A CHANGING AUDIENCE Our audience, one which no other medium reaches so exclusively, is CEOs of businesses located in northern and western Pennsylvania. When our first magazine issue was published in 1988, most were CEOs of manufacturing companies. Today, manufacturing company CEOs still comprise the largest group of members, but in total, they make up slightly more than 30 percent of our 4,500-plus magazine distribution. While this may be a surprise to many readers, it still reflects the fact that our region has a higher percentage of manufacturing employment than
Pennsylvania and the United States. However, it also reflects the hundreds of businesses involved in health care, insurance, banking, retail, hospitality, service and other industries that do business in our region.
AN UNCHANGED MISSION Serving You
We may not all be “making it” literally in terms of manufacturing, but our common goal is “making it” in business — in growing and succeeding, in profiting and reinvesting, and in providing good jobs for residents in our communities.
The MBA is your organization, and this is your magazine. Please read it. Or tell us why you don’t and what would increase your interest and readership. With the new insight you’ve already shared, we hope this new look will be looked at more closely.
Please read ahead. And give us feedback. Thank you.

LEADING THE WAY IN ASSISTED LIVING
The mission of Westlake Woods Assisted Living can be summed up in four simple words: independence, privacy, dignity and choice.
W
estlake Woods was developed by Scott D. Allen and Timothy W. Coughlin, two Erie natives, who own LifeServices Assisted Living, a private company operating nine communities in western Pennsylvania and Greater Cleveland, Ohio. “Our residents helped us understand that, even though they can’t live at home anymore, they deeply value their independence, privacy, dignity, and the choice as to how they live their lives,” says Coughlin. “At all of our communities, every aspect of our design, service, and care approach is with these four values in mind.” The moment you enter the mahogany front doors of this community, you sense Westlake Woods provides a unique alternative in long-term living unmatched in the greater Erie area. A Community Designed to Feel Just Like Home. Westlake Woods offers 68 spacious onebedroom and studio apartment homes, each with a living room, kitchenette, private Shown here is an example of a One-Bedroom Traditional apartment.
bathroom, and oversized windows offering natural light and views to the Community’s greenspace. “Our building design and construction approach focused exclusively on creating a comfortable residential environment as much like home as possible,” says Allen, a licensed engineer who leads the LifeServices’ development process. “We created a low-profile building, in a quiet neighborhood, constructed with residential, rather than commercial, construction materials. Everything we did was to avoid any sense of an institutional feel to our Community.” While all residents enjoy private apartment homes, over half of the interior is a comfortable commons of sunrooms, family rooms, and a Community dining room. “We know we’ve succeeded when residents refer to our Community as home,” adds Allen. It’s the Care That Makes the Difference. While the building is unique, Westlake Woods’ care, delivered by an experienced and compassionate Care Team, makes it unique in the Erie area. “Every Team member demonstrates our mission in how they assist and interact with our residents daily,” says Susan Evans, Community Director for the past 15 years. “We create a culture of community here, but it’s more like we’re one big family.”
As the first and only licensed Assisted Living Community in the Greater Erie area, Westlake Woods is designated by the Commonwealth of Pennsylvania as an alternative to traditional nursing home care. “Other facilities say they are like us, but they are licensed as personal care homes, and they’re not supposed to care for seniors who need nursing home care,” says Coughlin. “We are a state-designated

alternative to nursing home care and less than 10 percent of our residents ever get moved to a nursing home. They stay with us in their own apartment home with the care they need. Best of all, they do so for a little more than half the price of a nursing home bed.” Excellence in care is a standard Westlake Woods works to achieve every day. Annually, the Community passes its state inspections with flying colors. “Westlake Woods has been deficiency free for the last five years,” Evans explains. “Given the state average is nine violations per facility, we’re pretty proud of that record.” To learn more, visit www.LifeServicesAssistedLiving.com or call 814/835-0330.

SPOTLIGHT Q&A| EXPERT ADVICE
Why Is Long-Term Care Insurance Important? Long-term care (LTC) insurance helps pay for care when you can no longer care for yourself. It may protect your family’s financial future and your investments and savings. Many employers are considering LTC policies for their employee benefits packages and for themselves. Here, Loesel-Schaaf Insurance Agency Vice President Ed Althof explains the benefits of long-term care insurance and the agency’s own LTC education program. Public awareness of long-term care insurance has been growing. What is LTC? LTC is custodial assistance with bathing, continence, dressing, eating, toileting, and transferring due to a chronic illness, cognitive issue or disability that can be provided in the home, at adult day care, or in an assisted or skilled nursing community. Is LTC insurance right for everyone? Who qualifies? When is it best to consider a long-term care insurance policy? An LTC plan is essential; whether insurance is appropriate should be an informed decision. People need to be educated to make the best choices for their situation. Individual LTC insurance is medically underwritten; therefore, health and age are important factors. However, no one should presume they won’t qualify. You are never as young or as healthy as you are today, so it’s never too early for you to consider LTC planning, especially individuals age 40 through 70 who are concerned about protecting their retirement portfolio or have had a personal experience.
What are the typical nursing costs with and without LTC coverage? LTC insurance provides a dedicated stream of income to help pay for care. If your monthly benefit is less than the cost of care, you pay the difference out-of-pocket. Most don’t mind paying for care, just not 100 percent of it. The PA median cost for a Home Health Aide is $21 per hour. The annual cost for Assisted Living is over $42,000; Skilled Nursing is $113,150 for a private room. These costs are expected to double every 15 years and must be taken into consideration when planning for future care.
LTCEPP® at the employer level can offer advantages such as underwriting concessions and federal tax advantages. A well-designed LTC program with selective funding for owners, spouses and key employees can enhance a company’s recruitment/retention strategies. Tell us about your exclusive agreement with the MBA to provide discounts and the best premium rates available in LTC insurance. We’ve negotiated discounts specifically for MBA members and their families. As an independent agency, we have access to traditional long-term care and life hybrid plans through various carriers. There is no specific cookie-cutter approach. Plans are tailor made to employer’s desires.
Why should employers consider offering LTC insurance as part of their benefits package? Our Long-Term Care Education and Planning Program (LTCEPP®) is the “missing link” in a comprehensive benefit program. Through 401(k)s and profit-sharing plans, companies are helping employees save and plan for a secure future. Paying for care can affect the best thought-out retirement plan. Providing employees options that address LTC and its related effects assists them in a difficult time and adds value and competitiveness to an organization’s benefit program.

METAL LEVELS
It is important that consumers not equate the metallic categories with the amount or quality of care they can expect with that plan.
Can Help Determine the Right Health Plan Adam Pittler is director of Product Development, for UPMC Health Plan, which is part of the UPMC Insurance Services Division. This division offers a full range of insurance programs and products and also includes: UPMC for Life, UPMC for You, UPMC for Kids, UPMC WorkPartners, Community Care Behavioral Health, LifeSolutions, EBenefits Solutions, and Askesis Development Group.
Mention gold, silver and bronze and most people probably think of medals awarded at Olympic competitions. Since the advent of the Affordable Care Act (ACA) in 2009, those same metals have an important connection to health insurance. Now, bronze, silver, gold, and even platinum are tools used to help health insurance consumers comparison shop. They provide coverage information for persons shopping for health insurance coverage on the Marketplace. Open enrollment for ACA coverage in 2016 began November 1, 2015, and ends January 31, 2016.
Why the Metallic Terms? The metal tiers provide consumers a standard measurement and make it easier to compare plans. They also help consumers understand which plans offer more comprehensive coverage and cover a greater portion of health-care costs. Plans are assigned an “actuarial value,” referring to the share of health care expenses the specific plan will cover. If, for instance, you decide to purchase a bronze plan, you will need to pay more out of pocket than for a silver, gold or platinum one. Plans are rated up from bronze, to silver, gold and platinum, the highest. Platinum plans are the most generous and carry the highest premiums, but also have the lowest out-of-pocket costs. For example, a bronze plan will cover 60 percent of health-care costs, a silver plan will cover 70 percent, a gold plan 80 percent, and a platinum plan will cover 90 percent.
How Plans Are Similar All plans — bronze, silver, gold and platinum — must provide a minimum level of coverage in 10 categories, known as “essential health benefits.” These include prevention and wellness, ambulatory (outpatient) care, laboratory services, emergency care, hospitalization, maternity and newborn care, pediatric care (medical, dental and vision), mental health and substance use disorder services, prescription medications, rehabilitation and habilitation. To evaluate plans on the same metallic level, you must carefully review the details of each health insurance plan offered at that level. This includes the cost of monthly premiums, deductibles, copayments and coinsurance. All insurers are required to provide an easy-to-read summary of benefits and coverage to help compare plans. Even though two plans might be on the same level, the cost to a consumer may differ. This could be because of outof-pocket expenses that are accrued and dependent on the health services needed. Tax Credits and Cost Estimates Consumers looking to maximize tax credits and subsidies should probably look to silver level plans. The size of tax credits is based on income and the cost of the second-lowest silver plan in each region. The tax credit remains the same for all levels and covers more of the premium at a silver level than at the gold and platinum levels. Persons entitled to subsidies need to enroll in a specific silver plan to receive it. Most insurance purchasers are focused totally on premium cost and do not think about their estimated, total health-care costs for an entire year. You have to determine if a higher monthly premium would be worth it to decrease out-of-pocket expenses. For more information, visit https://www.upmchealthplan.com/ individuals/learn/.

They are members of the Independent Council on Aging and the Alzheimer’s Association of Northwestern Pennsylvania Advisory Board, among other organizations. Perhaps your parents have commented that they may need to make some changes in their life. Though it might be hard to think of them as vulnerable, it’s good to be realistic and help them be involved in planning during their elderly years. Together, you, your siblings and your parents can take that first important step to finding the best solutions for their needs. The Home Instead Senior Care network can help you address some of those questions. You can also find answers to those questions from Home Instead founders
5.
Review the estate planning process. A comprehensive, written estate plan is beneficial. It designates a power of attorney for someone to act in their behalf should they become incapacitated; sets out their wishes for medical treatment at the end of life; designates a health-care proxy when they can no longer make choices on their own; and, explains how they want their estate distributed upon death.
6.
Help set up a will. Even when the financial consequences of dying without a will are small, the emotional repercussions can be tremendous. Our parents also should put in writing how they want their remains handled.
7.
Set in place an advance directive. This document, sometimes referred to as a living will, states the signer’s wishes in case some accident or medical episode leaves him near death with little or no chance of recovery.
8.
Designate a power of attorney. The senior should give someone the power of attorney to act on his behalf if he is disabled in an accident or by an illness.
9.
Review insurance coverage. Sorting through insurance options can be a major task. Find out what coverage your senior already has — life insurance, Medigap policies (private insurance) and long-term insurance.

Take an inventory and get organized. Survey all the resources at the family’s disposal, which include people — children, other relatives, neighbors and friends who will be able to help — as well as crucial documents and financial resources. Prepare to be flexible. No matter which care options you choose, it’s likely the alternative will have to be modified or even discarded in time. So, be flexible. It is likely that no resolution will be permanent. Enlist help from a geriatric care manager. The geriatric care manager is a professional who assists families with problems or concerns they have not been able to handle entirely on their own. This person helps you and your family identify needs and find ways to meet them.

LEGAL BRIEF |PLANNING AHEAD
Digital Assets
Preserve and Protect Assets Traditionally Not Considered in Estate Plans Matthew B. Wachter, Esq. is an associate attorney at MacDonald, Illig, Jones & Britton, LLP and is affiliated with the firm’s Business Transactions, Tax and Trusts & Estates Practice Groups. He received a Masters of Laws in Taxation degree from Villanova University School of Law after receiving his Juris Doctorate from Duquesne University.
We acquire an ever-growing and diverse collection of assets during our lifetime. To preserve and protect them, an estate plan is typically created with the counsel of an estate planning attorney. It preserves our wishes, and grants certain people power and authority to handle our affairs when we are not capable or upon death. However, estate plans, whether simple or complex, traditionally consider only our hard tangible assets. Recently, a new class of assets of ever-growing importance has arisen not traditionally considered in estate plans: digital assets. Valuable for Loved Ones We have all created or acquired digital assets and an electronic digital identity consisting of far more than the electronic accounts we access online to manage our digital photo albums or social network profiles. Our digital assets include the information necessary to access the financial assets and accounts we routinely manage on our personal computers or smartphones. Everything from our savings and checking accounts, stock trading accounts, medical information, credit card payments and even our gas and electric bills are accessed and managed online via a litany of profile names, online passwords and “secret” security questions.
Digital assets increasingly mimic traditional “hard” assets. PayPal and Bitcoin accounts are often worth thousands of dollars and access to website domains and email accounts are crucial to many businesses. Valuable digital assets also include information stored in secure electronic “dropbox” folders, frequent flyer airline miles, hotel reward points, electronic music, and video and audiobook collections maintained on digital accounts and devices. Preserve and Protect It is important to consider how your heirs will access the assets you store digitally and the manner in which the executor of your estate or agent named in a power of attorney document will manage the affairs conducted electronically. Some practical questions to consider: Will your spouse have the information necessary to access an electronic joint checking account upon your death? Will the executor be able to manage online payment of bills and expenses? What happens to pictures uploaded to an electronic picture album? Will social media accounts be deleted or maintained after your death? Practical Considerations Digital assets create questions and scenarios unforeseen by estate planners.
Access to the websites where we store digital assets are governed by everchanging “terms and conditions,” and users are typically granted restricted and limited licenses that are nontransferable or terminate at death. It is important to establish procedures granting access and preserving the information necessary to manage your online accounts with your attorney. Specify the power of both your executor and agent under your power of attorney document to access and manage your online and digital affairs. Safely and securely store and actively maintain a separate list of online passwords and account information. Today, there are services whereby an online database of your passwords and login information is maintained and released to beneficiaries upon death. Most importantly, the next time you speak with an estate planning attorney, take time to plan and consider your “digital” assets and electronic identity — valuable and important, but easily overlooked as you plan your affairs. For more information about digital assets, contact Matthew B. Wachter at 814/870-7717 or mwachter@mijb.com.

Cyber Attacks on the Rise for U.S. Companies Riley Walters is a research assistant at the Allison Center for Foreign and National Security Policy at The Heritage Foundation. Researchers are concerned over the strength and comprehensiveness of cybersecurity in the United States, as companies are being targeted in cyber attacks at an increasing rate of occurrence and cost. The quantity and quality of information being hacked, stolen, destroyed or leaked is becoming more of a problem for consumers and businesses alike. The Ponemon Institute recently released its 2015 Cost of Cyber Crime, which analyzes its cost for a variety of 58 U.S. organizations both public and private. The United States, in comparison with other nations in the study, continues to rank highest in its cost of cyber crime at an annual average of $15.4 million per company. Ponemon surveyed companies in the areas of finance, energy and utilities, and defense and aerospace — three of the most affected sectors — as well as communication, retail and health care. Their annual cost of cyber crime has more than doubled since 2010, which then averaged $6.5 million. This year, companies saw an average of 160 successful cyber attacks per week, more than three times the 2010 average.
Every company surveyed was the victim of a Trojan, virus, or worm-type of attack; 97 percent were victims of a malware attack, and 76 percent were victims of a Webbased attack. Just as worrisome are those with malicious intent already with access to a system. Congress and the Obama administration should: • Consider how regulations financially affect businesses. While asking businesses to focus more on cybersecurity is noble, policymakers need to remember businesses will focus only on as much security as fits their business model. However, businesses (especially smaller businesses) will need to think about how cybersecurity breaches will affect their image and bottom line. • Avoid minimum security standards. Setting obligatory cybersecurity standards for companies will not prevent breaches — in fact, it may worsen security. Avoid making companies commit funding to securing
one or several aspects, when a hacker can simply attack or breach from where funding was misallocated. • Increase cooperation with private businesses. As the backbone of the tech market and target of many of these attacks, private industry is working on best practices and collaborating to create the technology and workforce necessary to counter cyber threats. Increasing cooperation with private business will allow government access to firsthand knowledge on emerging threats and vice versa will help private businesses prepare using whatever cyber information the government has to share. Cyber attacks are on the rise and will continue to be of concern for the foreseeable future. It is up to private industry to meet these concerns headon and support the government to act lawfully against cyber criminals — so long as businesses lack the authority to fight back against those who threaten their systems.

SURVEY: MAJORITY OF FAMILY BUSINESS LEADERS DON’T HAVE SUCCESSION PLAN Seventy-three percent of U.S. family businesses admit not having a documented and robust succession plan for senior roles, the latest PwC U.S. Family Business Survey finds. The survey of owners, leaders and top executives of mid-sized U.S. familyowned businesses across a range of industries indicates that two-in-five respondents will find it difficult to give full control to their successors; 56 percent

believe they will stay involved in their companies longer than is optimum to ensure a smooth transition. Moreover, 47 percent of next-generation family members view succession as becoming more difficult due to the growing age gap between current leadership and those in line to take over.
Disability Claims
EMPLOYERS MUST LEARN HOW TO APPROACH GROWING NEEDS OF AGING WORKFORCE
The makeup of the workforce is shifting. According to recent research by Aetna, more older employees plan to continue working past normal retirement age. About 70 percent plan to work for pay in retirement, compared to the 27 percent of retirees who do so now. Baby boomers — those born between 1946 and 1964 — are about 77 million strong. Older workers are frequently an employer’s most valuable asset, given their experience and commitment. Employers should learn how to approach disability claims for older workers in a way that keeps them productive, motivated and committed. As workers age, they require more time to get back to work following a disability. Both frequency and duration of claims increase with age. This is true
RESEARCH: GROUP RANKS LIST FOR RETIREMENT PLANNING
especially with disability claims with a musculoskeletal nature. It’s critical for an employer to understand the nature of his/her workforce — a major factor in designing a sound disability plan.
To adequately prepare for retirement, Americans need to minimize taxes, save for emergencies and prepare to live longer than their parents, according to NAPFA-Registered Financial Advisors who ranked a comprehensive list of tried and true advice for those five, 10 and 20 years away from retirement.
Employers cannot ignore: 33 The workforce is aging; 33 Pay attention to ergonomics;
NAPFA asked its members to rank advice representing the type of comprehensive planning consumers should expect from financial planners — estate planning, investments, education funding, insurance and risk management, retirement planning and senior issues.
33 Ensure a return to work policy is in place encouraging return to work; and, 33 Be aware of co-morbidities.
The poll found that advice focused on maximizing retirement savings through tax planning ranks high with advisers in each time-frame category. Advisers recommend contributing the maximum amount of pre-tax income to 401(k)s, using tax-advantaged IRAs and staying abreast of tax-reduction opportunities from the Internal Revenue Service.

HR Q&A | EMPLOYEE ANSWERS
SHOULD WORKING EMPLOYEES ENROLL IN MEDICARE? It is prudent to first indicate to employees that although you cannot make specific recommendations, you will be happy to help by sharing resources so employees can make informed and meaningful decisions. Then, instruct employees to make a rank-ordered list outlining the features important to them. Many employees consider only costs.
Eldercare Help at Work HOW EMPLOYERS CAN HELP EMPLOYEES CARE FOR AGING PARENTS Many employers have employees in what is commonly referred to as the “sandwich generation” — those faced with the demands of caring for children as well as caring for aging parents.
