice model on (among other matters):
In the last decade, the ACT Government conducted a thorough review of the building regulatory environment in 2010 and again in 2015. The ACT Government’s focus on building regulatory reform started to gather some momentum two years ago when the ACT Government responded to Master Builders call to establish a Building Regulatory Advisory Committee (BRAC) to act as an advisory group to government on building regulator priorities. However, building reforms are progressing slowly, and instead of fast-tracking reforms, the ACT Legislative Assembly’s Standing Committee on Economic Development and Tourism has resolved to hold yet another inquiry into Building Quality in the ACT. The committee will inquire into: 1 / The certification regime for the building and construction industry. 2 / The merits of standard contracts or statutory requirements in contracts covering build quality. 3 / Industry skills accreditation and ongoing professional development. 4 / Processes and practices for the identification and rectification of defects. 5 / The cost effectiveness of current building compliance and defect rectification practices for industry, government, individuals or body corporates and the potential for the introduction of alternative dispute resolution mechanisms. 6 / The role of Access Canberra. 7 / The regulatory setting or practices in other jurisdictions that could inform consideration of any of the above. 8 / Personal experiences that could inform consideration of any of the above. 9 / Any other relevant matter. The MBA’s policy goals have been bolstered recently with the release of the final report commissioned by the Building Ministers Forum (BMF). The BMF is the group
>> licensing and accreditation; >> certification and inspections; >> quality controls and assurance processes; and >> auditing and enforcement practices. This extract from the report’s Executive Summary provides an overview of the challenge ahead: The goal is to have nationally consistent technical standards applying across Australia. Whilst our country has a national technical standard for buildings, our federation provides for each state and territory to have its own laws governing the implementation of the NCC. After having examined the matters put to us, we have concluded that their nature and extent are significant and concerning. But legislation alone will not improve building quality in the ACT. Industry must continue to lead the discussion about improving building quality, and it must also lead by example. Of the approximately 4,000 licensed builders in the ACT, 12% are members of Master Builders ACT. Before becoming a member of Master Builders ACT, prospective members must be nominated by two existing members, approved by their relevant sector council, and approved by the full MBA Executive Committee. Upon joining, members agree to abide by the MBA Code of Conduct, and are subject to ongoing adherence to the Code by their clients, the general public, other members, and the MBA Executive Committee. These members are leaders in our industry, and have all made a commitment to quality and excellence in the construction industry. For building quality in the ACT to improve our industry leaders must continue to demonstrate best practice, all license holders must be held accountable to public and legislative standards, and government must continue to improve building legislation to ensure it reflects community and industry standards.

Civil Contractors Federation Earth Awards ACT Branch
The 2018 Civil Contractors Federation (CCF) Earth Awards were held at the National Arboretum on May 11. In attendance were over 260 industry participants and invited guests who witnessed a display of the best civil construction projects undertaken in the ACT and surrounding region during 2017/2018.
“In addition to producing quality works, a significant feature of local ACT civil companies is their policy of directly employing permanent construction teams and minimising the use of temporary subcontractors. ACT CCF members always seek to partner with the ACT Government in achieving high levels of employment standards, site safety and value in the expenditure of the tax-payer dollar,” Peter said. “The annual awards night is our opportunity to reflect upon the last 12 months, our role

Strengthening of the bridge included fabrication and installation of six welded steel beams at equal spacing between the existing concrete I-girders. Each beam was spliced, bolted together in situ, laterally restrained and mounted on fabricated steel bearing seating brackets. The project encompassed several highly technical elements, including the complex task of positioning the 16 tonne welded steel beam sections underneath the existing bridge structure. Complex Civil developed a bespoke trolley system to allow each beam section to be transversely positioned into alignment, hydraulically jacked one point five metres, longitudinal shifted over the abutment shelf and bolted together in position.

The initial concept was developed at tender stage and brought to reality by the highly skilled project delivery team, who added further functionality to the design by using the trolley as a platform and catch deck during associated grouting operations. The exceptionally innovative system worked seamlessly and was highly commended by the client and superintendent.

The Dickson Bus Depot project provided numerous opportunities for the innovative team at Cord Civil to develop leading-edge engineering solutions to address a range of challenging issues.
The West Basin Boardwalk is positioned just above the lake water level in Acton providing a protected cove for recreational lake users with a place to berth watercraft and access the waterfront precinct.
A variety of different surfaces including flexible pavements and full-depth rigid asphalt and concrete pavements were constructed over stabilised base works to fulfill the requirements of the project brief.
The design and construction of the 8.1m wide by 110m long cantilevered boardwalk involved working from both land and water and reengineering of the lake edge profile.
Cord Civil also constructed an integrated drainage system with concrete protection encasement where necessary, to allow sufficient protection from new larger and heavier buses.
Construction included sheet piling, the installation of circular hollow piles and capping beams, the manufacture and installation of precast concrete panels, metal frameworks and floating pontoons.
Bus shelters for the new routes were constructed with tree pits containing mature trees added along the concrete verge. The pits contain a specified structural soil-mix to encourage growth, and root barriers to protect the infrastructure.
Noteworthy features of the project include the efficient construction over water of architecturally inspired precast panels and timber deck areas with bespoke brass seating features and handrails.
Street-light-poles with CCTV and PA capability, along with detailed landscaping and furniture were also installed.
The West Basin Boardwalk project was complex in design and presented challenges in navigating through the approval process and construction. However exhaustive planning enabled Chincivil to achieve quality construction, provide safety for the workers and ensure environmental protection of the lake ecosystem.
All work was constructed in a high traffic location with ensuing traffic control problems, further enhancing the quality of the solutions developed by Cord Civil for the Dickson Bus Depot.

Delivering a new suburb on time and under budget is an impressive feat but that’s exactly what Canberra Contractors did when they completed Stage Two of Throsby. The project involved innovative earthwork plans and introduced new topsoil improvement methods to promote landscape germination. Staging the necessary earthworks helped minimise dust and erosion. An adaptive management framework was implemented to monitor the effects the construction might have on Superb Parrot breeding activity adjacent to the site, with some habitat being purposefully relocated to a wild life reserve. There were also sensitive environmental and heritage considerations with both hollow and registered trees located on site and significant aboriginal heritage sites discovered. The project continued during a lengthy period of inclement weather and required the temporary diversion of a floodway creek. Canberra Contractors complied with all applicable laws and regulations, and applied responsible work standards where laws and regulations had not been established.

DECORATIVE CONCRETE Concrete is evolving and Australian designers and builders are finding amazing ways to make this essential construction medium a new and exciting feature of construction. Today’s concrete is being coloured, stained, dyed, exposed, ground, polished, recoloured, resurfaced and featured in structures. Specialised aggregates are being introduced to enhance the design and look of concrete and to even improve the functionality of a structure, like glowing aggregates in footpaths for after dark usage. Some ways which concrete is being used as an ascetic element include: Coloured Concrete: This is typically the inclusion of a coloured oxide into pre-mixed concrete at the time of batching to provide a specific colour tone to the concrete. Exposed Concrete: Involves a chemical treatment being applied to concrete surface during installation which retards the very top of the concrete surface. This is then washed away to “expose” the colour and texture of aggregates in the concrete mix. Polished Concrete: A polished look is achieved in a number of ways, and is often handled by specialist contractors. This finished can be achieved in a number of ways including a grind and seal approach,
a burnish finish applied during placement and via a true polishing of the concrete surface. The look of the product is enhanced and individualised through the inclusion of colours and specific aggregate to the concrete. Colour Resurfacing: “Resurf” is mainly used to rejuvenate an existing concrete surface at a fraction of the replacement cost. High strength coloured slurry is sprayed by a hopper gun onto the concrete to create a new durable coloured surface. This method is extremely popular for driveways, but is also finding a market by replacing paving, tiles and other surface finishes in commercial construction and public spaces. Stamped Concrete: “Stamping” a textured finish into the surface of fresh concrete whilst it is still in a plastic state. Mainly used in conjunction with oxide coloured concrete, throw on colour, release agents and stains to create a look of tiles, timber, stones and other designs with concrete. Stencil Concrete: Or Colour Hardener, uses tapes or pre-cut stencils to provide a pattern to the surface of fresh (still wet) concrete. A coloured powder hardener is then thrown onto the surface which reacts with the wet concrete to provide a brick, rock or tile look.
Colour Sealers: A concrete paint in a multitude of colours. This system is mainly used in the residential housing and renovation market to enhance the look of driveways, paths, balconies and entertaining areas. Concrete Benches and furniture: With the endless possibilities in colour, aggregate and finish it’s easy to see why concrete furnishing has become so popular. With the added bonus of strength and durability concrete is finding its way into benchtops, tables, chairs and other interesting areas of furnishing. Concrete offers the opportunity to design a true unique piece in any project. There are numerous other systems and finished which can be applied to achieve decorative finishes including dyes and stain or epoxy, flake, polyurethane and polaspartic coating systems. Canberra has a plethora of organisations working with the local design and building community to achieve more with their concrete. Furthermore, it is important to engage with these businesses early in your construction process so you can understand what is involved with working with concrete to meet your designed vision. Start a conversation with your pre-mixed supplier, local decorative concrete supplier, concrete placer or specialist concrete contractors to see what you can achieve on your project.
Marching to the Beat of its Own Drum Canberra marches to the beat of its own drum and the Canberra housing market is no exception. The residential housing market in the nation’s capital is displaying greater resilience than the national housing market. Dwelling prices expanded by 0.6% in Canberra in April and by 2.6% in the year to April, according to CoreLogic data. The combined performance of the eight capital cities across Australia was much weaker; prices in the combined capital cities contracted 0.3% in April and fell by 0.3% in the twelve months to April. The resilience of the Canberra housing market can be explained by a number of key economic factors. A buoyant jobs market, strong population gains and a robust economy are helping to support demand for housing. The jobless rate remains one of the lowest of all the jurisdictions, business and household spending is solid, regional and international flights have been expanded, helping to boost tourism to reach record highs and enhance international trade. Infrastructure investment and capital initiatives have, and will, continue to contribute positively to the economy and stimulate business. Canberra’s rental market is also in better shape than most other capital cities around Australia. Gross rental yields in Canberra stood at 4.3% for houses and 5.6% for units in April, which are among the highest of the capital cities in Australia.

It is a right that benefits both parties as it recognises that in a modern Australia, each workplace is different.
New building approvals reached record highs in September 2016, largely supported by mid-to high-density dwelling starts. Apartments represented almost 80% of construction approvals – a step up from the 67% average over the past decade. Dwelling price growth peaked at an annual rate of 8.8% in Canberra in April and May 2017. Canberra dwelling prices have continued to rise (albeit it at a slower pace) and annual dwelling price growth remains in positive territory, unlike some of the other capital cities. The slowdown in housing has been spurred by the widening of macro-prudential measures by APRA last year and the combination of weak wages growth and high household debt. Furthermore, considerable supply of housing stock, especially apartments, means the demandsupply fundamentals have shifted. The slowing in Canberra’s housing cycle has further to run, but the softening will be moderated by the positive fundamentals underlining the Canberra economy. The Canberra housing market might be more resilient, but it is not immune to the slowdown in the housing cycle that the rest of Australia is experiencing. The housing market in Canberra has passed its peaks in terms of both approvals to build dwellings and price growth.

The gem that we now know as Woden Contractors was just another unpolished stone in the quarry 60 years ago. The company started when a visionary young man stepped out of his comfort zone and took a chance. In 1957, then 31-year-old Ken Fryer left a secure job with the Federal Police to venture out on his own. He purchased an International BTD6 dozer (40 hp) and commenced a micro business and the rest, as they say, is history. That micro business has grown to become the oldest serving, and one of the most successful civil companies, in the ACT region. By 1959, just two years after leaving his police uniform behind, Ken had amassed a staff of 30, and the company was awarded its first government contract, a 12-lot subdivision off Schlich Street, in Yarralumla.
The company started when a visionary young man stepped out of his comfort zone and took a chance.
Since then, Woden Contractors has constructed many of Canberra’s major civil infrastructure projects including the Kings Avenue Bridge, the Glenloch Interchange, the Bowen Place Crossing and a significant section of the Gungahlin Drive extension. The company was also responsible for the entire Jerrabomberra Estate over a 20-year period, construction of the Gleneagles Estate with its championship golf course, and delivered much of Canberra’s early high-pressure gas reticulation during the 1980’s.

Woden Contractors has always invested heavily in training its staff. This has evolved from the early days when training plant operators was carried out on an ad hoc basis on site to the structured apprenticeships in Civil Plant Operations and Diesel Fitting that are carried out in conjunction with the MBA and other RTO’s today. The current team includes around 75 employees and the company is extremely proud of the fact that 15% of those employees have been there for over 15 years and 25% have clocked up more than 10 years of service. Among them is Ross Barrett who joined as an engineer in 1970 and remains as a company director 48 years later. Research* shows that, on average, women are more likely to have less super when they retire than men. There are several factors that contribute to this. Women are more likely to take more time out of paid work to have families, they’re more likely to work part-time and, generally, they’re paid less. Women also live longer than men^, which means it’s even more important that they have enough super to last their retirement. WHAT CAN YOU DO TO REDUCE THE GAP? First and foremost, make sure your employer is paying your super. The amount your employer pays is usually at least 9.5% of your regular pay. You can also: Combine all your super together into one account – This will make it easier to manage and you’ll save on fees. Find your lost super - If you’ve been paid super into many different funds and your details have changed, your old super fund may have lost touch with you and transferred your super to the ATO. This money is called ‘lost super’, but it’s super you can still claim. Top up your super by putting in extra yourself - You can do this by paying more from your before-tax salary (salary sacrificing) or from your after-tax salary. An after-tax super contribution may see you eligible for the Government’s contribution of up to $500. Remember, adding a small amount to your super now can make a big difference later on. Ask your partner or spouse to make a spouse contribution - They’ll receive a tax offset of up to $540 if your assessable income and total reportable fringe benefits for the financial year are less than $40,000. There’s a lot you can do to boost your super and retirement income and improve the quality of your retirement. A balanced approach is driving the development of Canberra’s newest community.
With construction recently kicking off on Canberra’s newest master planned community - Ginninderry, behind the scenes is a team like no other. Riverview Developments, the local developer behind the 40-year development which will ultimately deliver up to 11,500 dwellings in the ACT and NSW, has a proactive approach to the achievement of gender balance and ethnic diversity within its staff structure. The project team currently has 10 women on its 18-strong project team, exceeding a 50/50 gender balance. The team also has four staff from non-English speaking backgrounds, two staff from the LGBTIQ community and two permanent employees from the ACT Down Syndrome Association in office assistant roles. Senior female managers are leading the way at Ginninderry in housing, marketing & communications, training & employment, accounting, sales, community & cultural planning and sustainability, and making decisions that are shaping this exciting new community. Emma Sckrabei heads up the SPARK Training and Employment program and moved from South Australia to join the team in 2015. “We have an amazing team and I am so proud to say I work for a developer that really cares about social justice, lifelong learning and giving back to the community. City Renewal Authority
If you’re planning on building in the city centre, along Northbourne Avenue or around Dickson then there’s a new public authority you should be aware of.
The City Renewal Authority was created in July 2017 to shape the growth of the central part of Canberra with the unabashed goal of making it a great place to live, explore and enjoy. It is responsible for leading the growth and improvement of the City Renewal Precinct, which runs from West Basin to the Federal Highway and includes the city centre, Northbourne Avenue and the Dickson Group Centre. Chief Executive Officer Malcolm Snow said one of the critical success factors in renewing the city was to ensure there was a high standard of design and construction.

“The ACT Government tasked us with ensuring that our renewal program was design-led and people focused,” Mr Snow said. “In order to help us achieve this the government made the authority a referral agency for all development applications within the City Renewal Precinct. “This means that ACT Planning seeks our advice on new development proposals within the precinct.” The authority welcomes the opportunity to discuss plans for new developments with proponents before they lodge their applications. “We encourage anyone who is planning on building or developing within the precinct to get in touch with us as early as possible in the process,” Mr Snow said. “Renewing our city will be achieved through a combined effort between government, industry and the community. We all need to work together to achieve the best outcomes.”

The principles should ideally be considered by land owners and their design advisors at the earliest formulation of the development proposal. “All Canberrans want their city to be the best it can be and if we work together then we will be able to achieve outcomes that benefit everyone,” Mr Snow said. The City Renewal Authority is also responsible for improving and activating the precinct’s public environment. As well as upgrading existing public spaces the authority is creating new public spaces such as Henry Rolland Park at West Basin, which opened in April. It is also activating the precinct with events and interventions from Dickson through to West Basin. “Great cities are well designed, well built and well used,” Mr Snow said. “I look forward to working with the development industry to help our city precinct grow into the premium destination in Canberra.”

A Matter of Phoenixing or Tax Revenues?
Reform of the Australian insolvency law has recently gained increased momentum. September 2017, saw the introduction of the “safe harbour” laws seeking to provide a degree of protection to directors when faced with difficult times. While this is the case, the Federal Government has also announced a package of reforms targeting directors and advisors in relation to what they describe to be “phoenixing”.

“Phoenixing” is the process of moving assets of one company to a new company without the new company providing valuable consideration. This is done in an attempt to leave behind the liabilities of the first company such as the payment of taxes including GST. The GST system is reliant on business to be the collectors of the tax and then remitting that money to the Australian Taxation office (“ATO”). The other features of this activity is that usually there are common directors and the first company is then placed into some form of external administration. Phoenixing to avoid paying GST has grown significantly in recent years. Offending companies claim GST input tax credits for their costs and expenses, collect GST from customers, do not remit the GST to the ATO, but instead then place the company into external administration. This sort of behaviour has other affects. Knowing that the GST and other taxes will not be generally pursued by the ATO for some time, these companies pursue aggressive market share. This also adversely affects consumers, at the time when these companies are placed into external administration they are unable to complete the contracts obtained by aggressive market share practices.

ASIC data for the years of 2013 to 2017 suggests that about 12,000 insolvent entities had most likely engaged in some form of phoenixing activity. Estimates from Government suggests that the cost to taxpayers in lost revenue is around $3 billion dollars. The proposed reforms include the following: 1 / The introduction of a Director Identification Number (DIN) which identifies the directors and links them to their present and previous directorships. The director is then required to quote their number when incorporating a new company. This will interface with government agencies and ASIC databases to allow regulators to record the relationships between individuals and entities and other people more easily.

2 / The inclusion of a specific phoenixing provision in the Corporations Act making it an offence to transfer property from one company to another if the main purpose of doing so it to avoid paying creditors; 3 / Extending the offence to those who encourage tax avoidance schemes ie advisers who assist the phoenix operators such as accountants and financial advisers; 4 / Provisions which address the issue of backdating a directorâ&#x20AC;&#x2122;s appointment or resignation. So that if a change of director form is lodged more than 28 days after resignation, the director could still be liable for misconduct up to the date of lodgement; 5 / Greater power to the ATO to use the garnishee power to recover a security deposit from a suspected phoenix operator; 6 / Making directors personally liable for GST liabilities as part of the extended director penalty provisions; and
The new reforms are aimed at curbing bad corporate behaviour and they do so by imposing more express obligations on to directors and other advisers
7 / Prohibiting related entities to the phoenix operator from appointing a liquidator. Overall, the new reforms are aimed at curbing bad corporate behaviour and they do so by imposing more express obligations on to directors and other advisers. These reforms should be viewed as part of the suite of amendments including those in relation to the safe harbour provisions.

MASTER BUILDER AUSTRALIA UPDATE – Federal Budget
Overall the 2018 Federal Budget will boost confidence in the building and construction industry. Reducing the tax burden on households and small business is good for the economy and good for builders. People may decide to renovate their kitchen sooner or buy their first home faster. It’s also great news that our many small builders who are sole traders will also get tax relief in this Budget. Master Builders called on the Government for measures to make it easier for you to succeed in your business and we applaud them for listening. Labor also announced a tax cut plan in their Budget Reply. Master Builders called for more certainty for state and territory governments to sign up to the $1.5 billion Skilling Australians Fund (SAF) and the Government has listened. The SAF will focus on funding for new apprentice training initiatives that are no longer conditional on a levy of skilled migration. $250 million is available for state and territories in this financial year, a share of $50 million is available for governments that sign-up to the SAF prior to June 7 and $50 million per year over four years is available to states and territories who are signed up to the SAF. The Opposition’s strong focus on skills and training in its reply to the Budget is also welcome.
The Government’s infrastructure Budget will play a key role in setting the nation up for future prosperity. The additional $24 billion investment in infrastructure across the country will boost the productivity and liveability of our cities. In the ACT the Budget contains $100 million in new money to upgrade the Monaro Highway. Small builders will benefit from the extension of the $20,000 immediate tax write-off scheme until 2019. There are more SMEs in our industry than any other sector of the economy and this is for them. The incorporated small business tax discount rate will increase from 5 per cent to 8 per cent allowing SME builders who are sole traders to write-off their assets faster. Building and construction investment is a major driver of the improvement in the Budget position. The Budget Papers recognise the importance the residential building sector has played over the past few years in helping the economy transition from the peak of the mining construction boom and the forecast pickup in non-residential (commercial and civil construction) in the rosier economic picture over the next four years. The bottom line is that you should be hugely proud of the contribution you and your business makes to our economy and the community. WHAT’S IN IT FOR SMALL BUSINESS? The 2018-19 Budget focusses on reducing the tax burden on small business by: >> Increase of low income tax offset - tax relief for 2018-19 by increasing the low-income tax offset to taxpayers earning up to $87,000, as well as a reduction in the income tax rate which will reduce the tax burden on unincorporated entities. >> Extending the instant write off for equipment purchases of up to $20,000 for 12 months to 30 June 2019 for businesses with a turnover of less than $10 million. >> Increased the unincorporated small business tax discount rate from 5 per cent to 8 per cent. This rate will increase to 16 per cent by 2026-27. >> Extend the company tax cuts to 27.5 per cent to business with turnover of less than $50 million from 1 July 2018. To reduce company tax rate for all businesses under the Ten Year Enterprise Tax Plan. >> The Government’s National Partnership on Regulatory Reform will reward States/Territories that reduce regulatory restrictions on competition, particularly those on small business. >> The Government has deferred the start date of changes to the taxation of financial arrangements (TOFA) rules announced in the 2016 17 Budget. The Ten Year Enterprise Tax Plan — business simplification — taxation of financial arrangements — regulation reform measure will reduce the scope of the TOFA rules, decreasing compliance costs. >> National Partnerships on Small Business Regulatory Reform will provide funding to deliver reforms that make it easier to do business for the 360,000 small businesses in our industry. NAWIC ACT CEO SHADOW PROGRAM The enormously successful CEO Shadow Program is back for 2018! The program pairs industry leaders with CEOs and senior managers to allow future leaders to gain invaluable insights into the day-to-day operations of their CEO counterparts. We’re calling for expressions of interest to take part in this forward thinking and unique program. With a remarkable response from last year’s program, we can’t wait to see what positive results this year’s program will bring for participants and CEOs. NAWIC INTERNATIONAL WOMEN’S DAY SCHOLARSHIP NAWIC’s IWD Scholarship is the most significant scholarship for female professionals in the property and construction industry. The $20,000 scholarship provides funding for a research paper that will benefit and empower women across the Australian property and construction industry. Our 2017 International Women’s Day Scholarship winner, Sara Prendergast, will be doing a national tour this year, sponsored by NAWIC, to present the findings from her research project: “What are the most effective attraction strategies to entice women into operational roles?” This research project investigates how companies can build an operational workforce that will open pathways for women in the construction industry, particularly careers in civil construction.
CANBERRA GIRLS GRAMMAR SCHOOL TINY HOUSE PROJECT NAWIC ACT are proud partners of the Canberra Girls Grammar School Tiny House Project. A class of Year 10 STEM students are designing and constructing a fully functional, sustainable and technologically advanced Tiny House.
