We’ve all heard of beachfront properties and lakeside apartments, but one developer has taken the Kiwi dream of living by the sea one step further. Yes believe it or not, floating homes are being touted as the latest solution to the growing housing crisis and now they are making their way to New Zealand. Twenty floating homes are being planned for Gulf Harbour, on Auckland's Waitemata Harbour. The homes will be docked at the Fairway Bay marina and plugged in to water, electrical and sewage systems. Resource consent has already been granted, with construction planned to commence in early 2016 and the first house expected to be completed by June. The floating home concept has been backed by London firm Baca Homes, which has already achieved acclaim for the innovative Amphibious House design – a traditional house on fixed foundations, that is until a flood occurs, when it rises up in its dock and floats, buoyed by the floodwater. And the firm may have struck architectural gold again with its own floating home concept, designed as part of an architectural design competition to encourage novel solutions for affordable housing, which has attracted more than 200 entries from leading architects in 16 countries. One of 10 firms shortlisted for the New London Architecture (NLA) award, Baca has developed a high-quality prototype for prefabricated floating homes that can be constructed quickly and easily. With rivers, lakes and oceans making up a significant portion of the earth’s surface, it was only a matter of time before structures typically reserved for land began to retreat into the water. A small isolated country, characterised by its proximity to the ocean, many of New Zealand’s most ingenious creations are already linked to the water – Hamilton Jet, the ski plane, bungy, blokart and zorb are all examples of New Zealand inventions that not only pushed traditional boundaries of travel but also embody the Kiwi sense of adventure with unique ways to experience the water. Before long, it seems, we’ll be living on it.

he year 2015 has been a momentous one in Christchurch. Every element of the rebuild has gathered pace, from residential to commercial, with the result that residential earthquake repairs are almost complete. The central city is a sea of cranes, with many more to come based on the number of consents granted for commercial redevelopment. And the rebuild of residential houses, be it on their existing sites or in new subdivisions, continues at great pace. Time and again I’m approached by people who’ve visited Christchurch for a day or two reporting what an exciting and stimulating place they’d experienced. And they’re right; Christchurch is humming with activity. I’m pleased to report this will definitely continue in 2016, with new legislation to be passed before April which will allow for regeneration to be the focus of both central and local government’s ongoing investment in Christchurch. While the list of things ticked off or well underway this year is long – the Bus Interchange, the Earthquake Memorial, the Retail Precinct, the Innovation Precinct, the Avon River Precinct, the Justice and Emergency Services Precinct, and the Margaret Mahy Family Playground – there is so much more to do. In 2016 we’ll see work begin on residences in the East Frame, the Metro Sports Facility, the Convention Centre Precinct, and a public engagement process for future use of the flat land residential red zone – an area over four times the size of Hagley Park. Add to that the completion of horizontal infrastructure repairs – yes, smooth roads are nearly here – and 2016 is going to be another very busy year. The readership of this magazine is making all this happen. You’re working in all conditions, day after day to make greater Christchurch a better city than it was before the earthquakes. For that we are all extremely grateful, and I extend my best wishes to you and your families for a safe and happy holiday season.

s we enter into the festive season after a long and challenging year it is really important that we take time out to think about how we look after ourselves and how we look after each other. I have noticed since 2010 that as we close into Christmas we find most people across our community start running on empty tanks. The physical and emotional exhaustion is palpable and totally understandable as a legacy of what most of us have been through. There are also of course some people who are stuck and are still struggling with insurance, land and/or housing issues which puts more complication into their lives than they ever thought possible. Those of us that are managing to make progress need to ensure that we do what we can to support those still stuck. There is clear evidence that the psychosocial issues emanating from the earthquake are far from being resolved. Research tells us that it takes up to ten years for people to come to terms with what they have been through after such a major catastrophic event. This is obvious by the increase in mental health referrals, the way some people and some families are struggling and the increased concern our health and education systems have for young people who show abnormal signs of stress and agitation which can be related back to the environment they have grown up in. We are now at a stage that children who had not been born are now starting to attend school and many of those are showing signs of increased vulnerability. It is a season of goodwill and this community has plenty of it. Let’s be sure that we all give a little more than usual to those people who need it – not just in a material way but in an emotionally supportive context.

W

ith Christmas now upon us the pace of building activity seems to have lifted another notch. This is particularly evident in the Retail Precinct and areas close by this precinct. Nick Hunt’s BNZ square facing Hereford Street is now in its final fit out phase and we expect to see its government office tenants move in in early 2016. The other half of BNZ Square opposite Ballantynes on Cashel Street has reached its full height and we will see this part completed in late 2016. This combined development is the largest office rebuild so far in Christchurch on one site. Tim Glasson’s ANZ Centre, on the old Triangle Centre site, has reached its full height and is also progressing well. It will bring the office tenants of ANZ and Beca to the CBD in early 2017. Philip Carter’s Crossing redevelopment is now well underway with the steel framework for its 600+ car park building showing its central part of this development – another great development bringing high end fashion retail to our CBD around some very special building and spaces. This is due for completion in early 2017. My Terrace development is flying along with the central Oxford Terrace buildings built and the external wall claddings being installed over the next month or so. The foundations for the substantial office building on the corner at Cashel and Oxford Terrace has just been finished. The five storey office building on Hereford Street will be fully framed up before Christmas. Sage 1 facing the Avon River will be open in mid-2016 to coincide with the completion of this part of the Avon River Precinct. Over the river Ng i Tahu have two substantial office buildings being built and opposite this on Cashel Street is the very substantial Price Waterhouse Centre’s five storey building all due for completion in late 2016. The Innovation Precinct is on a roll with the Vodafone and Kathmandu Buildings well advanced. The big Justice Precinct is a massive whole block development which is progressing well and is due for completion in 2017. It’s time to go for a walk around our new CBD to see the rebirth of our central city.

he recent tragic events in Paris may well give international travellers pause for thought and steer them towards generally safer shores. New Zealand tourism is going gangbusters and is picked as one of the major growth areas of our economy – and the good news is that Christchurch is gradually getting back onto the map. As we enter summer it’s fantastic to see so many more activities, bars, restaurants and accommodation providers ready for summer. Despite accommodation still not at preearthquake levels, there are many positive things happening in our local tourism sector. The Spark Bikes share system has now had over 1000 rides since launching in August. Mainly aimed at CBD visitors, tourists familiar with the concept in other countries will no doubt use them to get around our city. Our Convention Centre may be not ready until 2018 but that won’t stop 15,000 international participants at the Festival of Golden Oldies in Christchurch that year. Other conferences, festivals and events continue to be planned and confirmed. New, improved and adapted tourism experiences have come out of the earthquakes. How many locals have been on Red Bus’ Rebuild Tour or visited a pre earthquake attraction to see how they’ve changed or interpreted and acknowledged the earthquakes? Punting on the Avon, dining in the Restaurant Tram or winding through the Gondola’s Time Tunnel aren’t the same as they were five years ago. Inherent in New Zealand’s adventure tourism attractions is the potential for risk. Years of hard won plaudits can be wiped out in a tragedy. Reputations can be damaged so quickly, even more so with the speed of social media. Key factors in managing reputational damage are planning and preparation. Internal and external communication are key. Tourism operators will do well to ensure that they are ready.

s we near the fifth year anniversary of the February Earthquakes, there is a sense that our city’s recovery is moving into a new phase. It isn’t just about rebuilding what was lost, but about looking forward to how our city will look in 30, 50, 100 years’ time. The work we are doing now will determine what it’s like for our children and grand-children to live in Christchurch in the future. This puts our city at the forefront of the discussion about the future of urban living in New Zealand. No other city in the developed world has the opportunity to reshape itself that we do now. Building great cities is going to be one of the big art forms of the 21st century our challenge is to deliver an outstanding quality of life in a city that is changing in ways none of us could have predicted before the earthquakes. That means housing, transport, and built environments that promote quality of life. We should be aiming for high quality homes that people can afford to own and are fit to face the environmental challenges of the 21st century. This means being in close walking distance to jobs, cafés, entertainment and greenspace. We should be making sure we are doing everything possible to revitalise our central city so that we don’t become a city of disconnected suburban islands. And, as we deal with the ongoing frustrations around traffic and road repairs, it’s a reminder of the importance of high quality public transport to decrease the congestion on our roads. We don’t want Christchurch to become a city like Auckland – where spending hours trapped in gridlock is just an accepted part of life. That’s why Andrew Little’s proposal for passenger rail in Canterbury is so exciting – it’s a proposal whose time has come. Taken together, these ideas would give us the opportunity to build something lasting and meaningful out of the mess of the last few years.

ast month, the Parliamentary Environment Commissioner, Dr Jan Wright released her national report on coastal hazards. It made for grim reading and, unsurprisingly, some cities are in for a harder time than others if we do nothing to stop rising sea levels. Unfortunately for us, Christchurch will not fare well if things keep going the way they are. The report warns that low-lying areas, those less than 1.5 metres above the spring high tide mark, are most at risk as the sea-levels rise. In Christchurch this means about 10,000 homes and 200 kms of road. With warnings like “slowly unfolding red-zone”, our Government needs to step up and take notice. Our cities can manage this, our communities can manage this, but to do it well will require help from Government. The report highlights the need for various agencies to work together to tackle this problem. Dr Wright made recommendations to the Minister of Environment, Minister of Conservation and the Finance Minister. The recommendations looked at the role both central and local government can take in planning for the future. The National Government have been slow to act by all accounts. Back in 2010, the Green Party called for a National Policy Statement under the Resource Management Act which would provide clear and consistent policy directions for local councils responding to sea-level rise. Doing nothing will not help anyone. National is weak on taking action to stop climate change and they are even shirking leadership in preparing for the impacts of climate change. Being complacent of the effects of sea-level rise is not going to help the people or the communities of Christchurch. We need to act sooner rather than later.

Protecting vulnerable workers from financial exploitation

I

ntroducing Ruth Burgess, Lexington Legal’ ‘pro bono’ and newest solicitor

Every issue Canterbury Build magazine will bring you up to date legal advice, with some of the city's leading specialist law firms providing information on a wide variety of issues of importance to both business owners and consumers.

I met Paul Brown of Lexington Legal in Hanmer at the Hope Conference – advertised as “the best place to learn about human trafficking, exploitation and slavery from leading NZ experts”. I put my hand up and offered to help and now I find myself heading the firm’s pro-bono work… and I am busy. For example take the recent issue of some Filipino farm workers getting work visas using false documentation. Currently this is being investigated by Immigration New Zealand (INZ), who have placed some workers reapplying for visas on interim visitor visas. This is particularly harsh on those workers who have finished one contract and were about to start work for a new employer. Those workers cannot [legally] start work until their status is decided; they are not eligible for WINZ benefits, and they are reliant on their friends’ goodwill for support. Both guilty and innocent are punished. An arrest has been made and I look forward to all the details coming out. In the Philippines workers go to a recruitment agency to get a job overseas. Some – but not all – recruitment agencies charge a fee of around one months’ [NZ] salary. Many workers can’t pay this so they borrow the money, often at huge interest rates, in the belief all will be well once they are earning ‘the big money’ overseas. Once in NZ some workers find the cost of living far higher than expected, their income lower and a huge debt back in the Philippines. This isn’t slavery, but it is financial exploitation of vulnerable workers. I am happy to do this work on a voluntary basis, but Lexington Legal has set up a Givealittle page to try and cover – or recover – some of the costs of doing this work. The Construction Contracts Amendment Act 2015

F

rom 1 December 2015, the rst of a number of major changes to the Construction Contracts Act 2002 (the Act) will come into force. These amendments, in conjunction with the changes to the Building Act 2004 which took effect from 1 January of this year, signicantly impact how construction work is managed and undertaken at a macro level, from the pre-contract stage through to the expiry of the defects liability period. Currently, only disputes concerning payment under a construction contract can be referred to adjudication under the Act. The adjudicator’s determinations are then enforceable by the courts. However for any construction contract entered into from 1 December 2015, the distinction between enforcing determinations relating to payment, and settling disputes relating to the parties’ rights and obligations, is removed. This means that disputes which typically arise between parties to a construction contract, such as suspending or terminating work for breach, variation disputes, defective work and obligations to rectify, and other breaches, will all fall within an adjudicator’s jurisdiction. The objective of the adjudication process under the Act, with its abbreviated timeframes for responding to a claim, supports the Act’s overarching intent, namely, to facilitate regular and timely payment between parties to construction contracts and resolve disputes that do arise in a “speedy” way. In the context of payment disputes, this mechanism has been fairly successful. A real concern with the forthcoming amendment is that the Act does not provide a longer timeframe than the current 5 working days for a recipient of a claim to “respond” to the claiming party. Construction disputes, particularly those about “rights and obligations” can often be complex, sometimes needing the involvement of multiple parties and experts. Inherent technicalities of construction work, multi-contract relationships, the existence of contractors, suppliers, and principals, all have an impact on how one responds to a dispute. While the amendments allow an adjudicator to grant extra time for reply and determination (as a means to avoid “ambush” claims), it is uncertain how often, or how long, an extension will be granted in such circumstances. The second round of amendments which come into force on 1 September 2016 extend the scope of the Act to apply to design, engineering, and quantity survey work. So professional consultants within these sectors will fall within the jurisdiction of the Act’s adjudication process. Difculties with professional indemnity insurance response, and obtaining independent expert opinion before ling a response are even more pronounced here. The question has to be asked: is the Act’s adjudication process geared up for the new complexities involved, and how will the construction sector respond?

Massive award-winning HNZ repair MISSION ACCOMPLISHED. Housing New Zealand’s programme to repair and make improvements to 5000 of its earthquake damaged homes across greater Christchurch has been achieved ahead of time. It has also collected some serious recognition for its efforts too

T

he Canterbury Earthquake Recovery Programme (CERP), formed by Housing New Zealand after the Canterbury earthquakes was charged with restoring its housing stock back to pre-earthquake levels. This involved building up to 700 new homes and repairing up to 5000 homes. The programme of building new homes continues at pace with more than 300 completed and hundreds more either under construction or contracted to be built. The repairs however, passed the 5000 target last month – a monumental achievement. CERP acting general manager Andrew Booker said he was thrilled about that result because it meant thousands of tenants were now living in repaired and improved homes throughout greater Christchurch.

The repairs programme has involved minor repairs but also major repairs to many Housing New Zealand properties throughout greater Christchurch.

Accolades and awards Tenants are not the only ones impressed with Housing New Zealand recently receiving numerous accolades and awards from the social housing sector. The Australasian Housing Institute (AHI), at its national awards event in Wellington in late October, awarded CERP the overall award for Excellence in Social Housing. The awards formally recognise excellence in professional practice and highlighting the difference that social housing professionals make to people’s lives. The programme to recycle and restore damaged homes from the red zone – run in partnership with the Department of Corrections at Rolleston Prison – scooped the team award for Leading Asset Management. A week later, at the AHI Australasian awards in Perth, CERP was again in the

spotlight, winning the overall Excellence in Social Housing award against a top quality field of finalists. Mr Booker says this recognition is fantastic because the programme was a major team effort with many moving parts. “To have the industry recognise the work that gone into the Canterbury Earthquake Recovery Programme is really satisfying. A lot of people have worked really hard to make this programme a success.’’ Housing New Zealand chief executive Glen Sowry is also delighted with CERP’s well-deserved success. “We are immensely proud of the team and contractors involved across the programme, from planning and design through to tenancy liaison, building and repairing, quality assurance and the all-important health and safety.’’

As well as this, there has been an opportunity in some cases to install new floor coverings, ventilation, heating, insulation and other upgrades as part of the repair programmes. Mr Booker says Housing New Zealand has completed a major part of the Canterbury recovery in very quick time which was testament to the goodwill of tenants and the staff’s management of the programme. Reaching the 5000 target ahead of the December 2015 deadline is very satisfying. “It has been a large scale programme but I’m really proud of how everyone involved has pulled together and worked extremely well to get there,’’ he says. Late last month, Hon Bill English, the Minister Responsible for Housing New Zealand, visited Christchurch to formally congratulate Housing New Zealand on reaching its 5000 target.

Great results for tenants Mr Booker says the most pleasing part of the programme’s success is that it has benefitted thousands of Housing New Zealand tenants throughout Christchurch and he believes their support and co-operation throughout the programme has been a critical factor in its success. Tenants worked closely with Tenancy Liaison staff who helped them when they needed to move out of their homes for repairs and other work. The staff helped provide storage, worked closely with tenants and their families to ensure they were housed in the appropriate area, co-ordinated other support services when needed and generally acted as the go-to person before, during and after the repairs. This ensured they were moved back into their repaired property as smoothly as possible. Every effort was taken to minimise disruption as much as possible for tenants during repairs which can be inconvenient and stressful. Feedback from tenants clearly showed this well managed approach is not only appreciated but made the entire repairs process as easy as possible. Repairs were organised on a suburb by suburb basis and, in many cases, a street-by-street basis as much as possible to make it easier for both contractors and tenants.
